“A Media Staple Under Bush”: Where Are The ‘Comeback’ Columns About Obama?

For a “lame duck” politician who’s supposed to be licking his wounds after the Democratic Party’s steep midterm losses, President Obama these days probably doesn’t mind scanning the headlines each morning. Instead of confirming the slow-motion demise so many in the pundit class had mapped out for him, the headlines paint a picture of a president, and a country, in many ways on the rebound:

That’s probably more good news for Obama in one month than he had in the previous three combined.

And that selection of headlines doesn’t cover news of the most recent smooth and efficient enrollment period for the Affordable Care Act, the announcement of Obama’s executive action to deal with the languishing issue of immigration, his high-profile endorsement of net neutrality, or the United States’ landmark agreement with China to confront climate change.

As for Obama’s approval rating, it has remained steady in recent months, just as it has for virtually all of 2014. But aren’t lame ducks supposed to tumble after tough midterm defeats, the way President George W. Bush did right after the 2006 votes?

Meanwhile, the assumption that Republicans had boxed Obama in politically via their midterm momentum and would be able to bully him around (impeachment! a government shutdown!) hasn’t yet come to fruition. To date, their main response to the immigration executive order that Obama issued has been for Republicans to cast a symbolic vote of disapproval (i.e., Obama called their bluff).

Already the bloom seems to be coming off the GOP’s win. “According to the survey, 50 percent of Americans believe the GOP taking control of the House and the Senate next year will be bad for America,” CNN reported this week.

None of this is to say that Obama’s surging or that paramount hurdles don’t remain on the horizon. But some recent developments do undercut a widely held consensus in the Beltway press that Obama’s presidency effectively ended with the midterms and that his tenure might be viewed as a failed one.

Right after the election, a November Economist editorial announced, “Mr. Obama cannot escape the humiliating verdict on his presidency.” Glimmers of hope after the midterms were no reason to think Obama had “somehow crawled out of the dark place that voters put him,” the Washington Post assured readers. (Post columnist Dana Milbank has recently tagged Obama as a hapless “bystander” who’s “turning into George W. Bush.”) And a McClatchy Newspapers headline declared, “President Obama Is Now Truly A Lame Duck.”

But as the facts on the ground now change, many in the press seem reluctant to drop its preferred script and adjust to the headlines that suggest Obama’s second term is not shaping up to be the wreck so many pundits hinted it would be.

It’s worth noting that during Bush’s failed second term, which ended with his approval rating hovering around 20 percent, the same Beltway press did the opposite. Back then the press appeared overly anxious to proclaim a Bush comeback underway. Unlike Obama who’s actually rebounding, the D.C. press often touted Bush’s comeback, even though one never materialized.

At the time of the 2006 midterm elections, NBC’s Chuck Todd predicted that “if Democrats get control of Congress, President Bush’s approval rating will be over 50 percent by the Fourth of July next year.” Democrats did win the House and the Senate in 2006, but Todd’s predication was off — by 20 points. Bush was floundering with a 30 percent approval rating on Independence Day, 2007.

Todd was hardly alone. Earlier in 2005, Time got a quick jump on the Bush-is-back competition, announcing that the president had “found his voice” and that relieved White House aides “were smiling again” after a turbulent 2005. That year, according to the Gallup numbers, Bush’s approval rating remained submerged, falling as low as 31 percent. When it briefly climbed to 40 percent, the Baltimore Sun quickly asked, “Is Bush The New Comeback Kid?”

Even when Bush’s approval rating trended down again after the Republicans’ 2006 midterm wipeout, pundits were back on the hunt for the elusive comeback. In early 2007, Washington Post columnist David Broder, the dean of the Beltway press corps, typed up the White House spin and claimed, “It may seem perverse to suggest that, at the very moment the House of Representatives is repudiating his policy in Iraq, President Bush is poised for a political comeback. But don’t be astonished if that is the case.” Broder was sure, “Bush now shows signs of renewed energy and is regaining the initiative on several fronts.” Thirteen months later, Broder finally conceded the Bush comeback hadn’t materialized. (In fact, the opposite had unfolded.)

The media’s “comeback” double standard seems to reflect the misguided Beltway consensus that America’s a center-right country, so of course it was only a matter of time before Bush regained his footing (he didn’t) and that Obama would likely fade away during his second term (he hasn’t).

“The Cycle Of Republican Radicalization”: The Particularly Intense Loathing Republicans At All Levels Have For Obama Feeds The Cycle

Yesterday, the Washington Post reported on a Quinnipiac poll from a week ago showing a striking change in public opinion on immigration. The question was whether undocumented immigrants should be deported or should be able to get on a path to citizenship. Clear majorities of the public have long favored a path to citizenship (especially if you provide details of what that path would entail, which this poll didn’t). But that has changed, because Republicans have changed. As the Post described the Quinnipiac results, “Although [Republicans] supported citizenship over deportation 43 to 38 percent in November 2013, today they support deportation/involuntary departure over citizenship, 54 to 27 percent.”

That’s an enormous shift, and it provides an object lesson in a dynamic that has repeated itself many times during the Obama presidency. We’ve talked a lot about how the GOP in Congress has moved steadily to the right in recent years, but we haven’t paid as much attention to the movement of Republican voters. But the two feed off each other in a cycle.

Immigration is a perfect example. Before this latest immigration controversy, Republican voters were at least favorably inclined toward a path to citizenship. But then Barack Obama moves to grant temporary legal status to some undocumented people (and by the way, nothing he’s doing creates a path to citizenship for anyone, but that’s another story). It becomes a huge, headline-dominating story, in which every single prominent Republican denounces the move as one of the most vile offenses to which the Constitution has ever been subjected. Conservative media light up with condemnations. And because voters take cues from the elites on their own side, Republicans are naturally going to think the order was wrong while Democrats are going to think it was right.

But what the Quinnipiac poll suggests — and granted, this is only one poll and we won’t know for sure until we get more evidence — this process also ends up shifting people’s underlying beliefs about the issue. In this case, the controversy makes Republicans more conservative.

Let’s take another example. People like me have mocked Republican officeholders for the way they shifted on the wisdom of health insurance reform that involves establishing a marketplace where people can buy private insurance, providing subsidies so those with modest incomes can afford it, and imposing an individual mandate to ensure a wide risk pool. When Mitt Romney passed a plan on that model in 2006, Republicans thought it was an innovative, market-based solution to the problem of health insecurity and the uninsured, but when Barack Obama passed a similar plan in 2010, they decided it was a freedom-murdering socialist nightmare.

But it’s safe to say that the average Republican voter didn’t have much of an opinion on that particular kind of health care reform prior to Barack Obama becoming president. They did, however, have opinions on the underlying question of whether it’s the responsibility of the government to make sure that everyone has health coverage. You’d expect most Republicans to say no, since they believe in the free market and aren’t favorably inclined toward the safety net. And most did — in Gallup polls, the number of Republicans answering no to this question has consistently been over 50 percent. In 2006, for instance, it was 57 percent. But since then the rejection of government having this responsibility has gone from a majority position among Republicans to near-unanimity. In 2013, it reached 86 percent.

So it isn’t just that Republican voters were convinced that the Affordable Care Act is a bad thing. As a group they moved to the right, with the minority of them who believed in a government responsibility for health care either changing their minds or changing their party affiliation.

This movement hasn’t happened on every issue; for instance, you might be surprised to learn that substantial numbers of Republican voters appreciate the reality of global warming and favor taking steps to address it; in some cases, even a majority of them do, depending on what specific question is being asked (see here for some examples). My guess is that there are two reasons we haven’t seen a similar movement to the right on climate. First, there is some diversity of opinion within the GOP elite, from outright climate denialism on one end to acknowledgement of reality on the other (without, it should be said, accepting that anything ought to be done about it). Second, and perhaps more important, the issue has never been at the top of the news agenda for an extended period in recent years, particularly in a conflict that pits all Republicans against Barack Obama.

But when an issue like immigration or health care does meet those criteria, you get a particular cycle. Elite Republicans take their place in the fight against Obama; then rank-and-file Republicans follow along; then pushed by their constituencies, the officeholders harden their positions, which in turn pulls their voters farther to the right, and on it goes. The particularly intense loathing Republicans at all levels have for Obama feeds the cycle, pushing them toward not just disagreeing with him on particular courses of policy but rejecting the underlying principles he holds.

Is this cycle going to continue after Obama leaves office? If Hillary Clinton wins in 2016, it probably will.

“More Consequential And Far-Reaching”: Why The Supreme Court Should Be The Biggest Issue Of The 2016 Campaign

Supreme Court justice and pop culture icon Ruth Bader Ginsburg left the hospital yesterday after having a heart stent implanted and expects to be back at work Monday. Despite various health issues over the years, Ginsburg insists that she is still of sound body at age 81 (her mind isn’t in question) and has no plans to retire before the end of President Obama’s term to ensure a Democratic replacement. If she keeps to that pledge, and presuming there are no other retirements in the next two years, the makeup of the Supreme Court could be a bigger campaign issue in 2016 than ever before. It certainly ought to be.

Ordinarily, the Supreme Court is brought up almost as an afterthought in presidential campaigns. The potential for a swing in the court is used to motivate activists to volunteer and work hard, and the candidates usually have to answer a debate question or two about it, which they do in utterly predictable ways (“I’m just going to look for the best person for the job”). We don’t usually spend a great deal of time talking about what a change in the court is likely to mean. But the next president is highly likely to have the chance to engineer a swing in the court. The consequences for Americans’ lives will probably be more consequential and far-reaching than any other issue the candidates will be arguing about.

As much as we’ve debated Supreme Court cases in recent years, we haven’t given much attention to the idea of a shift in the court’s ideology because for so long the court has been essentially the same: divided 5-4, with conservatives having the advantage yet liberals winning the occasional significant victory when a swing justice moves to their side. And though a couple of recent confirmations have sparked controversy (Samuel Alito and Sonia Sotomayor were both the target of failed attempts to derail their nominations), all of the retirements in the last three presidencies were of justices from the same general ideology as the sitting president. The last time a new justice was radically different from the outgoing one was when Clarence Thomas replaced Thurgood Marshall — 23 years ago.

Whether a Democrat or a Republican wins in 2016, he or she may well have the chance to shift the court’s ideological balance. Ginsburg is the oldest justice at 81; Antonin Scalia and Anthony Kennedy are both 78, and Stephen Breyer is 76. If the right person is elected and the right justice retires, it could be an earthquake.

Consider this scenario: Hillary Clinton becomes president in 2017, and sometime later one of the conservative justices retires. Now there would be a liberal majority on the court, a complete transformation in its balance. A court that now consistently favors those with power, whether corporations or the government, would become much more likely to rule in favor of workers, criminal defendants and those with civil rights claims. Or alternately: The Republican nominee wins, and one of the liberal justices retires. With conservatives in control not by 5-4 but 6-3, there would be a cascade of even more conservative decisions. The overturning of Roe v. Wade would be just the beginning.

Look at what the Supreme Court has done recently. It gutted the Voting Rights Act, said that corporations could have religious beliefs, simultaneously upheld and hobbled the Affordable Care Act, struck down a key part of the Defense of Marriage Act and moved toward legalizing same-sex marriage, all but outlawed affirmative action, gave corporations and wealthy individuals the ability to dominate elections and created an individual right to own guns — and that’s just in the last few years.

Whether you’re a Democrat or a Republican, there is probably no single issue you ought to be more concerned about in the 2016 campaign than what the court will look like after the next president gets the opportunity to make an appointment or two. The implications are enormous. It’s not too early to start considering them.

“The Undeniable Truth”: Why I’m (Still) Thankful For President Obama

On a day when we pause to consider those things for which Americans ought to be thankful, I feel obliged to mention my appreciation for many of the things that Barack Obama has accomplished as President of the United States, and my profound relief that he is in the Oval Office rather than any of the Republicans who sought to displace him.

On this day, it seems appropriate to reflect not only on Obama’s considerable achievements, but on how much worse our situation might be if his opponents had been in control of events from January 2009 until now.

With our continuous immersion in harsh commentary from factions and ideologues across the spectrum, a mindless negativity tends to dominate assessments of his presidency. He is certainly more flawed than his most zealous supporters would ever have admitted six or seven years ago, which is why some of them are disproportionately disappointed today; he has made regrettable mistakes in both policy and politics; and, as we saw in this month’s midterm election, he has suffered declines in public confidence that injured his image and the fortunes of his party. His approval ratings remain low.

And yet, whatever his fellow citizens may feel, the undeniable truth is that Obama righted the nation in a moment of deep crisis and set us on a navigable course toward the future, despite bitter, extreme, and partisan opposition that was eager to sink us rather than see him succeed.

So I’m thankful that Obama was president at the nadir of the Great Recession, rather than John McCain, Mitt Romney, or any other Republican who might have insisted on austerity and prevented the stimulus spending that saved us from economic catastrophe. It wasn’t large enough or long enough to prevent the human suffering of unemployment, but it was sufficient to bring recovery, more rapidly than most countries have recovered after a major panic.

The simple proof may be found in the record of growth that outpaced every other industrialized country in the world – a record that seems even more impressive because the crash began here, as a consequence of irresponsibility and criminality in American financial markets. Undergirding the stimulus was his courageous decision to bail out the automotive industry, denounced as “socialism,” saved at least a million jobs and prevented the further deindustrialization of America.

I’m also thankful that Obama – a politician who respects science and listens to scientists — was president as we began to encounter the difficult realities of climate change. Having declared his determination to double the production of renewable energy in this country, he has far exceeded that objective already. Under his guidance, the federal government has acted against excessive carbon dioxide in the atmosphere, required automakers to double their fuel economy by 2025, ordered agencies to achieve sustainability in operations and purchases, and invested tens of billons in smart electric grids, conservation, and clean fuels.

I’m thankful that he oversaw passage of financial reform, despite his overly cautious failure to prosecute the financial felons who caused the crisis and his refusal to take down any of the big banks. Like the stimulus and the auto bailout, the Dodd-Frank Act is imperfect but useful and necessary – and wouldn’t have occurred if the bankers and their most abject Republican servants had been fully in charge.

I’m even more thankful that he pushed through the most extensive and generous reform in American health care since the passage of Medicare and Medicaid, the Affordable Care Act – which, despite its troubled debut, has proved to be a remarkable success. It isn’t Medicare for all, but Obamacare is insuring and protecting millions of Americans who would otherwise be subject to the Tea Party Republican policy, pithily summarized by that mob screaming “let ‘em die” at the GOP debate in 2012. Health care costs are falling, Medicare’s solvency has improved, and millions more of the country’s poor and working families are covered by Medicaid, in spite of Republican legislators and governors who would, quite literally, let them die.

Finally, I’m appreciative of many other policy decisions Obama has made – promoting human rights by ending anti-gay discrimination in the military, banning the Bush era tolerance of torture, outlawing unequal pay for women, and most recently his executive order on immigration. I’m grateful that he is seeking peace through negotiation with Iran, instead of going directly (and insanely) to war as McCain or Romney would almost surely have done. I’m glad he had the guts to order the operation that finished Osama bin Laden.

None of this diminishes the president’s political errors, his sometimes naïve attitude about “bipartisanship,” his excessive deference to the national security and defense establishments, or his persistent susceptibility to wrongheaded cant about entitlements and deficits.

But he remains admirably cool under attacks that would madden most people. He refuses to mimic the cynical, mindless, and ugly conduct of his adversaries. He still proclaims American values of shared responsibility and prosperity, of cooperation and community, of malice toward none and charity for all.

In different ways, those ideals were epitomized by the presidential founders of this national holiday – George Washington, Abraham Lincoln, and Franklin Roosevelt – and their persistence is reason for thanksgiving, too.

“More Silliness And Hysteria”: Gripes About Excessive Regulations And Taxes Often Are Baseless

In the last couple of months we have seen the country whipped up into near hysteria over the virtually nonexistent threat of Ebola.

While the only people who contracted the disease in this country were those who treated a man who died of the disease, tens of millions of people became convinced they were in danger on airplanes and public buses and even routine visits to the supermarket.

Politicians have sought to exploit the same sort of fears with their rants about regulations and high taxes sinking the economy. These complaints have as much foundation in reality as the Ebola threat.

The regulation screed usually focuses on the number of pages in bills like the Affordable Care Act and the Dodd-Frank financial reform bill. While lengthy bills are unfortunate from the standpoint of the trees cut down for the paper, the length bears no relationship to the amount of regulation.

To take one example, the Volcker Rule, which prohibits banks with government insured deposits from engaging in risky speculation, ended up more than three times its original length as the industry carved out an array of exceptions. The greater length was associated with less regulation, not more.

Dodd-Frank was about curbing the sorts of abuses that gave us the financial crisis. Is the argument that we need corrupt banks to foster growth?

The screams over the ACA are equally misguided. The rules have little impact on large firms, the vast majority of whom already offered insurance that met ACA requirements. It might have been expected to affect mid-sized firms that did not previously offer insurance, but none of the complainers has yet presented any evidence that these mid-sized firms have been especially hard hit in the last few years.

The tax complaints require some serious amnesia. Tax rates were higher for most people in the 1990s when we saw the strongest growth in almost three decades. We then lowered taxes in 2001 and saw a weak recovery followed by the collapse in 2008.

The explanation for the continuing weakness is not a surprise to those of us who warned of the housing bubble before the crisis. The bubble had been driving the economy both directly through its impact on construction and indirectly through the impact that $8 trillion of housing bubble wealth had on consumption. When the bubble burst, the economy lost its driving force.

The building boom of the bubble years lead to enormous overbuilding of housing. When the bubble burst, construction didn’t just fall back to normal. It fell to the lowest levels in 50 years, costing the economy more than four percentage points of GDP, amounting to $700 billion annually in lost demand. The loss of housing wealth meant that consumption fell back to more normal levels.

While both housing and construction are up from their low-points in the recession, they are not going to return to bubble peaks, at least not without another bubble. This means that the economy continues to have a huge shortfall in demand. Cutting taxes and reducing regulation will not magically fill this gap in demand.

There are essentially two ways to increase demand. One is directly through more government spending. This is currently taboo in Washington since we are all supposed to hate budget deficits.

The other is by reducing the trade deficit. The way to reduce the trade deficit is to make U.S. goods more competitive with a lower-valued dollar. Talk of a lower dollar is also taboo in political circles.

In short, it is not difficult to find ways to boost the economy; the problem is that politics prevents them from being discussed. Instead we get silliness about taxes and regulation.
