Nearly a week since Indiana Governor Mike Pence signed the Religious Freedom Restoration Act (RFRA), igniting a nationwide debate about whether the controversial law invites discrimination based on sexual orientation, most potential Republican presidential candidates have taken the opportunity to bolster their conservative credentials.
“Governor Pence has done the right thing,” said former Florida Governor Jeb Bush on Monday.
“I want to commend Governor Mike Pence for his support of religious freedom, especially in the face of fierce opposition,” Texas Senator Ted Cruz said in a written statement. “Governor Pence is holding the line to protect religious liberty in the Hoosier State. Indiana is giving voice to millions of courageous conservatives across this country who are deeply concerned about the ongoing attacks upon our personal liberties. I’m proud to stand with Mike, and I urge Americans to do the same.”
Ben Carson, former Arkansas Governor Mike Huckabee, Florida Senator Marco Rubio, Wisconsin Governor Scott Walker, Louisiana Governor Bobby Jindal, former Pennsylvania Senator Rick Santorum, former Hewlett-Packard CEO Carly Fiorina, and former Texas Governor Rick Perry all expressed their support for Pence and Indiana’s RFRA law. (Meanwhile, Democrats Hillary Clinton and Martin O’Malley have come out against it.)
But two likely 2016 candidates have been notably absent from this debate: New Jersey Governor Chris Christie and Kentucky Senator Rand Paul. What do they think about the law, and why have they been so quiet on the issue?
Samantha Smith, the communications director for Christie’s Leadership Matters for America PAC, did not return a request for comment on Wednesday morning. (I’ll update this if I hear back.) Christie’s past statements offer little light on where he will fall on the issue, but he has been shifting to the right on social issues in advance of the Republican primary. On Tuesday, he announced his support for a 20-week abortion ban. Given Christie’s shaky position within the party, and the fact that the rest of the field supports Indiana’s law, it would be very surprising if he joined with liberals in opposing it.
As for Paul, Sergio Gor, the communications director of RandPAC, wrote in an email, “The Senator is out of pocket with family this week and has not weighed in at this time.”
It makes sense that Paul is unplugging with his family this week: He’s expected to announce his presidential bid on April 7, the beginning of a long, grueling journey—and a victory would mean that these are his last moments of real privacy for a very long time. Could anyone blame him if he wanted to spend a few quiet days with his family? I couldn’t.
But it also seems a bit convenient that Paul is entirely unreachable while the controversy swirls. If his campaign launch is just six days away, surely Paul and his staff are in close communication. How long does it take to send a tweet or tell your staff to craft a statement?
It will be interesting to see how Paul reacts to the law—as he’ll be forced to do, probably no later than April 7—in light of his libertarian credentials. If he stuck true to them, not only would he support the law but also support the right of Indiana’s businesses to discriminate against LGBT people, something that the rest of the Republican field opposes. (They just disagree with liberals about whether Indiana’s law would allow discrimination.)
But if recent history is any guide, don’t expect Paul to stick true to his libertarian roots. Almost whenever he has faced a choice between traditional libertarian positions and mainstream Republican positions, he has chosen the latter in hope of winning the GOP nomination. Just recently, for instance, he called for more defense spending after saying for years that the military was bloated and needed further cuts.
In fact, Paul has already reversed himself on whether private businesses should be allowed to exclude people from their establishments for any reason. “I think it’s a bad business decision to exclude anybody from your restaurant,” he told the Louisville Courier-Journal in 2010. “But, at the same time, I do believe in private ownership.” He continued, “In a free society, we will tolerate boorish people, who have abhorrent behavior, but if we’re civilized people, we publicly criticize that, and don’t belong to those groups, or don’t associate with those people.” Just a few years later, as that position became controversial, Paul (dishonestly) said that he never held the libertarian position to begin with.
So while it is taking a while for Paul to give his position, it isn’t hard to deduce where he’ll eventually fall. Maybe he’s just waiting until the spotlight on Indiana dies down a bit, so that his libertarian supporters are less aware when he adopts the party line. But if that’s his plan, it’s not very presidential.

Last week, Republican governor Chris Christie’s administration settled New Jersey’s long-standing environmental lawsuit against ExxonMobil Corp. for pennies on the dollar. For a decade, the state had been seeking $8.9 billion in damages for pollution at two refineries in the northern part of the state, and yet Christie’s top officials abruptly proposed closing the case for just $225 million.
In the aftermath, as environmentalists express outrage and legislators move to block the settlement, the question on many observers’ minds has been simple: Why did Christie settle?
One possible answer is just as simple: money — more specifically, campaign cash.
According to federal records, ExxonMobil has donated more than $1.9 million to the Republican Governors Association since Christie’s first run for governor in 2009. That includes $279,000 during Christie’s election and re-election races, and also another half-million when he chaired the organization in 2014. Additionally, one of Exxon’s law firms in the New Jersey case also donated $30,000 to the RGA since 2013.
Another possible answer could be relationships.
Christie’s first attorney general worked for Exxon for seven years. His deputy chief of staff in 2014 left the governor’s office for a job with Exxon’s lobbying firm in Trenton. And weeks before the settlement was announced, one of his cabinet secretaries took a job with Exxon’s New Jersey law firm.
Still another possible answer about why Christie settled the Exxon case could be found in a little-noticed provision his administration slipped into the annual budget in 2014.
The language in question empowers the governor to divert money obtained from environmental litigation away from pollution cleanup programs and into the state’s general fund, where it can be used to fill budget gaps or finance corporate subsidies. The provision explicitly takes precedence over other state laws designed to direct proceeds from environmental lawsuits into New Jersey’s environmental protection programs.
Because the provision is temporary, remaining in force only until a new budget is enacted, critics say that it effectively encourages Christie’s administration to settle cases as quickly as possible to free up cash that the governor can then tap however he sees fit. The most expedient way to accelerate a settlement is to lessen the fines sought from the company facing the lawsuit.
“This is money that rightfully belongs to the people of New Jersey to make up for the injury to the environment,” said Jeffrey Tittel, executive director of the New Jersey Sierra Club. “Instead, the governor is diverting it for other purposes. It’s a twofer: Reduced settlements help the oil companies before Christie’s presidential campaign, and Christie can quickly get more money for the record amounts of corporate subsidies he is handing out.”
So which answer is correct? Is the settlement a product of campaign cash, relationships or budget machinations? It is hard to say for certain, but in all likelihood it is probably a little bit of all three — plus some presidential campaign calculation sprinkled in.
In politics, as rare as it is to see a policy decision made on the substantive merits of an issue, it is even rarer that a decision is only about one thing. Most often, decisions represent a mixture of motivations. In agreeing to such a small settlement in the Exxon case, Christie placates his politically connected colleagues and gets himself some extra cash to spend on his budget’s new tax cuts. He also gives a gift to an oil industry donor just as he starts raising money for a 2016 White House bid.
Sure, the settlement may not be great policy, but it may be shrewd short-term politics. That divergence is hardly surprising — at this moment in history, good policy and good politics are not often synonymous.

Because New Jersey Governor Chris Christie recently quarantined a nurse in a large tent when he thought she might have had Ebola, you might have assumed that he of all people would seize upon a measles outbreak—attributable to a movement of anti-vaccine reactionaries—to lecture parents for putting children at risk. But when pressed to take a position on the view that parents should vaccinate their children, Christie hedged. “It’s more important what you think as a parent than what you think as a public official,” he said. “I also understand that parents need to have some measure of choice in things as well. So that’s the balance that the government has to decide.”
It’s tempting to attribute his sudden fondness for “balance” to lessons he over-learned during the Ebola panic he helped nurture. But it’s also mistaken.
Vaccine skeptics don’t mirror climate change deniers, who are overwhelmingly conservative and amplified by vast wealth. But the anti-vaxx movement nevertheless presents a greater political problem for Republicans than Democrats, who, like President Obama, are unafraid to make explicit declarations about the importance of vaccinating children. By and large, Republican politicians don’t tout their own ignorance of vaccine science or use it to shield themselves from substantive questions about immunology, public health, or child rearing. Vaccine skepticism and climate change denial are, again, more different as reactionary movements than they are alike.
But two facts about vaccine skeptics and the risks they pose make it difficult for Chris Christie and perhaps other Republicans to treat anti-vaxxers as brusquely as he’s happy to treat unionized teachers in Newark.
It’s not that Republicans must pretend to believe that vaccines cause autism. But a large, motivated population of vaccine skeptics begs for interventions Republicans can’t easily get behind. The two most straightforward ways to increase vaccination rates or otherwise reduce the risk of losing herd immunity are: Imposing government mandates and stigmatizing the white, affluent people who comprise the core of the anti-vaxx movement.
Hectoring white people and imposing mandates on their families doesn’t fit comfortably in the GOP wheelhouse these days, and Christie’s awkward walkback underscores the bind that places on conservatives exquisitely.
Christie’s office: “The governor believes vaccines are an important public health protection and with a disease like measles there is no question kids should be vaccinated. At the same time different states require different degrees of vaccination, which is why he was calling for balance in which ones government should mandate.”
Shorter Christie: I am a scientist, man. But a conservative one.
Conservatives and liberals are both overwhelmingly of the view that childhood vaccines carry important benefits; conservatives, however, are inherently skeptical of government interventions of any kind. Thus, Republican politicians who lean too heavily on the state action, even in the realm of something as essential to the common good as immunization, will run into problems.
A 2014 study by Dan Kahan for Yale Law School’s Cultural Cognition Project found that people with left-leaning political outlooks are likelier to support restricting non-medical exemptions for childhood vaccine requirements, likely reflecting “an ideological predisposition against government regulation independent of any ideological sensibility specific to childhood vaccination.”
This tendency might not hold if anti-vaxxers existed on the fringes of political life, or were overwhelmingly of foreign origin, or were monolithically liberal. Opposition to government intervention can be both reflexive and selective. But the available evidence suggests vaccine skeptics tend to be white, educated, affluent, and, per Kahan’s study, politically diverse.
It’s not that Republicans are in thrall to vaccine skeptics, but it can be difficult for them to confront vaccine skeptics in ways that don’t alarm conservatives for other reasons. And taken to an extreme, it becomes hard to tell the difference between the two.

“Mary Pat and I have had our children vaccinated and we think that it’s an important part of being sure we protect their health and the public health,” Christie told reporters here Monday. But the likely Republican presidential candidate added: “I also understand that parents need to have some measure of choice in things as well, so that’s the balance that the government has to decide.”
And it gets worse: Christie said, “It’s more important what you think as a parent than what you think as a public official.”
No, no, a thousand times no. It’s great that Christie vaccinated his children, but it’s also completely irrelevant. And what he thinks as a parent is absolutely not more important than what he thinks as a public official. Want to know why? Because he’s a public official. That means that he has a responsibility for the health and welfare of the nine million people who live in his state. I am so tired of politicians who say, “My most important title is Mom/Dad.” It isn’t. When you decided to run for public office, you accepted that there would be times when you’d have to act in the public interest regardless of your family’s interest, or your friends’ interest, or the interest of the town you grew up in. When you took the oath of office you made a covenant that you’d work on behalf of the larger community. The fact that you’re a parent can help you understand other parents and their concerns, but it doesn’t change your primary responsibility.
One can certainly express some measure of understanding toward anti-vaxxers while still holding that their views are not just mistaken but profoundly dangerous. Fear for the health of one’s children is a powerful force. As a general matter there’s nothing wrong with distrusting the pharmaceutical industry. One can understand how someone might end up with such views. That being said, there’s about as much real evidence that vaccines cause autism as there is that volcanoes cause post-nasal drip.
So the responsible thing for a governor to say would be, “As a parent, I get where they’re coming from. But as a public official it’s my responsibility to say that they’re wrong, and in their error they aren’t just threatening their own children’s health, they’re threatening the entire community.” You don’t have to think parents who refuse to vaccinate their kids should be arrested, but their ideas ought to be condemned for the harm they do. If Chris Christie has sympathy for them as a father, that’s fine. But he has a more important job to do.
After getting some criticism over his initial remarks, Christie clarified through a spokesperson that he believes all kids should be vaccinated. Which is good, and I hope that this episode provides a lesson for him and other officeholders. Politicians are always trying to tell us that they’re just regular folks like us, and all you need to succeed in high office is common sense and a strong memory of your humble roots. It’s baloney. We choose them for those offices because we need them to make complex and difficult decisions that require more than common sense. We don’t try to elect the best dad to be governor or president, we try to elect the person who’ll be the best governor or president.
Are Republicans more likely than Democrats to fall into this regular-guy routine? Politicians from both parties do it, but the GOP has certainly embraced know-nothingism on other issues. “I’m not a scientist” has become the standard Republican way to say we shouldn’t do anything to address climate change. For a long time they have played the identity politics game, which requires demonstrating that you’re “one of us” and your opponent is alien and contemptible, with particular vigor. That’s an argument that denies there’s anything special about public office; all we need is to find a candidate with “[insert our state here] values,” and everything will be fine.
But it won’t, and it would be nice if the people vying for office stopped pretending otherwise.

Since shortly after the 2012 presidential election, New Jersey governor Chris Christie has made it very clear that he plans to run for the White House in 2016. But according to a new survey, Republicans would rather he stay in the Garden State.
That’s the takeaway from a CBS News poll, released Sunday, which asks Americans who they would — and would not — like to see run for president.
Republicans are intrigued by several potential candidates. They agree 59 to 26 percent that Mitt Romney should launch a third presidential bid — a much warmer reception than he’s received from party insiders — and 50 to 27 percent that former Florida governor Jeb Bush should try to become the third member of his family to win the White House. Former Arkansas governor and Fox News host Mike Huckabee also polls well, with 40 percent wanting him to run and 29 percent hoping he declines.
But Republicans are much more sour on Christie: Just 29 percent want to see him join the race, while 44 percent disagree. Only former Alaska governor Sarah Palin polls worse, with 59 percent urging her to stay out of the race and 30 percent hoping she jumps in.
Considering that Christie has been traveling the country in a highly publicized shadow campaign, while Palin has been filling her days with impeachment calls and incomprehensible rambling, that’s not a great sign.
It’s not just national Republicans who aren’t crazy about a potential Christie campaign; his own constituents don’t seem very enthused by the idea, either. A Fairleigh Dickinson University poll released last week found that 47 percent of New Jersey voters disapprove of Christie’s job performance, compared to just 39 percent who approve. Furthermore, voters agreed 53 to 32 percent that Christie is more concerned with running for president than being governor, and an overwhelming 72 percent said that Christie’s gubernatorial decisions are influenced by his presidential ambitions.
Previous polls have found likely Democratic nominee Hillary Clinton walloping Christie in New Jersey in a hypothetical presidential matchup.
According to the CBS poll, Democrats are much more excited for a Clinton campaign than Republicans are about Christie; 85 percent of Democrats want Clinton to run for president, while just 11 percent want her to pass on the race.
