A Conservative Defense Of Government: You’re A Fan Of Government, So Stop Pretending Otherwise

Everyone knows that Ronald Reagan famously said, “Government is not the solution to our problem; government is the problem.” But as Ramesh Ponnuru recently pointed out, there is a “less famous yet crucial beginning of that sentence”: “In our present crisis.”

Conservatives rightly hate nanny-state government and big-spending bureaucracy. But too often, the word “government” has become unfair shorthand for what is actually only bad or oppressive government.

Conservatives aren’t anarchists, after all. We don’t want Big Brother, but none of us should want to live in a Hobbesian state where every person is absolutely and entirely for himself, either. Instead, we believe in ordered liberty via limited government.

Certainly, the size and scope of government has increased over the years. But still, we shouldn’t conflate all government with bad government. We need a functioning state, and yes, there is such a thing as a government that is too weak.

This is a lesson that goes back to our founding. And it’s one conservatives should appreciate. Judging from their colonial garb and tri-cornered hats, Tea Party activists are fond of the Constitution and its Founders. So you might expect that they, of all people, would appreciate the importance of having a government that isn’t laughably weak.

As Baylor professor and Patrick Henry author Thomas Kidd tells me, “Most of the major Founders became convinced that Americans needed a stronger national government to coordinate trade policy and protect against domestic and foreign threats.”

Under the Articles of Confederation, the government was impotent. “Major decisions — declaring war and signing treaties — needed the approval of nine states,” writes Richard Brookhiser in his book James Madison. Congress couldn’t even tax, and “as a result, the United States was perpetually broke,” Brookhiser adds.

To be sure, some patriots, like Patrick Henry and Samuel Adams, opposed the Constitution precisely because they feared big government. But as Kidd points out, “the majority of the best-known Founders believed that the new republic needed a bigger, stronger government for the United States to survive and compete on the world stage.”

“If men were angels, no government would be necessary,” wrote Madison, who (in fairness) added, “If angels were to govern men, neither external nor internal controls on government would be necessary.”

So, a natural question: What should a limited government do?

For starters, preserve law and order, ensure the rule of law, enforce contracts, provide for our defense — and yes, control the border. (I’m also partial to clean water, but that’s just me.)

Max Weber said the government has a “monopoly on legitimate violence in society.” This is needed to enforce law and order. Otherwise, whoever has the biggest gun — or the most brothers — takes your property.

“Government is the most common form of hierarchy,” Robert Kaplan recently noted. “It is a government that monopolizes the use of violence in a given geographical space, thereby preventing anarchy. To quote Thomas Hobbes, the 17th-century English philosopher, only where it is possible to punish the wicked can right and wrong have any practical meaning, and that requires ‘some coercive power.'”

But government functions don’t just keep us safe, they also make us prosperous. Sure, overregulation can be a job killer. But consider the extreme alternative. If you believe that someone could steal your business if he wants to, then you are much less likely to start one. If you believe that someone can break a contract with you — or steal your invention — without fear of punishment, that might make it less likely that you will go into business or to invest in research and development.

In their 2012 book Why Nations Fail, economists Daron Acemoglu and James A. Robinson provide a largely free market argument for why some nations succeed. For example, Acemoglu and Robinson fault protectionist policies instituted to avoid the process of creative destruction as a primary reason some nations fail.

But interestingly, they also frequently cite a lack of a strong central government as a prime reason nations fail. For example, the authors lament Somalia’s “lack of any kind of political centralization, or state centralization, and its inability to enforce even the minimal amount of law and order to support economic activity, trade, or even basic security of its citizens.”

I can’t imagine that any conservatives who decry government would prefer this sort of extreme chaos to our current, albeit imperfect, government.

So maybe the answer is to be more specific about our concerns with government. Attempting to do just that, Nobel Prize-winning economist James M. Buchanan distinguished between the productive state, the protective state, and the redistributive state.

Essentially, the productive state would constitute infrastructure like roads and bridges, the protective state would encompass the police, criminal justice, etc., and the redistributive state is obviously the entitlement state.

While most conservatives concede that we need some social safety net, they are mostly worried about the out-of-control growth of the redistributive state. And yet, too seldom is that distinction made. Instead, the criticism is usually directed at “government.”

When it comes to government, a lot of conservatives are probably too obsessed with size. Grover Norquist famously wants to shrink government to such a small size that you can drown it in a bathtub.

But I’m not sure most Americans want that. And trying to force it via draconian cuts doesn’t work, especially if they don’t address the specific problem, such as the need for entitlement reform. “You can’t make a fat man skinny by tightening his belt,” observed John Maynard Keynes.

Whether you’re a conservative who cares about preserving law and order, or a free marketer who appreciates the importance the rule of law plays in providing confidence and incentives to entrepreneurs, you’re a fan of government. Stop pretending otherwise.

“Marco Rubio’s Tangled Web”: Don’t Let President Obama Stop Immigration Reform!

Marco Rubio has a big op-ed in the Wall Street Journal today explaining to conservatives why they should support immigration reform, and WaPo’s Greg Sargent has a persuasive take on it:

So how can Republicans who want immigration reform get conservatives to accept it, given that Obama also wants it?

Republicans pushing for reform have come up with a strategic answer to that question, one that isn’t really acknowledged openly. They are subtly making the case to their base that a defeat for immigration reform is actually a hidden victory for Obama, and that passing the Senate compromise is actually worse for the President than the alternative, i.e. doing nothing.

In this sense, the immigration reform debate is perhaps the ultimate test of what Obama referred to as the need to create a “permission structure” — that is, a way for conservatives to accept something Obama wants, too. The message — which is carefully couched – is that, yes, Obama wants immigration reform, but conservatives should accept the Gang of Eight compromise because the alternative is actually better for the President.

The basic idea here is that the status quo with its alleged weak border enforcement is as bad as or worse than legalizing the undocumented workers already here. There’s even a hint in Rubio’s op-ed that absent reform legislation, the radicals in the administration will find other, more devious ways, to legalize undocumented folk, even as they are inviting more to come in.

Perhaps understanding that this argument isn’t exactly open-and-shut, Rubio also invites conservatives to “toughen” the border enforcement language in the Gang of Eight bill–as he’s been doing in interviews for several days. I guess ideally he’d like Obama to play his part by yelling and screaming about any modifications before eventually caving in, because he’s so weak, you know.

Greg notices something else interesting about Rubio’s pitch: it doesn’t contain the usual political arguments that are actually the motive for virtually all the Republican interest in immigration reform:

There’s a key nuance here. As I understand the thinking, GOP base voters are turned off by the political argument that we must reform immigration because if we don’t, Obama will be able to screw Republicans over politically with Latinos. The reason the political argument doesn’t work is partly because many GOP base voters are persuaded that immigration reform will create a whole lot of Democratic voters — in purely political terms, rank-and-file members of the GOP base believe immigration reform is a net win for Democrats no matter how you slice it.

I’d add to that observation the equally important fact that a lot of Tea types are turned off by electoral arguments generally: they don’t want to hear about how the Republican Party might wrangle a few more Latino voters via a betrayal of principle–they want to pursue their ideological tenets to the ends of the earth. There’s just not a lot of openness to strategic or tactical thinking here; it’s fight-fight-fight, based to some degree on the iron conviction that all the strategery of the Republican Establishment of the past hasn’t worked while howling at the moon worked just fine in 2010.

In any event, it’s a tangled web ol’ Marco seems to be weaving, and if Greg and I can see through it, I’m reasonably sure a lot of his intended audience can see through it, too.

“A Big Problem Is Brewing”: This Could Be A Career Ender For Michele Bachmann

With a special investigator soon to be appointed by the chief justice of the Iowa Supreme Court, the ethics cloud hovering over Rep. Michele Bachmann could quickly become a major problem for the Tea Party hero, experts tell Salon.

“This is very serious,” said Craig Holman, a government ethics lobbyist at liberal-leaning watchdog group Public Citizen. “It’s not Watergate, or at least not yet, but these are a series of allegations that are each serious on their own, and when you put them all together, this could be a career ender for Michele Bachmann.”

Ken Boehm, chairman of the conservative-leaning National Legal and Policy Center, told Salon that we should wait to see what investigators find — indeed, no wrongdoing has been reported so far — though he acknowledged the escalating scrutiny could be a major headache for the congresswoman down the line.

The Iowa investigation, looking into whether the campaign improperly paid a state senator, is just one of at least three different probes examining a range of allegations related to Bachmann’s failed presidential campaign, including charges that she improperly used campaign funds to promote her book, that her campaign “launder[ed]” money, and that one of her staffers stole an email list from a home-school organization.

Two former staffers, including her former chief of staff, have agreed to testify against Bachmann, which Holman said is “very unusual” and something that will push investigators at the Federal Elections Commission and the Office of Congressional Ethics, each of which reportedly has its own investigations into the campaign, to take the matter seriously.

OCE can’t issue penalties itself, but instead refers matters to the House Ethics Committee, where the range of potential punishments is huge, from a letter of censure to expulsion from the House, though the committee has a reputation for partisan gridlock and could easily sidestep the matter. FEC violations, meanwhile, come with civil fines, but the commission is even more notoriously ineffectual than the Ethics Committee.

The real punishment, even if no wrongdoing is found, would likely instead come in November of next year, when Bachmann will face off against Democrat Jim Graves, whom she beat by less than 4,500 votes in 2012. The race presents real challenges for Graves, as turnout will be lower without a presidential race, and the district remains the most conservative in Minnesota.

But Professor Larry Jacobs, who runs the Center for the Study of Politics and Governance at University of Minnesota, says the ethics questions are a “big problem” for Bachmann. “There are a lot of things a conviction politician like Michele Bachmann can withstand, and being attacked by Democrats is definitely one of them. But the kind of krypton that will disable her is having her convictions challenged,” he told Salon.

Some supporters will no doubt stick by her, and refuse to believe the veracity of any charges (see: Glenn Beck), but others may not. “These charges are particularly damaging because they cut to the core of her greatest strength among her followers, which is her authenticity. This cloud of questions has now enveloped her in the ‘usual politics’ label and what I’ve heard from her supporters — and this is obviously not a scientific sample — is, ‘she’s just like the rest of them,’” Jacobs added.

For his part, Graves isn’t ready to make an issue of the ethics questions — yet. “We aren’t going to make any assumptions,” he told Salon. “We’re confident in the bipartisan process responsible for investigating this matter. The truth will set you free — or otherwise. I’m just disappointed at how long this issue has had to go on, creating another distraction from the real needs and concerns of Minnesotans.”

Bachmann’s core supporters will probably never vote for a Democrat, but they might stay home, which could be trouble in a low-turnout race like midterms generally are. Still, Jacobs guesses that Bachmann hangs on for another cycle, but barely. And if the ethics questions get worse, that prediction might change.

“The Decider’s Poor Decisions”: George W Bush’s Legacy Keeps Getting Worse

In retrospect, George W. Bush’s legacy doesn’t look as bad as it did when he left office. It looks worse.

I join the nation in congratulating Bush on the opening of his presidential library in Dallas. Like many people, I find it much easier to honor, respect and even like the man — now that he’s no longer in the White House.

But anyone tempted to get sentimental should remember the actual record of the man who called himself The Decider. Begin with the indelible stain that one of his worst decisions left on our country’s honor: torture.

Hiding behind the euphemism “enhanced interrogation techniques,” Bush made torture official U.S. policy. Just about every objective observer has agreed with this stark conclusion. The most recent assessment came this month in a 576-page report from a task force of the bipartisan Constitution Project, which stated that “it is indisputable that the United States engaged in the practice of torture.”

We knew about the torture before Bush left office — at least, we knew about the waterboarding of three “high-value” detainees involved in planning the 9/11 attacks. But the Constitution Project task force — which included such figures as Asa Hutchinson, who served in high-ranking posts in the Bush administration, and William Sessions, who was FBI director under three presidents — concluded that other forms of torture were used “in many instances” in a manner that was “directly counter to values of the Constitution and our nation.”

Bush administration apologists argue that even waterboarding does not necessarily constitute torture and that other coercive — and excruciatingly painful — interrogation methods, such as putting subjects in “stress positions” or exposing them to extreme temperatures, certainly do not. The task force strongly disagreed, citing U.S. laws and court rulings, international treaties and common decency.

The Senate intelligence committee has produced, but refuses to make public, a 6,000-page report on the CIA’s use of torture and the network of clandestine “black site” prisons the agency established under Bush. One of President Obama’s worst decisions upon taking office in 2009, in my view, was to decline to convene some kind of blue-ribbon “truth commission” to bring all the abuses to light.

It may be years before all the facts are known. But the decision to commit torture looks ever more shameful with the passage of time.

Bush’s decision to invade and conquer Iraq also looks, in hindsight, like an even bigger strategic error. Saddam Hussein’s purported weapons of mass destruction still have yet to be found; nearly 5,000 Americans and untold Iraqis sacrificed their lives to eliminate a threat that did not exist.

We knew this, of course, when Obama became president. It’s one of the main reasons he was elected. We knew, too, that Bush’s decision to turn to Iraq diverted focus and resources from Afghanistan. But I don’t think anyone fully grasped that giving the Taliban a long, healing respite would eventually make Afghanistan this country’s longest or second-longest war, depending on what date you choose as the beginning of hostilities in Vietnam.

And it’s clear that the Bush administration did not foresee how the Iraq experience would constrain future presidents in their use of military force. Syria is a good example. Like Saddam, Bashar al-Assad is a ruthless dictator who does not hesitate to massacre his own people. But unlike Saddam, Assad does have weapons of mass destruction. And unlike Saddam, Assad has alliances with the terrorist group Hezbollah and the nuclear-mad mullahs in Iran.

I do not advocate U.S. intervention in Syria, because I fear we might make things worse rather than better. But I wonder how I might feel — and what options Obama might have — if we had not squandered so much blood and treasure in Iraq.

Bush didn’t pay for his wars. The bills he racked up for military adventures, prescription-drug benefits, the bank bailout and other impulse purchases helped create the fiscal and financial crises he bequeathed to Obama. His profligacy also robbed the Republican Party establishment of small-government credibility, thus helping give birth to the tea party movement. Thanks a lot for that.

As I’ve written before, Bush did an enormous amount of good by making it possible for AIDS sufferers in Africa to receive antiretroviral drug therapy. This literally saved millions of lives and should weigh heavily on one side of the scale when we assess The Decider’s presidency. But the pile on the other side just keeps getting bigger.

“The Politics of Paranoia”: A Constant Stream Of Desperate Drivel By The Far-Right

Out-of-control federal government. An immediate and immense Muslim threat. Gun grabbing, national registries and eventual mass confiscations. Tyranny.

The politics of the political right have become the politics of paranoia.

According to too many of them, the country is collapsing, and the government is not to be trusted. The circle of safety is contracting. You must arm yourselves to defend your own.

It is no wonder, then, that in this environment, a Washington Post/Pew Research Center poll released Wednesday found that while 47 percent of Americans were angry or disappointed that new gun control legislation in the Senate (including the enormously popular background-checks provision) had failed to pass, 39 percent were very happy or relieved. Fifty-one percent of Republicans had those sentiments, compared with 22 percent of Democrats.

This underscores just how frightened of the government far-right Republicans are.

A Quinnipiac University poll this month found that 91 percent of Americans (including 88 percent of Republicans) said that they supported background checks for all gun buyers. But that same poll found that 61 percent of Republicans worried that if there were background checks for all gun purchases, the government would use that information in the future to confiscate legally owned guns.

Furthermore, a January Pew Research Center report found that for the first time since the question was asked in 1995, most Americans now believe that the federal government threatens their personal rights and freedoms.

According to the report:

“The growing view that the federal government threatens personal rights and freedoms has been led by conservative Republicans. Currently 76 percent of conservative Republicans say that the federal government threatens their personal rights and freedoms and 54 percent describe the government as a ‘major’ threat.”

The report continued:

“By comparison, there has been little change in opinions among Democrats; 38 percent say the government poses a threat to personal rights and freedoms and just 16 percent view it as a major threat.”

Incidentally, 62 percent of those who had a gun in their home thought the government posed a threat, as opposed to 45 percent of those without a gun in the home.

In January, the right-wing Web site World Net Daily, writing about a poll the site conducted with the consulting firm Wenzel Strategies, bemoaned:

“The seeds of a tyrannical government are present in the United States, with a citizenry happy with a heavily armed law enforcement presence and a disbelief that their government could do anything that would make them want to revolt, according to a new poll.” The poll revealed “widespread belief” that the Second Amendment “really is for self-protection and hunting, not for ‘fighting back against a tyrannical government.’”

Fritz Wenzel of the consulting firm is quoted as saying that the poll’s finding “demonstrates the downside of more than 230 years of government stability. This survey shows it is hard for many Americans to think of a situation in which their government would need to be overthrown. Of course, the last time there was a serious fight for the future of the federal government, in the Civil War, Washington won.”

And that’s just the tip of it. Last month, Glenn Beck described the makeup of what he believed was the coming “New World Order.” It did not bode well for America.

“I think you might even have some Nazi influence in the United States, unfortunately, because we’ve had it before. And it will happen there and there, I think,” Beck said, placing dots over the Northwest and the Northeast on a map.

Discussing the Muslim Brotherhood’s “influence,” Beck said:

“I think there’s going to be a slight influence in South America and Mexico and in the United States. I think it is going to be more significant than anyone imagines, and I believe that you are also then going to be co-ruled by a thug-ocracy of this part of the world. And I think it’s going to be, at least in our case, I think it’s going to be China. China will be the balance of our power. They will use Muslim, um, Islam as the real enforcers that they will then help us and whoever is in power in our country. We will be ruled by an American, but it will be a technocrat that will answer to China. And, they will stomp things out and use Islam as much as they have to, to get rid of anyone who’s standing up, I think.”

O-kay.

And Beck delivered this prattle in a suit jacket, not a straitjacket.

This is the constant stream of desperate drivel that has fostered a climate of fear on the far right that makes common-sense consensus nearly impossible.
