“Republicans Still Love Gitmo”: Don’t Want To Admit They Were Wrong To Support The Cuban Prison In The First Place

The Republicans have a strange emotional attachment to keeping the prison at Guantanamo Bay open for the foreseeable future. As an explanation, I kind of discount actual fear that the inmates might escape from a super maximum security prison in the United States. I know they fan that fear whenever the subject of closing Gitmo comes up, but I believe this is just a tactic.

Maybe they just don’t want to admit that they were wrong to support the Cuban prison in the first place. That certainly seems to animate the most vocal opponents who also are the most notorious neoconservative members of the Senate.

Take a look at how they’re responding to the administration’s just-announced plan to close the notorious facility:

Senator John McCain, the Arizona Republican who chairs the armed services committee, all but rejected a plan he himself has urged the administration to submit. McCain has shifted his positions on Guantánamo from the Bush to the Obama administrations, but has positioned himself as the last gasp of Obama’s ambitions to win congressional support.

McCain, while pledging to look at the plan in hearings, termed it “a vague menu of options, not a credible plan for closing Guantánamo, let alone a coherent policy to deal with future terrorist detainees,” and said Obama had “missed a major chance”.

Senator Kelly Ayotte, a New Hampshire Republican on the armed services committee, preemptively rejected the final proposal in a statement.

“The president is doubling down on a dangerous plan to close Guantánamo – a move that I will continue to fight in the Senate,” Ayotte said.

Senator Tom Cotton, the Arkansas Republican and war veteran, dismissed the plan as a “political exercise”. Cotton, a rising star in GOP national security circles, received significant media attention for declaring Guantánamo detainees “can rot in hell” last year.

Then there’s Marco Rubio, who is already criticizing the plan on the campaign trail, saying that not only shouldn’t the prison close, but we should never give the property at Gitmo back to a “communist dictatorship.”

I don’t expect Congress to act on the president’s plan. Maybe Obama will act after the November election when he’s truly a lame duck. What are they gonna do? Impeach him?

“Not At All What Republicans Wanted To Hear”: O’Connor Undermines GOP Talking Points On Court Vacancy

In the fight over filling the Supreme Court vacancy, Republicans clearly have the more difficult task, at least when it comes to rhetoric and public relations. The Constitution has already made clear how the process is supposed to unfold, it’s now up to GOP senators to make the case that they should ignore – indeed, they have an obligation to ignore – the constitutional model.

Republicans can’t come right out and say the truth, since “we hate the president” isn’t a compelling talking point, so they tend to frame their concerns as high-minded. As Sen. Orrin Hatch (R-Utah) put it yesterday, the partisan blockade against any court nominee is intended to protect the institution from “politicization” and “denigration.”

It’s difficult to take such an argument seriously, and it certainly doesn’t help when an actual retired Supreme Court justice seems to have no use for the right’s talking points. The Huffington Post reported yesterday:

Sandra Day O’Connor, the retired Supreme Court justice appointed by a Republican president, said on Wednesday that President Barack Obama should get to name the replacement for the late Justice Antonin Scalia.

O’Connor, in an interview with a Fox affiliate in Phoenix, disagreed with Republican arguments that the next president, and not Obama, should get to fill the high court vacancy.

O’Connor specifically said during the interview, “I think we need somebody there to do the job now and let’s get on with it.” She added, in reference to President Obama, “It’s an important position and one that we care about as a nation and as a people. And I wish the president well as he makes choices and goes down that line. It’s hard.”

That’s not at all what Republicans wanted to hear.

On the contrary, O’Connor, a Reagan appointee who retired in 2006, effectively said the opposite of what GOP senators have argued since Saturday night.

Republicans have said the seat should remain vacant for 11 months; O’Connor wants the confirmation process to begin and for a new justice to take the seat “now.” Republicans have argued that the president shouldn’t nominate anyone; O’Connor made clear the nominating choice is up to the president.

Obviously, O’Connor is now a private citizen and her opinions are her own, but she’s also a respected figure, especially on matters related to the high court. If she’d said the opposite in the interview, encouraging Obama and sitting senators to leave the seat vacant until 2017 for the good of the institution, it’s a safe bet Republicans would be citing her judgment every day for the next several months.

But she didn’t. O’Connor seems to have no use for the GOP arguments whatsoever.

“The Unprecedented ‘Precedent'”: What Kind Of Dictator Must Obama Be To Oppose 80 Years Of “Standard Practice”?

How can you tell the seemingly unanimous position of the Republican Party that President Barack Obama should not be permitted to select the late Supreme Court Justice Antonin Scalia’s successor is motivated by something other than apolitical concern for the republic? You can start by looking at the ways that their main talking point – that such an election-year nomination hasn’t been confirmed in 80 years – is both factually incorrect and more broadly intellectually dishonest and a novel reinterpretation of “precedent.”

Eighty years has become a truly magical number in the day since Scalia shuffled off this mortal coil. “The fact of the matter is that it’s been standard practice over the last 80 years to not confirm Supreme Court nominees during a presidential election year,” Republican Senate Judiciary chair Chuck Grassley said. Standard practice! What kind of dictator must Obama be to oppose 80 years of standard practice? “It has been over 80 years since a lame duck president has appointed a Supreme Court justice,” Florida Sen. Marco Rubio said in the Republican presidential debate Saturday night; “We have 80 years of precedent of not confirming Supreme Court justices in an election year,” Texas Sen. Ted Cruz echoed.

Flim-flam and jiggery-pokery.

Just as a factual matter, as has been widely noted, Reagan nominee Anthony Kennedy was (unanimously) confirmed to the court in February 1988 – not only an election year but a year in which Reagan was term-limited and could not run again. So just right off, the talking point is wrong. (Grassley, by the way, broke with his own self-professed “standard practice” and voted to confirm Kennedy.)

But! But! But Kennedy was nominated in 1987, so he doesn’t count, right? When was the last time in history that a president nominated someone for the court in an election year and the Senate confirmed them? That would be Franklin Roosevelt nominating Frank Murphy, then the attorney general, on Jan. 4, 1940, and the Senate confirming him 12 days later. So that was 76 years ago, which is still less than the enchanted “80” benchmark.

So where does the 80-year figure come from? So far as I can tell – through a cursory bit of Googling – it originated with a National Review post from Ed Whelan at 5:32 p.m. yesterday, some minutes after the news of Scalia’s untimely demise started to spread around the country. Points to Whelan for quick research but note how he phrased his item: “It’s been more than 80 years since a Supreme Court justice was confirmed in an election year to a vacancy that arose that year, and there has never been an election-year confirmation that would so dramatically alter the ideological composition of the Court.” He was referring to Benjamin Cardozo, “confirmed in March 1932 to a vacancy that arose in January 1932,” 84 years ago.

Note the rhetorical evolution from Whelan’s careful phrasing (“… in an election year to a vacancy that arose that year”) to the more widely promulgated talking point as expressed by, say, Grassley (“standard practice over the last 80 years to not confirm Supreme Court nominees during an election year,” period) or Cruz (“80 years of precedent of not confirming Supreme Court justices in an election year”).

Details, details, right? Do they matter? Well, yes, they do. Cruz, Grassley and anyone who repeats the assertion that there’s 80 years of precedent against confirming nominees in an election year is, in fact, wrong.

And the difference is important for a couple of reasons: First, imprecision reflects the questionable logic of the alleged precedent: that Obama’s “lame duck” status – lame duck traditionally means that his successor has been chosen, not that at some point in the future he’ll definitely be out of office – should deprive him and relieve senators of their constitutional duty. How better to justify this notion than by invoking tradition. But this is not a tradition of nonconfirmation in an election year (Kennedy was confirmed) or of presidents not nominating in an election year (Lyndon Johnson nominated Abe Fortas and Homer Thornberry in 1968) or of only confirming in an election year if the nomination came in the previous year (Murphy), but of not confirming in an election year when the vacancy occurred in that year.

That’s a much narrower standard than is being broadly bandied about. But it has to be or else the 80-year “standard practice” becomes less impressive: 76 years, or 48 years or 26 years.

The beauty of 80 years is that it sounds like an awfully big number – saying that the GOP is merely abiding by the “standard practice” of 80 years makes it sound routine, as if this is something that’s come up time and again over eight decades and is a settled matter. But since Cardozo was confirmed this narrowly drawn set of circumstances has arisen … once. Once! One instance in eight decades does not “standard practice” make.

Neither does it make 80 years of precedent. In fact it’s the opposite of precedent: The fact that 84 years ago Cardozo was nominated and confirmed to an opening that arose in an election year is actually precedent for – wait for it – considering an Obama nominee.

So if not respect for venerated precedent, what is going on here? Simple: The GOP neither wants to put another Obama nominee on the court nor allow its ideological balance to tip – especially when there’s a nontrivial chance that a year from now they’ll be able to replace Scalia with someone of like philosophy.

Does anyone think that if Scalia had died in December – before the election year – that the GOP reaction would be at all different? Or that in an alternate reality Senate Majority Leader Mitch McConnell is telling President Mitt Romney that a Supreme Court nomination won’t be considered because he’s in the last year of his term?

The party is putting governing on hold in the name of political calculation. Republicans should own up to it and drop both the “80-year” talking point and the larger pretense of principle.

“When The Applause Dies For Jeb Bush”: He Misjudged The Depth Of The Anger And Division Within His Own Party

“Please clap,” Jeb Bush wryly told a subdued crowd in New Hampshire last week, a moment that epitomizes his problem.

The pundits call it lack of traction. Among too many voters it’s lack of interest.

If Jeb bombs in New Hampshire, he’s done. Even if he doesn’t quit the race, it’s over.

A year ago this scenario was unimaginable. He had more money, more brains, more connections and more governing experience than any other Republican wanting to be president. Like many people, I thought his nomination would be a slam dunk.

The gaseous rise of Donald Trump upended everything, but not only for Jeb. The other candidates had to scramble, too. Some did a better job.

Sure, Iowa is a silly place to start a presidential campaign. Its demographics are freakishly white, and the GOP electorate is anomalously dominated by evangelical Christians.

Still, Jeb spent plenty of time and money there, and wound up with only 2.8 percent of the vote. That’s miserably weak, and there’s no positive spin.

What’s happening? The answer is, for better or worse: Not much.

Jeb hasn’t made any huge, embarrassing blunders on the campaign trail. He’s not obnoxious or unlikable. True, he’s not an electrifying personality, but in most election cycles that wouldn’t disqualify him.

Obviously, he misjudged the depth of the anger and division within his own party. He isn’t the only candidate to get caught off guard.

But he is the only Bush on the ballot, and that’s probably hurt him more than it has helped. Jeb isn’t the one who invaded Iraq and basically exploded the Mideast. He isn’t the one who jacked up the deficit with war spending and then left the U.S. economy teetering on a cliff.

That was his brother, but seven years later lots of voters haven’t forgotten. Before committing to Jeb, they need to be convinced that he’s way different from George W., that he’s wiser and more careful, and that he doesn’t have a Dick Cheney blow-up doll riding shotgun.

So far, there is no sign of a grass-roots pro-Jeb frenzy. The fact he was Florida’s governor for two terms isn’t wowing the masses — even in Florida.

Polls here show Jeb trailing Trump, Ted Cruz and Marco Rubio. He is only slightly ahead of the sleepwalking Ben Carson.

How is this possible? That question is echoing among the heavy hitters who gave more than $100 million to Jeb’s super PAC. They’re running out of patience.

Jeb’s new strategy is tag-teaming with New Jersey Gov. Chris Christie to tear down Rubio, who surged impressively and finished third in Iowa. Christie is playing the Don Rickles role, insulting Rubio in public, while the Bush team bankrolls a flurry of anti-Marco ads in the media.

The New York Times reports that Jeb has already spent $20 million attacking his former protege. I guess this means no more workouts together at the Biltmore gym.

It’s a grim battle for the sane wing of the Republican Party, which means placing at least third in New Hampshire.

The positioning is crucial because Trump’s vaudeville act is starting to fray, and the icy zealotry of Cruz scares many conservatives.

If this were a script, you would now write in a timely entrance by the seasoned, well-credentialed Jeb Bush.

Except, wait — there’s baby-faced, inexperienced Marco ahead of him. Way ahead.

Here’s a guy who has accomplished zero in the Senate, flip-flops when he feels the heat and can’t even manage his own credit cards. How is he beating an old pro like Jeb?

By successfully casting himself as a fresh and electable alternative. Rubio’s only got one speech, but he’s good at it. Ironically, he grew up to be slicker and more calculating than his mentor.

Such is Jeb’s desperation that he has a new campaign commercial using a photo of Terri Schiavo. She was the brain-dead woman whose husband and parents were locked in a legal fight over the continuation of life-support procedures.

As governor, Jeb inserted himself into the case, ultimately involving his president brother and Congress in the effort to keep a feeding tube in Schiavo, who’d been comatose for 13 years.

Eventually the courts put a stop to the political meddling, and she was allowed to die.

The episode was Jeb’s worst mistake in office, an obscene governmental intrusion into a private family tragedy. Now he’s dredging up the memory in hopes of attracting extreme right-to-life voters.

If he asks you to clap, you know what to do.

“The Waterboy”: The Rick Snyder Vision, The Republican Vision, If You Don’t Have Money, You’re Not Really A Citizen

May I suggest the ideal Republican vice-presidential candidate for whichever wingnut secures the GOP nomination this year: Michigan Governor Rick Snyder.

Is there any doubt that America’s worst governor would be the perfect partner for the 2016 Republican nominee? Snyder’s handling of the Flint water crisis succinctly symbolizes the GOP’s vision of government: penny-pinching, cold, scornful of the weak and vulnerable, operating with reckless disregard for future generations. The Republican base wants a truly conservative ticket: a Trump-Snyder or Cruz-Snyder pairing would deliver that dream.

Ever notice that Snyder doesn’t seem to have any real remorse or sorrow for his actions towards Flint’s residents? His “apology” in his January 19 State of the State address was a pathetic joke, one that failed to convince any sentient from America. Snyder never gave a damn about the residents of Flint, and still doesn’t. The Snyder vision–the Republican vision–is that if you don’t have money, you’re not really a citizen.

Eight years ago, in an interview with Thomas Frank about President George W. Bush’s failures, MSNBC’s Rachel Maddow observed:

[T]his is a problem of conservatism. This is a problem of letting people run government when they believe that government can’t work and ought not work.

No wonder Maddow has been so outraged by Snyder’s human-rights abuses, as we all should be. Maddow understands that Snyder is conservatism. He is continuing the dark tradition Ronald Reagan gave birth to 35 years ago when he declared, “Government is not the solution to our problem; government is the problem.”

Yet government is not the problem per se. Government run by people who hate government is the problem. Government run by people who regard certain citizens as worthless moochers undeserving of the basic necessities of life is the problem.

We hear so much about the compassion so many Americans feel for the victimized residents of Flint. Yet we must acknowledge the sad reality that there are far too many Americans who simply don’t give a damn about the residents of Flint…who couldn’t care less that they’re drinking contaminated water…who turn a blind eye, a deaf ear and a cold heart to those whose health has been damaged for life as a result of Snyder’s deranged decision-making.

Those are the very same Americans who are embracing the hate-filled messages of Donald Trump and Ted Cruz. Those are the very same Americans who probably think Snyder is the real victim in the Flint crisis–the victim, of course, of “political correctness,” “race hustlers” and the “liberal media.”

Recall the repulsive running mates Republicans have selected over the decades. Richard Nixon in 1952. Spiro Agnew in 1968. Dan Quayle in 1988. Dick Cheney in 2000. Sarah Palin in 2008. Paul Ryan in 2012. Considering this track record, would Snyder really be that far-fetched of a choice?

Think about what animates the right today: Contempt for the mainstream media. Contempt for racial minorities. Contempt for government. Contempt for those outside of the right-wing tribe. Snyder would appeal to all of the right’s darkest impulses: selecting him as VP would be the ultimate bleep-you to progressives, the “political establishment” and the Fourth Estate. I wouldn’t put the selection of Snyder past this radicalized and reckless Republican Party. Would you?
