“Era Of Party Polarization”: GOP’s “Constitution” Confusion; Why Tom Cotton’s Silly Iran Letter Matters
As readers of my colleague Jim Newell know by now, Tom Cotton, Arkansas’ new GOP senator, is already establishing himself as one of the leading doomsayers and fearmongers in Congress, which is no small feat. Indeed, by acting as the driving force behind a provocative open letter to the leaders of Iran and helpfully informing them that any deal reached with the Obama administration over their nuclear program will ultimately be subject to the Senate’s review, Cotton has already made himself a hero to the neoconservative right. In fairness, though, that wasn’t the hardest thing to do: Cotton’s earlier warnings of a (completely fictional) alliance between Mexico’s drug cartels and ISIS, as well as his rant in defense of Guantánamo Bay, had endeared them to him already.
But while Cotton is making the media rounds and hoovering-up donations from Bill Kristol and the military industrial complex, I think it’s worthwhile to revisit a discussion that was bouncing around the left-wing corners of the Internet last week. The topic was the inherent, structural flaws of the U.S.’s presidential system — which is rickety and slow in the best of times and downright unstable in the worst — and how they were becoming increasingly hard to ignore in our era of party discipline and polarization. Because even though I don’t believe Cotton and his letter represent a constitutional crisis as some of President Obama’s allies have suggested (and is certainly not an act of treason), I do consider the freshman senator’s recent behavior to be a good window into how the presidential system’s flaws can manifest in the real world.
However, before we look at Cotton more closely, let’s do a quick and dirty recap of one of the presidential system’s more common critiques. As readers of the late political scientist Juan Linz (or Vox’s Matt Yglesias) remember, one of the issues that can arise when a presidential system features disciplined and ideological parties is a crisis of sovereignty. That’s a fancy way of describing an argument between the executive and the legislative branches over which one is really in charge. Since they exist independently, and were empowered by voters through separate elections, both can claim to represent the will of the people. And if the two branches find themselves on opposite sides of a major dispute, push can come to shove — and worse.
Applying this model to the current foofaraw over Cotton’s letter isn’t a slam-dunk, but it is still edifying. In this case, the problem is that Cotton and his fellow signatories are mucking-up the conduct of President Obama’s foreign policy, which has traditionally been seen as constitutionally (and normatively) protected. Congress always has a role in foreign policy, of course — even if recent history indicates it to be shrinking. Usually, a president is left to negotiate a deal that he then presents to Congress for approval. But Cotton and his Republican allies in the Senate are so dead-set against an agreement of any kind with Iran that they’re trying to squash the deal upfront instead.
The end result seems to be the further dissolution of what was once an unwritten rule — “politics stops at the water’s edge” — in the name of some greater good. And this is where ideology comes in. Because it’s hardly as if Congress has never disagreed with a president’s foreign policy this strongly before. They have, as the representatives and senators elected during the worst days of the Vietnam War can attest. What is different, though, is the tenor of their arguments, as well as the dispute’s supposed stakes. Hysterical warmongers like Cotton have always been with us — but rarely before have people with such radical views held so much power within either party’s caucus.
Keep this in mind about Cotton: Unless he’s an actor of Daniel Day Lewis-like talents, he sincerely believes that the consequences of a nuclear Iran would be apocalyptic. He’s said dozens of times that the only deal with Iran he’d accept is one that resulted in complete nuclear disarmament — which, as Think Progress’s Igor Volsky noted, is a demand that even the George W. Bush administration considered ridiculous. He also seems to be under the impression that Iran is even more dangerous than it is, agreeing as he does with Israel Prime Minister Benjamin Netanyahu’s claim that Iran is on the verge of going nuclear. The fact that Netanyahu’s been saying this for more than a decade, and that his own country’s leading intelligence agency disagrees, has apparently not made much of an impression.
Regardless of how broken Cotton’s assessment of the Iranian threat may be, though, he’s still a U.S. senator. And as his letter notes with a characteristic lack of subtlety, Cotton and his fellow members of the Senate are quite likely to stick around (for “perhaps decades”) while the term-limited President Obama isn’t. Which means that so long as Cotton and his allies believe a deal with Iran over its nuclear program will lead to a second Holocaust, or will strengthen Iran’s hand in its “war” with “the West,” then the kind of norms of conduct he’s breaking — like not trying to sabotage a sitting president’s foreign policy — will continue to fade into irrelevance. And so long as right-wing donors and the voters in Arkansas reward him for challenging the president’s sovereignty, while the media allows him and his allies to muddy the waters with specious claims that Obama is the one breaking protocol, he’ll have no reason to act any other way.

“A Walk Down Memory Lane On Republican Obstruction”: A Consciously Thought-Out Strategy To Create Dysfunction
For some of us its pretty galling to hear Sen. Majority Leader Mitch McConnell suggest that the way to end dysfunction in Washington is for President Obama to move to the “middle,” or to have to listen to a Republican presidential candidate opine about the lack of “adult conversations” in D.C.
For the record, here’s a little walk down memory lane of Republicans talking publicly about their strategy for obstruction:
1993 – Bill Kristol writes a memo outlining a strategy for Republicans on President Clinton’s health care reform proposal.
Faced with forceful objections in the past, the [Clinton] Administration has generally preferred to bargain and compromise with Congress so as to achieve any victory it can. But health care is not, in fact, just another Clinton domestic policy. And the conventional political strategies Republicans have used in the past are inadequate to the task of defeating the Clinton plan outright. That must be our goal…
Simple, green-eyeshades criticism of the plan…is fine so far as it goes. But in the current climate, such opposition only wins concessions, not surrender…
Any Republican urge to negotiate a “least bad” compromise with the Democrats, and thereby gain momentary public credit for helping the president “do something” about health care, should also be resisted.
2003 – Governor Deval Patrick recalls Grover Norquist’s comments on plans for a “permanent Republican majority.”
At our 25th college reunion in 2003, Grover Norquist — the brain and able spokesman for the radical right — and I, along with other classmates who had been in public or political life, participated in a lively panel discussion about politics. During his presentation, Norquist explained why he believed that there would be a permanent Republican majority in America.
One person interrupted, as I recall, and said, “C’mon, Grover, surely one day a Democrat will win the White House.”
Norquist immediately replied: “We will make it so that a Democrat cannot govern as a Democrat.”
2009 – As Michael Grunwald reported, these two ideas coalesced into a Republican plan on how to respond to the election of President Barack Obama.
…the Republican plot to obstruct President Obama before he even took office, including secret meetings led by House GOP whip Eric Cantor (in December 2008) and Senate minority leader Mitch McConnell (in early January 2009) in which they laid out their daring (though cynical and political) no-honeymoon strategy of all-out resistance to a popular President-elect during an economic emergency. “If he was for it,” former Ohio Senator George Voinovich explained, “we had to be against it.”
2010 – Having implemented that plan in response to President Obama’s proposal to reform health care, former speech-writer for President George W. Bush – David Frum – is ejected from the party for writing this:
At the beginning of this process we made a strategic decision: unlike, say, Democrats in 2001 when President Bush proposed his first tax cut, we would make no deal with the administration. No negotiations, no compromise, nothing. We were going for all the marbles. This would be Obama’s Waterloo – just as healthcare was Clinton’s in 1994…
Could a deal have been reached? Who knows? But we do know that the gap between this plan and traditional Republican ideas is not very big. The Obama plan has a broad family resemblance to Mitt Romney’s Massachusetts plan. It builds on ideas developed at the Heritage Foundation in the early 1990s that formed the basis for Republican counter-proposals to Clintoncare in 1993-1994.
Barack Obama badly wanted Republican votes for his plan…Too late now. They are all the law.
2011 – Former Republican Congressional staffer Mike Lofgren explains the strategy.
A couple of years ago, a Republican committee staff director told me candidly (and proudly) what the method was to all this obstruction and disruption. Should Republicans succeed in obstructing the Senate from doing its job, it would further lower Congress’s generic favorability rating among the American people. By sabotaging the reputation of an institution of government, the party that is programmatically against government would come out the relative winner.
So let’s be clear…this was a consciously thought-out strategy by Republicans to create dysfunction in Congress that never fit the “both sides do it” meme embraced by much of the media.
As I’ve pointed out before, President Obama has engaged a lot of different strategies to deal with this obstruction that have each had various amounts of success at different times. But as we head into the next presidential election, we’re likely to hear a lot about how Washington doesn’t work.
That will be the big challenge for the Democratic nominee in 2016. I only wish it was possible for them to take Paul Waldman’s advice.
So imagine if a candidate in the general election, or a president in his inaugural speech, said, “This is my program. I realize that the folks in the other party don’t like it. There may be a few places where we can compromise, and if so, that would be terrific. But I’m going to treat the voters like adults and tell them that I’m not expecting a whole lot of cooperation. I’m going to fight for what I promised to do when I ran, and if you don’t like the results, you can turn me out in four years.”
That would at least be honest, and nobody would be disappointed when the result is partisan fighting.
Of course he’s right when he says that would be honest. The question is…are American voters ready for honesty?

“Short-Term Pain Isn’t A Problem”: How Republicans Are Heightening The Contradictions
Congress is going on recess at the end of this week, and they’ll be doing it without a bill to address the large number of Central American children showing up at the southern border—John Boehner couldn’t even come up with a bill that would pass his house after Ted Cruz convinced House conservatives to oppose it. On that issue, on the Affordable Care Act, and on other issues as well, we may be seeing the rise of a particular strategy on the right—sometimes gripping part of the GOP, and sometimes all of it—that can be traced back to that noted conservative Vladimir Lenin. I speak of “heightening the contradictions,” the idea that you have to intentionally make conditions even more miserable than they are, so the people rise up and cast off the illegitimate rulers and replace them with you and your allies. Then the work of building a paradise can begin.
In the end, the House GOP leadership wanted a bill that contained a small amount of money to actually address the problem, made a policy change Republicans want (expediting deportations of Central American children), and did some things that don’t address the problem at all (like beefing up border security, which is irrelevant since these kids are happily turning themselves in). But the conservatives wanted to attach a provision to the bill that would also undo the Deferred Action for Childhood Arrivals (DACA) program, under which “dreamers” who have been in the U.S. since before 2007 can stay under certain conditions.
As Cruz and his allies knew quite well, while the broader GOP bill faced an uncertain fate in the Senate, a bill that had DACA repeal attached to it had zero chance of passing there. So what was the point? It may be that they were thinking along the same lines as conservative wise man Bill Kristol, who today told Republicans to pass nothing and let Barack Obama take the blame:
If the GOP does nothing, and if Republicans explain that there’s no point acting due to the recalcitrance of the president to deal with the policies that are causing the crisis, the focus will be on the president. Republican incumbents won’t have problematic legislation to defend or questions to answer about what further compromises they’ll make. Republican challengers won’t have to defend or attack GOP legislation. Instead, the focus can be on the president—on his refusal to enforce the immigration law, on the effect of his unwise and arbitrary executive actions in 2012, on his pending rash and illegal further executive acts in 2014, and on his refusal to deal with the real legal and policy problems causing the border crisis.
Hooray! Sure, the crisis that they’re allegedly so angry about would continue unabated. But what’s that next to a little political difficulty for Barack Obama?
Something quite similar is happening on the Affordable Care Act. The phrase you now hear from everyone on the right is that the law will “collapse under its own weight,” which is a way of saying that even though there’s been nothing but good news lately about how the law is going, it’s so awful that it will inevitably cause such horrible suffering that everyone will come to agree with us that it must be repealed. “I think it’s going to collapse under its own weight in time,” says Paul Ryan. “Obamacare will collapse under its own weight,” writes Phil Gramm in the Wall Street Journal. “Eventually, all this is going to collapse around them,” says Rep. Marsha Blackburn about the law.
That “collapse” is a fantasy that will never happen, but let’s take them at their word when they say it will. While they never get specific about what the collapse will look like, by definition it would be disastrous for millions of Americans. Would they lose their insurance coverage, or be unable to get treatment for serious medical conditions? It would have to be something like that to constitute a “collapse.” And the Republican position isn’t, “This collapse is coming, so we’d better work hard to make sure it doesn’t and insulate vulnerable Americans from its effects.” Instead, their position is, “This collapse is coming, so we’ll just wait until the nightmare of suffering and death plays itself out, after which we’ll be there to offer our as-yet-undetermined health care alternative.”
The Halbig lawsuit that Republicans are all guffawing about was nothing if not an effort to heighten the contradictions and accelerate the collapse. If it succeeds, insurance subsidies will be taken away from Americans in 36 states, making coverage unaffordable for millions. Republicans won’t say explicitly that this is the outcome they desire, but it’s the only reason to file the lawsuit in the first place. And of course, if the disaster of those millions losing coverage was something Republicans wanted to forestall, they could do it in an afternoon. Just pass a short bill making clear that subsidies apply in every state, and the problem would be solved. But that, of course, wouldn’t heighten the contradictions.
This idea has its limits—for instance, Congress is probably going to pass some short-term fix for the highway trust fund before tomorrow. But that’s because it would be harder for Republicans to escape blame for the consequences when all those construction projects start shutting down. If there’s any way at all for Obama can take the fall on an issue, they’ll do it.
To be sure, there is a certain logic at work here. Like every political party, today’s Republicans believe that if they were in complete control, their preferred policies would be so glorious and work so well that the total of suffering in the country would be reduced to microscopic levels. So some increased suffering in the short term is tolerable if it helps us get closer to that future nirvana. That’s of some reassurance, right?

“June Is GOP Throwback Month”: Republicans Are Not Trying Very Hard To Escape Their Past
The right has long seemed stuck in the 1980s, ever basking in Ronald Reagan’s warm glow and policy solutions. This month it seems conservatives have decided to switch things up and temporally relocate themselves to the 2000s, if just for a little while.
So a giant squirrel is following former Secretary of State Hillary Clinton around the country on her book tour. Seriously. The Republican National Committee has dispatched someone in a bright orange squirrel costume to appear at her book events. The costume, Mother Jones reported this week, is left over from a similar 2008 publicity stunt in which the party used the squirrel to illustrate its concerns about ACORN, the now-defunct voter mobilization group. There was a logic to it then – squirrels and acorns – but now it’s as if someone at the RNC was cleaning out a closet, came across the squirrel suit and thought to themselves: Well, we can’t let this beauty go to waste. So the squirrel now wears a T-shirt which reads, “Another Clinton in the White House is Nuts.”
That sentiment neatly channels one of the early, sanctimonious premises of the George W. Bush presidency – the idea of Clinton fatigue, that the country didn’t want any more of the 42nd president, that “America wants somebody to restore honor and dignity to the White House,” as Bush put it while campaigning for the office. That somebody at the RNC thinks describing a return to Clintonism as “nuts” indicates that that particular delusion hasn’t been dislodged in the intervening 14 years. Remember that when he left office Bill Clinton enjoyed a 66 percent approval rating, according to Gallup. And just this week a Wall Street Journal/NBC News/Annenberg poll found that he is easily the most admired president of the last quarter century, with 42 percent of respondents naming him the most admired chief executive in that time. That’s light-years ahead of President Barack Obama (18 percent), the Bush who succeeded Clinton (17) and the one who preceded him (16). Peace and prosperity will do that for you.
Of course the Bush presidency reoriented itself after 9/11, and we’re getting a flashback of those years as well, thanks to the collapse of the Iraqi armed forces in the face of the jihadist Islamic State of Iraq and the Levant (an al-Qaida splinter group) and the civil war in Syria. So the whole neocon cast that devised the original Iraq fiasco have crawled out of the GOP memory hole apparently intent on proving the old Karl Marx-ism that history repeats itself first as tragedy then as farce. “This is about preventing another 9/11,” former Deputy Defense Secretary Paul Wolfowitz said on MSNBC this week, having updated his talking points not a wit from the first time he advocated sending armed forces into Iraq. Writing on The Weekly Standard’s website, Fred Kagan and Bill Kristol argue for air strikes and ground troops as “the only chance we have to persuade Iraq’s Sunni Arabs that they have an alternative to joining up with” al-Qaida or facing government death squads. Truly nothing persuades people of our benevolent intentions like bombing and invading their country. We’ll be greeted as liberators – just like we were the first time, right?
But the award for abject lack of self-awareness goes to former Vice President Dick Cheney, who wrote with his daughter in The Wall Street Journal this week: “Rarely has a U.S. president been so wrong about so much at the expense of so many.”
Meanwhile back in the original Bush country – Texas – the 43d president’s gubernatorial successor this month channeled one of the uglier aspects of the 2004 presidential campaign, shameless gay-bashing. Recall the role played in the Bush re-election campaign of riling up the social right with state level campaigns against gay marriage. Speaking in San Francisco last week, Texas Gov. Rick Perry compared homosexuality with alcoholism, saying that both afflictions can be resisted with a sufficient amount of will power. This sort of noxious comparison might have been unremarkable a decade ago, but times have changed and rapidly, with polls now showing majorities of Americans favoring marriage equality, for example. In 2014 it draws rebukes like this one, from CNBC host Joe Kernen: “I don’t think gay marriage leads to cirrhosis of the liver or domestic violence or DWIs.” Yeah, there is that.
Perry seems to have gotten the message, telling reporters at a press lunch on Thursday that he – and the GOP in general – shouldn’t get “deflected” onto social issues like the nature of homosexuality. “I stepped right in it,” he said.
Adjusting to rapid change can be hard, doubly so for conservatives whose ideology inherently resists it. Perhaps the best recent example of that emerged this week from North Carolina. State House Speaker Thom Tillis, the GOP Senate nominee, told “Carolina Business Review” in 2012 (the interview was ferreted out this week by Talking Points Memo) that “the traditional population of North Carolina and the United States is more or less stable. It’s not growing. The African-American population is roughly growing but the Hispanic population and the other immigrant populations are growing in significant numbers. We’ve got to resonate with those voters.” When asked whether Tillis was characterizing whites as the state’s and the country’s “traditional population,” his spokesman said no, that he was merely referring to “people who have been in North Carolina for a long time.” This is transparent nonsense. He contrasted the “traditional” population with, among others, the African-American population, which I’m fairly certain has been in the Tar Heel State for some time now.
But take a step back and look past the offensive content: Tillis was answering a question about his party’s inability to appeal to minorities, so when he talked about non-“traditional” voters he was doing so in the context of wanting to “resonate” with them. If this is the right’s idea of reaching out, it’s going to be a long decade for them – no wonder they’re trying to C.

“No Remaining Credibility”: 5 Iraq ‘Experts’ Who Are Always Wrong About Iraq
American pundits have an unusual profession; it is one of the only careers in which repeated, catastrophic, and humiliating failures seem to do nothing to prevent one from continuing to find work. Just ask Dick Morris.
The media’s tendency to forgive blown predictions and provide airtime and column inches to guests with little to no remaining credibility has become particularly offensive since the Iraq situation rapidly devolved into crisis. Despite the fact that those who made the case for the war helped end thousands of lives and waste trillions of dollars, many of those who have been proven to understand nothing of the country have been welcomed back as “experts” on the disaster.
Here are five of the worst offenders:
Judith Miller
On Friday, Fox News contributor Judith Miller took it upon herself to criticize the media’s coverage of the situation in Iraq.
“There have been a couple of reporters who have stayed in Iraq, who have been covering the growing power of ISIS…but the American media are so busy playing the blame game, ‘who’s responsible for this debacle,’ that they don’t even pay attention to a story that was there, and available for all to cover,” Miller complained.
“Did the media buy the line from the administration?” host Eric Shawn later asked Miller.
“It’s really a failure — another, yet another — failure of reporting,” Miller said.
This is, as The Huffington Post’s Jack Mirkinson deftly put it, “a turn of events that could signal the departure of all irony from the world.” After all, through her catastrophically flawed reporting in the buildup to the war, Miller arguably did more than anyone alive to advance the myth that Saddam Hussein possessed stockpiles of weapons of mass destruction. It would be almost impossible to find someone less qualified to criticize journalists for their Iraq reporting.
Douglas Feith
Douglas Feith, who served as the undersecretary of defense for policy during the Bush administration, ripped President Obama’s approach to Iraq in comments to Politico on Thursday:
“This is the education of Barack Obama, but it’s coming at a very high cost to the Syrian people, to the Iraqi people [and] to the American national interest,” said Doug Feith, a top Pentagon official during the George W. Bush administration.
“They were pretty blasé,” Feith said of the Obama team. “The president didn’t take seriously the warnings of what would happen if we withdrew and he liked the political benefits of being able to say that we’re completely out.”
While credulously quoting Feith’s opinion on the situation in Iraq, Politico declined to note that Feith was in charge of postwar planning after President Bush declared the fiasco to be “Mission Accomplished.” It did not go well.
Rather than being presented as an expert on how the president should manage the crisis in Iraq, Feith may be better remembered as he was once described by retired general Tommy Franks: “The dumbest fucking guy on the planet.”
Paul Wolfowitz
On Sunday, NBC’s Meet The Press invited former deputy secretary of defense Paul Wolfowitz to argue, essentially, that we should have stayed in Iraq for decades.
“We stuck with the Kurds through 20 years. Northern Iraq, Kurdistan’s a success story. We stuck with South Korea for 60 years. South Korea is a miracle story. But if we had walked away from South Korea in 1953, that country was a basketcase,” he said.
Wolfowitz is another odd choice for an Iraq expert, considering that — like most of the neoconservatives in the Bush administration’s Pentagon — he has a remarkable record of being wrong about almost everything related to the war.
It’s not like Wolfowitz doesn’t know that it was a catastrophe; when MSNBC’s Chuck Todd introduced him as the “architect” of the 2003 invasion during yet another talking-head appearance on Tuesday, Wolfowitz immediately pushed back.
“If I had been the architect, things would have been run very differently,” he insisted. “So, that’s not a correct label.”
Bill Kristol
Weekly Standard editor Bill Kristol has a long and well-earned reputation for being America’s least accurate pundit (non-Dick Morris division). But the nadir of his busted analysis centered around the Iraq War, for which he fully embraced the flawed case. Kristol claimed at various points that “American and alliance forces will be welcomed in Baghdad as liberators” and that “there’s almost no evidence” that the country’s Sunni and Shia populations might clash, among many, many other false assertions.
That still didn’t stop ABC’s This Week from inviting Kristol to analyze the current situation in Iraq. Unsurprisingly, he blamed President Obama:
“It’s a disaster made possible by our ridiculous and total withdrawal from Iraq in 2011,” he argued. Kristol added that President Obama was wrong when he declared the war was over.
“President Obama said two days before election day, in 2012, Iraq is on the path of defeat, the war in Iraq is over. That was enough to get him re-elected. Iraq is on the path of defeat. Neither is true. It’s a disaster for our country,” Kristol said.
Nevermind the fact that Kristol himself predicted that the conflict would “be a two-month war” — and declared it “won decisively and honorably” in April 2003.
John McCain
Perhaps no supporter of the Iraq War has been more shameless in his criticism of President Obama than his opponent in the 2008 presidential campaign, Senator John McCain (R-AZ).
“Lindsey Graham and John McCain were right,” the Arizona senator boasted of himself and his South Carolina colleague on the Senate floor. “Our failure to leave forces on Iraq is why Sen. Graham and I predicted this would happen.”
“We had it won,” McCain later said during one of his many cable news appearances. “General Petraeus had the conflict won, thanks to the surge. If we had left a residual force behind, we would not be facing the crisis we are today. Those are fundamental facts … The fact is, we had the conflict won. We had a stable government … But the president wanted out, and now, we are paying a very heavy price. And I predicted it in 2011.”
As MSNBC’s All In with Chis Hayes recently illustrated, McCain doesn’t exactly have the best record on the topic. Much like Kristol, McCain was certain that Iraq had WMD, that Americans would be greeted as liberators, that the war would essentially pay for itself, and that sectarian violence in the country would never ignite: http://player.theplatform.com/p/2E2eJC/EmbeddedOffSite?guid=n_hayes_montage_140612
Don’t expect the Arizona Republican to evolve on the issue, by the way; he’s too busy knocking the president to bother attending Senate hearings on the crisis.
