“An Affront To Our National Values”: The Gigantic Disaster Of The CIA’s Torture Program
The Senate Intelligence Committee released the executive summary of its report on the CIA’s use of torture in the years after the September 11 attacks, which took place at “black sites” in foreign countries (the full report can be read here). While we’ve known a good deal about this for some time, many of the details are new, and I want to focus attention on a few of them to make a particular point about this program and how we’re debating it today.
The picture the CIA itself and Bush administration officials have always tried to paint of the torture program is one of highly trained professionals using carefully considered, perfectly legal techniques that were limited and humane, and produced valuable intelligence that directly saved American lives. When you read the Senate report, however, you see something very different: people who essentially had no idea what they were doing.
Their task was urgent, and their fear was genuine, but in that urgency and fear they brutalized prisoners, withheld information and in some cases lied outright to other agencies of government (including Congress, the State Department, and the White House), and generally made a mess of things. There’s no other way to put this: the torture program was a gigantic disaster; if this weren’t a family newspaper I’d use a word that starts with “cluster.”
First, let me quote from the executive summary of today’s report, about one of the black sites:
Conditions at CIA detention sites were poor, and were especially bleak early in the program. CIA detainees at the COBALT detention facility were kept in complete darkness and constantly shackled in isolated cells with loud noise or music and only a bucket to use for human waste. Lack of heat at the facility likely contributed to the death of a detainee. The chief of interrogations described COBALT as a “dungeon.” Another senior CIA officer stated that COBALT was itself an enhanced interrogation technique. At times, the detainees at COBALT were walked around naked or were shackled with their hands above their heads for extended periods of time. Other times, the detainees at COBALT were subjected to what was described as a “rough takedown,” in which approximately five CIA officers would scream at a detainee, drag him outside of his cell, cut his clothes off, and secure him with Mylar tape. The detainee would then be hooded and dragged up and down a long corridor while being slapped and punched.
One of the detainees at this site was left overnight shackled to the wall and naked from the waist down in near-freezing temperatures. The next morning he was found dead of hypothermia.
Now let me cite a couple of the specific cases. This an email from a medical officer present for the interrogation of Abu Zubaydah:
The sessions accelerated rapidly progressing quickly to the water board after large box, walling, and small box periods. [Abu Zubaydah] seems very resistant to the water board. Longest time with the cloth over his face so far has been 17 seconds. This is sure to increase shortly. NO useful information so far.. ..He did vomit a couple of times during the water board with some beans and rice. It’s been 10 hours since he ate so this is surprising and disturbing. We plan to only feed Ensure for a while now. I’m head[ing] back for another water board session.”
In addition to waterboarding, Zubaydah was subjected to extended use of stress positions, which are designed to produce excruciating pain. At the end of the intensive period of interrogation, CIA officers declared the torture a success — not because Zubaydah had actually given up information on upcoming attacks, but because the officials decided they had completely broken his will and satisfied themselves that he had no such information to give.
Quite naturally, what concerned interrogators most was the prospect of future attacks. However, in multiple cases, they were faced with prisoners who were cooperative and supplied intelligence on things like the structure of al-Qaeda, but if the prisoner said he had no information about upcoming attacks, that would be taken as proof that he should be tortured further.
A significant amount of the report focuses on the site known as Cobalt, which is described not only as a horrific “dungeon” but a place where personnel rotate in and out and few seem to have any idea what they’re doing. Here’s the result of a visit there by a military legal advisor:
The U.S. military officer also noted that the junior CIA officer designated as warden of the facility “has little to no experience with interrogating or handling prisoners.” With respect to al-Najjar specifically, the legal advisor indicated that the CIA’s interrogation plan included “isolation in total darkness; lowering the quality of his food; keeping him at an uncomfortable temperature (cold); [playing music] 24 hours a day; and keeping him shackled and hooded.” In addition, al-Najjar was described as having been left hanging — which involved handcuffing one or both wrists to an overhead bar which would not allow him to lower his arms — for 22 hours each day for two consecutive days, in order to “‘break’ his resistance.” It was also noted al-Najjar was wearing a diaper and had no access to toilet facilities…According to the CIA inspector general, the detention and interrogation of Ridha al-Najjar “became the model” for handling other CIA detainees at DETENTION SITE COBALT.
But it wasn’t always the on-site interrogators pushing the interrogations to be more brutal. In one case cited by the report, the interrogators judged that a detainee named Abd al-Rahim al-Nashiri, who was implicated in the 2000 attack on the USS Cole, was being cooperative and forthcoming, based on their interactions with him and the fact that he was giving information on things like the structure of al-Qaeda. But he claimed that he didn’t have any information on upcoming attacks. The interrogators’ superiors at CIA headquarters wrote to them, “it is inconceivable to us that al-Nashiri cannot provide us concrete leads…. When we are able to capture other terrorists based on his leads and to thwart future plots based on his reporting, we will have much more confidence that he is, indeed, genuinely cooperative on some level.”
In other words, the idea that the prisoner simply didn’t have information on upcoming attacks was inconceivable to them. So they sent an untrained interrogator known for his temper to the site, who proceeded to do things like threaten the prisoner with a gun and an electric drill.
When that also failed to produce information on upcoming attacks, a contractor psychologist visited and created a new interrogation plan, based on yet more brutal techniques. This led the CIA’s chief of interrogations to inform his colleagues that he was retiring. In an email, he wrote, “this is a train wreak [sic] waiting to happen and I intend to get the hell off the train before it happens.” Eventually, everyone concluded that al-Nashiri didn’t have any information on upcoming attacks.
That’s just a bit of what’s in the report. One other interesting detail that jumped out at me was that on a couple of occasions, interrogators used mock executions, a favorite psychological torture technique of the Iranian regime.
We should note that many in the CIA dispute the details, particularly whether they were dishonest in their dealings with other agencies. What seems beyond dispute, however, is that the United States of America initiated a program of torturing prisoners that was planned and executed by people who knew next to nothing about interrogation.
As John McCain — who was subjected to some of these same torture techniques as a prisoner of war in Vietnam — said about this report: “The truth is sometimes a hard pill to swallow. It sometimes causes us difficulties at home and abroad. It is sometimes used by our enemies in attempts to hurt us. But the American people are entitled to it, nonetheless.” Many in his party don’t share that belief.
And even the White House can’t seem to bring itself to call this by its true name. Today I was on a background call with a group of senior administration officials, and they were asked repeatedly why they seemed so reluctant to use the word “torture,” even after President Obama admitted that “we tortured some folks.” One official replied, “We’re not going to go case by case in a report like this and try to affix a label to each action.” But they do affix a label: “enhanced interrogation techniques,” which they used again and again, accepting the euphemistic label the Bush administration affixed to it.
The White House certainly deserves credit for ultimately supporting the release of this report (even if they seemed reluctant to do so). For all the protestations of the CIA, Bush administration officials, and their supporters, a few things are beyond dispute. George W. Bush and the people who worked for him made torture the official policy of the United States government. The program that carried out their wishes was an unholy mess. It was an affront to all the values that this nation is supposed to stand for. And it made it much easier for terrorist groups to recruit new adherents.
And there are a lot of people talking on television, writing op-eds, and even running for office who sound like they’d be only too happy to do it all over again.

“Deny Terrorists Their Power”: Terrorism’s Threat Lies Only In Its Psychological Effect
I have not seen the video.
Not saying I won’t, but for now, I’ve chosen not to. To rush online and seek out cellphone footage of two fanatics with machetes who butchered a British soldier in London on Wednesday, to watch them standing there, hands painted red with his blood, speaking for the cameras, would feel like an act of complicity, like giving them what they want, like being a puppet yanked by its strings.
Sometimes, especially in the heat of visceral revulsion, we forget an essential truth about terrorism. Namely, that the people who do these things are the opposite of powerful. Non-state sponsored terror is a tactic chosen almost exclusively by the impotent.
These people have no inherent power. They command no armies, they boss no economies, their collective arsenals are puny by nation-state standards. No, what they have is a willingness to be random, ruthless and indiscriminate in their killing.
But they represent no existential danger. The United States once tore itself in half and survived the wound. Could it really be destroyed by men using airliners as guided missiles? Britain was once bombed senseless for eight months straight and lived to tell the tale. Could it really be broken by two maniacs with machetes?
Of course not.
No, terrorism’s threat lies not in its power, but in its effect, its ability to make us appalled, frightened, irrational, and, most of all, convinced that we are next, and nowhere is safe. Here, I’m thinking of the lady who told me, after 9/11, that she would never enter a skyscraper again. As if, because of this atrocity, every tall building in America — and how many thousands of those do we have? — was suddenly suspect. And I’m thinking of my late Aunt Ruth who, at the height of the anthrax scare, required my uncle to open the mail on the front lawn after which, she received it wearing latex gloves.
I am also thinking of the country itself, which, in response to the 9/11 attacks, launched two wars — one more than necessary — at a ruinous cost in lives, treasure and credibility that will haunt us for years.
Have you ever seen a martial artist leverage a bigger opponent’s size against him, make him hurt himself without ever throwing a punch? That’s the moral of 9/11. The last 12 years have shown us how easily we ourselves can become the weapon terrorists use against us. This is especially true when video footage exists (How many times have you seen the Twin Towers destroyed?). After all, getting the word out, spreading fear like a contagion, is the whole point of the exercise.
That could not have been plainer Wednesday. Having reportedly run the soldier, Lee Rigby, down with a car, having hacked him to pieces with machetes, these men did not blow themselves up and they did not run. No, they spoke their manifestos, their claims of Muslim grievance, into the cellphone cameras of passers-by.
Almost instantly, this was all over television and the Internet. Almost instantly the voices of impotent men were magnified to a global roar. Almost instantly, we all stood witness.
Terrorism uses its minimal power to achieve maximum effect and this is easier than ever on a planet that is now electronically networked and technologically webbed. Our connectivity is an exploitable vulnerability.
But in the end, no, these people cannot destroy us. Can they grieve us? Certainly. But they cannot destroy us unless we help them do it.
Their most lasting violence is not physical, but psychological — the imposition of fear, the loss of security. We cannot control what such people do. But we can control our reaction thereto. So let it be finally understood: From time to time, we will face the desperate evil of impotent men. But the only power they have is the power we give them.
I propose we give them none.

“History Advises And Democracy Demands”: Why President Obama Is Right To Limit The Authorization Of Military Force Against Terrorists
On CNN’s State of the Union this morning, Rep. Michael McCaul (R-TX) the chair of the House Committee on Homeland Security, attacked President Obama for calling for the post-9/11 Authorization for Use of Military Force (AUMF) to be rolled back — a topic the Senate Armed Services Committee recently held a related hearing on. According to McCaul, when President Obama “calls for repeal” of this Authorization, he risks taking away America’s “counterterrorism footprint to respond to the future bin Ladens of the world.”
It is not accurate to claim that Obama wants to strip the United States of its power to fight terrorism, or to imply that he wants to repeal the AUMF right away. Here are President Obama’s exact words regarding this authorization of force:
I intend to engage Congress about the existing Authorization to Use Military Force, or AUMF, to determine how we can continue to fight terrorists without keeping America on a perpetual war-time footing.
The AUMF is now nearly twelve years old. The Afghan War is coming to an end. Core al Qaeda is a shell of its former self. Groups like AQAP must be dealt with, but in the years to come, not every collection of thugs that labels themselves al Qaeda will pose a credible threat to the United States. Unless we discipline our thinking and our actions, we may be drawn into more wars we don’t need to fight, or continue to grant Presidents unbound powers more suited for traditional armed conflicts between nation states. So I look forward to engaging Congress and the American people in efforts to refine, and ultimately repeal, the AUMF’s mandate. And I will not sign laws designed to expand this mandate further. Our systematic effort to dismantle terrorist organizations must continue. But this war, like all wars, must end. That’s what history advises. That’s what our democracy demands.
So Obama does want to reshape the AUMF, but his immediate plans do not include repeal. They include recognizing the substantial gains America has made towards crippling al Qaeda and developing a legal framework that makes sense in light of that reality — one that will still enable us to fight terrorists without relying on the very broad powers granted by the AUMF.
There should be little question that the current AUMF is too broad. Enacted by reeling lawmakers in the immediate aftermath of 9/11, and signed into law just one week after those attacks, the AUMF gives the president sweeping authority to identify and target terrorist threats with little or any external checks on this authority. In the AUMF’s words, “the President is authorized to use all necessary and appropriate force against those nations, organizations, or persons he determines planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored such organizations or persons, in order to prevent any future acts of international terrorism against the United States by such nations, organizations or persons.”
As a constitutional matter, the president’s powers are at their apex when he acts pursuant to an express grant of authority from the Congress. As Justice Robert Jackson famously explained, the validity of a president’s actions made pursuant to congressional authorization are entitled to the “strongest of presumptions and the widest latitude of judicial interpretation, and the burden of persuasion would rest heavily upon any who might attack it.” Accordingly, there are minimal limits on what President Obama — or any future president — may do within the bounds of the AUMF’s text. The president may unilaterally determine that a family in Pakistan once harbored an al Qaeda leader, and then bring America’s military might to bear against this family. Such breathtaking power may have seemed appropriate in September of 2001, when the nation was still in mourning and the scope of the threat facing us was still unclear, but it is not an appropriate power to permanently place in the hands of a single person.
The Obama Administration, for its part, imposed its own limits on when it will invoke this power to kill a suspected terrorist. Among them, “[t]he policy of the United States is not to use lethal force when it is feasible to capture a terrorist suspect,” there must be “[n]ear certainty that non-combatants will not be injured or killed,” and lethal force will be used “only against a target that poses a continuing, imminent threat to U.S. persons” (although it’s worth noting that the administration has also defined the word “imminent” broadly in the past). But it is not at all clear that the Constitution requires future presidents to abide by these limits, and unlikely that any court would step in to enforce them absent a significant change in federal law. As a practical matter, this administration’s rules probably just function as limits the Obama Administration places on itself so long as it chooses to abide by them.
So, ultimately, the question Congress needs to ask is whether the permanent scope of presidential war-making power should be fixed by the immediate response of a wounded nation struck by an unprecedented attack with no ability to determine right away whether a series of similar attacks would soon follow. Should President Hillary Clinton have this sweeping power? How about President Ted Cruz?
Or, alternatively, should Congress recognize that the world has changed for the better in the last 12 years? Osama bin Laden is dead and al Qaeda is far weaker than it was in 2001. American law should recognize this reality.

“The Bullhorn Is In The Museum, And So Is The Bull”: Bush’s Long-Shot Campaign To Be Seen As Truman
The dedication this week of the George W. Bush Presidential Library and Museum was more than an opportunity for the five living U.S. presidents to compare notes on what Stefan Lorant called “the glorious burden” of the office.
It also was the beginning of Bush’s campaign for rehabilitation. As Bill Clinton said at the ceremony, all presidential libraries are attempts “to rewrite history.”
Bush’s ultimate goal — already hawked by his former political advisor Karl Rove — is to become another Harry S. Truman, a regular-guy commander in chief whose stock rose sharply about 20 years after he left office.
The superficial comparisons are intriguing. Vice President Truman only became president because Franklin D. Roosevelt died in office in 1945. The failed haberdasher and product of the Kansas City political machine was unlikely to make it to the top on his own. He was a plain-spoken, unpretentious man who cared enough about racial injustice that he desegregated the armed forces.
Bush became president because he was born on third base, to paraphrase Texas governor Ann Richards’ quip about his father, and because of the Supreme Court decision in Bush v. Gore in 2000; an unexceptional man who drank heavily until he was 40 probably wouldn’t have made it on his own. He’s a blunt, compassionate conservative who, as Jimmy Carter pointed out at the dedication, saw the ravages of AIDS in Africa and elsewhere and did something about it. (Bush also appointed two black secretaries of state.)
Like Iraq in Bush’s era, the Korean War was hugely unpopular when Truman left office in 1953, and his decision to drop two atomic bombs on Japan was at least as controversial as Bush’s support for torture.
Still, you don’t have to be Arthur Schlesinger Jr. to know that the differences between Bush and Truman are much greater than the similarities.
In Korea, Truman was responding to communist aggression, not hyping unconfirmed stories about weapons of mass destruction.
While Truman’s “Marshall Plan” (named for his secretary of state, George C. Marshall) produced spectacular results in postwar Europe, Bush apparently didn’t even have a plan for postwar Iraq.
His decision to disband the Iraqi army was catastrophic. Iraq and the simultaneous neglect of Afghanistan are only the best-known Bush administration fiascos that are all but airbrushed out of the museum, though not out of the historical record.
A broader list would include weakening bank-capital requirements and prohibitions on predatory lending that helped pave the way for the financial crisis; botching the response to Hurricane Katrina; gutting federal rules on worker safety, education, veterans’ affairs and other protections; endorsing a Constitutional amendment banning gay marriage; editing climate-change reports to the specifications of ideologues; reinstating the global gag rule on family planning in deference to right-wing anti-abortion activists, and politicizing appointments to the federal bench and federal law enforcement.
All this is ignored by Bush apologists. Ed Gillespie, a longtime Republican operative who last year helped the party’s presidential nominee, Mitt Romney, offered a defense of Bush in National Review that sought to absolve him of any blame for the budget deficit. As if the trillion-dollar wars, unaffordable tax cuts, the $550 billion (unpaid-for) prescription-drug benefit and hundreds of billions of lost revenue in the recession that began on his watch could be erased from history.
The new museum on the campus of Southern Methodist University in Dallas is cleverly designed to subsume Bush’s record within the burdens of the presidency. It includes a “Decision Theater” that puts visitors in the shoes of a president forced to make tough calls on a variety of pressing issues.
The subtext is that this is an extremely hard job and that you, the visitor, couldn’t do it any better than Bush did.
While this may make for a thought-provoking museum experience, it’s a low bar for presidential performance. Allowing for some mistakes, we should admire our presidents not because they have to face tough decisions but for making the right ones.
The “moral clarity” that is Bush’s claim to presidential respectability is only worth something if it results in clear achievement.
As a sign that even Bush knows his batting average on big decisions was low, the museum barely mentions Vice President Dick Cheney, Defense Secretary Donald Rumsfeld, and other officials who helped him make them.
Cheney’s churlish behavior and frequent shots at President Barack Obama over the last four years have made Bush, who has refrained from criticism, look restrained and classy by comparison.
But you can’t flush a disastrous war down the memory hole. At the dedication, the word “Iraq” wasn’t mentioned once, and the museum covers the subject in a section devoted to “the Global War on Terror.”
Continuing to conflate Iraq with the Sept. 11 attacks is an insult to truth that historians will never be able to overlook.
On Sept. 14, 2001, I was in the White House press pool and was five feet from Bush as he stood atop a crushed truck as rescue workers at Ground Zero shouted that they couldn’t hear the president speak.
“I can hear you! I can hear you,” Bush said through a bullhorn. “The rest of the world hears you, and the people who knocked these buildings down will hear all of us soon!” It was a defining moment for his presidency.
The problem that Bush can never get around is that “the people who knocked these buildings down” — namely, Osama bin Laden — didn’t hear from Bush, while others unconnected to the attacks did.
The bullhorn is in the museum. And so is the bull.

“Leaning Towards Darkness”: The Mind Of A Terror Suspect
While the Boston area lay paralyzed by a lockdown, with one terror suspect dead and another on the loose as a massive manhunt filtered through the area’s arteries, we got a better sense of the second young man.
It’s complicated.
The suspects were brothers. The one who was on the loose was taken into custody on Friday evening. He was the younger of the two, Dzhokhar Tsarnaev, 19. The elder, Tamerlan Tsarnaev, 26, was killed in a confrontation with authorities, but not before participating in the fatal shooting of an M.I.T. police officer, the carjacking of an S.U.V. and the shooting of a transit police officer, who was critically injured.
They were of Chechen heritage. Tamerlan was a boxer; Dzhokhar, a college student.
“A picture has begun to emerge of 26-year-old Tamerlan Tsarnaev as an aggressive, possibly radicalized immigrant who may have ensnared his younger brother Dzhokhar — described almost universally as a smart and sweet kid — into an act of terror,” The Boston Globe reported Friday.
The Globe quoted a person named Zaur Tsarnaev, who the newspaper said identified himself as a 26-year-old cousin of the suspects, as saying, “I used to warn Dzhokhar that Tamerlan was up to no good.” Tamerlan “was always getting into trouble,” he added. “He was never happy, never cheering, never smiling. He used to strike his girlfriend. He hurt her a few times. He was not a nice man. I don’t like to speak about him. He caused problems for my family.”
But what about that image of Dzhokhar as sweet?
On Friday, BuzzFeed and CNN claimed to verify Dzhokhar’s Twitter account. The tweets posted on that account give a window into a bifurcated mind — on one level, a middle-of-the-road 19-year-old boy, but on another, a person with a mind leaning toward darkness.
Like many young people, the person tweeting from that account liked rap music, saying of himself, “#imamacbookrapper when I’m bored,” and quoting rap lyrics in his tweets.
He tweeted quite a bit about women, dating and relationships; many of his musings were misogynistic and profane. Still, he seemed to want to have it both ways, to be rude and respectful at once, tweeting on Dec. 24, 2012: “My last tweets felt too wrong. I don’t like to objectify women or judge anyone for their actions.”
He was a proud Muslim who tweeted about going to mosque and enjoying talking — and even arguing — about religion with others. But he seemed to believe that different faiths were in competition with one another. On Nov. 29, he tweeted: “I kind of like religious debates, just hearing what other people believe is interesting and then crushing their beliefs with facts is fun.”
His politics seemed jumbled. He was apparently a 9/11 Truther, posting a tweet on Sept. 1 that read in part, “Idk why it’s hard for many of you to accept that 9/11 was an inside job.” On Election Day he retweeted a tweet from Barack Obama that read: “This happened because of you. Thank you.” But on March 20 he tweeted, “Evil triumphs when good men do nothing.” This sounds like a take on a quote from Edmund Burke, who is viewed by many as the founder of modern Conservatism: “The only thing necessary for the triumph of evil is for good men to do nothing.”
Dzhokhar Tsarnaev had strong views on the Middle East, tweeting on Nov. 28, “Free Palestine.” Later that day he tweeted, “I was going to make a joke about Hamas but it Israeli inappropriate.”
Toward the end of last year, the presence of dark tweets seemed to grow — tweets that in retrospect might have raised some concerns.
He tweeted about crime. On Dec. 28 he tweeted about what sounds like a hit-and-run: “Just saved a bunch of money on my car insurance by switching my car into reverse and driving away from the accident.” And on Feb. 6 he tweeted, “Everything in life can be free if you run fast enough.”
He posted other tweets that could be taken as particularly ominous:
Oct. 22: “i won’t run i’ll just gun you all out #thugliving.”
Jan. 5: “I don’t like when people ask unnecessary questions like how are you? Why so sad? Why do you need cyanide pills?”
Jan. 16: “Breaking Bad taught me how to dispose of a corpse.”
Feb. 2: “Do I look like that much of a softy?” The tweet continued with “little do these dogs know they’re barking at a lion.”
Feb. 13: “I killed Abe Lincoln during my two hour nap #intensedream.”
The last tweet on the account reads: “I’m a stress free kind of guy.” The whole of the Twitter feed would argue against that assessment.
