“Ending The Permanent Crisis”: These Problems Are Really Republican Problems
This has to stop.
Ever since they took control of the House of Representatives in 2011, Republicans have made journeys to the fiscal brink as commonplace as summertime visits to the beach or the ballpark. The country has been put through a series of destructive showdowns over budget issues we once resolved through the normal give-and-take of negotiations.
The old formula held that when government was divided between the parties, the contending sides should try to “meet in the middle.” But the current Republican leadership doesn’t know the meaning of the word “middle,” so intimidated by the tea party has it become.
Here is a way out of permanent crisis: President Obama should demand the repeal of all artificial deadlines and tell both houses of Congress that he won’t make further proposals until each actually passes a replacement to the sequester — not a gimmick or something that looks like an alternative, but the real thing.
With everyone on the record, normal discussions could begin, and Washington would no longer look like the set of a horror movie in which a new catastrophe lurks around every corner.
The solution to the problems of democracy is more democracy, so let both houses hold votes on all the potential remedies — on Obama’s own proposal, on packages put forward by Democrats Chris Van Hollen in the House and Patty Murray in the Senate, and on anything the Republicans care to proffer, including the sequester itself.
Let the House Republican majority show that it can come up with a substantial alternative or, failing that, allow a plan to pass with a mix of Republican and Democratic votes.
In the Senate, ditch the unconstitutional abuse of the filibuster and let a plan pass by simple-majority vote. Misuse of the filibuster is a central cause of Washington’s contorted policymaking. Let’s end the permanent budget crisis by governing ourselves though the majorities that every sane democracy uses.
The air of establishment Washington is filled with talk that Obama must “lead.” But Obama cannot force the House Republican majority to act if it doesn’t want to. He is (fortunately) not a dictator.
What Obama can do is expose the cause of this madness, which is the dysfunction of the Republican Party.
Journalists don’t like saying this because it sounds partisan. But the truth is the truth, whether it sounds partisan or not.
And a staunch conservative has succinctly explained why this problem really is a Republican problem. In an admirably candid interview Monday with Ezra Klein on MSNBC, Ben Domenech, a conservative blogger, said the new tea party Republicans in the House don’t want their leadership to sit down with Obama to talk because “they have their doubts about the ability of Republicans to negotiate any better situation.”
Read that carefully: We are in this mess because Republicans don’t trust their leaders to bargain. Domenech added that many conservatives “don’t buy this distinction between smart cuts and dumb cuts,” a distinction that is not “all that critical.” This is astonishing: Government is bad, so all cuts are more or less the same. And you wonder why we have a crisis?
House Speaker John Boehner keeps saying that the House has twice voted for ways to replace the sequester. What he doesn’t say is that those votes were held in the last Congress, so the bills are dead. If they are so good, why doesn’t the speaker bring them up again and pass them now? The answer is almost certainly that he doesn’t have the votes. If I’m wrong, Boehner can prove it by calling the question. I’m not worried.
One proposal Republicans are floating would give Obama more flexibility to administer the sequester. Thus, a party that says it can’t trust Obama enough to negotiate with him would trust him so much as to grant him exceptional power.
The contradiction is so glaring that Republicans are split on the idea, and it’s foolish anyway. As a senior administration official suggested, it’s like being told that two of your fingers will be cut off but you could choose which fingers. How is it a “concession” to ask Obama to organize the cuts he says would be a disaster?
The nation is exhausted with fake crises that voters thought they ended with their verdict in the last election. Those responsible for the Washington horror show should be held accountable. And only one party is using shutdowns, cliffs and debt ceilings as routine political weapons.

“SCOTUS Sanctioned Racism?”: Conservative Justices Attack The Voting Rights Act
As a statue paying tribute to civil rights pioneer Rosa Parks was unveiled in Washington, D.C., the Supreme Court heard arguments in the case of Shelby County v. Holder, which will decide the Constitutionality of the Voting Rights Act of 1965 that bears Ms. Parks’ name.
Section 5 of the VRA requires election officials in selected states and regions, mostly in the South, to pre-clear any changes to voting laws. This provision has been called the “cornerstone of civil rights law” in America.
“Is it the government’s submission that citizens in the South are more racist than citizens in the North?” asked Supreme Court Chief Justice John Roberts.
Solicitor General Donald Verrilli said no.
Roberts noted that Massachusetts had the lowest turnout rate of black voters while Mississippi had the highest. He and all of the conservative justices on the court expressed skepticism of the continued relevance of a law that was originally intended to be an emergency accommodation.
The Voting Rights Act was renewed for 25 years by a Republican Congress and signed by George W. Bush in 2006. But right-wing organizations and donors have waged a two-decade campaign to destroy Section 5.
The law was deemed Constitutional in 1999, before Roberts and Justice Samuel Alito joined the Court. Justice Clarence Thomas has previously called Section 5 unconstitutional and Justice Antonin Scalia’s antipathy to the law was clear to all in attendance.
Scalia called Section 5 a “perpetuation of racial entitlement” and suggested that Congress could never be convinced to let the law lapse. “They’re going to lose votes if they vote against the Voting Rights Act. Even the name is wonderful.”
Justice Sonia Sotomayor twice asked Scalia, “Do you think Section 5 was voted for because it was a racial entitlement?” He did not answer either time.
Experts believe that Justice Anthony Kennedy will be the deciding vote on the case. He appeared extremely troubled by the idea of pre-clearance, saying it put some states under the ”trusteeship of the United States government.”
“Times change,” Kennedy said at one point.
“Kennedy asked hard questions — that’s his job,” Myrna Perez, a senior counsel with the Brennan Center, told the Washington Post‘s Greg Sargent. “But the questions didn’t signal the law’s demise.”
Verrilli pointed out that jurisdictions can “bail out” of the pre-clearance requirement once they’ve demonstrated a 10-year discrimination-free record — nearly 250 of the 12,000 state, county and local governments covered by the law have bailed out.
Justice Elena Kagan noted that the covered jurisdictions hold 25 percent of the U.S. population, but account for 56 percent of voting-rights lawsuits.
Sotomayor asked Bert Rein, the lawyer representing Shelby County, Alabama, ”Why would we vote in favor of your county, whose enforcement record is the epitome of the reasons that cause this law to be passed in the first place?”
In his brief, Rein argued that conditions that made the law necessary no longer exist.
The Nation‘s Ari Berman, who was at the hearing, noted that the rash of legislative attempts to restrict voting rights since 2010, which he’s called the “GOP’s War on Voting,” never came up during the arguments.

“Tone Deaf And Arrogant”: This Season’s Paul Ryan, Eric Cantor Takes On The Violence Against Women’s Act
House Majority Leader Eric Cantor is a powerful player on Capitol Hill who has pretty much flown under the radar with the general public. But I predict that won’t be true much longer. Now that Cantor is taking the lead on blocking reauthorization of an inclusive version of the Violence Against Women Act in the House, more and more women are asking just who is this representative from Virginia’s 7th district, with his regressive brand of politics?
Cantor has a 12-year history in Congress of voting to restrict women’s access to abortion, deny marriage rights to same-sex couples and block efforts to address workplace discrimination. He’s opposed to affirmative action, embryonic stem cell research and expanding hate crimes law to cover sexual orientation, gender, gender identity and disability. He even voted against the Lilly Ledbetter Fair Pay Act.
These anti-woman measures are bad enough. But the worst has been Cantor’s implacable hatred of the Violence Against Women Act, an antipathy so fierce that he not only took the lead in blocking it during the 112th Congress, but has now stepped forward to derail it once again. His reasoning? Near as I can tell, he just doesn’t want some victims to get help.
On Feb. 12, the Senate passed an inclusive version of VAWA reauthorization, S. 47, by an overwhelming bipartisan vote of 78-22. The Senate’s bill would offer new protections to lesbian, gay, bisexual and transgender victims, who report being unable to access services at astonishingly high rates. It would address college and university-based sexual violence, dating violence and stalking by requiring campuses to be transparent about their assault rates, prevention programs and assistance for victims. It would also recognize Native American tribal authorities’ jurisdiction over rapes committed by non-tribal members on reservations.
I was heartened by the huge margin of victory in the Senate. It indicates that Senate Republicans understand they need to regain credibility with women voters — specifically on the issue of rape — and supporting a reauthorization of VAWA that protects all sexual assault victims would be a step in the right direction. Some House Republicans understand this too; 19 of them sent a letter to the House Republican leadership urging them to pass a bipartisan bill that “reaches all victims.” In fact, we know we have the votes in the House to pass the Senate’s inclusive VAWA, if the leadership will just allow it to happen without playing political games.
Unfortunately, Eric Cantor is either too tone-deaf or too arrogant to do the right thing. Rather than moving swiftly to pass the Senate VAWA bill, Cantor has produced a “substitute amendment” that eliminates protections contained in the Senate bill, and even scales back current law, while also undermining the Office on Violence Against Women. Among its many flaws, this substitute drops LGBT protections; permits non-Native suspects to circumvent tribal authorities, leaving Native American women with inadequate protection from their abusers; and allows college and university administrations to shirk their duty to keep students safe from sexual assault.
To boot, in keeping with the Republicans’ 2013 stealth strategy as telegraphed by Louisiana Gov. Bobby Jindal (i.e., stick with the extremist anti-woman agenda but don’t be so obvious about it), Cantor has put his own stealth moves on VAWA: His bill is deceptively numbered S. 47 (because it’s a substitute amendment of the Senate bill), and it was put forward by a woman, House Republican Conference Co-Chair Cathy McMorris Rodgers (R-Wash.). I’d say that’s too clever by half. Women voters are not so easily fooled, and will likely be offended by the clumsy attempt at subterfuge.
Eric Cantor is like this season’s Paul Ryan: an influential conservative with bad ideas who has thus far escaped public scrutiny. This time around we don’t have a Mitt Romney to help raise Cantor’s profile, but that’s okay. The majority leader’s attempt to derail a hugely popular bipartisan VAWA — and his willingness to write off the more than 1,400 local, state and national organizations that have expressed support for the Senate bill — will ensure that he will have to answer to the voters for his actions, probably sooner rather than later. Let me be the first to say it couldn’t happen to a nicer guy.

“GOP Reversion To Form”: When Did “Tax Reform” Become A Tax Hike?
One of the issues baffling non-conservatives in assessing the latest stage of the fiscal conflict in Washington is that Republicans are treating Democratic demands for loophole-closing on the wealthy exactly like it’s a tax rate increase. That’s odd, since it’s Republicans who have continuously injected loophole-closing–or as they usually call it, “tax reform”–into the debate. For years they’ve discussed it as a possible way to finance a revenue-neutral tax rate cut. Paul Ryan made it (or at least a very vague version of it) central to the math and marketing of his various budget proposals. During most of the 2012 campaign, Mitt Romney touted “tax reform” in the more traditional way, as a magic asterisk that would both limit revenue losses from the tax rate cuts he was proposing, and would also (even less plausibly) prevent his overall plan from changing the distribution of the tax burden. After the election, “tax reform” became part of the package Republicans supported as a “fiscal cliff” measure to maintain all the Bush tax rate cuts.
But Republicans have always been reluctant to talk about tax reform if it’s used for any purpose other than reducing tax rates or avoiding higher tax rates, even though conservative economists tend to support loophole-closing as an efficiency measure worth taking in isolation from rate changes.
So once the battle over tax rates ended (temporarily) with the so-called “fiscal cliff” agreement, Republicans quickly declared not just tax rates but any additional revenues as off-limits in future agreements. So even though you’d think they’d be at least as open to a tax-reform-for-entitlement-reform deal as they were for a tax-rates-for-entitlement-reform deal last year, that has not been the case. It’s tax rates that continue to drive GOP tax policies, even in the absence of any real chance that they will soon be raised or lowered.
Here’s how Jonathan Chait explains what he calls this “reversion to form:”
The answer to this piece of the mystery is clear enough: Republicans in Congress never actually wanted to raise revenue by tax reform. The temporary support for tax reform was just a hand-wavy way of deflecting Obama’s popular campaign plan to expire the Bush tax cuts for the rich. Conservative economists in academia may care about the distinction between marginal tax rates and effective tax rates. But Republicans in Congress just want rich people to pay less, period. I can state this rule confidently because there is literally not a single example since 1990 of any meaningful bloc of Republicans defying it.
What has aided the easy reversion to form, with low taxes for the rich dominating all other considerations, is the pent-up rage and betrayal John Boehner has engendered among his most conservative members. Almost nothing Boehner has done since taking over as speaker has endeared him to his ultras. Every subsequent compromise creates more embitterment, and the last few moves have provoked simmering rage.
Conservatives had to swallow a tax hike, and then swallow an increase in the debt ceiling. Boehner has, incredibly, had to promise his members that he will not enter private negotiations with Obama.
The pressure for confrontation as a method has built up to the point where seemingly no deal Boehner could reach would leave him safe.
So Republicans aren’t open to the tax reforms they’ve supported in the past, or to entitlement reforms they’ve been demanding for years (though this particular issue is complicated by the fact that they only want “entitlement reforms” if they significantly reduce actual benefits; anything else can’t possibly be a “reform”). They have truly painted themselves into a corner this time, and that’s why we are going to have a sequester followed quite possibly by a government shutdown if Democrats resist making the domestic spending part of the sequester permanent.

“By Their Own Hands”: While Republicans Warn Against “Greece”, That Is Exactly Where Austerity Budgeting Will Lead The U.S.
Indebted America is in danger of turning into destitute Greece, or so congressional Republicans and conservative commentators have been warning us for years now. For many reasons, this is an absurd comparison – but it may not always be quite so ridiculous if Washington’s advocates of austerity get their way.
The Republicans actually want to impose Greek-style budget-slashing on the United States. And the federal budget sequestration scheduled to take effect next week could represent the first serious step here toward the kind of fiscal policies that have proved so ruinous not only in Greece — raising unemployment, destroying hope, and encouraging extremism — but across Europe.
Nearly every day, House Speaker John Boehner or Senate Minority Leader Mitch McConnell – or Senator Rand Paul or Rep. Paul Ryan, or almost any other prominent Republican – insists that the only way to improve the economic prospects of the American people is to impose drastic budget cuts on them. While these Republican leaders don’t love the sequester budget only because it cuts too deeply into defense programs, they are eager to impose similar cuts or worse on every domestic function, from health care and education to food safety and infrastructure.
Unwilling as they usually are to name specific cuts, the Republican plans that have emerged lately are indeed similar in scope and impact to those imposed by European central bankers on Greece, Spain, Portugal, Ireland, and other beleaguered states across the continent (and imposed by the British government on the United Kingdom itself).
Enacting the same fiscal policies in this country would, presumably, induce the same effects. Yet despite their enthusiasm for extreme austerity the Republican, Tea Party, and assorted media soothsayers almost never want to discuss what has happened in Europe as a result of those same policies. It is not always possible to ignore the unhappy reality of renewed recession, from England to Italy.
Just last weekend, the British were jolted by news that Moody’s had downgraded investments in their country’s sovereign debt from its traditional AAA status.
Why would the bond rating agency do something like that? Principally because the miserable budgeting of Tory Prime Minister David Cameron’s government has mired the United Kingdom in negative growth, with no prospect of reducing its debt, which keeps growing. So the scheme that was supposed to improve the fiscal outlook for the British has merely lowered their credit rating. That wasn’t supposed to happen — in fact, the austerity plan was designed to preserve Britain’s AAA rating — but it was inevitable as soon as Downing Street chose budget-balancing over growth.
The same downward trajectory can be marked wherever the leaders of dominant Germany have forced austerity plans onto indebted governments.
So damaging has this process become for all of Europe that the Germans finally began suffering the ironic consequences in the last quarter of 2012. Their export-led growth strategies cannot work when their neighbors, reduced to poverty, can no longer purchase German goods. If German exports pick up again this year, it will only happen because customers in the U.S. and China remain exempt from the effects of austerity.
Until now, the United States has escaped the fate of Europe, remaining the “sole bright spot” of steady growth in the global economy, because President Obama resisted the fiscal extremism of his Republican adversaries, and contrived to ward off recession with necessary spending. Now sequestration, with all of its dire social and economic effects, will provide a taste of what is to come under Republican austerity: a shrunken nation with a dim future.
