“GOP Hates Obama More Than A Nuclear Iran”: Republicans Will Reap What They Have Sown

That letter to Iranian leaders from 47 Republican senators could well destroy critical bipartisanship in U.S. foreign policy for years to come and treacherously undermine the bargaining power of the person constitutionally authorized to conduct American affairs abroad—the President of the United States. On top of what House Speaker John Boehner did by unilaterally inviting Israeli Prime Minister Benjamin Netanyahu to address Congress, this letter seriously points to one terrible conclusion: a formidable number of Congressional Republicans hate President Obama more than they love America.

These acts go entirely beyond legitimate criticism of presidential actions abroad. They are not like a few legislators wandering in foreign lands and expressing their disagreement with their government. They surely exceed the usual congressional resolutions of disagreement with presidential policy.

What the 47 did was not a trivial matter or “a tempest in a teapot,” as Senator John McCain has described it. It could well affect possible Iranian concessions in the end game. The ayatollahs could well conclude from that letter that concessions they might have made just aren’t worth it politically, as the agreement would go nowhere anyway. They’d be taking political risks for nothing.

Beyond these negotiations, the effects on our national security may well be profound and lasting. Just look at the future implications of what these Republican senators said in their letter. They maintained, in effect, that this thing a President of the United States has been negotiating will either be thrown out by Congress or discarded by the next president, so don’t waste your time. Did the 47 even consider how future Congresses would apply such words to future presidents?

For one moment, did these senators think about how their actions could affect the ability of President Barack Obama to protect the safety of America? Did they consider how their insistence that he doesn’t matter affects his power to protect American interests and lives in the Middle East or NATO countries? These noble legislators were saying Mr. Obama doesn’t speak for Congress or the American people, and bad guys of the world, you can defy him and thus the United States however you wish.

And don’t think for a second that Democrats will forget these acts of near treachery to a sitting president of their party when a Republican president takes the helm. Don’t expect the Democrats to be saints and models of self-restraint given the behavior of Speaker Boehner and these 47 Republicans. At some critical time, in some critical place, Democrats will exact revenge on a Republican in the White House and, alas, on US national interests. At some point, the Republicans will reap what they have sown.

Seven sitting Republican senators fully realized the consequences of what their colleagues were doing and refused to sign the letter. Those with such good sense merit mentioning: Bob Corker, Lisa Murkowski, Jeff Flake, Lamar Alexander, Susan Collins, Dan Coats, and Thad Cochran. At least some senatorial Republicans put their country above partisanship, blind ideology, and hatred of the duly elected President of the United States.

Many Republican worthies who have conducted U.S. national security policy in the past and who may do so in the future know well that the agreement being negotiated with Iran by Mr. Obama is not another Munich or a sellout, as Israel’s prime ministerial hit man intoned to Congress. Putting all the baloney aside (and boy there are mountains of it this time), in the simplest terms this agreement extends the time for an Iranian nuclear breakout to a bomb and enhances our knowledge of what’s going on with nuclear programs inside Iran through greater inspections.

It’s surely not heaven, and the Iranians surely can’t be trusted, but it’s surely better than the idiotic alternatives. These would be forgoing the agreement and letting Iran simply get to a bomb quickly, as the severest critics fear they will, or going to war with Iran to delay that day.

Those who argue that Iran will be brought to its knees by enhanced economic sanctions ignore history. Look at North Korea, Pakistan, Cuba and so forth. Look at the fact that a large majority of Iranians feel they should have peaceful nuclear energy capability. Look at the fact that all the countries partnering with the U.S. in negotiating with Iran (Britain, France, China, Russia, and Germany) back the current negotiating track, which includes a gradual lifting of economic sanctions. And stare at the reality that if we stiff our own sensible negotiating track with Tehran, then our negotiating partners will lift their own sanctions from Iran without an American “OK.”

The White House was right on the mark in saying that the only ones who rejoiced at the Republicans’ unintelligible rant were the hardliners in Tehran. They don’t want the agreement either. Have these 47 Republican senators ever wondered if they might be green-lighting those in Tehran who yearn for Iran to be a nuclear power?

The House Republicans who invited a foreign leader to Congress to attack the President of the United States and the 47 Republican senators who undermined U.S. national security with their letter can’t be expected to repent. Anyone who would do these things may well be beyond redemption. But Republican leaders who have effectively and nobly carried out US foreign policy in the past and may do so in the future must step up now to protect America’s future.

“Sedition In The Name Of Patriotism”: Cynical Opportunists In League With Sectarian Fanatics

On many occasions during the last few years, as I heard talk of secession and nullification, and of defiance of the courts, and of duly enacted statutes representing slavery and tyranny, and of Higher Laws and a Right to Revolution, and most recently, of allegiance to a foreign government–all more or less countenanced by one of our two major political parties–I’ve thought of a historical parallel, as described in one of my favorite books, George Dangerfield’s The Strange Death of Liberal England.

The period in question was just prior to World War I when a Liberal majority government committed by mandate and party alliance to Home Rule for Ireland was obstructed by a Tory minority in alliance with Ulster Unionists which explicitly and implicitly threatened civil war. Here’s how Dangerfield describes a crucial lurch into sedition, when Tory leader Bonar Law traveled to Belfast to pledge allegiance to Ulster and its political leader, Sir Edward Carson, at a huge rally:

At this historical gathering the sedition being preached by Mr. Bonar Law, who led off with a scholarly appeal to Ulster’s worst fighting instincts, was nearly surpassed by Mr. Walter Long. “If they put Lord Londonderry and Sir Edward Carson in the dock,” roared Mr. Long, “they will have to find one large enough for the whole Unionist Party.” Whereat Mr. Bonar Law and Sir Edward Carson turned toward each other, clasped hands, and maintained this affecting attitude long enough for the whole assembly to realize that they were doing their level best to look like generals on the eve of battle. And then, while everyone stood with bared heads, Sir Edward released Mr. Law, and strode to the front of the speakers’ stand. “Raise you hands,” he shouted. “Repeat after me–never under any circumstances will we submit to Home Rule.” In the centre of the show grounds there was a signalling tower, with a flagstaff ninety feet tall, and while the audience, and the Marquess of Londonderry, and the Protestant Primate, and the Presbyterian Moderator, with obedient thunder intoned those words after Sir Edward, a Union Jack was broken from the flagstaff. It measured forty-eight feet by twenty-five. It was the largest ever woven. Patriotism could do no more.

Sedition in the name of patriotism should sound familiar today. Just over a century ago in England, the seditionists–aptly described by Dangerfield as cynical opportunists in league with sectarian fanatics–won. The country recovered, but was never quite the same. Are we headed in that same direction?

You have to wonder, as does Paul Waldman today at the Plum Line:

The American political system runs according to a whole series of norms, many of which we don’t notice until they’re violated. For instance, the Speaker of the House can invite a foreign leader to address Congress for the sole purpose of criticizing the administration, and he can even do it without letting the White House know in advance. There’s no law against it. But doing so violates a norm not only of simple respect and courtesy, but one that says that the exercise of foreign policy belongs to the administration. Congress can advise, criticize, and legislate to shape it, but if they simply take it upon themselves to make their own foreign policy, they’ve gone too far.

But as has happened so many times before, Republicans seem to have concluded that there is one set of rules and norms that apply in ordinary times, and an entirely different set that applies when Barack Obama is the president. You no longer need to show the president even a modicum of respect. You can tell states to ignore the law. You can sabotage delicate negotiations with a hostile foreign power by communicating directly with that power.

I wonder what they’d say if you asked them whether it would be acceptable for Democrats to treat the next Republican president that way. My guess is that the question wouldn’t even make sense to them. After all, that person would be a Republican. So how could anyone even think of such a thing?

“GOP Lawmakers Are Violating The Logan Act”: Playing With Fire; Senate GOP Tries To Sabotage Nuclear Talks

In a practical sense, when congressional Republicans invited Israeli Prime Minister Benjamin Netanyahu to deliver a joint-session address, it was part of a larger sabotage campaign. GOP lawmakers, without so much as a hint of embarrassment, are openly trying to derail international diplomatic talks with Iran, and Republicans had no qualms about partnering with a foreign government to undermine American foreign policy.

The GOP gambit arguably marked a new low. But after hitting the bottom of the barrel, Republicans dug a hole and fell just a little further.

A group of 47 Republican senators has written an open letter to Iran’s leaders warning them that any nuclear deal they sign with President Barack Obama’s administration won’t last after Obama leaves office. […]

“It has come to our attention while observing your nuclear negotiations with our government that you may not fully understand our constitutional system…. Anything not approved by Congress is a mere executive agreement,” the senators wrote. “The next president could revoke such an executive agreement with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.”

Josh Rogin’s report makes clear that the signatories “hope that by pointing out the long-term fragility of a deal with no congressional approval … the Iranian regime might be convinced to think twice” about striking a deal with Americans and our negotiating partners.

The letter was organized by Sen. Tom Cotton (R-Ark.), a right-wing freshman who has spent months bragging about his hopes of destroying any diplomatic agreement intended to stop Iran’s nuclear ambitions.

The list of the 47 GOP senators who signed on to the letter is online here. Note, that list features several presidential hopefuls, including Ted Cruz, Rand Paul, and Marco Rubio. (Only seven Senate Republicans decided not to endorse the letter: Lamar Alexander, Dan Coats, Thad Cochran, Susan Collins, Bob Corker, Jeff Flake, and Lisa Murkowski.)

Norm Ornstein noted this morning that he’s “flabbergasted” by the “astonishing breach of conduct.” That’s clearly the appropriate response. But I’m also struck by how dangerous the Republicans’ conduct is.

As we discussed back in January, when the broader sabotage campaign came into focus, there is no real precedent for this in the American tradition. The U.S. system just isn’t supposed to work this way – because it can’t. Max Fisher explained that we’re looking at “a very real problem for American foreign policy.”

The Supreme Court has codified into law the idea that only the president is allowed to make foreign policy, and not Congress, because if there are two branches of government setting foreign policy then America effectively has two foreign policies.

The idea is that the US government needs to be a single unified entity on the world stage in order to conduct effective foreign policy. Letting the president and Congress independently set their own foreign policies would lead to chaos. It would be extremely confusing for foreign leaders, and foreign publics, who don’t always understand how domestic American politics work, and could very easily misread which of the two branches is actually setting the agenda.

The United States and our allies have reached a delicate stage of diplomacy on a key issue, but as far as congressional Republicans are concerned, the United States isn’t really at the negotiating table at all – the Obama administration is. Republican lawmakers not only disapprove of the process, they also feel justified conducting their own parallel, freelance foreign policy, which includes partnering with foreign governments and sending a message to the very rival the United States and our allies are negotiating with.

In other words, for the first time anyone can remember, we’re watching American elected officials brazenly trying to sabotage American foreign policy.

Under the circumstances, it’s no longer ridiculous to wonder whether GOP lawmakers are violating the Logan Act.

As for the GOP’s legal argument to Tehran, Jack Goldsmith added, “It appears from the letter that the Senators do not understand our constitutional system or the power to make binding agreements.”

Unfortunately, that’s not the only thing they fail to understand. They seem equally confused about propriety, U.S. protocols, and how American foreign policy is supposed to work.

“The Bibi-Boehner Coalition”: Inviting The Leader Of Another Nation To Criticize Our Own President, And Netanyahu’s Decision To Accept

It was disconcerting to watch Congress cheer wildly as a foreign leader, the prime minister of one of America’s closest allies, trashed an American president’s foreign policy. It was equally strange that the Speaker of our House of Representatives interjected the United States Congress into an Israeli political campaign.

It fell to Isaac Herzog, Benjamin Netanyahu’s leading opponent in Israel’s March 17 election, to make the essential point: that Tuesday’s speech was “a very harsh wound to Israel-U.S. relations” and “will only widen the rift with Israel’s greatest ally and strategic partner.”

The rapturous greeting Congress bequeathed on Netanyahu for his attack on President Obama’s approach to negotiations with Iran no doubt created great footage for television ads back home and won him some votes at the right end of Israel’s electorate.

But Herzog’s observation stands: John Boehner’s unprecedented act of inviting the leader of another nation to criticize our own president, and Netanyahu’s decision to accept, threaten to damage the bipartisan and trans-ideological coalition that has always come together on behalf of Israel’s survival.

Netanyahu may have spoken the words, “We appreciate all that President Obama has done for Israel,” but the rest of his speech painted the president as foolish and on the verge of being duped on a nuclear deal by the mullahs in Tehran.

The Israeli leader reached for the most devastating metaphor available to him, the appeasement of the Nazis that led to the Holocaust. He urged the United States “not to sacrifice the future for the present” and “not to ignore aggression in the hopes of gaining an illusory peace.” This is what he was accusing Obama of doing. No wonder House Democratic Leader Nancy Pelosi described herself as “near tears” over Netanyahu’s “condescension toward our knowledge of the threat posed by Iran.”

Pelosi was on to something here because the differences between Obama and Netanyahu are not over whether the Iranian regime in its current form is trustworthy. Nobody believes it is. At stake is a balance of risks, a choice between two imperfect outcomes.

On one side is a deal that buys at least a decade in which Iran will not be able to produce a nuclear weapon and will be subjected to inspections and other limitations. On the other side is a decision to blow up the current negotiations because the guarantees of any likely accord would not be sufficiently airtight.

Yes, the emerging deal does carry the risk that down the road, Iran could get nuclear weapons. But failing to reach an agreement will not necessarily stop Tehran from going nuclear, and an end to negotiations would in no way ensure that the rest of the world would return to effective sanctions. Netanyahu’s rhetoric pointed toward his real goal, which is regime change, but how exactly could that happen without armed conflict?

Netanyahu evaded this by offering a thoroughly rosy scenario. “Now, if Iran threatens to walk away from the table — and this often happens in a Persian bazaar — call their bluff,” he said. “They’ll be back, because they need the deal a lot more than you do.” Really? If the Iranian regime is as horrible as Netanyahu says it is, why does he expect its leaders to be as flexible as if they were haggling over the price of a carpet?

The crux of the difference between Obama and Netanyahu is about a bet on the future. The Israeli prime minister argued that “the ideology of Iran’s revolutionary regime is deeply rooted in militant Islam, and that’s why this regime will always be an enemy of America.” He added, “I don’t believe that Iran’s radical regime will change for the better after this deal.”

Obama’s bet, by contrast, is that a deal opening up space and time provides the best chance we have of encouraging political evolution in Iran. Of course there is no guarantee of this, but it’s a reasonable assumption that ending the negotiations would set back the forces of change.

Skeptics of an agreement, Netanyahu included, can usefully push Obama to get the longest timeline and the toughest guarantees he can, and American negotiators can try to use the threat of opposition in Congress to strengthen the final terms.

But Netanyahu never gave a satisfactory answer to the most important question: What is the alternative? As for Netanyahu’s provocative and divisive intervention in American politics and Boehner’s meddling in Israel’s election, the voters of our friend and ally will render a judgment soon.

“Upending The Status Quo”: How Obama Is Shrewdly Using Partisanship To Sideline Netanyahu And Save The Iran Nuclear Deal

The conventional wisdom is that partisanship in Washington, D.C., is one of the biggest obstacles to solving America’s most entrenched problems, from fixing the immigration system to closing the inequality gap. But if the fallout from Israeli Prime Minister Benjamin Netanyahu’s forthcoming address to Congress is any indication, partisanship can be a pretty useful tool when it comes to upending the status quo.

Throughout the controversy, the White House has been happy to run its relationship with Netanyahu through the partisan vortex, helping splinter a bipartisan consensus that was once the most potent domestic threat to a U.S. rapport with Iran — a deal that would constitute the crowning accomplishment of President Obama’s foreign policy legacy.

Of course, Netanyahu has himself to blame more than anyone. By accepting an invitation from House Speaker John Boehner (R-Ohio) to essentially hammer the administration before a joint session of Congress, without notifying the White House or the State Department, he took his longstanding disdain for Obama to new heights. When even Fox News anchors are questioning your treatment of the president, this may be a sign you have crossed a line.

He exacerbated his problems by rejecting an invitation from Democratic Sens. Dick Durbin (Ill.) and Dianne Feinstein (Calif.) to privately meet with Democrats, in what they said was an attempt to “balance the politically divisive invitation from Speaker Boehner.” Netanyahu explained that the meeting would “compound the misperception of partisanship regarding my upcoming visit,” but it seems his rejection accomplished that just fine on its own.

“Since when does an Israeli prime minister say no to a meeting with Democrats?” bemoaned a former Israeli official to The New York Times. And referring to Durbin and Feinstein, he said, “By the way, their Israeli voting record is impeccable. Not good, not very good, impeccable.”

This gets to the crux of the problem for Obama, as he potentially heads into the final stretch of a years-long attempt to reach a deal on Iran’s controversial nuclear program. He not only has to fend off opposition from Republicans, but staunch pro-Israel members of his own party, some of whom seem intent on passing additional sanctions on Iran to scuttle any deal. The problem is so acute that, as recently as January, Obama faced the prospect of a united Congress overriding his veto for the first time in his presidency.

But that has changed. By aligning himself so plainly with the GOP, Netanyahu may have made it impossible for Democrats to join the Republicans. As Dov Zakheim writes at Foreign Policy, “Netanyahu’s determination to address Congress has all but destroyed any chance the Hill’s passing new sanctions and overriding a presidential veto. The deal will therefore go ahead.”

The Obama administration appears to realize this, taking the fight to Netanyahu in a highly public way. The White House made clear it would snub Netanyahu, saying both Obama and Vice President Joe Biden would not meet with him. It still has not said who (if anyone) will be attending the annual summit this weekend of the American Israel Public Affairs Committee, the powerful pro-Israel lobby. [Update: Rice and Samantha Powers, the U.S. ambassador to the U.N., will attend.] Then this week, National Security Advisor Susan Rice said Netanyhu’s speech was “destructive” to U.S.-Israeli relations — not “unhelpful” or any other boilerplate diplomatic language, but “destructive.”

Then Secretary of State John Kerry used his testimony on Wednesday to the House Foreign Affairs Committee to remind everyone that Netanyahu supported the U.S. invasion of Iraq in 2003. Never mind that Kerry was for it before he was against it — he noted that Netanyahu is a hysterical hawk and associated the Israeli prime minister with the most divisive foreign policy issue of the last generation. After all, everyone knows that there is little rank-and-file Democrats hate more than the Iraq War and those who egged the Bush administration on. (Kerry’s attack was all the more remarkable given the fact that his friendship with Netanyahu goes back to the 1970s.)

This is all bad news for those who believe that a U.S. accord with Iran would spell doom for Israel. But for those who believe that diplomacy and negotiations are far better than the alternatives, they might have partisanship to thank.
