Do Republicans Really Oppose Making Health Care Insurance Cheaper?

The health-care debate has a cyclical nature, and I don’t want to keep writing the same posts over and over again. So rather than write a whole new piece on the GOP’s rediscovery of the Congressional Budget Office’s estimate that the health-care law will reduce the labor supply (which they recast as “destroying jobs”), I’ll just link to the long post I did on the subject in January.

In case you don’t want to click over, though, the short version is this: If you make health-care insurance cheaper and make it harder for insurance companies to deny people coverage, then a certain number of people who would like to leave the labor force but can’t afford or access health-care insurance without their job will stop working.

To understand why, imagine a 62-year-old woman who works for IBM and beat breast cancer 10 years ago. She wants to retire. She has the money to retire. But no one will sell her health care under the status quo. Under the health-reform law, she can buy health care in an exchange because insurers can’t turn her away due to her history of breast cancer. So she’ll retire. Or imagine a 50-year-old single mother who wants to home-school her developmentally disabled child but can’t quit her job because they’ll lose health care. The subsidies and the protections in the Affordable Care Act will give her the option to stop working for awhile, while under the old system she’d need to stick with her job to keep her family’s health-care coverage. That’s how health-care reform can reduce the labor supply. If either case counts as a destroyed job, then so does my winning the lottery and moving to Scotland in search of the perfect glass of whiskey.

Moreover, this would happen for any health-care reform that reduced costs and improved access. So when Republicans say that they want a better health-care reform bill that does even more to reduce costs, they’re calling for legislation that, according to them, would “destroy” even more jobs than the Affordable Care Act. If they’re against all legislation that might destroy jobs in this way, then they’re against making health care cheaper. In fact, by that logic, we could just jack the price of health-care insurance up and make it easier for insurers to turn individuals away. Then even more people would have to stick with their employers. Job creation!

Ineffective and Unfair: Conservatives Target Preventive Health Care for the Ax

It seems we’ve entered the season of shortsighted thinking. With 50.7 million uninsured Americans, Republicans are on a rampage to repeal the Affordable Care Act. Adding insult to injury, the most recent House Republican plan to cut the federal budget deficit this fiscal year took a scalpel to $10 billion in federal grants that provide health care to indigent women and children, slashing $2 billion in federal funding that is bound to have very expensive consequences.

Funding for community health centers will be cut in half by the Republican cuts. Sen. Orrin Hatch (R-UT), who was a co-sponsor of the legislation responding to President George W. Bush’s call to expand funding for these centers in 2008, says that “since 2001, additional funding has allowed health centers in more than 750 communities nationwide to provide care to about four million new patients. These centers provide affordable and quality care to at-risk Americans who otherwise might have to do without.”

He’s right on the mark. No health care costs will be avoided by cutting this $1 billion out of the budget because the absence of care doesn’t stop you from getting sick. It simply means you get sicker and you turn up at the emergency room or a hospital when your illness has progressed to the point that your care needs are exorbitantly expensive.

On top of this cut to care, which more often than not is the safety-net care for women and children, the proposals would also cut the maternal and child health block grant by 30 percent. This block grant pays for child immunizations and prenatal care for tens of thousands of women and children. It’s obvious that without access to immunizations more will have to be spent to care for kids sick with easily preventable illnesses.

And reducing access to prenatal care is both life-threatening and costly. A preemie baby’s health care costs are 10 times higher than a full-term, healthy-weight child, according to the March of Dimes. The organization estimates that the full lifetime health care costs for these fragile children hit the $17 billion mark. It’s simply penny wise and pound foolish to cut $199 million out of a program that has a proven track record of delivering health to babies and driving down America’s health care costs.

Among the programs slashed is one of the most efficient programs to improve child nutrition: the Women, Infants and Children program run by the Department of Agriculture. This program gives expectant mothers with very small children important tips on how to feed their children healthy meals. And it provides them with coupons to incentivize them to purchase the best foods for their children. Research shows that without this intervention the nutritional intake of these children would be higher in fats, salts, and sugars, according to a recent U.S. Food and Nutrition Services study.

Instead of spending $1,400 a month in extra medical care for an obese child, for just $41 per month this program shifts these young mothers and children into healthy eating patterns, says the Centers for Disease Control and Prevention. Clearly, the WIC approach is a useful and relatively cheap way to stem the rising tide of childhood obesity.

An unsurprising but equally shortsighted cut is the complete elimination of family-planning services. If you just listened to their sound bites, you would think these funds could be used for abortions. But we all know that’s not permitted. These federal funds make it possible for uninsured women and men to get access to critical contraceptive services, pregnancy counseling, and tests for sexually transmitted infections, cervical cancer screening, and other critical health screens. Without access to these health care services, the health care needs of these adults will not disappear.

Instead, these adults will end up with unintended pregnancies and preventable health conditions that could have been avoided had they had ready access to commonplace family-planning services and screenings. Indeed, every dollar spent on family-planning services saves taxpayers $4 in Medicaid-funded prenatal, delivery, and postpartum services alone, according to a recent study by the Guttmacher Institute.

The absurdity of these cuts to the block grant, community health care centers, and family-planning services is that none of this funding would be necessary if we had a fully functioning national health care system where every American had access to high-quality care.

Benjamin Franklin famously said, “An ounce of prevention is worth a pound of cure.” Millions more Americans will lose access to health care as a result of these cuts and as a result more will have to be spent to address the real health care consequences of these cuts. Franklin also invented bifocals so his aging colleagues could see the important documents they gathered to draft. Perhaps the Republican leadership needs to adjust their glasses so they more clearly see that $2 billion in cuts they propose to the health care services for poor women and children will cost the taxpayers billions more in unnecessary health care expenses.

The Next Step for Egypt’s Opposition

When I was a young man in Cairo, we voiced our political views in whispers, if at all, and only to friends we could trust. We lived in an atmosphere of fear and repression. As far back as I can remember, I felt outrage as I witnessed the misery of Egyptians struggling to put food on the table, keep a roof over their heads and get medical care. I saw firsthand how poverty and repression can destroy values and crush dignity, self-worth and hope.

Half a century later, the freedoms of the Egyptian people remain largely denied. Egypt, the land of the Library of Alexandria, of a culture that contributed groundbreaking advances in mathematics, medicine and science, has fallen far behind. More than 40 percent of our people live on less than $2 per day. Nearly 30 percent are illiterate, and Egypt is on the list of failed states.

Under the three decades of Hosni Mubarak’s rule, Egyptian society has lived under a draconian “emergency law” that strips people of their most basic rights, including freedom of association and of assembly, and has imprisoned tens of thousands of political dissidents. While this Orwellian regime has been valued by some of Egypt’s Western allies as “stable,” providing, among other assets, a convenient location for rendition, it has been in reality a ticking bomb and a vehicle for radicalism.

But one aspect of Egyptian society has changed in recent years. Young Egyptians, gazing through the windows of the Internet, have gained a keener sense than many of their elders of the freedoms and opportunities they lack. They have found in social media a way to interact and share ideas, bypassing, in virtual space, the restrictions placed on physical freedom of assembly.

The world has witnessed their courage and determination in recent weeks, but democracy is not a cause that first occurred to them on Jan. 25. Propelled by a passionate belief in democratic ideals and the yearning for a better future, they have long been mobilizing and laying the groundwork for change that they view as inevitable.

The tipping point came with the Tunisian revolution, which sent a powerful psychological message: “Yes, we can.” These young leaders are the future of Egypt. They are too intelligent, too aware of what is at stake, too weary of promises long unfulfilled, to settle for anything less than the departure of the old regime. I am humbled by their bravery and resolve.

Many, particularly in the West, have bought the Mubarak regime’s fiction that a democratic Egypt will turn into chaos or a religious state, abrogate the fragile peace with Israel and become hostile to the West. But the people of Egypt — the grandmothers in veils who have dared to share Tahrir Square with army tanks, the jubilant young people who have risked their lives for their first taste of these new freedoms — are not so easily fooled.

The United States and its allies have spent the better part of the last decade, at a cost of hundreds of billions of dollars and countless lives, fighting wars to establish democracy in Iraq and Afghanistan. Now that the youth of Cairo, armed with nothing but Facebook and the power of their convictions, have drawn millions into the street to demand a true Egyptian democracy, it would be absurd to continue to tacitly endorse the rule of a regime that has lost its own people’s trust.

Egypt will not wait forever on this caricature of a leader we witnessed on television yesterday evening, deaf to the voice of the people, hanging on obsessively to power that is no longer his to keep.

What needs to happen instead is a peaceful and orderly transition of power, to channel the revolutionary fervor into concrete steps for a new Egypt based on freedom and social justice. The new leaders will have to guarantee the rights of all Egyptians. They will need to dissolve the current Parliament, no longer remotely representative of the people. They will also need to abolish the Constitution, which has become an instrument of repression, and replace it with a provisional Constitution, a three-person presidential council and a transitional government of national unity.

The presidential council should include a representative of the military, embodying the sharing of power needed to ensure continuity and stability during this critical transition. The job of the presidential council and the interim government during this period should be to set in motion the process that will turn Egypt into a free and democratic society. This includes drafting a democratic Constitution to be put to a referendum, and preparing for free and fair presidential and parliamentary elections within one year.

We are at the dawn of a new Egypt. A free and democratic society, at peace with itself and with its neighbors, will be a bulwark of stability in the Middle East and a worthy partner in the international community. The rebirth of Egypt represents the hope of a new era in which Arab society, Muslim culture and the Middle East are no longer viewed through the lens of war and radicalism, but as contributors to the forward march of humanity, modernized by advanced science and technology, enriched by our diversity of art and culture and united by shared universal values.

We have nothing to fear but the shadow of a repressive past.

Postcard From A Free Egypt

Circulating through the streets of Cairo tonight, with families packed into cars honking their horns in celebration and everyone strolling to Tahrir Square, I heard so many celebratory chants, but none more accurate and powerful in its simplicity than this one: “The people of Egypt made the regime step down.’’

The overwhelming sense of personal empowerment here, by a people so long kept down and underestimated by their own government was a sight to behold.

Tomorrow we can all talk about how hard this transition will be, how many pitfalls and uncertainties lie ahead for Egypt, but to be in Tahrir Square tonight, to feel the energy and pride of a people taking back the keys to their country and their future from a tired old dictator, was a privilege. As a group of men who had commandeered a horse and buggy bellowed as they crossed the Nile Bridge: “Hold your head up high. You are Egyptians.’’

My guess right now is that there are a lot of worried kings and autocrats tonight – from North Africa to Burma to Beijing. And it is not simply because a dictator has been brought down by his people. That has happened before. It is because the way it was done is so easy to emulate. What made this Egyptian democracy movement so powerful is its legitimacy.

It was started by youth and enabled by Facebook and Twitter. It was completely non-violent and only resorted to stone-throwing when faced with attacks by regime thugs. It drew on every segment of the Egyptian population. There was a huge flag in Tahrir Square today with a Muslim crescent moon and a Christian cross inside it. And most of all, it had no outside help.

In some ways, President Barack Obama did the Egyptian revolution a great favor by never fully endorsing it and never even getting his act together for how to deal with it. This meant in the end that Egyptians know they did this for themselves by themselves – with nothing but their own willpower, unity and creativity.

This was a total do-it-yourself revolution. This means that  anyone in the neighborhood can copy it by dialing 1-800-Tahrir Square. And that is why my favorite chant of all that I heard coming back from Tahrir tonight was directed at the leader next door, Muammar el-Qaddafi of Libya. It said, “We don’t leave Tahrir until Qadaffi leaves office.’’ Hello Tripoli, Cairo calling.

In many ways, what we have witnessed in Egypt today is the real decolonization of this country. That is, after the British left Egypt, the country was ruled by an incompetent king and then, since 1952, by a stifling, top-down military dictatorship. For the first time in modern history, “Egypt is truly in the hands of its own people,’’ remarked Egyptian political scientist Maamoun Fandy.

And the sense of liberation is profound, or as another sign in Tahrir said: “Mubarak, if you are Pharaoh, we are all Moses.’’

Egypt has always been the center of gravity of the Arab world and because it drifted these past 30 years, so too did the whole Arab world. One can only hope with this liberation that Egypt can now start to catch up with history and become a leading model for Arab development. If it does, others will follow. If it does, the Arab world will have two emotional hearts, not just one.

There will always be Mecca in Saudi Arabia, where Muslims will make the pilgrimage to be closer to God. And there will be Tahrir Square, where people will come to touch freedom. For that to happen, though, Egypt will have to take this freedom it just earned and run with it – to show that it really can improve the lives of an entire nation. That will not be easy, and it will not happen overnight.

This country has a lot of catching up to do. But if Egyptians show just half the creativity, solidarity and determination in the next year of nation-building that they showed in Tahrir Square these last 18 days, they just might pull this off.

Commerce Clause Challenges To Health Care Reform

Among the key points I make in defense of this federal law are:

1. The “commerce” in question is simply health insurance, and not the non-purchase of insurance as challengers have framed it.  Because “regulate” clearly allows both prohibitions and mandates of behavior, mandating purchase is lexically just as valid an application of the clause as is prohibiting purchase or mandating the sale of insurance.

2. Although existing precedent might allow a line to be drawn between economic activity and inactivity, there is no reason in principle or theory why such a line should be drawn in order to preserve state sovereignty.  Purchase mandates, after all, are as rare under state law as under federal law.

3. Challengers do not seriously dispute the constitutional validity of the ACA’s regulation of insurers or the economic necessity of the mandate in order for that regulation to be effective.  In fact, they essentially concede the mandate’s necessity by asking to strike the entire law if it is declared invalid.  Accordingly, the mandate would pass the tests for constitutional necessity articulated by at least seven of the Justices in the Comstock opinion last year, and might even pass the necessity test embraced by Justices Thomas and Scalia.

4. An important challenge, not yet clearly discussed by court opinions to date, is that the mandate does not, strictly speaking, simply “carry into execution” Congress’ other regulatory powers, but is the exercise of a distinct power.  However, both modern and historical precedents under the Necessary and Proper Clause are not limited narrowly to merely implementation measures.  Both Comstock and a series of decisions under the Postal Power are good examples to the contrary since they authorize independent federal powers that expand the range of purposes and measures permitted by express Congressional powers.

5. There is no coherent basis for declaring a purchase mandate to be constitutionally “improper,” and a categorical ban on regulating inactivity would contradict the implicit reasoning underlying several other established precedents — such as those upholding the draft and the Congressional subpoena power.   Also, federal eminent domain allows compelled transactions justified in part by the Necessary and Proper clause’s expansion of the commerce power, when applied, for instance, to citizen’s refusal to sell land for use in constructing highways, bridges, and canals.

6. Using the 10th Amendment to justify a categorical prohibition of purchase mandates (as Randy Barnett has argued) would be no more convincing than using the 9th or 5th Amendments (substantive due process).  Instead, such a move would, for the first time and contrary to precedent, make the 10th a protector of individual liberties rather than just federalism concerns, and would radically enforce an absolute right to economic liberty, regardless of level of legislative justification or judicial scrutiny (see point 9).

7. Slippery slope concerns are no greater here than for any other of a range of expansive federal powers.  Instead, the novelty of the mandate subjects it to greater political constraint, and so “parade of horribles” concerns may be even more unrealistic than similar settings where the Court has rejected them.

8. Grounding the mandate in the Necessary and Proper clause helps to confine its precedential effect by emphasizing it’s necessary role in the ACA’s particular regulatory scheme that, in other respects, clearly resides within the core of the conventional commerce power.  This essential supportive and interconnected role is not shared by free-standing mandates to purchase American cars or broccoli, for instance.

9. Counteracting imaginary slippery slope concerns about absurd hypothetical laws are the legitimate concerns about insurmountable barriers that a prohibition of purchase mandates would erect.  Forbidding Congress from any purchase mandate could cripple necessary efforts, for instance, to require preventive measures in the face of a massive pandemic that threatened tens of millions of lives.
