“Obamascare Tactics In Red State Races”: Passing Laws That Prevent Any Future Governor From Accepting Medicaid Money

If I asked you to name two states where the incumbent Republican governors might lose reelection this fall, you would likely, I expect, say Florida and Pennsylvania. I doubt very much you’d offer up Georgia and Kansas.

But lo and behold—the contests in both of those states are right now a little closer than you’d expect. In Kansas, Sam Brownback is the governor. You remember Brownback—he was a senator for a spell, best remembered (by me anyway) for his prominent role in that hideous Republican appropriation of poor Terry Schiavo in their zealotry to “promote life.” In Georgia, the bossman is Nathan Deal, also a former Congressman, whose term is best remembered for the way he announced a departure date for his gubernatorial run. (He realized that the House would be voting on Obamacare shortly thereafter, and delayed his departure so he could vote against it.)

It ought to be easy-peasy-lemon-squeezy for right-wing Republicans to get reelected in those states, but recent polls have shown them dangling along the margin-of-error cliff. Deal leads Jason Carter (yep, Jimmy’s grandson) by just 3.4 percent in the realclearpolitics average, and Brownback actually trailed Democrat Paul Davis 42-40 in one February poll. Brownback’s approval rating is also deeply underwater. So it’s conceivable—that’s as far as we should prudently go—that both could lose.

Now, here’s the rub. Both, naturally, oppose the expansion of Obamacare into their states. They say no force on earth or in heaven will make them take that Medicaid money. It’s estimated that 600,000 Georgians and 78,000 Kansans would benefit. But they’re having none of it. And that’s their right. But what they’re doing now, in cahoots with friendly legislators, is a step beyond: In both states, they’re passing laws that would prevent any future governor from accepting the Medicaid money.

It works like this. Under the Affordable Care Act, the process by which states decide to accept the money is entirely up to them. Some states determined that legislative action should be required. You may have read about the Republicans in the Florida legislature rebuffing GOP Governor Rick Scott for the five minutes he was toying with taking the money. New Virginia Governor Terry McAuliffe wants the money badly, and his Democratic State Senate is with him, but they’re hamstrung by the GOP-controlled House of Delegates, which is against.

Initially, Georgia and Kansas were states where it was just the governor’s call. Which was fine as long as the Republicans looked like sure things. But the polls tightened up, and people started getting a little antsy. Hey, what if a Democratic governor got elected and said, ‘Okay, Barack, write me that check?’

And so Brownback signed his state’s law last Friday. His office just announced it this week. Why the delay? Shouldn’t one such as Sam Brownback be proud of signing this socialism-blocking law? Well, it turns out that it was originally a law about something else, requiring the state to provide quick payment to certain in-state Medicaid care providers. This provision was tacked on late. A Wichita Democrat, Jim Ward, said: “That bill is what I think is endemic with this legislative process under this governor and this speaker and Senate president. There was no hearing. There were no opportunities for people who have a stake in Medicaid expansion to come in and talk about it.”

In Georgia, it’s easier. The legislation was passed about a month ago. If Deal doesn’t veto it, it becomes law. And since he supports it—indeed, since his staff helped write this law that willingly hands gubernatorial power over to the legislature—it will. And into the bargain, the Georgia legislature also passed—on the next-to-last day of the session—a bill that blocks state employees from helping Georgians sign up for care under the ACA.

So stop and think about this. Kansas and Georgia have just taken what was a gubernatorial decision out of the hands of not only current but future governors. You can argue plausibly that the people’s representatives should have a say in such a decision, on principle. But principle wasn’t at work here. Political expediency was. Legislators in the two states know that Republicans are likely to have control as far as the eye can see. And they’ll never say yes. And they’re doing all this in the name of what? In the name of denying 678,000 people a chance at health-insurance coverage.

It gets worse. The ACA makes cuts to certain current Medicaid programs on the assumption that states would take this new Medicaid money. It cut funding for hospitals that serve the poor, cuts intended to be mitigated by the fact that a large number of poor would now be insured once the states they live in accepted the new money. But in states that did not, those people are suffering even more. Several rural hospitals in Georgia have closed. They could be saved if the state took the Medicaid money.

Carter vows he’s going to make this skeezy law, and the Medicaid question generally, an issue. The Georgia law has sparked large protests and arrests and might end up being the most important issue in the campaign. In Kansas, Davis supports Medicaid expansion—and according to a recent poll so do 55 percent of Kansans, against just 39 percent who oppose taking the money. So maybe there’s not as much the matter with Kansas as we thought. With the people, anyway. The governor and the legislators are another matter.

“Stuck In The First Stage Of Grief”: GOP Reflexively Making Themselves Feel Better About A Reality That’s Causing Them Pain

At a press conference last week, President Obama announced a figure that was hard to even imagine a month ago: 8 million consumers signed up for private insurance through exchange marketplaces during the Affordable Care Act’s open-enrollment period. Obama also took a moment to chide Republicans for having been wrong about practically every aspect of the debate.

“I recognize that their party is going through the stages of grief,” he said, “and we’re not at acceptance yet.”

That sounds about right, though I’m not sure the GOP is “going through the stages of grief” so much as it’s stuck on the first one. If the process is believed to have five stages – denial, anger, bargaining, depression, and acceptance – we have quite a ways to go before “acceptance” is even on the horizon.

Denial still dominates.

Rep. Tim Huelskamp (R-Kan.) said Monday he believes the uninsured rate in his state has increased since implementation of the 2010 health care reform law.

“It’s hard to get accurate numbers on anything,” Huelskamp told his constituents at a town hall in Salina, Kan., according to video posted by Eagle Community Television. “But the numbers we see today is that – as I understand them – we believe there are more people uninsured today in Kansas than there were before the president’s health care plan went into effect. And I thought the goal was to bring more people into insurance.”

There are a wide variety of counts when it comes to determining just how many uninsured Americans have been able to get coverage, but all of the reports have something important in common: they all show the rate of the uninsured going down, not up. We can discuss exactly how many, whether that’s in line with expectations, whether that’s enough to sustain the larger system, and why progress is happening faster in blue states than red states.

But to argue that the number of uninsured people is climbing is comparable to arguing that the federal budget deficit is getting larger; the planet is experiencing global cooling; and Obama has pushed use of executive orders to new heights.

Oh wait, conservative Republicans often believe all of those bogus claims, too.

Obviously, the problem isn’t limited to Huelskamp. On Friday, Sen. Dean Heller (R-Nev.) said he doesn’t believe the Obama administration’s enrollment totals, calling the figures “all smoke and mirrors.” On Thursday, House Majority Whip Kevin McCarthy (R-Calif.) suggested consumers receiving ACA subsidies to defray the costs of coverage may be engaged in “fraud.”

Much of the Republican establishment quickly embraced the “cooking the books” conspiracy theory, which was soon after followed by the Census Bureau conspiracy theory.

The right doesn’t bother with evidence to bolster any of this – evidence is irrelevant. Denial isn’t about rationality; it’s about reflexively making one feel better about a reality that’s causing them pain.

That said, GOP officials aren’t just embracing denial, they’re swimming in it in the most self-indulgent fashion possible. Republicans almost seem to be enjoying their distaste for health care reality, seemingly eager to one up their far-right colleagues.

Let’s also not brush past the “heads I win, tails you lose” problem – “Obamacare” critics believe the numbers are correct and reliable when they point to facts Republicans want to hear. Enrollment totals are low? This is proof that conservatives were right all along and that the ACA is a failure. Enrollment totals soared in March? This is proof that the White House is perpetrating a fraud – because conservatives were right all along and that the ACA is a failure.

It’s become effectively impossible under conditions like these for the two sides to even have a conversation about health policy. Paul Krugman’s take over the weekend rings true:

Not a day goes by without some prominent Republican politician or pundit insisting that the enrollment numbers are phony, that more people are losing insurance than gaining it, etc.. I know that’s what the base believes, because it’s what they hear from Rush and Fox. But you would think that important people would have someone around who has a clue, who knows that enrollment data and multiple surveys are all telling the same story of unexpected success. OK, maybe not – if famous senators don’t have anyone to clue them in about BLS data, they might really still be living in the bubble. But that’s really their choice.

And the point is that with enrollment more or less closed for 2014, there’s not much point in spinning. OK, maybe if you can keep up the pretense all the way to November, you can slightly sway base voters for the midterms. But even that’s doubtful – by the fall, we’re going to have a very clear picture of how things went; and the shape of that picture has already been determined.

I guess that what gets me is the – to use the technical term – wussiness of it all. Isn’t there any space on the right for people who sell themselves as tough-minded, who condemn Obamacare on principle but warn their followers that it’s not on the verge of collapse? Is the whole party so insecure, so unable to handle the truth, that it automatically shoots anyone bearing bad news?

I’m going to assume those are rhetorical questions, because the answer seems pretty obvious.

“Last Gasps Of A Dying Movement”: Obamacare Obstructionists’ Self-Created Trap

Kevin McCarthy doesn’t have the best timing. The House majority whip released what he hoped would be the foundational document of Obamacare truthers, “Debunking Obamacare’s 7 million enrollees ‘success’ story,” the same day the White House announced that, in fact, 8.03 million Americans had enrolled in the insurance exchanges. Republicans will no doubt try to debunk the higher figure the same way, but the more we learn about who’s been covered under the Affordable Care Act, the harder it will be. It is, overwhelmingly, a success story.

I said the same thing back when the number was 7 million: Imagine how many more people might have been covered if shrill Republicans hadn’t made repealing and obstructing the ACA their top priority. The news that 35 percent of enrollees are under 35 is particularly heartening: it means many young people ignored the campaign to tell them not to sign up – remember that creepy Uncle Sam “doctor” and reports of cool campus keg parties? Yes, the president had Zach Galifianakis and Bradley Cooper – damn you, Bradley Cooper! Greg Gutfeld is still so angry at you – but imagine where we’d be without an organized national campaign to scare people out of signing up.

The campaign to discredit the act will continue. McCarthy’s dumb document lists five new metrics for measuring success, including how many enrollees have actually paid, and how many didn’t have insurance before. Those are old talking points, but they’ve added a new one – how many received subsidies — which is ugly in several ways. Republicans will use a high rate of subsidies, if that’s the case, to negate the act’s success, when in fact the subsidies were always key to it: You can’t have an individual mandate to purchase private insurance without making some provision to help those who can’t afford it. Affordability is why most didn’t have it in the first place.

But McCarthy also tacks on an ugly parenthetical, asking “how many received a subsidy (raising concerns about fraud).” Brian Beutler at the New Republic calls this an effort to “welfarize Obamacare,” to stigmatize it and also make it subject to the same hysteria about “fraud” that conservatives use to smear other social programs. Remember that Sen. Ted Cruz called the subsidies “sugar,” telling Sean Hannity that when Americans got a taste of it, they’d be “addicted to the sugar, addicted to the subsidies. And once that happens, in all likelihood, it never gets …”

“It’s over,” Hannity declared. “It never gets repealed.”

Exactly.

Still, a high rate of subsidies will let the GOP continue to demonize the “takers” vs. the “makers.” But some of them are going to have a big problem: A lot of the takers will turn out to be their voters. Poor Mitch McConnell: His own state of Kentucky, under the leadership of Democratic Gov. Steve Brashear, set up its own insurance exchange, expanded Medicaid and conducted a bold public health campaign to get folks into “Kynect.” Now Kentucky has reduced the number of uninsured by 40 percent – and many of those newly insured are McConnell’s aging white constituents.

McConnell seems appropriately alarmed. The man who has repeatedly pledged to “repeal” the law just this week told healthcare workers in Kentucky that repealing the law can’t happen while Obama is president, so “we’re going to figure out a way to get this fixed.” That softer tone isn’t sitting well with his Tea Party challenger Matt Bevin, who’s already accusing McConnell of being an Obamacare appeaser, but the Senate minority leader seems to be looking past Bevin to his November battle with Alison Lundergan Grimes.

The only thing that might get Republicans out of a mess of their own making is Democratic cowardice, and you can never underestimate the capacity of centrist and red state Democrats to sabotage themselves and their own party. We’ll see how hard Grimes hits McConnell over his role in obstructing the ACA; so far, it hasn’t been very hard at all. She needs to make him the man who’s trying to charge women more than men for insurance again; the man who’s trying to take healthcare away from 370,000 Kentuckians who have it thanks to Democrats.

Democrats have similar opportunities in Virginia and Arkansas. Republicans have been itching to make the midterms a referendum on Obamacare. Thursday’s news means that might not work the way they had planned.

“Conservative Crybabies Lose Again”: The Right’s Laughable New Obamacare Conspiracies, Officially Debunked

If you click through a few conservative news websites, you’ll learn all about the latest and most nefarious bit of lawless chicanery from the Obama administration as it tries to paper over the Affordable Care Act’s obvious failures. Jumping off from a New York Times report that the Census Bureau “is changing its annual [healthcare] survey so thoroughly that it will be difficult to measure the effects of President Obama’s health care law in the next report,” conservatives have put two and two together and come up with CONSPIRACY.

Megan McArdle asks, “Is Obama cooking the Census books for Obamacare?” Townhall’s Guy Benson suspects this change was implemented to boost Democratic fortunes for the midterms: “The brand new survey questions will unquestionably ‘reveal’ a dramatic decrease in the uninsured population, bureau experts say, which will deliver Democrats a super handy talking point. And oh-by-the-way, the artificially improved numbers will be released … this fall.” Mediaite’s Noah Rothman writes that the conservatives who argle-bargled in 2009 about the White House politicizing the census now look prescient. “The fears of some that the Census Bureau could be corrupted by the imperatives of the political operatives in the White House was today proven accurate.”

Nonsense. The timing of the switch is obviously not ideal, though, as Vox’s Sarah Kliff notes, the new methods will be used to collect data for 2013, before the state marketplaces went up and the Medicaid expansion took effect. The suggestion of political interference from the White House, however, is a bombshell accusation that, despite Rothman’s insistence, is nowhere near being “proven.” Evan McMorris-Santoro of BuzzFeed talked to a census official who said that the White House had precisely zero involvement in the changes implemented, and that the bureau had been discussing the shift “way before the ACA was an idea.”

Regardless, it’s a big story on the right, and not just because conservatives love a good conspiracy. In the past week or so, conservatives have seen their reliable avenues for attacking the Affordable Care Act evaporate right in front of them.

The announcement that Kathleen Sebelius was stepping down as Health and Human Services secretary sparked a brief round of schadenfreude and some enthusiastic sand-kicking at Ezra Klein, but ultimately Sebelius’ departure means that Republicans and conservatives have lost one of their favorite ACA punching bags. Her successor-in-waiting, Sylvia Mathews Burwell, is an experienced administrator and the rarest of rare things: an Obama administration official who is actually on good terms with key Republicans in Congress. They’ll have a tough time painting her as controversial, and (assuming she’s confirmed) Burwell will assume control of Obamacare as it swings upward from its functional and political nadir.

Speaking of which, as conservatives are trying to suss out White House manipulation of the Census Bureau, Obamacare keeps on doing exactly what it was intended to do. This week the Congressional Budget Office found that Obamacare will cover more people for less money than initially estimated, and that insurance premiums likely will not spike next year, thus driving a stake through three core conservative attacks on the health law.

Health insurers, who just last month were floating anonymous warnings of massive premium increases, are now starting to warm to the state health exchanges. “At least two major national insurers intend to expand their offerings,” reported Politico on April 16, “although a handful of big players like Aetna, Humana and Cigna, are keeping their cards close for now. None of the big-name insurers have signaled plans to shrink their presence or bail altogether after the first rocky year. And a slew of smaller health plans are already making moves to join more states or get into the Obamacare business for the first time.”

And, in a development that should shock no one, Gallup found that in states that embraced Obamacare (i.e., set up their own health exchanges and expanded Medicaid) the rate of uninsured adults declined three times faster than in those states that rejected the Medicaid expansion or had the feds set up their insurance marketplace. All told, Gallup’s findings translate to about 10 million newly insured Americans.

Obamacare works in states that want it to work, and the tangible benefits of that success are putting pressure on Republicans who have to date been antagonistic toward the law. As Greg Sargent observed, Republican Senate candidates are now suddenly reticent when it comes to discussing the Medicaid expansion. Most notable among them is Tom Cotton in Arkansas, where Medicaid was expanded under a compromise measure in which federal dollars are used to purchase private plans. Cotton supports the full repeal of Obamacare, but won’t comment specifically on Arkansas’ “private option” for Medicaid, amusingly dismissing it as “a state-based issue.”

I certainly don’t want to leave the impression that the Affordable Care Act has been neutralized as a political issue or that it won’t face problems down the road – a looming increase in healthcare costs, for example. But for now Obamacare is shoring up some of its biggest political vulnerabilities, leaving conservatives to sputter about census conspiracies.

“Stuck Between Obamacare And A Hard Place”: As A Massachusetts State Senator, Scott Brown Voted For Romneycare

Former Massachusetts Sen. Scott Brown will officially kick off his campaign to unseat New Hampshire Democratic Sen. Jeanne Shaheen tonight, as he attempts to return to the world’s greatest deliberative body (or something) after being ousted from his Bay State Senate seat by Democrat Elizabeth Warren two years ago. According to leaked excerpts of the speech he plans to deliver tonight, Brown will be campaigning against Obamacare, just as he did in 2010 when he won an upset in the race to succeed the late Sen. Edward Kennedy.

“Along with our money and our health plans, for a lot of us, it feels like we’re losing our liberty, too. Obamacare forces us to make a choice, live free or log on — and here in New Hampshire, we choose freedom,” Brown plans to say. (Get it? Because New Hampshire’s state motto is “live free or die.” But wait, if Obamacare is the major assault on freedom Republicans claim it is, do you have the choice to live free under it? Or is it just that “log on or die” didn’t send the right message? But I digress.)

There’s definitely a danger for Brown in taking this approach. Yes, the health care law has, according to a recent WMUR Granite State poll, a less than stellar approval rating in New Hampshire, with only 34 percent saying they approve of it while 53 percent say they oppose it. (Let’s add the caveat that the poll doesn’t say what portion of the opposition thinks the law goes too far and what portion thinks it doesn’t go far enough.) But Brown will have a hard time getting around the various problems other Republicans are running into when it comes to making Obamacare a focal point of a campaign.

For starters, the law may be unpopular in theory, but in practice, signups under Obamacare’s New Hampshire exchange have exceeded expectations. Does Brown have a plan for providing for those folks? Or how about the estimated 50,000 people who are going to receive health insurance under New Hampshire’s recently approved Medicaid expansion, which was made possible by Obamacare and on which Brown has thus far been mum? Those are real people who are experiencing real benefits from the law.

And therein lies the problem for Republicans, which Brown is eventually going to run into as well: Providing the benefits of Obamacare requires something that looks like Obamacare. Just look at this quote a Republican aide gave to Talking Points Memo’s Sahil Kapur (emphasis added):

As far as repeal and replace goes, the problem with replace is that if you really want people to have these new benefits, it looks a hell of a lot like the Affordable Care Act. … To make something like that work, you have to move in the direction of the ACA. You have to have a participating mechanism, you have to have a mechanism to fund it, you have to have a mechanism to fix parts of the market.

And Brown knew this once upon a time. As my former colleague Igor Volsky noted, as a state senator Brown voted for the Massachusetts health reform law that looks a whole lot like Obamacare.

This is exactly why the long awaited Republican health care alternative never actually comes to fruition. (Sure, some individual lawmakers have proposed plans, but the party hasn’t coalesced around one bill.) To actually craft an alternative, the GOP would either have to admit that Obamacare is a pretty darn conservative measure or admit, like House Budget Committee Chairman Paul Ryan did the other day, that the popular provisions and benefits of Obamacare have to go away as well in order to enact a more Republican-y plan.

Will that latter approach work in still quite blue New Hampshire? Or will Brown try to get away with hand waving about an Obamacare alternative that will never materialize? Either way, spouting “live free or log on” will be no slam dunk.
