“White Progressives’ Racial Myopia”: Why Their Colorblindness Fails Minorities — And The Left

Sen. Bernie Sanders, the lifelong crusader for economic justice now running for the Democratic presidential nomination, has serious civil rights movement cred: he attended the historic 1963 March on Washington, where Dr. Martin Luther King Jr. and a quarter million people changed the country’s course when it came to race. It would be wrong and unfair to accuse him of indifference to issues of racial equality.

But in the wake of his picture-postcard campaign launch, from the shores of Vermont’s lovely Lake Champlain, Sanders has faced questions about whether his approach to race has kept up with the times. Writing in Vox, Dara Lind suggested that Sanders’ passion for economic justice issues has left him less attentive to the rising movement for racial justice, which holds that racial disadvantage won’t be eradicated only by efforts at economic equality. Covering the Sanders launch appreciatively on MSNBC, Chris Hayes likewise noted the lack of attention to issues of police violence and mass incarceration in the Vermont senator’s stirring kick-off speech.

These are the same questions I raised last month after watching Sen. Elizabeth Warren and New York Mayor Bill de Blasio hail the new progressive movement to combat income inequality at two Washington D.C. events. Both pointed to rising popular movements to demand economic justice, most notably the “Fight for $15” campaign. Neither mentioned the most vital and arguably most important movement of all, the “Black Lives Matter” crusade. (Which is odd, since “Fight for $15″ leaders have explicitly endorsed their sister movement.) And the agendas they endorsed that day made only minimal mention, if they mentioned it at all, of the role that mass incarceration and police abuse plays in worsening the plight of the African American poor.

Looking at the overwhelmingly white Bernie Sanders event last week, I saw it again: the rhetoric and stagecraft employed by white progressives whom I admire too often –inadvertently, I think — leaves out people who aren’t white. Of course, Sanders’ home state of Vermont is 96 percent white, so his kickoff crowd predictably reflected that. But his rhetoric could have told a more inclusive story.

So could Elizabeth Warren’s. I love her stirring stories about her upbringing: the days when her mother’s minimum wage job could support a family, when unions built the American middle class, and when Warren herself could attend a public university for almost nothing. Like a lot of white progressives, she points to the post World War II era as a kind of golden age when income inequality flattened and opportunity spread, the result of progressive action by government. I’ve written about the political lessons of that era repeatedly myself.

But the golden age wasn’t golden for people who weren’t white. Yes, African American incomes rose and unemployment declined in those years. But black people were locked out of many of the wealth-generating opportunities of the era: blocked from suburbs with restricted covenants and redlined into neighborhoods where banks wouldn’t lend; left out by the GI Bill, which didn’t prevent racial discrimination; neglected by labor unions, which discriminated against or outright blocked black members. (That’s why I gave my book, “What’s the Matter with White People?”, the subtitle “Why We Long for a Golden Age that Never Was.”)

Conservatives look back at those post-World War II years as a magical time when men were men, women raised children, LGBT folks didn’t exist or stayed closeted, and the country was white. Progressives point to the government support that created that alleged golden age, but they too often make it sound rosier than it was for people who weren’t white. In fact some of those same policies of the 1950s helped create the stunning disparities between black and white family wealth, which leaves even highly paid and highly educated African Americans more vulnerable to sliding out of the middle class.

All of this leaves white progressives vulnerable to charges that they don’t understand the political world they live in today.  “I love Elizabeth, but those stories about the ‘50s drive me crazy,” one black progressive told me after a recent Warren event.

Dara Lind points to Sanders’ socialist analysis as a reason he’s reluctant to focus on issues of race: he thinks they’re mainly issues of class. She samples colleague Andrew Prokop’s Sanders profile, which found:

Even as a student at the University of Chicago in the 1960s, influenced by the hours he spent in the library stacks reading famous philosophers, (Sanders) became frustrated with his fellow student activists, who were more interested in race or imperialism than the class struggle. They couldn’t see that everything they protested, he later said, was rooted in “an economic system in which the rich controls, to a large degree, the political and economic life of the country.”

Increasingly, though, black and other scholars are showing us that racial disadvantage won’t be undone without paying attention to, and talking about, race. The experience of black poverty is different in some ways than that of white poverty; it’s more likely to be intergenerational, for one thing, as well as being the result of discriminatory public and private policies.

Ironically, our first black president has exhausted the patience of many African Americans with promises that a rising economic justice tide will lift their boats. President Obama himself has rejected race-specific solutions to the problems of black poverty, arguing that policies like universal preschool, a higher minimum wage, stronger family supports and infrastructure investment, along with the Affordable Care Act, all disproportionately help black people, since black people are disproportionately poor.

At the Progressive Agenda event last month, I heard activists complain that they’d been told the same thing: the agenda will disproportionately benefit black people, because they’re disproportionately disadvantaged, even if it didn’t specifically address the core issue of criminal justice reform. (De Blasio later promised the agenda would include that issue.) But six years of hearing that from a black president has exhausted people’s patience, and white progressives aren’t going to be able to get away with it anymore.

Hillary Clinton could be the unlikely beneficiary of white progressives’ stumbles on race. The woman who herself stumbled facing Barack Obama in 2008 seems to have learned from her political mistakes.  She’s taken stands on mass incarceration and immigration reform that put her nominally to the left of de Blasio’s Progressive Agenda on those issues, as well as the president’s. Clinton proves that these racial blind spots can be corrected. And American politics today requires that they be corrected: no Democrat can win the presidency without consolidating the Obama coalition, particularly the African American vote.

In fact, African American women are to the Democrats what white evangelical men are to Republicans: the most devoted, reliable segment of the party base. But where all the GOP contenders pander to their base, Democrats often don’t even acknowledge theirs. Clinton seems determined to do things differently, the second time around. The hiring of senior policy advisor Maya Harris as well as former Congressional Black Caucus director LaDavia Drane signal the centrality of black female voters to the campaign. In a briefing with reporters Thursday in Brooklyn, senior Clinton campaign officials said their polling shows she’s doing very well with the Obama coalition, despite her 2008 struggles – but she’s taking nothing for granted.

Pointing to Warren and Sanders’s shortcomings when it comes to racial politics doesn’t mean they’re evil, or they can’t learn to see things with a different frame. But they’re going to have to, or they’ll find that the populist energy that’s eclipsing Democratic Party centrists will be dissipated by racial tension no one can afford.

“The NYPD Slowdown’s Dirty Little Secret”: Not All Of Them Want The Slowdown To End

The police slowdown in New York, where cops have virtually stopped making certain types of low-level arrests, might be coming to an end soon. For a lot of police officers, it’ll be an unhappy moment, because they never liked making the penny ante collars in the first place.

“We’re coming out of what was a pretty widespread stoppage of certain types of activity, the discretionary type of activity by and large,” police commissioner Bill Bratton told NPR’s Robert Siegel in an interview Friday.

In the rank and file of the police department, there are mixed feelings about the slowdown and a possible return to the status quo.

“I’d break it down like this,” an officer in East Harlem told The Daily Beast. “20 percent of the department is very active, they’d arrest their mothers if they could, and they want to get back to work. Another 20 percent doesn’t want any activity period; they’d be happy to hide and nap all day.”

The officer added, “And then there’s the great middle that thinks things are fine now as far as their concerned and all they want is good arrests.”

The not good arrests, by implication, were all the low level infractions policed as part of the so-called “Broken Windows” approach to law enforcement, defended by both Bratton and Mayor de Blasio. It holds that one of the ways to bust high-level crooks is to crack down on seemingly minor crimes.

Between December 29 2014—January 4 2015, arrests across New York city dropped by 56 percent and summonses were down 92 percent compared to the same time last year.

It’s not novel to point out that the police slowdown, which pitted the police and their unions against city hall, granted one of the central demands of the #blacklivesmatter protestors—an end to Broken Windows policing.

Less noted though, is how many police officers are themselves ambivalent about actively enforcing low level offenses, and how that bodes for the post-slowdown future of policing in New York.

Retired NYPD lieutenant Steve Osborne made the point in an op-ed for the New York Times that was sharply critical of both de Blasio and the protestors.

“More police productivity has meant far less crime, but at a certain point New York began to feel like, yes, a police state, and the police don’t like it any more than you,” Osborne wrote.

“The time has probably come for the Police Department to ease up on the low-level ‘broken-windows’ stuff while re-evaluating the impact it may or may not have on real, serious crime,” he added. “No one will welcome this more than the average cop on the beat, who has been pressed to find crime where so much less of it exists.”

Day to day, no one has been telling police officers in New York how not to do their jobs.

“It sounds very unusual,” the officer in East Harlem said, “but I haven’t seen any coordinated activity besides the union putting the message out and then saying jump.”

It hasn’t taken much effort to coordinate the slowdown because, as Osborne notes, average beat cops were never that excited in the first place with going after public urination and loitering arrests. To them, it was a distraction from stopping more serious crimes.

Broken Windows advocates argue that some cops always resisted more active policing. When Broken Windows was first introduced, they say, police officers had to be pushed, by Bratton among others, to adopt the active policing approach that brought crime down to its current historic lows in new York.

But as New York got safer, the methods rather than the results became the measures of success. More arrests meant better policing as the tail started to wag the dog.

Bratton himself has said nearly as much in criticizing his predecessor Ray Kelly’s overuse of the controversial stop and frisk tactic that overwhelmingly targeted minorities.

“The commissioner and the former mayor did a great job in the sense of keeping the community safe, keeping crime down, but one of the tools used to do that, I believe, was used too extensively,” Bratton said in March 2014.

Stop and Frisks have fallen considerably since their high in 2011 when 685,724 New Yorkers were stopped by police, but some numbers driven approaches remain embedded in the department.

As a detective in the Bronx tells The Daily Beast, “there technically are no quotas” in the police department “but you can call them what you want, “productivity goals,” they are back door quotas.”

And those back door quotas can put pressure on officers.

“I have to suspend my disbelief,” the officer in East Harlem said, “to see how sentencing a guy with an open container is going to really bring crime down.”

“Violent crimes haven’t gotten worse in my little slice of heaven despite the slowdown on summonses and misdemeanors,” the officer added. “We’re still responding to robbery patterns. We haven’t gone down in presence for the more serious offenses.”

He acknowledged that it was too soon to say how such a policing strategy would play out over an extended period. “Whether it works will reveal itself over time. That remains to be seen.”

Once New York is out of the slowdown, it’s not clear what kind of policing the city will see on the other side. Will Bratton push the police to bring arrests back up to levels before they dropped off or will the department test its ability to back off?

Maybe there will be some new middle ground possible despite the bluster and rhetoric. According to The Daily News, the combative president of the police union is pushing for just a slowdown that’s a little bit faster. As one police source told the paper, “He said they should go back to at least 50% of what they used to do.”

“For NYPD, No Defense For The Indefensible”: Support Good Cops, Oppose Bad Ones

This should not even need saying, but obviously, it does. So, for the record:

To oppose police brutality is not to oppose police. No one with a brain stands against police when they do the dangerous and often dirty job of safeguarding life and property. But no one with a conscience should stand for them when they assault or kill some unarmed, unthreatening somebody under color of authority.

Support good cops, oppose bad ones: You’d think that a self-evident imperative. But it turns out some of us are unwilling to make the distinction. For them, the valor of the good cops renders the bad cops immune to criticism.

As you’ve no doubt heard, an unstable man named Ismaaiyl Brinsley went cop hunting in Brooklyn on Dec. 20. He randomly shot to death two police officers, Rafael Ramos and Wenjian Liu, in retaliation for the unpunished police killings of two unarmed African-American men in Ferguson, Missouri, and Staten Island, New York.

What followed was tiresomely predictable. Erick Erickson of Fox “News” said President Obama and New York City mayor Bill de Blasio had “all but encouraged retaliation” against police. Rudy Giuliani accused the president and the mayor of putting forth propaganda that “everybody should hate the police.” The National Review Online blamed Obama and de Blasio for creating a “racially charged, rabidly anti-police” atmosphere.

It might be hard to tell from that superheated rhetoric, but the sin they refer to is as follows: Obama and de Blasio called for reform as people vigorously protested the Staten Island and Ferguson killings.

Tempting and easy as it might be to deconstruct all that right-wing drivel, what should truly trouble us is the behavior of the police in the wake of the shooting. Meaning those New York cops who pointedly turned their backs on the mayor as he spoke at Ramos’ and Liu’s funerals. The NYPD has also engaged in a work slowdown — arrests, tickets and summonses down sharply over the last two weeks.

With this temper tantrum, this turning its back on the representative of the people it serves, the NYPD shames itself, shames its profession, and dishonors the memory of its slain men. It also, paradoxically, makes stronger the case for reform.

What other profession behaves this way? Do good lawyers see an attack on bad lawyers as an attack on them all? Are good firefighters threatened by criticism of incompetent ones? Yet this behavior is routine among police — something to keep in mind when we talk reform.

It’s all well and good to say we need body cams, but that’s just a start. As the cases of Rodney King in Los Angeles and Eric Garner in Staten Island make apparent, a visual record is useless if people are unwilling to see what is right in front of them. And yes, there should also be some state-level mechanism for a special prosecutor in cases like these, so we are never again asked to believe impartial justice can be meted out to a given cop by people in the local courthouse who work with him every day.

But the behavior of New York cops, their righteous pique at the idea of being questioned by the people they work for, suggests another needed reform. We must find ways to change police culture so that it becomes easier for cops to police themselves, to name and shame the brutal or trigger-happy incompetents among them.

Yes, that will be much easier said than done: In no other job might your life depend tomorrow on the colleague you stand up against today. But the alternative is this status quo wherein police are effectively above the law they swear to uphold.

Where bad cops cannot be questioned, good cops cannot be trusted — and all cops are undermined.

There’s something else that should not need saying, but does.

“Perpetuating Itself”: America’s War Machine Sells Fear And Loathing Beyond Ferguson; Black And Brown People Pay The Price

The War Machine is the violent nexus of military and economic forces that grinds us up to perpetuate itself. With politicians of all stripes in its pockets and buoyed by lobbyists, the War Machine is beyond the reach of civil government and easily tramples individual souls, especially when they inhabit bodies of color. War is a big, multi-trillion-dollar business, requiring the sales, construction and operation of guns, drones, missiles, governmental armies, private armies, public prisons, private prisons and the like.

While the War Machine has been operated most obviously overseas in places like the Middle East, and domestically behind bars, it is now increasingly clear that the War Machine is also operating on America’s streets.

The War Machine has always made for strange bedfellows. Even as the conflict in Afghanistan, America’s longest foreign war, ostensibly ends, America’s largest police department and its union are in sometimes open conflict against their civilian commander, supported by a right wing that normally hates public unions.

The NYPD’s beef with its chief? That Mayor Bill de Blasio merely said he had “the talk” about police that all parents of black boys have with their sons. My father had it with me, as did every parent of every black person I know. But the War Machine will accept no criticism, ever: not for torturing brown people overseas, nor for making brown children fear police at home.

Beware she who dares to speak out at such times. When a Fox affiliate selectively edits the words of Baltimore protester Tawanda Jones to make it sound as if she said “kill a cop” when she did not, it is an example of how the War Machine hates dissent. Speech feels as under assault now as it did after 9/11, because it’s one thing for the press to express its belief, however misguided, that the exercise of free speech isn’t warranted. But it should be another for government officials to declare if, when and how dissent is appropriate. In 2001, George W Bush’s press secretary, Ari Fleischer, once warned “all Americans that they need to watch what they say, watch what they do”; in 2014, de Blasio declared after the shooting of two police officers that it was time to “put aside political debates, put aside protests”. Protest and dissent scare the War Machine.

Moments of crisis are a prime time to sell fear, and “patriotic” policy, and guns. Demanding considerations of peace leading up to a foreign war threaten those sales. Demanding a consideration of the 1,100 people killed by American police last year, even after two police officers have been killed, may similarly threaten the standard narrative – and that’s why it’s so important for protesters to keep forcing this conversation, about real lives and real justice and real reform, right now.

Because Washington won’t. Our national consciousness may now be raised about the dangers of arming of our local police departments with military-grade weapons after citizens across the nation demanded that black lives, indeed, matter. Our eyes may have been opened to torture committed by our military. But neither the right nor the “left” in Washington have any plans to punish the torturers – nor stem the flow of military equipment intended for use against civilians into Ferguson, Brooklyn and beyond – anytime soon.

When I watched, with horror, as the mother of Antonio Martin realized live on Ustream that her son had just been shot by police, I thought to myself, “The War Machine will be gunning for her next.” It will blame her for being the cause of police violence against black bodies, and not examine the context in which that violence occurred. The War Machine does not want us as a society to ask of ourselves the difficult questions about why it is that black people, abroad and at home, have been kept in the margins and away from economic opportunity, employment, education and safety. It prefers that we maintain the status quo and uncritically support the state, no matter how violent and oppressive.

The War Machine will say, at best, that the answer to such violence against civilians is merely technological, because driving up the sale of body-cams and more guns is what it does so well. But, more likely, the War Machine will want to make an example of Antonio Martin’s mother: that she and her son are a good excuse for more surveillance of black bodies, even though we know over-policing does not reduce crime.

Of course, the War Machine doesn’t care particularly about black mothers or black women. The story of a deranged man from Georgia going on a shooting spree has been entirely about the death of two police officers in New York, and hardly at all about the shooting of Shaneka Thompson in Baltimore. Similarly, the War Machine doesn’t care especially about Officers Wenjian Liu and Rafael Ramos as individuals; like Ismaaiyl Brinsley did, it just sees them as cops. To the War Machine, violence must repeat itself: that’s why those officers’ deaths are being heralded as an occasion to suspend dissent – as a moment of “grieving, not grievance” – and not as a time to question American violence overall.

The War Machine has always had an insatiable need for bodies of color from before the birth of this nation. The genocide of Native Americans, the Atlantic Slave trade of Africans, the conquest of Mexicans, the colonization of Filipinos and Hawaiians, the mass importation of Chinese workers subsequently denied citizenship under the Chinese Exclusion Act: the War Machine created and then expanded the size of the United States using non-white bodies, waging war against them, and making them second-class citizens (when it deigned to make them citizens at all). Though the 13th Amendment ended legal slavery, it did not end the War Machine’s assault on black people, which has simply morphed from slavery, sharecropping and Jim Crow segregation, to modern day schools which are just as segregated, police violence, economic exploitation and mass incarceration. The War Machine has so effectively decimated the black community, for example, that for the few of us who do manage to get, say, an education, it is almost meaningless as a way to move up in the world.

The Black Lives Matter movement is about more than just justice for our deaths: it’s about the depreciation of black life in the service of accumulation of stuff for white people, from slavery to “security” to shopping. This status quo is protected, often violently, by police. And now as the War on Terror (allegedly) scales down, there is an oversupply of “stuff” used to commit violence in the name of quelling it – and an undersupply of violence to quell. The “ongoing slippage between policing and war that still visibly characterizes the present”, as the historian Nikhil Pal Singh recently observed, shouldn’t be seen as mere coincidence: it’s the War Machine coming home, and coming home as hungry as ever.

“Who Should Investigate Police Abuse?”: When Local DA’s Investigate Local Police Officers, There Is An Inherent Conflict Of Interest

The national conversation about police abuse will shortly take a new turn. Following the failures of local grand juries to bring charges against the white police officers who killed Michael Brown in Ferguson, Missouri, and Eric Garner, in Staten Island, protesters around the country took to the streets. Then, after the murders of the New York police officers Rafael Ramos and Wenjian Liu in Brooklyn on December 21st, a fierce backlash against the anti-police protests began. The result is a sour standoff, with opposing sides united only in their sense of victimhood. Protesters shout “I can’t breathe,” and cops turn their backs on Mayor Bill de Blasio—but now what?

To date, one serious proposal for reform has emerged. On December 8th, Eric Schneiderman, the Attorney General of New York, proposed that Governor Andrew Cuomo name him, Schneiderman, as an independent special prosecutor to investigate and, if appropriate, prosecute police officers in any situation where they cause the death of a civilian. As Schneiderman noted in his letter to the governor, the proposal seeks to address a real problem. When local district attorneys investigate local police officers, there is an inherent conflict of interest. In virtually all usual circumstances, police and prosecutors are partners, working together to build cases against defendants. This is especially true in a place like Staten Island, where the elected district attorney, Dan Donovan, both works closely with the police and answers to many of them as his constituents. As Schneinderman noted, on the rare occasions when prosecutors investigate the police, even when all parties act with the best of intentions, “the question is whether there is public confidence that justice has been served, especially in cases where homicide or other serious charges against the accused officer are not pursued or are dismissed prior to a jury trial.” Cases, in other words, like those of the officers who killed Brown and Garner. (Cuomo has hedged in response to Schneiderman’s idea, saying that he wants to weigh a full package of reforms.)

Schneiderman’s proposal met with a fiercely negative response from an unexpected quarter. Kenneth Thompson, the newly elected district attorney in Brooklyn, blasted Schneiderman’s proposal as “unworkable” and an insult to the state’s sixty-two elected district attorneys. Thompson, a Democrat, is hardly a mouthpiece for his colleagues in law enforcement; he defeated an incumbent district attorney, in significant part, by criticizing the cozy relationship between police and prosecutors in the borough. In his objections to Schneiderman’s proposal, Thompson pointed to potential practical problems—saying that it would stretch the attorney general too thin, particularly if it came to include all accusations of police brutality, not just those that ended in death. But Thompson’s objections were also more profound. “As the duly elected district attorney of Brooklyn, I am more than able to thoroughly and fairly investigate any fatality of an unarmed civilian by a police officer,” Thompson said. Indeed, Thompson recently brought a police-brutality case against two officers, and is investigating the recent police-shooting death of an unarmed man in a housing project.

The conflict between Schneiderman and Thompson illustrates a paradox, even a contradiction, in the criminal-justice system. New York, like most states, has a regime of elected countywide prosecutors. The idea is that law enforcement should respond to the needs of the local community, and for the subjective needs of the community to be paramount. But the system also demands objectivity—an ideal of justice untainted by the special interests of the locals. This is the heart of the conflict over Schneiderman’s idea, and both sides can point to examples that prove their point. It is true that local prosecutors like Thompson have, on occasion, brought successful cases against local police officers. And outsiders, who are not subject to the usual checks and balances on prosecutors, can abuse their freedom. “When you start to talk about special prosecutors—do we really want another Ken Starr?” Frank Sedita, the Erie County District Attorney, asked in response to Schneiderman, referring to the federal independent counsel who led the investigation of President Bill Clinton. The risk, according to Sedita, is ending up with “somebody who is not accountable to the public and specifically not accountable to the citizens of that county.”

Schneiderman’s idea has considerable appeal; his judgment in the Eric Garner case would surely have had more credibility than the one rendered by Donovan. Still, special prosecutors are not necessarily good or bad. Like the locals they replace, they are only as good as the cases they bring, or refrain from bringing. That, ultimately, will rest on the good judgment of the individuals involved, and no one has yet figured out a way of putting the right person in place all the time.
