“Documenting Police Killings”: Wide Discrepancies In Rate Of Police Killings Among Major Metropolitan Police Departments

One of the sources of confusion arising during recent controversies over police killings in Missouri and in New York has been the lack of good and consistent data on similar incidents. Congress just passed legislation to revive a lapsed 2000-2006 data collection law, but as veteran journalist Blake Fleetwood notes in a web-exclusive piece for Ten Miles Square today, the earlier law wasn’t enforced. As a result we know less than we should about police killings and such closely related issues as the risk to police of being themselves killed by lethal force in the line of duty. But by piecing together available data, Fleetwood does reach some tentative conclusions well worth testing with fresh data.

A Washington Monthly analysis of police homicides found wide discrepancies in the rate of police killings among major metropolitan police departments, when measured against population figures.

Contrary to popular belief, New York City—-with a police homicide rate of 1 in 123,529 citizens—-ranks near the top (best, least people killed) of large cities in the U.S. The NYPD killed 68 people from 2007 – 2012 out of a population of 8.4 million.

In Miami-Dade County, in a population of 2.5 million, (less than a third of the people living in NYC) police killed 68 citizens during that same five-year period. This means that citizens of Miami are 3.5 times more likely to killed by their local policeman than their counterparts in New York City.

An amalgamated review of police shooting data from the FBI, the Centers for Disease Control and Prevention (CDC) and figures from 105 major police departments (obtained by the Wall Street Journal) —- when overlaid with population figures —- revealed that the Los Angeles Police Department killed 111 citizens during this period in a population of 3.8 million, which works out to one police homicide per 21,229 persons. This indicates that the average citizen’s chance of being killed by a policeman is nearly six times greater in Los Angeles than in New York City.

Fleetwood esttimates that the total number of police killings from 2007-2012 probably exceeded three thousand. Probably half or more of those killed did not have firearms. Moreover, while no one wants to expose police officers to undue risk, some facts remain that contradict the impression that it’s open season on the police:

In five years, 2008 to 2012, only one policeman was killed by a firearm in the line of duty in New York City. Police officers are many times more likely to commit suicide than to be killed by a criminal. Eight NYC policemen took their own lives in 2012, alone.

Comparatively, a fisherman is 10 times more likely to be killed on the job than a police officer, according to national figures from the Bureau of Labor Statistics. A logging worker is eight times more likely than a police officer to die on the job, and a garbage man is three times more likely to die while working.

Most policemen killed on the job die in auto accidents, according to FBI statistics.

What can be done to reduce the number of police killings without making the lives of officers more dangerous? Fleetwood points to better training of a sort that used to be available not that long ago:

Twenty years ago Bill Clinton funded the Police Corps, whose mission was to train elite policemen with physical and mental conditioning very much like the training of the Seals and Green Berets. The recruits spent a year role-playing through every possible situation. The Police Corps produced 1,000 of the best trained and most professional policeman in the country.

But it was expensive, and, according to Joe Klein, it was killed by George W. Bush.

If the United States had better trained, more professional police, we certainly would not have so many police homicides, which are tearing apart the social fabric of our country.

“Be The Smarter Bush Brother, Jeb; Don’t Run!”: Why Would A Guy Running For President Create A Brand Spanking New Bain Capital?

So Jeb is running. Or is he? And he’s really formidable! Or… is he?

I can’t remember in my adult lifetime a presidential candidate quite like Jeb Bush. Every presidential election we have our A-list candidates, your Clintons and your Romneys and your Humphreys and indeed your Bushes. And, every election, we have our quasi-comic-relief candidates, your Al Haigs and Gary Bauers and Bill Richardsons. These archetypes usually reside in separate life forms. But in John Ellis Bush, they exist in the same body.

The A-list case is: He’s a Bush. And… and… OK, he was the governor of a huge and electorally important state. And largely considered to have been, to those who can still remember, a successful and reasonably popular one. And there’s his Latina wife. But really, the A-list case comes down to the fact of his last name. Just as a football coach named Lombardi is going to win automatic positive “free media” until he turns out to be a total loser, a politician named Bush is going to be assumed to be a serious playah until he undeniably proves otherwise. Until then, establishment money is going to cascade to him.

The quasi-comic-relief case consists of a much longer list. First of all: Well, he’s a Bush. That is to say, while the name confers a certain status among insiders and the media, at the same time it reminds too many voters of the brother. This would be an obvious problem in a general election, but I think even in a primary. The Republican red-hots, the pols who play to the base that dominates the primary process, have been ranting against Dubya and his big-spending ways since the day he left office. There’s no reason to think the family tree will bring much good will.

The bigger thing is this. What in the world is a guy who wants to run for president doing, precisely during the months of presidential speculation, starting up an offshore private-equity firm? But Bush has done exactly that, filing the papers for BH Global Aviation with the SEC right around Thanksgiving. The fund raised $61 million in September, largely from foreign investors, and it incorporated in the U.K. and Wales to avoid paying American taxes. Business questions are raised—who starts a PE firm and bails on it in a matter of mere months?—but more salient are the political questions: Why would a candidate, on the eve of a presidential run, go out of his way to create what is in effect his very own brand spanking new Bain Capital?

Then there’s the service gap. He hasn’t been in office since January 2007, and more to the point hasn’t run a campaign since 2002. To find a presidential candidate with as long a gap between campaigns (excluding those like Eisenhower, who’d never run), you have to reach back to James Buchanan. Questions of rust will arise, of course, but more than that, we can fairly wonder whether he has a feel for the politico-culture landscape these days. The conservative movement of today is a rather fiercer creature than the one his brother held at bay with a few Scriptural dog whistles.

Here’s more, in terms of problems he’ll have with the base: He’s on the board of Bloomberg Philanthropies. Come have a look at the “our work” page at the philanthropy’s website: Beyond Coal. Vibrant Oceans. Reproductive Health. Tobacco Control. No, no guns per se, but of course Mike Bloomberg is so identified in the right-wing mind with the torching of the Second Amendment that that one will undoubtedly come up.

Beyond this there’s the pro-immigration position. Rush Limbaugh has been laying into Bush on this one. There is such a thing in presidential primary politics as a single-issue deal-breaker. Ask Rudy Giuliani about how his pro-choice position worked out for him. And Jeb, of course, will also have to deal with his outspoken support for Common Core, which the Republican base loathes.

The polls? He runs a little bit ahead of the competition, with 14 percent in the current RCP average to Chris Christie and Mike Huckabee’s 10 and Paul Ryan’s 9.7 (and Ben Carson’s 8.8)! And with regard to taking on Hillary Clinton, he does no better than any of the rest of them. He’s 5 to 10 points behind her in just about every poll. That just is not the traditional idea of the frontrunner.

Throw it all into the kettle and, what? Well, it’s possible to imagine Bush as the nominee and even as the next president. To return to the Lombardi analogy, one would always imagine that a Lombardi would have it in him to find a way to win. So it is with a Bush. They are two-for-two, after all.

But maybe that’s just a psychological mirage. Maybe it’s just as easy, if not easier, to imagine him lasting four primaries. Here’s your 2016 GOP presidential primary calendar, at least as it currently exists. It starts as usual with Iowa and New Hampshire, which seem respectively more like Huckabee/Cruz and Ryan/Paul states than Bush states. Florida doesn’t come along until March 1. Has anyone ever—or since 1976, when we really started having lots of primaries and caucuses—won a party nomination without winning a primary or caucus until March? I don’t think that can be done.

And it might be easiest of all imagining him “exploring” a candidacy for a while and then deciding the hell with it. As has been oft-observed, he doesn’t seem to want to be president, and by most accounts his wife has never been hot on the idea. It used to be frequently said back in 2000 that Jeb was “the smart brother.” Given the tribulations that await him on the hustings versus the easy millions that dangle before him in the global aviation business, the choice that would prove he’s the smart one seems pretty clear.

“Whose Values Did The Torture Program Uphold?”: We Can Press For Those Responsible To Be Held Accountable

Who are we?

That’s one question begged by the Senate Intelligence Committee report on the CIA’s torture of detainees after Sept. 11. There are other questions, but this may be the key one. And it is getting harder to answer.

“That’s not who we are,” President Barack Obama declared of the abusive pressure tactics used by American interrogators on detainees in foreign holding tanks, supposedly to extract information about terror plots. But some of those seem so gratuitously abhorrent, it’s a stretch to even call them interrogations. Where is the interrogation component of force-feeding people their meals rectally? How much valid information could you get on the 17th day of one long, round-the-clock interrogation? What investigatory purpose is served by leaving a prisoner naked until he dies of hypothermia?

Politicians may quibble over the semantics of the practices and the politics of the report’s release, just before Democrats lose control of the Senate. Apologists for the program, both from the Bush administration and the CIA, reject the word “torture.” Former Vice President Dick Cheney goes so far as to call the 6,300-page report “full of c–p,” even as he acknowledges no authorization was given for rectal force-feeding. Call it what you want, but when the purpose is to terrify, degrade, in some cases bring people convicted of no crime to the brink of death, and leave them emotionally and physically broken down, one can only hope those tactics would be anathema to most Americans.

Elected leaders, including Obama, Sen. Dianne Feinstein, whose committee brought out the report, and Republican Sen. John McCain, who knows torture first-hand, believe its release will show the world, as Feinstein said, “that we are in fact a just and lawful society.” McCain said Americans need to know “when the values that define our nation are intentionally disregarded by our security policies.”

Whose values did the program uphold — The CIA’s? The Bush administration’s? That’s hard to answer since the report doesn’t look at individual culpability. Cheney’s justifications aside, the CIA did not inform the administration or get approval for some measures. On the other hand, secret legal memos sent by the Bush administration set forth a covert CIA program abroad to conduct such interrogations. Officials claimed an anti-torture treaty only applied inside the U.S. And though one of Obama’s first acts in office was to ban those practices, even Obama officials reportedly considered upholding the interpretation.

So, who are we? Are there two different sets of American values to employ selectively, according to circumstances? Was the CIA satisfying itself that the ends justify the means, even though those harsh techniques were of little ultimate value in capturing Osama bin Laden? Did agents grow oblivious to the boundary lines and become dehumanized like the Abu Ghraib captors, rogue elements with enough power to abuse? Or were they opportunists like James Mitchell, the Florida psychologist who designed and implemented the program with his partner for a cool $80 million, though never schooled in the mindset or tactics of al-Qaida?

Now that this has happened, can we still claim to have those shared values in the rule of law? Can we still claim the moral authority to condemn human rights violations in Yemen or North Korea? Even though we braced for global fallout from the report, knowledge of our abhorrent interrogation practices have already contributed to terrorist recruitment efforts, even of U.S. citizens.

Americans are not unique. Like everyone, whether we do bad or good depends largely on the cues we get from our environments. Those who lack faith that the system treats everyone equally might not see a need to play by the rules. Much has been made, for instance, of the looting and rioting in the wake of a Ferguson grand jury’s failure to indict a white police officer for the fatal shooting of an unarmed young black man. Without revisiting the merits of that case or justifying the behavior, there was clearly an element of nihilism that didn’t spring from bad upbringings, as some people have claimed. It reflected a lack of belief that justice is for all. So hold the looters responsible but in the long run, let’s make sure our police forces, prosecutors and courts model the rules of fair play.

We Americans can’t change what took place in our names in secret faraway holding pens, but we can press for those responsible to be held accountable. We can vow not to let it happen again on our watch. We can use our votes and our voices to assert our common values when our leaders sometimes seem to have lost their way.

Who are we? We are the voters and the taxpayers, the office-seekers and marchers and peaceful protesters, guided by an enlightened Constitution, a belief in doing what is right and a democracy that demands our engagement.

“The ‘Obama Refuses To Lead’ Crowd Falls Silent”: It’s Striking To Realize What The President Has Done Just Since The Midterms

Kevin Drum pauses today to take stock of the recent actions from President Lame Duck.

So how have things been going for our bored, exhausted, and disengaged president? He’s been acting pretty enthusiastic, energized, and absorbed with his job, I’d say.

It’s funny, in a way, to think about how long ago the midterm elections seem. Seven weeks ago, President Obama was apparently supposed to be a defeated man, crushed by an electoral rebuke, pushed into irrelevancy by an ascendant far-right majority in Congress. It was up to the White House, the Beltway said, to start looking for new ways to make Republicans happy.

There’s a script that lame-duck presidents are supposed to follow, and gosh darn it, Obama would be expected to play by the rules, slipping further and further out of frame.

But given today’s developments, it’s striking to realize what the president has done over the 58 days since the midterms.

Obviously, there’s today’s historic announcement about U.S. policy towards Cuba. There’s also Obama’s breakthrough climate agreement with China, the successful secret mission that freed American prisoners in North Korea, and the sharp reduction of prisoners at Guantanamo Bay.

And that’s just foreign policy. Closer to home, the president has unveiled a major new immigration policy that will bring new hope to 5 million immigrants; he’s taken the lead on net neutrality; and he’s scored a series of confirmation victories in the closing days of the Senate.

All of this comes against the backdrop of an improving job market, a highly successful ACA open-enrollment period, falling gas prices, a Russian crisis that arguably benefits the United States, and the number of Ebola cases in the United States falling to zero.

The White House’s many critics don’t want to hear this, but if Obama were a Republican, it’s likely we’d be inundated with coverage about how “President Comeback just got his mojo back.”

Indeed, I continue to think about Dana Milbank’s column from two weeks ago today.

…Obama has demonstrated a preference to mull rather than to act. Former Obama Pentagon chief Leon Panetta, in his memoir, wrote that Obama too often “relies on the logic of a law professor rather than the passion of a leader.”

Today’s historic agreement with Cuba belies such criticism – plenty of presidents have talked about a more sensible course on Cuba, but this president actually did something about it. This required some bold leadership and a willingness to take a risk on a contentious issue, and Obama delivered.

To be sure, we can and should argue about the merits of the president’s decisions. Maybe this dramatic foreign policy shift is a major step forward, maybe not.  Perhaps Obama’s post-midterm moves will advance the nation’s interests, perhaps not.

But the point is, for all the chatter about a disengaged president who’s reluctant to act, the last seven weeks prove those assumptions wrong. Obama has clearly taken charge, pursuing an ambitious agenda with striking vigor.

Every pundit who carelessly throws around the “why won’t Obama lead more?” cliches clearly needs to rethink the thesis.

“The Sanity Initiative”: Obama Realizes What 10 Presidents Didn’t; Isolating Cuba Doesn’t Work

President Barack Obama made the dramatic announcement Wednesday that his administration is ending efforts to isolate Cuba that go back more than 50 years. While Congress will have to decide whether to end a formal economic embargo and a ban on casual tourism, senior administration officials said in a White House conference call that they would do everything within their power to end what Obama called a “failed policy.”

“Isolation has not worked,” said Obama from the White House.

Isolation has not helped to promote human rights in Cuba, it has not led to the downfall of the Castro government, and it is a policy carried out by the United States alone in the world. “I do not believe we can continue doing the same thing for five decades and expect a different result,” said Obama in a none too subtle allusion to a popular definition of insanity.

The initiative comes after 18 months of secret talks, with a major impetus provided by Pope Francis, who hosted the final discussions between Cuban and U.S. officials at the Vatican in the fall. (We should have known something was up when Obama and Cuban President Raul Castro shook hands at Nelson Mandela’s funeral a year ago.)

On Tuesday, Obama and Raul Castro spoke on the telephone for the better part of an hour, going down the checklist of measures that had been agreed upon in the negotiations.

These included a swap of three Cuban spies imprisoned in the United States for the last 15 years in exchange for an unnamed “U.S. intelligence asset” who has spent the last two decades in Cuba’s prisons. The asset was said to have provided the vital information that led to the shutting down of three different Cuban spy operations in the United States, including one in the Defense Intelligence Agency.

The release of American contractor Alan Gross, imprisoned for the last five years, was presented by the administration as a humanitarian decision by Havana since he was not an intelligence agent—despite Cuban claims—and thus the U.S. government would not trade spies to gain his release. Clearly the liberation of Gross took place in the context of what might be called a “grand bargain.”

Other measures include the decision to reopen embassies, closed since 1961, and steps to remove Cuba from the State Department list of countries that support terrorism.

There will be a dramatic expansion of the kinds of licenses that will allow Americans to travel legally to Cuba, covering everything from journalism to humanitarian work and help to the private sector on the island. Even if “tourism” is still barred by law, it is difficult to imagine that anyone wanting to visit the island will not be able to find some category that allows that to happen. And visitors can bring up to $100 worth of Cuban cigars back to the U.S. with them.

To help with those purchases, U.S. financial institutions will be able to operate to some extent in Cuba, and, perhaps most importantly, U.S. credit cards and debit cards will start to function.

Obama is arguing that engagement is more likely to bring about change in Cuba than isolation ever did, and his new policy will try to target areas where change is needed and can be made, particularly with regard to human rights, private enterprise, and access to information. (In what may be a significant gesture, Cuba released 53 prisoners on a list provided by the Obama administration although, of course, this was presented as a sovereign decision by Havana.)

The Treasury and Commerce departments also intend to clear the way for the U.S. export to Cuba of goods that will help small private construction firms, entrepreneurs and small farmers. Telecommunications workers and investors clearly will find it easy to travel to Cuba, at least from the American side. A major part of the Obama initiative aims to get more and better Internet access for the Cuban people.

Not the least of the Obama administration’s motives is the sense that the American policy of isolating Cuba has, instead, isolated the United States. Not a single country in the world supported it, including and especially the other countries of the Americas, north and south.

Even in the darkest days of right-wing dictatorships in South America in the 1980s, even they thought it wiser to engage the Castro regime than to attack it so relentlessly and gratuitously that it had an excuse for all its own failings. More than 30 years ago, the Argentine ambassador to Havana, who served the generals in Buenos Aires, would tell visiting reporters, “the best way to make war on Castro is with peace.”

Obama couldn’t say that on Wednesday, of course.
