“Shutdown Politics Divides GOP”: No Real Precedent For A Party Being Responsible For Two Government Shutdowns Over 24 Months
Sen. Ted Cruz (R-Texas) is ready for an ugly showdown that may very well shut down the federal government at the end of the month, as are dozens of House Republicans. Meanwhile, GOP leaders in both chambers are pushing as hard as they can in the opposite direction.
But no one in Republican politics is more resistant to this strategy than vulnerable GOP incumbents worried about their re-election bids next year. Politico reported this week on one of these lawmakers:
In an interview, Sen. Kelly Ayotte (R-N.H.) said it’s “obvious” Cruz is only making this his latest cause to boost his visibility in a presidential campaign. And Ayotte, who withdrew her name from Lee’s 2013 letter on Obamacare, said she will “absolutely not” sign onto Cruz’s latest missive.
“There are not enough votes to even get (to) 60 in the Senate. But even if you could get by that (hurdle), the president is going to veto it and we certainly don’t have 67 votes,” Ayotte said. “So I guess I would ask: What’s the strategy for success?”
Sen. Ron Johnson (R-Wis.), another blue-state Republican incumbent facing a tough race next year, is also reportedly urging his colleagues to avoid a shutdown at all costs – for his sake, if not theirs.
All of which raises the question: are Ayotte and Johnson correct? Would another government shutdown hurt them and their party?
Reader B.G. emailed me last night to suggest the nervous senators’ concerns are misplaced. I’m reprinting the reader’s note with permission: “The GOP paid no political price in the 2014 election for shutting down the government in 2013. As much as I loathe Cruz, it is not irrational for him to think that shutting down the government will be a cost-free endeavor (from a GOP political perspective). I am sure he is betting, and not without evidence, that any government shutdown will be long forgotten by the time the 2016 election rolls around.”
After House Speaker John Boehner (R-Ohio) told Fox News this morning that “the American people will punish you if you are just playing politics or making a point that can’t be achieved,” reader B.G. added in a follow-up email, “Well, no, not based on recent history…. In fact, if I were Ted Cruz, I would be making the point publicly that the 2013 shutdown worked. ‘Look, we did it, and the American people rewarded us.’”
As a practical matter, Cruz and his allies are doing exactly that. For all the hand-wringing among Republican leaders, the Texas senator and his allies routinely make the argument on Capitol Hill that the hype is wrong and the risk of an electoral backlash from shutdowns is vastly overstated. These are, Cruz & Co. insist, consequence-free gambits.
To which I say, maybe.
First, it’s worth remembering that there are qualitative differences between midterm cycles and presidential election years. In the latter, more people, especially Democrats, actually bother to show up. There’s no denying the fact that Republicans had a great year in 2014, despite shutting down the government in 2013, but the national electorate will look far different – larger, more diverse, etc. – in 2016.
Second, for some of these vulnerable incumbents, the national landscape isn’t nearly as relevant as the prevailing political winds in their own home states. And in a state like Wisconsin, where Johnson is an underdog anyway, there’s simply no upside to having the public get angry with his party all over again.
Third, don’t discount the possibility of a cumulative effect. Republicans faced no discernible punishment for the last shutdown, but there’s no real precedent for a party being responsible for two shutdowns over the course of 24 months, and it’s no surprise that GOP leaders don’t see value in pushing their luck.
Finally, there’s the broader context of the 2016 cycle to consider: Republicans are going to ask the American mainstream to give the GOP power over the House, the Senate, and the White House, simultaneously, for the first time in a decade. Democrats will respond that an unhinged, radicalized Republican Party with a right-wing agenda hasn’t earned, and cannot be trusted with, that much power over the federal government.

“Screwing Up A One-Car Funeral”: House Republicans Three-Headed Monster Of A legislative Vehicle For Its Views On Iran
One of the few things we all thought we could count on when Congress returned from its August recess was a quick vote in the House on a resolution of disapproval for the Iran Nuclear Deal. After all, (1) it’s an issue on which all congressional Republicans seem to agree, (2) there’s a mandated timetable for dealing with the resolution that everybody agreed on months ago, and (3) it’s all kinda Kabuki Theater right now because Democrats have the votes to filibuster the resolution in the Senate.
But sometimes with these birds even the simplest things come unglued. Suddenly today a “revolt of House conservatives”–by no means the first or last–occurred, and now pending a meeting of House GOPers that’s currently underway, the Party of Responsible Government looks likely to produce some sort of three-headed monster of a legislative vehicle for its views on Iran, per Politico‘s Jake Sherman:
They are moving toward voting on a measure asserting Obama did not submit all elements of the agreement with Iran, a concept first raised by Reps. Mike Pompeo (R-Kan.) and Peter Roskam (R-Ill.), a former member of GOP leadership. Second, Republicans are working on a bill to try to prevent Obama from lifting sanctions against Iran. Third, the House would vote on a resolution to approve of the Iran pact. The original plan was to vote on a disapproval resolution.
This first gambit is based on the growing right-wing furor over “side agreements” between the Iranians and international nuclear monitors, plus alleged other “secret” deals, which conservatives claim cancels the procedural timetable for any votes and also makes the administration vulnerable to lawsuits. Boil it all down, and it’s an effort to add the Iran Nuclear Deal to the long list of things on which the Tyrant Obama supposedly broke the law and violated the Constitution.
In other words, House GOPers are talking to themselves, and to the almighty base.
The third gambit supposedly makes the treasonous nature of Democrats more obvious by requiring them to vote for the deal, not just against a resolution of disapproval.
Trouble with that one, and with the whole package, is that it’s not being coordinated with the Senate, where it’s totally not welcome (guess Ted Cruz is too busy in Kentucky trying to get into photos with Kim Davis to serve as the liaison between House and Senate wingnuts). So what should have been the easiest of maneuvers in a very crowded and complicated schedule has become a fiasco (Greg Sargent calls it “snatching defeat from the jaws of defeat.”), and congressional GOPers have become the people who could screw up a one-car funeral. Just amazing.

“Preparing To Engage In Political Hand-To-Hand Combat”: Chamber Of Commerce Will Go After Incumbent Republicans
One of the things a lot of people have been watching is what the business community – which has typically been pretty conservative – does in response to the Republican dissent into extremism. A lot of the shenanigans pushed by the tea partiers (i.e., debt ceiling crisis) are terribly destabilizing and that is not good for business. We also watched as the business community weighed in on cultural issues when they brought a halt to the Religious Freedom Restoration Act in Indiana recently.
According to Anna Palmer and Jake Sherman, the Chamber of Commerce has about had enough with the nonsense. It’s interesting to note what finally pushed them to that point. It wasn’t the total obstruction employed by Republicans from the beginning of Obama’s presidency – or even the constant hostage crises they created. It’s something that has come more recently.
The early discussions by top-level Chamber operatives like Rob Engstrom and Scott Reed reflect a broad consensus among companies with business before Congress that the political dynamic needs to change on Capitol Hill.
The theory is simple: The Chamber spent some $70 million in 2014, mostly to help Senate Republicans build their majority. But many of their legislative priorities — immigration reform, the renewal of the Export-Import Bank and a long-term highway bill — have been held up by a clutch of conservative lawmakers in the House.
Apparently these business people thought that by giving control of Congress to Republicans – gridlock would end and some things would actually get done. They put the blame for that not happening on the kind of Republicans who joined the ultra-conservative House Freedom Caucus and have made Speaker Boehner’s life miserable. And so the Chamber is in the midst of developing a political strategy to challenge them in their re-election.
The U.S. Chamber of Commerce is gearing up to challenge some House Republicans in primary elections, frustrated after much of its agenda has been stymied by a small pocket of conservative GOP lawmakers.
The influential and well-heeled business group is already eyeing several races, but the plans are still in their infancy and the targets have not yet been decided upon, according to more than a half dozen Republican sources on K Street and Capitol Hill.
The group’s apparent new willingness to engage in hand-to-hand political combat to take out sitting Republicans would represent a major shift for the business community, which has largely shied away from targeting sitting lawmakers.
This will be an interesting story to keep an eye on over the next few months. It speaks to the growing divide in the Republican Party in its march towards extremism. What various entities with traditional ties to the Party do in response will likely tell us whether the GOP can survive and morph into something new or goes the way of the Whigs.

“The GOP Is One Heck Of A Dysfunctional Family”: Republican’s Having A Lot Of Trouble Getting That Governing Thing Down
If you wonder why Congress is so feeble these days that it can’t even find a simple way to pass a transportation bill, look no further than Rep. Mark Meadows (R-N.C.), who proffered a little resolution on Tuesday night to oust John Boehner from the speakership.
The move was quickly dismissed by Boehner loyalists as showboating by a second-term member, and Meadows himself said he might not even seek a vote on his own measure. His hope is to provoke a “family conversation” among Republicans. It’s a heck of a dysfunctional family. The GOP these days may have its advantages on the Lannisters of “Game of Thrones” fame, but it’s a very long way from the Brady Bunch.
Perhaps by crushing Meadows’s insurrection, which many of even the most rebellious right-wing Republicans thought was ill-timed, Boehner will strengthen his hand. The more likely outcome is that this resolution to “vacate the chair” will once again remind Boehner of the nature of the party caucus over which he presides. I use “preside” rather than “lead” precisely because his difficulty in leading these folks is the heart of his problem.
The House GOP (and this applies more than it once did to Senate Republicans as well) includes a large and vocal minority always ready to go over a cliff and always ready to burn — fortunately, figuratively — heretical leaders and colleagues. More important, a significant group sympathizes with Boehner privately but is absolutely petrified that having his back when things get tough will conjure a challenge inside the party by conservative ultras whose supporters dominate its primary electorate in so many places.
This means that Republicans have to treat doing business with President Obama and the Democrats as something bordering on philosophical treason. Yes, on trade, where Obama’s position is relatively close to their own, they will help the president out. But it’s very hard to find many other issues of that sort. Politicians of nearly every kind used to agree that building roads, bridges, mass-transit projects and airports was good for everybody. Now, even pouring concrete and laying track can be disrupted by weird ideological struggles.
The text of Meadows’s anti-Boehner resolution is revealing. He complains that the speaker has “caused the power of Congress to atrophy, thereby making Congress subservient to the Executive and Judicial branches, diminishing the voice of the American people.” Actually, Congress has done a bang-up job of blocking Obama’s agenda since Republicans won control of the House in 2010. How, short of impeachment, is it supposed to do more to foil the man in the White House?
Meadows also hits Boehner for “intentionally” seeking voice votes (as opposed to roll calls) on “consequential and controversial legislation to be taken without notice and with few Members present.” He has a point. But since so many Republicans are often too timid to go on the record for the votes required to keep government moving — they don’t want to be punished by Meadows’s ideological friends — Boehner does what he has to do.
On the other hand, Meadows’s charge that Boehner is “bypassing the majority of the 435 Members of Congress and the people they represent” is absolutely true.
But the logic of this legitimate protest is that Boehner should allow many more votes on the floor in which a minority of Republicans could join with a majority of Democrats to pass legislation, thereby reflecting the actual will of the entire House. If Boehner had done this with immigration reform, it would now be a reality. Boehner didn’t do it precisely because he worried about what Republicans of Meadows’s stripe would do to him.
Meadows’s move bodes ill for the compromising that will be required this fall to avoid new crises on the debt ceiling and the budget. Republicans already faced difficulties on this front before the “vacate the chair” warning shot, as Post blogger Greg Sargent noted Wednesday.
And Rep. Walter B. Jones (R-N.C.), another Boehner critic, reacted to the resolution by invoking the Lord Voldemort all Republicans fear. Jones expressed the hope that “the talk-show hosts who are so frustrated would pick up on this thing and beat the drum.” It’s enough to ruin a speaker’s summer.
Republicans are talking a good deal about the threat to their brand posed by Donald Trump’s unplugged, unrestrained appeal to the party’s untamed side. The bigger danger comes from a Republican Congress that is having a lot of trouble getting that governing thing down.

“This One’s A Doozy!”: House Republicans Manage To Trip Over Confederate Flags
The recent debates over Confederate symbols have been limited almost entirely to states and local communities. Federal policymakers can show some leadership on the issue – and many have – but the decisions about Confederate flags, statues, road names, and license plates aren’t made in Washington, D.C.
This week, however, congressional Republicans found a way to trip over the issue anyway.
The developments started rather innocuously. Late Tuesday, after just a couple of minutes of debate, the U.S. House passed a measure sponsored by Rep. Jared Huffman (D-Calif.) that would “prohibit the display of Confederate flags on graves in federal cemeteries.” Earlier in the day, the House also instructed the National Park Service to no longer sell Confederate flag in gift stores.
The measures passed by way of voice votes, and the developments didn’t generate much attention. That is, until last night, when Rep. Ken Calvert (R-Calif.) announced a dramatic change: a Republican amendment was set to undo what the House had just done.
Facing pressure and brewing media interest, late this morning, House GOP leaders were forced to pull the underlying bill altogether. Politico reported:
House Republican leadership was forced to pull a spending bill from the floor Thursday after an uproar over the Confederate flag threatened to sink the entire measure.
This one’s a doozy, so let’s unpack what happened.
At issue is an Interior Department spending bill, which was already considered controversial because it includes funding for the EPA – and the right does not care for the EPA. But some Southern Republicans complicated matters, telling the leadership they were prepared to help kill the spending measure altogether over the anti-Confederate amendments.
Republican Rep. Steven Palazzo of Mississippi, for example, said in a statement, “Congress cannot simply rewrite history and strip the Confederate flag from existence. Members of Congress from New York and California cannot wipe away 150 years of Southern history with sleight-of-hand tactics.”
House Democrats, not surprisingly, responded with apoplexy over the GOP majority reversing course, defending Confederate flags, and attempting to scrap two amendments that passed without controversy just two days ago.
Faced with growing turmoil, House Speaker John Boehner (R-Ohio) pulled the spending bill from the floor. Boehner told NBC News’ Luke Russert that the spending bill “is going to sit in abeyance until we come to some resolution.”
The Republican leader added that he does not want to see the issue become a “political football.” If today’s floor fight is any indication, it would appear Boehner’s too late.
South Carolina lawmakers managed to get this right, but the same cannot be said about Congress.
Postscript: It’s worth noting that while Rep. Ken Calvert (R-Calif.) was the member who announced the proposed reversal, he was not the one pushing for the change. Calvert said he introduced the amendment at the behest of the House Republican leadership, which was acting under pressure from Southern lawmakers.
