“Deluded And Dysfunctional, The Republicans Have Lost The Plot”: They’ve Run Out Of People To Blame For Not Compromising

Recently, in an effort to embarrass Republicans pandering to their scientifically challenged base, Senate Democrats proposed a series of votes on climate change. While most Americans and the overwhelming majority of scientists believe climate change is real and people are the primary cause of it, Republican voters are evenly divided on whether it exists at all, and reject the idea that we are responsible.

One amendment, by the Democratic senator Brian Schatz, stated simply that climate change is real and human activity significantly contributes to it. Republican senator John Hoeven offered a compromise: take the word “significantly” out. When asked why, he said: “It was about finding that balance that would bring bipartisan support to the bill.”

Reaching across the aisle in search of compromise and consensus is the professed goal of almost every candidate for public office in the US, particularly in recent times, when presidents have come to personify not unity but division. Over the past six decades, the 10 most polarising years in terms of presidential approval have been under either George W Bush or Barack Obama.

As a means, bipartisanship is, of course, an admirable goal: the more politicians are able to work together, put the interests of their constituents first and get things done, the better. The grandstanding, bickering and procedural one-upmanship that characterises so much of what passes for politics is one of the things that makes electorates cynical and drives down voter turnout.

But as an end in itself, bipartisanship is at best shallow and at worst corrosive. For it entirely depends what parties are joining together to do. This is particularly true in America, where constituencies are openly gerrymandered, both parties are funded by big money, and legislation is often written by corporate lobbyists.

Bipartisan efforts over the past couple of decades have produced the Iraq war, the deregulation of the financial industry, the bank bailout made necessary by that deregulation, the slashing of welfare to the poor, and an exponential increase in incarceration. As the hapless Steve Martin says to his hopeless travel companion, John Candy, in Planes, Trains and Automobiles: “You know, I was thinking, when we put our heads together … we’ve really gotten nowhere.”

Comity in the polity is overrated and should certainly not be mistaken for what is right or even popular. And even if it wasn’t overrated, bipartisanship is not always possible. Half of Republicans still believe the US did find weapons of mass destruction in Iraq, over half believe climate change is a hoax, and almost half do not believe in evolution. There is a limit to how much agreement you can reach with people with whom you disagree on fundamental matters of fact, let alone principle.

But if the parties cannot work together, they are at least supposed to work separately. What has become evident since Republican victories in November’s midterm elections, which delivered them both houses of Congress, is that they don’t just have a problem compromising with Democrats – they cannot even compromise with each other. For the past four years they have revelled in their dysfunctionality, using Obama as a foil. Apparently unaware that brinkmanship is supposed to take you to the edge, not over it, they have shut down the government and almost forced the nation to default on its debts through a series a spectacular temper tantrums.

As the Republican congressman Marlin Stutzman pointed out in a particularly candid moment 18 months ago, when Republican obduracy caused a government shutdown, “We have to get something out of this. And I don’t know what that even is.”

These hissy fits have invariably been aimed at forcing Obama to undo the very things he pledged to do if elected, and to which Republicans have no plausible, coherent response: during his first term that was Obamacare; now it is immigration reform. Opposition, in short, had become not a temporary electoral state but a permanent ideological mindset in which their role was not to produce workable ideas but to resist them.

When they won the Senate as well as the House, they were supposed to work together to produce Republican legislation that Obama would be forced to veto, definitively exposing the real source of the gridlock. In fact, they are simply imploding under the weight of their own obstinacy. They’ve run out of people to blame for not compromising with them. So now they’re blaming each other.

“The Republicans are like Fido when he finally catches the car,” the Democratic senator Charles Schumer told the New York Times. “Now they don’t have any clue about what to do. They are realising that being in the majority is both less fun and more difficult than they thought.”

Their current internal feud was prompted by Obama’s executive order for modest immigration reform, which was enacted last November. It aims to prevent the deportation of up to 5 million undocumented immigrants living in the US, provide many with work permits, and shift the focus of immigration control to deportations of convicted criminals and recent arrivals.

The Republican-controlled House, where funding bills must originate and legislation can be passed by a simple majority, has voted for a Department of Homeland Security (DHS) bill that would eviscerate Obama’s reforms. But to get the bill through the 100-seat Senate they need 60 votes. Senate Republicans have only 54 seats and Democrats, who are unanimously opposed to the bill, keep filibustering it.

In a functional party the Republican Speaker, John Boehner, would work out what changes he could make to the bill to give the Republican Senate majority leader, Mitch McConnell, a fighting chance of getting the requisite majority to pass legislation they could both take credit for. Instead, Boehner has offered McConnell not compromise but commiserations. “He’s got a tough job over there; I’ve got a tough job over here. God bless him, and good luck.”

The House has sent the same bill to the Senate twice. The Senate has failed to pass it several times. In effect, they’ve treated the Republican-controlled Senate no differently to how they treated its Democratic predecessor, with similar results. Reflexively, House Republicans have their bottom lip extended and at the ready. “We sent them a bill,” representative Michael Burgess told Politico, “and they need to pass it. They need to pass our bill.” A tantrum is not far off. “Politically, [McConnell] needs to make a lot of noise,” says representative John Carter.

Senate Republicans, meanwhile, roll their eyes, count to 10 and wait patiently for the noise to give way to reason. “We can go through the motions, sure, but I don’t think we’re fooling anybody,” said Republican senator Jeff Flake about the prospect of another doomed vote. “Because we need [Democratic] support to get on the bill.”

If they don’t find a solution by 27 February, then the DHS will be shut down and Obama won’t have had a thing to do with it. The true source of the gridlock over the past six years will be clearer than ever. The emperor will be out there, twerking, in the buff.

“It’s not an issue of commitment, it’s a matter of math,” said the Republican senator John McCain – perhaps failing to realise that math, like science, is no competition for blind faith and bad politics.

“A Juvenile GOP”: If The Party’s Aim Is To Show Americans It Is Ready To Govern, We Are Witnessing An Epic Fail

Bang. Bang. Crash. That was the sound of the Republican majority in Congress shooting itself in both feet, then tripping over them.

At a moment of heightened concern that terrorists in the Middle East might stage or inspire attacks on U.S. soil, the GOP-controlled House and Senate are unable to agree on a bill to fund the Department of Homeland Security. If the party’s aim is to show Americans it is ready to govern, we are witnessing an epic fail.

Rather than ensure the smooth operation of the agency charged with keeping the nation safe, Republicans would rather argue about a separate issue — immigration — and struggle over tactics for tilting at windmills. Meanwhile, a Feb. 27 deadline for passing an appropriations bill draws near. “I don’t believe we should shut down the Department of Homeland Security, given the threats that are obviously out there and the attacks on America,” Sen. John McCain (R-Ariz.) said Wednesday. But too few in his party are listening.

The problem is that Republican conservatives want to use the Homeland Security funding bill to reverse President Obama’s executive actions allowing millions of undocumented immigrants to stay without fear of deportation. A measure stripping out money to fund Obama’s initiatives easily passed the House, with its massive GOP majority and streamlined procedural rules. But the Senate is a different story.

It was obvious from the beginning that Majority Leader Mitch McConnell (R-Ky.) did not have the 60 votes needed to get the bill through the Senate. Nevertheless, McConnell has dutifully brought the bill up three times — and seen it rejected each time by Democrats, who quite reasonably demand a clean funding bill with no extraneous bells or whistles.

“Isn’t that the definition of insanity? Voting for the same bill over and over again?” McCain asked.

Indeed, the whole episode does seem pretty insane. House Speaker John Boehner (R-Ohio) knew the bill he sent to the Senate would be dead on arrival. McConnell knew he didn’t have the votes to pass it. And both leaders knew that if the legislation somehow made it through — perhaps when Democrats weren’t looking, or through divine intervention — there was no way Obama would ever sign it into law.

Boehner and McConnell appear to be trying to teach House Republicans a lesson in basic arithmetic. The class, however, is busy throwing spitballs.

The GOP majority in the House continues to value symbolic posturing over pragmatic action. Is this too sweeping a statement? Not if you consider what House Republicans were doing this week instead of working on a Homeland Security bill that might actually pass: Voting for the 56th time to repeal the Affordable Care Act, knowing full well that this attempt, like the previous 55, had no earthly chance of success.

GOP freshmen wanted to have their votes recorded in obeisance to what has become a Republican article of faith: Obamacare is evil incarnate. If I stipulate that the whole universe gets the message, would you guys please stop pretending that Obama is ever going to sign legislation abolishing the landmark health-care program that bears his name ?

Let’s see, what else have Republicans achieved since taking control of both chambers? Well, the House tried to pass a bill banning abortion after 20 weeks of pregnancy but had to pull the legislation at the last minute over a requirement that rape victims report their assault to police before qualifying for an exemption. Republicans did manage to pass a bill authorizing the building of the Keystone XL pipeline, but Obama promises a veto and the GOP doesn’t have the votes to override him.

If this is the pattern, it’s going to be a long couple of years.

Let me suggest a different approach. First, Republicans must cross a big hurdle: acknowledging that with Democrats able to block legislation in the Senate and Obama still resident in the White House, passing legislation will require compromise. Once you get beyond that, the rest is easy.

No, you can’t repeal Obamacare, but you might be able to make it work better for your constituents. No, you can’t undo Obama’s immigration actions without passing legislation that the Senate and the president find acceptable. No, you can’t hijack funding for a crucial government agency without suffering political damage — and ultimately folding because you don’t have the cards.

The GOP apparently hopes the display of juvenile behavior we’re witnessing will inspire voters to give the party even more power in 2016 by electing a Republican president. Good luck with that.

“Drag-Racing Off A Political Cliff”: Republicans Attack Immigrants While Putting America In Danger

The House of Representatives’ Department of Homeland Security (DHS) funding bill, which is really a law seeking the mass deportations of undocumented people, including children, died on the Senate floor, victim of arithmetic certainty.

Mathematical reality seems to be a challenge to the GOP House majority. While most Americans have heard about the 60-vote rule in the U.S. Senate that impacts most legislation — the cloture/filibuster, as it is commonly known — House Republicans insist in passing bills that cannot make that threshold, and are subsequently dismayed that their legislation dies an ignominious death.

Yet once again, and this would now seem to be par for the course for Speaker John Boehner’s (R-Ohio) House, Republicans have passed a bill that, with zero support of Senate Democrats, failed to meet the basic 60-vote threshold — three times.

It has been clear for some time that Democrats will not support the liquidation of President Obama’s executive actions on immigration. Moreover, should such a bill pass by some deus ex machina event, the president would veto it.

So why insist on passing a bill that cannot become law? One must assume that the potency of a quixotic quest to achieve the impossible is irresistible to many members of the Republican caucus in the House. Majority Whip Steve Scalise (R-La.) seemed to insist that two plus two does not equal four when he told The Hill that “There’s not a Plan B, because this is the plan.”

In other words, after the mass deportation bill crashed and burned in the Senate, the House has no other plan, no other path forward to fund America’s shield from terrorism, Homeland Security.

Showing the triumph of ideology over logic, The Hill further reports that Rep. John Fleming (R-La.) said before the Senate vote that: “[M]any of us agree that we should stand behind the one bill that we sent over there. Most of us feel that way. … Anything less than that, we’re not going to get any better result anyway. So why not just go for what’s really right?”

Of course, the obvious “better result” would be not to put America’s security at risk, and instead pass a clean DHS funding bill that would keep the nation safe. Immigration can always be tackled as a separate issue by the Republican-controlled Congress.

In fact, Rep. Jeff Denham (R-Calif.) recently told me on my radio show that the House leadership has given immigration-reform Republicans encouragement to develop a set of sweeping immigration reform bills. So at least in the pro-arithmetic wing of the Republican Caucus, there is a reality-based path forward to deal with immigration without the perennial government shutdown threat — implicit in Scalise’s “not a Plan B” comment — that has become Republicans’ go-to tactic for forcing through their agenda when they fail to muster the votes necessary to pass legislation in both chambers.

It would be refreshing to see the big House Republican majority have as much passion for governing as they do for deportation. As Americans look at our society, polling clearly suggests that bread-and-butter issues dominate the agenda of the people. The economy, of course, and education, healthcare and the sense of economic insecurity that hangs like a shadow over most American families are the issues that should be tackled by a giant majority with ambitions to govern for more than two years.

I have yet to see one poll in which Americans rank mass deportations of undocumented immigrants as a top priority. Moreover, it’s hard to imagine that Americans favor such deportations over the continued funding and smooth operation of the country’s principal anti-terrorist agency, DHS.

Ironically, the party that has claimed the mantle of being the true fighters against a global jihadist threat is willing to drag-race off a political cliff to deport people rather than fund Homeland Security.

This is a choice that has both practical and symbolic resonance. The practical impact is obvious: Even one day, contrary to Rep. Mario Diaz-Balart’s (R-Fla.) jaunty declaration otherwise, when DHS is not funded is one day too many. Republicans willfully weakening America’s national security would be irresponsible, bordering on seditious.

And the political and symbolic effects would also be notable. Will Americans easily forget that Republicans bet with their safety, indeed the safety of the nation, for the unachievable policy goals of deporting millions of people?

Perhaps we’re seeing here the inherent weakness of a Republican majority so divided among ideologies and passions that it is literally incapable of governing for the benefit of the nation.

At the very least, we are witness to the fact that even GOP leaders such as Rep. Scalise are a little weak on the universal truths of basic arithmetic.

“Foot-Dragging Tedium Can Become Dangerous”: Senate Republicans Are Already Frustrated With John Boehner’s Crazy Caucus

There’s an any-port-in-a-storm quality to Speaker John Boehner’s piloting of the House, and nothing illustrates that better than Republican squabbling over whether and how to fund the Department of Homeland Security.

Why is the Department of Homeland Security about to run out of money? Because back in December, conservatives wanted to use a government funding deadline to pick a big fight with President Obama over his deportation relief policies, and rather than risk a shutdown, or wrest the till back from the hardliners, GOP leaders decided to give them whatever they could cobble together. What they came up with was a harebrained scheme to fund all government operations except for Homeland Security through the end of the fiscal year. Meanwhile, they extended DHS funding through February only, and promised to fight Obama’s deferred action programs in the context of a narrower threat to shut down the department that enforces immigration policy.

The problems with this strategy were obvious from the outset. As I observed at the time, denying DHS an appropriation wouldn’t freeze Obama’s deportation programs, because the agency implementing them is self-financing. In fact, denying DHS an appropriation wouldn’t accomplish very much at all; as a national security hub, most of its functions are considered essential, and thus exempt from the kinds of closure protocols that apply to national parks and Social Security administrative offices.

The upshot is that Republicans are threatening to infuriate DHS employees and their allies, weaken DHS functionality, and, in a losing p.r. campaign, surrender the mantle of national security back to Democratsall unless Obama agrees to rescind his own executive actions. As muggings go, this isn’t much different than screaming, “Your money or my life!” No less an immigration hardliner than Representative Steve King understands that the plan has always amounted to capitulation.

But having promised a brawl, Boehner must now go through the motions, which look more and more contrived as prominent Republicansparticularly in the Senatestep in to admit that they will fund DHS, come what may.

This week, John Cornyn, the number two Senate Republican, told CNN “we’re not going to take any chances with the homeland.” Cornyn is showing his cards here, but he’s also putting the House’s strategy up for ridicule. Because House Republicans must proceed as promised, Cornyn et al must now pledge not to incur the mostly-imagined risk that his House counterparts are supposedly inviting. When Republicans let appropriations lapse in 2013, and DHS was just one of the many agencies ensnared in the shutdown, domestic security wasn’t the core political concern. By centering the fight around DHS alone, though, conservatives have left themselves no choice but to swallow Democratic demagoguerytheir strategy is premised on the notion that Obama will relent when the threat to national security becomes too great. There are no national park closures to obscure the fact that the fight is over something called the Department of Homeland Security, and you gain no leverage by threatening to withhold funds from DHS, if you admit that withholding funds from DHS doesn’t really accomplish much.

Senate Republicans have other political concerns as well.

Dean Heller, a Republican senator from Nevada, worries that forcing a fight with Obama over immigration policy, in the context of an appropriation, invites the risk that certain members lapse into referring to affected immigrants “in a way that is offensive.” Mark Kirk of Illinoisa vulnerable incumbentbelieves any “government shutdown scenario” would be “a self-inflicted political wound for Republicans.”

Where Senate Republicans would like to avoid deadline-driven fights altogether, Boehner promises to drag them into those fights at the behest of conservatives, even when he knows he can’t win. His inability to admit the obvious, while Republican senators feel unencumbered, reflects the dramatically different pressures a House speaker and a Senate majority leader face. The strategic rift thus isn’t limited to DHS, but will emerge any time Senate Republicans see political dividends in a compromise that House hardliners won’t accept.

To avoid an embarrassing, damaging lapse in highway funding, for instance, senate Republicans, including Orrin Hatch, who helms the tax writing committee, are warming to the idea of replenishing the highway trust fund by increasing the gas tax. Collapsing gas prices have made the prospect of a higher gas tax less punitive, and lent an obvious idea bipartisan support.

Naturally, Boehner can’t accept this.

At least not yet. The logic of a higher gas tax might become more appealing to him as the funding deadline nears, just as we assume the logic of extending DHS funding cleanly will overwhelm him before too long. As a template for addressing pressing national business, taking symbolic stands like these is more tedious than dangerous. But foot-dragging tedium can become dangerous when the pressing business is increasing the debt limit or responding to unanticipated crises.

“Who’s Afraid Of Ted Cruz And Ken Cuccinelli?”: No Republican Is Conservative Enough To Avoid A Primary

Senator Ted Cruz’s (R-TX) plan to fight President Barack Obama’s executive action on immigration reform during the debate over the $1.1 trillion “cromnibus” spending bill didn’t go very well. Cruz raised a point of order against the bill, arguing that the portion funding the Department of Homeland Security is unconstitutional due to the president’s action. But Cruz’s move enraged his fellow Senate Republicans, unwittingly allowed Democrats to confirm some two-dozen Obama administration nominees who otherwise would not have gotten votes, and totally failed to stop the president. The measure was voted down 74-22, with 20 Republicans joining the Democratic majority to rebuke the Texas freshman.

Although Cruz reportedly apologized to his colleagues, the episode isn’t finished yet. Cruz evidently has a plan to get revenge against those who opposed him — with a little help from his friends.

In comments to Politico on Tuesday, Senate Conservatives Fund president Ken Cuccinelli suggested that his group — with which Cruz has a close association — will target the senators who voted against him in the coming elections.

“People’s votes may by themselves inspire folks to say: ‘I’m running against this guy or this girl,’” Cuccinelli warned. “I have a funny feeling that some people who weren’t thinking of running two weeks ago are thinking of running now.”

So will the seven senators on the ballot in 2016 who opposed Cruz — Kelly Ayotte (R-NH), Dan Coates (R-IN), Ron Johnson (R-WI), Mark Kirk (R-IL), John McCain (R-AZ), Lisa Murkowski (R-AK), and Pat Toomey (R-PA) — lose their jobs for opposing the Tea Party hero?

Probably not. Under closer examination, Cuccinelli’s threat rings rather hollow.

As right-wing groups have repeatedly proven, no Republican is conservative enough to avoid a primary. No single vote would have been enough to prevent 2014 challenges to Senators Mike Enzi (R-WY), Pat Roberts (R-KS), or John Cornyn (R-TX) — the 2nd, 8th, and 13th most conservative members of the Senate, according to National Journal’s 2014 rankings — and helping Ted Cruz try to blow up a government spending bill would not have saved supposed RINOs like John McCain or Kelly Ayotte from drawing right-wing opponents.

Additionally, it’s not clear that incumbents should actually fear a challenge from the Senate Conservatives Fund. In 2014, the group backed three candidates challenging Republican incumbents: Matt Bevin in Kentucky, Chris McDaniel in Mississippi, and Milton Wolf in Kansas. All three bombed in spectacular fashion.

“Our members know that our candidates are underdogs,” an SCF spokeswoman told The Washington Post in October, in an effort to defend the group’s performance. “The establishment has a lot more money and is willing to smear conservative candidates with false attacks. But they still want us to keep fighting because otherwise we wouldn’t have people like Ted Cruz, Mike Lee, and Rand Paul in the Senate today.”

That’s true. But it’s also a perfect explanation of why Republican senators have no reason to fear standing against Ted Cruz.

It’s entirely possible that some of the senators who opposed Cruz’s point of order will fall in 2016. But it’s extremely unlikely that last weekend’s vote will be the incident that doomed them.
