“A Feckless Coward”: Boehner’s Wimpiness Exposed, As Democrats Call His Bluff
I’ve been making the case that when it comes to immigration reform, John Boehner is a feckless coward who, caught between two bad political choices, is content to defer action indefinitely while engaging in empty excuse-making to save face. Thankfully, I don’t have to make that case anymore. John Boehner is making it for me.
For months now, Boehner has been arguing that the biggest obstacle to passing immigration reform in the House is that the Republicans just can’t trust President Obama to actually enforce the law when it comes to border security and deportations. This is a ridiculous standard on its face – the House GOP didn’t trust George W. Bush on enforcement, so it’s doubtful that any president could meet their maximalist expectations. And as my colleague Jim Newell points out, Boehner is essentially arguing against the passage of any legislation on any issue. If you can’t trust the president, why bother?
Faced with Boehner’s obvious bluffing on the trust issue, the Democrats called him out. Yesterday, Harry Reid offered Boehner a way around his crippling mistrust of the president: pass comprehensive reform legislation now, but tweak the bill so that it takes effect in 2017, after Obama has left office. “If Republicans don’t trust President Obama, let’s give them a chance to implement the bill under President Rand Paul or President Theodore Cruz,” Reid said.
Problem solved, right? Hah… no. Boehner’s office released the following statement shooting down the idea: “Such a scenario would eliminate any incentive for the administration to act on border security or enforce the law for the remainder of President Obama’s term.”
So Republicans can’t implement immigration reform now because Obama won’t enforce the law. But they also can’t wait to implement immigration reform because Obama needs incentives to enforce the law? Boehner has put himself in the position of arguing that he can’t act because Obama needs to be incentivized to do something he won’t do anyway.
Boehner is just making up reasons for why he can’t act on his own stated convictions and get immigration reform passed. It has nothing to do with President Obama and everything to do with Boehner not wanting to jeopardize his own grasp on power and his party’s chances to make gains in the midterms.
Brian Beutler points out that the threat of executive action to limit deportations further reduces the chances of reform passing, since it’ll agitate the hardline reform opponents in the House and make Boehner even more reluctant to act (if that’s even possible). Any move from the White House will be seized upon by Boehner and the Republicans as an out-of-control imperial president circumventing the will of Congress, and they’re far more eager to make that argument to voters heading into the midterms than to arrive at a coherent policy outcome.
That’s the reason Boehner is contorting himself into logical inconsistencies on immigration. Acting to pass legislation threatens to damage him politically. Inaction puts the spotlight on President Obama. And for all of Boehner’s talk about his commitment to immigration reform, he’s more invested in saving his own skin.

“Ultimately Responsible For Republican Inaction”: Whether He Likes It Or Not, Boehner Controls Immigration Bill’s Fate
For months, House Speaker John Boehner (R-Ohio) tried to blame President Obama for House Republicans’ refusal to consider immigration reform: GOP lawmakers don’t trust the White House, the argument went, so the administration’s responsible for Republican intransigence. A few weeks ago, however, Boehner accidentally told the truth: House Republicans, afraid of hard work and tough choices, are ultimately responsible for inaction on the issue.
So which is it? As a matter of substance, the Speaker’s accidental honesty gave away the game, but as a matter of politics, it’s awkward when the House Republican leader blames his own members for a colossal failure – so now Boehner seems to be pushing both arguments simultaneously.
The Ohio Republican, speaking at a luncheon sponsored by several San Antonio business groups, acknowledged that there are some in his conference who do not want to take on the issue, but he was measured in speaking about his colleagues’ resistance.
“There are some members of our party who just do not want to deal with this. It’s no secret,” he said. “I do believe the vast majority of our members do want to deal with this, they want to deal with it openly, honestly and fairly.”
Boehner then added, “I put the ball back in the president’s court. He’s going to have to do something to demonstrate his trustworthiness.”
There are hints of good news here for reform proponents, but for the most part, the Speaker’s position is simply incoherent. If the “vast majority” of House Republicans want to tackle immigration reform, Boehner and his leadership team can … wait for it … tackle immigration reform. There’s nothing stopping them – they’re the House majority; they can do as they please; the Senate has already acted; and the White House is eager to sign something into law.
As for President Obama demonstrating his “trustworthiness,” the administration has already shown its commitment on this issue by increasing deportations and boosting border security to heights without modern precedent. What’s more, leading Democratic lawmakers have offered to delay implementation of the law until 2017, at which time there will be a new president.
Boehner has never been a policy guy, per se, but it’s implausible to think the Speaker of the House isn’t aware of these basic details. It’s what makes his odd rhetoric somewhat baffling – Boehner says Republicans are and aren’t interested in reform, while the president is and isn’t to blame for GOP intransigence.
The Speaker added, in reference to immigration reform in general, “This is not about politics, not about elections. It’s about doing the right thing for the American people. It’s about doing the right thing for the country. Period.”
That’s a perfectly nice sentiment, though it naturally leads one to wonder when, exactly, Boehner might stop talking about the issue and might start governing.
In the meantime, some of the Speaker’s allies are offering his party some not-so-subtle advice. Benjy Sarlin noted yesterday:
Republican-leaning immigration supporters, which include a variety of business leaders and trade associations, have been lobbying Republicans for a year to pass a reform bill. Chamber of Commerce CEO Tom Donohue warned Republicans on Monday that failure to pass a bill this year would be fatal to the party’s presidential hopes given the rising power of Hispanic and Asian voters who are largely opposed to the GOP’s current immigration stance.
“If the Republicans don’t do it, they shouldn’t bother to run a candidate in 2016,” he said in a panel discussion. “I mean, think about that. Think about who the voters are.”
To borrow a metaphor, the ball is in Boehner’s court.

“Surprise! Republicans Aren’t Serious About Reform”: The GOP’s Lame Attempt To Blame Obama For The Failure Of Immigration Reform
This week, it became all too clear that House Republicans don’t really want to address immigration reform in any meaningful way this year. And if the reform effort does wither on the vine, Republicans know just who to blame: themselves.
Ha, just kidding. They’re going to blame President Obama.
A mere week after unveiling a list of immigration “principles” that the GOP would pursue, Speaker of the House John Boehner (R-Ohio) said Thursday that handling immigration this year would be “difficult,” because many Republicans don’t trust Obama.
“There’s widespread doubt about whether this administration can be trusted to enforce our laws,” he said. “And it’s going to be difficult to move any immigration legislation until that changes.”
Of course, a bipartisan immigration reform package has already passed the Senate, which includes an eye-popping $40 billion for border security. Obama has even signaled that he would be prepared to sign into law a more modest package, including one that bestowed only legal status — as opposed to citizenship — to undocumented workers.
The obstacle to reform has always been in the GOP-controlled House, where hardcore conservatives have opposed any law that bears even a whiff of amnesty. That, in turn, has spooked potential reform supporters who are wary of a primary challenge.
Indeed, Boehner’s so-called principles can be seen as a trial balloon that was quickly deflated by members of his own party, including influential conservative writers like The Weekly Standard‘s William Kristol, who argued that the issue unnecessarily divided the GOP ahead of the 2014 midterms.
Boehner’s remarks were still notable, though, in that they are part of a ridiculous attempt to pin the blame on Obama, a strategy that Republicans have been testing out for months.
Back in October, Sen. Marco Rubio (R-Fla.), who helped author the Senate’s immigration bill before fleeing to chase down his lost conservative credibility, said Obama poisoned immigration reform by standing firm through the government shutdown and debt ceiling fight. By not agreeing to the GOP’s fantastical demands that he gut his health-care law, Rubio said, Obama made immigration reform “harder to achieve.”
“The president has undermined this effort, absolutely, because of the way he has behaved over the last three weeks,” he said.
To be sure, some on the right have charged all along that the White House can’t be trusted to meet tough border security and verification requirements, necessitating “specific enforcement triggers” before a path to citizenship or legal status could even come into play. What’s different now is that the claim has gone mainstream, a reflection of how desperate the GOP is to convey to Latino voters that they would do something on immigration were it not for Obama.
A sampling from the past week:
- Rep. Paul Ryan (R-Wis.): “Here’s the issue that all Republicans agree on — we don’t trust the president to enforce the law.”
- House Majority Leader Eric Cantor (R-Va.): “There’s some real question of trust here and the White House continues to really thumb its nose up, if you will, at the Congress.”
- Rubio (again): “We just don’t think government will enforce the law anyway.”
As Slate’s David Weigel explains, the argument is pretty much bunk:
Say the Senate bill was passed in the House tomorrow, conferenced, and signed by the president. He’s got three years left in office. The legalization component of the Senate bill depends on a border security standard that’s going to be determined by a panel of state governors. They have five years to sign off. If you think about the timing of the Affordable Care Act — passed in 2010, implemented at the end of 2013 — there’s no real danger of Obama using a new immigration law to grant more amnesty. He could do that right now.
So, file these talking points under “Republicans Looking Busy.” [Slate]
But Boehner can’t spike immigration reform without first finding a scapegoat to blame for its failure. And since Senate Republicans are on board, who else is there to blame but the ultimate conservative bogeyman?

“Running Out Of Excuses”: Boehner’s ‘Trust’ Issues On Immigration
The odds of congressional success on immigration reform tend to swing wildly from one day to the next. Reform’s chances are either “likely” or a “long shot” depending on the latest quote, headline, hearing, poll, or rumor.
But this morning, the man who largely has the future of the policy in his hands made it sound as if immigration reform simply will not happen anytime soon.
House Speaker John Boehner said Thursday that House leaders cannot move immigration reform legislation until President Barack Obama restores “trust” among Republicans.
But the GOP leader did not say what rebuilding that trust might entail.
The Speaker told reporters, “There’s widespread doubt about whether this administration can be trusted to enforce our laws. And it’s going to be difficult to move any immigration legislation until that changes.”
Boehner added, “The president’s asking us to move one of the biggest bills of his presidency, and yet he’s shown very little willingness to work with us on the smallest of things.”
As a factual matter, some of this is just odd. Obama has generally shown overwhelming willingness to work with Congress on just about anything, large or small. There’s probably a reason Boehner didn’t mention any examples to bolster his argument.
But the real significance of the Speaker’s comments were their likely bearing on the immigration debate. As Boehner sees it, House Republicans aren’t confident that the Obama administration will enforce federal law, and as such, they don’t want to vote for reform. As the argument goes, even if Congress approves sweeping border-security measures intended to satisfy GOP lawmakers’ demands, Obama may simply blow off laws (or parts of laws) whenever it strikes his fancy.
Indeed, it’s not just Boehner making this argument. House Majority Leader Eric Cantor (R-Va.) and House Budget Committee Chairman Paul Ryan (R-Wis.) pushed the same case on the Sunday shows.
It’s a deeply flawed argument, though the motivation behind it is quite clear.
Note, if the argument sounds familiar, there’s a good reason – the “we can’t pass immigration reform because Obama’s an untrustworthy tyrant” tack first came up last summer. At the time, some congressional Republicans argued that a delay in the implementation of Affordable Care Act provisions was undeniable proof that “we have a president that picks and chooses the laws that he wants to obey and enforce. That makes him a ruler. He’s not a president, he’s a ruler.”
As we discussed at the time, the complaint isn’t persuasive. When it comes to the Affordable Care Act, the administration has some discretion in implementing various provisions. It’s not unusual and it’s not unique to health care. Plenty of parts of the Dodd/Frank financial-regulatory reform law were delayed, too. This has long been the norm, and using it as an excuse not to trust the entire executive branch on literally every issue is kind of silly.
As Brian Beutler wrote in July:
The administration isn’t unlawfully writing the employer mandate out of existence, just like it wouldn’t unlawfully refuse to send thousands of agents to the border if an immigration reform law required them to.
And because immigration reform will be a bipartisan law if it passes, Republicans in Congress will have less incentive to stand in the way if the implementation process reveals real problems with its drafting. Which means the administration won’t be left, as it is with the ACA, facing a suboptimal choice between implementing the law poorly or taking clunky administrative steps to smooth the process out.
So, if “we don’t trust Obama” is such a weak pretense for killing immigration reform, why are congressional Republicans so heavily invested in it? A few reasons, actually.
First, the GOP desperately hopes to convince the American mainstream that the president is an out-of-control, “lawless” radical. It’s not true – Obama’s actually a fairly moderate technocrat – but the manufactured narrative has become a convenient way for Republicans to raise money, rile up the base, and kill popular legislation.
Second, as a policy matter, it’s possible GOP lawmakers hope to use this excuse to tilt the policy playing field in their favor. As Greg Sargent noted on Monday, Republicans may very well insist that increased border security begin well in advance of any other part of immigration reform, insisting that it’s the only way for Obama to prove his “trustworthiness.” In other words, the legislation would give Republicans everything they want, with the understanding that other provisions could come later, once GOP lawmakers are satisfied the president isn’t a big liar.
And finally, let’s not lose sight of the blame game. Congressional Republicans, who have zero major legislative accomplishments since the 2010 midterms, are prepared to kill a popular, bipartisan immigration-reform effort that’s been endorsed by business leaders, labor leaders, economists, immigration advocates, and the faith community. If they refuse to pass legislation, as now appears likely, GOP leaders will need an extraordinary excuse to justify failure on this level.
According to Boehner, Cantor, and Ryan, that excuse effectively boils down to this: “Republicans don’t like Obama.” If they think that’ll work in persuading the public, they may want to consider a back-up plan.

“A Corporate Honeypot”: Look Out, Here Comes The New Border-Industrial Complex
“Good fences make good neighbors,” goes the old adage. That civilizing thought refers to such friendly structures as the beautiful rock walls of New England, elegant split rails in the South, iconic whitewashed pickets of the Midwest and even privacy fences in neighborhoods all across our country.
But the neighborly adage definitely did not contemplate the 700-mile, 20-foot-high, drone-patrolled, electronically monitored fence of steel and razor wire that our government has erected across our nation’s border with Mexico, from the tip of Texas to California’s Pacific Coast.
This thing is not a fence, but a monstrous wall of hostility, a deliberate affront to our Mexican neighbors. As Senator John McCain aptly put it in a recent debate on immigration, our Land of the Free has constructed “the most militarized border since the fall of the Berlin Wall!”
There are four big flaws with the theory that you can “secure” a border (i.e., keep people from crossing it) by throwing up a big ol’ wall. First, it doesn’t work. A 20-foot wall quickly begets 22-foot ladders — people are innately inventive, and those determined to get in or out will find many ways to do it.
Second, walls create bigger problems than they resolve, for they are deeply divisive. Our Mexican wall is ugly, both literally and in the unmistakable message of contempt it screams nonstop at the Mexican people. It’s generating bitterness toward us — and that turns neighbors into enemies.
Third, that wall has physically ripped healthy relationships apart. For centuries, families, friends, businesses and cities themselves were thoroughly integrated into unified communities across the artificial line drawn on a map.
Fourth, such walls are insanely expensive — so far, Washington has hurled tens of billions of dollars at this one to build, maintain and police it. Enforcement alone costs $18 billion per year. In addition, states have dumped untallied billions into it.
Can these policymakers even spell w-a-s-t-e? Yet the U.S. Senate voted overwhelmingly in June to waste another $46 billion to build 700 more miles of the hateful wall and double the number of militarized border agents.
Is there no other need in our country for that money? Nothing constructive we might do with it?
But I shouldn’t be too harsh on Washington, for both Republicans and Democrats are beginning to respond aggressively to economic needs. “It has been a tough time,” says one Washington insider, noting with relief that a new spending proposal “could help out.”
Unfortunately, he and Congress aren’t referring to your tough times or helping out with your needs. No, no — they are rushing to the aid of the multibillion-dollar military-industrial complex. The government, you see, has not been getting our nation into enough wars to satisfy the insatiable appetite that Lockheed Martin, Northrop Grumman and other war profiteers have for government money. But now they’ve spied a new place they can militarize with their high-tech, high-cost, razzle-dazzle weaponry: yes, that border we share with Mexico.
In recent months, these corporate predators deployed an army of lobbyists to Congress, armed with mass campaign contributions. Targeting the immigration issue, “border security!” is their battle cry. They’ve already conquered the Senate’s bipartisan immigration bill, stuffing it with $46 billion for goosed up militarization of the 2,000-mile border. They’ve literally turned the immigration bill into a corporate honeypot. More drones! More electronic gadgetry! More agents needing more weapons, night-vision goggles and other war toys!
Various corporate lobbyists put their specific wish lists directly in the Senate bill. Rather than calling generally for the purchase of certain categories of hardware, it mandates brand-name purchases. For example, the bill requires the border patrol to buy six airborne radar systems from Northrop at $9.3 million each and 15 Black Hawk helicopters from Sikorsky at $17 million apiece.
What we have here is the emergence of a full-fledged monster — a Border-Industrial Complex that literally will tax us with an ever-expanding policy of permanent border war.
How long before they use the cry of “terrorism!” to militarize the Canadian border, too? And what after that? My guess is they’ll want to seal off those pesky antiwar radicals in places like Vermont! Ultimately, they can fence all of us in. Or is it out?
