“America Moving Farther Apart”: Hillary Clinton Probably Can’t Get Gun Control Passed. But She Should Talk About It, Anyway
Hillary Clinton is talking about guns, and everyone seems surprised. After all, doesn’t she know the issue is a sure loser for Democrats?
The truth is quite a bit more complicated than that — in fact, pushing for measures like expanded background checks is likely to help Clinton in the 2016 election. But if she’s going to promise to make headway on this issue, she needs to offer some plausible account of how as president she could make real progress where Barack Obama couldn’t.
Let’s address the matter of the gun issue’s political potency first. As is the case on so many issues, the Republican position is more popular when the questions are vague, while the Democratic position is more popular when the questions are specific. If you look at polling on guns, what you see is that the country is split pretty evenly on the broad question of whether gun laws should be more strict or less strict. But particular measures to regulate guns get much more support, especially universal background checks, which as many as nine out of ten Americans endorse.
At some point in this discussion, someone will always say: “But what about the NRA? They’re so powerful!” The NRA’s power is real in some ways and illusory in others, and it’s important to understand which is which. When it comes to lobbying, the NRA is indeed hugely powerful. It has the ability to stop any legislation on guns, often before it even gets written. But elections are an entirely different story. Almost all the congressional candidates who win the NRA’s supposedly coveted endorsement are Republican incumbents from conservative districts who win their elections by huge margins. When Republicans have a good election, as they did in 2014 and 2010, the NRA rushes to reporters to claim credit, saying the election proves that voters will punish any candidate who isn’t pro-gun. But when Democrats have a good election, as they did in 2012 and 2008, the NRA is strangely silent.
Gun ownership has been steadily declining since the 1970’s, and guns are more concentrated among voters that Democrats already won’t win and don’t need. For instance, according to the Pew Research Center, whites are twice as likely as Hispanics to own guns. If winning over Hispanic voters is the sine qua non of a Republican victory, advocacy for loosening gun laws isn’t exactly going to be part of a winning formula for the GOP. The person most likely to be a gun owner is a married white man from the South — in other words, probably a Republican.
When people argue that Hillary Clinton shouldn’t touch the gun issue, watch out for comparisons to how Bill Clinton did in the Electoral College, because America’s political geography is very different than it was two decades ago. For instance, I guarantee you that Senator Joe Manchin will at some point loudly advise that Clinton needs to tread carefully on guns if she’s to win his home state of West Virginia like her husband did twice. But the truth is that Clinton is probably not going to win West Virginia no matter what she does, and she doesn’t need to. Barack Obama’s two comfortable Electoral College victories were built on combining Democratic strongholds in the Northeast and West with the more liberal states in the Midwest and the fast-changing Southwest, where Hispanic votes are key. Clinton will almost certainly seek to assemble the same map — and it’s one where advocacy for the more popular gun restrictions will help her, not hurt her.
Still: if Clinton says it’s vital to enact universal background checks and other “common-sense” gun laws, she has to explain how she’s going to do it. Let’s not forget that in the wake of the horrific Newtown massacre, a bipartisan measure to expand background checks failed to overcome a Republican filibuster in the Senate, falling six votes short of the 60 it needed. If a bill that had the support of 90 percent of the public couldn’t make it past congressional Republicans just after 20 elementary school students had been murdered, how is Clinton going to convince them to vote for whatever she proposes?
But talking about gun measures in the presidential campaign could still have a practical impact, by elevating the issue and thereby making it more likely that more gun laws might be passed on the state level. And that’s where all the action has been of late: since the Newtown shooting, there have been dozens of laws passed at the state level on the subject of guns, and they tell a story of red and blue America moving farther apart.
In Red America, one state after another has passed laws to expand who can get a gun and where you can take it. Last year Georgia passed a law allowing people to take guns into churches, government buildings, and bars. “Stand your ground” laws have proliferated in Republican-run states (despite the fact that research indicates that they increase the number of homicides).
Meanwhile in Blue America, dozens of laws have been passed to rein in guns. Legislatures in states like California, Maryland, and Connecticut expanded background checks, restricted access for those with mental illness or domestic abuse convictions, and made it harder to get assault weapons. In 2014, voters in Washington state passed a ballot initiative mandating universal background checks by a wide margin.
So when we talk about the gun issue, we have to keep three things in mind. First, the kind of restrictions Clinton is proposing are hugely popular. Second, there really are two Americas when it comes to guns. And third, one of those Americas has the ability and the desire to stop any gun legislation in Congress. If Hillary Clinton has a plan to deal with that last reality, it would be interesting to hear.

“The Right To Be Free From Guns”: Those Who Want To Live, Shop, Go To School, And Worship In Gun-Free Spaces Also Have Rights
Advocates of a saner approach to guns need a new strategy. We cannot go on like this, wringing our hands in frustration after every tragedy involving firearms. We said “Enough” after Sandy Hook. We thought the moment for action had come. Yet nothing happened. We are saying “Enough” after Charleston. But this time, we don’t even expect anything to happen.
What’s needed is a long-term national effort to change popular attitudes toward handgun ownership. And we need to insist on protecting the rights of Americans who do not want to be anywhere near guns.
None of this should mean letting Congress off the hook or giving up on what might be done now. So kudos to Sens. Joe Manchin (D-WV) and Pat Toomey (R-PA) for saying on Tuesday that they are looking for ways to bring back their proposal that would require background checks for gun sales. In 2013, it failed to get the needed 60 votes and won support from only three Republicans besides Toomey.
Lest anyone doubt that gun-control measures can work, a study released earlier this month by the Center for Gun Policy and Research at Johns Hopkins University found that a 1995 Connecticut law requiring a permit or license contingent on passing a background check was associated with a 40 percent drop in gun homicides.
But as long as gun control is a cause linked to ideology and party — and as long as the National Rifle Association and its allies claim a monopoly on individual rights arguments — reasonable steps of this sort will be ground to death by the Washington Obstruction Machine.
That’s why the nation needs a public-service offensive on behalf of the health and safety of us all. It could build on the Sandy Hook Promise and other civic endeavors. If you doubt it could succeed, consider how quickly opinion changed on the Confederate flag.
My friend Guy Molyneux, a progressive pollster, laid out how it could happen. “We need to build a social movement devoted to the simple proposition that owning handguns makes us less safe, not more,” he told me. “The evidence is overwhelming that having a gun in your home increases the risks of suicide, domestic violence, and fatal accidents, and yet the number one reason given for gun purchases is ‘personal safety.’ We need a public health campaign on the dangers of gun ownership, similar to the successful efforts against smoking and drunk driving.”
The facts were on the side of those who battled the tobacco companies, and they are just as compelling here. When we talk about guns, we don’t focus enough on the reality, reported in the 2015 Annual Review of Public Health, that nearly two-thirds of the deaths from firearms violence are suicides. Yes, people can try to kill themselves with pills, but there’s no coming back from a gunshot to the head. Those in the throes of depression who have a gun nearby are more likely to act on their darkest impulses.
Nor do we talk enough about accidental deaths when children get their hands on guns, or what happens when a domestic argument escalates and a firearm is readily available. The message is plain and simple: Households that voluntarily say no to guns are safer.
“The best way to disarm the NRA rhetorically is to make the Second Amendment issue moot,” Molyneux said. “This is not about the government saying you cannot own a handgun. This is about society saying you should not have a gun, especially in a home with children.”
Molyneux says his approach “does not imply giving up on gun control legislation.” On the contrary, the best path to better laws is to foster a revolution in popular attitudes. And this approach would finally put the rights of non-gun owners at the center of the discussion.
“Those of us who want to live, shop, go to school, and worship in gun-free spaces also have rights,” Molyneux says. “In what way is ‘freedom’ advanced by telling the owner of a bar or restaurant they cannot ban handguns in their own place of business, as many states now do? Today, it is the NRA that is the enemy of freedom, by seeking to impose its values on everyone else.”
The nation could ring out with the new slogans of liberty: “Not in my house.” “Not in our school.” “Not in my bar.” “Not in our church.” We’d be defending one of our most sacred rights: The right not to bear arms.

“The Dangers To Everyone”: A Gun-Carrying GOP Congressman Is Outraged A Man With A Concealed Gun Got Near Obama
Stipulating that none of the Secret Service lapses, revealed in the press over the past week, should’ve happened in the first place, the only one that strikes me as truly inexplicable is the revelation that USSS allowed an armed felon into an elevator with President Obama at the Centers for Disease Control, and that they didn’t know he was armed.
The two other big stories aren’t as terrifying, at least to me. Inexcusable, maybe, but explicable. In the case of the fence jumper, I get why people on a security detail might let their guard down when the people they’re charged with protecting are off site. And the inconvenient truth is that the Secret Service can’t stop every determined person with a sniper rifle from taking shots at the White House from a number of different locations in the city. Maybe they bungled the response, but the rifle shots themselves were probably not preventable.
The armed felon in the elevator represents a different level of failure. There appears to be widespread recognition of this fact in both the media and in Congress. That’s good, and important, but it’d be nicer still if elected gun enthusiasts thought through the logical implications of their completely warranted outrage.
Consider the following exchange from a Tuesday oversight hearing on Capitol Hill.
Rep. Jason Chaffetz (R-Utah), who heads a House subcommittee that oversees the Secret Service, first heard of the breakdown from a whistleblower. The Washington Post confirmed details of the event with other people familiar with the agency’s review.
“You have a convicted felon within arm’s reach of the president, and they never did a background check,” Chaffetz said. “Words aren’t strong enough for the outrage I feel for the safety of the president and his family. “
Chaffetz added: “His life was in danger. This country would be a different world today if he had pulled out his gun.”
This is all true, but it could use a little further unpacking. Chaffetz isn’t a gun grabber. He’s spoken openly about the fact that he carries a concealed weapon when he’s in his Utah district. He cosponsors legislation that would erode state concealed carry restrictions by requiring those states to honor concealed carry permits from other states, including states with weaker permitting processes. (This would presumably apply to Washington, D.C., now, too.) And yet Chaffetz also joins the overwhelming consensus that Obama shouldn’t have been on an elevator with a person carrying a concealed weapon because he fully grasps that people carrying concealed weapons can be incredibly dangerous.
Chaffetz is appalled that USSS allowed a person to carry a concealed handgun around the president without conducting a background check, but supports legislation to make it significantly easier for people—many of whom come into lawful possession of firearms without undergoing background checks—to carry concealed weapons around you and me.
This isn’t to give USSS a pass. They should’ve been aware of every armed person on the premises in advance of the visit, and followed protocol to keep them or their guns away from the president. But the man on the elevator was a security contractor at CDC. His employer issued him that gun. His felony convictions only underscore the dangers—to everyone, not just the president—of combining easy access to firearms with lax carry laws. But that’s more or less the beau ideal for the gun lobby, gun enthusiasts, many Democrats, and the entire Republican party.

“New Study Makes The Case For Gun Control”: The Strongest Evidence We Have That Background Checks Really Matter
During last year’s battle over gun control, the pro-gun side did more than passionately invoke the Second Amendment: They claimed that gun control doesn’t work. Sometimes even the reformers, surveying the limited impact of legislation from the 1990s, feared the same. But a new study on universal background checks makes the strongest case yet that the policy saves lives. “This is probably the strongest evidence we have that background checks really matter,” said Philip Cook, a gun expert at Duke’s Sanford School of Public Policy.
The study, from the Johns Hopkins Center for Gun Policy and Research, found the murder rate in Missouri jumped 16 percent—an additional 55 to 63 murders a year—after the repeal in 2007 of a state law that required anyone purchasing a handgun to obtain a permit showing they had passed a background check. (Though federal law mandates background checks by licensed dealers, private dealers don’t have to perform them in all but 14 states.) “This study provides compelling confirmation that weaknesses in firearm laws lead to deaths from gun violence,” said Daniel Webster, the study’s lead author, in a statement.
Since this is only a single study, “it’s just suggestive,” warned David Hemenway of Harvard’s School of Public Health. It is “another piece of evidence that is consistent with the bulk of the literature, which shows where there are fewer guns, there are fewer problems… But you want eight more studies that say background checks really matter.”
And the study isn’t perfect: Missouri also enacted a “stand your ground” law in 2007, creating some challenges in disentangling the effects. But Cook said he is confident that background checks played a major role because the authors tracked an increase in guns that went directly from dealers to criminals—exactly the scenario background checks are designed to prevent. The study also notes an uptick in guns “purchased in Missouri that were subsequently recovered by police in border states that retained their [permit-to-purchase] laws.”
The findings at least begin to fill a gap in the research that last year’s debate exposed. Mayors Against Illegal Guns, Michael Bloomberg’s gun control group, found that the shortage of data stems from a shortage of funding—especially federal funding. In 1996, the National Rifle Association and the gun lobby pushed Congress to eliminate the $2.6 million appropriation that underwrote the Center for Disease Control’s research on firearm injuries. President Barack Obama ended the funding freeze last year, and Garen Wintemute, director of the Violence Research Program at the University of California, Davis, told NBC that private funding for gun research has also spiked with the shooting of Congresswoman Gabrielle Giffords and other high-profile acts of violence.
So why hasn’t the new finding gotten much attention? “I don’t mean to diminish the value of the study, but I don’t think it could have made a difference last year, and I don’t think it will now,” said Tom Diaz, a former policy analyst at the Violence Policy Center. He called the finding “very clear,” but added: “The debate is just unhinged from the facts.”
As the study notes, 89 percent of Americans, and 84 percent of gun owners, supported universal background checks in 2013, before this study bolstered the argument for them. But that’s just one more reason for Congress to pick up the issue again—that, and a new analysis last week which found there have been 44 school shootings since the one at Sandy Hook Elementary School in Newtown, Connecticut.

“Gun-Crazy Business Models”: Beretta USA Teaches Us How Not To Run Your Corporation
We often think of business leaders as hard-nosed pragmatists, guided by dollars and cents with little regard to emotion. But the truth is that corporate executives are human just like the rest of us. They can be as irrational as anyone, and frequently make business decisions on the basis of things like spite.
So it is that the gun maker Beretta USA has decided against expanding operations into West Virginia, despite heavy lobbying from state officials, because, as the Charleston Gazette reports, “they say Sen. Joe Manchin’s push to expand background checks makes the state less stable for their business.” Perhaps the folks at Beretta don’t quite understand what a senator does, or how laws passed (or in this case, not passed) by Congress actually work. If Congress were to pass a background check bill for the country, it wouldn’t make the state of West Virginia any more or less “stable” for the gun business than any other state.
And after all, business is booming. It isn’t that more Americans are buying guns (gun ownership is on a steady long-term decline), but that those who do own guns are buying more and more of them. That’s why companies like Beretta have forged such a close alliance with the National Rifle Association. The NRA tells its constituents that the country is about to descend into a Mad Max-style apocalypse and that politicians will be confiscating their guns any day, so they rush out to buy more, and the gun manufacturers reap the profits.
A new background check law might help keep guns out of the hands of some people who shouldn’t have them, but it probably wouldn’t hurt Beretta’s bottom line one bit. They’re in a business that has gone nowhere but up. Nevertheless, like other gun advocates, they want to think of themselves as oppressed, kept down by mean politicians in their crusade for liberty. But wherever they decide to move those couple of hundred jobs, they’ll be just fine.
And by the way, in the six and a half months since the Sandy Hook massacre, roughly 5,600 Americans have been killed with guns.
