The World According To Clarence Thomas And Ayn Rand
The Los Angeles Times highlights some of Justice Clarence Thomas’s more extreme solo opinions, most of which seem to be rooted in this: every year Thomas has his new clerks come to his home to watch a movie—”the 1949 film version of the classic of libertarian conservatism, Ayn Rand’s The Fountainhead.”
Explains a lot, and not just his willingness to be the only (often crazy) dissenter on key cases.
Among them, he has declared that the Constitution gives states a right to establish an official religion. Prisoners, he wrote, have no constitutional right to be protected from beatings by guards. Teenagers and students have no free-speech rights at all, he said in an opinion Monday, because in the 18th century, when the Constitution was written, parents had “absolute authority” over their children.Two years ago, the court ruled that a school official could not strip-search a 13-year-old girl to look for two extra-strength ibuprofen pills. Thomas — alone — dissented, calling the search of her underwear “reasonable and justified.”
Alone, he voted to strike down a key part of the Voting Rights Act that is credited with giving blacks political power in the South. And he was the lone justice to uphold the George W. Bush administration’s view that an American citizen could be held as an “enemy combatant” with no charges and no hearing….
“He is the most radical justice to serve on the court in decades,” said Erwin Chemerinsky, dean of the UC Irvine Law School and a liberal constitutional scholar. He “would change the law dramatically and give little weight to precedent. It’s easy to overlook how radical [he is] because his are usually sole opinions that do not get attention.”
He’s the Federalist Society’s dream Justice, a true “constitutional conservative.” Ed Kilgore writes about the radicalism of the movement in reference to Michele Bachmann, but it’s applicable here.
…[C]onstitutional conservatives think of America as a sort of ruined paradise, bestowed a perfect form of government by its wise Founders but gradually imperiled by the looting impulses of voters and politicians. In their backwards-looking vision, constitutional conservatives like to talk about the inalienable rights conferred by the Founders—not specifically in the Constitution, as a matter of fact, but in the Declaration of Independence, which is frequently and intentionally conflated with the Constitution as the part of the Founders’ design. It’s from the Declaration, for instance, that today’s conservatives derive their belief that “natural rights” (often interpreted to include quasi-absolute property rights or the prerogatives of the traditional family), as well as the “rights of the unborn,” were fundamental to the American political experiment and made immutable by their divine origin….The obvious utility of the label is that it hints at a far more radical agenda than meets the untrained eye, all the while elevating the proud bearer above the factional disputes of the conservative movement’s economic and cultural factions.
On the economic side of the coin, most mainstream politicians are not going to publicly say that the monstrosities they associate with ObamaCare, “redistribution of wealth,” or Keynesian stimulus techniques are rooted in their desire to reverse the New Deal, as well as a long chain of Supreme Court decisions that also happened to make possible the abolition of segregation. But many conservative activists actually think that way, and have in mind as their goal nothing so modest as a mere rollback of federal social programs to the levels of the Bush or even the Reagan administration. Bachmann and other candidates can talk to most voters as though they are simply trying to defend America from a vast overreach by the 44th president. But to the radicalized conservative base that dominates contests like the Iowa Caucuses, the constitutional conservative label hints broadly at a more audacious agenda ultimately aimed at bringing back the lost American Eden of the 1920s, if not an earlier era.
It’s an interesting concept for Thomas to align with, given that he would have been considered only 3/5ths of a man “in the 18th century, when the Constitution was written.” Or perhaps he’s interpreting it as three out of five African-Americans being counted, and assuming he’d of course be among the three. Of course, if we returned to his preferred era of governance, he could be in prison on the basis of his marriage alone. And it’s a pretty safe bet, had so many of the laws he has dissented from so strenuously not been passed and upheld, the last place he’d find himself now is on a seat in the highest court of the land.
All of which would only be an interesting quirk of Thomas’s personality if he weren’t part of an increasingly extreme majority on the court, manifesting this hard-right, highly corporatist, and dangerous philosophy. That he’s guided by Ayn Rand should be enough to put his place on the court in question, if his ethical lapses alone weren’t enough to do so.

Budgeting For Insecurity: GOP Soft On Terrorism
Has any political party in history been as hypocritical as the modern GOP in terms of paying lip service to principles they undercut with policies?
Republicans say they are all about supporting our troops, and then they slash veterans benefits. They loudly proclaim their religious devotion to gatherings of evangelicals, but their philosopher queen is the faith-hating atheist Ayn Rand (see video in Noteworthy box above). Turns out they have two faces even for matters of critical national security, as yesterday’s editorial in the New York Times, “Budgeting for Insecurity,” makes disturbingly clear. An excerpt:
House Republicans talk tough on terrorism. So we can find no explanation — other than irresponsibility — for their vote to slash financing for eight antiterrorist programs. Unless the Senate repairs the damage, New York City and other high-risk localities will find it far harder to protect mass transit, ports and other potential targets.The programs received $2.5 billion last year in separate allocations. The House has cut that back to a single block grant of $752 million, an extraordinary two-thirds reduction. The results for high-risk areas would be so damaging — with port and mass transit security financing likely cut by more than half — that the chairman of the House Homeland Security Committee, Peter King of New York, voted against the bill as “an invitation to an attack.”
The Times editorial goes on to explain that the “Republicans made clear that budget-cutting trumped all other concerns…One $270 million cut, voted separately, would eliminate 5,000 airport-screening jobs across the country, according to the Transportation Security Administration.” They also fought to cut more than half of funding for first responder training, but the Democrats were able to restore most of it.
As the Times editorial asks, “Are these really the programs to be cutting?” Not if we put national security before politics.

“Republican Virtues”: I Don’t Think So
I’ve been mulling over a column by David Brooks on “The Politics of Solipsism” for the past couple of weeks. What he wrote is nervy to say the least. He argues that America has lost the republican virtues on which it was founded, namely, the curbing of self-centeredness in the interest of the public good. I too am a fan of Cicero, but Brooks fails in one of the primary republican virtues by not forthrightly acknowledging that Republicans, the adherents of Ayn Rand, are the ones who have most blatantly deserted these same virtues. Self interest has center stage on their platform.
Brooks praises Truman and Eisenhower, but he fails to mention that it was President Kennedy who repeatedly challenged Americans and asked them to sacrifice. He urged us to go to the moon because it was tough, not because it was easy. And when my father, Robert Kennedy, was running for president and medical students asked him who would pay for more health care for the poor, he quickly answered, “You will.”
Contrary to the Republican philosophy, summed up by Ronald Reagan, that government is the problem, John and Robert Kennedy considered politics an honorable profession and affirmed that government was the place where we “make our most solemn common decisions.”
Both my uncle and my father knew that America is at its best when its citizens are willing to give up something for others. That was the spirit in which they committed themselves to public service. Ultimately they both gave their lives in the service of their country.
Like my father and my uncle, I believe that serving the public good is the essential republican virtue. In fact I led the effort to make Maryland the first and still only state in the country where community service is a condition of high school graduation. I did this because I believe that virtue comes from habits developed, not sermons given. Aristotle said, “we become house builders by building houses, we become harp players by playing the harp, we grow to be just by doing just actions.”
Republican governors are making their mark attacking public servants. They’re laying off citizens who exemplify republican virtues like teaching in inner city schools, fighting drug cartels, and rushing into burning buildings. Why? So that those who make outrageous salaries can pay lower taxes.
Brooks says that Republicans want growth, but I see no evidence that they want growth for anyone but the most well off. Where is the commitment to education, to infrastructure, to science?
Brooks commends Paul Ryan for sending the message that “politics can no longer be about satisfying voters’ immediate needs.” And yet Ryan would give the rich even more of a tax break at a time when our taxes are the lowest in three decades.
George Washington, whom Brooks also praises, would be surprised that the rich are being asked to shoulder less of a burden. He supported excise taxes that would fall disproportionately on the wealthy. When he went to war, he brought his wife, Martha, to share the hard, cold winter of Valley Forge along with him.
The wealthy have a special responsibility. From those who have been given much, much will be asked. In a true republic, people of wealth and privilege are first in line to serve in government, go to war, contribute to the honor and glory of their country. They set the nation’s values. If what they value is money, money, money, then the country will follow.
After 9/11, George Bush asked us to shop. At just the moment when he could have called us to a cause greater than ourselves, he (apparently on the advice of Karl Rove) urged us to step up for new TVs and designer bags rather than for the public good.
So if Brooks really wants to put an end to the politics of solipsism, he must take on the Republican party itself, which has done so little to cultivate the virtues of service, sacrifice, and commitment to country.
Please don’t lecture us about solipsism and republican virtues when it’s Republicans who are the ones who have made such a virtue of self interest.
