“Dwelling In Sequesterland”: Once The Sequester Is Solved, Rand Paul Will Go Back To Being An Oddball

This is a weird moment in American politics. The sequester has just chopped $43 billion out of this year’s defense budget and Republicans are pretending not to care. Now Senator Rand Paul is winning kudos for conducting an old-fashioned talking filibuster against drone warfare from Republican National Committee Chairman Reince Priebus (“I think it was completely awesome”). (Click here in the unlikely event you want to watch all 13 hours of Paul’s filibuster, and here for a video abridgement from the Washington Post.) With Politico‘s Lois Romano gushing that the filibuster has abruptly “vaulted [Rand] into the top tier of Republican power players,” Paul now says he’s “seriously” pondering a 2016 run for president. “I think our party needs something new, fresh and different,” Paul told Romano.

We have to figure out how to appeal to the West Coast, New England [and] around the Great Lakes area. We need to figure out how to appeal to the blue-collar voters that voted—that were Democrats that voted for Reagan and I think are drifting back because they see us as the party of the wealthy. … I do want to be part of making the Republican Party again more of a national party, less than a regional party, which I think we’re in danger of becoming.

Paul’s specific objection to drones is that they might be used to kill U.S. citizens on U.S. soil. His apparent preference for civil liberties over civil rights is one problem he’ll likely have running for president. (Paul recently voted against the Violence Against Women Act largely on states-rights grounds, and as recently as last year he argued that the 1964 Civil Rights Act was a cruel imposition on property rights.) Paul inhabits approximately the same niche as Haley Barbour, another seemingly strong candidate with a civil rights problem who ultimately decided not to run in 2012. But that isn’t the biggest obstacle to a plausible Paul candidacy. The larger problem is Paul’s opposition to the U.S. national-security establishment.

In ordinary times, it would be unwise for a Republican seeking the presidential nomination to deny this establishment the right to kill an enemy combatant on U.S. soil—even if that combatant were a U.S. citizen. But these aren’t ordinary times. We dwell in Sequesterland, a Brigadoon-like place where the GOP feels free not to define itself though toughness on defense. Even here in Sequesterland, Paul didn’t escape condemnation from the Wall Street Journal editorial page (“If Mr. Paul wants to be taken seriously he needs to do more than pull political stunts that fire up impressionable libertarian kids in their college dorms”) and from Sens. John McCain (“totally unfounded”) and Lindsay Graham (“To my party, I’m a bit disappointed that you no longer apparently think we’re at war”). But since this is Sequesterland, most other Republicans gave Paul a pass lest they give the public occasion to wonder why, if they’re so darned desperate to defend national security, they’re bleeding the Pentagon.

They are bleeding the Pentagon, incidentally. As Fred Kaplan has argued forcefully in Slate, the mere likelihood that $43 billion could be sliced out of the Pentagon budget without compromising national defense does not mean that this $43 billion cut is a breeze. As with the civilian cuts, the sequester cuts are across the board and don’t really give managers any leeway to prioritize this at the expense of that. Here’s Kaplan:

What about the $179 million allotted for modifications to the AH-64 Apache helicopter? How do the Army’s managers parse that? And how does anyone, whether in Congress or the Pentagon’s comptroller office, perform oversight of that feat, this year and in the near future? Not only is the exercise disruptive and in some cases absurd, it also creates excuses for contractors to bilk the Pentagon after the budget crisis is over, claiming that they suffered cost overruns as a result of inefficiencies brought on by sequestration.

Because this can’t possibly last, it won’t. One way or another, the GOP will be transported out of Sequesterland, and when that happens Paul will lose his get-out-of-jail-free card.

Remember Chuck Hagel? Former Republican senator from Nebraska? Just before the sequester hit Hagel was confirmed as defense secretary, but his margin was historically narrow because nearly every Senate Republican opposed him. (Paul was one of only four GOP yeas.) The president named a Republican to be secretary of defense, and Senate Republicans (including, for very foggy reasons, Paul) actually gave serious thought to filibustering the nomination. Much of the Republican resistance to Hagel was based, childishly, on the mere fact that Obama wanted him. But much of it was based on Hagel’s having taken positions on national security issues that his fellow Republicans judged unacceptably dovish—and Hagel isn’t nearly as dovish as Paul is. If Hagel proved unacceptable to the GOP, it’s inconceivable that Paul—who less than one month before the 2012 election published an op-ed condemning Mitt Romney for being too hawkish in the Middle East and too willing to increase Pentagon spending—will ever pass muster. And by “the GOP” I don’t just mean GOP politicians. I mean voters, too. Those Reagan Democrats whom Paul thinks he can woo in California, New England, and the Great Lakes? They’re pretty hawkish. They won’t vote for a candidate who’s weaker on defense than Barack Obama is.

New York magazine’s Jonathan Chait writes that Paul’s libertarianism on national security issues “will remain cool with his party only as long as the GOP remains out of the White House.” I disagree. I think it will remain cool with his party only as long as the GOP dwells in Sequesterland. Once that little matter gets resolved, Paul will go back to being an oddball. I’m not saying he won’t try to get elected president—after all, it runs in the family—but he will never inhabit the “top tier of Republican players.” That it looks like he might right now is just a quirk of circumstance.

“Remaining In Denial”: The GOP Must Come To Terms With George W. Bush’s Disastrous Presidency

It’s still freezing in much of country, but it’s springtime for Republican intellectuals.

With the Romney debacle behind them, a number of analysts have gone public with accounts of the party’s failures and ambitious proposals for its reform. Over the last few weeks, Ross Douthat, Michael Gerson and Pete Wehner, Yuval Levin, Ramesh Ponnuru, Jim Pethothoukis, David Frum, and Tod Lindberg have all weighed in on where the GOP should go.

The proposals include promising ideas, such as emphasizing tax and regulatory simplification over income tax cuts, or moving away from hard-line positions on abortion and gay marriage. Nevertheless, these plans are a misleading point of departure for GOP renewal. That’s because their authors remain in denial about the cause of Republicans’ unpopularity: the catastrophic failure of the Bush presidency.

Start with foreign policy. From the 1960s until the 21st century, Republicans reliably enjoyed the trust of the public to manage America’s foreign affairs and protect its national security. The attacks of September 11 gave George W. Bush the opportunity to build on that reputation. Instead, he squandered it by mismanaging the war in Afghanistan and plunging the nation into a disaster in Iraq.

Not every setback was Bush’s fault. Nevertheless, the president bears more personal responsibility for foreign policy than any other issue. In most Americans’ minds, then, Afghanistan and Iraq were Bush’s wars. By the conventional logic of politics, that means that they are Republican wars, too.

Yet Republican reformers are reluctant to admit the obstacle that Bush’s legacy poses to public confidence on foreign affairs. Although they acknowledge that the wars have been unpopular and expensive, they present these facts in the passive voice, as if the deaths of nearly 7,000 Americans were the result of weather or other uncontrollable forces. Here is how Gerson and Wehner describe the loss of the GOP’s foreign policy advantage: “Nor has the decidedly mixed legacy of the wars in Iraq and Afghanistan over the last decade worked to bolster the Republicans’ electoral advantage in the conduct of foreign policy; if anything, the opposite is the case.” Who do they think they’re fooling?

Then there’s the economy. The reformers write eloquently, and correctly, of the need for Republican responses to long-term problems of unemployment, wage stagnation, and rising health-care and education costs. As with foreign policy, however, they are reluctant to acknowledge that the Bush administration did little to reverse these trends, and in some ways exacerbated them. In an otherwise compelling critique of Republicans’ fixation on marginal income tax rates, Ponnuru manages not to mention that the Bush administration regarded tax cuts as a signature achievement. Ordinary citizens have longer memories.

I emphasize foreign policy and the economy because these are areas of Bush’s most dramatic failures. But Bush’s record as an administrative centralizer and critic of Social Security also overshadows Republican efforts in education and entitlement reform. It’s not good enough for Republicans to pledge that things will be different next time. To convince Americans that they’re serious, reformers need to name names about the cause of the public’s justifiable mistrust.

To be fair, the reformers are in a difficult position. They won’t attract converts within the party if they mount a frontal assault on its idols. And they know that Bush and his policies remain popular both with Republicans in office and with many base voters.

What’s more, several of the reformers have professional ties with the Bush administration. Frum, Gerson, and Wehner all worked as speechwriters in the White House. For them, rejection of the Bush legacy amounts to rejection of their own work. That’s not easy for even the most rigorous thinker.

But the reformers’ connections to the Bush administration reflect the GOP’s larger problem: an institutional and intellectual elite dominated by alumni or associates of the Bush administration. As Robert Draper reported in The New York Times Magazine, the RNC committee established late last year to investigate the party’s failings was staffed with the likes of Ari Fleischer, Bush’s press secretary. Such a team is not very likely to ask tough questions — or to recognize unflattering answers. In addition to new policies, Republicans desperately need new personnel.

It takes a long time for political parties to recover from defeat. Since winning suggests that they’re doing something right, it takes even longer to recover from victory. Because it reassured Republicans that aggressive war, fiscal policies that favor the rich, and the ideologically-inspired transformation of beloved domestic programs were fundamentally popular, the re-election of George W. Bush in 2004 was like a drug that relieves symptoms without treating the underlying disease. Conservative intellectuals must help the GOP break its dependence on these dangerous nostrums — and its continuing allegiance to the doctor who prescribed them.

“Dictatorship Vs Democracy”: Republicans Are Trying To Exercise Powers That Do Not Rightly Belong To Them

Readers familiar with my work know that one of my favorite quotes about the nature of politics, and democracies in particular, comes from Walter Lippmann’s Essays in the Public Philosophy, where the preeminent American journalist of the 20th century tried in 1955 to diagnose why fascism and other forms of dictatorship took root in democratic Europe in the early decades of the last century.

It is possible to govern a great state without giving the masses of people full representation, writes Lippmann. “But it is not possible to go on for long without a government which can and does in fact govern.”

If, because of gridlock, stalemate, partisanship and implacable polarization people find “they must choose whether they will be represented in an assembly which is incompetent to govern, or whether they will be governed without being represented, there is no doubt at all as to how the issue will be decided,” writes Lippmann. “They will choose authority, which promises to be paternal, in preference to freedom which threatens to be fratricidal.”

Because the truth is, says Lippmann, large communities cannot do without being governed. “No ideal of freedom and of democracy will long be allowed to stand in the way of their being governed.”

The standoff between President Obama and the Republican hardliners over the sequester is not, at the end of the day, about taxes and spending.

It is, rather, about whether America can remain a viable democracy in which the country is able to move forward with a program once that program has been put to a vote — as President Obama’s plan of a balance between spending cuts and tax hikes was in the last election — or whether a determined minority supported by little more than 20% of the public will still be able to leverage tools that were crafted two centuries before to arm the minority against majority “tyranny” in order to dictate surrender terms to that majority by holding the nation’s government and economy hostage.

Republicans who insist that President Obama show “leadership” in this crisis by “capitulating” to their political demands are engaging in the same cynical wordplay for which the GOP has become famous. For like those who said the only way to save the village was to destroy it, Republicans say the President must save the nation from the “devastating” consequences of $85 billion in budget cuts by cutting another $85 billion from the budget — only not from defense and without new taxes, which are “off the table.”

But the darker side of these calls for executive action to overcome legislative gridlock is the one that Walter Lippmann understood so well decades ago. It’s one the President referred to obliquely in his press conference when he reminded reporters who wanted to know why he did not just “do something” to end the standoff that presidents under our Constitution are not “dictators” (Obama used that word) who can dispatch the Secret Service like a Praetorian Guard to prevent legislators from catching their planes or forcing these duly-elected, if recalcitrant, democratic leaders to do a thing once they’ve made up their minds not to.

It does not take a genius — or unhinged conspiracy theorist – to imagine that one strategy a right wing authoritarian movement might employ to concentrate political power in the hands of a few would be to: First, allow the wealthy to make unlimited, untraceable political contributions; Second, strike down the Voting Rights Act as unconstitutional as part of a broader strategy to disenfranchise the right wing’s opposition; and finally, make democracy so unworkable that a frustrated public chooses “authority to freedom” just as Lippmann predicted.

The rise of Hitler, as Lippmann points out, was fueled and facilitated by the German public’s frustration with a dysfunctional German parliament unable to govern because it had become a battleground between parties of the extreme left and right.

What’s been extraordinary in the recent stalemate over the sequester, however, is that the flight from democracy to dictatorship which Lippmann foretold if popular government proved incompetent to govern, has not been evident among the American people, who are standing solidly with the President.

Instead, it’s Washington’s political class who’ve blinked first, unnerved perhaps by the dysfunction of a political system they no longer understand nor control.

A good example is Ron Fournier, writer for the National Journal and former Washington Bureau Chief for the Associated Press, who says Obama makes a credible case that he has reached farther toward compromise than House Republicans. But, paraphrasing Bill Joel, Fournier nevertheless insists: “You may be right, Mr. President, but this is crazy.”

Even though the public sides with Obama and gives Republicans “pathetic approval ratings,” Fournier still blames Obama for the GOP’s stonewalling because “in any enterprise, the chief executive is ultimately accountable for success and failure.”

Even if Congress is factually to blame, Fournier says “there is only one president” and even “if he’s right on the merits, Obama may be on the wrong side of history. Fair or not, the president owns this mess.”

The impulse to let the bullies have their way also helps explain, I think, why Bob Woodward has made a fool of himself empowering Republican obstructionists as he, wrongly, accuses the President of “moving the goal posts” when Obama insists on the very same balanced package of deficit-cutting tax hikes and spending cuts the President has been pushing all along, ever since Republicans first pushed the nation to the brink of insolvency two years ago in an effort to win concessions on spending through extortion they could not win democratically at the ballot box.

As John Harwood writes in the New York Times, Republicans don’t seek to grind government to a halt so much as they aim “to shrink its size by an amount currently beyond their institutional power in Washington, or popular support in the country, to achieve.”

President Obama acknowledges that some entitlement cuts are needed to keep the programs solvent, says Harwood. He also based his reelection on the choice he gave voters for his smaller cuts combined with tax increases on affluent Americans versus the Republicans’ bigger ones without tax increases.

Americans chose Obama’s approach. Even surveys today show 50 percent of Americans approve of Obama’s job performance while only 29 percent expressed a positive view of the Republican Party, said Harwood. Among demographic groups, the only group that views Republicans more positively than negatively are white Southerners, and even then it was by just 39 percent to 35 percent.

“More than twice as many Americans credited Mr. Obama, as compared with Republicans, with emphasizing themes of bipartisan unity,” said Harwood.

Republicans today are trying to exercise powers that do not rightly belong to them, at least not democratically. So why are so many Beltway elites willing to let them?

It’s the nation’s political elites who seem to be abandoning democracy, not the masses, as they urge Obama to flex executive muscles he does not possess or surrender unconditionally to the non-negotiable demands of an ideological minority that knows it can’t win elections outright but also that the country can’t move forward without it just so long as its capacity for manufacturing crisis after crisis remains undiminished.

“Once Again Senators”: Obama Prosecutes Terrorist Suspect And The “Little Generals” Complain Again

Sulaiman Abu Ghaith, Osama bin Laden’s son-in-law and an al Qaeda spokesperson, appeared in a New York courtroom this morning, and pleaded not guilty to plotting to kill Americans. It was his first court appearance after having been captured on Feb. 28 and flown to New York last week.

Of course, there apparently has to be a political angle to the proceedings, and as Adam Serwer noted, several congressional Republicans are “furious” at the Obama administration for “prosecuting an alleged terrorist.” And why might that be? Because the GOP officials disapprove of the use of the federal court system.

Several Senate Republicans are slamming the administration’s to move its latest terror suspect through the federal court system, bypassing the military tribunals in Guantanamo Bay, Cuba. […]

“Military detention for enemy combatants has been the rule, not the exception. By processing terrorists like [Ghaith] through civilian courts, the administration risks missing important opportunities to gather intelligence to prevent future attacks and save lives,” according to a joint statement by Sens. Kelly Ayotte (R-N.H.), Lindsey Graham (R.S.C.) and John McCain (R-Ariz.).

Do we really have to explain this to Congress again?

Look, we have a very capable system of federal courts, which have tried and convicted plenty of terrorists. We have also have a terrific system of federal penitentiaries, which have a record of never, ever allowing a convicted terrorist to escape.

On the other hand, we also have a system of military commissions, which tend to be an ineffective setting for trying suspected terrorists. It’s why every modern presidential administration has relied on civilian courts for these kinds of trials. It’s why the Pentagon, Justice Department, and intelligence agencies are unanimous in their support for trying accused terrorists in civilian courts. It’s why folks like David Petraeus and Colin Powell — retired generals McCain, Graham, and Ayotte tend to take seriously — agree with the Obama administration and endorse Article III trials.

So why must Republicans rely on stale, misleading talking points?

“Routine Securities Taken For Granted”: Essential Government Tasks Need Reliable Funding

Here’s hoping that Stewart Parnell goes to prison.

The former president of the now-bankrupt Peanut Corp. of America, Parnell ran a filthy Georgia processing plant contaminated with salmonella that injured more than 600 people in a 2008-2009 outbreak, killing nine. Last month, federal prosecutors charged Parnell and three others with criminal offenses, claiming the executives intentionally shipped out contaminated peanut products.

It’s about time that white-collar criminals whose actions result in death or horrible injuries have to do the perp walk, just like the leeches who sell narcotics to kids. Former workers and federal inspectors say the plant, located in the small southeast Georgia town of Blakely, was a breeding ground for bacteria — with a leaky roof, dirty floors, mold on the ceiling and walls, and rats and roaches everywhere.

Still, it’s not enough to know that Parnell is finally going before the bar of justice. I also want a vigorous and assertive government that will help ensure that plants like Parnell’s Blakely facility won’t be free to operate in the future.

With President Obama battling Republicans over government spending, it’s easy to forget the important functions that federal agencies carry on every day. The Washington commentariat has concluded the agreement — known as “sequestration” — that produced shortsighted budget cuts hasn’t caused any harm to the majority of Americans, an indication, in that view, that Obama oversold the consequences of the cuts.

Is that true? The fact is we may never know how much harm will be done by those cuts. We don’t know how many children will miss their vaccinations, how many Head Start teachers will be laid off, or how many food inspections will be skipped.

The line between cause and effect is especially hard to draw in the work of those federal agencies whose jobs are aimed at prevention. The inspectors at the Food and Drug Administration have done their jobs well when you don’t hear of a food-borne illness or a faulty medical product. That sort of work is essential, but its results are hard to measure. And it never attracts public attention of the sort that ensures big budgets.

After the Blakely fiasco, Congress passed laws beefing up the powers given to the FDA. The agency used that new authority to shut down a New Mexico peanut processing plant that was implicated in a 2012 salmonella outbreak.

That decision came after the FDA, the Centers for Disease Control and Prevention (another federally funded agency) and state and local health departments tracked the outbreak to that specific plant, run by Sunland Inc. That outbreak sickened dozens.

I don’t know — and neither do you — whether the CDC will continue to have all the resources it needs to track deadly diseases with the across-the-board spending cuts dictated by GOP intransigence. I don’t know whether the Consumer Protection Agency will be able to track down all the lead-tinged toys coming in from China. I don’t know whether the FDA will be able to shut down the next Sunland before hundreds are hurt.

But I do know this: When I fix my 4-year-old a peanut-butter-and-jelly sandwich, I should not have to worry about whether she’ll get food poisoning. When you buy peanut butter crackers from a convenience store to placate your growling tummy on a road trip, you shouldn’t fear that eating them will send you to an emergency room.

Those are routine securities that we take for granted because we live in an affluent, developed nation with government regulations for food safety. However, those protections cost money. They don’t come free.

I’ve eaten in countries where there were no pesky government regulations keeping the milk pasteurized and the water free of parasites and the cooked meat free of harmful bacteria. I’ll take more government — with its higher costs — any day.
