“Shifting Tectonics On Guns”: It’s No Longer The Simple Question Of Doing What’s Right Versus Doing What’s Expedient

As the Senate moves towards a vote on Harry Reid’s gun violence package, which now (after the excision of a renewed assault gun ban and high-capacity ammo clip restrictions) centers on a quasi-universal background check system for gun sales, there are a lot of shifting techtonics to keep in mind:

First, public opinion remains overwhelmingly in favor of universal background checks across just about every subset of the population. The opposition may be noisy and influential, and benefits from the perception that this is a “voting issue” only for opponents, but this is at present not a close call in terms of where the public stands.

Second, the near-unanimity of public opinion probably reflects the ironic fact that for many years a stronger background check system was the default-drive alternative offered by the NRA to every other gun measure. Yes, the gun lobby has been fighting to protect the “gun show loophole” to background checks for some time, and has quietly worked to undermine the system as it exists, but it’s still difficult for Lapierre and company to pretend it represents a deadly threat to the Second Amendment.

Third, we are in a period where the once-powerful force of red-state Democratic reluctance to make waves on “cultural issues” is waning. There are fewer red-state Dems to worry about, for one thing. For another, voter polarization and reduced ticket-splitting have made the route to survival for red- (and more often, purple-) state Democrats depend more on base mobilization than has been the case in the past.

This last factor remains important in the 60-vote Senate, however. Plum Line’s Greg Sargent runs the numbers this morning, and identifies five Democrats and three Republicans who are being cross-pressured by the usual NRA threats–but also by Michael Bloomberg’s lavishly funded upcoming ad campaign pushing back.

How individual senators, the two parties, and the White House calculate all these factors will largely determine what happens after the Easter Recess. But in this installment of the Gun Wars, it’s no longer quite the simple question of doing what’s right versus doing what’s expedient that it used to be.

“The Sentiment Is Swinging”: Unanimous Senate Vote Bolsters Movement To Break Up Big Banks

It’s nearly impossible to get 99 U.S. senators to agree on anything.

But this past weekend, 99 senators agreed to send a non-binding message that the $83 billion subsidy “too big to fail” banks get from the government needs to end. The measure was co-sponsored by senators Sherrod Brown (D-OH) and David Vitter (R-LA).

The implicit subsidy first came to light in February when a Bloomberg News report found that “recurrent bailouts of the largest financial institutions have given [big banks] a unique advantage: They get a break on their borrowing costs, because creditors expect taxpayers to support them whenever they get into trouble.”

Shortly thereafter, Attorney General Eric Holder made the shocking admission that the Justice Department exercises restraint in prosecuting big banks for fear of shocking the global financial system.

“I am concerned that the size of some of these institutions becomes so large that it does become difficult for us to prosecute them when we are hit with indications that if you do prosecute, if you do bring a criminal charge, it will have a negative impact on the national economy, perhaps even the world economy,” Holder said, during testimony to the Senate Banking Committee.

Now all of the Senate’s Republicans have joined with senators Brown and Elizabeth Warren (D-MA) — who have long warned of the big banks’ continued ability to wreck havoc on the economy — to call for an end to the implicit subsidy.

“I’m glad that Republicans and Democrats can agree: ‘Too big to fail’ needs to end, and these big-bank subsidies make no sense,” Senator Warren said.

Bank lobbyists have denied that the subsidy exists. But as a Bloomberg editorial notes, they’ve rejected any steps that would prevent the government from having to serve as their backstop in case of a crisis.

“If big banks don’t get a subsidy on their debt, it’s hard to understand why they’re so adamantly opposed to measures, such as increased capital requirements, that would put a limit on their borrowing,” the editors noted. “Large banks commonly borrow $25 or more for each $1 in equity — or capital — they get from their shareholders, compared with less than 50 cents per $1 of equity for the average U.S. corporation.”

Financial reform following the financial crisis was weakened by bank lobbying. As Senator Dick Durbin (D-IL) noted at the time, the “banks own the place.” And by “the place,” he meant Congress.

This vote shows the sentiment is swinging against the banks. Whether senators are willing to vote against them when actual legislation is on the line still remains to be seen.

“Reality Check”: Hey Republicans, There Was An Election And You Lost

On Thursday, the top Democrat in the House made what amounted to a major concession, pronouncing herself open to the idea of reducing Social Security benefits. This moved Nancy Pelosi closer to the position that President Barack Obama, who has already put out a plan that includes chained-CPI, has staked out in pursuit of a deficit reduction “grand bargain” with Republicans. This could make it easier for Obama to convince Senate Republicans, whom he’s begun courting in recent weeks, that he can deliver on a deal that includes real sacrifices on Democratic priorities.

And how does the top Republican in the House fit into this mix? Well, he doesn’t.

In a Thursday interview with the New York Times, Speaker John Boehner said he’s not currently engaged in budget conversations with the White House and suggested the onus is on Obama to move closer to the blueprint that Paul Ryan staked out this week — a 10-year balanced budget plan that the GOP-controlled House will probably adopt in the next week. That Ryan budget offers absolutely nothing in the way of concessions. But for a few cynical accounting tricks, it’s the same plan Ryan presented in 2012 and 2011, one that would turn Medicare into a voucher program, slash taxes on corporations and the wealthy, gut the Affordable Care Act and turn federal programs targeted for the poor into block grants for states to manage. It was this radical rethinking of the size and scope of the federal safety net that played a major role in last year’s election, with Democrats warning voters that the Ryan plan would be implemented if Republicans gained control of the executive and legislative branches.

In other words, House Republicans — and their leader — haven’t budged at all on fiscal issues since the election, even though the results were humbling for their party. Sure, they provided a scattering of votes for the New Year’s Eve fiscal cliff deal that raised income tax rates on high-end earners, but a) that was because they were up against a Jan. 1 deadline that would have triggered across-the-board tax hikes for all earners if no deal was reached; and b) the majority of House Republicans still voted against that package. And since that deal was enacted, the determination of House Republicans to stop any further revenue increases — even those involving loopholes and deductions, not income tax rates — has only intensified. The president already got his tax hikes, the GOP talking point goes, and now he wants more?

The reason Obama wants more, of course, is that he and most of his party (and, truth be told, a number of Republicans) would like to turn off the sequester, which went into effect on March 1 when the two parties failed to reach agreement on a replacement plan. The stumbling block was simple: Republicans were adamant in opposing a “balanced” deal with a revenue component. Many of them also claimed that Obama wasn’t serious about cutting entitlement spending, even though the president produced the above-referenced plan, which included Social Security benefits cuts. It’s clear that, for the time being anyway, House Republicans are completely uninterested in striking a fiscal deal with Obama, unless the deal is that he goes along with everything they want.

What’s so striking — and, some might say, galling — about this is that Republicans lost pretty badly in the most recent election. No, it wasn’t en epic LBJ ’64-style wipeout, but the party spent 2011 and 2012 convinced that the rotten economy would compel voters to fire Obama, restore Republican control of the Senate and boost the GOP’s House majority. But none of that happened. As I wrote last week, it can sometimes feel like Republicans actually won the election. The problem is mainly centered in the House, although the Senate has more than its share of problems, and can be explained by two main factors:

1. Geography

The average House Republican represents a district that is older, whiter and more Republican-friendly than the country as a whole. Gerrymandering is typically cited as the reason for this, but it’s a red herring. The real problem is that the core Democratic vote — a rising majority of nonwhites, millennials, single women and college-educated professionals — is tightly bunched in metropolitan areas. They account for massive majorities in a relatively small number of congressional districts. Suburban, exurban and rural areas, by contrast, tend to be populated by more Republican-friendly voters, who are more widely dispersed. Thus, it’s not uncommon in big states for Democrats to enjoy clear majorities in statewide elections even as Republicans gobble up the majority of House seats. Barring the kind of anti-Republican wave elections we saw in 2006 and 2008, this dynamic should persist through the next decade, ensuring Republican control of the House. The Republicans in these districts are mostly immune to the cultural and demographic changes that hurt their party at the national level in 2012; thus, the same reflexively anti-tax/anti-government/anti-Obama hysteria that sold in these areas before November 2012 still sells today — making it likely that these districts will send to Washington either a) true believer Tea Party-type congressmen and -women, who win their seats simply by running far to the right in the GOP primary; or b) secretly pragmatic Republicans who adopt the rhetoric and voting habits of the Tea Party crowd for the sake of their own political survival.

2. The powerless speaker

A case can be made that Boehner’s skills as a House leader are underappreciated. There’s something to this, but it’s an argument that amounts to a backhanded compliment — that Boehner, by routinely looking the other way as his party worsens its public image and subjecting himself to the occasional high-profile indignity, is able to build just enough clout to steer the House GOP away from complete catastrophe when he absolutely has to. There’s an art to this, all right, and I guess you could say Boehner is good at it. But that’s really the limit of his power as speaker. The problem is that the conservative movement has never trusted him and has been looking for the moment he sells them out from the second he claimed the speaker’s gavel in 2011. This has imposed some humiliating limits on him — forcing Boehner, for instance, to walk away at the 11th hour from grand bargain negotiations with Obama in the summer of ’11 and compelling him to promise Republicans a few months ago that he wouldn’t attempt any more one-on-one negotiations with the president.

So when it comes to Obama’s current quest for a grand bargain, there’s really nothing for Boehner to do but repeat the right’s familiar attacks on Obama for always wanting to raise taxes and never wanting to cut spending. Never mind, of course, that Obama has already signed off on $2.5 trillion in deficit reduction and is seeking $1.2 trillion more with his grand bargain crusade, and that most of that money is from spending cuts. Acknowledging that would destroy whatever credibility Boehner now has with the conservative base, and make it impossible for him to push any kind of deal through the House without being dethroned. So he bashes away, pretends the problem is Obama’s inflexible liberalism and waits. What the endgame is is unclear. It may just be that Boehner is hoping to keep the GOP conference from pursuing a debt ceiling showdown in May. Or maybe he’s hoping that after a few more months of bashing Obama, he just might have clearance to put a Senate-passed grand bargain on the House floor and to allow it to pass mainly with Democratic votes. Or he may think none of this is possible — and may mainly be interested in patching up the damage the fiscal cliff deal did to his standing with the right.

The key here is that Boehner oversees a Republican conference whose members do not, generally speaking, feel any personal pressure to respond to the Democrats’ big national victory last November. In the America where they leave, Obama and the national Democratic Party are as reviled now as they were before Election Day.

“Exhaustion”: The Strongest Reason For Hope And A Way Out Of Our Budget Wars

There are, believe it or not, grounds for hoping that the so-called sequester, stupid as it is, might open the way to ending our nation’s budget stalemate.

Hope is in short supply right now, but the case for seeing a way out of the current mess rests on knowable facts and plausible assumptions.

It starts with the significant number of Republicans in the Senate — possibly as many 20 — who think what’s going on is foolish and counterproductive. The White House is betting that enough GOP senators are prepared to make a deal along lines that President Obama has already put forward.

Obama’s lieutenants argue that, while Republicans are aware that the president is seeking new revenue through tax reform, many did not fully grasp the extent to which he has offered significant long-term spending cuts. These include reductions in Medicare and a willingness (to the consternation of many Democrats) to alter the index that determines Social Security increases. Obama has proposed $930 billion in cuts to get $580 billion in revenues.

Senior administration officials note that Obama cannot stray too far from his existing offer, which was already a compromise, without losing the Democratic votes a deal would need. But his framework, they believe, could create a basis for negotiation with Republican senators, such as Sen. Lindsey Graham (S.C.), who dislike the deep, automatic cuts in defense spending, and others, such as Sens. Susan Collins of Maine and Bob Corker of Tennessee, who dislike government-by-showdown.

Graham was especially bullish, declaring that Obama’s outreach to Republicans — the president invited about a dozen GOP senators to dinner Wednesday night — was “the most encouraging engagement on a big issue I’ve seen since the early years of his presidency.”

If the Senate actually passed a bipartisan solution, it would still have to clear the House, requiring Speaker John Boehner (R-Ohio) to allow yet another bill through with a large number of Democratic votes. But the sequester almost certainly marked the high point of solidarity among House Republicans. Letting it take hold was an easy concession for Boehner to make to more militant conservatives; it kept them from pushing toward a government shutdown or a politically and economically dangerous confrontation over the debt ceiling.

Now comes the hard part for Boehner. Already, more moderate conservatives are pushing back against the depth of the budget cuts that Rep. Paul Ryan will have to propose in order to balance the budget in 10 years. At least some House Republicans may come to see a bipartisan Senate-passed deal as more attractive than the alternatives.

In the meantime, the House passed a continuing resolution on Wednesday to keep the government functioning until the fall. It provided the Defense Department with greater flexibility to handle the automatic cuts. The Senate and the House must agree on a bill by March 27, and Sen. Barbara Mikulski, a Maryland Democrat who chairs the Appropriations Committee, argues that flexibility on defense should be matched on “compelling human priorities” and in other domestic areas, including science and technology. Yet both sides seem committed to keeping the government open, which would create a kind of cold peace.

This, though, would not prevent the automatic cuts from becoming more noticeable, and they are likely to get more unpopular as time goes on. Their effects would be felt by, among others, air travelers, school districts, state governments, universities and the employees of defense and other government contractors. House Republicans representing districts with large military bases are apt to be especially eager to reverse the cuts.

From Obama’s point of view, engaging with Senate Republicans now to reach a broad settlement makes both practical sense, because there is a plausible chance for a deal, and political sense, because he will demonstrate how far he has been willing to go in offering cuts that Republicans say they support. In the process, he would underscore that the current impasse has been caused primarily by the refusal of House Republicans to accept new revenues.

While it’s the GOP that has been using serial, self-created crises to gain political leverage, many in the party are no less worn out by them than the Democrats. “Even we are tired . . . of lurching from one cliff to another,” Sen. John McCain (R-Ariz.)told the Wall Street Journal on Wednesday. “I think that’s lending some pressure towards trying to come up with some kind of a grand bargain.”

Thus does the strongest reason for hope arise from one of the most basic human responses: exhaustion.

“Changing The Culture”: All Women Deserve The Right To Live Free From Fear

President Obama signed the Violence Against Women Act into law on Thursday.

“All women deserve the right to live free from fear,” the president told those in attendance. “That’s what today is about.”

In 2011, VAWA lapsed for the first time since 1994, when House Republicans balked at enhanced protections for undocumented immigrants, Native Americans and members of the lesbian, gay, bisexual and transgender community. Studies have shown that the law — written by then-senator Joe Biden — dramatically reduced domestic violence by as much as 67 percent (PDF).

The law previously had been expanded and renewed twice with broad bipartisan support.

“This is your day. This is the day of the advocates, the day of the survivors. This is your victory,” Obama said. “This victory shows that when the American people make their voices heard, Washington listens.”

The bipartisan Senate bill that included the expanded protections was not even put up for a vote in the House last year. A GOP “civil war” that led to Speaker Boehner breaking the Hastert Rule — which requires a majority of the House majority to support any bill that gets a vote — was required before the bill was finally passed 288-138 earlier in February.

House Republicans also voted on their own version of the law without the new provisions, which failed to win majority support.

The law is so popular that Republican congressman Tim Walberg (R-MI) recently claimed he voted for the law even though he only supported the failed Republican version.

“One of the great legacies of this law is it didn’t just change the rules, it changed our culture. It empowered people to start speaking out,” Obama said.

Despite the continued effectiveness of the law — violence against women is down 64 percent just in the last decade – 1 in 5 women will be raped during their lifetime, the president noted.

“There are still too many women in this country who live in fear of violence,” Biden said in his introduction of President Obama.

Not only does the law improve the criminal justice system’s response to crimes against women, it authorizes about $659 million a year over five years to fund grants for transitional housing, legal assistance, law enforcement training and hotlines.

It also reauthorizes the Trafficking Victims Protection Act, adding stalking to the list of crimes that make immigrants eligible for protection, along with authorizing programs that help college campuses deal with sexual violence.

The president dedicated the victory to the victims of domestic violence.
