“The Media Has Cast Its Traditional Role Aside”: Washington Circus Steals The Spotlight From Where It Belongs

Can President Barack Obama put out the brush fires that are sucking the air out of his second-term agenda? Can he stop the spread of mini-scandals that are consuming Washington?

No, he cannot. The president could (unconstitutionally) shutter every Internal Revenue Service office and fire every staffer, from top-ranking executives to lowly administrative aides, and it would hardly matter. Republicans would simply change the terms of the debate and impeach him for destroying the 16th Amendment.

Official Washington is now all spectacle, all circus, all manufactured outrage abetted by a press corps addicted to controversy. Actual policies are slighted while political posturing takes the stage; simmering problems are ignored while canned contretemps and stale theater consume all the attention. That has been true for years now, but it just keeps getting worse.

There are serious failings at the heart of each of the sideshows currently consuming officialdom. The most egregious concerns the IRS, where bureaucrats singled out conservative groups for a vetting that veered into political harassment. That not only violates deep-rooted ideals of fairness and justice, but it also contravenes federal law. It raises the specter of the sort of political harassment carried out by Richard Nixon, who wielded the IRS as a bludgeon against his political adversaries, and by J. Edgar Hoover, who ordered tax audits of the Rev. Martin Luther King Jr.

While IRS-gate reflects poorly on Obama’s leadership, there is not a scintilla of evidence that he had anything to do with it. Further, the president has responded with aplomb: He has forced the resignation of the acting head of the agency as the FBI launches a criminal investigation. (That’s about all the administration can do since federal rules insulate IRS bureaucrats from elected officials, all in an effort to prevent scandals such as those mentioned above.)

If Republicans doubt the president’s ability to impartially oversee an investigation of his own administration, they might appoint a special prosecutor. Instead, they have promised more hearings on Capitol Hill — more partisan spectacle, more canned outrage, more useless theater.

Though the national press corps sticks to its unwritten rule of blaming Democrats and Republicans equally for the mess our national politics have become, the facts show that responsibility cannot be equally apportioned. Democrats don’t eschew partisan mudslinging, but they are not very good at it. The GOP, by contrast, has raised it to an art form.

Take a look at the last two presidential administrations. Though Bill Clinton reigned over an era of peace, prosperity and a balanced budget, the GOP impeached him on charges that grew out of an adulterous affair. George W. Bush took the country to war on the wings of a lie, tortured detainees and wrecked the budget. Democrats pointed fingers and conducted investigations, but they did not impeach him.

The news media, meanwhile, breathlessly report every email, every accusation, every pointed finger. They parse political winners and losers. Will the Benghazi hearings damage Hillary Clinton’s chances for the presidency in 2016? Will the IRS controversy hurt immigration reform? Will the controversies heal Republicans’ internal divisions?

As much as it troubles me to say so, Washington journalists have cast aside their traditional roles as trumpets of a substantive truth. They rarely uncover genuine abuses of power, cast a skeptical eye on untoward developments (such as the warmongering that led to the invasion of Iraq) or even explain the nuances of policy. Heck, they barely bother to inform the public when yesterday’s huge scandal becomes suddenly less, well, scandalous.

Take the budget deficits. Wasn’t it just two months ago that Republicans were insisting that the Obama administration was sending the entire nation to the poorhouse? What happened to those deficits?

As it turns out, they are shrinking, just as many mainstream economists had predicted. As the economy recovers, the federal government pays out less in assistance and takes in more in taxes.

You haven’t heard a lot of chatter about that or about the people hurt by the continuing cuts that were supposedly made necessary by that looming deficit. Many struggling Americans are finding their childcare options limited, their community clinics closed, their assistance for housing and meals shrinking — with little notice from official Washington. That’s the real scandal.

“The Hollowing Out Of Government”: The Real Reason Why The Government “Isn’t Doing Its Job”

The West, Texas chemical and fertilizer plant where at least 15 were killed and more than 200 injured a few weeks ago hadn’t been fully inspected by the Occupational Safety and Health Administration since 1985. (A partial inspection in 2011 had resulted in $5,250 in fines.)

OSHA and its state partners have a total of 2,200 inspectors charged with ensuring the safety of over more than 8 million workplaces employing 130 million workers. That comes to about one inspector for every 59,000 American workers.

There’s no way it can do its job with so few resources, but OSHA has been systematically hollowed out for years under Republican administrations and congresses that have despised the agency since its inception.

In effect, much of our nation’s worker safety laws and rules have been quietly repealed because there aren’t enough inspectors to enforce them.

That’s been the Republican strategy in general: When they can’t directly repeal laws they don’t like, they repeal them indirectly by hollowing them out — denying funds to fully implement them, and reducing funds to enforce them.

Consider taxes. Republicans have been unable to round up enough votes to cut taxes on big corporations and the wealthy as much as they’d like, so what do they do? They’re hollowing out the IRS. As they cut its enforcement budget – presto! — tax collections decline.

Despite an increasing number of billionaires and multi-millionaires using every tax dodge imaginable – laundering their money through phantom corporations and tax havens (Remember Mitt’s tax returns?) — the IRS’s budget has been cut by 17 percent since 2002, adjusted for inflation.

To manage the $594.5 million in additional cuts required by the sequester, the agency has announced it will furlough each of its more than 89,000 employees for at least five days this year.

This budget stinginess doesn’t save the government money. Quite the opposite. Less IRS enforcement means less revenue. It’s been estimated that every dollar invested in the IRS’s enforcement, modernization and management system, reduces the federal budget deficit by $200, and that furloughing 1,800 IRS “policemen” will cost the Treasury $4.5 billion in lost revenue.

But congressional Republicans aren’t interested in more revenue. Their goal is to cut taxes on big corporations and the wealthy.

Representative Charles Boustany, the Louisiana Republican who heads the House subcommittee overseeing the IRS, says the IRS sequester cuts should stay in force. He calls for an overhaul of the tax code instead.

In a similar manner, congressional Republicans and their patrons on Wall Street who opposed the Dodd-Frank financial reform law have been hollowing out the law by making sure agencies charged with implementing it don’t have the funds they need to do the job.

As a result, much of Dodd-Frank – including the so-called “Volcker Rule” restrictions on the kind of derivatives trading that got the Street into trouble in the first place – is still on the drawing boards.

Perhaps more than any other law, Republicans hate the Affordable Care Act (Obamacare). Yet despite holding more than 33 votes to repeal it, they still haven’t succeeded.

So what do they do? Try to hollow it out. Congressional Republicans have repeatedly denied funding requests to implement Obamacare, leaving Health and Human Services (the agency charged with designing the rules under the Act and enforcing them) so shorthanded it has to delay much of it.

Even before the sequester, the agency was running on the same budget it had before Obamacare was enacted. Now it’s lost billions more.

A new insurance marketplace specifically for small business, for example, was supposed to be up and running in January. But officials now say it won’t be available until 2015 in the 33 states where the federal government will be running insurance markets known as exchanges.

This is a potentially large blow to Obamacare’s political support. A major selling point for the legislation had been providing affordable health insurance to small businesses and their employees.

Yes, and eroding political support is exactly what congressional Republicans want. They fear that Obamacare, once fully implemented, will be too popular to dismantle. So they’re out to delay it as long as possible while keeping up a drumbeat about its flaws.

Repealing laws by hollowing them out — failing to fund their enforcement or implementation — works because the public doesn’t know it’s happening. Enactment of a law attracts attention; de-funding it doesn’t.

The strategy also seems to bolster the Republican view that government is  incompetent. If government can’t do what it’s supposed to do – keep workplaces safe, ensure that the rich pay taxes they owe, protect small investors, implement Obamacare – why give it any additional responsibility?

The public doesn’t know the real reason why the government isn’t doing its job is it’s being hollowed out.

“Congressional Responsibility With No Accountability”: Why The Green Lantern Theory Of Presidential Power Persists

At today’s press conference, President Obama spent a fair amount of time pushing back on what some of us are calling the “Green Lantern Theory of Presidential Power.” This theory — which seems to hold broad sway over many in the press — holds that presidents should be able to bend Congress to their will, and any failure to do so proves their weakness and perhaps even their irrelevance.

What accounts for the persistence of this theory? The answer, I think, lies in the tendency of reporters and analysts who are trying to remain a neutral, nonpartisan posture to feel comfortable making process judgments, but not ideological ones.

The extent and limits of presidential power were at the center of one of the most interesting exchanges of the day. ABC News’s Jonathan Karl asked this question:

Mr. President, you are a hundred days into your second term. On the gun bill, you put, it seems, everything into it to try to get it passed. Obviously, it didn’t. Congress has ignored your efforts to try to get them to undo these sequester cuts. There was even a bill that you threatened to veto that got 92 Democrats in the House voting yes. So my question to you is do you still have the juice to get the rest of your agenda through this Congress?

Obama answered that Republicans have the option of cooperating with him to avert the sequester. He also said:

You seem to suggest that somehow, these folks over there have no responsibilities and that my job is to somehow get them to behave. That’s their job. They are elected, members of Congress are elected in order to do what’s right for their constituencies and for the American people. So if, in fact, they are seriously concerned about passenger convenience and safety, then they shouldn’t just be thinking about tomorrow or next week or the week after that; they should be thinking about what’s going to happen five years from now, 10 years from now or 15 years from now. The only way to do that is for them to engage with me on coming up with a broader deal. And that’s exactly what I’m trying to do is to continue to talk to them about are there ways for us to fix this.

As Jamelle Bouie quipped: “Barack Obama asks press to maybe, possibly, hold Republicans responsible sometime.” Bouie added: “Congressional Republicans have agency, and at a certain point, they need to be held accountable for their actions.”

But here’s the problem: If a reporter or analyst were to call out Republicans for failing to compromise with Obama, that reporter or analyst would be calling on them to adopt a particular policy position, such as moving towards a mix of new revenues and spending cuts to replace the sequester. It would amount to a criticism of the Republican position — i.e., that we should only replace the sequester with spending cuts. This is impermissible for the neutral writer, because it constitutes an ideological judgment. On the other hand, faulting Obama for failing to get Republicans to move his way does not constitute taking any kind of stand on who is right, ideologically speaking. It only constitutes a judgment of Obama for failing to manipulate the process adequately.

This sometimes works against Republicans, too. John Boehner was widely pilloried by commentators for failing to control his caucus during the fiscal cliff fight. But Boehner struggled to do this because many conservatives in his caucus had adopted the extreme and borderline delusional position that taxes must not be raised, ever, no matter what. Criticizing the position of conservatives, however, would constitute an ideological judgment, which is far harder for the nonpartisan writer to make than to claim Boehner just can’t control his Members because he’s ineffective — a process criticism.

This isn’t to absolve Obama of all responsibility to move Congress. Surely presidents have the power to set the agenda and get the public to think more about an issue. But as many others have explained at great length — see Jonathan Bernstein and Kevin Drum on this – the president’s influence over Congress is currently quite limited, historically speaking, for a host of reasons. And in the particular case of guns and the sequester, the Green Lantern argument is even more absurd: Toomey-Manchin wouldn’t have passed even if every Democrat had voted for it; and the sequester cuts can’t be replaced with a compromise of Obama’s choosing because Republicans control the House of Representatives.

The reason all these explanations don’t weigh on the Green Lanternites is the basic process/ideological imbalance identified above. It’s okay for the nonpartisan writer to criticize a president for failing to exert his will (a process judgment), but it’s not okay for the nonpartisan writer to fault Republicans for failing to agree to move in the direction of the policy a president wants (an ideological judgment). Today, for instance, Ron Fournier, to his credit, conceded that Obama was right in describing the limits on his powers. But he added: “Even if you concede to Obama every point of his Tuesday news conference, a president looks weak and defeated when he shifts accountability to forces out of his control.”

Perhaps this is how the public will view Obama; perhaps it isn’t. What is clear, however, is the basic imbalance here. While neutral commentators often hold up compromise, abstractly, as the Holy Grail, the process/ideology dichotomy makes it much easier for those commentators to fault the president for failing to work the process effectively enough to secure compromise than to pillory the opposition for being ideologically uncompromising.

“Entirely Symbolic”: The President’s Budget, Less Than Meets The Eye

On Twitter this morning I observed the irony that after an anemic jobs report the chattering classes would spend the rest of the day talking about whether the president’s budget (a summary of which was leaked today; the actual document is due to be released next Wednesday) offered enough spending cuts to be taken seriously.

The big news, if you want to call it that, is that the budget will formally propose what Obama has offered hypothetically as part of a “grand bargain” in exchange for significant new revenues: a shift to a “chained CPI” for Social Security COLAs (and other federal pensions and benefit programs, it seems), and some additional means-testing of Medicare benefits.

Whether or not chained CPI (which assumes consumers will switch to lower-price alternatives in purchases as overall prices rise) is a more accurate estimate of inflation, there’s no doubt utilizing it would operate as an across-the-board benefit cut–albeit one that occurs very slowly over time–something Obama and virtually all Democrats have opposed as a matter of principle in the past. There will be howls of outrage from Democratic members of Congress and progressive advocacy groups about this fresh Obama endorsement of the idea, some based on categorical rejection of Social Security benefit cuts, some based on the argument that Obama is offering a crown jewel and getting very little if anything in exchange from Republicans.

What may temper this reaction is the knowledge that this budget is entirely symbolic, and that it is certain to be rejected and denounced by House Republicans immediately for its inclusion of new revenues and its failure to project an actual balanced budget. It appears the White House is again trying to show a willingness to compromise for purposes of strengthening his hand in future fiscal battles, though some think it’s related to Obama’s effort to kick-start “grand bargain” negotiations with those Senate Republicans who are willing to consider some new revenues in exchange for “entitlement reform.”

For the record, there is actually some new spending in Obama’s budget: a pre-K initiative and this week’s “brain research” proposal, both paid for by a tobacco tax increase and a cap on the size of Individual Retirement Accounts. But there’s little in the way of “stimulus.” While the budget would cancel the appropriations sequester, it would in other ways achieve even lower defense and non-defense discretionary spending. Aside from the “offsets” just mentioned, new revenues in the budget–the usual reductions in “loopholes” theoretically supported by some Republicans–come in at $580 billion, a pretty low figure.

How you view this budget depends almost entirely on how you view Obama’s overall fiscal strategy. Is he maintaining the “high ground” on the budget, or making unilateral concessions to an opposition that is just going to pocket them without making any of their own? And is this budget connected to the forced fiscal negotiations that might occur in May or June if House Republicans decide to make a play on a new debt limit increase, despite warnings from the business community not to do so?

In any event, there’s zero that is self-executing about this budget, so it will mostly just represent another maneuver in a budgetary chess game that now seems increasingly disconnected from the economy.

“Reality Check”: Hey Republicans, There Was An Election And You Lost

On Thursday, the top Democrat in the House made what amounted to a major concession, pronouncing herself open to the idea of reducing Social Security benefits. This moved Nancy Pelosi closer to the position that President Barack Obama, who has already put out a plan that includes chained-CPI, has staked out in pursuit of a deficit reduction “grand bargain” with Republicans. This could make it easier for Obama to convince Senate Republicans, whom he’s begun courting in recent weeks, that he can deliver on a deal that includes real sacrifices on Democratic priorities.

And how does the top Republican in the House fit into this mix? Well, he doesn’t.

In a Thursday interview with the New York Times, Speaker John Boehner said he’s not currently engaged in budget conversations with the White House and suggested the onus is on Obama to move closer to the blueprint that Paul Ryan staked out this week — a 10-year balanced budget plan that the GOP-controlled House will probably adopt in the next week. That Ryan budget offers absolutely nothing in the way of concessions. But for a few cynical accounting tricks, it’s the same plan Ryan presented in 2012 and 2011, one that would turn Medicare into a voucher program, slash taxes on corporations and the wealthy, gut the Affordable Care Act and turn federal programs targeted for the poor into block grants for states to manage. It was this radical rethinking of the size and scope of the federal safety net that played a major role in last year’s election, with Democrats warning voters that the Ryan plan would be implemented if Republicans gained control of the executive and legislative branches.

In other words, House Republicans — and their leader — haven’t budged at all on fiscal issues since the election, even though the results were humbling for their party. Sure, they provided a scattering of votes for the New Year’s Eve fiscal cliff deal that raised income tax rates on high-end earners, but a) that was because they were up against a Jan. 1 deadline that would have triggered across-the-board tax hikes for all earners if no deal was reached; and b) the majority of House Republicans still voted against that package. And since that deal was enacted, the determination of House Republicans to stop any further revenue increases — even those involving loopholes and deductions, not income tax rates — has only intensified. The president already got his tax hikes, the GOP talking point goes, and now he wants more?

The reason Obama wants more, of course, is that he and most of his party (and, truth be told, a number of Republicans) would like to turn off the sequester, which went into effect on March 1 when the two parties failed to reach agreement on a replacement plan. The stumbling block was simple: Republicans were adamant in opposing a “balanced” deal with a revenue component. Many of them also claimed that Obama wasn’t serious about cutting entitlement spending, even though the president produced the above-referenced plan, which included Social Security benefits cuts. It’s clear that, for the time being anyway, House Republicans are completely uninterested in striking a fiscal deal with Obama, unless the deal is that he goes along with everything they want.

What’s so striking — and, some might say, galling — about this is that Republicans lost pretty badly in the most recent election. No, it wasn’t en epic LBJ ’64-style wipeout, but the party spent 2011 and 2012 convinced that the rotten economy would compel voters to fire Obama, restore Republican control of the Senate and boost the GOP’s House majority. But none of that happened. As I wrote last week, it can sometimes feel like Republicans actually won the election. The problem is mainly centered in the House, although the Senate has more than its share of problems, and can be explained by two main factors:

1. Geography

The average House Republican represents a district that is older, whiter and more Republican-friendly than the country as a whole. Gerrymandering is typically cited as the reason for this, but it’s a red herring. The real problem is that the core Democratic vote — a rising majority of nonwhites, millennials, single women and college-educated professionals — is tightly bunched in metropolitan areas. They account for massive majorities in a relatively small number of congressional districts. Suburban, exurban and rural areas, by contrast, tend to be populated by more Republican-friendly voters, who are more widely dispersed. Thus, it’s not uncommon in big states for Democrats to enjoy clear majorities in statewide elections even as Republicans gobble up the majority of House seats. Barring the kind of anti-Republican wave elections we saw in 2006 and 2008, this dynamic should persist through the next decade, ensuring Republican control of the House. The Republicans in these districts are mostly immune to the cultural and demographic changes that hurt their party at the national level in 2012; thus, the same reflexively anti-tax/anti-government/anti-Obama hysteria that sold in these areas before November 2012 still sells today — making it likely that these districts will send to Washington either a) true believer Tea Party-type congressmen and -women, who win their seats simply by running far to the right in the GOP primary; or b) secretly pragmatic Republicans who adopt the rhetoric and voting habits of the Tea Party crowd for the sake of their own political survival.

2. The powerless speaker

A case can be made that Boehner’s skills as a House leader are underappreciated. There’s something to this, but it’s an argument that amounts to a backhanded compliment — that Boehner, by routinely looking the other way as his party worsens its public image and subjecting himself to the occasional high-profile indignity, is able to build just enough clout to steer the House GOP away from complete catastrophe when he absolutely has to. There’s an art to this, all right, and I guess you could say Boehner is good at it. But that’s really the limit of his power as speaker. The problem is that the conservative movement has never trusted him and has been looking for the moment he sells them out from the second he claimed the speaker’s gavel in 2011. This has imposed some humiliating limits on him — forcing Boehner, for instance, to walk away at the 11th hour from grand bargain negotiations with Obama in the summer of ’11 and compelling him to promise Republicans a few months ago that he wouldn’t attempt any more one-on-one negotiations with the president.

So when it comes to Obama’s current quest for a grand bargain, there’s really nothing for Boehner to do but repeat the right’s familiar attacks on Obama for always wanting to raise taxes and never wanting to cut spending. Never mind, of course, that Obama has already signed off on $2.5 trillion in deficit reduction and is seeking $1.2 trillion more with his grand bargain crusade, and that most of that money is from spending cuts. Acknowledging that would destroy whatever credibility Boehner now has with the conservative base, and make it impossible for him to push any kind of deal through the House without being dethroned. So he bashes away, pretends the problem is Obama’s inflexible liberalism and waits. What the endgame is is unclear. It may just be that Boehner is hoping to keep the GOP conference from pursuing a debt ceiling showdown in May. Or maybe he’s hoping that after a few more months of bashing Obama, he just might have clearance to put a Senate-passed grand bargain on the House floor and to allow it to pass mainly with Democratic votes. Or he may think none of this is possible — and may mainly be interested in patching up the damage the fiscal cliff deal did to his standing with the right.

The key here is that Boehner oversees a Republican conference whose members do not, generally speaking, feel any personal pressure to respond to the Democrats’ big national victory last November. In the America where they leave, Obama and the national Democratic Party are as reviled now as they were before Election Day.
