“An Effective Ad Man”: Democrats Could Use Their Own Grover Norquist
Here’s the first lesson from the early skirmishing over ways to avoid the fiscal cliff: Democrats and liberals have to stop elevating Grover Norquist, the anti-government crusader who wields his no-tax pledge as a nuclear weapon, into the role of a political Superman.
Pretending that Norquist is more powerful than he is allows Republicans to win acclaim they haven’t earned yet. Without making a single substantive concession, they get loads of praise just for saying they are willing to ignore those old pledges to Grover. You can give him props as a public relations genius. Like Ke$ha or Beyonce, he is widely known in Washington by only one name. But kudos for an openness to compromise should be reserved for Republicans who put forward concrete proposals to raise taxes.
The corollary is that progressives should be unafraid to draw their own red lines. If you doubt that this is a good idea, just look at how effective Norquist has been. Outside pressure from both sides is essential for a balanced deal.
Start by insisting that Social Security and any increase in the retirement age be kept off the table. President Obama’s bargaining hand will be strengthened further if he can tell Republicans that there just aren’t Democratic votes for steep cuts in Medicaid and Medicare. The president’s room for maneuver expands still more if liberals refuse to look at cuts in programs unless Republicans are prepared to raise tax rates on the wealthy.
Already, there are signs that Republicans realize how much leverage the president has. If Congress doesn’t act, all the Bush tax cuts expire at the end of the year. At that point, the Senate’s Democratic majority has the power to block (or Obama can veto) any restoration of the upper-end Bush tax rates.
One indication that Republicans are aware they’re boxed in came from Rep. Tom Cole (R-Okla.), one of his party’s shrewdest political minds. He suggested that Republicans should take up the president’s invitation to extend the Bush tax cuts for the 98 percent of Americans who earn less than $250,000 a year. Yes, this would amount to throwing in the towel on those upper-bracket levies. But Cole knows that it won’t help the Republican brand if voters come to see the GOP’s one and only objective as protecting wealthier Americans from tax increases.
The next lesson is not about politics or PR. It’s about substance, and this is where the Washington establishment has to get serious. The simple fact is that it’s bunk to claim that “tax reform” alone can produce the revenue we need.
One of the great disservices of the Bowles-Simpson commission was that it fed the impression that tax reform could generate so much cash that it would permit a cut in tax rates.
Grant Erskine Bowles and Alan Simpson credit for good intentions — they were desperate to find a way to get Republicans on their commission to acknowledge the need for new revenue. It’s also worth remembering that their proposal assumed the expiration of the Bush tax cuts for those earning more than $250,000 a year. Nonetheless, their stress on tax reform with lower rates was more a political deal than wise policy. They sent us down the wrong path.
The only way tax reform might raise enough money to prevent a rate increase, let alone create an opportunity for rate cuts, is to reduce popular deductions (like the one on mortgage interest) so deeply that middle-class Americans would get a tax increase, too. And eliminating or sharply undercutting the deduction for state and local taxes is a bad idea. This only penalizes higher-tax states that try to solve their own social problems — for example, by providing health insurance to their low-income residents.
And all the schemes to eliminate tax expenditures to avoid rate increases have the effect of protecting just one group: Americans with very high incomes. That’s how the math works.
The right thing is to bring back Bill Clinton’s tax rates on the well-off and then have a broad tax reform discussion next year. A similar logic applies to health-care programs, as Jonathan Cohn suggested in the New Republic. Before making big cuts in Medicaid and Medicare, we need to see whether the reforms in the Affordable Care Act can contain medical inflation.
The fiscal cliff creates an enormous opportunity to end an era in which it was never, ever permissible to raise taxes. In the pre-Grover days, conservatives believed passionately in pay-as-you-go government. A tough stand by progressives will make it easier for conservatives to return to the path of fiscal responsibility.

“Never Underestimate GOP Cynicism”: Those Who Think Sandy’s Effects Won’t Matter Because It Primarily Affected Blue States Should Think Again
For all the speculation about the effect of Hurricane Sandy and its aftermath on the election, one important aspect has gotten surprisingly little attention: How many people will be unable to vote because of power outages, floods, and impaired transportation systems? How many will be deterred from voting because they are dealing with serious dislocations in their lives? And what new forms of Republican mischief will all this invite?
Other things being equal, President Obama seems to have been the winner so far because of his impressive handling of the crisis. Chris Christie surely helped on the image front.
But other things are not equal. Four days before the election, at least three million Americans are without power. And so are thousands of neighborhood polling places.
Bus and subway lines are not fully operating, and there are gas shortages, especially in New Jersey. Both factors raise obstacles to people getting to the polls.
Hundreds of thousands of people—conceivably more than a million—may not be able to vote in their usual polling place. Some may not bother to vote at all.
As always, lower-income voters, who tend to favor Democrats, have fewer options and backup plans than more affluent voters. Any competent political scientist will confirm that it’s always a challenge to persuade lower-income citizens that voting can make a difference in their lives. The aftermath of the storm is just one more obstacle to full participation.
Last-minute shifts in polling venues are both confusing to voters and to local election officials, many of whom are volunteers. People who registered may not show up on lists if they are voting outside their usual location, leading to more ballot challenges than usual, even without Republican skullduggery.
Some jurisdictions are printing up paper ballots as a fallback, but the preparations seem surprisingly lackadaisical. At the very least, all of this introduces new uncertainty and new opportunities for ballot challenges.
Under the Help America Vote Act of 2002, passed after the 2000 election debacle, federal law requires local officials to permit provisional voting if there is some question about whether a citizen is entitled to cast a ballot. But provisional voting invites legal appeals, and God help us if the number of challenged ballots in a key swing state exceeds the margin separating the candidates. Worst case, we could see the courts getting involved, with ominous echoes of the Supreme Court’s theft of the 2000 election.
It may seem comforting to Democrats that most of the hardest-hit states are safely blue. But think again. Although Obama seems narrowly ahead in the projected electoral count, the popular vote seems to be almost a tie. To win it, Obama needs to roll up big margins in states deep blue like New York—where turnout could well be depressed. He would of course still be president if he won the Electoral College and lost the popular vote. But in terms of the national psychology (and his own self-confidence as a fighter), Obama would have more of the appearance of a mandate if he won the popular vote.
One of the hard hit states, Pennsylvania, is still close enough that Republicans are throwing money into it. At this writing, between 250 and 300 Pennsylvania polling places are still without power, along with 307,000 Pennsylvania citizens. On balance, any fallout from the storm that depresses turnout is not good for Democrats.
Mercifully, the talk from earlier in the week that a state might actually try to postpone Election Day has faded. It’s clear that only Congress has the right to set Election Day. If elections were not postponed during the Civil War, it’s unthinkable that they’d be postponed a week after a hurricane. Even The Wall Street Journal editorial page discouraged the idea of delaying the election (maybe because Obama’s lead is widening?)
But after what we’ve seen in the past several elections in Republican voter-suppression efforts, never estimate the cynicism of the GOP or its appetite for fishing in troubled waters. The best antidote to all of this is a big general turnout and a stormproof margin of Democratic victory.

“A Deep Irony”: The Tea Party Has Done Serious Damage To Republicans’ Hopes Of Being The Majority
There are those who say that the tea party is fading in influence, but nothing could be further from the truth. In fact, the movement is on the cusp of achieving what once seemed nearly impossible: keeping the Senate Democratic.
A year ago, famed political handicapper Charlie Cook gave Republicans a 60 percent to 70 percent likelihood of capturing control of the Senate; now, he tells me the likelihood of it remaining Democratic is 60 percent.
The switch in fortunes can be attributed to many causes — a slate of lackluster Republican candidates high among them — but one thing is beyond serious dispute: If not for a series of tea party upsets in Republican primaries, the Republicans would be taking over the Senate majority in January.
In the 2010 cycle, tea party candidates caused the Republicans to lose three Senate seats easily within their grasp: Sharron Angle allowed Democratic leader Harry Reid to keep his seat in Nevada, Christine O’Donnell handed Joe Biden’s former seat right back to the Democrats in Delaware, and a tea party favorite in Colorado, Ken Buck, lost a seat that was his to lose.
Now, tea party picks are in jeopardy of losing two more races that heavily favored Republicans: Richard Mourdock, who beat longtime Sen. Richard Lugar in the Indiana Republican primary, is struggling against Democrat Joe Donnelly; and Todd Akin, who bested the Republican establishment’s favorite in the Missouri Senate primary, is expected to lose to the onetime underdog, Democratic Sen. Claire McCaskill, because of Akin’s infamous comments on “legitimate rape.”
Democrats and affiliated independents now have 53 seats to the Republicans’ 47. The way things look now, they seem likely to end up with 51 or 52 after the election; if President Obama is reelected, they would keep control of the chamber with 50 seats because Vice President Biden would have the tiebreaker vote. This would mean that the seats the tea party cost the Republicans — between three and five, depending on the outcomes in Indiana and Missouri — will have kept the Democrats in charge.
For the tea party cause, the consequences should be fairly obvious. If Obama wins reelection, this would deny Republicans unified control of Congress (GOP control of the House is virtually certain) and diminish their leverage in negotiations with the White House. If Romney wins, it would give Democrats the ability to thwart his agenda and to launch probes of the administration.
But there’s a case to be made that the outcome is bad for everybody because it could continue the paralysis for another two years. Divided government can be quite effective when one party controls the White House and the other controls Congress, as was the case in the mid-1990s when Bill Clinton and the Republican Congress balanced the budget. This outcome, however, would perpetuate a split between a Democratic Senate and a Republican House, which has produced mostly finger-pointing over the past two years.
There is a deep irony here: The tea party faithful, who claimed they wanted to shake up Washington, have wound up perpetuating the old system. In fighting for ideological purity in primaries regardless of the consequences, they have set back their own cause of limited government and expanded freedom.
High among those putting Republican Senate control in jeopardy is Mourdock, who eviscerated Lugar, the longtime chairman of the Senate Foreign Relations Committee, by running to his right in the primary. Now realizing they are in danger of losing a seat that Lugar kept Republican for 36 years, Indiana Republicans used a super PAC to send out a direct-mail piece quoting favorable remarks Lugar made about Mourdock. But Lugar’s Senate office let it be known that it did not authorize the mailing and that Lugar would not campaign for Mourdock.
While Mourdock still has a shot at the Senate, Missouri’s Akin appears to be squandering an easy win for Republicans because of his remarks about rape. Akin beat the preferred candidate of the GOP establishment, businessman John Brunner, in the primary, but his candidacy floundered after he voiced his bizarre thoughts about a woman’s body being able to reject the sperm of a rapist.
In a situation even worse than Mourdock’s, the party establishment abandoned Akin. “I’m convinced now they don’t want Akin to win,” Akin adviser Rick Tyler complained this week to the Daily Caller, a conservative Web site.
Of course they want him to win. But they know that in Missouri, as in Indiana, Delaware, Colorado and Nevada, the tea party has done serious damage to Republicans’ hopes of being the majority.

“Liberals Need To Get A Grip”: While Others Push Opinions To Extremes, Feel Free To Stop Rending Your Garments
As a liberal who writes about politics for a living, I’ve spent the last few days talking to increasingly panicked Democrats, who have begun to overreact to the fact that President Obama had a poor debate performance, which then produced a movement in some polls toward Mitt Romney. I think David Weigel put it well yesterday: “The first presidential debate has come to remind me of Star Wars Episode I: The Phantom Menace. Democrats walked out of the theater/turned off the TV saying ‘huh, well, I wanted it to be better.’ After a few days of talking to friends, it changes from a disappointment into the worst piece of crap in human history.” Andrew Sullivan kind of went nuclear after seeing the Pew poll I discussed yesterday, writing a post titled, “Did Obama Just Throw the Entire Election Away?” I can answer that: No.
For many years, psychologists and sociologists have known that in small groups, a uniformity of opinion can push opinion to the extremes. For instance, if you get a group of liberals together and tell them to talk about military spending, by the time the discussion is over, each individual will end up favoring spending cuts even deeper than they favored before the discussion began. There’s an analogous movement in the opinions liberals have undergone since last Wednesday, but here conservatives and the mainstream media play a role as well. There’s no question that reporters, eager for a new storyline and an invigorated race, have seized on the idea that the debate changed everything. And as Kevin Drum explains, conservatives benefit from their large stable of hacks:
Here’s how things would have gone if liberals had their fair share of hacks. Obviously Obama wasn’t at his best on Wednesday. But when the debate was over that wouldn’t have mattered. Conservatives would have started crowing about how well Romney did. Liberals would have acknowledged that Obama should have confronted Romney’s deceptions more forcefully, but otherwise would have insisted that Obama was more collected and presidential sounding than the hyperactive Romney and clearly mopped the floor with him on a substantive basis. News reporters would then have simply reported the debate normally: Romney said X, Obama said Y, and both sides thought their guy did great. By the next day it would barely be a continuing topic of conversation, and by Friday the new jobs numbers would have buried it completely.
Instead, liberals went batshit crazy. I didn’t watch any commentary immediately after the debate because I wanted to write down my own reactions first, and my initial sense was that Obama did a little bit worse than Romney. But after I hit the Publish button and turned on the TV, I learned differently. As near as I could tell, the entire MSNBC crew was ready to commit ritual suicide right there on live TV, Howard Beale style. Ditto for all their guests, including grizzled pols like Ed Rendell who should have known better. It wasn’t just that Obama did poorly, he had delivered the worst debate performance since Clarence Darrow left William Jennings Bryan a smoking husk at the end of Inherit the Wind. And it wasn’t even just that. It was a personal affront, a betrayal of everything they thought was great about Obama. And, needless to say, it put Obama’s entire second term in jeopardy and made Romney the instant front runner.
Kevin is absolutely right about this, and it shows not only that there’s a difference between the conservative and liberal media worlds, but between MSNBC and Fox specifically. While MSNBC made a decision a while back that it would go ahead and become the liberal cable network, particularly in prime time, the individuals who appear on those shows have limits to how hackish they’re willing to be. On Fox, there really are no limits. It’s not as if Steve Doocy and the rest of the crew at “Fox and Friends” are going to say, “Wait, we’re supposed to say the jobs numbers are manipulated by a White House conspiracy? I really don’t think that’s supported by the facts.” I guarantee you that even if Obama performs spectacularly in the second debate and Romney stumbles terribly, Sean Hannity will still get on the air immediately afterward and tell everyone watching that Romney was fantastic and Obama was terrible. This will not only help buck up conservatives, it will encourage reporters to discuss the debate in the way Kevin describes.
Some people have said that Obama’s performance was the worst in history, but that’s just ridiculous. George W. Bush was much worse in all his debates in 2004, Bob Dole was terrible in 1996, George H.W. Bush was awful in 1992, and the worst debate performance was without question Ronald Reagan’s in his first debate in 1984, where he was barely coherent and, in retrospect, probably showing some initial signs of Alzheimer’s. You’ll note that two of the people I just mentioned ended up winning. Obama didn’t do particularly well last Wednesday, it’s true. But he’s a very competitive guy, and I’m sure he’s going to show up next week with plenty more focus and vigor. There are a lot of other factors—a recovering economy, the fact that it now looks like he’ll have more money, a superior ground operation—that continue to make him the favorite. So liberals can feel free to stop rending their garments.
