“A Typical Republican Trick”: Gun Nuts Deploy Rand Paul And Ted Cruz For Cynical Political Scheme

Earlier this week the Senate voted 82-12 to open debate on the Bipartisan Sportsmen’s Act, a measure introduced by Democratic Sen. Kay Hagan that “aims to preserve federal lands for hunting, fishing and shooting” and had over 20 Republican co-sponsors. It also would “amend the Toxic Substances Control Act, preventing the Environmental Protection Agency from regulating ammunition and fishing equipment that may contain lead.” Sounds … lovely. What it really is, though, is a vehicle for an endangered red-state Democrat such as Kay Hagan to bring something home to brag about.

And that’s why it had to die on Thursday, in a spectacularly cynical yet all-too-common flameout during amendment.

Republicans, who agreed with the bill in spirit but, more pertinently, knew that it might help Kay Hagan win reelection, pulled off a typical trick: trying to attach a number of insane gun lobby amendments to the bill that would force Hagan and other red-state Democrats to cast difficult votes.

Sen. Tom Coburn’s amendment would limit “the circumstances under which veterans can be denied access to firearms because of mental illness.” Sen. Ted Cruz’s “would allow expanded interstate transport of ammunition and firearms.” And then, there’s beloved hero-Sen. Rand Paul, who thinks this hunting and fishing bill represents the latest perfectly reasonable opportunity to strip Washington, D.C., of all its gun laws.

Rand’s proposed amendment to the Bipartisan Sportsmen’s Act would repeal the registration requirement, end the ban on semi-automatic rifles and high-capacity magazines, expand the right to carry guns outside the home and protect the right to carry guns on federal land in D.C. and elsewhere in the country. In essence, the bill would eliminate the District’s local gun laws, leaving only federal firearms law to regulate gun ownership and use in the city.

(You’ve got to love the way Republicans casually introduce amendments to overhaul laws set by the local government of the District of Columbia. Oh, here’s a little amendment to get rid of all your gun laws. Oh, here’s a quick note I drew up to keep marijuana criminalized in your little town of sin. Non-voting Delegate Eleanor Holmes Norton, of course, is never consulted on these things, but members of Congress do seek her out when they want to bitch about the traffic. Anyway, this is an aside, which is why it’s in parentheses.)

Once Coburn et al. drafted their amendments, pro-gun control Democrats decided to retaliate. “If we open this to a gun debate, we’re going to hear both sides,” Sen. Dick Durbin said earlier in the week. And so he drew up an amendment to “stiffen the penalty for straw purchases of guns to 15 years in prison,” while Sen. Richard Blumenthal offered one that “would temporarily take guns away from people who commit domestic violence and have a restraining order placed against them.”

And so Harry Reid blocked amendments, Republicans withdrew their support, and the measure went down on a 41-56 cloture vote this morning. This is all well and good according to the Gun Owners of America, a lobby that had pushed for the Republican amendment flood to what it called “a do-nothing, reelection bill for Harry Reid’s cronies.”

We weep not, reader, for the demise of the Bipartisan Sportsmen’s Act of 2014. The nation will survive without it. But if a bill that essentially says “WE LIKE HUNTING AND FISHING” gets bogged down in an amendment battle about whether or not to have any gun control laws anymore and then dies, maybe it wouldn’t be a bad idea to begin the August recess right now and extend it through Election Day.

“When Conservatives Cry Wolf”: It’s More Like A Howl For Attention And A Public Relations Campaign

There were two important developments in the Republican Party last week. Let’s take stock.

First, after years of saying that yes, they would develop and introduce an alternative to Obamacare, three GOP senators finally presented one: Orrin Hatch, Tom Coburn, and Richard Burr unveiled what they call their PCARE plan (yes, it’s another one of those syrupy, dopey Washington acronyms that have become such a pestilential constant in our city). Conservatives exulted; “See? We can be serious about policy!” But as Jonathan Chait wrote, the thing was awfully general and sketchy, and as soon as people started asking serious questions about how this or that would work, “things began to fall apart.” As of now, the plan has evanesced into something that no one really takes seriously and everyone recognizes for what it is—a mere talking point, a general outline that exists solely so Republicans can go on teevee and say they have a plan.

The second development occurred several days ago when John Boehner promised big movement on the immigration front. We’ll do a bill this year, he said. No citizenship, no “amnesty,” but a process toward legal status. The Republicans were ready to cut a deal. Boehner posted his guidelines for reform on his web site Monday. By Friday, 4,500 comments had been posted, roughly 95 percent (or more!) of them negative (“Please tell the Jews that we don’t want their One World Order. If they like immigrants send them to Israel[sic],” wrote user “Barbara Cornett”). At the end of the week, Boehner suggested that immigration reform might not, after all, be on the docket this year. (Update: I softened this language from the original, at the suggestion of Greg Sargent, and he’s right about Boehner’s words, although I remain a hard-shell skeptic.)

Remember when we had a “budget deal” in December, and the government didn’t shut down again, and negotiations didn’t go until the eleventh-and-a-half hour? At that point, we actually had some people talking about the dawn of a new day in Washington. Maybe the Republicans really were changing their stripes.

When an alcoholic is destroying a family, it’s his drinking, self-denial and lies that are creating the problem. But a lot of the time, the family contributes, too. It’s in, perhaps, its own state of denial. “Oh it’s not so bad, really. Oh he’s under lots of pressure. I think he can stop, I really do. Maybe not just yet. As soon as he gets through this (intense time at work/family illness/etc.).”

This is what the larger Washington establishment has become: The enabling spouse of the drunk. “They’ll change. I just know it. This time, I really don’t see how they can’t. I mean, supporting immigration reform is so clearly in their own self-interest!” And certainly, it is. But laying off the sauce is certainly in the alcoholic’s self-interest, too. In that case, we all understand why the alkie doesn’t stop. It has nothing to do with self-interest. He knows his own self-interest. But he can’t change until his shame and disgust with himself is such that he’s ready to try.

With the GOP, it’s more complicated, because this isn’t just one person’s conscience. It’s an entire machinery of ideology-fueled delusion and rage. In fact, now that I think about it, our two examples above are perfect, because each describes the two huge problems with the GOP extremely well. They also explain why they’re not going to be putting down the bottle anytime soon.

The healthcare vignette provides us a textbook example of how the GOP has retreated into policy fantasyland. The specific policy point on which the plan began to unravel was as follows: Our GOP trio proposed, of course, a way to cover more Americans, because that’s pretty much the point, right? Right. Okay. Well, to cover more people, you have to spend money, which means you have to come up with a way to finance it.

Obviously, that’s a pretty thorny dilemma for Republicans. But the trio decided to finance their healthcare expansion by placing a cap on untaxed health benefits. That is, healthcare benefits are untaxed right now. So Hatch, Burr, and Coburn would have taxed benefits starting at about 65 percent of the average cost of a plan.

In other words—yes, a tax increase! An expert from the Kaiser Family Foundation told Talking Points Memo: “This would be a meaningful hit on people. It’s a big radical change. This is not an incremental thing, and it affects most people under 65.” So, they quietly changed it, raising the cap, which obviously means less revenue and less coverage.

You can imagine what those three would have said if Obama had put forward something like this. (He proposed a tax on “Cadillac plans,” but they affect only a small percentage of health consumers.) So why would they do the same? Because they live in policy fantasyland. This plan wasn’t intended as anything serious. It was created for public relation purposes only.

Immigration showcases the other malignant GOP tumor: The rage of the base. The base won’t permit immigration reform. It’s pretty much that simple. Boehner, of course, could stand up to that base, and he’d pass a bill, with mostly Democrats. But he just told us he’s not going there.

And so it goes. People often ask me, Tomasky, when do you think they’re going to change? The answer, of course, is it depends. If they somehow capture the White House in 2016, then there’s no incentive to change, and the future is pretty bleak. But if they lose to Hillary Clinton, and she wins reelection, then I do think that by 2024 it will finally be a different party. Is that supposed to be reassuring? That’s a decade away!

In the meantime, they will keep doing what they do. I really wish Washington would stop enabling them, but people are nervous about their nonprofit status, their funders and board members, and are simply devoted to the idea that both parties are responsible. They’re helping the drunk stay drunk. As my friend Bill B. says, from their comments and actions on healthcare and immigration, to contraception and most everything else, the Republicans keep telling us who they are. When are people going to believe them?

“When Conservative Isn’t Conservative Enough”: A Signal To The GOP Base That Even The Radicals Aren’t Radical Enough

With Sen. Tom Coburn (R) retiring at the end of the year, well ahead of the scheduled end of his term, there will be a Senate special election in Oklahoma in 2014. Given the fact that the Sooner State is one of the “reddest” in the nation, it’s very likely the seat will remain in Republican hands. The question is which Republican.

Rep. Tom Cole (R) and state Attorney General Scott Pruitt (R) quickly withdrew from consideration, but Rep. James Lankford (R) launched his campaign yesterday, vowing in his announcement speech to “continue Dr. Coburn’s conservative legacy.”

In theory, the right-wing congressman, elected in the 2010 GOP wave, would appear to be exactly the kind of candidate far-right activists would hope for. Conservative groups don’t quite see it that way.

[T]he Senate Conservatives Fund, a key pressure group, took the stark step Monday morning of saying – even before Mr. Lankford’s official announcement – that he will not be getting their support.

“We won’t support Congressman Lankford’s bid for the Senate because of his past votes to increase the debt limit, raise taxes and fund Obamacare,” said Matt Hoskins, the group’s executive director. […]

The Madison Project, another group that directs attention and money to the campaigns of anti-Washington candidates, said Mr. Lankford is the wrong candidate for the party. In a blog post, the group said Mr. Lankford isn’t a “purely liberal Republican,” but said he is “a quintessential status quo Republican.”

This isn’t an intra-party dynamic in which the Republican base rejects an electable, mainstream candidate, boosting Democratic chances of picking up a competitive seat.

Rather, this is the latest evidence that for GOP-affiliated organizations hoping to influence elections, being conservative is no longer conservative enough.

To hear the Senate Conservatives Fund and its allies tell it, Lankford is some kind of RINO. I poked around the ThinkProgress archive this morning to get a sense of some of the congressman’s greatest hits and found a few gems:

* Lankford believes sexual orientation is a “choice,” so employment discrimination against gay Americans should be legal.

* He believes climate change is a “myth,” pushed by those seeking to “control” people.

* He blamed “welfare moms” for gun violence.

* He wants the United States to defund and abandon the United Nations.

The Senate Conservatives Fund and its allies think this guy just isn’t conservative enough. Perhaps some folks are just tough to please.

In the larger context, though, the organizations’ dissatisfaction with James Lankford does help explain the growing tensions between the Republican Party and these extremist outside groups. When this congressman can’t meet the activist groups’ standards for conservatism, it signals to GOP leaders that there’s simply no point in trying to cater to their demands – even radicals won’t be seen as radical enough.

“Will The GOP Ever Be Happy?”: No Matter The Facts, They Just Don’t Care If Healthcare.Gov Works Or Not

Healthcare.gov is well on its way to full stability, but Republicans refuse to acknowledge it. No matter the facts, the GOP is committed to the message that Obamacare has failed.

It wasn’t that long ago when Republicans were deeply concerned over the quality of the president’s healthcare website.

In a letter to Kathleen Sebelius, head of the Department of Health and Human Services, Rep. Darrell Issa and Sen. Lamar Alexander demanded answers for the massive glitches that attended the rollout of Healthcare.gov. “We are concerned by recent comments to the media that the system suffers from architectural problems that need design changes,” wrote the two GOP lawmakers, “We seek information about these problems as well as whether you still expect individuals to suffer a tax penalty if they do no purchase government-approved health insurance.”

Likewise, in a statement, Republican National Committee chairman Reince Priebus said that “Obamacare is collapsing under its own weight.” This was echoed by the Senate Republican Policy Committee, which called the website an “inexcusable train wreck” and wondered “how President Obama can tax uninsured Americans for not having something that they can’t purchase.”

The administration responded to all of this criticism—and more—with a promise that Healthcare.gov would work for the majority of users by December 1st. And it does. According to the administration, a five week “tech surge” has doubled the capacity of the online interface to the health care exchanges that form the core of the Affordable Care Act. As of this month, the website can handle 50,000 simultaneous users, for a total limit of 800,000 users per day. The site is functional more than ninety percent of the time, up from fifty-five percent of the time in October.

There is still a whole host of work to finish, especially on the back-end, where critical communications are made to insurers with regards to subsidies and eligibility. Overall, however, the White House has achieved more than 400 of the 600 fixes on its “punchcard” of repairs. Healthcare.gov is on the fast track to full stability, which will be a significant boost to the law and its prospects.

Given the extent to which Republicans were so concerned with the status of the website, you’d think they would greet this as good news, even as they continue to oppose the law. The message doesn’t have to be extensive. Something as simple as, “We still oppose the law, but we’re glad Americans haven’t been left in the cold,” would suffice.

Even that, however, is too generous for Republicans, who can’t concede any goodwill to the president’s health care law. “[The] website is least of Obamacare’s problems,” tweeted Sen. John Cornyn of Texas. “This isn’t just about a broken website, it’s about a fundamentally-flawed law,” wrote Michael Steel, a spokesperson for Speaker of the House John Boehner. And on ABC’s This Week, Oklahoma Senator Tom Cole said that “You never get a second chance to make a first impression, and the first impression here was terrible.”

The Republican complaints of two months ago were purely opportunistic. For them, it just doesn’t matter if Healthcare.gov is working, since Obamacare is destined to fail, reality be damned! At most, the broken website was useful fodder for attacks on the administration. Now that it’s made progress, the GOP will revert to its usual declarations that the Affordable Care Act is a hopeless disaster. Meanwhile, hundreds of thousands of Americans have gained access to health insurance thanks to the Medicaid expansion or the exchanges, and many more will join their ranks as the deadline for coverage approaches.

Republicans haven’t offered a response to this because, as of this moment, the party doesn’t have a response. Yes, there are conservative intellectuals with ideas for reform, but as an institution, the GOP has little to say about the constellation of problems in American health care. Even in their drive for repeal, Republicans failed to offer an alternative. At most, lawmakers like Bob Corker of Tennessee have tentatively called for “market-driven” reforms, like changes to the tax code, and allowing insurers to sell across state lines. Ironically, the Affordable Care Act allows for these changes, but that doesn’t seem to matter to the GOP.

It’s almost cliché to say that the Democratic Party is gambling its success on the Affordable Care Act. If it works, the party can point to a broad program that delivers needed benefits to millions of Americans. If it doesn’t, it’s hard to imagine how Democrats will re-earn the trust of a skeptical public, to say nothing of the fate of the uninsured and the broader consequences for liberalism.

In the same way, the Republican Party is gambling its fate on the failure of the law, with no attempt to grapple with the possibility of its success. What happens if Obamacare works as advertised? How do GOP leaders salvage a failed crusade? And more importantly, how do GOP voters react when the prospect of repeal is completely, unambiguously off the table?

“Driving Through Red Lights”: Extreme Chaos Being Caused By The Unrivaled Republican Gang Of 40

In the 1970s, in its days of hard-line Communist isolation, China was ruled by the extremist “Gang of Four.” Drivers then were sometimes encouraged to proceed at red lights because red was the revolutionary color signifying advance — resulting in a chaos that was emblematic of the times.

In the United States, we always do things in a grand way, so it’s a tribute to American exceptionalism that we have far outperformed China in the field of extremist ideologues. We don’t have some pathetic little foursome, but an unrivaled “Gang of 40.”

That’s my name for the 40 hard-line Republican House members who have forced the shutdown of the federal government and are now flirting with a debt default that could spin the world into recession. In their purported effort to save America money, they’re costing us taxpayers billions of dollars.

Obviously, there are differences — our Gang of 40 disdain Mao suits — but there is a similar sense in which an entire nation is held hostage by a small group of unrepresentative figures who don’t have much of a clue about economics or about where they’re taking the country.

The Gang of 40’s government shutdown has been bad enough, cutting off death benefits to families of service members and ending federal support for rape crisis centers. It’s doubly painful that all this is happening while the House and Senate gyms remain open.

(Bravo to the Washington restaurant that is offering a 10 percent discount to some federal workers, while posting a 10 percent surcharge to members of Congress. Maybe members of the Gang of 40 should also be compelled to wash dishes?)

What’s most troubling about the mess is the way the extremists downplay the risks of running into the debt limit. Astonishingly, Representative Ted Yoho, a Florida veterinarian, says that missing the debt ceiling deadline “would bring stability to world markets.”

Or there’s Senator Rand Paul, who said that not raising the debt limit could be reframed as “a pretty reasonable idea.” Even Senator Tom Coburn says it wouldn’t be so bad to miss the debt-limit deadline and face a “managed catastrophe.”

There’s now a right-wing echo chamber, shaped by Fox News Channel and Web sites like RedState, that repeats such nonsense until it acquires a patina of plausibility — and thus makes a catastrophe more difficult to avoid. A Pew Research Center poll this month found that 54 percent of Republicans believe that the United States can miss the debt-limit deadline without major problems.

What makes our trajectory dangerous is that the hard-liners are getting positive feedback. The most reliable Republican voters are about twice as likely to say that Congressional Republicans have compromised too much as to say that they haven’t compromised enough.

Hang on to your hat. We may be in for a wild ride.

I’ve often been curious about the wretched political leadership in America in the 1840s and 1850s in the run-up to the Civil War: How could American politicians have been so stubborn as they inched toward cataclysm? Watching today’s obstreperousness, I’m gaining a better insight.

Two features strike me about this moment — and both are echoes of the mistakes in the run-up to the Civil War. One is the obliviousness of central players, especially the Gang of 40, to the risks ahead.

The second is the way politicians seek leverage by brazenly threatening deliberate harm to the nation unless they get their way. The House Republican hard-liners lost their battle against Obamacare in the democratic process, just as President Obama lost his battle for an assault-weapons ban. But instead of accepting their loss as Obama did, members of the Gang of 40 took hostages. Unless Obamacare is defunded, they’ll cause billions of dollars in damage to the American economy.

The G.O.P. claims to be the party particularly concerned by budget deficits. Yet its tantrum caused a government shutdown that cost the country $1.6 billion last week alone.

As for the debt limit, the costs of missing that deadline could be infinitely greater. Already, interest rates are spiking for one-month Treasury bills to their highest levels since the 2008 financial crisis.

The Bipartisan Policy Center, a think tank, calculates that the 2011 debt-ceiling confrontation will, over a decade, cost American taxpayers an extra $18.9 billion.

And that was the price tag for a crisis in which the debt-limit deadline was eventually met. If this deadline is missed, the costs in higher interest rates in the years ahead will be billions more.

Members of the Gang of 40 are unwilling to pay for early childhood education, but they’re O.K. with paying untold billions for a government shutdown and debt-limit crisis? That’s not governance, but extremism.
