“Routine Partisan Lip Service”: Immigration, Impeachment, And Insanity On The Republican Right
Obstructing, denouncing, and demonizing Barack Obama are so central to the existence of the Republican Party today that its leaders simply ignore the real purposes of the president’s proposed immigration orders. So someone should point out that his imminent decision will advance priorities to which the Republican right offers routine lip service: promoting family values, assisting law enforcement, ensuring efficient government, and guarding national security.
Much of the argument for immigration reform, and in particular the president’s proposed executive orders, revolves around the imperative of compassion for immigrant families. That is a powerful claim — or should be, at least, for the self-styled Christians of the Republican right. If they aren’t moved by empathy for struggling, aspiring, hard-working people, however, then maybe they should just consider the practicalities.
America is not going to deport millions upon millions of Latino immigrants and their families to satisfy Tea Party prejudices, even if that were possible. Attempting to do so would be a gigantic waste of taxpayers’ money, an unwelcome burden on thousands of major employers, and an inhumane disgrace with international consequences, none of them good. It might or might not be “legal,” but it would surely be stupid.
Instead the Obama administration aims to relieve the terrible pressure on immigrant laborers and their children, and to direct resources where they will best accomplish national objectives, by deporting serious felons and other illegal entrants who may endanger security. By insisting on those broad yet clear distinctions, the president will protect the innocent and prosecute the not-so-innocent – exactly what he should be doing with the support of Congress.
Those wise objectives don’t interest the congressional majority, compared with the chance to rile their base by muttering threats against Obama. Just the other day, a tweet appeared under the name of Chuck Grassley, long among the dimmer members of the Senate, warning that the president is “flagrantly violating his oath” and “getting dangerously close to assuming a Nixonian posture.” For the Iowa Republican, that’s subtlety. In case you missed it, he was blustering about impeachment, and he isn’t alone.
Like so many of the familiar accusations against the president, complaints that his executive orders on immigration are “Nixonian” or “lawless” lack merit. Such orders are well within the recognized authority of his office, and considerably more conservative than the official conduct of some of his predecessors, such as George W. Bush – who issued about a hundred more executive orders than Obama has done so far.
With respect to constitutional principle, the camouflage favored by Obama’s antagonists, their flexibility is telling. The separation of powers only matters when they say so. They say nothing when the president uses executive orders to tighten immigration and deport more people than all his predecessors combined. Indeed, when the outcome pleases Republicans, then nobody needs to worry about executive overreach, let alone high crimes and misdemeanors.
Nor does a presidential executive order – even one granting “amnesty” to immigrant children – trouble the Republicans when a Republican president implements that kind of reform. When Presidents Ronald Reagan and then George H.W. Bush took action to keep immigrant families together during their respective administrations, refusing to wait for Congress to move, there was no barking from the likes of Grassley. (According to The Hill, the two GOP presidents made those adjustments following the passage of the 1986 Immigration Reform and Control Act, which created a “path to citizenship” for about 3 million undocumented workers. It was signed by the sainted Reagan.)
Republicans in the Senate and House have rejected every legislative opportunity on immigration, including measures to strengthen border security. That’s because they prefer partisan confrontation – and that is what they will get. The consequences for their party promise to be politically devastating – and still worse if they are foolish enough to believe their own rhetoric about impeachment.

“Republicans Cloaking Their Extremism”: The Values Election We Didn’t Have — And Must Have
Tuesday’s elections have left us with a dismal political landscape in Washington, D.C. and exposed the deep dissatisfaction many Americans feel with the economy and the functioning of government.
The results also, let’s be frank, pay sad tribute to the dishonest genius of Republican Party strategists, who coached candidates to hide clear records of extremism, and who spent six years laser-focused on making Congress dysfunctional while managing to convince voters it was the fault of President Obama and the Democrats.
By cloaking their extremism, and by evading responsibility for anti-government and anti-governing obstructionism, Republican leaders kept voters from having a clear sense of the real contest this year’s elections represented. In 2008 and 2012, there was no denying that the elections were between two very different systems of values and ideas about the role of government in promoting and protecting the well-being of its people. This year’s election was largely a failure to the extent that it was not about values and policies but the personal unpopularity of President Obama, any and all government failings, and the dysfunction in Washington.
In fact, there’s a troubling paradox in the election results: some of the best news for progressives is also some of the most depressing, because it points to the depth and cost of our political failures.
Here’s what I mean. Voters in red states and blue cities alike voted to raise the minimum wage, which polls show has majority support across the political spectrum. But those same voters elected Republican candidates who have opposed efforts to raise workers’ wages. Colorado and North Dakota both rejected anti-choice “personhood” amendments, but voters elected officials in favor of “personhood” laws and hell-bent on closing down health clinics. Polls show support for equal rights for LGBT people way up, but many voters still supported candidates who are committed to resisting any gains toward legal equality.
Voters are rightly dissatisfied with an economy that leaves so many workers and families with stagnant or sinking wages and opportunities. Yet they voted for candidates most likely to make those problems worse. Americans who are hurting are not the ones who will benefit from further tax cuts for the rich, policies that give wealthy corporations and shadowy political groups more influence over elections than voters and ordinary people, and the gutting of regulations that protect consumers and communities from wrongdoing by unaccountable corporations. They’re concerned about climate change yet their votes yesterday hand the gavel of the Senate committee responsible for dealing with it to a climate change denier.
The deck was clearly stacked against progressives this year. Democrats faced contested races in a number of conservative states. There was seemingly no end to the bad news overseas, some of which found its way home. And President Obama’s popularity dwindled even as the economic picture brightened, because so many people were not feeling any of the benefits in their own pockets.
But that’s no excuse for the wave of defeats. Too many Democrats did not make a clear and convincing case about the consequences of policies pushed by far-right activists and promoted by Republican elected officials. And that allowed the debate to become a referendum on voters’ feelings about Barack Obama — and on an insider’s squabble about where the buck stopped on the lack of effective action in Congress.
We must not let Republicans continue to get away with the sleight-of-hand they used to distract voters from their extremism this year. Progressive leaders must make clear what values are at stake in the upcoming policy debates — and whose policies are aligned with the American values and the interests of American families. We must push Democrats to draw clear distinctions between the values of the far-right lawmakers who will make this the most ideologically extreme Congress in memory and the voters who believe our nation’s future depends on prosperity that is broadly shared, not funneled only to those at the very top. This also requires Democrats to have a clear agenda that excites the people who sat out this week’s elections.
Moving forward, the most important mission for President Obama and Democratic congressional leaders is not to show how well they can work with Republican congressional leaders, but to show voters that they can and will take principled stands when core values are at stake, and to help Americans understand how the policy agenda of far-right Republicans undermines the kind of communities and country they want to live in.

“Don’t Be Fooled, GOP Not Trying To Help Hourly Workers”: The Next Attempt By Republicans To Mislead On The Affordable Care Act
If you were paying close attention, you would have heard a new phrase being repeated by Republicans, particularly Mitch McConnell, over the last few days: “restore the 40-hour workweek.” You may have said, “Wait, is the workweek not 40 hours anymore?” If you had no idea what McConnell is talking about—and I’m pretty sure he’s hoping very few people do—it sounds like he’s advocating some kind of pro-worker initiative. And indeed, that’s how he and John Boehner put it in their op-ed in today’s Wall Street Journal, saying that one of the top items on their agenda is to “restore the traditional 40-hour definition of full-time employment, removing an arbitrary and destructive government barrier to more hours and better pay created by the Affordable Care Act of 2010.”
Now we’re getting closer. The government, with that damn Obamacare, is cutting your hours and pay! As Boehner put it, we have to “restore the 40-hour workweek for American workers that was undone by Obamacare.” Since we’re probably going to be hearing this from a lot of Republicans in the coming days as they wax rhapsodic about their deep concern for America’s hourly workers, it would be good to clarify just what it is they’re talking about here.
So let’s be absolutely clear: what they’re proposing is to make it easier for large employers to have full-time employees to whom they don’t provide health insurance. That’s it.
This is about the employer mandate of the Affordable Care Act. It required that companies with 50 or more employees provide health coverage to full-time workers. The mandate has been delayed—for companies with 100 or more workers it takes effect in January, while those with between 50 and 99 will have to comply in 2016. The law’s authors had to define “full-time” somehow, and they knew that if they defined it as someone working 40 hours, then employers could just cut people to 39 and deny them coverage. So they set the line at 30 hours, partly on the assumption that if an employer has a full-time employee, it would be difficult to cut them all the way down to 29 hours to declare them part time and avoid offering the coverage.
One really important thing to understand for context: almost all large employers already offer health coverage. In fact, 96 percent of firms with 50 or more workers do so, even before the mandate kicks in. Among larger firms the number is even higher. For all but a small number of firms, this provision doesn’t matter.
Republicans have always objected to the employer mandate, and they’d like to repeal it entirely. The fact that now McConnell and Boehner are suddenly talking about the question of where the line between part-time and full-time work is suggests strongly that they’re going to be introducing legislation to move that line. It takes a lot of gall to present it as some kind of pro-worker initiative, since what it actually means is, “We want to let your boss cut your hours from 40 to 39, then he’ll be able to take away your health coverage.” But they’re surely hoping that the debate will sound to the public like Republicans want to mitigate the job-killing effects of Obamacare and stand up for workers, while the President just wants government sticking its hand in everybody’s business. And who knows, they might be right.
For the record, there are strong arguments that the employer mandate should indeed be repealed—provided it’s replaced with new provisions that protect people whose employers drop coverage. And I’ve advocated de-coupling health insurance from employment for years. But don’t let Mitch McConnell fool you into thinking he’s trying to help hourly workers.

“The Problem Of Political Precedents”: When Failure Is Rewarded, It Encourages More Failure
In a democracy, fear is supposed to be a powerful motivator for policymakers. There’s a constant realization that there’s always another election coming, and those who want to keep their jobs – and avoid voters’ wrath – will have to be responsible stewards of the public trust.
But what if these norms start to break down? What if the incentives baked into the cake prove to be faulty?
Kevin Drum made a comment last week that struck a chord, noting that Americans seemed inclined to blame Democrats, not Republicans, “for the rising dysfunction of the federal government.”
[This] is especially galling for Democrats, but it’s a win for Republicans and yet another sign of change in the way Washington is likely to work in the future. Republicans have discovered that a sufficiently united party can obstruct everything and anything but largely escape blame for the resulting gridlock.
This lesson has not been lost on Democrats, and it bodes ill for the future regardless of who wins our next few elections.
I think that’s correct and it’s a point that’s not repeated nearly enough.
In a democratic model, the last couple of years have been a mess of historic proportions. Republicans, consciously or not, decided to roll the dice – they would ignore the 2012 election results, refuse to govern, and kill measures regardless of their merit, popular support, or bipartisan appeal. They would shut down the government. They would eschew compromise. They would ignore calls to present policy solutions of their own. They would create the least productive Congress in modern American history.
And then they would wait for the American people to give them a reward.
Which voters delivered yesterday with a lovely bow on top.
When there is no accountability in a political system, there is no incentive for even well-intentioned policymakers to behave responsibly. It seems quite twisted: an unpopular party with unpopular ideas failed miserably at basic governance, and was rewarded handsomely for its efforts. The process isn’t supposed to work this way, and yet we now know it works exactly this way.
The resulting precedent is more than a little discouraging. When failure is rewarded, it encourages more failure. When obstruction is rewarded, it encourages more obstruction. When radicalism is rewarded, it encourages more radicalism. When a refusal to compromise is rewarded, it means politicians will be led to believe they, too, should refuse to work on bipartisan solutions.
It’s not a recipe for sound governance.

“The Hostility Of Latter-Day Republicans”: For Obama, No Point In Being Conciliatory Now
I didn’t watch much TV last night, but I got the impression that whenever the gabbers ran out of steam in describing what was unfolding, they’d revert to blah blah blah about whether the results would re-inaugurate some sort of Era of Good Feeling in Washington.
It’s unclear to me if this sort of talk reflects incredible delusions about the hostility to compromise of latter-day Republicans, or the belief that Barack Obama and Democrats have no play but total surrender. Either way, it makes no sense, even if both sides make the obligatory cooing sounds about bipartisanship and “solving the country’s problems” for a few days.
Last night’s results, in fact, will enormously ratchet up pressure on Republican congressional leaders to act as though their party is already in charge. We’re much more likely to hear ultimatums than peace offerings. I’d figure Boehner and McConnell will let the White House know, privately and publicly, that life can get easier if Obama (a) approves the Keystone XL pipeline, (b) indefinitely delays any DACA expansion, and (c) indefinitely delays final action on climate change regs.
Maybe (a) is a viable option; for all any of us knows, the administration has already decided to approve Keystone. But pure merits aside, backing off on DACA would squander the most important political chip Obama can play for his party before leaving office, and backing off climate change regs might well kill prospects for doing anything on the most important long-range challenge facing the country for many years to come. I personally cannot see anything within the power of congressional Republicans to offer Obama that would justify either concession. Saying “no,” on the other hand, will almost certainly cause Republicans heartburn over the inevitable divisions of opinion about how, exactly, to respond (after the shrieks of rage have subsided). Add in the fact that an awful lot of Republican activists and opinion-leaders are going to vastly over-interpret the midterm results into either a “mandate” or a sign of manifest destiny, there’s little reason to think the GOP is going to listen to those who think the next two years must be devoted to changing the party’s image. At this point, it would be a terrible idea for Obama and Democrats to help Republicans achieve a “pragmatic” makeover they’re not willing to earn by disappointing the almighty “base.”
Besides, Democrats have another task that should absorb their time for the next year or so: coming up with a agenda for keeping the economic recovery going while boosting its tangible benefits for the 99%. Making progress on that front would be better medicine for the Democratic Party and for the country than considering concessions to the people who think there’s not enough inequality today.
