“Suppressing The Vote”: For The GOP, “Integrity Of The Ballot” Is A Deceptive Myth

Now that the U.S. Supreme Court’s hyper-conservative faction has neutered the Voting Rights Act, Republican officials around the country have re-energized their campaign to block citizens of color from voting.

Florida Gov. Rick Scott surprised no one last week when he announced that he would resume a controversial and clearly partisan purge of the voting rolls, supposedly to clear them of non-citizens. Nor is there any shock in the decisions by officials in Texas, Alabama and Mississippi to proceed with harsh new voter ID laws.

While Republicans contend the new laws and purges are necessary to protect the integrity of the ballot, that stale defense no longer merits extensive debate. It’s obvious that GOP activists have but one purpose in changing laws that affect voting and registration: putting up obstacles that might suppress the franchise among voters who usually support Democrats.

Actually, a few have admitted as much. Last year, Republican Mike Turzai, House majority leader in the Pennsylvania legislature, bragged about the passage of a strict new voter ID law, claiming it would “allow Gov. Romney to win the state of Pennsylvania.” Though Romney lost Pennsylvania on his way to overall defeat, the state’s GOP chairman still said earlier this year that voter ID “probably helped a bit” in cutting President Obama’s margin of victory from 2008.

A similar admission came from Republican campaign consultant Scott Tranter when he spoke at a post-election analysis hosted last December by the Pew Center on the States. He dismissed the idea of bipartisan cooperation to eliminate the long lines and other dismal conditions that had plagued voting in many areas.

“… At the end of the day, a lot of us are campaign professionals and we want to do everything we can to help our sides. Sometimes we think that’s voter ID, sometimes we think that’s longer lines, whatever it may be,” Tranter said.

Not that you needed those admissions to know that the GOP-led campaign to “protect the integrity of the ballot” is phony, the 21st-century version of the poll tax. Remember when Alan Wilson, South Carolina’s Republican attorney general, claimed last year that hundreds of dead people had voted in his state?

Ah, never happened. As you might expect, zombies have little interest in electoral politics. State authorities investigated and found no — zip, zero, zilch — zombie voters there.

Wilson made his claims in defense of a strict new voter ID law, one of the GOP’s more popular methods for suppressing the franchise. Supposedly, the requirement for showing state-sponsored identification, such as a driver’s license, would prohibit not only the dead but also other unworthies who claim to be legitimate voters. There is just one problem with that theory: Voter impersonation is virtually non-existent.

But voter ID laws do serve the purpose for which they are actually intended. They pose an obstacle for thousands of elderly and poor Americans who lack driver’s licenses, most of whom tend to support Democrats.

Florida, where Scott is proceeding with his purge, is a particularly interesting case. According to Florida Democratic strategist Steve Schale, the state has gained 1.5 million registered voters since 2006. Of those, 61 percent are blacks or Latinos, both strong constituencies for the Democratic Party. It’s no wonder, then, that Florida Republicans have worked so hard to block the franchise among those voters.

You may have noticed, though, that voter suppression hasn’t helped the GOP win presidential elections in the last two cycles. Indeed, their tactics may have given Obama the winning edge in Florida in 2012: Black voters were so angered by obvious attempts to discourage them from voting that they turned out in huge numbers, enduring long lines.

Given that reality, some conservatives believe the GOP should give up its emphasis on blocking the ballot. As The New York Times‘ Ross Douthat has written: “the GOP is … sending a message to African-Americans that their suspicions about conservatism are basically correct, and that rather than actually doing outreach to blacks, the right would rather not have them vote at all.”

Indeed, there is no reason for black voters to believe anything else.

“You Expect Me To Read The Bill?: NC Governor Admits He “Doesn’t Know Enough” About The Voter Suppression Bill He’s About To Sign

North Carolina Gov. Pat McCrory (R) said Friday he would sign a bill passed by the North Carolina legislature that would become the most suppressive voting law in the nation. But when asked to speak about a provision in the bill that would prohibit 17-year-olds from registering in advance of their 18th birthday, McCrory admitted he “did not know enough” and had not read that portion of the bill.

The bill, passed just weeks after the U.S. Supreme Court gutted the Voting Rights Act and paved the way for new suppressive state laws, imposes a laundry list of new restrictions on access to the ballot, including eliminating same-day registration, cutting early voting, easing campaign contribution limits, and expanding the mechanisms for alleging voter fraud. In remarks saying he would sign the bill, McCrory focused on his support for the bill’s voter ID requirement — a particularly suppressive and discriminatory policy that McCrory has long supported. But when asked by an Associated Press reporter about another provision in the bill to limit new voter registration opportunities, McCrory said, “I don’t know enough. I’m sorry. I haven’t read that portion of the bill.”

McCrory also dodged questions about two other elements of the bill that restrict early voting and end same-day registration, choosing instead to tout new campaign contribution limits, and pointing to an amendment — added by Democrats — that would expand early voting hours to make up for the limited early voting days.

When a reporter repeated the original question, McCrory said same-day registration concerns him because of the “possibility for abuse.” He added: “There’s plenty of opportunity for voter registration — online, off-line, through many methods. I thought that was a fair system before, and I think it’s a fair system now.” The Associated Press pointed out that North Carolina has no online voter registration, although voters can download a form online and print it out

In the wake of the U.S. Supreme Court’s June decision that effectively disables federal oversight of states with a history of voting discrimination, states have raced to pass new restrictive voting laws. On Thursday, Attorney General Eric Holder said he would challenge a voter ID law in Texas under another provision of the VRA not affected by the Supreme Court’s ruling. Holder hinted he would pursue similar actions against other states with restrictive laws, saying, “This is the department’s first action to protect voting rights [after the Supreme Court’s ruling]. … But it will not be our last.”

“Like Thieves Covering Their Tracks”: North Carolina Republicans Push Extreme Voter Suppression Measures

This week, the North Carolina legislature will almost certainly pass a strict new voter ID law that could disenfranchise 318,000 registered voters who don’t have the narrow forms of accepted state-issued ID. As if that wasn’t bad enough, the bill has since been amended by Republicans to include a slew of appalling voter suppression measures. They include cutting a week of early voting, ending same-day registration during the early voting period and making it easier for vigilante poll-watchers to challenge eligible voters. The bill is being debated this afternoon in the Senate Rules Committee. Here are the details, via North Carolina State Senator Josh Stein (D-Wake County):

If anyone had any doubt about the bill’s intent to suppress voters, all he/she has to do is read it. The bill now does the following:

*shortens early voting by 1 week,
*eliminates same day registration and provisional voting if at wrong precinct,
*prevents counties from offering voting on last Saturday before the election beyond 1 pm,
*prevents counties from extending poll hours by one hour on election day in extraordinary circumstances (like lengthy lines),
*eliminates state supported voter registration drives and preregistration for 16/17 year olds,
*repeals voter owned judicial elections and straight party voting,
*increases number of people who can challenge voters inside the precinct, and
*purges voter rolls more often.

Meanwhile, it floods the democratic process with more money. The bill makes it easier for outside groups to spend on electioneering and reduces disclosure of the sources. It also raises the contribution limits to $5k per person per election from $4k and indexes to amount to rise with inflation.

The bill even eliminates Citizens Awareness Month to encourage voter registration, notes Brent Laurenz, executive director of the nonpartisan North Carolina Center for Voter Education. Because God forbid we encourage people to vote! The proposed bill eliminates nearly all of the democratic advances that made North Carolina one of the most progressive Southern states when it comes to voting rights and one of the top fifteen states in voter turnout nationally, guaranteeing that there will be longer lines at the polls, less voter participation and much more voter confusion.

The legislation is likely to be deeply unpopular. For example, 56 percent of North Carolinians voted early during the 2012 election. Blacks used early voting at a higher rate than whites, comprising a majority of those who voted absentee or early. According to Public Policy Polling, 78 percent of North Carolinians support the current early voting system and 75 percent have used it in the past.

In addition, over 155,000 voters registered to vote and voted on the same day during the early voting period in 2012. “Voters expressed their satisfaction and gratitude that North Carolina had a process that afforded citizens with more opportunities to register and vote,” said a 2009 report from the state board of elections.

Republicans in North Carolina have taken abuse of the democratic process to a whole new extreme: they’ve won elections with the help of huge corporate money, they’ve gerrymandered the legislative maps to resegregate the state and drastically limit the representation of their political opponents, they’ve passed a slew of extreme right-wing bills in the past few months to benefit the top 1 percent and harm everyone else—and now they’re going all out to prevent those opposed to that political agenda from exercising their democratic rights. “There’s a certain evil symmetry to the proposal,” writes Rob Schofield, director of research for NC Policy Watch. “After having spent months passing scores of regressive and destructive proposals into law, state leaders are now, like thieves covering their tracks, doing everything in their power to make sure they’re not caught or punished for their actions.”

In the final depressing twist, North Carolina no longer has to clear these voting changes with the federal government, since the Supreme Court invalidated Section 4 of the Voting Rights Act. Nevertheless, it’s almost certain parts of the legislation—if enacted—will be challenged under the state constitution or other provisions of the VRA, and could very well spark a major backlash among North Carolina voters. In twelve weeks, more than 900 North Carolinians have been arrested for peaceful protest as part of the Moral Monday movement. Recently, Senate Rules Committee Chairman Tom Apodaca boasted that North Carolina would no longer have to go through the legal headache of complying with Section 5 of the VRA. Responded Rev. Barber of the North Carolina NAACP, “If you think you can take away our voting rights, you’ll have a headache.”

“One Nail In The Coffin”: Wisconsin Voters Reaffirm Election Day Registration

Voters in Madison and Milwaukee have reaffirmed the state’s Election Day registration law, with an overwhelming majority supporting the practice in two advisory referendums on Tuesday’s ballot. Allowing voters to register on Election Day has helped Wisconsin achieve one of the highest voter turnout rates in the country — but some state Republicans have proposed rolling back the state’s highly successful law.

Advocates say the vote on the advisory referendum sends a message to Wisconsin Governor Scott Walker and legislative leaders that election day registration works well and should be retained. Around 82 percent of voters in Dane County (where Madison is located) supported Election Day registration, and 73 percent of Milwaukee voters backed it.

The Milwaukee Common Council and Dane County Board added the advisory referendums to the April 2 ballot after Governor Walker indicated support for ending election day registration in November 2011, followed by other top Republicans, including Assembly Speaker Robin Vos. Students, people of color, and the poor are most likely to register on election day — largely because they are more likely to have moved since the last time they voted — and proposals to end Election Day registration were considered part of the larger GOP push to rig the voting process for partisan gain.

Pew Charitable Trusts recently ranked Wisconsin as one of the highest-performing states in the nation during the 2008 and 2010 election cycles, and praised the Dairy State for allowing voters to register at the polls on election day, which has helped Wisconsin achieve the second-highest voter turnout rate in the nation. The other seven states that allow Election Day registration also rank among those with the highest turnout in the country.

In 1975, Wisconsin was one of the first states in the country to allow voters to register on election day, and in recent years others have been catching on: last year, California and Connecticut passed Election Day registration (but the laws have not yet taken effect), and fourteen other states are considering similar proposals this year.

In February, Wisconsin’s Government Accountability Board estimated that ending Election Day registration could cost $14.5 million. Walker backed off his support for any measure that cost that much, but Speaker Vos questioned the cost estimate.

Tuesday’s referendum votes are non-binding, but voting rights advocates hope the measure will put the nail in the coffin for proposals to end Wisconsin’s Election Day registration.

“Virginia Is The New Florida”: New Voter Suppression Efforts Prove The Voting Rights Act Is Still Needed

In 2011 and 2012, 180 new voting restrictions were introduced in forty-one states. Ultimately, twenty-five laws and two executive actions were passed in nineteen states following the 2010 election to make it harder to vote. In many cases, these laws backfired on their Republican sponsors. The courts blocked ten of them, and young and minority voters—the prime target of the restrictions—formed a larger share of the electorate in 2012 than in 2008.

Despite the GOP’s avowal to reach out to new constituencies following the 2012 election, Republican state legislators have continued to support new voting restrictions in 2013. According to a report by Project Vote, fifty-five new voting restrictions have been introduced in thirty states so far this year. “The 2013 legislative season has once again brought an onslaught of bills to restrict access to the ballot, including proposals to undercut important election laws that have recently opened the electorate to more voters,” writes Erin Ferns Lee. These measures include “strict photo ID policies…voter registration restrictions; voter purges; [felon] disenfranchisement; and policies to cut back or revoke voting laws that have made voting more convenient.”

Here’s the breakdown of where such laws have been introduced.

Mandating a government-issued photo ID to cast a ballot: Arkansas, Connecticut, Iowa, Illinois, Massachusetts, Maryland, Missouri, Montana, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, Oklahoma, Virginia, Washington, West Virginia, Washington, Wyoming

Restricting voter registration drives: Illinois, Indiana, Montana, New Mexico, Virginia

Banning election-day voter registration: California, Minnesota, Montana, Nebraska

Requiring proof of citizenship to register to vote: Massachusetts, Missouri, Nevada, Oklahoma, Oregon, South Carolina, Texas, Virginia

Purging the voter rolls: Colorado, Indiana, New Mexico, Texas, Virginia

Reducing early voting: Arizona, Indiana, South Carolina, Texas, Wisconsin

Disenfranchising ex-felons: Virginia.

(On the plus side, thirty states have also introduced measures to make voting easier by adopting online voter registration, election-day registration, expanded early voting and the restoration of voting rights for ex-felons.)

Most of these measures are still pending before state legislatures, but Virginia, which has gubernatorial and legislative elections this year, is leading the way in enacting new voting restrictions. On January 21, 2013, as Virginia State Senator Henry Marsh, a longtime civil rights activist, attended President Obama’s second inauguration on Martin Luther King Day, the deadlocked Virginia Senate took advantage of Marsh’s absence to pass a new redistricting map that reduced Democratic seats by diluting black voting strength in at least eight districts. The measure was ultimately defeated in the Virginia House, but the move set the tone on voting rights for the legislative session.

On Tuesday morning, as the nation followed the debate over Proposition 8 at the Supreme Court, Virginia Governor Bob McDonnell signed a strict voter ID bill. In the last election, Virginians could vote by showing a number of different IDs, including a utility bill, a Social Security card or, this being the South, a concealed handgun permit. The new law restricts the forms of acceptable ID to a driver’s license, a passport, a state-issued photo ID card, a student ID with a photo on it or an employee photo ID. The Commonwealth Institute, a progressive research group, estimates that 869,000 registered voters in Virginia may lack these forms of photo ID, and says the new law will cost the state anywhere from $7 to $21 million to implement.

McDonnell’s spokesman called the photo ID law “a reasonable effort to protect the sanctity of our democratic process.” Yet the measure will likely only exacerbate the existing problems in Virginia’s election system, according to voting rights experts. In the last election, Virginia voters waited up to seven hours to cast a ballot. “Long lines across the state were a result of insufficient resources, poor allocation of resources that did exist, and frequent breakdowns of aging voting equipment,” according to a post-election report by the Election Protection coalition.

Moreover, study after study has shown that voter ID laws disproportionately impact young and minority voters. Not only are these constituencies less likely to have photo ID, but even in states without ID laws, black and Hispanic youth were significantly more likely than whites to be asked to show ID. According to a Politico write-up of a new report by political scientists at the University of Chicago and Washington University, “17.3 percent of black youth and 8.1 percent of Latino youth said their lack of adequate ID kept them from voting, compared with just 4.7 percent of white youth.” Mamie Locke, chairman of the Virginia Black Legislative Caucus, called the ID law “a continuation of attempts by Republicans to suppress the vote of individuals who are not likely to support their right wing agenda.”

Nor is voter fraud a rampant problem in Virginia, as supporters of the voter ID law suggest. There have been only thirty-five cases of alleged election fraud since 2000 in the state, according to an exhaustive survey by News21, and only five cases led to plea deals or convictions. Ironically, the one major case of election fraud in the state last year concerned a GOP firm charged with dumping voter registration forms.

Virginia must receive approval for its election change from the federal government under Section 5 of the Voting Rights Act. The new voting restrictions enacted in Virginia and introduced elsewhere across the country show why Section 5 is still very much needed. If anything, the statute should be expanded in light of contemporary voter suppression efforts, not eliminated.

Virginia is quickly becoming the new Florida when it comes to electoral dysfunction. Like Florida, Virginia also passed new laws this year to restrict voter registration drives and to purge the voter rolls of alleged non-citizen voters. In Florida, such measures forced groups like the League of Women Voters to halt voter registration efforts and wrongly labeled thousands of eligible voters as non-citizens. All of this is happening, coincidentally, in a crucial election year for the Commonwealth.

The continued push to restrict the right to vote reveals the extent to which conservative power remains deeply embedded in the states, thanks to the 2010 election and subsequent aggressive gerrymandering by GOP state legislatures to protect their majorities. To combat this imbalance, Howard Dean’s group Democracy For America is launching a new effort to flip state legislatures from red to blue. The group will start, fittingly, in Virginia this year, and then expand to Iowa, Michigan and Pennsylvania in 2014. DFA plans to spend $750,000 targeting five seats in the Virginia House of Delegates in 2013. Jamelle Bouie explains why this is savvy politics:

It’s hard to overstate how smart a way this is for liberal groups to invest their time and money. Virginia, in fact, is a great case study for why it’s key for Democrats to make gains on the state level. Democrats control both Senate seats in the state, and it was key to Barack Obama’s victories in 2008 and 2012. Despite this, Republicans control all three statewide offices (governor, lieutenant governor, and attorney general), the House of Delegates, and have the tie breaking vote in the state senate. The result? Republicans have been able to push a strong conservative agenda in the state.

With Congress deadlocked, the states are where the action is. It’s good that people are finally taking notice, especially as state politics continue to shift further to the right in many places.
