“Boehner’s Latest Humiliation”: Surrender; Government-By-Crisis Fails The GOP Again
Ever since Republicans first devised their ill-conceived plan to use funding for the Department of Homeland Security as a hostage in hopes of forcing President Obama to abandon his immigration policy, the gambit was doomed to eventual failure.
On Tuesday, the debacle reached its logical conclusion. Hours after Speaker John Boehner (R-OH) acknowledged defeat, the House of Representatives ended the game and passed a bill funding DHS through September, without preconditions. The bill passed the house 257 to 167, with just 75 Republicans joining the Democratic minority to keep the department open.
There was never any real doubt that this would be the outcome. Since the equally poorly-thought-out government shutdown of 2013, President Obama has made it clear that he will not give in to Republican attempts to use must-pass spending bills to blackmail him into dismantling his agenda. The Department of Homeland Security was always a poor target for a hostage, given its importance to national security — and the fact that shutting it down would do nothing to stop President Obama’s executive actions on immigration. And voters were always going to blame Republicans, not Democrats, for a crisis that the GOP created.
Still, House Republicans insisted on dragging the crisis out until the last second, and managed to undermine Speaker Boehner’s tenuous authority in the process. Yet again.
So will this latest humiliation convince Boehner and his caucus to rethink their strategy of government-by-crisis? It’s unlikely; if the “fiscal cliff,” the government shutdown, and repeated debt ceiling standoffs (among other House-made emergencies) didn’t change their course, there’s no reason to believe that the DHS near-shutdown will be different.
In related news, on Tuesday the Congressional Budget Office announced that the debt ceiling will have to be increased in October or November.

“Hey, Boehner; Show Some Stones For Once”: The Right Wing Is Toothless And Congress Is Essentially Leaderless
So here’s something I’ve often wondered over the last few years. What exactly would happen if John Boehner bucked the right-wingers in the House? You know—if he gave us one of those heroic Hollywood moments that we so long for in this sail-trimming city and gave a big speech about how he was putting principle ahead of politics and the consequences be damned.
You know what I think would happen? If, say, he followed Mitch McConnell’s lead and allowed a vote on a clean DHS-funding bill? After all the dust settled—nothing. Oh, the dust would fly to the heavens for a few days. Tea Partiers would scream about his betrayal. Rush Limbaugh and all the rest of them would fulminate. There’d be a few breathless stories about how his speakership was in mortal peril. And then, something else would happen in the news cycle, the intoxicating effect of the drug of munity would wear off, and we’d be back to exactly where we were before the dust went skyward.
We have a dysfunctional legislative system, and one of the hallmarks of a dysfunctional system—indeed the main hallmark of a dysfunctional system—is that no one is held accountable for anything they do. And there’s no reason to think Boehner would be held accountable by his right wing.
First of all, they don’t have the votes to oust him. In his last speakership election, 25 Republicans voted against him. That’s a chunk, but it’s a small chunk. And besides, who are they going to replace him with? Majority Leader Kevin McCarthy, who seems not able to count noses and who isn’t particularly well liked by his GOP colleagues? Majority Whip Steve Scalise, now branded as a white-supremacist sympathizer? One doesn’t expect much of today’s GOP, but I doubt very much that even this hardened assemblage would want to be led by a man with that charge hanging around his neck.
So the whole business is ridiculous. And in fact, if you look closely at the record, you see that Boehner has bucked his right wing. Although “bucked” isn’t really the right word, since to buck means to resist with some show of strength. Boehner never does that. What he does is that he hews to the right-wing line rhetorically for as long as he possibly can, and then, when it’s two minutes til midnight and it’s obvious to everyone that he has to bend, he bends. He did it on the debt ceiling. He does it on budget questions. And there’s always a great deal of sturm and drang, but soon enough, it’s back to business.
Think here about the famous Hastert Rule, that a Republican leader can’t bring anything to the floor that doesn’t have the support of a majority of the Republican majority. This has come up a number of times in the last four years, and always the line is: Oh my God, he can’t break the Hastert Rule! Dare he break the Hastert Rule? His speakership is in grave jeopardy if he breaks the Hastert Rule! No, Lord, not the Hastert Rule!!
Well, he’s broken the Hastert Rule three times. The first time was on the fiscal cliff negotiation at the beginning of 2013. On that one, 85 House Republicans voted for the compromise bill that emerged, and 151 of them voted against it. The second time was on Hurricane Sandy relief, which happened just a couple of weeks after the fiscal cliff vote. That time, 49 GOPers voted for the relief, and 179 against. And the third came a little more than a month later—two years ago tomorrow, in fact—when the House passed a reauthorization of the Violence Against Women Act. That time, 87 Republicans voted aye, and 138 nay.
So look at that record. In two months’ time, Boehner violated the allegedly inviolate Hastert Rule three times. And what happened to him? Well, we’re still calling him Mr. Speaker, last I checked. The right wing has not mutinied. And in fact the dark little psychological secret is that the vast majority of them have no interest whatsoever in mutiny. It’s far better for business for them, back in the home districts, to be able to scream betrayal and present themselves to their rabid constituents, the kind who just might go organize themselves to find a primary challenger to run against them, as the true defenders of liberty against all the sell-outs and ideological harlots they have to contend with on a daily basis, Boehner included. Gower Champion couldn’t choreograph it any better.
If I’m right about all this, and I am, then the question is why Boehner can’t, just once, show some stones and say, at 10 or 15 minutes til midnight rather than the usual two, “Sorry, we’re gonna do the reasonable thing here, and save this other fight for another day?” Well, some have argued that it may be in this case that he doesn’t actually know whether he has the votes. But I think that’s a reach. He’s got 245 Republicans. There are 188 Democrats, presumably all of whom would vote for a clean bill. So he’d need about 30 Republicans to back a clean bill. If he can’t get a mere 15 percent of his caucus to vote for a clean bill, maybe he’s got no business being speaker anyway. That would mean breaking the Hastert Rule, but as we’ve seen, he’s paid no price for that in the past.
And look at what happened in the Senate after McConnell decided to be reasonable. The vote was 98-2! The holdouts were Jim Inhofe and Jeff Sessions. Ted Cruz voted for the clean bill! Mike Lee! Joni Ernst and all the new red-hots. McConnell called the radicals’ bluff, and they folded. I say there’s every reason to think that roughly the same thing would happen in the House.
It’s often said in Washington that Congress is held captive to the hard right. But that’s not it. Boehner could break that hold if he wanted to. So it’s not really the radicals who are to blame, but Boehner’s refusal to be their leader and tell them “this is the way it is.” That’s the one thing, as their leader, he’ll never do. You know—lead.

“The Rolling Disaster Of John Boehner’s Speakership”: He’s Sure To Be Known As One Of The Weakest Speakers In American History
For years now, John Boehner’s continued occupation of the House speakership has been in doubt. Would the tea partyers evict him in a coup? Would he simply not want this thankless task anymore? The presumption, which I’ve always shared, is that Boehner is in a nearly impossible position. Pressed by a large right flank that sees any compromise as a betrayal, he is constrained from making the deals necessary to pass legislation. While Mitch McConnell can successfully corral his caucus to vote as a unified bloc, the one over which Boehner presides contains so many extremists and cranks that it’s just impossible to hold together.
All of that is true. But might it also be true that Boehner is just terrible at his job?
Look at the two stories about Boehner making the rounds today, both of which were addressed in an appearance he made on “Fox News Sunday” yesterday. The first is the possibility of a shutdown of the Department of Homeland Security if Congress can’t pass a bill to fund the department. At a moment when the news is being dominated by terrorism, both in the Middle East and in Europe, a shutdown would be a PR disaster for the GOP (even if, in reality, the key functions of the department would continue with little interruption). The House passed a bill to fund the department, including a provision revoking President Obama’s executive actions on immigration. Everyone knows that such a bill is going nowhere — it failed to overcome a Democratic filibuster in the Senate, and even if it had, Obama has made clear that he’ll veto it.
Asked repeatedly by host Chris Wallace whether the House would revisit the Homeland Security spending bill, Boehner kept repeating that “The House has done its job.” And he couldn’t have been clearer on the possibility of a shutdown:
WALLACE: And what if the Department of Homeland Security funding runs out?
BOEHNER: Well, then, Senate Democrats should be to blame. Very simply.
WALLACE: And you’re prepared to let that happen?
BOEHNER: Certainly. The House has acted. We’ve done our job.
Boehner can say “Senate Democrats should be to blame,” but that won’t make it so. Everyone knows how this is going to end: Both houses are going to pass a “clean” spending bill, which Obama will sign. The only question is whether there’s a department shutdown along the way. If and when that happens, Republicans are going to be blamed, just as they were when they forced a total government shutdown in 2013. His calculation now seems to be the same as it was then: I’ll force a shutdown to show the tea partyers that I’m being tough and standing up to Obama, and then once it becomes clear that we’re getting the blame, that’ll give me the room to end the crisis by giving in and allowing the vote that will bring everything to a close. It’s not exactly a strategy to maximize his party’s political gain.
That brings us to the second ongoing PR catastrophe Boehner has engineered, the upcoming speech to Congress by Israeli Prime Minister Benjamin Netanyahu. Both here and in Israel, where Netanyahu faces an election next month, the speech has been roundly condemned for politicizing the relationship between the two countries, essentially turning the Israeli prime minister into a partisan Republican coming to the U.S. to campaign against President Obama’s approach to negotiating with Iran about their nuclear program. Worst of all, Boehner invited Netanyahu to make the speech without informing the White House, a bit of foreign policy usurpation that people in both parties find somewhere between inappropriate and outrageous. Here’s how Boehner talked about it yesterday:
BOEHNER: And then when it comes to the threat of Iran having a nuclear weapon — these are important messages that the Congress needs to hear and the American people need to hear. And I believe that Prime Minister Netanyahu is the perfect person to deliver the message of how serious this threat is.
WALLACE: But when you talk with [Israeli ambassador] Ron Dermer about inviting Netanyahu, you told him specifically not to tell the White House.
Why would you do that, sir?
BOEHNER: Because I wanted to make sure that there was no interference. There’s no secret here in Washington about the animosity that this White House has for Prime Minister Netanyahu. And I frankly didn’t want them getting in the way and quashing what I thought was a real opportunity.
WALLACE: But it has created a — if not a firestorm, certainly a controversy here. It has a created a controversy in Israel. And shouldn’t the relationship between the U.S. and Israel be outside of politics?
BOEHNER: It’s an important message that the American people need to hear. I’m glad that he’s coming and I’m looking forward to what he has to say.
It may be that by now Boehner thinks that having come this far, he can’t rescind the invitation without making the whole thing look even worse. That’s possible, but by making the invitation in the first place, and keeping it secret from the administration, he created a truly epic blunder, one that not only makes him look bad but also damages American foreign policy interests.
So on the whole, Boehner is managing to combine legislative incompetence with PR incompetence. He’s already sure to be known as one of the weakest speakers in American history, for at least some reasons that are out of his control. But he might also be known as one of the least effective. Perhaps no one could have done a better job in his place, but since no other Republican seems to want the job, we may never know.

“Forget About Repealing Obamacare”: Too Many “Message” Votes Have Put The GOP In A Bind
If at first you don’t succeed, try, try again? That certainly seems to be the motto of House Republicans. Last week, the House GOP took its 56th vote to repeal the Affordable Care Act, President Barack Obama’s signature health care reform law.
The bill’s prospects for consideration in the Senate are low and the president has repeatedly promised to veto such a measure anyway. After 56 tries, the House votes to repeal the health care law have become so commonplace that hardly anyone in Washington even blinks an eye at them anymore. Even the president says he’s lost count of how many repeal votes there have been. If House Republicans are serious in their quest to roll back the Affordable Care Act, why do they keep pursuing a strategy they know is doomed to fail?
They do it because these multiple repeal votes aren’t a serious attempt to void the health care law. They are merely symbolic message votes. Voting to repeal the Affordable Care Act was a popular campaign message for candidates on the right, and the recent House vote gave them a chance to fulfill their election year promises.
The repeal votes also give the Republican party a platform to continue talking about their opposition to the health law and to highlight its differences with the president. However, too many “message” votes may have also put the party in a bind. After 56 votes on essentially the same piece of legislation, the Republican party has faced criticism, according to The Hill, for failing to articulate an alternative plan. The repeated symbolic votes also expose the party to criticism for failing to lead in a critical policy area. The time spent in fruitless endeavors to repeal the law could have instead been used to negotiate on policies to fix the Affordable Care Act’s weaknesses. When it comes to health care policy, Republicans have simply become the party of no.
It’s time to switch tactics. Following the House votes last week, Sen. Orrin Hatch, R-Utah, Sen. Richard Burr, R-N.C., and Rep. Fred Upton, R-Mich., released a proposal for an alternative health care plan. The proposal is a good first step and perhaps necessary as, for the first time, three House Republicans voted against repeal of the Affordable Care Act in protest of their party’s apparent lack of a plan to replace it.
In addition to putting an actual health care plan on the table, Republicans may also want to consider trying to make changes to the current health care law in pieces. There could be opportunity for negotiation on aspects of the law that remain unpopular, such as the medical device tax, the Medicare Independent Payment Advisory Board and the definition of a full-time work week. Further, the Supreme Court ruling on the King v. Burwell case later this year regarding the legality of the subsidies being provided for the purchase of health insurance on the federal exchanges could provide Republicans with another opportunity to change the law. If the Supreme Court rules against the subsidies, a legislative fix may be necessary. By taking advantage of these opportunities, the party might be able to make the law more palatable for its constituency and improve its credibility in the process.
House Republicans have made their disdain for the Affordable Care Act very clear. A 57th vote to repeal the law will not be necessary, especially since it, too, would be doomed to fail as long as Obama is in office. However, it’s entirely possible we’ll see one. By focusing strictly on repeal of the entire law, Republicans risk giving the impression that they are completely unwilling to engage in meaningful debate on health care policy. The party should instead work to improve the law and continue putting forward ideas to do so.
A great example of this can be found at the state level. Following the Supreme Court’s decision that the Affordable Care Act’s Medicaid expansion was optional, several Republican governors have proposed alternative Medicaid plans to the administration. Some have already been successful in putting their imprint on the president’s initial policy because they came to the table in a serious manner. Republicans at the federal level would do well to follow suit.

“Deluded And Dysfunctional, The Republicans Have Lost The Plot”: They’ve Run Out Of People To Blame For Not Compromising
Recently, in an effort to embarrass Republicans pandering to their scientifically challenged base, Senate Democrats proposed a series of votes on climate change. While most Americans and the overwhelming majority of scientists believe climate change is real and people are the primary cause of it, Republican voters are evenly divided on whether it exists at all, and reject the idea that we are responsible.
One amendment, by the Democratic senator Brian Schatz, stated simply that climate change is real and human activity significantly contributes to it. Republican senator John Hoeven offered a compromise: take the word “significantly” out. When asked why, he said: “It was about finding that balance that would bring bipartisan support to the bill.”
Reaching across the aisle in search of compromise and consensus is the professed goal of almost every candidate for public office in the US, particularly in recent times, when presidents have come to personify not unity but division. Over the past six decades, the 10 most polarising years in terms of presidential approval have been under either George W Bush or Barack Obama.
As a means, bipartisanship is, of course, an admirable goal: the more politicians are able to work together, put the interests of their constituents first and get things done, the better. The grandstanding, bickering and procedural one-upmanship that characterises so much of what passes for politics is one of the things that makes electorates cynical and drives down voter turnout.
But as an end in itself, bipartisanship is at best shallow and at worst corrosive. For it entirely depends what parties are joining together to do. This is particularly true in America, where constituencies are openly gerrymandered, both parties are funded by big money, and legislation is often written by corporate lobbyists.
Bipartisan efforts over the past couple of decades have produced the Iraq war, the deregulation of the financial industry, the bank bailout made necessary by that deregulation, the slashing of welfare to the poor, and an exponential increase in incarceration. As the hapless Steve Martin says to his hopeless travel companion, John Candy, in Planes, Trains and Automobiles: “You know, I was thinking, when we put our heads together … we’ve really gotten nowhere.”
Comity in the polity is overrated and should certainly not be mistaken for what is right or even popular. And even if it wasn’t overrated, bipartisanship is not always possible. Half of Republicans still believe the US did find weapons of mass destruction in Iraq, over half believe climate change is a hoax, and almost half do not believe in evolution. There is a limit to how much agreement you can reach with people with whom you disagree on fundamental matters of fact, let alone principle.
But if the parties cannot work together, they are at least supposed to work separately. What has become evident since Republican victories in November’s midterm elections, which delivered them both houses of Congress, is that they don’t just have a problem compromising with Democrats – they cannot even compromise with each other. For the past four years they have revelled in their dysfunctionality, using Obama as a foil. Apparently unaware that brinkmanship is supposed to take you to the edge, not over it, they have shut down the government and almost forced the nation to default on its debts through a series a spectacular temper tantrums.
As the Republican congressman Marlin Stutzman pointed out in a particularly candid moment 18 months ago, when Republican obduracy caused a government shutdown, “We have to get something out of this. And I don’t know what that even is.”
These hissy fits have invariably been aimed at forcing Obama to undo the very things he pledged to do if elected, and to which Republicans have no plausible, coherent response: during his first term that was Obamacare; now it is immigration reform. Opposition, in short, had become not a temporary electoral state but a permanent ideological mindset in which their role was not to produce workable ideas but to resist them.
When they won the Senate as well as the House, they were supposed to work together to produce Republican legislation that Obama would be forced to veto, definitively exposing the real source of the gridlock. In fact, they are simply imploding under the weight of their own obstinacy. They’ve run out of people to blame for not compromising with them. So now they’re blaming each other.
“The Republicans are like Fido when he finally catches the car,” the Democratic senator Charles Schumer told the New York Times. “Now they don’t have any clue about what to do. They are realising that being in the majority is both less fun and more difficult than they thought.”
Their current internal feud was prompted by Obama’s executive order for modest immigration reform, which was enacted last November. It aims to prevent the deportation of up to 5 million undocumented immigrants living in the US, provide many with work permits, and shift the focus of immigration control to deportations of convicted criminals and recent arrivals.
The Republican-controlled House, where funding bills must originate and legislation can be passed by a simple majority, has voted for a Department of Homeland Security (DHS) bill that would eviscerate Obama’s reforms. But to get the bill through the 100-seat Senate they need 60 votes. Senate Republicans have only 54 seats and Democrats, who are unanimously opposed to the bill, keep filibustering it.
In a functional party the Republican Speaker, John Boehner, would work out what changes he could make to the bill to give the Republican Senate majority leader, Mitch McConnell, a fighting chance of getting the requisite majority to pass legislation they could both take credit for. Instead, Boehner has offered McConnell not compromise but commiserations. “He’s got a tough job over there; I’ve got a tough job over here. God bless him, and good luck.”
The House has sent the same bill to the Senate twice. The Senate has failed to pass it several times. In effect, they’ve treated the Republican-controlled Senate no differently to how they treated its Democratic predecessor, with similar results. Reflexively, House Republicans have their bottom lip extended and at the ready. “We sent them a bill,” representative Michael Burgess told Politico, “and they need to pass it. They need to pass our bill.” A tantrum is not far off. “Politically, [McConnell] needs to make a lot of noise,” says representative John Carter.
Senate Republicans, meanwhile, roll their eyes, count to 10 and wait patiently for the noise to give way to reason. “We can go through the motions, sure, but I don’t think we’re fooling anybody,” said Republican senator Jeff Flake about the prospect of another doomed vote. “Because we need [Democratic] support to get on the bill.”
If they don’t find a solution by 27 February, then the DHS will be shut down and Obama won’t have had a thing to do with it. The true source of the gridlock over the past six years will be clearer than ever. The emperor will be out there, twerking, in the buff.
“It’s not an issue of commitment, it’s a matter of math,” said the Republican senator John McCain – perhaps failing to realise that math, like science, is no competition for blind faith and bad politics.
