“What’s A Speaker To Do?”: The Farm Bill Failure Has Disastrous Implications For John Boehner
It’s hard to understate how much of a setback the farm bill’s surprise failure was for an already dysfunctional and divided House of Representatives.
It showed that House leadership doesn’t have a complete measure of the vote counts for even the most basic bills. It provided embarrassment all the way up to House Speaker John Boehner, who took the unusual step of publicly supporting the bill and voting for it. And it signaled possible turbulence ahead for other larger and higher-profile bills, such as one on the issue of immigration.
The debacle brings up fresh new questions about major legislation passing through the House. If Boehner can’t bring his conference together to move a farm bill through to a conference committee, what does it mean for immigration, debt ceiling, and government appropriations bills looming later this summer and fall?
The looming immigration fight, in particular, parallels the farm bill in many ways, though it could hypothetically have even more disastrous consequences for the Republican Party if it fails.
A similar version of a Senate farm bill that earned bipartisan support in a 66-27 vote failed to pass the House. Soon, an immigration bill that now looks likely to earn more than 70 bipartisan Senate votes could present Boehner with the same problem.
“The two are very different issues. However, the farm bill highlights how complicated things are here in the House,” one House GOP aide told Business Insider.
From here, the farm bill faces one of two likely fates — it could either face extinction, or House leadership could put a modified version on the floor. It’s unlikely, though, that a modified bill will come to the floor, considering that it would likely take more food-stamp cuts to earn Republican votes — something that would scare off Democrats. Most likely, a GOP aide said, a one-year extension will be passed, like both the House and Senate did last year.
A final version of any farm bill, even a one-year extension, will likely need a majority of Democrats to support its passage. The House last passed a farm bill extension as part of the bill to avert the fiscal cliff, which passed with a majority of Democrats supporting it. That overall bill required Boehner to break the Hastert Rule.
On immigration, Boehner will have an even narrower path to navigate. He has pledged to not allow a vote on a bill that does not garner majority support from Republicans. It’s clear that breaking that promise, however, is perhaps the only way a bill would pass through the House to become law — even if the Senate bill is watered down to earn more Republicans’ support.
Doing so would likely mean Boehner would face a revolt from conservative members of his caucus. Already, Rep. Dana Rohrabacher (R-Calif.) has warned him on his speakership.
One Democratic strategist, though, said Boehner might have to be willing to buck the majority of his caucus to do something he feels is necessary for the future of the party. The strategist pointed to comments from Sen. Lindsey Graham (R-S.C.) last weekend, who cautioned immigration reform was necessary to keep the GOP from falling into a “demographic death spiral.”
“He might have to decide between the short-term imperative of keeping his speakership,” the strategist said, “and the long-term imperative of the future of the Republican Party.”

“The Scandal Is In What’s Legal”: Holding Congress Accountable For National Security Agency Excesses
It didn’t generate much attention at the time, but in the closing days of 2012, while most of the political world was focused on the so-called “fiscal cliff,” Congress also had to take the time to reauthorize the government’s warrantless surveillance program. A handful of senators — Ron Wyden (D-Ore.), Jeff Merkley (D-Ore.), Pat Leahy (D-Vt.), Rand Paul (R-Ky.) — proposed straightforward amendments to promote NSA disclosure and add layers of accountability, but as Adam Serwer reported at the time, bipartisan majorities rejected each of their ideas.
In effect, every senator was aware of dubious NSA surveillance — some had been briefed on the programs in great detail — but a bipartisan majority was comfortable with an enormous amount of secrecy and minimal oversight. Even the most basic of proposed reforms — having the NSA explain how surveillance works in practice — were seen as overly intrusive. The vast majority of Congress was comfortable with NSA operating under what are effectively secret laws.
With this in mind, Jonathan Bernstein asked a compelling question over the weekend and provided a persuasive answer: “If you don’t like the revelations this week about what the NSA has been up to regarding your phone and Internet data, whom should you blame?”
There is, to be sure, plenty of blame to go around. The NSA has pushed the limits; federal courts approved the surveillance programs; George W. Bush got this ball rolling; President Obama kept this ball rolling; and telecoms have clearly participated in the efforts.
But save plenty of your blame — perhaps most of your blame — for Congress.
Did you notice the word I used in each of the other cases? The key word: law. As far as we know, everything that happened here was fully within the law. So if something was allowed that shouldn’t have been allowed, the problem is, in the first place, the laws. And that means Congress.
It’s worth pausing to note that there is some debate about the legality of the exposed surveillance programs. Based on what we know at this point, most of the legal analyses I’ve seen suggest the NSA’s actions were within the law, though we’re still dealing with an incomplete picture, and there are certainly some legal experts who question whether the NSA crossed legal lines.
But if the preliminary information is accurate, it’s hard to overstate how correct Bernstein is about congressional culpability.
Towards the end of the Bush/Cheney era, there was a two-pronged debate about surveillance. On the one hand, there were questions about warrantless wiretaps and NSA data mining. On the other, there was the issue of the law: the original FISA law approved in 1978 was deemed by the Bush administration to be out of date, so officials chose to circumvent it, on purpose, to meet their perceived counter-terrorism needs.
In time, bipartisan majorities in Congress decided not to hold Bush/Cheney accountable, and ultimately expanded the law to give the executive branch extraordinary and unprecedented surveillance powers.
In theory, Obama could have chosen a different path after taking office in 2009, but the historical pattern is clear: if Congress gives a war-time president vast powers related to national security, that president is going to use those powers. The wiser course of action would be the legislative branch acting to keep those powers in check — limiting how far a White House can go — but our contemporary Congress has chosen to do the opposite.
This is, by the way, a bipartisan phenomenon — lawmakers in both parties gave Bush expansive authority in this area, and lawmakers in both parties agreed to keep these powers in Obama’s hands. What’s more, they not only passed these measures into law, they chose not to do much in the way of oversight as the surveillance programs grew.
OK, but now that the NSA programs are causing national controversies again, perhaps Congress will reconsider these expansive presidential powers? Probably not — on the Sunday shows, we heard from a variety of lawmakers, some of whom expressed concern about the surveillance, but most of whom are prepared to allow the programs continue untouched.
Indeed, for many lawmakers on the right, the intended focus going forward won’t be on scaling back NSA efforts, but rather, will be on targeting the leaks that exposed the NSA efforts.
Conservatives, in particular, seem especially eager to leave these powers in the president’s hands — even though they have nothing but disdain for this particular president. And as Jon Chait explained, support for the NSA programs from the right will matter a great deal: “The Republican response is crucial, because it determines whether the news media treats the story as a ‘scandal’ or as a ‘policy dispute.'”
Michael Kinsley, referencing campaign-finance laws, once argued that in Washington, the scandal isn’t what’s illegal; the scandal is what’s legal. I’ve been thinking a lot about this adage in recent days.
If the reports are accurate and the NSA is acting within the law, but you nevertheless consider the surveillance programs outrageous, there is one remedy: Congress needs to redraw the legal lines. At least for now, the appetite for changes among lawmakers appears limited, which only helps reinforce the thesis about who’s ultimately responsible for this mess.

“Based On Ambition”: Marco Rubio Decides Whether He Wants To Kill Immigration Reform Or Not
The Senate has just begun the weeks-long process of debating and voting on the immigration reform bill crafted by the “gang of eight.” Harry Reid would like the bill passed on July 4, for the rather obvious symbolism. Supporters are still confident that the bill will pass the Senate.
The best thing the bill has going for it is that Mitch McConnell is going to actually allow it to come to the floor. (Minority Leader McConnell has veto power over most Senate business, because many senators have convinced themselves that the founders wanted him to.) The “gang” has four Republican members, meaning only a few more are needed in order to reach 60 votes and beat a potential filibuster. Kelly Ayotte is one Republican who’s publicly announced her support for the bill.
That assumes, obviously, that all Democrats and all the Republican members of the “gang” vote for their own bill, which might not happen. In fact “gang” member Marco Rubio has threatened to vote against the bill unless it includes “tougher” border security. And amending the bill so that Democrats no longer want to vote for it is one of the Senate anti-reform bloc’s strategies for defeating the bill. Rubio has begun signalling that he supports such an amendment, by Senator John Cornyn, that would increase surveillance and enforcement at the border. More importantly, it would prevent the “trigger” point at which immigrants can apply for green cards, and then citizenship, from happening until a series of incredibly unreasonable security standards are met, including “90 percent of illegal border crossers” apprehended and “100 percent border surveillance, or situational awareness, of each one-mile segment of the Southern border.”
(In Bush’s second term, Cornyn made similar proposals, and then decided not to support reform after all, surprise surprise.)
Meanwhile, Ted Cruz, a right-wing populist Senate newcomer who may want to be president, just like Senator Rubio, has, unlike Rubio, won himself a great deal of conservative affection by declaring himself immigration reform’s greatest enemy in the Senate. In explaining his opposition to Yahoo, Cruz sums up the right-wing argument: If immigration reform fails, Democrats will be to blame, because they insisted that immigration reform actually do something about immigrants:
“The biggest obstacle to passing common sense immigration reform is President Barack Obama,” Cruz tells The Fine Print, going on to say that the White House’s “insistence” on including a path to citizenship is standing in the way of the bill’s ultimate passage.
Cruz has not “ruled out” a filibuster, which means he will filibuster. But then everyone already assumed the bill would require 60 votes to pass.
This is Rubio’s problem: It’s hard to see the GOP changing so much by 2016 that having been essential in passing immigration reform won’t be seen by many conservative activists as a massive liability. Rubio had a “pass” from conservative media figures like Rush Limbaugh to work on this stuff before, because everyone sort of “agreed” immigration reform was necessary. The further we get from November 2012, though, the less urgent it seems, and the nativist factions are reasserting themselves. Mark Krikorian in the National Review and Mickey Kaus at the Daily Caller are trashing Rubio almost every day. This Powerline post is a good example of the sort of press he’s increasingly getting. Rubio is now supporting amendments demanding incredibly strict border enforcement before the “path to citizenship” can begin. This is what conservatives want. The Powerline guy’s headline is “MARCO RUBIO’S LATEST FIG LEAF.” The problem, you see, is that Rubio’s proposed security amendments will rely on the government to enforce them, and you can’t trust the government. There’s not really any pleasing these guys, except, of course, with a bill that provides no path to citizenship at all — which is the Cruz approach.
The calculation now, for Rubio, is a bit complicated. If it looks like something close to the Senate bill can pass the House with Republican support, Rubio is no longer the sole conservative responsible for it happening. He escapes blame. If the Senate bill passes with Rubio’s support and then Boehner decides to get the bill through the House with Democratic votes, Rubio will be branded a traitor to the conservative cause for the rest of eternity. If it passes the Senate and dies in the House, Rubio stuck his neck out for nothing.
When Rubio met behind closed doors with some of the most conservative members of the House, he was less trying to sell the bill than he was getting a feel for the room. As the National Review’s Jonathan Strong says:
Opponents and advocates estimate that 10 to 20 Republican senators are on the fence. Politics, as much as policy, is driving their final calculus. What they need isn’t always some specific change but rather, as one top Republican described it, a “secret sauce” of political cover.
Rubio’s argument is that he’s working to make the bill conservative enough to pass. But aligning himself with people like Cornyn, whose goal is to make the bill totally unpalatable to Democrats, suggests that he’d be fine with simply making the bill unpassable. And right now prospects in the House look grim. Last week, Republicans passed a bill designed to force the administration to deport “Dream” immigrants — people who’ve done well in school or in the armed forces since arriving here as children. Former House “gang” affiliate Raul Labrador quit the group. House Judiciary Committee Chairman Bob Goodlatte, whose committee will have to approve the bill before it reaches the House floor, doesn’t want a comprehensive bill. He wants a series of smaller, stand-alone bills that will allow Republicans to vote for more border security without also voting for “amnesty.” Few Republican members of the House have any personal political incentive to moderate on immigration: Most of their seats are safe.
And in 2014, and 2016, conservative voters won’t be thinking of the long-term demographic health of the Republican party. They’ll just be asking whether Republicans worked with or against this reviled administration. Rubio knows this. His decision to become a key player on immigration was based on his ambition, not any particular principled concern for the undocumented. His ambition will continue to determine his course of action.

“Worried About The Right Wing”: Marco Rubio Threatens To Betray His Allies On Immigration Reform
As we discussed in April, Sen. Marco Rubio (R-Fla.) spent a few months playing an awkward game on comprehensive immigration reform. On the one hand, Rubio has been a high-profile member of the “Gang of Eight,” helping negotiate the details of the legislation. On the other hand, the Florida Republican signaled his willingness to oppose the legislation he’s ostensibly helping write. Rubio would say he likes his own bill, but wouldn’t commit to it.
Many of those involved in the process grew weary of Rubio straddling the fence. It was common to hear Capitol Hill insiders joke that the senator thought he could be “a little bit pregnant” on the policy.
But all that changed in mid-April, when Rubio got off the fence and began championing the legislation he helped craft. And all of that changed again late yesterday when Rubio said he’s prepared to reject his own legislation.
Speaking with radio host Hugh Hewitt Tuesday, Rubio said the Senate should “strengthen the border security parts of this bill so that they’re stronger, so that they don’t give overwhelming discretion to the Department of Homeland Security.” He said he was working with other senators on amendments to do just that.
Then Hewitt asked: “If those amendments don’t pass, will you yourself support the bill that emerged from Judiciary, Senator Rubio?”
Rubio answered, “Well, I think if those amendments don’t pass, then I think we’ve got a bill that isn’t going to become law, and I think we’re wasting our time. So the answer is no.”
Even for Rubio, this is bizarre. The Florida Republican had concerns about provisions related to border security, which he worked out through the “Gang of Eight” negotiations — his colleagues made the changes he wanted to see, which in turn led Rubio to endorse the bipartisan legislation.
But now the senator is moving the goalposts, saying the changes that have already been made aren’t good enough, and unless he’s able to move his bill even further to the right, Rubio is prepared to reject his own legislation.
Well, maybe Democrats can once again give Rubio what he wants, keeping the larger effort intact?
I’m afraid not — Rubio is asking far too much.
Senate Minority Whip John Cornyn intends to introduce a sweeping amendment to the immigration bill when it goes on the floor next week, seeking to replace an entire section devoted to border security and tweak the national security and criminal justice titles.
Sen. Marco Rubio (R-Fla.), one of the members of the Senate’s bipartisan Gang of Eight, has been working with Cornyn on the amendment “for weeks,” a Rubio aide said.
The Texas Republican wants stricter border patrol provisional “triggers” before registered immigrants are allowed to apply for green card status. His amendment would require 100 percent operational control of the Southern borders and that 90 percent of illegal border crossers be apprehended. It would also require 100 percent border surveillance, or situational awareness, of each one-mile segment of the Southern border and installment of a national E-Verify system before registered immigrants can pursue green cards.
No serious person involved in the negotiations believes this is a responsible approach. Indeed, no one even thinks these standards are realistic — it’s exactly why the Gang of Eight considered and rejected these measures during their negotiations. Rubio said they weren’t necessary to earn his support for the legislation, and now he’s saying they are.
He is, in other words, apparently prepared to betray his allies.
And why would Rubio do this? Because the Republican Party’s radicalized base opposes comprehensive reform, and Rubio’s support for the bill will undermine his future career ambitions, including a likely run for national office in 2016. [Update: Adam Serwer notes this is ultimately pointless, since the right will still resent the fact that he helped write a bill they hate, and the left will resent the fact that he walked away from a deal reached in good faith.]
There is an important caveat to all of this: Rubio has waffled before. I don’t recall him going as far as he did with Hugh Hewitt, but the Florida Republican occasionally waffles, only to be brought back into the fold. Reform proponents can hope that McCain and Graham will give him a call this morning, Rubio will walk back his comments from yesterday, and the process will move forward. Rubio isn’t a policy guy, so it’s possible he got rattled yesterday and said what he didn’t entirely mean.
But if we take his words at face value, Rubio has put the future of immigration reform at great risk, basically because he’s worried right-wing activists won’t like him anymore.

“Maybe It’s Just A Coincidence”: Chris Christie’s Self-Serving Senate Election Calendar
So Chris Christie’s announced the schedule for a special election to replace the late Sen. Frank Lautenberg, and short of appointing himself, he’s taken the route most likely to serve his own political interests. Here’s NBC’s report:
Christie announced at a press conference that he had opted against appointing a successor to Lautenberg to serve until the 2014 election, and scheduled a general election on Oct. 16. The primary will be held in August. Christie also said he would appoint an interim senator to serve between now and November, though he explained that he had not decided on that temporary appointee yet.
With this decision, Christie is potentially helping create the conditions for a big win in his re-election contest against Democrat Barbara Buono this November. Without a contested Senate campaign happening at the same time as his own re-election, turnout among Democrats is likely to be far lower, allowing Christie to run up the margin of victory in a race he is already a big favorite to win.
That, in turn, could make him look like a more formidable presidential candidate in 2016 should he choose to run.
Beyond that, it gets Christie off the hook of an obligation to appoint a senator that pleases both his party’s conservative “base” (not just in New Jersey, but nationally) and a general electorate, and gives the former a decent shot to get a conservative senator into office via a low-turnout special election. That will probably, however, be viewed as a consolation prize to right-wingers who wanted him to appoint one of their own to the seat right on up to November 2014 (a legally dubious proposition).
And there’s another problem:
Christie’s decision to hold a special election in October could also be a gamble, leaving the governor open to criticisms of making a self-serving decision and causing a hefty financial cost to the state that could run as high as $24 million for the special election.
Christie said he wasn’t aware of what the cost would be – but in typical Christie fashion, said it didn’t matter.
“I don’t know what the cost would is, and quite frankly I don’t care,” he said. “The cost cannot be measured against the value of having an elected representative in the United States Senate when so many important issues are being debated this year.”
Blah blah blah. Rationalizations aside, Christie looked at the angles and did what was best for Chris Christie. Maybe it’s just a coincidence.
