“The Die Is Cast”: The NYPD Is Running An Unethical Experiment On New Yorkers; Let’s See What Happens

Scientific knowledge sometimes isn’t worth the ethical cost. For example, when it was first suspected that smoking causes lung cancer, a strong way to test the theory would have been to take a bunch of babies, expose half to lots of cigarette smoke for decades, and see what happened. That would have resulted in valuable evidence but obviously would have come at too high an ethical cost.

The New York Police Department is apparently not moved by these sorts of considerations. Enraged by the murder of two police officers, which has been ludicrously blamed on Mayor Bill de Blasio, the city’s finest have been conducting a work slowdown in protest. (The official line is that there is no coordinated slowdown, but the numbers don’t lie.)

It’s unclear what the motivation is behind the slowdown. There are three possibilities. First, the NYPD hopes that reduced policing will spark a crime spree, leading the public to turn on de Blasio. Second, the force is cutting back on ticketing to hit the city government in the wallet. Or third, it is a visceral lashing out at a city that isn’t providing the unquestioning, worshipful deference the cops apparently think they deserve at all times.

None of these are mutually exclusive, of course. I’d put some weight on all three, with the bulk of it on the last one. In any case, it’s a seriously unethical experiment on the citizens of New York. How much policing does the city really need? We’re about to get an answer, whether we like it or not.

The New York Times has compiled some interesting data on the reduction in policing activity. Just about every category of law enforcement is down from this time last year. Subway policing has basically stopped altogether. Arrests and citations for minor offenses (parking tickets and the like) have fallen by 90 percent or more. Arrests for violent crime are down by a small amount and appear to be returning to normal. But only detective bureau arrests have returned to their previous level, after a sharp reduction last week.

It’s probably fair to say that after a week of genuinely risking public safety, the NYPD is beginning to think better of its rash behavior and is scaling back the slowdown on violent crime.

Still, crime of any kind barely budged, either last week or this week. This suggests that the NYPD is not the only thing standing between New York and a blighted dystopian hellscape.

It casts more serious doubt on the “Broken Windows” theory, beloved of police departments and city governments in New York and across the nation. This idea holds that the way to reduce serious crime is to crack down on minor offenses. For two weeks running, minor offenses have gone essentially unpunished. The result? Bupkis.

This is not dispositive proof, of course. There are dozens of potential confounding factors, and the situation is changing daily. In particular, two weeks may just be too short a time for crime to take root. But when it comes to policing, experiments of any kind are rare. Undoubtedly, experts will be sifting the resulting data in the ensuing months, and whatever conclusions they draw should get wide attention.

Finally, there’s the issue of government funding. New York City took in $890 million from fines and tickets in fiscal year 2014, out of an overall budget of $70 billion. That’s a fairly small fraction of the total, especially compared with the brutally oppressive little municipalities surrounding St. Louis that run mostly on fines. However, it’s still true that unnecessary fines are perhaps the worst of all possible sources of government revenue, since they tend to disproportionately come from heavily policed poor and minority communities. If these tickets aren’t actually necessary for public safety, or are just a way to extract money from those least able to defend themselves, then New York ought to be finding that money elsewhere.

No ethicist could have signed off on this experiment. But the die is cast. We might as well glean what lessons we can.

“Let’s Talk About ‘Black On Black’ Crime”: African-Americans Long Oppressed By What Might Be Called “America On Black” Crime

OK, fine. Let’s talk about “black on black” crime.

That, after all, is where the conversation seems to inevitably turn whenever one seeks to engage a conservative on the American habit of shooting unarmed African-American boys and men. So it was exasperating, but nowhere near surprising, to see former New York City mayor Rudy Giuliani go there last week on Meet the Press.

Asked by host Chuck Todd, during a discussion of the Michael Brown shooting in Ferguson, Missouri, about the fact that African-American communities like that one are often served by snow-white police departments, he offered some perfunctory words about the effort to produce more representative cop shops. But then Giuliani took a sharp turn off topic and into the brambles. “I find it very disappointing,” he told Todd, “that you’re not discussing the fact that 93 percent of blacks in America are killed by other blacks. … I would like to see the attention paid to that that you are paying to this.”

There followed a sharp exchange with another panelist, author and professor Michael Eric Dyson, which produced this parting shot from the mayor: “The white police officers wouldn’t be there if you weren’t killing each other.”

Somehow, he managed not to call Dyson “you people.” In nearly every other respect, Giuliani’s words reeked of a paternalistic white supremacy unworthy of a former mayor of America’s largest city — or even a sewer worker in its remotest Podunk. But again, this has become the go-to “reasoning” for those on the right — Sean Hannity, Lou Dobbs, Rush Limbaugh — when asked to give a d–n about the killings of unarmed black boys and men.

That formulation is false for multiple reasons.

In the first place, being concerned over the shooting of unarmed black men hardly precludes being concerned over violence within the African-American community. Giuliani and others suggest a dichotomy where none exists.

In the second place, they ignore the obvious: When black people commit crimes against black people, they face prosecution, but when police officers (or certain neighborhood watchmen) commit crimes against black people, they face getting off with little if any punishment.

In the third place, what exactly is “black on black” crime?

Do black people kill one another? Sure they do. Ninety percent of black murder victims are killed by black assailants.

But guess what? White people kill one another, too. Eighty-three percent of white victims are killed by white assailants. See, the vast majority of violent crime is committed within — not between — racial groups. Crime is a matter of proximity and opportunity. People victimize their own rather than drive across town to victimize somebody else.

So another term for “black on black” crime is “crime.”

But there is crime and there is crime.

Redlining, loan discrimination and predatory mortgages have stripped generations of wealth from the African-American community. What is that if not robbery?

The Republican Party practices policies of voter suppression. That’s the assault and battery of African-American political rights.

Mass incarceration criminalizes the very existence of black men and boys. That’s the rape of equal justice.

Unarmed people are killed by those who are purportedly there to protect and serve them and the “just us” system looks the other way. That’s the murder of basic human rights.

It is touching that Giuliani and others are so concerned about black-on-black crime. But African-Americans have also been long oppressed by what might be called “America on black” crime.

When do you suppose they’ll be ready to talk about that?

“What Does ‘Black-On-Black Crime’ Have to Do With Ferguson?”: The Issue Isn’t Us; It’s How White America Views Blackness

The answer to the question posed in this post’s title is nothing. Absolutely nothing. Not one thing. Nada. Zip. Zero.

The “Black-on-Black crime” moniker is racist rhetoric functioning under the guise of concern for the state of Black America. People of all races — Blacks included — seemingly love to discuss how not killing our own and being more respectable will alleviate the effects of racism.

It’s dangerous, however, to tell Black people to dress better, work harder or be respectable because it diverts attention from the gaze of the oppressor to the behavior of the disenfranchised. It showcases how deep anti-blackness runs within our society. This highly misinformed line of thinking negates the complex historical implications surrounding a white cop killing an unarmed Black teenager.

Authority has a long history of not respecting Black people so why some folks think becoming more respectable will solve anything is confusing. Our respect means nothing to those who see no value in Black life. They don’t care for or want our respect — they want our compliance. They want our submission.

“Black-on-Black crime” highlights the fear surrounding Black masculinity, the lack of Black femininity, and perceived inherent Black criminality. And, when Black people are shamed for committing the same crimes at almost the same rates as whites, it illustrates how much the white supremacist gaze has been internalized.

The term, which originated in the 1980s, cites Black people as a problem as opposed to poverty, poor educational opportunities, proximity and other factors that lead to increased crime rates within all communities — regardless of color.

Research conducted by David Wilson explains how the media picked up on a new wave of violence within Black communities — which was undoubtedly fueled by job loss, debased identity and “rampant physical decay”– and constructed the misperception that intraracial crime was a malady only plaguing Black America.

But racial exclusivity is apparent in the majority of violent crimes. Around 91 percent of Black victims are murdered by Black offenders while 83 percent of white victims are killed by another white person, based on the most recent FBI homicide statistics.

The “Black-on-Black” crime argument alludes that there’s nothing normal about Black intraracial crime. “White-on-white” violence is simply called crime. Why is Black intraracial violence depicted as some rare Pokémon in crime discussions when it is only slightly more prevalent?

Flawed white perception is not assuaged is these talks — Black behavior is, instead, attacked. This places Black folk in a “Catch 22.” No matter how “respectable” we are or become, as long as our skin is Black we will never amount to white standards though we are expected to be a reflection of them.

Respectability will never be a solution because the issue isn’t us; it’s how white America views blackness.

Mike Brown’s death, and the subsequent lack of justice, isn’t about the myth of “Black-on-Black crime.” It’s about how Blacks are disproportionately, and often unjustly, targeted by law enforcement. It’s about how systemic racism frames the way in which Black people, especially men, are viewed. It’s about how Black corpses are criminalized and put on trial but their white killers often go unindicted.

The circumstances surrounding Mike Brown’s death represent a much larger racially oppressive government and police structure that excuses white killers but refuses to humanize black victims due to the inherent guilt attributed to black people and blackness.

And when you tell Black people to be more respectable and not kill one another, you’re identifying us as savage brutes who deserve to be gunned down due to this assumed lack of humanity.

The protests in Ferguson do not show the supposed intrinsic animalistic nature of Black people. They showcase a community — and reflect a nation of people — tired of constantly being at the mercy of a justice system that sees no value in their livelihood.

Ferguson is illustrating what happens when people are fed up with being targeted. Ferguson is spearheading a movement. Stop detracting from that with baseless “Black-on-Black crime” discussions.

“Are Americans “Stupid” Or Uninformed?”: The Purpose Of The Media Is To Produce ‘Eyeballs’…For Advertisers

Republicans are making hay out of Jonathan Gruber’s suggestion that those who crafted Obamacare thought the American public was stupid. While that was a politically incorrect (and stupid) thing to say, we’ve all seen enough “man on the street” interviews where too many people don’t know which party controls Congress or who the current Vice President is to simply dismiss it as untrue.

But a more relevant question would be to ask whether or not the American public is “stupid” (inferring a lack of intelligence) or uninformed. That is the question sparked by this recent Gallup poll. They found that – while the violent crime rate has dropped dramatically since the early 1990’s (from 80 incidents of violent crime/1000 people to 23/1000), 63% of Americans think that violent crime is increasing.

Back in the 1990’s I attended a workshop on the effects of television on young people. The presenter asked the audience, “What is the purpose of television?” After a lot of responses that focused on entertainment, the presenter said that the purpose was to produce eyeballs…for advertisers. I would suggest that the same thing is now true of our news media. The perception of an increase in violent crime is likely a direct result of the old adage: “if it bleeds, it leads.”

Media Matters recently produced a report showing that both cable and network news reporting on Ebola spiked in the days leading up to the 2014 midterms and then simply went to almost nothing afterwards. I don’t buy the idea that this was some collusion between the media and Republicans. I suspect it had more to do with the way that fear of the disease spreading grabbed everyone’s attention, and then a total elimination of coverage once it was clear that wasn’t going to happen (at least not in this country). In other words, success at containing the spread of Ebola doesn’t produce eyeballs.

Circling back to the subject of Obamacare, its interesting to note the effect all this has on the perceptions of the public.

Jon Krosnick, Wendy Gross, and colleagues at Stanford and Kaiser ran large surveys to measure public understanding of the ACA and how it was associated with approval of the law. They found that accurate knowledge about what’s in the bill varied with party identification: Democrats understood the most and liked the law the most, independents less, and Republicans understood still less and liked the law the least. However, attitudes were not just tribal. Within each party, the more accurate your knowledge of the law, the more you liked it.

These researchers found that in the unlikely event that the public had a perfect understanding of the law, approval of it would go from 32% to 70%. That’s the price we pay for an uninformed public.

Its true that technology has allowed partisans and ideologues to choose media sources that confirm their beliefs. But those who simply want “the news” are pretty regularly fed a diet that inflames more than it informs. If you doubt that, take a look at one retired anchorman’s reaction to the movie “Anchorman.”

If we want this to change, we’ll need everyone to think twice about what they do with their eyeballs.

“Why Even Pretend?”: There’s No Humane Way To Carry Out The Death Penalty

No one who supports the death penalty should have the slightest problem with the way Clayton Lockett died.

Lockett, a convicted murderer, spent 43 minutes in apparent agony Tuesday night as the state of Oklahoma tried to execute him by injecting an untested cocktail of drugs. Instead of quickly losing consciousness, he writhed in obvious distress and attempted to speak. Witnesses described what they saw as horrific.

Prison authorities halted the procedure — they were going to revive Lockett so they could kill him at a later date, presumably in a more aesthetically pleasing manner — but the condemned man suffered a heart attack and died.

The state postponed a second execution that had been scheduled for the same night, but I wonder why. We fool ourselves if we think there is a “humane” way to way to kill someone. Sure, the second inmate, Charles Warner, probably would have suffered an equally agonizing death. But isn’t this the whole point?

When I read about the crimes Lockett committed, I wish I could support capital punishment. When I read about what Warner did, I want to strangle him with my own hands. But revenge is not the same thing as justice, and karmic retribution is not a power I trust government to exercise. The death penalty has no place in a civilized society.

Lockett raped, brutalized and murdered a 19-year-old woman who had graduated from high school just two weeks earlier, shooting her and then burying her alive. Lockett and his accomplices also beat and robbed a 23-year-old man and raped an 18-year-old woman. The crimes took place in 1999; Lockett has been awaiting execution since 2000.

Warner, the other man who was to die in the Oklahoma execution chamber Tuesday, was convicted in 1999 of raping and murdering an 11-month-old child who was the daughter of his live-in girlfriend. The baby suffered unspeakable abuse.

The question is not whether Lockett and Warner deserve to die; clearly they do, as far as I’m concerned. The question is whether our society, acting through the instrument of government, should kill them. I believe there is no way to impose capital punishment without betraying the moral standards that our justice system is theoretically designed to uphold. Put simply, when we murder we become murderers.

Perhaps the most powerful argument against the death penalty is that it is irreversible. Sometimes, judges and juries make honest mistakes and innocent people may be condemned to death. Some studies have shown an apparent racial bias in the way capital punishment is meted out, with blacks who kill whites more likely than other defendants to end up on death row.

Put all this aside for the moment and assume that both Lockett and Warner committed those heinous crimes and that each was convicted in a scrupulously fair trial. The judgment of the state of Oklahoma is that both men must die. How, then, are they to be killed?

What about a public beheading, like in Saudi Arabia? No one would seriously suggest such a thing. Yet a razor-sharp sword surely would have been less agonizing — or at least much quicker — than the drugs injected into Lockett’s bloodstream.

The general idea of lethal injection is to give the condemned a powerful sedative followed by one or more lethal agents. But the sole manufacturer of one of the commonly used drugs stopped making it in 2011. Drug makers in Europe, where the death penalty is considered barbaric, refuse to export drugs to the United States for use in executions. As a result, there have been shortages. Oklahoma was using a new, unproven cocktail to kill Lockett.

Reportedly, Lockett’s vein “blew” shortly after the execution began, meaning that he was not getting the full doses. But his was hardly the first lethal injection execution in which the condemned showed visible signs of great pain.

I would argue that there’s no reason to believe lethal injection is a more humane way to end a life than electrocution, poison gas, hanging, firing squad or even guillotine. Of course, we’ll never know. We can tell ourselves any story we want about how quickly and painlessly death arrived, and the one person who could prove us wrong will never speak again.

But why even pretend? Clayton Lockett was a bad man. Those who believe it was right to kill him have no reason to be ashamed of the way he died — and no right to look away.
