“Congress Largely On The Sidelines For Paris Deal”: Mitch McConnell Is Powerless To Block Obama’s Climate Change Deal

One of the few times countries around the world have reached a climate change deal to cut global greenhouse gasses was the 1997 Kyoto treaty, which required binding cuts from industrialized nations. Top Republicans told the press it was “dead on arrival” and would never gain approval from the Senate. And that was, more or less, the end of Kyoto—other countries pointed to the U.S. never ratifying it as reason enough to ignore their own commitments.

Senate Majority Leader Mitch McConnell has now pledged to kill the latest emerging global consensus to act on climate change. His strategy is to obstruct a deal at the next major conference in Paris at the end of the year. As Politico reported earlier this week, congressional Republicans have returned from their August recess with every intention of derailing a deal long before we get to December. An aide to McConnell is reaching out to foreign embassies to detail how the GOP-controlled Congress plans to stop President Obama’s climate plan from moving forward.

But this won’t be another Kyoto, because McConnell just isn’t a credible threat to the global negotiations. Well aware that Republicans have not changed their minds on UN climate treaties—and have in fact gone to a greater extreme—negotiators have put together a different kind of deal for a Paris conference at the end of the year, one that looks nothing like Kyoto. Republican obstinacy is so predictable, it’s already baked into the structure, politics, and messaging ahead of a deal in Paris.

At Paris, countries are responsible for putting forward their own emissions plans. Though it’s not clear what structure the final deal will take—including which elements are binding and which are not—the emissions cuts proposed at Paris probably won’t require Senate approval because they won’t be binding, as they were in Kyoto. Obama has pledged U.S. climate action through executive authority. (Of course, that also means that many of his pledges in Paris will rely on the commitment of his successor.)

McConnell’s strategy is clear: Send the world some very mixed messages on what the U.S. intends to do about its own greenhouse gas emissions. He’s emphasizing Republican plans to block the Clean Power Plan, a key part of Obama’s strategy to cut the U.S.’s carbon footprint by reducing emissions from electricity 32 percent by 2032. The GOP’s likely tool will be the Congressional Review Act, which requires only a majority vote to repeal a law—but it’s still subject to Obama’s veto, which makes repeal unlikely. The Senate may also take up a bill passed by the Environment and Public Works Committee that delays the Clean Power Plan until court challenges are resolved, a process that could take years and years—but though the Supreme Court could send the regulation back to the Environmental Protection Agency, defenders insist it is on sound legal ground. One tactic might work in the short term: Congress’s control over appropriations gives the GOP the ability to withhold the $3 billion Obama promised to the Green Climate Fund, an international fund to help poorer nations adapt to climate change. But it’s unlikely that alone would be enough to blow up broader negotiations.

Despite the largely hollow threats from McConnell, the Obama administration has been conducting its own outreach to large polluters like China to explain how the U.S. can deliver on its promises in good faith without Congress’ input—as long as a Democrat is in office, that is. In March, the U.S. submitted its pledge to cut greenhouse gas emissions up to 28 percent by 2025 over 2005 levels. When negotiators ask State Department climate envoy Todd Stern about the “solidity of U.S. action,” he says he assures them that “the kind of regulation being put in place is not easily undone,” signaling that the White House is confident its Clean Power Plan and other EPA regulations can survive court battles and congressional opposition.

All this means mixed news for Paris: The bad news is that a single Republican is powerful enough to undo the deal—but not until long after December, and only if the GOP wins the White House in 2016. The good news, though, is this means Congress is largely on the sidelines for Paris and won’t make or break the negotiations. It won’t be Mitch McConnell who sinks a deal.

“Another Ridiculous Endeavor”: Republicans Schedule New ‘Obamacare’ Repeal Vote

There’s some disagreement about how many times House Republicans have voted to repeal all or parts of the Affordable Care Act. I’ve seen some estimates of 56 separate votes, though some put the total a little higher.

But let’s not forget their friends on the other side of the Capitol. As National Journal reports, Senate Republicans are at least going through the motions to keep their repeal crusade alive, too.

Senate Majority Leader Mitch McConnell has proposed repealing Obamacare as part of the long-term highway bill currently being considered in the upper chamber.

McConnell’s office said Friday that the Senate would vote Sunday on an amendment to the highway legislation that would repeal the Affordable Care Act. The initial vote, which would cap debate on the repeal amendment, would need 60 votes.

Obviously, this is a ridiculous endeavor. The very idea of repealing an effective health care law is increasingly bizarre, and as Senate GOP leaders realize, there’s zero chance of the repeal measure passing. The fact that Mitch McConnell sees this as a necessary part of the debate over highway spending is itself quite sad.

So why in the world is the Republican leader doing this, announcing an ACA repeal vote out of the blue? Apparently because McConnell is looking for an adequate pacifier for his far-right flank and this is the best he could come up with.

This gets a little complicated, but McConnell appears to see Obamacare repeal as a spoonful of sugar to help the medicine go down. The medicine, in this case, is the restoration of the Export-Import Bank. The Washington Post reported this morning on how the Senate Majority Leader hopes to get the highway bill through the chamber:

McConnell … set up votes on two controversial measures – a repeal of the Affordable Care Act, and a reauthorization of the Export-Import Bank of the United States – and did it in such a way that will make it difficult for other amendments to be considered.

That move incensed [Sen. Ted Cruz] – who had announced his intention to offer other amendments, and who, like many conservatives, strongly opposes the bank’s reauthorization, though it enjoys support from a supermajority of his Senate colleagues. While McConnell has personally spoken against Ex-Im reauthorization, Democrats said in June he had agreed to schedule an Ex-Im vote in order to get highly divisive trade legislation passed.

Though McConnell said there was no deal, Cruz is now convinced that McConnell lied, which has apparently enraged the Texas Republican. Politico added:

Ted Cruz took to the Senate floor Friday and charged that Mitch McConnell told a “lie,” escalating his campaign against GOP leaders and challenging the traditions of the usually decorous chamber.

In a scathing floor speech, the Texas firebrand accused the Senate majority leader of breaking his word to him and the rest of the GOP conference over McConnell’s plans for the controversial Export-Import Bank, the country’s chief export credit agency.

C-SPAN posted Cruz’s entire harangue to YouTube. For a senator who claims to abhor “Republican-on-Republican violence” when the topic is Donald Trump, Cruz has no similar qualms when publicly expressing his scorn for Mitch McConnell.

“From ‘Con man’ To Governor?”: The Republican Nominee For Governor In The Great State Of Kentucky

A year ago, Matt Bevin was seen as a rather ridiculous figure in Kentucky Republican politics. He’d launched a primary fight against incumbent Sen. Mitch McConnell (R-Ky.), which led the GOP establishment to go after Bevin with a vengeance.

The results weren’t pretty. Bevin was labeled by leaders of his own party as a “con man” who lies “pathologically.” The first-time candidate was exposed as a man who lied about his educational background, and whose business needed a taxpayer bailout. By Primary Day, Bevin lost by 25 points, and his career in politics appeared to be effectively over.

A year later, however, Kentucky Republicans will have to stop calling him a dishonest con man and start calling him their nominee for governor. The Lexington Herald-Leader reported this morning:

After Thursday’s recanvass of votes cast in the Republican primary for governor, Secretary of State Alison Lundergan Grimes said that there were “no substantial changes” and that she thought Matt Bevin would be the GOP nominee when the vote is certified June 8.

This morning, Bevin’s primary rival conceded the race. Bevin will now take on state Attorney General Jack Conway (D) in November, in the race to replace outgoing Gov. Steve Beshear (D).

McConnell, who characterized Bevin as a dangerous loon just last year, issued a statement this morning that said, “I congratulate Matt Bevin on his victory and endorse him for governor.”

It’s just such an improbable scenario. Even this year, the GOP gubernatorial primary was supposed to come down to state Agriculture Commissioner James Comer and former Louisville Metro Councilman Hal Heiner. But when the top candidates turned on each other, they ended up tearing each other down, clearing the way for Bevin.

I honestly can’t think of a comparable recent situation in which a state party viciously tore a guy down one year, only to scramble to build him back up less than a year later.

As for whether or not Bevin might actually become governor, we’ll find out soon enough – this has instantly become the most interesting race of 2015 – but as the process continues, I’m reminded of my favorite Matt Bevin story.

In early 2014, as regular readers may recall, Bevin accepted an invitation from the Gamefowl Defense Network and he delivered a speech to several hundred attendees. Asked later for an explanation, the GOP candidate claimed ignorance, saying he thought he was addressing a states’ rights group and had no idea he was speaking to pro-cockfighting activists.

The event’s hosts soon after explained that Bevin’s defense was literally unbelievable: the “entire rally” was devoted to the issue and “there was never any ambiguity” about the point of the gathering organized by the Gamefowl Defense Network.

Bevin told reporters he was “the first speaker” at the event and left before he realized what the Gamefowl Defense Network was up to. It turns out, that wasn’t true – the group’s director was the first speaker and he made it abundantly clear what the gathering was all about.

Bevin also told reporters he didn’t address the issue of cockfighting itself, which also turned out to be untrue – he specifically told attendees at the end, “I support the people of Kentucky exercising their right, because it is our right to decide what it is that we want to do, and not the federal government’s.”

Making matters slight worse, when msnbc originally asked Bevin about his appearance, he argued, “It wasn’t a cockfighting event, that’s where you all need to start telling the truth about what happened.”

Yes, telling the truth about it is important.

Bevin eventually apologized for the whole mess. Now he’s the Republican nominee for governor in the great state of Kentucky.

“An Insurgency By Any Other Name”: Republicans Only Believe In Democracy Insofar As It Achieves Their Desired Ends

In my very first post here at Political Animal, I described the possible threat from a Confederate insurgency. In his review of Charles Murray’s latest book, By the People: Rebuilding Liberty Without Permission, Ian Millhiser basically describes it as an insurgency by another name.

Before he gets to the book, Millhiser reminds us of a couple of things. First of all, he points to the fact that it was not that long ago that Majority Leader Mitch McConnell suggested that democracy wasn’t working.

At the height of 2011’s debt ceiling crisis, then-Senate Minority Leader Mitch McConnell (R-KY) offered a candid explanation of why his party was willing to threaten permanent harm to the U.S. economy unless Congress agreed to change our founding document. “The Constitution must be amended to keep the government in check,” McConnell alleged. “We’ve tried persuasion. We’ve tried negotiations. We’ve tried elections. Nothing has worked.”…

Few politicians are willing to admit what McConnell admitted when he confessed that elections have not “worked” to bring about the policy Republicans tried to impose on the nation in 2011. Elected officials, after all, only hold their jobs at the sufferance of the voters, and a politician who openly admits that they only believe in democracy insofar as it achieves their desired ends gives the middle finger to those voters and to the very process that allows those voters to have a say in how they are governed.

Secondly, he reminds us that, even though an entire industry has risen to debunk Murray, he is still revered by powerful Republicans.

Dr. Murray’s pre-Bell Curve work shaped the welfare reforms enacted in the 1990s. Former Republican vice presidential candidate Paul Ryan cited Murray in 2014 to claim that there is a culture of laziness “in our inner cities in particular.” Last April, when Jeb Bush was asked what he liked to read, he replied “I like Charles Murray books to be honest with you, which means I’m a total nerd I guess.”

So when Murray speaks, powerful and influential men (and his acolytes are, almost invariably, men) listen, including men who shape our nation’s fiscal policy and men who could be president someday.

Millhiser then does a thorough job of explaining what Murray proposes in this book. It’s important to note that it’s title “By the People” is the exact opposite of what he recommends. Basically what Murray wants to see is an ultra-rich benefactor who would be willing to pay for a legal defense fund that would subvert the work of the federal government.

To impose these limits on society, Murray claims that his Madison Fund can essentially harass the government into compliance. The federal government, Murray claims, cannot enforce the entirety of federal law “without voluntary public compliance.” Federal resources are limited, and only a small fraction of these limited resources have been directed towards enforcement. Thus, Murray argues, by simply refusing to comply with the law and contesting every enforcement action in court, regulated entities can effectively drain the government’s resources and prevent it from engaging in meaningful enforcement.

These are not merely the ravings of a lunatic right-winger. I was immediately reminded of the fact that Majority Leader Mitch McConnell has advised states to disregard the recent EPA rulings on coal plant emissions while various entities challenge them in court.

For a while now I have been suggesting that this form of Republicanism is best described as a beast in it’s final death throes. That beast is now a minority in this country and as it lashes out, one of the only remaining possibilities for survival is to subvert our democratic process.

I hope that by now you know that I am not one given to hyperbole and conspiracy theories. I don’t say all this to ramp up a fevered reaction. But it’s important to see what is happening here with clear eyes and name it for what it is…a call to insurgency.

“Minimum Wage Is A Self-Made GOP Problem”: Conservatives Believe Losing Now Means Losing Forever

Too bad George W. Bush is persona non grata among congressional Republicans. If he were less unpopular, they might find in the waning years of his presidency an example of what to do about a vexing issue facing them in 2016, an issue Senate Majority Leader Mitch McConnell called that “gosh darn” minimum wage.

In their bid to take over the Congress in 2006, the Democrats vowed to raise a federal minimum wage that had remained unchanged since the second term of the Clinton administration. After sweeping midterm victories in both chambers, congressional Democrats put the issue on their agenda, calling for an incremental increase from $5.15 an hour to $7.25 by 2009.

That wasn’t enough for Barack Obama, who vowed to raise the minimum wage to $9.50 by 2011 if elected president. His promise, however, came before the Great Recession cast a pall over many of his campaign promises. The minimum wage has remained $7.25 since he took office. (It is now higher in some cities and states; New York State recently raised it to $15 an hour in the New York City metropolitan area and $12.50 upstate.)

So the push to raise the minimum wage isn’t new. That’s a bit counterintuitive given the attention being paid to economic inequality, an issue that arose in the aftermath of the 2007 financial collapse. Even Republican contenders for the White House are obliged at least to pay lip service to the issue. And to be sure, a stagnant minimum wage is the bedrock of economic inequality. But the thread of the debate began during the second Bush administration, which was hostile or indifferent to the law, and allowed the purchasing power of the base wage to erode while the cost of living continued to climb or, indeed, soar. (To briefly illustrate, using 2013 dollars: if the minimum wage were $7.25 in New York City, the actual value would be about $4 an hour.)

What did President Bush do that could serve as a model for today’s congressional Republicans? First, two observations. One, Bush’s presidency was nearing historic levels of unpopularity by 2007. Two, voters tend to punish the party in power in hard times. The 2008 election was going to be rough for any GOP candidate.

But also keep in mind the nature of the business wing of the GOP. It is against wage mandates, because wages cut into profits. But the faction is also politically canny. It was willing to concede to demands for a higher minimum wage, if conceding weakened Democrats in 2008. Put another way: if Republicans had continued to resist raising the wage, then the wage issue may have become more potent for Barack Obama. So the business wing of the Republican Party — including 82 members of the House, all but three senators, and the president — held its nose and supported a wage hike.

The conservative wing of the GOP, on the other hand, is the opposite of canny. It does not see the wisdom of conceding on the minimum wage, even as the minimum wage has taken on more significance than it had a decade ago. Conservatives believe losing now means losing forever, and losing is inconceivable given the righteousness of their cause. Therefore, the more they resist raising the minimum wage, the more potent it will be for the Democratic Party’s nominee. As Harry Reid told The Hill yesterday: “If Republicans don’t do something about it, it’s a major issue.”

Reid was commenting on the most recent effort to exploit conservative intransigence. In the past, the Democrats called for $10.10 an hour. Yesterday, Senator Patty Murray introduced a bill raising the wage to $12 by 2020. The Raise the Wage Act, she said, would affect 38 million workers. Moreover, she was clearly relishing the moment. “I want to hear what the Republican presidential candidates have to say about this,” she said.

And they responded in predictable fashion.

Ted Cruz said the bill would be a “job-killing” disaster. Marco Rubio warned that workers would be replaced by robots. Scott Walker questioned the validity of wage mandates in general. Rand Paul said a base wage is good for young people but nobody else. And Jeb Bush, who most represents the interests of the business wing of the Republican Party, punted to the “private sector.”

You’ve got to wonder whom they think they are speaking for. According to a February poll by the Associated Press, 6 in 10 favor raising the minimum wage, including 40 percent of Republicans. In 2013, Gallup found more than 71 percent in favor, including half of Republicans. Last year, a Washington Post/ABC News survey found that 50 percent of respondents are more likely to vote for candidates who favor raising the minimum wage.

Clearly, the Republican presidential field isn’t speaking for the majority, or even for members of their party who see the good in increasing the wage. Jeb Bush is speaking for a business faction that fears higher wages eating into profits, while the rest is speaking for conservatives who believe compromise equals surrender.

The smart thing would be to give in now to prevent the minimum wage from haunting the Republican candidate later. But don’t hold your breath. On the occasion last summer when Mitch McConnell complained about the Democrats proposing to raise that “gosh darn” minimum wage (once again!), he added one more comment suggesting there’s no returning to the political pragmatism the George W. Bush administration exhibited in 2007.

“These people believe in all the wrong things,” he said.
