“Unclassified Sensitive Crap”: Rep. Darrell Issa Defends Potentially Endangering Libyan Lives
The Republican politicization of the Benghazi attack may have endangered the lives of several Libyan nationals. Rep. Darrel Issa (R-CA), Chairman of the House Committee on Government Oversight and Reform, released 166 pages of documents [PDF] on Friday as part of his investigation into the Obama administration’s response to the Sept. 11, 2012 attack.
That evening, Foreign Policy reported that the documents contained unredacted names of several Libyans working closely with the United States government. In an interview with Rogin, an Obama administration decried Issa’s action as endangering the lives of those named:
“Much like WikiLeaks, when you dump a bunch of documents into the ether, there are a lot of unintended consequences,” an administration official told The Cable Friday afternoon. “This does damage to the individuals because they are named, danger to security cooperation because these are militias and groups that we work with and that is now well known, and danger to the investigation, because these people could help us down the road.”
One of the cables released by Issa names a woman human rights activist who was leading a campaign against violence and was detained in Benghazi. She expressed fear for her safety to U.S. officials and criticized the Libyan government.
“This woman is trying to raise an anti-violence campaign on her own and came to the United States for help. She isn’t publicly associated with the U.S. in any other way but she’s now named in this cable. It’s a danger to her life,” the administration official said.
Among others named in the document were a port manager working with the U.S. to improve infrastructure, as well as various militia members and commanders who share information on other armed groups within Libya. Top Democrats, including Sens. John Kerry (D-MA), Carl Levin (D-MI), and Dick Durbin (D-IL), have slammed Issa for the document dump.
Rep. Gerry Connoly (D-VA), who also sits on the Oversight Committee, likewise issued a statement saying, “The irony is that while Chairman Issa purports to be sincere in his desire to investigate the recent attack so that we can learn how best to protect our diplomats in the future, his own actions have now compromised the safety of U.S. personnel and Libyans working together to forge a better Libya.”
This is not the first time that the Oversight Committee’s Republican majority has possibly exposed sensitive information in the course of their investigation into Benghazi. During the Oct. 10 hearing, Issa and Rep. Jason Chaffetz (R-UT) may have revealed the classified location of a CIA safehouse while viewing an unclassified map.
Issa defended himself and his committee’s actions in a statement last night:
“President Obama should be ashamed of yet another example where his administration has been caught trying to mislead the American people about what happened in Libya,” Issa said in a statement Sunday night. “Obama administration officials and their surrogates are clearly reeling from revelations about how the situation in Benghazi was mishandled and are falsely politicizing the issue in a last ditch effort to save President Obama’s reelection effort.”
“I applaud the bravery of this activist and other Libyans who are willing to speak publicly and work in positions that puts them in regular contact with diplomatic officials,” Issa added. “They deserve better than to have the Obama administration parade them out as part of their election campaign strategy to distract Americans from legitimate questions about the handling of security and the response to a terrorist attack.”
As a spokesman for the Oversight Committee pointed out on Friday, the documents were not classified. However, the Executive Branch has a multitude of designations related to security. The best known are documents that are ‘classified’, be they SECRET or TOP SECRET, with various other interlocking levels of compartmentalization past that. These levels indicate the amount of potential damage to the United States’ national security their release would have and ensure that they remain closely guarded.
Unclassified documents also can receive labels that advise their level of ability for distribution. For example, the documents released by the Government and Oversight Committee were labeled “unclassified, but sensitive,” meaning that while their contents would not harm the United States directly, they are not intended for wide release.
Rep. Issa has been quoted, according a partial transcript released by Rep. Elijah Cummings (D-MD), as referring these unclassified designations as “crap.” Those whose names were published would likely argue otherwise.

“A Deep Irony”: The Tea Party Has Done Serious Damage To Republicans’ Hopes Of Being The Majority
There are those who say that the tea party is fading in influence, but nothing could be further from the truth. In fact, the movement is on the cusp of achieving what once seemed nearly impossible: keeping the Senate Democratic.
A year ago, famed political handicapper Charlie Cook gave Republicans a 60 percent to 70 percent likelihood of capturing control of the Senate; now, he tells me the likelihood of it remaining Democratic is 60 percent.
The switch in fortunes can be attributed to many causes — a slate of lackluster Republican candidates high among them — but one thing is beyond serious dispute: If not for a series of tea party upsets in Republican primaries, the Republicans would be taking over the Senate majority in January.
In the 2010 cycle, tea party candidates caused the Republicans to lose three Senate seats easily within their grasp: Sharron Angle allowed Democratic leader Harry Reid to keep his seat in Nevada, Christine O’Donnell handed Joe Biden’s former seat right back to the Democrats in Delaware, and a tea party favorite in Colorado, Ken Buck, lost a seat that was his to lose.
Now, tea party picks are in jeopardy of losing two more races that heavily favored Republicans: Richard Mourdock, who beat longtime Sen. Richard Lugar in the Indiana Republican primary, is struggling against Democrat Joe Donnelly; and Todd Akin, who bested the Republican establishment’s favorite in the Missouri Senate primary, is expected to lose to the onetime underdog, Democratic Sen. Claire McCaskill, because of Akin’s infamous comments on “legitimate rape.”
Democrats and affiliated independents now have 53 seats to the Republicans’ 47. The way things look now, they seem likely to end up with 51 or 52 after the election; if President Obama is reelected, they would keep control of the chamber with 50 seats because Vice President Biden would have the tiebreaker vote. This would mean that the seats the tea party cost the Republicans — between three and five, depending on the outcomes in Indiana and Missouri — will have kept the Democrats in charge.
For the tea party cause, the consequences should be fairly obvious. If Obama wins reelection, this would deny Republicans unified control of Congress (GOP control of the House is virtually certain) and diminish their leverage in negotiations with the White House. If Romney wins, it would give Democrats the ability to thwart his agenda and to launch probes of the administration.
But there’s a case to be made that the outcome is bad for everybody because it could continue the paralysis for another two years. Divided government can be quite effective when one party controls the White House and the other controls Congress, as was the case in the mid-1990s when Bill Clinton and the Republican Congress balanced the budget. This outcome, however, would perpetuate a split between a Democratic Senate and a Republican House, which has produced mostly finger-pointing over the past two years.
There is a deep irony here: The tea party faithful, who claimed they wanted to shake up Washington, have wound up perpetuating the old system. In fighting for ideological purity in primaries regardless of the consequences, they have set back their own cause of limited government and expanded freedom.
High among those putting Republican Senate control in jeopardy is Mourdock, who eviscerated Lugar, the longtime chairman of the Senate Foreign Relations Committee, by running to his right in the primary. Now realizing they are in danger of losing a seat that Lugar kept Republican for 36 years, Indiana Republicans used a super PAC to send out a direct-mail piece quoting favorable remarks Lugar made about Mourdock. But Lugar’s Senate office let it be known that it did not authorize the mailing and that Lugar would not campaign for Mourdock.
While Mourdock still has a shot at the Senate, Missouri’s Akin appears to be squandering an easy win for Republicans because of his remarks about rape. Akin beat the preferred candidate of the GOP establishment, businessman John Brunner, in the primary, but his candidacy floundered after he voiced his bizarre thoughts about a woman’s body being able to reject the sperm of a rapist.
In a situation even worse than Mourdock’s, the party establishment abandoned Akin. “I’m convinced now they don’t want Akin to win,” Akin adviser Rick Tyler complained this week to the Daily Caller, a conservative Web site.
Of course they want him to win. But they know that in Missouri, as in Indiana, Delaware, Colorado and Nevada, the tea party has done serious damage to Republicans’ hopes of being the majority.

“A Stark Choice”: Bipartisanship In A Romney Administration
I’ve probably yelled enough about the mendacity of Mitt Romney’s claims last week that he’d “sit down with Democrats” the day after the election and start charting a bipartisan path for the country. But Paul Ryan was up to it again last night, arguing that he couldn’t tell us how he’d pay for an across-the-board tax cut because that would be up to bipartisan negotiations in Congress (as though they could repeal the laws of mathematics!).
Most readers here are probably familiar with the relentless demonization of bipartisanship as “surrender” throughout the Republican primaries, and the specific pledges Romney made to remain faithful to policies guaranteed never to attract a single Democrat (from a repeal-and-reverse approach to health care, to the cut-cap-balance meta-pledge, to the many promises never to accept a tax increase). The most important pledge Romney made, in my opinion, is to sign Paul Ryan’s budget resolution as is if Republicans manage to whip it through Congress using reconciliation procedures, which would mean revolutionary changes in the structure and purpose of the federal government, adopted swiftly on a party-line vote.
But what happens if Romney wins and Republicans fall short of getting control of the Senate? Would this scenario enable him to break his promises and perhaps unleash that secretly moderate Mitt who’s been lying through his teeth the last five years or so?
I don’t think so. Even if Romney is so inclined (and I see no particular reason to believe he is), he’d be dealing with a highly mutinous House GOP and the bulk of a Senate GOP Caucus that would insist the new president use his leverage not to cut deals but to break skulls. Depending on the margin of Democratic control of the Senate, and the identity of the Democratic Caucus, there would almost definitely be an effort to buy a vote or two to put them in operational control of Congress, and with items like the repeal of Obamacare and the enactment of the Ryan budget on the table, they’d pay a pretty high price for treason. If that didn’t work, the combination of Republican control of the House, the presidential veto, and GOP filibuster power in the Senate would be used to squelch any Democratic legislation on even the most quotidian matter. With the entire bipartisan commentariat and the business community screaming for action to avert a “fiscal cliff,” Republicans would probably get their way on that set of threshold issues simply by way of superior leverage. And even without congressional support, a new administration could probably paralyze implementation of Obamacare via executive action and inaction.
Perhaps that’s as much as they could accomplish, but beyond that, you’d find a powerful sentiment among Republicans to withhold bipartisan action pending the midterm elections of 2014, when a more favorable electorate (in terms of turnout patterns) and another positive landscape for GOP Senate gains would make the final conquest of Congress a solid betting proposition. And on one big priority of the conservative movement–the final reshaping of the Supreme Court and the reversal of Roe v. Wade–the odds would be very good for a Romney appointment that would survive the Senate on traditional grounds of deference to the president.
More generally, from Romney’s perspective, the certainty of a wholesale uprising by his party’s “base” and its dominant congressional faction in the event of genuine “bipartisanship” would be a much bigger strategic problem than finding ways around a narrow Democratic margin in the Senate. Besides, if Romney does win, it will almost certainly be due to a tilting of the electorate that also makes a Republican Senate more likely than it appears to be today.
In any event, as I’ve said often, Obama and his entire campaign owe it to the country as much as to themselves to demand as many public concessions as possible, in advance, if Mitt and Paul intend to continue right down to Election Day professing their love for bipartisan negotiations. I doubt any real concession will be made, and perhaps it will finally dawn on the media if not the public that there’s really no way around a stark choice between two very different parties and agendas.

“Dealing With The Cavities”: The Romney-Ryan Tax Loophole Fantasy
One point I mentioned during the live blog of the debate last night which I think is worth reiterating (over and over again) regarding Mitt Romney and Paul Ryan’s refusal to give details on half of their tax plan—don’t be fooled by their refusal to fill out the details of their plan.
To recap: Romney has proposed a 20 percent across the board income tax cut, to cut corporate taxes, and repeal the Alternative Minimum Tax, among other things. He claims that he will make up the lost tax revenue by closing unspecified loopholes in the tax code. This is where the $5 trillion dispute comes from about Romney’s tax plan—his tax cuts are projected to cost around $5 trillion. He argues that it’s not fair to characterize his proposal as a $5 trillion tax cut because—you’ll have to take his word on this—he’s going to offset it by closing loopholes.
Why won’t he or Ryan name the loopholes they’d be willing to close in order to pay for their massive tax cut? Because in a giant act of bipartisan magnanimousness they want to work with Congress to decide which loopholes to close. There are two things going on here.
One is that this is the political equivalent of Romney and Ryan doling out heaps of candy to the public but then saying they’ll work with the Congress to determine precisely which teeth will have to be drilled to deal with the resulting cavities. They’re willing to give out very specific goodies, in other words, and then pretend they’re being brave bipartisans by letting Congress work out the painful details of paying for them. That’s neither brave nor bipartisan.
As TNR’s Noam Scheiber noted last night on Twitter:
Why would you be specific about lowering rates 20 percent but not offsets. Wouldn’t the first part make bipartisan compromise harder too?
If they’re so intent on working with Congress, why put a specific number on one side of the tax reform equation but not the other? Why not say the goal is to lower rates by however much eliminating deductions allows but that they’ll leave the details up to Congress? The reason goes back to the origin of Romney’s tax plan in February when he was trying to win the Republican nomination. Attempting to seem bold and Reaganesque, he proposed the 20 percent across-the-board tax cut. His emphasis then was on rate cuts, including for the rich. He wanted the big bold number. Now he has to backfill the details, which bring me to the other thing going on here.
Romney’s math doesn’t work. Tax loopholes have become the modern equivalent of wasteful spending–a generic and vastly overestimated pool of money politicians can cite as offsets for their expensive policies. The Congress’s nonpartisan Joint Committee on Taxation found that if you repealed all itemized deductions from the tax code (as in goodbye mortgage interest deduction), it would only pay for a 4 percent cut in tax rates.
And more specifically to Romney’s plan, the nonpartisan Tax Policy Center (whose findings the Romney campaign used to tout), has run the numbers and figured out that the wealthy don’t currently get enough breaks in the tax code to pay for the Romney tax cuts. In order to pay for the cuts middle class taxpayers would have to lose expenditures—more than offsetting the tax breaks they would see.
And while Romney and Ryan have talked about a half-dozen independent “studies” which defend his tax plan, they are actually not studies at all—rather they’re three blog posts, an op-ed, and a couple of white papers, one of which was written by Romney’s own economic advisers. Oh, and they don’t actually back up his plan, according to The Atlantic’s Matthew O’Brien.
So understand that while Romney’s goal sounds good, it’s straight out of campaign fantasy land.

“The Polar Express”: It’s A Wonder Anything Ever Gets Done In Congress
This is the season of Extreme Politics. Everything’s exciting. Mitt Romney paid taxes! Joe Biden just bought a 36-pound pumpkin! Paul Ryan is campaigning with his mom again!
Oh, and Congress is ready to go home to run for re-election. I know you were wondering.
“I haven’t had anybody in West Virginia tell me we should hurry home to campaign,” protested Senator Joe Manchin, a Democrat.
This might be because Manchin is approximately 40 points ahead in the polls. He could probably spend the next month in a fallout shelter without anybody noticing. Nevertheless, he is so fearful of alienating conservatives that he refuses to say who has his support for president. There are only about five undecided voters left in this country and one of them is a senator from West Virginia.
The good news is that our lawmakers spent their last pre-election days in Washington working to pass a bill that would keep the government running for the next six months. This is sometimes referred to as a “continuing resolution,” and sometimes as “kicking the can down the road.” Personally, I am pretty relieved to see evidence that this group has the capacity to kick a can.
Let’s look at what else they were up to. This is important, partly because the last things you take up before going back to the voters shows something about your true priorities. Also partly because it will give me a chance to mention legislation involving 41 polar bear carcasses in Canadian freezers.
The Senate had a big agenda for its finale. Kicking the budget can down the road! Passing a resolution on Iran designed to demonstrate total support for whatever it is Israel thinks is a good idea! The Sportsmen’s Act!
O.K., the last one was sort of unexpected. It’s a bunch of hunting-and-fishing proposals, ranging from conservation to “allowing states to issue electronic duck stamps.” Also, allowing “polar bear trophies to be imported from a sport hunt in Canada.” A long while ago, some Americans legally hunted down said bears, happily envisioning the day when they could display a snarling head on the study wall, or perhaps stuff the entire carcass and stick it in the front hallway where it could perpetually rear on its hind legs, frightening away census-takers.
But then the United States prohibited the importation of dead polar bears, and there have been 41 bear carcasses stuck in Canadian freezers ever since.
Free the frozen polar bears! Well, not before November, since the Senate minority leader, Mitch McConnell, dug in his heels, claiming the whole hunting bill was only coming up to help its main sponsor, Jon Tester of Montana, in a tight race. McConnell, who publicly set his own top policy priority as making sure Barack Obama didn’t get re-elected, hates naked partisanship.
The House, meanwhile, declined to take up two major bipartisan bills from the Senate. One was the farm bill, which Speaker John Boehner admitted he just couldn’t get his right wing to vote for despite pleas from endangered rural Republicans.
The other was aimed at reviving the teetering U.S. Postal Service, which is about to default again. “I hear from our Republican colleagues they didn’t want to force their folks to make difficult votes,” said Tom Carper, a lead Senate sponsor.
Really, there’s no excuse on this one. By the time a difficult issue has been turned into a bipartisan Senate bill, it’s no longer all that difficult. People, if you see a member of the House majority campaigning in your neighborhood, demand to know why the Postal Service didn’t get fixed.
Although on the plus side, the House did agree that the space astronauts should be allowed to keep some flight souvenirs.
One thing virtually nobody in the Senate considered a pre-election priority was spending hours and hours arguing about a proposal from Senator Rand Paul of Kentucky to eliminate foreign aid to Libya, Pakistan and Egypt. However, in the grand tradition of the upper chamber, Paul had the power to hold up the crucial kicking-the-can bill hostage by threatening a filibuster if he didn’t get his way.
“He can keep us here for a week and a half if we don’t let him bring it up,” grumbled Senator Charles Schumer.
Rand Paul does this sort of thing all the time. Who among us can forget when he stalled the renewal of federal flood insurance under the theory that the Senate first needed to vote on whether life started at conception?
The majority leader, Harry Reid, pointed out repeatedly that he has had to struggle with 382 filibusters during his six years at the helm. “That’s 381 more filibusters than Lyndon Johnson faced,” he complained. Obviously, Robert Caro is never going to write a series of grand biographies about the life of Harry Reid.
It’s a wonder anything ever gets done. Although, actually, it generally doesn’t.
