“Out Of Their Minds”: Senate Republicans Kill Veterans’ Jobs Bill

With a major national election just seven weeks away, senators would have to be out of their minds to reject a jobs bill for U.S. military veterans, right?

Apparently not.

Veterans won’t be getting a new, billion-dollar jobs program, not from this Senate. Republicans on Wednesday afternoon blocked a vote on the Veterans Job Corps Bill after Jeff Sessions of Alabama raised a point of order — he said the bill violated a cap on spending agreed to by Congress last year.

The bill’s sponsor, Patty Murray of Washington, said that shouldn’t matter, since the bill’s cost was fully offset by new revenues. She said Mr. Sessions and his party colleagues had been furiously generating excuses to oppose the bill, and were now exploiting a technicality to deny thousands of veterans a shot at getting hired as police officers, firefighters and parks workers, among other things.

The bill needed 60 votes to advance. The final tally was 58 to 40, and all 40 opponents of the proposal were Republicans.

As proposals go, this should have been a no-brainer. The Veterans Job Corps Act of 2012, sponsored by Sen. Patty Murray (D-Wash.), sought to lower unemployment among military veterans, giving grants to federal, state, and local agencies, which in turn would hire veterans — giving priority to those who served on or after 9/11 — to work as first-responders and in conservation jobs at national parks.

The bill was fully paid for, and entirely bipartisan — Sen. Richard Burr (R-N.C.) had his own set of ideas for the bill, and Murray incorporated all of them into her legislation.

And yet, all but five Senate Republicans voted to kill it anyway, 48 days before a national election. Even Burr sided with his party to defeat the bill, and it was filled with his provisions.

A New York Times editorial added the other day, “It makes sense for the 99 percent of Americans to find new ways to pay their debt to the 1 percent who serve in uniform. To most people, Senator Murray’s bill would seem like one decent way to do that. But not if you’re one of those Republicans in Washington who thinks it’s more important in an election year to deny Democrats a success or accomplishment of any kind.”

“Extremely Deceptive”: Scott Brown Is Lying About His Reproductive Rights Record

Running for Senate in a deep-blue state—where support for abortion rights has been measured at nearly 70 percent—Republican Scott Brown needs to make it clear that he supports reproductive rights. That’s why he’s telling reporters that he “promise[s]” never to vote in the Senate to curb reproductive rights, and why he has a new ad airing statewide today with this script:

NARRATOR: Scott Brown is pro choice, and he supports a woman’s right to choose.

WOMEN: I like that Scott Brown is independent, he really thinks for himself. His record shows that he supports women, he supports families. When my daughters grow up, I want to make sure that they have good jobs with equal pay, and I know Scott Brown will fight for that. I support Scott Brown because I know he wants to get our economy moving forward again. I’m a mom, I have a family, and I know that Scott Brown will fight hard for families.

BROWN: I’m Scott Brown and I approve this message.

Sounds nice. And it’s true Brown did object to the GOP platform language on abortion. But his actual record—touted in the ad—directly contradicts the new message.

Consider:

Brown was a co-sponsor of the Blunt Amendment earlier this year, which would have allowed employers to deny women preventive care options under the company plan—including contraception, mammograms, pre-natal screenings, cervical cancer screenings. (It was written broadly enough to allow any employer to do this, not just religious ones). This would have jeopardized the preventive health services of 20.4 million women nationwide, and 517,000 in Massachusetts alone.

Brown voted to defund Planned Parenthood last year when he supported House Resolution 1, the Republican spending plan that was ultimately defeated in the Senate. It would also have removed funding under Title X for health centers for low-income women. 

Brown may have supported the Stupak-Pitts Amendment to the Affordable Care Act, which would have stripped any funding for abortions by any health insurance product subsidized by the government. It wasn’t included in the Senate version that Brown voted on. But his staff told the Associated Press in November 2009 that Brown would have supported it—though he told Boston’s WBUR that same month that he would have opposed it.

It’s extremely deceptive, then, for Brown to pretend he supports a woman’s right to choose, as the ad claims. Or in the words of said Stephanie Schriock, President of EMILY’s List: “Scott Brown is straight-up lying to Massachusetts voters with his latest ad. Brown does not support a woman’s right to choose – his anti-choice voting record has earned him the support of an anti-choice organization in this very campaign.”

Indeed, Massachusetts Citizens for Life has endorsed Brown in his race against Elizabeth Warren. “We consider him a senator who votes prolife,” Anne Fox, the president of that group, told the Boston Globe last month. (Though Republican Majority For Choice has also backed him).

Brown is also misleading about his record on women’s issues elsewhere in the ad. For example, a woman featured says that “I want to make sure [my daughters] have good jobs with equal pay, and I know Scott Brown will fight for that.” But in November 2010, Brown supported a Republican filibuster of the Paycheck Fairness Act, which would have required employers to prove that any gender disparities in pay were directly related to job performance. That bill was passed by the House two years ago, but has never cleared a Senate filibuster.

“GOP Selective Memory Loss”: A Fleeting Illusory Democratic Congressional Supermajority

It’s in Republicans’ interest right now to characterize the Democrats’ congressional majority in 2009 and 2010 as enormous. As the argument goes, President Obama could get literally anything he wanted from Congress in his first two years, so Democrats don’t have any excuses.

The stimulus wasn’t big enough? Blame Dems; they had supermajorities in both chambers for two years. There’s no comprehensive immigration reform? Blame Dems; they had supermajorities in both chambers for two years. There was only one big jobs bill? Blame Dems; they had supermajorities in both chambers for two years. And so on.

The right continued to push the line over the weekend.

Fox News Sunday host Chris Wallace falsely claimed Democrats had a 60-vote Senate majority for the first 2 years of his presidency.

“For the first 2 years he had a filibuster proof majority in the Senate,” Wallace told LA Mayor Antonio Villaraigosa, making the case that Obama has only himself to blame for his poor economic record.

I realize memories can be short in the political world, and 2010 seems like a long time ago, but it’s unnerving when professionals who presumably keep up with current events are this wrong. Even if various pundits lost track of the specific details, I’d at least expect Fox News hosts to remember Sen. Scott Brown’s (R) special-election win in Massachusetts.

Since memories are short, let’s take a brief stroll down memory lane, giving Wallace a hand with the recent history he’s forgotten.

In January 2009, there were 56 Senate Democrats and two independents who caucused with Democrats. This combined total of 58 included Sen. Ted Kennedy (D-Mass.), whose health was failing and was unable to serve. As a practical matter, in the early months of Obama’s presidency, the Senate Democratic caucus had 57 members on the floor for day-to-day legislating.

In April 2009, Pennsylvania’s Arlen Specter switched parties. This meant there were 57 Democrats, and two independents who caucused with Democrats, for a caucus of 59. But with Kennedy ailing, there were still “only” 58 Democratic caucus members in the chamber.

In May 2009, Sen. Robert Byrd (D-W.Va.) was hospitalized, bringing the number of Senate Dems in the chamber down to 57.

In July 2009, Sen. Al Franken (D-Minn.) was finally seated after a lengthy recount/legal fight. At that point, the Democratic caucus reached 60, but two of its members, Kennedy and Byrd, were unavailable for votes.

In August 2009, Kennedy died, and Democratic caucus again stood at 59.

In September 2009, Sen. Paul Kirk (D-Mass.) filled Kennedy’s vacancy, bringing the caucus back to 60, though Byrd’s health continued to deteriorate.

In January 2010, Sen. Scott Brown (R-Mass.) replaced Kirk, bringing the Democratic caucus back to 59 again.

In June 2010, Byrd died, and the Democratic caucus fell to 58, where it stood until the midterms. [Update: Jonathan Bernstein reminds me that Byrd’s replacement was a Dem. He’s right, though this doesn’t change the larger point.]

Wallace believes the Dems’ “filibuster proof majority in the Senate” lasted 24 months. In reality, he’s off by 20 months, undermining the entire thesis pushed so aggressively by Republicans.

“Demented Dominion”: Jim DeMint Claims Romney Personally Pledged Support For Pushing Tea Party Agenda In First 100 Days

Senator Jim DeMint is all smiles. Ted Cruz’s upset victory in Texas’s Republican Senate primary means the conservative wing of the GOP conference, a bloc the second-term lawmaker from South Carolina shepherds, will almost certainly increase its ranks.

“This confirms that there is a new political reality,” DeMint tells National Review Online in an interview in his office. “The people who are winning, for the Senate particularly, are those who are telling Americans the truth.”

Political observers expect Cruz, should he win in November, to join DeMint’s coalition of tea-party favorites, which includes Senator Mike Lee of Utah, Senator Rand Paul of Kentucky, and Senator Ron Johnson of Wisconsin, among others.

DeMint agrees that Cruz would be an ally, but he emphasizes that he is looking for an ideological partner, not a political loyalist. Cruz’s rise has not whetted DeMint’s ambitions. “I have no intention of running for leader,” he says, when asked whether he will challenge Senator Mitch McConnell, the Republican leader. “I’ve been a leader ever since I walked in the Senate door. You don’t have to be elected to lead.”

Besides, DeMint says, McConnell sees the signals coming out of Texas, Indiana, and other states where tea-party candidateshave won. And as a savvy operator, McConnell is probably not looking to buck the newcomers.

“Elected leaders carry an important administrative function, but they are going to reflect the conference,” DeMint tells me. “If the conference is moving in the right direction, our leaders will move in the right direction.”

A week ago, DeMint traveled to Texas, where he stumped for Cruz alongside former vice-presidential nominee Sarah Palin. Standing with the youthful contender and Palin in Houston in front of thousands of voters was “pretty emotional,” DeMint recalls. “For so long, the party bosses controlled all the money and picked the candidates, pretty much deciding who they would run as a Republican.” These days, thanks to conservative activists and the rise of the Tea Party, “that has totally changed.”

Last summer, DeMint was one of the first conservative leaders to endorse Cruz, who was then an unknown. DeMint weighed in early to send a message to his fellow Republicans. “There is not enough urgency around here,” he says, commenting on Capitol Hill’s ongoing fiscal debate. “But when I got to know Ted, it became clear that he is ready to make the hard choices — and they’ll need to be made.”

DeMint already has a legislative plan ready for Cruz’s arrival. “If we get the [Senate] majority and the White House, we have got to pass a budget that sets up the structure, through reconciliation, to repeal Obamacare by killing the mandate,” he says. He also wants to “totally redo our tax code,” put “Medicare on a sustainable course,” and “deal with Social Security.” But should Republicans win then stumble, “it’d be betrayal to our country.”

“We need to do it in the first 100 days,” DeMint says. “[Mitt] Romney has told me, face to face, that he knows that he needs to get these things done right away. He is looking at this as a one-term proposition.”

DeMint acknowledges that reform faces many hurdles, but come January, the 60-year-old senator is optimistic that he’ll have a slew of tea-party senators ready to help. “Ted Cruz, Richard Mourdock, Deb Fischer, hopefully Mark Neumann, these folks will hopefully come in and bring a lot of closet conservatives in the Republican party out in the open,” DeMint chuckles. “Marco Rubio, Rand Paul, Mike Lee — they have the sense of urgency. But they are outnumbered.”

“If we get four or five more like them, it will embolden a lot of [Senate] Republicans who are conservative at heart, but got into a business-as-usual rut and don’t want to rock the boat,” DeMint says. “Now, if they see the boat rocking, I think it might help us.”

“No Budget, No Pay”: How To Get Congress On Good Behavior

If taxpayers want better results from Congress, they must stop paying their elected officials for failure. After all, you get what you pay for.

That’s why I’ve introduced a bill called No Budget, No Pay. It’s not your typical congressional reform. It is the first effort to pay Congress for performance, the way that an increasing number of doctors, teachers, corporate executives, athletes, and other professionals are paid.

The bill, H.R. 3643, is so simple that it sells itself. If Congress fails to pass a budget and all 12 appropriations bills by the beginning of each fiscal year, October 1, congressional pay will stop. If Congress is even a day late, the penalties could be hundreds of dollars per day per congressman. Longer delays mean greater penalties (and the missed pay cannot be retroactively restored). It’s a harsh regime, but a necessary one. Our nation suffers when Congress fails to pay America’s bills on time.

Today’s Congress has not passed a budget in three years and has not completed all of its budget and appropriations bills on time in 15 years. Few incumbents can even remember meeting these obligations. This is no way to run a superpower.

Congress is so accustomed to today’s back-loaded schedule that it cannot imagine efficiency. Congress barely meets in January and February and, this year, the House was in session for only 10 days in May. Each house delights in passing bills that are dead on arrival in the other body. No Budget, No Pay would make the House and Senate actually talk to one another again. The heat from members to meet the deadline would be so intense that Congress, as a whole, could start forging deals.

A conventional reform would simply levy a flat penalty to punish Congress for tardiness. That’s like yanking a teenager’s allowance because he misbehaved. The goal should be to encourage better behavior. The threat of cutting congressional pay would do precisely that.

Properly understood, No Budget, No Pay is gentler than you think. It will not result in a single senator or congressman losing any pay. The reason: When everyone has an incentive to meet a deadline, you naturally finish on time, even early. For example, when California legislators tried it, they suddenly got much better at meeting deadlines. This is the power of aligned incentives: When everyone is on the same team, you have a much better chance of winning. The threat of punishment is more effective than the punishment itself.

This new type of reform engages the most powerful lobbyists on earth: congressional spouses. No one wants to miss a paycheck, especially spouses who are tired of excuses. These spouses will force Congress to work much harder much earlier in the winter and spring, instead of procrastinating into the summer and fall. Remember, members’ spouses have never let Congress miss a major holiday like Christmas. No Budget, No Pay puts October 1 in the same elite category as December 25.

The dirty secret of today’s Congress is that many members actually benefit from missing our financial deadlines. When they hold up negotiations, highlight a parochial cause, and take a budget or appropriations bill hostage, they get lots of free publicity and become a hero to the special interests they are protecting. This helps them finance their reelection campaigns. Some of their colleagues will honestly object to the delays, but most are just waiting for their own chance to grandstand. Meanwhile, taxpayers suffer because government agencies are crippled with unpredictable funding starts and stops on a month-to-month or even week-to-week basis. Sometimes a key agency like the Federal Aviation Administration is even forced to shut down many of its operations, as happened last August.

Having experienced (and often envied) their colleagues’ selfishness, many members are naturally afraid to be held accountable for the behavior of Congress as a whole. They are particularly afraid to vouch for the other body, either the House or Senate. Social scientists call this a collective action problem. It seems foolish to bet a paycheck that any group of politicians will be prompt. But these doubters have never been in a capitol where everyone was desperate to get paid.

Some fear that wealthy colleagues could afford to grandstand, while poorer members would be deprived of that free publicity. This is possible, but the rich are just as vulnerable to peer group pressure, sometimes more so, because they do not want to be stigmatized for being wealthy. The vast majority of members in the Senate and House need their paychecks and would be quick to ostracize anyone who slowed the budget process down, particularly a rich colleague. Fearing for their positions, party leaders would also make sure that wealthy members were not able to obstruct.

The task is an urgent one. The bill currently has 10 cosponsors in the Senate and 73 in the House. We need more cosponsors now, because there are only a few weeks left in this session of Congress before the November elections. Of course, Congress will miss its October 1 deadline again this year, but passage of No Budget, No Pay this fall would help us meet the deadline next year, in October of 2013. Unless Congress passes No Budget, No Pay this session, no adjustments to congressional pay will be possible until at least 2015, because the 27th Amendment requires an intervening election before any adjustment to congressional pay.

Since no president or Supreme Court has the constitutional power to reform Congress, Congress must heal itself with help from voters back home. Ultimately, Congressional medicine is like veterinary medicine: It must be strong enough to work, and tasty enough to swallow. No Budget, No Pay meets all these tests. It is hugely popular with voters, potent enough to make Congress meet the annual October 1 deadline, and palatable to members once they understand that they will be paid — because they will finish their work on time.
