Questions About Why Rubio Is So Soft On Immigrants”: The Irony In Marco Rubio And Ted Cruz’s Argument Over “Amnesty”
Ted Cruz and Marco Rubio are for now the only real candidates with a chance to become the Republican nominee for president (granting that Donald Trump, whatever his chances, is an utterly unreal candidate), and to Rubio’s chagrin, they are engaged in a dispute over immigration that grows progressively more venomous.
This complex policy challenge has been reduced to the question of which of them is more fervently opposed to “amnesty” for undocumented immigrants, but the debate obscures an odd fact. Though Cruz is getting the better of the argument, the substance of Rubio’s position on the issue—which he is now desperately trying to justify—is actually more popular with Republican voters. But in this atmosphere, when fear and resentment are the order of the day, even that isn’t enough to help him.
A brief bit of background. In 2013, Rubio joined with a bipartisan group of senators called the Gang of Eight to write a comprehensive immigration reform bill, which passed the Senate but died in the House. Along with increasing border security and beefing up the E-Verify system through which employers check their employees’ immigration status, it provided for a path to citizenship for undocumented immigrants. But it was an extremely lengthy path. They would have to register, pay a fine, pass a background check, and at that point they would be granted provisional legal status. After waiting ten years, paying another fine, and showing that they had learned English, they could apply for a green card. Then if they got the green card, they could apply for citizenship three years after that. So it could be fifteen years or more before someone who is currently an undocumented immigrant became a citizen.
As for Ted Cruz’s part, he offered an amendment at the time stripping out the path to citizenship but allowing undocumented immigrants to get work permits. Rubio charges that this means Cruz supported legal status for the undocumented (horrors!), while Cruz says that his amendment was just a poison pill meant to sabotage the bill.
While Rubio has backed away from the bill—he now says he learned that comprehensive reform is impossible, and the answer is to do it piece by piece, with the enforcement pieces coming first—he still says he supports an eventual path to citizenship. But he’s always careful to stress how long it would be before that would even be discussed, much less implemented.
So right now, Rubio is defensively answering all kinds of questions about why he’s so soft on immigrants, while Cruz is the one attacking (and Rubio’s counter that Cruz is kind of an amnesty supporter too has fallen short). Yet Rubio’s position on the path to citizenship question—yes, but after a lengthy process—is quite popular within the party.
It matters a lot how you ask the question, but polling shows that, as a group, Republican voters are perfectly open to letting undocumented immigrants stay in the United States. When Pew asked recently if undocumented immigrants who “meet certain requirements” should be allowed to say, 66 percent of Republicans say yes, with 37 percent supporting citizenship and 28 percent supporting permanent residency.
But the more specific you make the question, the more open Republicans are to citizenship. When pollsters have asked whether undocumented immigrants should be able to apply for citizenship if they pay fines and learn English, clear majorities of Republicans say yes: 72 percent in a January 2014 CNN poll; 69 percent in an October 2013 CBS poll; 63 percent in a February 2013 Fox poll (those and others are collected here).
Those results demonstrate that if you can assure people—even Republicans—that undocumented immigrants will pay a price and assimilate, they have no problem with a path to citizenship. And that’s exactly what the Gang of Eight bill did.
So why isn’t Rubio winning on this issue? One reason is that his position is complex, while Cruz’s position is a rather simpler “He loves amnesty!”—and simpler messages usually prevail. Another reason is that the candidates aren’t actually appealing to all Republican voters, but the somewhat smaller and more conservative group that will actually vote in primaries. And finally, Donald Trump’s campaign, not to mention the general atmosphere of fear stirred up by the attacks in Paris and San Bernardino, has made anything resembling rational discussion on this issue all but impossible. Ted Cruz is capitalizing on that atmosphere with an enthusiasm bordering on the gleeful; he’s now airing an ad claiming that the Gang of Eight bill “would have given Obama the authority to admit Syrian refugees, including ISIS terrorists. That’s just wrong.” It should go without saying that his claim is absolutely ludicrous.
It’s possible that each passing day in which Donald Trump is on TV talking about border walls and excluding Muslims has the effect of nudging the Republican electorate to the right on anything that has to do with foreigners. But the polling results of the last few years show that Republicans are not a monolith, and there should be a market for a position like Rubio’s.
There’s another truth we should acknowledge in this debate. What a President Cruz would actually do on immigration is almost identical to what a President Rubio would do: not much. The last few years have proven that the Republican House has no appetite for comprehensive reform, no matter what the circumstances. And today’s GOP caucus is even more conservative than it was in 2013, after the sweep of 2014 brought in a whole new class of ultra-right members. Most Republicans hail from safe Republican districts, where they fear only a challenge from the right, so there’s no reason why they’d embrace comprehensive reform. The Republican Party itself may want to reach out to Hispanic voters, but your average Republican member of Congress has little reason to; indeed, all his interests run toward vehement opposition.
And if a Republican does somehow win the presidency, the urgency in demonstrating any goodwill toward Hispanics will be gone. So what will happen? The Republican Congress will pass a bill or two hiring more Border Patrol and ICE agents and building some more fences, the Republican president will sign those bills, and they’ll all call it a day—whether the public, including even Republican voters, would favor a path to citizenship or not.

“Republicans Take The Less Risky Path”: The Budget Passes! Has The GOP Congress Come To Its Senses?
The news that the House passed a budget that will fund the government through next fall, and the Senate quickly followed suit, is in and of itself a big deal. But the fact that the bill passed so easily — on a vote of 316-113 in the House, with Republicans voting in favor of it by a margin of 150-95 — may be the really interesting story here.
Is the GOP Congress not what we thought it was? Is the way liberal commentators (myself included) have characterized the Republican caucus in the House over the last couple of years, as a group dominated by extremists who are willing to burn down everything in their path, an oversimplification?
It just may be. But let’s look at some competing explanations for why this budget passed so easily:
Paul Ryan is a genius. Perhaps this is all Paul Ryan’s doing, so deftly did he work his members to corral support for this bill. There’s something to that — there were specific steps he took to make all his members feel like they had a voice in the process, and even some of the most conservative members have praised his openness to their input.
But there are a couple of reasons to think that this explanation is incomplete at best. First, it suggests that the crises and intra-Republican battles of the last few years occurred only because John Boehner was inept at managing the more restive parts of his caucus. While no one is going to suggest that Boehner was some kind of legislative sensei, the members who forced those crises weren’t doing it just because they disliked Boehner. They were acting out of their own ideological and electoral interests, many because they saw their political fortunes in their own districts tied to the idea that they would be uncompromising in fighting both Barack Obama and their party’s leadership.
Second, this bill really was a compromise. It doesn’t defund Planned Parenthood, it doesn’t reduce the size of government, and it gives Democrats plenty of other things they wanted as well. Republicans in the House weren’t going to go along with it for no reason other than the fact that they got to sit down with the new Speaker and voice their complaints. So while they may feel better about Ryan than they did about Boehner, that can’t be the whole story.
They realized that making a fuss only raises expectations. The key dynamic in Republican politics these days comes from voter dissatisfaction with the party’s leaders, who have repeatedly promised to fight President Obama to their dying breath but has been unable to deliver on any of their substantive goals, like repealing the Affordable Care Act. Smarter Republican members may realize that shutdown crises only serve to increase this dissatisfaction, because they inevitably end in defeat for the conservatives. Even the angriest tea partier could eventually face a primary challenger who points out that the congressman didn’t succeed in stopping the march of socialism, no matter how often he shook his fist at his party’s leadership. So the less risky path might be to let the bill pass, keep the government running, and hope that nobody takes much notice of it.
There’s a silent (or at least relatively quiet) majority of Republicans in the House. Let’s not forget that 95 Republicans did vote against the bill, including the most conservative ones. In the past, the conservatives (or the tea partiers, or the Freedom Caucus, or however you want to refer to them) were only able to create crises and shutdowns because they were able to bring slightly less crazy members along with them. So it isn’t that the extreme conservatives have gotten any less extreme; what made the difference this time is that the merely very conservative members were no longer willing to set fire to the Capitol.
Those members in the ideological middle of the caucus (which, to be clear, is a very conservative place) can sound like tea partiers when the situation demands, but they are also realistic enough to know that some battles aren’t worth fighting. They certainly feel pressure from their right, but they may have learned from the mistakes of the past. And right now, as we move into 2016, the calculation of which risks are worth taking has changed. Which leads us to the final explanation:
The presidential race has changed everything. As I’ve been arguing since the last midterm election, congressional Republicans didn’t really need to “show they can govern.” What they needed to do was avoid screwing things up for their eventual 2016 presidential nominee. The reason is simple: if a Republican wins the White House next year, 2017 will see a bacchanal of conservative legislating that will leave no Republican desire unfulfilled. Trying to extract a few concessions from Barack Obama today is spectacularly foolish if it makes Republicans look bad and thereby reduces the chances of electing a Republican president by even the tiniest amount. The best strategy for congressional Republicans is to do no harm, and be patient.
With the presidential primary campaign now in full swing, that reality may be hitting home for more and more members of Congress. So even the most conservatives ones aren’t going to try to force a shutdown. Instead, they’ll vote against the budget bill, and when a reporter asks they’ll say, yes, of course it’s a surrender to Obama and a betrayal of conservative values, blah blah blah. But in their hearts, they probably realize that at this particular moment, passing the budget is the smart move.
So which one of these explanations is the right one? The answer may be different for different members, but I’m pretty sure they all played a role.

“Crying About The Deficit Is A GOP Tool”: Can We Stop Pretending That Republicans Care About The Deficit Now?
Congress is about to pass a package that will keep the government operating through next September. And in order to sweeten the deal for conservative Republicans who would rather not spend money to have the government operate, they’ll also be voting on a $680 billion package of tax cuts. These bills contain both things Republicans want (like allowing oil exports, extending a research and development tax break for businesses, and delaying the “Cadillac Tax” in the Affordable Care Act) and things Democrats want (like extending the child tax credit and the Earned Income Tax Credit).
But whether you’re happy with the overall balance of line items in the bill, one thing’s for sure: it will increase the deficit rather substantially.
While there are some Republicans complaining about that, what they’re really mad about is the things they didn’t get, like banning Planned Parenthood from getting Medicaid reimbursements. In short, what mattered for both sides was the substantive details, and to some degree the politics (i.e. Republicans not wanting to suffer the fallout from another shutdown crisis).
Let’s be honest: despite all their talk about what we’re handing to the next generation and how government should balance its books just like a family does, when it comes down to actually making choices, Republicans are no more concerned about deficits than Democrats are. Crying about the deficit is a tool they use to constrain policies they don’t like. When it comes to the policies they do like, how much the government will have to borrow to fund them is barely an afterthought. So can we stop pretending they actually care about deficits?
There’s no denying that Republicans have wielded the fear of deficits and debt with extraordinary effect. They often convince the public that deficits are a serious problem that needs addressing, because most voters have only the vaguest understanding of how the government operates, and words like “debt” become a stand-in for “the economy.” And they have allies among those sometimes referred to as the Very Serious People in Washington, who gravely intone that government can’t do things like mitigate the effects of a recession if doing so will add to the debt. But when Republicans actually have to make choices, there’s a simple calculus at work: the programs they don’t support anyway, like food stamps or Medicaid, should be cut because we just can’t afford them. But the programs they do support, like military spending, not to mention tax cuts that will increase the deficit? Well, we just have to do those things, because they’re necessary.
Consider that the biggest Democratic policy initiative in recent years was the Affordable Care Act, which was completely paid for through taxes and budget cuts within Medicare. The ACA not only didn’t increase the deficit, it decreased it. The biggest Republican policy initiatives in recent years, on the other hand, were the Bush tax cuts and the Iraq War. The former cost somewhere between $2 trillion and $3 trillion (see here and here), while the latter cost around $2 trillion. There was no attempt to pay for either one, meaning the cost was just added to the deficit.
And why wasn’t there an attempt to pay for them? The simple answer is that when Republicans have something they want to do, they do it. Trying to pay for what you want to do just complicates things (as the authors of the ACA could testify). When George W. Bush took office, they wanted to cut taxes, particularly on the wealthy, so they did. They wanted to invade Iraq, so they did. If any Republican said, “It would be nice to do this, but it’s going to increase the deficit, so we shouldn’t,” they would have been laughed out of the room. And all those Republicans who today say that they don’t think Bush was a real conservative because he didn’t curtail spending? If you don’t remember them loudly objecting at the time, that’s because they didn’t.
The main reason Republicans are free to set aside concerns about the deficit right now is that it has dropped so dramatically over Barack Obama’s presidency, so it’s much harder to argue that it’s an urgent problem. The deficit peaked at $1.4 trillion in 2009, Obama’s first year in office, when the country was still in the depths of the Great Recession. By 2014 it had fallen to $484 billion, a decline of two-thirds. It went from 9.8 percent of GDP in 2009 down to 2.8 percent of GDP in 2014.
There are multiple reasons why, including sequestration, the improving economy, and the tax increases Obama negotiated. But if you want to grant presidents credit or blame for what happens with the deficit on their watch, in the last forty years, Presidents Obama and Clinton reduced the deficit as a proportion of GDP, President Carter kept it almost exactly where it was, and Presidents Bush the Younger, Bush the Elder, and Reagan increased the deficit. Notice a pattern?
And all the Republicans running for president have tax plans that would send the deficit into the stratosphere. They wave away the consequences by saying that they’ll come up with some package of (yet unspecified) budget cuts, or even better, that despite all historical evidence, this time cutting taxes will lead to such an explosion of economic growth that the deficit will actually fall (this is known as a belief in the “Tax Fairy”). But the truth is that they just want to cut taxes, and if one of them becomes president, that’s what he’ll do. And nobody on the Republican side will care what it does to the deficit.

“Ted Cruz Doesn’t Seem To Mind”: Cruz’s Cozy Ties To DC’s Most Prominent, Paranoid Islamophobe
The top two Republican presidential contenders share more than a star-crossed bromance: They are also both big fans of an Islamophobic birther conspiracy theorist who thinks Huma Abedin is a sleeper agent.
It’s old news that Donald Trump has a thing for Frank Gaffney, who helms the conspiratorial Center for Security Policy. When the reality television star-turned-presidential frontrunner decided we need to temporarily ban Muslims from immigrating to the United States, he cited a methodologically goofy poll from Gaffney’s group suggesting one quarter of the world’s Muslims support global jihad and violence against America.
Though the Trump megaphone probably gave Gaffney more exposure than he’s ever had, Gaffney has friends in other high places as well: namely, the office of Ted Cruz. But Cruz, might have more to lose than his golden-hued frienemy, since his connections to Gaffney highlights just how hard it may be for him to posture as simultaneously mainstream-friendly and die-hard conservative.
In fact, just yesterday Cruz sent a video message to his buddy’s Nevada National Security Action Summit, in which he praised Gaffney without equivocation.
“I’m so sorry I can’t be there in person,” he said in the video, “but I want to thank Frank Gaffney and the entire team at the Center for Security policy for elevating these critical issues.”
“Frank, a patriot, he loves this country, and he is clear-eyed about the incredible threat of radical Islamic terrorism,” Cruz added.
Then he said that Loretta Lynch has implemented a “ban on anti-Muslim rhetoric.”
Nope. That didn’t happen.
On the offhand chance you aren’t a long-time Gaffney watcher, a few things about his resume stand out. For starters, he helped push birther conspiracy theories about Obama, writing in 2008 at the Washington Times that “[t]here is evidence Mr. Obama was born in Kenya rather than, as he claims, Hawaii.” He argues that Huma Abedin, a top aide to Hillary Clinton, is a secret agent for the Muslim Brotherhood.
And he floated that a logo redesign for the Missile Defense Agency “appears ominously to reflect a morphing of the Islamic crescent and star with the Obama campaign logo” and was indicative of “submission to Shariah by President Obama and his team.”
Yipes!
On top of that, Gaffney has long argued that Grover Norquist, who heads the conservative Americans for Tax Reform, is secretly working to help Muslim Brotherhood moles infiltrate the U.S. government.
Big if true.
Because of curious statements like those, many mainstream conservatives have tried to banish him from their movement. He lost access to the CPAC mainstage, for example, and in 2012 got disinvited from a weekly off-the-record meeting of D.C. conservative power brokers.
But while everyone else has run away from Gaffney, Cruz has embraced him.
The video in Nevada wasn’t a one-time thing. Cruz also sent a video message to Gaffney’s July 25 New Hampshire National Security Summit, calling the organizer a “good friend.”
In March, Cruz appeared in person at Gaffney’s South Carolina National Security Action Summit—an event that Breitbart News co-sponsored—where he lavished praise on the birther.
“Frank Gaffney, the one and only,” Cruz said at that event, “you are a clarion voice for truth.”
He also appeared in person at Gaffney’s “Defeat Jihad Summit” in February of this year, where he praised his conspiratorial organization.
“This is an important gathering,” Cruz said at that event. “Let me say thank you to the Center for Security Policy for its leadership, for the Secure Freedom Strategy, a comprehensive serious strategy addressing the threat of radical Islamic terrorism.”
Secure Freedom Strategy is authored by a group called “The Tiger Team” and calls for identifying the Muslim Brotherhood’s operatives, “overt and covert.”
(Cruz’s team didn’t respond to a request for comment on whether he shared Gaffney’s concerns that Norquist is a covert Muslim Brotherhood operative. We will update this story if we hear back from them.)
On Feb. 6, 2014, he and Gaffney sat next to each other to discuss the dangers of an electromagnetic pulse attack at an event Gaffney’s group sponsored.
On September 8 of this year, he appeared on Gaffney’s radio show and said the Iran deal means “we are at a moment much like Munich in 1938, where allowing homicidal maniacs to acquire the military power to murder millions.” He also joined the show on April 22, 2014.
While Gaffney has found favor with Cruz and Trump, he isn’t buddy-buddy with everyone in the Republican presidential field. In fact, he suggested in 2011 that Chris Christie committed “misprision of treason” by appointing a Muslim lawyer, Sohail Mohammed, to the New Jersey Superior Court of Passaic County.
“Mr. Mohammed’s work for the American Muslim Union (AMU), an organization with close ties to Hamas, is what concerns Mr. Gaffney, not his religion,” emailed Alex VanNess, a spokesperson for the Center for Security Policy. “During an interview with Andy McCarthy on his book, Mr. Gaffney simply asked Mr. McCarthy if appointing a person with ties to such a terrorist group amounted to ‘misprision of treason.’”
Cruz and Trump aren’t the only 2016 contenders to legitimize Gaffney. Carly Fiorina sent a video message to the group’s most recent event, and Rick Santorum spoke at its South Carolina summit. But the Texan, by far, has done the most to consistently and publicly praise a guy who thinks Grover Norquist is a secret Muslim spy.

“Eradicate The Inequality And Anger”: If You Want To Beat Donald Trump, You Have To Do More Than Call Him A Fascist
The American political establishment, from the Democratic Party elite to their Republican counterparts, have discovered something alarming. There is now wide agreement that Donald Trump is a gigantic bigot and at least a quasi-fascist. He has been described as such by many ideologically diverse politicians and commentators, from the liberal Martin O’Malley to the conservative Max Boot.
And it hasn’t dented his support at all. On the contrary, Trump has surged ever higher in the polls.
As Matt Yglesias argues, Trumpism is the natural result of conservative political strategy. Republicans refuse to accept immigration reform — even though it could potentially help them make inroads among Latinos. They have also long refused to promulgate any economic policy that isn’t preposterously slanted towards the rich. Their only political road left is turning out lower-class whites — a not insignificant number of whom are outright racists — with rank race- and Muslim-baiting. As Ta-Nehisi Coates once wrote, race hustling — “profiting from their most backward impulses…stoking and then leeching off of their hate” — has a long history in American politics. As Greg Sargent points out, the rest of the GOP field, and particularly Ted Cruz, is only slightly behind Trump in anti-Islam fear-mongering.
Trump is obliterating the GOP brand among Latinos. Other minority groups who might have a natural affinity for conservative policy — ironically, including American Muslims, who are generally well-off and broke for Bush in 2000 — will be repelled by the perception that the GOP is the party of racists. Any such damage to the Republican image will be extremely hard to undo, so there will be continual temptation to go all in on the politics of racism.
Demonstrating the bigotry of Trumpism is a worthy and necessary task. Condemning Trump as the rebirth of Mussolini (as I have done), or attacking his supporters as unpatriotic, is worthwhile. But it’s not enough.
It’s time for liberals to start thinking about what to do against a political opponent that openly subscribes to bigotry. It’s time to start building anti-fascist political institutions. I fear that calling Trump a fascist will make no dent at all in the Trump phenomenon. Left-leaning Americans need to start thinking about building the brute political muscle to beat him.
What does that mean? Namely, that only a broad-based political movement, aimed at providing jobs and economic security for every American of every race, can permanently defeat what Trump represents.
That means politically activating the people who are the recipients of Democratic policy but do not vote (particularly the poor). One of the most devastating lines I’ve heard in American politics comes from a Republican political advisor in Kentucky: “People on Medicaid don’t vote.” That is part of why Matt Bevin was able to cruise to easy victory in that state after having promised to snatch health insurance from hundreds of thousands of people.
Unions should take the lead. Organizing is flaring up in food and service industries, contributing to small policy successes such as a $15 minimum wage at the city level. A small fraction of VW workers at a Chattanooga plant recently got union representation — the first United Auto Workers victory at any foreign-operated firm. Further organizing is desperately needed, and Democrats who know what’s good for them should immediately pass pro-union legislation such as card check or a repeal of Taft-Hartley the second they get a chance.
Churches also play an underrated role in left-leaning politics. Though regular church attendance is generally correlated with more conservative politics, fully 40 percent of people who attend church weekly still voted Democratic in 2004 (and 49 percent of white Catholics). As Elizabeth Stoker Bruenig points out, the teachings of Jesus Christ are highly amenable to a left-leaning interpretation.
Other parties could also be built up, particularly in insanely corrupt blue states like Illinois or New Jersey. The sad truth is that the Democrats — the party of Andrew Cuomo, Hillary Clinton, and Rahm Emanuel — are not a particularly great vehicle for the sort of policy that would actually benefit unions or the poor. The Working Families Party has had limited success shifting the balance of power in New York politics; more could be done.
Other experiments, such as Jacobin‘s reading group network, or perhaps a revitalization of tired online organizational models from the Bush years, ought to be tried or expanded.
Inequality in America is enormous. For the first time since the ’60s, at least a majority of Americans are not in the middle class. This is another way of saying that society has largely ceased to function for great swathes of the population. That, I believe, is a big root cause behind the rise of Trumpism. Anger and hatred — powerful political motivators indeed — fester under such conditions. To beat Trump, we can’t just call him a fascist. We have to build the movement and institutions that will eradicate the inequality and anger in which fascism thrives.
