“Punish Them At The Polls!”: Paycheck Fairness Act Blocked Again By Senate GOP
Senate Republicans on Monday blocked for the fourth time a bill that would strengthen federal equal pay laws for women.
The Paycheck Fairness Act would ban employers from retaliating against employees who share salary information with each other, impose harsher penalties for pay discrimination and require employers to be able to show that wage gaps between men and women are based on factors other than gender.
The bill needed 60 votes to overcome a Republican filibuster and advance to a final vote on passage, but it fell short Monday by a vote of 52 to 40. Senate Democrats have brought the bill to the floor four times since 2011, and each time Republicans have rejected it.
“The wage gap not only hurts our families, it hurts the economy,” Sen. Barbara Boxer (D-Calif.) said before the vote. “If it were reversed, I’d be standing here fighting for the men. It’s not right.”
Republicans say they oppose the bill because they believe it would discourage employers from hiring women, out of a fear of lawsuits. The GOP has accused Democrats of staging a “show vote” on the bill in an election year, knowing it won’t pass.
“At a time when the Obama economy is already hurting women so much, this legislation would double down on job loss, all while lining the pockets of trial lawyers,” Senate Minority Leader Mitch McConnell (R-Ky.) said before the last vote on the bill in April. “In other words, it’s just another Democratic idea that threatens to hurt the very people that it claims to help.”
Women working full-time in the U.S. earn an average of 77 cents for every dollar men earn, according to the Census Bureau. A small portion of that gap, economists say, is due to employers paying women less than men for the same work.
Republicans are trying to engage women voters ahead of the November midterm elections, but their opposition to the Paycheck Fairness Act and other equal pay measures has repeatedly been used against them in campaigns.

“A Defeat For American Democracy”: The Senate Tried To Overturn ‘Citizens United’ Today. Guess What Stopped Them?
A majority of the United States Senate has voted to advance a constitutional amendment to restore the ability of Congress and the states to establish campaign fundraising and spending rules with an eye toward preventing billionaires and corporations from buying elections.
“Today was a historic day for campaign finance reform, with more than half of the Senate voting on a constitutional amendment to make it clear that the American people have the right to regulate campaign finance,” declared Senator Tom Udall, the New Mexico Democrat who in June proposed his amendment to address some of the worst results of the Supreme Court’s interventions in with the recent Citizens United v. Federal Election Commission and McCutcheon v. Federal Election Commission decisions, as well as the 1976 decision in Buckley v. Valeo.
That’s the good news.
The bad news is that it’s going to take more than a majority to renew democracy.
Fifty-four senators, all Democrats and independents who caucus with the Democrats, voted Thursday for the amendment to clarify in the Constitution that Congress and the states have the authority to do what they did for a century before activist judges began intervening on behalf of wealthy donors and corporations: enact meaningful campaign finance rules and regulations.
But forty-two senators, all Republicans, voted no. As a result, Udall noted, the Republican minority was able to “filibuster this measure and instead choose to support a broken system that prioritizes corporations and billionaires over regular voters.”
The Republican opposition effectively blocked further consideration of the amendment proposal, since sixty votes were needed to end debate and force a vote. And, even if the Republicans had not filibustered the initiative, actual passage of an amendment would have required a two-thirds vote.
Though the Republican move was anticipated, Senator Bernie Sanders, the Vermont independent who has been one of the Senate’s most ardent advocates for reform, expressed frustration with the result. “I am extremely disappointed that not one Republican voted today to stop billionaires from buying elections and undermining American democracy,” said the senator, who has advocated for a more sweeping amendment to address the influence and power of corporate cash on American elections and governance. “While the Senate vote was a victory for Republicans, it was a defeat for American democracy. The Koch brothers and other billionaires should not be allowed to spend hundreds of millions of dollars electing candidates who represent the wealthy and the powerful.“
Now, said Sanders, “the fight to overturn Citizens United must continue at the grassroots level in every state in this country.”
Sanders is right to reference the role of grassroots movements.
Four years ago, when the US Supreme Court removed barriers to corporate spending to buy elections, serious reformers said a constitutional amendment would be necessary to reverse the Court’s Citizens United ruling. Most pundits and politicians, even those who recognized the threat posed to democracy by the opening of the floodgates for big money, dismissed a constitutional fix as too bold and too difficult to achieve.
But the people embraced the constitutional route to reform. Grassroots organizing succeeded in getting sixteen states and close to 600 communities to formally demand that Congress act.
At the same time, the money poured in, with campaigning spending breaking records in the 2012 presidential and congressional elections—and heading toward breaking the record for midterm elections in 2014.
That was enough to shake up even the most cautious Senate Democrats, who began moving earlier this year to advance the Udall amendment. Though activists wanted a stronger amendment, the Senate deliberations confirmed that there is broad support for a constitutional response to the money-in-politics mess—and that a substantial number of senators now see that constitutional response as right and necessary.
“Less than five years after the Citizens United decision sparked national outrage, we have seen the movement to get big money out of politics go from local, grassroots organizing to a vote in the United States Senate,” explained People for the American Way Executive Vice President Marge Baker, who worked with activists from Public Citizen, Common Cause, Free Speech for People and other groups to collect and deliver 3.2 million signatures on petitions supporting an amendment. “Today’s historic majority vote is a remarkable milestone for this movement and a platform for taking the fight to the next level. The debate in the Senate this week is a debate that Americans across the country who are passionate about fixing our broken democracy have wanted to see.”
With the DC debate done, for now, the fight goes back to the grassroots. Activists with groups such as Move to Amend, Public Citizen’s “Democracy is for People” campaign and Free Speech for People will continue to organize and agitate, not just for an amendment but for an amendment that makes it absolutely clear that money is not speech, that corporations are not people and that citizens have a right to organize elections where votes matter more than dollars.
“We have amended the US Constitution before in our nation’s history. Twenty-seven times before. Seven of those times to overturn egregious Supreme Court rulings. For the promise of American democracy, we can and we will do it again,” declared John Bonifaz, the president of Free Speech for People, said Thursday. “The pressing question before the nation today is whether it is ‘we the people’ or ‘we the corporations and big money interests.’ This is not a Democratic issue or a Republican issue. This is a deeply American issue. Whatever our political differences may be, we all share the common vision of government of, for, and by the people. Today’s US Senate vote is just the beginning. While this amendment bill did not receive this time the required two-thirds support in order to pass the Senate, we will be back again and again until we win. History is on our side.’

“An Onion Of Crazy”: Republicans Have A Joni Ernst Problem
Throughout the 2014 campaign season, the Iowa Senate seat held by retiring Democrat Tom Harkin has emerged as a surprisingly strong pickup opportunity for the Republican Party. President Barack Obama is wildly unpopular in Iowa, and Democratic nominee Bruce Braley has struggled to gain traction throughout the race (over the past five months, he’s seen a 10-point lead evaporate). But Republicans have a problem: their own nominee, state senator Joni Ernst.
Ernst has been an unconventional candidate from the beginning, but recently her curiosities have developed from quirky to extreme. In May, Ernst claimed that Iraq did, in fact, have weapons of mass destruction when the U.S. invaded. In June, video emerged of her vowing to stop Agenda 21, a non-binding UN resolution that she erroneously sees as a nefarious plot to outlaw property ownership. In July, she struggled to explain her flip-flop on whether President Obama “has become a dictator” who needs to be removed from office. Later that month, it was reported that Ernst believes that states can nullify federal laws they dislike.
Now another of her far-right positions is drawing widespread attention. In a Monday interview with the Globe Gazette, Ernst called for completely eliminating the federal minimum wage.
“The minimum wage is a safety net. For the federal government to set the minimum wage for all 50 states is ridiculous,” she said.
“The standard of living in Iowa is different than it is in New York or California or Texas,” she added. “One size does not fit all.”
Ernst’s comments represent a fundamental misunderstanding of how the minimum wage works. It is not “one size.” Although the federal government guarantees that the minimum wage cannot dip below $7.25 per hour, states can set their own rates (and they do — for example, New York’s is $8, and California’s is $9).
This is not the first time that Ernst has spoken out against the minimum wage; sensing opportunity, the Democratic Senatorial Campaign Committee has compiled an extensive list of her statements that government should have no role in the issue.
But Iowa voters seem unlikely to give her credit for consistency. In terms of both policy and politics, Ernst’s position is far out of line with her own state.
Iowa, which currently has a $7.25-per-hour minimum wage, would benefit greatly from the bill proposed by Senator Harkin and Rep. George Miller (D-CA) to gradually raise the federal minimum to $10.10. According to an Economic Policy Institute analysis, a $10.10 minimum wage would increase wages for 306,000 workers in Iowa — more than one-fifth of the workforce — and generate $272,483,000 of economic activity. Eliminating it altogether? Not so much.
Polls have consistenly shown that Iowans side with Braley, who favors an increase to $10.10, over Ernst in this case. So it’s no surprise that Braley has been using the issue to go after the Republican nominee.
The minimum wage attacks are just one part of Democrats’ broader campaign to paint Ernst as too far on the fringe for Iowa (or “an onion of crazy,” as Democratic National Committee chairwoman Debbie Wasserman Schultz recently put it). They have also targeted her as out of touch on Medicare and Social Security.
If Democrats can’t make Iowans fall in love with Bruce Braley by November, it appears that they will try to do the next best thing: Make them view Ernst as extreme to the point of unelectability. And nobody is helping them make that case more than Ernst herself.

“2014 And The Limits Of Rage”: Voters May Decide That Rage Has Its Limits And Government Has Work To Do
The short-term future of politics in the nation’s capital will be determined in large part by which party ends up in control of the Senate. But for a sense of the long-term future of politics in the country as a whole, watch the governors’ races.
The question to ask: Do voters begin to push back against the tea party tide that swept governorships and legislatures into Republican hands four years ago and produced the most radical changes in policy at the state level in at least a generation?
On the Senate races, two things are true. Simply because so many Democratic seats are at stake, the GOP has an edge. Republicans have probably already secured three of the six pickups they need to take control next year. But in the rest of the races, they have yet to close the deal. This year, late-breaking news and how well campaigns are run will really matter.
But something else is true about the fight for the Senate that is much less relevant in the struggle for governorships. Most of the key Senate contests are in Republican-leaning states where President Obama is not popular. GOP candidates are thus making him a big issue against Democrats. The 36 governors’ races, by contrast, span red and blue states, and many are in battlegrounds that decide presidential elections.
The Senate elections are backward-looking referendums. The governors’ races are forward-looking.
The one exception to the Obama rule may be Florida, where the former governor — and former Republican — Charlie Crist swept to a 3-to-1 victory in the Democratic primary Tuesday over former state senator Nan Rich. The primary was taken as a measure of how well-accepted Crist is in his new party, and the result was heartening for the Democrats’ marquee convert.
Unusually for Democrats this year, Crist has hugged Obama close and has hired many of the president’s key operatives to run his campaign. The former governor is essentially deadlocked in the polls with incumbent Rick Scott, a Republican, and much will depend on the willingness of Democrats to go to the polls in November. Four years ago, turnout was lopsided in favor of the Republicans, as Adam Smith, the Tampa Bay Times political editor, has noted. Crist is one of the handful of Democrats whom Obama may really be able to help this year.
Tuesday’s other major gubernatorial primary was in Arizona, which offered exactly the opposite lesson. Republicans chose the tea party’s favorite, state Treasurer Doug Ducey, a former partner and chief executive of Cold Stone Creamery. Ducey got 37 percent in a six-way race and vastly outspent second-place finisher Scott Smith, the former mayor of Mesa and the moderate in the race. Smith supported Gov. Jan Brewer’s expansion of Medicaid (she endorsed him over Ducey) and also the Common Core education standards.
It was striking on Tuesday night that Smith’s concession speech sounded a lot like the victory speech of Democrat Fred DuVal, who won his party’s nomination unopposed.
“We had a vision about bringing people together,” Smith said. “We gave them a message maybe that wasn’t red meat. Maybe it didn’t fit the primary campaign mode. But it was the truth.”
DuVal, who badly needs votes from independents and crossover Republicans, played down party altogether in his primary-night address. “What’s missing are leaders who care less about party politics and more about building a future together and growing our economy,” DuVal said. “We’re going to stop fighting and start fixing Arizona for Arizona families.” Ducey, who was endorsed by Ted Cruz and Sarah Palin, will be pressed to occupy some of the center ground that DuVal hopes to make his own.
The tea party has opened opportunities for Democrats elsewhere to frame this year’s choice as being between right-wing ideology and problem-solving. In Kansas, a poll released this week showed Democrat Paul Davis with an eight-point lead over Gov. Sam Brownback (R). A Brownback loss would be a devastating blow to the tea party’s approach to policy. In Wisconsin, Gov. Scott Walker, another hero to the right, is in a dead heat with Democratic businesswoman Mary Burke.
Democrats also have a very good chance of ousting Republican governors in Pennsylvania and Maine, although they face tough challenges to their incumbents in Illinois and Connecticut.
In 2010, an electorate heavily populated with tea party supporters expressed rage against government at all levels. In 2014, voters may decide that rage has its limits and that government has work to do.

“Rubio vs. Rubio On Immigration Reform”: His New Line Is The GOP Should Get 100% Of What It Wants Now, And Later
Sen. Marco Rubio’s (R-Fla.) has a challenge for which there is no obvious answer. He helped write a popular, bipartisan immigration-reform bill, which his party’s base hates with the heat of a thousand suns. If the conservative Floridian abandons his own legislation, he looks craven and cowardly. If the senator stands by his work, the Republican base will reject him.
And so Rubio is left trying to distance himself from his own bill in a way that doesn’t make him look ridiculous. As we were reminded yesterday, it’s easier said than done.
Sen. Marco Rubio (R-Fla.) on Sunday said Congress “will never have the votes” for a comprehensive immigration bill without first addressing border security, urging a step-by-step approach to the issue.
“We will never have the votes necessary to pass a one, in one bill, all of those things,” said Rubio on “Fox News Sunday” about border security, a path to legalization and an overhaul of the nation’s immigration laws. “It just won’t happen.”
What’s wrong with this? Well, everything.
First, the whole point of comprehensive immigration reform, which Rubio championed as recently as last year, is to create a compromise framework that both parties could embrace: Republicans get increased border security; Democrats get a pathway to citizenship for undocumented immigrants who are already in the United States. Rubio’s new line is that the GOP should get 100% of what it wants now, and later, Republicans will think about Democratic priorities.
In other words, the senator has gone from endorsing a bipartisan compromise to endorsing a policy in which his party gets everything it wants in exchange for nothing but the promise of possible action at some point in the future.
Second, while Rubio 2013 believed Congress can and should pass his bipartisan legislation, Rubio 2014 insists his bill “just won’t happen” because “we will never have the votes.” But this too is at odds with what we know – by many estimates, if the House Republican leadership brought comprehensive immigration reform to the floor, it would pass. That assessment is shared by many from the left, right, and center, which is why GOP leaders refuse to allow the House to work its will.
When Rubio says the votes aren’t there, he arguably has it backwards – the bill passed the Senate easily, and would likely fare just as well in the House if given a chance.
As for the Florida Republican inching away from his own positions, Rubio remains in an awkward spot.
“Fox News Sunday” host Chris Wallace on Sunday challenged Sen. Marco Rubio (R-FL) to explain why he pulled his support for the Senate bipartisan immigration reform bill.
Wallace displayed polls showing Rubio’s favorability taking a hit since supporting the bill. “Is that why you have now switched and said we have to do this in stages with enforcement first and any dealing with legality or citizenship for the immigrants way down the line and afterward?” Wallace asked.
Rubio said his stance on immigration reform has nothing to do with politics.
Perish the thought.
