“A Criminal Regime Of Terror”: A Negotiated Solution In Syria Starts With Congress’ Approval To Attack
A vote by Congress to reject the resolution sought by President Barack Obama to authorize military force in Syria will add to the long list of unintended consequences already produced by bad policy choices on Syria. Among other things, it will kill for the foreseeable future any prospect of a negotiated end to this gruesome, destabilizing, and dangerous conflict. Indeed, the eleventh-hour suggestion by Russia that Syria might put its chemical stockpile under international supervision aims to kill the president’s prospects by offering Congress the alternative of a lengthy, open-ended, and likely inconclusive process, one that would leave Bashar al-Assad’s regime free to return to business as usual: slaughtering civilians in their homes with conventional weaponry.
Let us first stipulate some hard, unpleasant truths. A large majority of Americans either doesn’t care about Syria, thinks the United States has no business doing anything about it, or both. Many in Congress normally inclined to support Obama think that he, of all people, may lead us into armed conflict resembling Iraq or worse. Others in Congress would gladly sink, or at least capsize, the ship of state (at least in terms of the country’s reputation and credibility) as long as Obama is on board. These are the facts the president faces as he tries to make a case for a resolution he need not have put before the Congress in the first place.
As if popular and Congressional apathy over the depredations of the Assad regime were not enough, the president hit a wall of indifference at the G20 gathering in St. Petersburg as well. In addition to the usual defense of the indefensible one would expect from Russian President Vladimir Putin, and the customary “let’s not further militarize this regrettable situation” from others, Obama was forced to endure “let’s have negotiations instead of violence” advice from Pope Francis and United Nations Secretary-General Ban Ki-moon.
Neither the Holy Father nor the Secretary-General was able to identify a way forward to peace talks. This is understandable, because under current conditions none exists. So long as the Assad regime’s strategy of choice remains one of mass terror aimed at populated areas it does not occupy, there is no prospect of dialogue, negotiation, compromise, reconciliation, reason, or peace. This was recognized in late 2011 by former Secretary-General Kofi Annan, who begged the Assad regime to take the initiative in implementing a ceasefire and a series of humanitarian steps. The regime’s latest answer to Annan, Ban, and Lakhdar Brahimi, the UN–Arab League envoy for Syria, was the chemical abomination of August 21.
Obama recognizes, at long last, that a criminal regime endowed with artillery, aircraft, rockets, and missiles will use those delivery systems to visit random death, widespread destruction, and universal terror on innocent civilians. It does so with conventional ordnance that kills and maims with high explosives. It does so with chemical munitions that strangle and smother. It drives millions from their homes, many into neighboring countries. It scars for life, physically and emotionally, those it does not kill outright. So long as this campaign of mass terror continues, it will make it impossible for anyone purporting to represent the opponents of this regime to take part in anything labeled a negotiation. So long as it continues, it is as solid an indicator as one could want that the regime has no interest in negotiating a blessed thing.
Ban, the Pope, and others who earnestly seek peace in Syria are not unaware of the foregoing. They hope, as does Obama, that some combination of Putin and Iran’s Supreme Leader Ali Khamenei will prevail on Assad to knock it off: to spare the innocent and give peace a chance. Indeed, Russia and Iran are free to do so, and by so doing make a U.S. military operation unnecessary and unthinkable. Yet as long as they enable the war crimes and crimes against humanity of the Assad regime, can Obama be faulted if he opts, with Congress’ permission, to neutralize the regime’s tools of terror—its artillery, rockets, missiles, and aircraft?
Contrary to prevailing opinion in the West, the Assad regime and its enablers do indeed think there is a military solution to the Syrian crisis. If Congress denies Obama the option of neutralizing Assad’s tools of terror, it will confirm the view of Assad and his supporters. It will do so by keeping the mass terror machine untouched and in business. For all we know Assad may have already learned his lesson about chemicals. No doubt Tehran and Moscow are mystified by their client’s stupidity. Yet if he returns to the practice of pounding populated areas with vicious impunity, no one should expect Western passivity to produce a negotiated solution to anything.
Russia and Iran should convince Assad to declare a ceasefire, invite UN observers, implement Annan’s humanitarian, de-escalatory steps, and prepare for Geneva. The chances of them doing so are low. They, and any sense of restraint by Assad, sink to zero if and when Congress turns down the president. If there are those in Congress sincerely interested in a negotiated end to Syria’s nightmare, one that can begin to stabilize the region soon instead of decades from now, they will give Obama the authorization he seeks.

“I Don’t See Anything”: Pulling The Curtain Back On Syria
When I was a law student in 1982, I escaped torts by backpacking through Syria and taking a public bus to Hama, where the government had suppressed a rebellion by massacring some 20,000 people.
The center of Hama was pulverized into a vast field of rubble interspersed with bits of clothing, yet on the fringe of it stood, astonishingly, a tourism office. The two Syrian officials inside, thrilled to see an apparent tourist, weighed me down with leaflets about sightseeing in Hama and its ancient water wheels. After a bit of small talk, I pointed out the window at the moonscape and asked what had happened.
They peered out at the endless gravel pit.
“Huh?” one said nervously. “I don’t see anything.”
It feels to me a bit as if much of the world is reacting the same way today. The scale of the slaughter may be five times that of 1982, but few are interested in facing up to what is unfolding today out our window in Hama, Homs, Damascus and Aleppo.
As one woman tweeted to me: “We simply cannot stop every injustice in the world by using military weapons.”
Fair enough. But let’s be clear that this is not “every injustice”: On top of the 100,000-plus already killed in Syria, another 5,000 are being slaughtered monthly, according to the United Nations. Remember the Boston Massacre of 1770 from our history books, in which five people were killed? Syria loses that many people every 45 minutes on average, around the clock.
The rate of killing is accelerating. In the first year, 2011, there were fewer than 5,000 deaths. As of July 2012, there were still “only” 10,000, and the number has since soared tenfold.
A year ago, by United Nations calculations, there were 230,000 Syrian refugees. Now there are two million.
In other words, while there are many injustices around the world, from Darfur to eastern Congo, take it from one who has covered most of them: Syria is today the world capital of human suffering.
Skeptics are right about the drawbacks of getting involved, including the risk of retaliation. Yet let’s acknowledge that the alternative is, in effect, to acquiesce as the slaughter in Syria reaches perhaps the hundreds of thousands or more.
But what about the United Nations? How about a multilateral solution involving the Arab League? How about peace talks? What about an International Criminal Court prosecution?
All this sounds fine in theory, but Russia blocks progress in the United Nations. We’ve tried multilateral approaches, and Syrian leaders won’t negotiate a peace deal as long as they feel they’re winning on the ground. One risk of bringing in the International Criminal Court is that President Bashar al-Assad would be more wary of stepping down. The United Nations can’t stop the killing in Syria any more than in Darfur or Kosovo. As President Assad himself noted in 2009, “There is no substitute for the United States.”
So while neither intervention nor paralysis is appealing, that’s pretty much the menu. That’s why I favor a limited cruise missile strike against Syrian military targets (as well as the arming of moderate rebels). As I see it, there are several benefits: Such a strike may well deter Syria’s army from using chemical weapons again, probably can degrade the ability of the army to use chemical munitions and bomb civilian areas, can reinforce the global norm against chemical weapons, and — a more remote prospect — may slightly increase the pressure on the Assad regime to work out a peace deal.
If you’re thinking, “Those are incremental, speculative and highly uncertain gains,” well, you’re right. Syria will be bloody whatever we do.
Mine is a minority view. After the Afghanistan and Iraq wars, the West is bone weary and has little interest in atrocities unfolding in Syria or anywhere else. Opposition to missile strikes is one of the few issues that ordinary Democrats and Republicans agree on.
“So we’re bombing Syria because Syria is bombing Syria?” Sarah Palin wrote, in a rare comment that liberals might endorse. Her suggestion: “Let Allah sort it out.”
More broadly, pollsters are detecting a rise in isolationism. The proportion of Americans who say that “the U.S. should mind its own business internationally” has been at a historic high in recent years.
A Pew survey this year asked voters to rate 19 government expenses, and the top two choices for budget cuts were “aid to the world’s needy” and the State Department. (In fact, 0.5 percent of the budget goes to the world’s needy, and, until recently, the military had more musicians in its bands than the State Department had diplomats.)
When history looks back on this moment, will it view those who opposed intervening as champions of peace? Or, when the textbooks count the dead children, and the international norms broken with impunity, will our descendants puzzle that we took pride in retreating into passivity during this slaughter?
Isn’t this a bit like the idealists who embraced the Kellogg-Briand Pact that banned war 85 years ago? Sure, that made people feel good. But it may also have encouraged the appeasement that ultimately cost lives in World War II.
O.K., so I’ve just added fuel to the battle for analogies. For now, the one that has caught on is Iraq in 2003. But considering that no one is contemplating boots on the ground, a more relevant analogy in Iraq may be the 1998 Operation Desert Fox bombing of Iraqi military sites by President Bill Clinton. It lasted a few days, and some say it was a factor in leading Iraq to give up W.M.D. programs; others disagree.
THAT murkiness is not surprising. To me, the lessons of history in this area are complex and conflicting, offering no neat formula to reach peace or alleviate war. In most cases, diplomacy works best. But not always. When Yugoslavia was collapsing into civil war in the early 1990s, early efforts at multilateral diplomacy delayed firm action and led to a higher body count.
Some military interventions, as in Sierra Leone, Bosnia and Kosovo, have worked well. Others, such as Iraq in 2003, worked very badly. Still others, such as Libya, had mixed results. Afghanistan and Somalia were promising at first but then evolved badly.
So, having said that analogies aren’t necessarily helpful, let me leave you with a final provocation.
If we were fighting against an incomparably harsher dictator using chemical weapons on our own neighborhoods, and dropping napalm-like substances on our children’s schools, would we regard other countries as “pro-peace” if they sat on the fence as our dead piled up?

“The Right Questions On Syria”: Are The Risks Greater If We Launch Missles Or If We Continue To Sit On Our Hands?
Critics of American military action in Syria are right to point out all the risks and uncertainties of missile strikes, and they have American public opinion on their side.
But for those of you who oppose cruise missile strikes, what alternative do you favor?
It’s all very well to urge the United Nations and Arab League to do more, but that means that Syrians will continue to be killed at a rate of 5,000 every month. Involving the International Criminal Court sounds wonderful but would make it more difficult to hammer out a peace deal in which President Bashar al-Assad steps down. So what do you propose other than that we wag our fingers as a government uses chemical weapons on its own people?
So far, we’ve tried peaceful acquiescence, and it hasn’t worked very well. The longer the war drags on in Syria, the more Al Qaeda elements gain strength, the more Lebanon and Jordan are destabilized, and the more people die. It’s admirable to insist on purely peaceful interventions, but let’s acknowledge that the likely upshot is that we sit by as perhaps another 60,000 Syrians are killed over the next year.A decade ago, I was aghast that so many liberals were backing the Iraq war. Today, I’m dismayed that so many liberals, disillusioned by Iraq, seem willing to let an average of 165 Syrians be killed daily rather than contemplate missile strikes that just might, at the margins, make a modest difference.
The Syrian Observatory for Human Rights, which tracks the number of dead in the civil war, is exasperated at Western doves who think they are taking a moral stance.
“Where have these people been the past two years,” the organization asks on its Web site. “What is emerging in the United States and United Kingdom now is a movement that is anti-war in form but pro-war in essence.”
In other words, how is being “pro-peace” in this case much different in effect from being “pro-Assad” and resigning oneself to the continued slaughter of civilians?
To me, the central question isn’t, “What are the risks of cruise missile strikes on Syria?” I grant that those risks are considerable, from errant missiles to Hezbollah retaliation. It’s this: “Are the risks greater if we launch missiles, or if we continue to sit on our hands?”
Let’s be humble enough to acknowledge that we can’t be sure of the answer and that Syria will be bloody whatever we do. We Americans are often so self-absorbed as to think that what happens in Syria depends on us; in fact, it overwhelmingly depends on Syrians.
Yet on balance, while I applaud the general reluctance to reach for the military toolbox, it seems to me that, in this case, the humanitarian and strategic risks of inaction are greater. We’re on a trajectory that leads to accelerating casualties, increasing regional instability, growing strength of Al Qaeda forces, and more chemical weapons usage.
Will a few days of cruise missile strikes make a difference? I received a mass e-mail from a women’s group I admire, V-Day, calling on people to oppose military intervention because “such an action would simply bring about more violence and suffering. … Experience shows us that military interventions harm innocent women, men and children.”
Really? Sure, sometimes they do, as in Iraq. But in both Bosnia and Kosovo, military intervention saved lives. The same was true in Mali and Sierra Leone. The truth is that there’s no glib or simple lesson from the past. We need to struggle, case by case, for an approach that fits each situation.
In Syria, it seems to me that cruise missile strikes might make a modest difference, by deterring further deployment of chemical weapons. Sarin nerve gas is of such limited usefulness to the Syrian army that it has taken two years to use it in a major way, and it’s plausible that we can deter Syria’s generals from employing it again if the price is high.
The Syrian government has also lately had the upper hand in fighting, and airstrikes might make it more willing to negotiate toward a peace deal to end the war. I wouldn’t bet on it, but, in Bosnia, airstrikes helped lead to the Dayton peace accord.
Missile strikes on Assad’s military airports might also degrade his ability to slaughter civilians. With fewer fighter aircraft, he may be less able to drop a napalmlike substance on a school, as his forces apparently did in Aleppo last month.
A brave BBC television crew filmed the burn victims, with clothes burned and skin peeling off their bodies, and interviewed an outraged witness who asked those opposed to military action: “You are calling for peace. What kind of peace are you calling for? Don’t you see this?”

“A Progressive Perspective”: Congress Should Approve The President’s Request To Punish The Use Of Chemical Weapons
I began my work in politics and the Progressive Movement working for civil rights and the end of the Viet Nam War in the 1960’s. And I worked hard to end one of the greatest foreign policy outrages of my lifetime – the War in Iraq.
I believe that U.S. military and covert actions to support the status quo in Central and South America, Africa and Asia were utterly indefensible.
But I also believe that there are times when the use of military force is not only justified – but required.
Bashar al Assad cannot be allowed to use chemical weapons to kill 1,400 people – over 400 children – in the plain site of the entire world – with impunity. It’s that simple.
Since the end of World War I – almost a century ago – there has been a worldwide consensus that human society will not allow combatants in conflicts to use chemical or biological weapons. After World War II, nuclear weapons were added to the list.
These true weapons of mass destruction present a danger far beyond their effects on the immediate combatants – or even the innocent bystanders – of a particular conflict. If the world allows and thereby legitimates their use, it will unleash forces that could endanger huge swaths of human society – and even the existence of humanity itself.
While chemical weapons cannot do damage as extensive as nuclear or radiological weapons – they have the potential of killing and maiming tens of thousands of our fellow human beings within hours or minutes. And their horrific effects have been graphically demonstrated in real time on the television screens of the world documenting Assad’s attacks on innocent civilians.
Sometime in the last century, human society entered a gauntlet. As we pass through that gauntlet, a race is on to determine whether our values and political structures evolve fast enough to keep up with the geometric increases in our technology? If they do, technology could propel human beings into an awesome and unprecedented period of freedom, possibility and fulfillment. If not, we could destroy ourselves and turn into an evolutionary dead end – like our cousins the Neanderthals.
To survive that gauntlet, it is critically important that we do everything in our power to absolutely ban the use of weapons of mass destruction – and to make those who violate that ban into worldwide pariahs. We must make their use unthinkable.
In political and historic narratives – some moments take on an iconic, symbolic importance. Assad’s use of chemical weapons is now one of them. Will the world stand idly by while we watch – up close and personal – as a government uses chemical weapons with impunity? Or will someone take action to require that the perpetrators of this crime be made to pay a price?
Most people in the world wish that someone had stepped up to stop the horrific genocide in Rwanda. Most now believe President Clinton and NATO did the right thing to prevent ethnic cleansing in Kosovo.
History will judge us harshly, if we stand by idly, and legitimate the use of chemical weapons – and weapons of mass destruction in general – by allowing their use in the view of the full world to go unpunished.
And let’s be clear. We’re not debating who has the right to possess these weapons – or to possess nuclear weapons and other weapons of mass destruction here — a major topic of political debate in the world for the last decade. We are talking about their actual use.
If we agree that we cannot allow that actual use to occur with utter impunity, then the only question remaining is – who will act to impose a serious sanction?
Unfortunately the United Nations has not yet evolved into an institution that has the ability to escape gridlock if one of the world’s major powers stands in the way. It will not act. Russia and China will prevent it.
So as a practical matter, if the United States does not lead some sort of international action to do so, it will not happen.
Of course the legacy of the War in Iraq casts a giant shadow on this showdown over chemical weapons in Syria. Its legacy casts doubt on the accuracy of American intelligence, and causes everyday Americans to be very reluctant to support any use of force in the world.
But this is not Iraq. The President is not asking for authorization to go to war – or to become engaged in the Syrian Civil War. He is not proposing – as Bush proposed in Iraq – an American military invasion. He is not proposing a campaign of “regime change” or “nation building.” America’s decision will surely have implications for the Syrian Civil War, but this decision is not even mainly about the Syrian Civil War. It is mainly about the use of chemical weapons.
The President is proposing that the Congress authorize him to take action in this very narrow circumstance. He is proposing that the world community demonstrate that if someone uses chemical weapons, there will be a substantial cost to that action – that we do not allow such an act to occur with impunity. Because if the world sits by, the message will be crystal clear: that the use of chemical weapons has once again become an acceptable means of armed conflict. That would be a tragedy – and would endanger the future of all of the world’s children – who could one day find themselves writhing in pain and gasping for breath like the Syrian children we all watched on television.
Condemnation and “moral outrage” against the use of chemical weapons do not constitute a sanction. They are, in fact, no sanction at all. We would never allow the perpetrator of a rape or murder in the United States to be subjected to “moral outrage” and sent home to contemplate his deed. How much less can we allow that to the be case when a government has murdered 1,400 of its own people using weapons that have been universally condemned by the entire international community for almost 100 years. That defies common sense.
I would argue that the control – and ultimate elimination of weapons of mass destruction – chemical, biological and nuclear – is one of the most critical priorities for Progressives like myself, and for our entire society. To secure the future of our species, we must eliminate them – not only from the hands of tyrants like Assad, or unreliable nation states, or non-state actors – but from all of the world’s arsenals, including our own.
We have begun to make progress down that long and difficult road with the end of the Cold War, the chemical weapons treaty, nuclear weapons treaties – and most importantly, the developing worldwide consensus that their use is unthinkable.
The world cannot afford an iconic use of chemical weapons to go unpunished. And the United States of America alone in the world has the ability to lead an appropriate international response.

“Patient Deliberation, Not Imperialism”: On Syria, President Obama Is More Like Woodrow Wilson Than George W. Bush
As President Obama moves toward launching military strikes against the Syrian regime, some have been quick to charge him with hypocritically following in the footsteps of the president he long sought to repudiate: George W. Bush.
Ron Paul kicked things off two months ago with a baseless charge of “fixing the intelligence and facts around the already determined policy.” More recently, a leading Russian legislator claimed Obama would be “Bush’s clone” because “just like in Iraq, this war won’t be legit.” Fox News columnist and strident U.N. critic Anne Bayefsky declared that Obama will be seen as a “hypocrite or a fraud” for not pursuing a U.N. Security Council resolution after “bashing” Bush on similar grounds.
The Bush swipe is a cheap shot. It also misses the far more relevant historical parallel. Obama is not walking in Bush’s footsteps, but Woodrow Wilson’s.
As World War I raged in Europe and civil war erupted in Mexico, Woodrow Wilson won re-election in 1916 on the slogan “He Kept Us Out Of War.” But Wilson’s slogan proved ephemeral, and his strategy of “armed neutrality” finally gave way in the face of German aggression.
Similarly, Obama won the presidency in no small part because of anti-Iraq War sentiment, and was re-elected at least in part for following through on withdrawal. Now Obama faces his own second-term Wilson moment, as Syria’s genocidal tactics severely test President Obama’s foreign policy goals of facilitating democracy, strengthening international institutions, and avoiding “dumb wars” that sap American lives, resources, and global influence.
The similarities do not end there. Both Wilson and Obama sought to turn away from the imperialism of their predecessors while embracing the use of American influence to spread the right of self-determination abroad. Both expressed restraint regarding the use of military force, yet both pushed back on pacifist constituencies in their political bases and kept their options open. Both were charged with vacillation, and both suffered the occasional rhetorical misstep, as they walked those fine lines in the run-up to military action.
Obama was knocked for drawing a “red line” against the use of chemical weapons without being prepared to follow through, arguably giving Syria license to go farther. Wilson quickly regretted saying America was “too proud to fight” in May 1915, three days after Germany sunk the Lusitania and killed 1,198 people, including 128 Americans. Seven months later, Wilson recalibrated. During a speaking tour promoting a new policy of military preparedness, Wilson made a clear break with his party’s pacifist wing: “There is a price which is too great to pay for peace, and that price can be put in one word. One cannot pay the price of self-respect.”
Still, Wilson’s restraint continued through the 1916 re-election campaign. Then less than three months after Election Day, Germany secretly cabled Mexico, proposing an alliance and offering three American states upon victory. Britain intercepted the code and fed it to Wilson, who publicized it and then took another two months before concluding it was time to enter the war.
Wilson risked being portrayed as a hypocrite, or even an outright liar, considering his campaign slogan. But as it turned out, his patient deliberation and clear reluctance for war buttressed his credibility when the moment for intervention came, helping to bring along a reluctant public.
Most importantly, Wilson did not betray his core principles. He did not flip from isolationism to imperialism. He had been seeking to play the role of peace broker, and end the war in a fashion that would move the world away from colonization and toward self-determination.
Shortly before he knew of Germany’s Mexican machinations, he laid out his vision in his “Peace Without Victory” address. Instead of a harsh peace in which the victor punishes the defeated, claims new territory, and sows the seeds of future conflict, Wilson saw a compromise settlement between belligerents, moving the world towards democratic governance and establishing a new “League of Nations” international body to prevent future world wars.
Wilson stuck by this vision even after he picked a side in the war, rejecting calls from both allies abroad and Republicans at home for an “unconditional surrender.”
Here too does Obama overlap with Wilson. Military action in Syria is not a betrayal of Obama’s foreign policy principles.
This is not a repeat of Bush-style neo-conservatism. There is nothing from the Obama White House that suggests a desire to handpick Syria’s leaders, establish permanent military bases, or claim natural resources. While Obama may not seek a U.N. Security Council resolution as he did to oust Libya’s Moammar Gadhafi, he is also not suddenly snubbing international law, as he reportedly sees justification in existing treaties such as the Geneva Conventions and the Chemical Weapons Conventions.
The administration’s emphasis on limited strikes makes clear that President Obama still wants to do all he can to avoid ending his presidency with a “dumb war” that would mire the United States in a hopeless quagmire.
The White House has even stated that the military strikes will not be designed to spark “regime change,” instead stressing that “resolution of this conflict has to come through political negotiation and settlement.” In other words, it anticipates some sort of power-sharing agreement between Syrian factions, leading to a government that is fully representative of all Syrian people. This policy objective harkens back to Wilson’s “Peace Without Victory.”
Of course, none of the above guarantees that Obama’s vision will triumph. Wilson learned that the hard way.
Wilson did succeed in accelerating the end of the war and jump-starting a negotiated settlement. But after long multi-party negotiations that he personally undertook, Wilson reluctantly accepted harsher terms for Germany’s surrender than he deemed fair. And a debilitating stroke in 1919 muddled his thinking and warped his ability to compromise with the Republican-led Senate, dooming ratification of the treaty and America’s entry into the League of Nations.
But Wilson’s inability to close the deal doesn’t mean he was foolish to try. He came pretty close, and a healthier Wilson with a stronger foreign policy team could well have pulled it off. In fact, President Franklin Roosevelt’s team did just that, proving Wilson’s wisdom correct with the founding of the U.N. after World War II. We have not suffered world wars since.
Obama may be taking a mighty gamble, but it is in pursuit of self-determination and an international order intolerant of genocide, not an ignoble quest for empire.
