“Living Exact Same Day Over And Over Again”: On Groundhog Day, Republicans Vote To Repeal Obamacare

President Obama hasn’t spent a lot of time with House Speaker Paul Ryan (R-Wis.), but the two leaders, joined by Senate Majority Leader Mitch McConnell (R-Ky.), met at the White House this morning. The point, according to everyone involved, was to look for ways the policymakers can find some common ground and try to get things done in 2016.

To help set the tone, the Wisconsin congressman told reporters yesterday he was excited about the Iowa caucuses because “what it tells me is the days of Barack Obama’s presidency are numbered.”

He’s a real charmer, this one. You can just feel his enthusiasm for bipartisan policymaking in an era of divided government.

After the meeting in which the president tries to find areas of possible agreement with GOP leaders, Ryan will hold another vote on repealing the Affordable Care Act. The Washington Post reported:

The House is scheduled to vote Tuesday on overturning President Obama’s veto of legislation to repeal Obamacare and defund Planned Parenthood. The vote, appropriately scheduled for Groundhog Day, is expected to fail, leaving conservatives to gear up for a final year of budget fights with the president.

Asked about today’s events, White House Press Secretary Josh Earnest told reporters, “Republicans are poised to host another vote in the United States Congress today for the 60th time to repeal Obamacare. It’s almost like it’s Groundhog Day, except today it is actually Groundhog Day and they’re doing it again.”

Earnest added, “So I’m not really sure that qualifies as the contours of a proactive legislative agenda but it does put some pressure on Speaker Ryan and Leader McConnell, and other Republicans in Congress, to lay out what it is exactly they support and try to find some common ground with the administration.”

For the record, estimates vary on exactly how many times Republicans have tried to repeal all or part of the ACA, but the last time I checked, they were up to 62. In other words, Earnest might have been understating the case a bit.

Incidentally, shortly before the last repeal vote, Ryan was asked why he was moving forward with a bill to eliminate the Affordable Care Act before the Republican alternative is ready. The Republican leader told reporters with a smile, “Just wait.”

We later learned that this wait will continue past this year – because GOP lawmakers have already effectively given up on their plans to unveil a reform alternative in 2016.

As for today’s veto-override vote, there’s no chance of the bill succeeding. Paul Ryan and his team know that, of course, but they’re holding the vote anyway, just to go through the motions.

Postscript: In case anyone doesn’t get the reference, I should probably mention “Groundhog Day” was a classic movie from 1993 in which Bill Murray is stuck in a time loop, forced to live the exact same day over and over again. For those who haven’t seen the movie, I can assure you it’s far more entertaining than watching Republicans vote 63 times to take health care benefits away from millions of families for no particular reason.

“The Bane Of Many Politicians’ Existence”: Senate GOP Solution To Super PAC Rivals; More Money In Politics

This may sound odd, but it rings true amongst Republicans and Democrats alike: The only people who loathe Super PACs more than voters forced to sit through an onslaught of their bullshit ads, are politicians themselves.

Don’t get me wrong, at first many Republicans loved the new, post-Citizen United world of PACs (a.k.a. Political Action Committees who act any way they want). But those powerful outside groups have become the bane of many politicians’ existence—even GOP lawmakers who oppose overturning the Supreme Court ruling.

“We’re at a point where the outside groups have so much more flexibility than the parties do that there’s nothing wrong with giving both political parties a little more flexibility in how they work with candidates,” said Roy Blunt (R-MO), a member of the GOP leadership team in the Senate.

As Congress scrambles to avoid a year end government shutdown, Senate Majority Leader Mitch McConnell is quietly trying to include a provision to dismantle any limitations remaining on what the parties in Washington can spend coordinating with their candidates. Both parties bemoan that their candidates have lost control of their own campaigns.

Currently GOP and Democratic leaders can only spend about $50,000 to assist House candidates and around $3 million working with Senate campaigns. But for Super PACs the sky is the limit on what they can raise and spend, thus neutering the parties and politicians alike.

“You notice that the political parties are now being shunted aside, because he who pays the pipers calls the tune,” said Sen. Bill Nelson (D-Fla.) who doesn’t think McConnell’s latest attempt is all that significant. “It’s the outside money, particularly in the Republican sphere, that is funding elections. And it’s all this undisclosed, unlimited money uncontrolled by the campaign finance law. So until we can stop the outside money you can tinker here and tinker there, and it doesn’t make any difference.”

PACs have complicated everything for today’s political class. Yes, candidates are still the central component of any campaign, but all the campaign cash has eclipsed many candidates’ messages in recent elections. That’s because it’s easier for PACs to rake in millions than it is for candidates and their party to take in similar rolls of dollar bills. Candidates and parties also have to play by different rules.

“The candidates we have to disclose everything and I have to put my name on it,” Sen. Kelly Ayotte (R-NH) told The Daily Beast. She’s facing a bruising reelection battle and thinks the Citizens United ruling has unleashed a double standard.

“The parties also, they have to say ‘from the party’ and be able to do that, but you know there are a lot of outside groups, they have different names and it’s tough to know where they’re coming from.”

While candidates want to exert more control over their own campaigns, so do party leaders. In recent years Tea Party challengers have embarrassed themselves and the Republican Party in Senate races from Delaware to Nevada. That made the GOP establishment bristle, and seems to be behind McConnell’s latest move to strengthen the parties.

“McConnell is a party man,” said Kyle Kondik, a campaign analyst at the University of Virginia’s Center for Politics. “He probably believes that if the parties are stronger they can exert more control over who gets the nomination. You make the party stronger the individual candidates get weaker.”

That’s why the Tea Party wing of the GOP is opposed to McConnell’s latest move.

Rep. Jim Jordan (R-Ohio), the head of the House Freedom Caucus, said the changes on coordination should also be extended to Super PACs who currently are forbidden from coordinating with campaigns.

“What’s good for the goose should be good for the gander,” Jordan told The Daily Beast. “So if it’s good for the parties, it should be good for outside groups who are involved in politics and have a big influence on politics as well. I mean free speech is free speech. So either don’t do it at all, or if you’re going to do it, do it in an equal fashion.”

This isn’t the first time McConnell has stealthily tried to unwind election law. As the legislative clock wound down at the end of last year, he worked with then Speaker John Boehner to lift the cap on what party committees could solicit from donors. The provision hiked the rate from just under $100,000 to nearly $800,000. It was barely noticed, but critics argue the new provision will be felt.

“It will basically turn the parties into another apparatus that’s owned by the big money crowd,” said Rep. John Sarbanes (D-Md.), an advocate for public financing of campaigns. “In a sense it would allow big donors to become benefactors of specific candidates, using the parties to do it. They would kind of go through the parties to become the sugar daddy of this candidate or that candidate. So the parties lose all independence; they just become the tool of the big money crowd.”

Then there’s the whole presidential scramble going on. South Carolina Sen. Lindsey Graham has proven to be a lackluster fundraiser in his #YOLOrace for the White House, but that doesn’t mean he hasn’t been carefully watching his opponents and their Super PACs. He predicts something will give when the new Congress convenes at the start of 2017.

“I think there is going to be a scandal about money coming in the 2016 cycle from unsavory sources,” Graham to The Daily Beast. “That’s what it’s going to take to spur discussion. So I don’t really care about moving the caps as long as it’s transparent.”

“We’re Going Home For Christmas”: GOP-Led Senate Failing At Its Most Basic Tasks

In light of the recent focus on counter-terrorism and national security, common sense suggests the Senate would want to quickly confirm Adam Szubin to serve as the Treasury Department’s under secretary for terrorism and financial crimes.

As the Huffington Post recently reported, we’re talking about a job that “involves tracking terrorists to prevent them from raising money on the black market and elsewhere.” Szubin is extremely well qualified; he’s worked on blocking terrorist financing in previous administrations; and he enjoys broad, bipartisan support in the Senate.

And yet, the Senate isn’t voting on his nomination. Politico reported overnight that Sen. Sherrod Brown (D-Ohio) has grown impatient with mindless Republican obstructionism and tried to end this farce yesterday.

A frustrated Brown took to the Senate floor Wednesday to force a confirmation vote on Szubin and a host of other nominees stuck in his committee. The panel’s chairman, Sen. Richard Shelby of Alabama, swiftly objected to each of Brown’s attempts.

“That’s a policy decision,” Shelby said Wednesday of the nomination of Szubin, whom Shelby called “eminently qualified” during his confirmation hearing in September. “You know, he’s probably a nice guy in all this. But there is a lot of dissent in our caucus on that.”

Asked whether Szubin could move through his committee soon, Shelby responded: “We’re not going to vote now. We’re going home for Christmas.”

It’s not altogether clear what in the world Shelby was talking about. When he says Szubin is “probably a nice guy in all this,” it’s unclear what “this” refers to. When the senator added there’s “dissent in our caucus on that,” he didn’t say what “that” meant.

But even if we look past the ambiguity, the end result is the same: an uncontroversial, perfectly qualified counter-terrorism nominee is being delayed – without explanation – apparently because Republicans don’t like President Obama.

And while that may seem ridiculous – because it is – it’s important to understand that Szubin is hardly the only one.

The same Politico report explained, “Nineteen potential judges, a half-dozen ambassadors, a terrorism financing specialist and two high-ranking State Department nominees are awaiting confirmation votes on the Senate floor, a backlog that has this GOP-led Senate on track for the lowest number of confirmations in 30 years. The Senate Banking Committee hasn’t moved on a single nominee all year.”

The Banking Committee, by the way, is led by Alabama’s Richard Shelby – the one who’s praised Adam Szubin, but who also refuses to let the Senate confirm Adam Szubin.

The story on judicial nominees is every bit as exasperating. The Huffington Post reported this week on Luis Felipe Restrepo, who, for reasons no one can defend, has “endured nearly every type of Senate delay a judicial nominee could endure.”

The Senate should be voting Monday to confirm Restrepo to the U.S. Court of Appeals for the 3rd Circuit. Senators typically vote on nominees in the order in which they were nominated, and Restrepo is first in line of any district or circuit court nominee. Instead, Majority Leader Mitch McConnell (R-Ky.) passed him over and teed up a vote on the next person in line, Travis McDonough, a Tennessee district court nominee.

Restrepo has been waiting his turn for a vote since he was nominated in November 2014. His nomination didn’t go anywhere last year, so President Barack Obama renominated him in January. Restrepo waited five months before he even got a hearing in the Judiciary Committee, thanks to his own state’s senator, Pat Toomey (R-Pa.), holding him up.

After his June hearing, Judiciary Committee Chairman Chuck Grassley (R-Iowa) delayed the vote for another month, for no real reason. The committee finally voted to move Restrepo forward in July, unanimously, and he’s been waiting in line for a confirmation vote by the full Senate ever since.

The court seat Restrepo is supposed to fill has been vacant for nearly 900 days. No, that’s not a typo, and yes, it’s contributed to a “judicial emergency” on the 3rd Circuit, with a case backlog getting worse.

Bloomberg’s Jonathan Bernstein recently explained, “It’s a Senate engaged in pure partisan harassment of Obama, and indifferent to the smooth functioning of government.”

When Senate Majority Leader Mitch McConnell (R-Ky.) was promoted to his current post, he promised Americans we’d see a new, different kind of chamber. Nearly a year later, I suppose he was correct – because the Senate is now far worse.

“Mollifying The Insurgents”: Contrary To Their Laughable Spin, That’s Basically Their Job Descriptions Of McConnell And Ryan

Congress has until a week from today to pass a spending bill or face another government shutdown. That means that Sen. Mitch McConnell and Speaker Paul Ryan have their work cut out for them. The last thing they want is to have the American electorate watch them shut the government down as we head into a presidential election year. And yet the insurgent wing of their party has been pushing for the inclusion of several “riders” to the spending bill that Democrats oppose and President Obama has promised to veto. They include:

* Making changes to the refugee program that would basically eliminate Syrian and Iraqi refugees

* Defunding Planned Parenthood

* Repealing Obamacare

There has also been talk about riders that would roll back Dodd-Frank Wall Street reforms and EPA’s environmental regulations.

One of the things McConnell and Ryan have been doing to forestall a shutdown is to bring up bills that include these items and allow votes on them separate from the spending bill. So as we saw in the immediate aftermath of the Paris attack, the House voted on the changes to the refugee program. There has still been some effort to include it in the spending bill, but as I mentioned recently, that push is starting to fade.

Last night McConnell pulled off a two-fer with a vote on a separate bill that would both defund Planned Parenthood and repeal significant parts of Obamacare. Since it was brought up under a process called “reconciliation,” Democrats couldn’t filibuster and so it required 51 votes to pass – it got 52. No one doubts that President Obama will veto the measure. So the spin Republicans are putting on this is fascinating.

Republicans hailed it as a political messaging victory and a fulfillment of their promise from the 2014 midterm election to force President Obama to veto the landmark healthcare reform law named after him.

A “political messaging victory?” Does that sound like the kind of thing their angry base is looking for? Ha-ha!

And someone is going to have to find a reference for that 2014 midterm election promise about forcing President Obama to veto a repeal of Obamacare. I’ve looked and can’t find where they said that. There was plenty of talk about actually repealing Obamacare. But forcing a veto…not so much.

All this drama is really about trying to find a way to mollify the insurgents in their party and get them to back off of attempts to shut the government down. In explaining some of the shenanigans McConnell had to pull off to get last night’s vote, Kevin Drum summed it up pretty well.

Politico has a fascinating story today. It’s all about Mitch McConnell’s months of LBJ-worthy maneuvering to get legislation passed that would repeal Obamacare and defund Planned Parenthood, thus paving the way for a clean budget bill later this year. But here’s the kicker: he wasn’t engaged in Herculean negotiations with Democrats. He was engaged in Herculean negotiations with his own party…

In today’s Washington, passing bills isn’t a matter of getting Republicans and Democrats to agree. They can usually manage that. The trick is somehow neutering the wingnut faction of the Republican Party. Once that’s done, negotiations between the two parties are (relatively speaking) a piece of cake. Welcome to 2015.

Over the net week, we’ll get to see if McConnell and Ryan have managed to mollify the insurgents. Contrary to their laughable spin, that’s basically their job description these days.

“Another Train Wreck For McConnell”: Wow, Republicans Revolting Against The Elimination Of Medicaid Expansion. Imagine That!

You might remember that back in early 2010 Senate Democrats used a rule called budget reconciliation to by-pass a Republican filibuster and tweak their version of the Affordable Care Act to make it consistent with the one in the House. As a result, Republicans had a bit of a hissy fit, making the dubious claim that a simple majority vote in the Senate signaled the end of democracy as we know it.

In a move that should break all of our irony meters, Senate Republicans will soon attempt to use that same budget reconciliation rule in an attempt to dismantle the Affordable Care Act with a vote on a bill that has already passed the House. And we wonder why the practice of politics gets a bad name.

But hold onto your hats. This one is running into some trouble because, even with 54 Republicans in the Senate, McConnell is going to have trouble rounding up the 51 votes he needs.

The first problem comes from the Senate’s version of insurgents – Cruz, Rubio and Lee – who say that simply throwing a monkey wrench into Obamacare is not enough.

“On Friday the House of Representatives is set to vote on a reconciliation bill that repeals only parts of ObamaCare. This simply isn’t good enough. Each of us campaigned on a promise to fully repeal ObamaCare and a reconciliation bill is the best way to send such legislation to President Obama’s desk,” the three senators said.

The House version of the bill also contains provisions that defund Planned Parenthood – which is a problem for some Republican Senators representing more moderate states.

But if the Planned Parenthood provision is in the final bill — Senate Republican aides say no final decisions have been made — a handful of votes from the moderate wing could also break away. They include Murkowski, and Sens. Mark Kirk of Illinois and Susan Collins of Maine.

And now a third front of opposition has opened up.

“I am very concerned about the 160,000 people who had Medicaid expansion in my state. I have difficulty with that being included,” said Sen. Shelley Moore Capito, a Republican from West Virginia…

Sen. John Hoeven (R), who represents North Dakota, where an estimated 19,000 people gained access to Medicaid after Republican Gov. Jack Dalrymple decided to broaden the program, said he was unsure about repealing the expansion.

“I respect the decision of our legislator and our governor on Medicaid expansion,” said Sen. Steve Daines (R) of Montana, which has a Democratic governor. “I’m one who respects their rights and voices.”

Wow, Republicans revolting against the elimination of the Medicaid expansion. Imagine that!

When you risk losing Republicans from red states like West Virginia, North Dakota and Montana, just imagine what that means to incumbents running for re-election in places like Illinois, Ohio, New Hampshire and Pennsylvania.

Mitch McConnell proved himself to be a master at corralling Republicans into line to obstruct everything the Democratic majority tried to do for six years. But the job of getting them together to actually pass legislation has proven to be a much more difficult task. The fact that this particular effort will simply result in a presidential veto – even if successful – shouldn’t be lost on anyone. It is increasingly looking like another train wreck for McConnell.
