“Pay Close Attention!”: Don’t Be Fooled By New GOP Enthusiasm For Over-The-Counter Birth Control
The hot new trend among Republican candidates is a surprising one, to say the least. As of now there are four GOP Senate contenders who have endorsed making birth control pills available over the counter.
All four — Cory Gardner in Colorado, Thom Tillis in North Carolina, Ed Gillespie in Virginia, and Mike McFadden in Minnesota — oppose abortion rights, and all four oppose the Affordable Care Act’s mandate that insurance policies pay for preventative care, including birth control, with no deductibles or co-pays. Yet these conservative Republicans are touting their deep commitment to easily available birth control. It’s likely that more Republicans will now be asked their position on OTC birth control, and some will embrace it to counter Dem criticism that they’re soldiers in a “war on women.”
The one who has advocated OTC birth control pills most aggressively is Gardner, in large part because he has been the target of relentless criticism from Democrats over his prior support of “personhood” measures granting full legal status to fertilized eggs, which would outlaw not only abortion but some forms of birth control as well. Here’s an ad in which Gardner practically pretends to be Gloria Steinem while a group of women nod and smile their approval.
Democrats telegraphed way back in April that they would make these attacks central in multiple Senate races. The fact that Republicans have come up with this new push-back suggests the Dem attacks may have been working.
The new-found embrace of OTC birth control pills might seem odd, even bizarre. But it makes more sense if you think about it as a fundamentally elitist position. The truth is that conservatives have long been much more concerned with restricting the reproductive choices available to poor and middle class women, while leaving wealthy women free to do pretty much as they please. And allowing birth control pills to be sold over the counter is perfectly in line with that history.
Let’s be clear that making birth control pills available over the counter would be a good thing — but only if insurance continued to pay for it. The cost of the pill can be as much as $600 a year, which is out of reach for many women. And we know that insurance companies seldom reimburse customers for OTC medications. The price of the medication might come down over time if it were sold over the counter, but in the meantime millions of women are dependent on their insurance plans to be able to afford it. By opposing the ACA, all these GOP candidates are putting themselves on record in opposition to requiring insurance companies to pay for any birth control in policies women themselves have bought. And that’s not to mention other forms of contraception, like IUDs, that require a doctor’s care and come with a significant up-front cost.
If you’re well-off, you can afford whatever kind of contraception you like whether your insurance company reimburses for it or not. And abortion restrictions don’t impose much of a burden on you either. The federal government bans Medicaid from paying for abortions, but that only affects poor women. A law mandating a 48-hour waiting period before getting an abortion may be an inconvenience for a wealthy woman, but it can make it all but impossible for a woman without means. In some states, it means taking (unpaid) time off work to travel to one of the state’s few abortion clinics, driving hundreds of miles, and paying for a hotel room.
While they’re going to use a lot of buzzwords like “access” and “choice,” the net effect of the policies these candidates are advocating would be to make birth control less available to women. And I think that’s why we haven’t seen any public blowback from the Christian right on this issue. The articles written about the new Republican enthusiasm for OTC birth control sometimes include a disapproving quote from a representative of the Catholic Church. But none of the bevy of organizations with the word “Family” in their name, which are so vehemently opposed to any kind of reproductive freedom for women, are loudly condemning these candidates. Nor are any of their Republican colleagues. So what does that tell you?

“In Conflict With A Man’s Interests”: More Proof That The Religious Right’s “Family Values” Obsession Is Really About Misogyny
One of the great self-justifying myths of the conservatives is that their support for traditional gender roles is not rooted in misogyny, but in “family values.” They don’t hate women and want to keep them down, the argument goes, so much as they believe everyone–including women–benefits if women are relegated to a submissive role in marriage and prevented from exercising reproductive rights. They’re not trying to oppress women for the benefit of men, they argue. They’re trying to protect them.
It’s easy to uphold those “family values” when only women have to pay the price for them. But the real test is when the purported beliefs of the religious right conflict with what men want. Women are asked to sacrifice a lot in the name of family values, such as the right to leave unhappy marriages or the right to abort unwanted pregnancies. But are conservatives willing to ask the same of men? Two recent examples demonstrate that when family values conflict with a man’s interests, suddenly family values aren’t as important as the right generally says they are.
The case of former Virginia governor Bob McDonnell is a particularly stomach-churning example. Along with Rick Santorum and Mike Huckabee, Bob McDonnell was supposed to be one of the great Christian right politicians whose commitment to a fundamentalist view of family life would set an example for the rest of America. The Christian right argument regarding marriage, which Bob McDonnell laid out in his 1989 master’s thesis at the conservative Christian Regent University, is purportedly one of exchange: Women submit to their husbands, staying home to serve their husbands and raise children; and in exchange, men offer protection and cherish women to the point of coddling.
As Dahlia Lithwick explained on Slate, “The thesis was an argument for infusing Christian Republican values into government policy,” on the grounds that traditional marriage is “the best safeguard against immorality and selfishness.” In order to preserve this traditional definition of marriage, McDonnell expected women to sacrifice reproductive rights, independent thinking and employment outside of the home. McDonnell claimed his views had softened since then, but as Lithwick notes, his actual policy positions as a politician suggested otherwise. Not only did McDonnell fight against abortion rights, he also pushed to make divorce much harder to get in the state of Virginia. Even though stricter divorce laws usually serve to make it harder for women to escape abusive relationships, asking women to give up personal safety in the name of “family values” was clearly not too great a sacrifice for McDonnell.
But recent months have put McDonnell’s commitment to marriage and family to the test; he and his wife have been subject to a 14-count federal indictment for public corruption. As Dana Milbank noted, McDonnell was given an opportunity to protect his wife, as the family values set tells us husbands are supposed to do in exchange for women’s submission. But given the choice between protecting his wife by taking a plea deal and going to court, McDonnell chose himself over family values, heading to court. Indeed, McDonnell not only refused to protect the woman he vowed to love and protect, his defense is built around throwing his wife under the bus, blaming her for everything and employing some tawdry sexist stereotypes about women being crazy and weak to sell the argument.
Don’t get me wrong: There is a strong amount of evidence that Maureen McDonnell is corrupt and a terrible decision-maker, and she seems to be admitting she had a cheater’s heart that led her to push one of her husband’s benefactors for illegal gifts. But that changes nothing. McDonnell has dedicated his career to the idea that women should sacrifice everything for the good of “family,” including bodily autonomy and personal safety, but the second he’s called upon to take on the responsibility of a good Christian husband to protect his wife, he ran away and tried to foist as much as the blame as he could on her. Turns out family values wasn’t about men and women sacrificing together for family, just a cover story to excuse male dominance over women.
McDonnell’s corruption charges all came out after he was out of public office. In order to see how conservative voters act when one of their leaders puts the interests of straight men over their supposed commitment to family values, look no further than the state of Tennessee. Rep. Scott DesJarlais is running for his third term for Congress as a “family values” Republican, and his bona fides with conservative voters were proved again when he won a primary last week against another conservative challenger.
All this, despite the fact that DesJarlais has a long history showing that while he firmly believes women should have to lose their basic human rights in the name of family values, he, as a man, has never shown any interest in making even the teeniest sacrifice for those same values.
DesJarlais has a 0% rating from NARAL. He believes women who are facing an unwanted pregnancy that could derail their lives should suck it up and be made to suffer, you know, for “life.” But when faced with the prospect of an unintended pregnancy that could hurt him, he suddenly became a big fan of abortion. DesJarlais encouraged, some would say badgered, his mistress to get an abortion during his first marriage. He also supported his first wife’s abortions.
DesJarlais’ enthusiasm for abortions that helped him is hardly the only incidence of him exempting himself from the family values he wishes to impose on women. During his first marriage, he admitted to having eight affairs, some with patients. He also admitted under oath that he threatened his first wife with a gun. DesJarlais portrays these events as long past and argues he’s a different man now. But he still voted against the Violence Against Women Act, suggesting he has not actually developed any real concern about women’s safety in marriage since then.
Not that the voters mind enough to vote him out of office. If family values were actually about valuing families, voters would demand more of Republican leaders. But that someone as hypocritical as DesJarlais can still win elections shows that family values was never about families; just a transparent cover story for old-fashioned misogyny.

“Creating Two Different Nations”: The Deepening Divide Between Red And Blue America
Halbig v. Burwell, the case in which opponents of the Affordable Care Act won a dramatic if temporary victory yesterday, has profound implications for millions of Americans’ health care. But it’s also a demonstration of a trend that is determining more and more of what our politics and our country are going to look like in future years.
We talk a lot about America being divided ideologically, with liberals and conservatives increasingly distrustful and dismissive of each other. But we’re also in the process of creating two different nations, where stepping across a state border means entering a society with profoundly different laws and policy goals. And Republicans may have just stumbled on a way to use the federal government to increase that division.
Both parties are driving this broad movement. In many Republican-controlled states, it’s now all but impossible for a woman to get an abortion; people are encouraged by the state government to bring their guns to church and into bars; and taxes are whittled away while social services are slashed. Democrats too have gotten more aggressive in places they control, on issues like raising the minimum wage, same-sex marriage, and legalizing marijuana.
But the challenges to the ACA have shown the Republicans a new path, a kind of federalized federalism, where they can not only make Red America a more conservative place through state laws, but exempt Red America from federal laws they don’t like.
This wasn’t part of a carefully laid-out plan. Initially Republicans were just using any and every means they could find to undermine the ACA, with the goal of destroying it completely. Though they failed to do that, they won their first significant (if partial) victory when the Supreme Court ruled that states could opt out of the law’s expansion of Medicaid, which meant that we have two different countries when it comes to health coverage for poor people. If you’re poor and you live in a blue state or one of the few red states that has accepted the expansion, you can get free health insurance. If not, you’re out of luck. See, for instance, this vivid New York Times article about the city of Texarkana, which lies half in Texas and half in Arkansas; whether you get health insurance is determined by which side of town you live in.
In the Halbig case, conservatives located a drafting error and pursued it for no reason other than that it looked like a promising vehicle for Republican-appointed judges to strike a blow at the law. Creating two different countries when it comes to the ACA wasn’t really the goal, but it could be the outcome.
Let’s imagine the Supreme Court upheld the D.C. Circuit panel’s decision. In the states that have already established state exchanges, nothing would change. With a few exceptions (like Kentucky and Idaho) these are blue states. Everywhere else, people would immediately lose the tax credits they received to buy insurance, reverting to the pre-ACA status quo. That means more people without insurance, and a system that is generally more cruel and unforgiving. The states that are Democratic-controlled or divided but haven’t yet set up an exchange, like Pennsylvania, New Jersey, and Maine, would probably move to do so in order to restore those subsidies to their citizens. Once it all shook out, you’d have a situation in which, for all intents and purposes, the most consequential social legislation passed through Congress in nearly half a century was operative in only half the country.
If that were to happen (and maybe even if it doesn’t), Republicans are likely to see a new means to accomplish their policy goals on any number of issues. If you can’t repeal a federal law you don’t like, maybe you can have it apply only to Blue America. Get a few creative lawyers together, and you can come up with a rationale for a lawsuit to allow states to opt out of almost any law; few can deny now that no matter how thin the legal reed you hang such a suit on, there will always be conservative judges who will embrace your logic. We could see a proliferation of opt-out amendments in Congress, as each significant piece of legislation is accompanied by an effort to give Republican states the ability to exempt themselves.
And don’t be surprised if perpetually vulnerable red state Democrats end up supporting those amendments from time to time, so they can give their party the votes it needs to pass bills, but also tell the folks back home that they stood up for states’ rights.
In 1932, Justice Louis Brandeis wrote in a dissenting opinion:
It is one of the happy incidents of the federal system that a single courageous state may, if its citizens choose, serve as a laboratory; and try novel social and economic experiments without risk to the rest of the country.
But the assumption has always been that when states act as laboratories of democracy, they’re exploring different ways to arrive at common goals. Increasingly, liberals and conservatives can agree only on the most abstract goals, like prosperity and freedom, but on almost none of the specifics. With the ACA as an example, Washington could become the new laboratory of division, where federal legislation and federal lawsuits become the means to drive Red America and Blue America further apart.

“An Emboldened Anti-Choice Movement”: Republican Family Values Put Women’s Lives In Danger Worldwide
Last week, a committee in the US House of Representatives approved a spending bill that would slash funding for international family planning and reimpose a harmful policy that reduces contraceptive access and tramples on the rights of healthcare providers.
On Monday, the supreme court ruled that some US employers could deny employees access to birth control coverage if they claim a religious objection to contraception.
Is it just me, or do we seem to be in retreat? This latest disregard for women – in the US and overseas – is not unexpected, but it is certainly disappointing. In many ways, we have been fighting the same battle for the past 30 years. But the battle lines have shifted and, frequently, we have to struggle to retain hard-won ground.
When I started working on this issue in the early 80s, there was true, bipartisan support for family planning. Some of the most sincere anti-abortion Republicans realised that the consistent, commonsense public policy position for them to take would be to support overseas family planning funding. Better access to contraception would reduce unintended pregnancies and abortions, especially unsafe abortions.
The global gag rule, also known as the Mexico City Policy, was one of the first instances of the domestic anti-choice agenda interfering with the health and lives of women in developing countries. Introduced 30 years ago, during the Reagan administration, the policy bars foreign organisations that receive US family planning assistance from using their own private, non-US government funds to provide information, referrals, or services for legal abortion, or to advocate for the legalisation of abortion in their own countries.
Since it was introduced, the gag rule has been subject to the vagaries of US politics – imposed or kept in place by Republican presidents, and repealed by Democrat leaders. Though it was rescinded by President Obama on taking office in 2009, Republicans in the House have tried every year since to reinstate it.
Their efforts are testament to a rightward shift in US politics, including an emboldened anti-choice movement that has continued to gain political power. The middle has shrunk, the partisan divide has grown, and the Republicans being elected to Congress now are more extreme and bent on undermining women’s health and rights. Under the guise of “protecting the unborn”, the misguided policies they espouse threaten the health and lives of millions of women and families.
The US’s $610m contribution to international family planning and reproductive health in fiscal year 2014 helped 31 million women and couples receive contraceptive services and supplies. It prevented 7 million unintended pregnancies and 3 million abortions (2 million of them unsafe), and saved the lives of 13,000 women. In addition, 60,000 fewer children lost their mothers.
The fact is that family planning saves women’s lives. But in Washington these days, the facts do not matter. Last week Republicans on the House spending committee imposed a completely unnecessary cap on international family planning funding.
The House committee bill proposes cutting international family planning funding by $149m, almost 25% from current levels. Using analysis from the Guttmacher Institute, this would result in more than 7.7 million fewer couples using contraception, more than 1.6 million additional unintended pregnancies, and 745,000 more abortions. Almost 3,000 more women would die in pregnancy or childbirth, and 13,400 more children would lose their mothers. So much for family values.
We have been fortunate in that during the past few years, Republican attacks in the House have been blocked by Senate family planning champions, where, for now at least, Democrats retain control. This has essentially resulted in maintenance of the status quo on family planning policy and on funding. The Senate version of this year’s spending bill counters the House by including $644m for international family planning, and a permanent, legislative repeal of the global gag rule.
But this uneasy stalemate could change, depending on the outcomes in key races in November. If Republicans take control of the Senate, the truce will be broken and battle lines redrawn. The drastic cuts the House committee approved last week could be seriously considered in an omnibus spending bill, and an offensive could be mounted by opponents to attempt to force the gag rule on a pro-choice president.
The health of women around the world is far too important to continue to be thrust on to the frontline of US domestic culture wars.

“From Extreme To Extreme-Lite?”: “Religious Liberty” Campaign Not Working Out That Well
In the wake of a predictable GOP filibuster of a Senate bill seeking to reverse the Supreme Court’s Hobby Lobby decision, Republicans are publicly complaining that Democrats are trying to “change the subject” from this or that issue (real or imaginary) they want to talk about, but are privately conceding the peril for their team of any extended conversation involving reproductive rights. At National Journal Sophie Novack reports they’d just as soon not go there:
Republican strategists who were around for [Todd] Akin’s “legitimate rape” comment in 2012 warn candidates to tread carefully on the issue. The GOP’s continued meetings on how to connect with women show the party is still haunted by his loss, and members have denounced his return to the political scene with the release of his new book.
“The fact that the Supreme Court made the decision—Republicans should let that stand and not engage in the debate. It will get them nowhere and take them off the message of real issue Americans are concerned about,” said Ron Bonjean, a GOP strategist and former spokesman for House and Senate leadership. “I think Republicans saw what happened with Todd Akin—it was a stupid and bad campaign strategy. It would be political malpractice for Republicans to engage with that kind of conversation.”
This is another way of admitting that the effort begun in 2012 to reframe the GOP’s extremist position on reproductive rights as a defense of “religious liberty” hasn’t worked as well as party strategists had hoped. Indeed, by shifting the focus from abortion to “abortifacient” birth control, the “religious liberty”-driven attack on Obamacare’s contraception coverage mandate has actually increased opportunities for Republican pols to say things that sound stupid or crazy to a big percentage of the population.
Was Akin’s disastrous “legitimate rape” commentary really any farther from the mainstream than talk about IUDs being little Holocaust machines? Is there really any way to frame the unchanging extremist position on abortion (life begins when ovum fertilized; ban all abortions with no exceptions for rape or incest) most Republicans embrace in a way that doesn’t hurt the party with swing voters generally and single women in particular? I don’t think so. But I also think “don’t talk about it” demands like Bonjean’s will infuriate the antichoice activists who set the GOP’s position in the first place and convince them to demand even more demonstrations of loyalty.
