“A Criminal Regime Of Terror”: A Negotiated Solution In Syria Starts With Congress’ Approval To Attack
A vote by Congress to reject the resolution sought by President Barack Obama to authorize military force in Syria will add to the long list of unintended consequences already produced by bad policy choices on Syria. Among other things, it will kill for the foreseeable future any prospect of a negotiated end to this gruesome, destabilizing, and dangerous conflict. Indeed, the eleventh-hour suggestion by Russia that Syria might put its chemical stockpile under international supervision aims to kill the president’s prospects by offering Congress the alternative of a lengthy, open-ended, and likely inconclusive process, one that would leave Bashar al-Assad’s regime free to return to business as usual: slaughtering civilians in their homes with conventional weaponry.
Let us first stipulate some hard, unpleasant truths. A large majority of Americans either doesn’t care about Syria, thinks the United States has no business doing anything about it, or both. Many in Congress normally inclined to support Obama think that he, of all people, may lead us into armed conflict resembling Iraq or worse. Others in Congress would gladly sink, or at least capsize, the ship of state (at least in terms of the country’s reputation and credibility) as long as Obama is on board. These are the facts the president faces as he tries to make a case for a resolution he need not have put before the Congress in the first place.
As if popular and Congressional apathy over the depredations of the Assad regime were not enough, the president hit a wall of indifference at the G20 gathering in St. Petersburg as well. In addition to the usual defense of the indefensible one would expect from Russian President Vladimir Putin, and the customary “let’s not further militarize this regrettable situation” from others, Obama was forced to endure “let’s have negotiations instead of violence” advice from Pope Francis and United Nations Secretary-General Ban Ki-moon.
Neither the Holy Father nor the Secretary-General was able to identify a way forward to peace talks. This is understandable, because under current conditions none exists. So long as the Assad regime’s strategy of choice remains one of mass terror aimed at populated areas it does not occupy, there is no prospect of dialogue, negotiation, compromise, reconciliation, reason, or peace. This was recognized in late 2011 by former Secretary-General Kofi Annan, who begged the Assad regime to take the initiative in implementing a ceasefire and a series of humanitarian steps. The regime’s latest answer to Annan, Ban, and Lakhdar Brahimi, the UN–Arab League envoy for Syria, was the chemical abomination of August 21.
Obama recognizes, at long last, that a criminal regime endowed with artillery, aircraft, rockets, and missiles will use those delivery systems to visit random death, widespread destruction, and universal terror on innocent civilians. It does so with conventional ordnance that kills and maims with high explosives. It does so with chemical munitions that strangle and smother. It drives millions from their homes, many into neighboring countries. It scars for life, physically and emotionally, those it does not kill outright. So long as this campaign of mass terror continues, it will make it impossible for anyone purporting to represent the opponents of this regime to take part in anything labeled a negotiation. So long as it continues, it is as solid an indicator as one could want that the regime has no interest in negotiating a blessed thing.
Ban, the Pope, and others who earnestly seek peace in Syria are not unaware of the foregoing. They hope, as does Obama, that some combination of Putin and Iran’s Supreme Leader Ali Khamenei will prevail on Assad to knock it off: to spare the innocent and give peace a chance. Indeed, Russia and Iran are free to do so, and by so doing make a U.S. military operation unnecessary and unthinkable. Yet as long as they enable the war crimes and crimes against humanity of the Assad regime, can Obama be faulted if he opts, with Congress’ permission, to neutralize the regime’s tools of terror—its artillery, rockets, missiles, and aircraft?
Contrary to prevailing opinion in the West, the Assad regime and its enablers do indeed think there is a military solution to the Syrian crisis. If Congress denies Obama the option of neutralizing Assad’s tools of terror, it will confirm the view of Assad and his supporters. It will do so by keeping the mass terror machine untouched and in business. For all we know Assad may have already learned his lesson about chemicals. No doubt Tehran and Moscow are mystified by their client’s stupidity. Yet if he returns to the practice of pounding populated areas with vicious impunity, no one should expect Western passivity to produce a negotiated solution to anything.
Russia and Iran should convince Assad to declare a ceasefire, invite UN observers, implement Annan’s humanitarian, de-escalatory steps, and prepare for Geneva. The chances of them doing so are low. They, and any sense of restraint by Assad, sink to zero if and when Congress turns down the president. If there are those in Congress sincerely interested in a negotiated end to Syria’s nightmare, one that can begin to stabilize the region soon instead of decades from now, they will give Obama the authorization he seeks.

“Mitt The Prophet”: Still Pandering, The Romney Camp Shows Its Continued Detachment From Reality
In preparation for a review on 2012 campaign books for the Monthly, I’ve been reading Jonathan Alter’s fine book The Center Holds this week, and have been marveling anew at the detachment from reality exhibited by Mitt Romney and his advisers, culminating in their inability to understand how and why they lost (or even that they had lost, until well after the race had been decided).
So it’s amusing to read McKay Coppins’ BuzzFeed article today indicating that the people who thought they’d be running the country right now are declaring Romney a prophet whose views are being vindicated every day:
From his widely mocked warnings about a hostile Russia to his adamant opposition to the increasingly unpopular implementation of Obamacare, the ex-candidate’s canon of campaign rhetoric now offers cause for vindication — and remorse — to Romney’s friends, supporters, and former advisers.
“I think about the campaign every single day, and what a shame it is who we have in the White House,” said Spencer Zwick, who worked as Romney’s finance director and is a close friend to his family. “I look at things happening and I say, you know what? Mitt was actually right when he talked about Russia, and he was actually right when he talked about how hard it was going to be to implement Obamacare, and he was actually right when he talked about the economy. I think there are a lot of everyday Americans who are now feeling the effects of what [Romney] said was going to happen, unfortunately.”
Give me a break. Nobody in Obama’s camp denied there were issues on which the U.S. and Russia would disagreed, and nobody predicted implementation of Obamacare would be a walk in the park, particularly given the viciously irresponsible determination of Republicans to screw it up while blocking with their House veto the simple legislative “fixes” major legislation always requires. Besides, Romney’s “prophecies” were virtually all throwaway lines aimed at pandering to conservatives to get them off his case so that he could run his campaign on the only issue he cared about: making himself the CEO of the U.S. economy.
Another quote from Spencer Zwick in Coppins’ piece gets at the truth of his and other Romneyites’ complaint:
“It’s frustrating because there’s no way to correct it,” Zwick said. “We don’t do what they do in the U.K. and lead the opposition party when you lose. When you lose there is no way to sort of be vindicated. There’s no way to say, ‘OK, well, I didn’t win the presidency but I’m going to continue to fight.’ There’s no fighting. There’s no platform to do that. Fifty million Americans voted for the guy and yet it’s all for nothing.”
Yeah, it’s tough to go from measuring the drapes in your White House office to being a political outcast with no appreciation from much of anyone in either party and no prospects for another campaign. But please, don’t pretend that the heavily financed mendacious shuffle which the Romney campaign represented from beginning to end was in fact some sort of prophetic stance.

“Rand Paul’s Unique Understanding Of Syria”: Strong Opinions About Another Subject He Doesn’t Really Understand
It wasn’t surprising to see Sen. Rand Paul (R-Ky.) on “Meet the Press” yesterday criticizing the idea of military intervention in Syria. It was, however, interesting to hear his rationale for what U.S. foreign policy should look like in this case.
“I think the failure of the Obama administration has been we haven’t engaged the Russians enough or the Chinese enough on this, and I think they were engaged. I think there’s a possibility Assad could already be gone. The Russians have every reason to want to keep their influence in Syria, and I think the only way they do is if there’s a change in government where Assad has gone but some of the same people remain stable.
“That would also be good for the Christians. I think the Islamic rebels winning is a bad idea for the Christians and all of a sudden we’ll have another Islamic state where Christians are persecuted.
“So I think really the best outcome for all the major powers would be a peaceful transition government, and Russia could influence that if they told Assad no more weapons.”
Paul seemed oddly preoccupied with Christians in Syria — a group he mentioned five times during the brief interview — to the point at which it seemed the senator may be confusing Syria with Egypt, where Coptic Christians have seen their churches burned.
But it was his rhetoric about Russia that was especially out of place.
About 13 years ago, then-Gov. George W. Bush and then-Vice President Al Gore met for the first of three debates, and Jim Lehrer asked about Slobodan Milosevic, who was threatening at the time to ignore his election results and leave office. Bush said it would be “a wonderful time for the Russians to step into the Balkans” and help lead diplomatic efforts.
Gore said that didn’t make any sense — Russia had largely sided with Milosevic and wasn’t prepared to accept the election results. Bush said, “Well obviously we wouldn’t use the Russians if they didn’t agree with our answer, Mr. Vice President.”
“They don’t,” Gore replied, making clear that only one candidate on the stage knew what he was talking about.
I thought about that 2000 debate watching Paul suggest the Obama administration should “engage” Russia to help create a “change in government” in Syria. Indeed, in Paul’s vision, Obama would convince Russia to deny military aid to the Assad government.
How would this happen, exactly? Does Rand Paul realize that Russia and the U.S. are on opposite sides of this, and “engaging” Russians to help oust Assad doesn’t really make any sense? Did the senator not fully prepare for questions about Syria before the interview?
Or is this just another issue in which the Kentucky Republican has strong opinions about a subject he doesn’t really understand?

“And Then There Were Three”: Was A Documentary Filmmaker The ‘Mastermind’ Behind The Snowden Leaks?
Peter Maass of The New York Times has published a long article detailing how documentary filmmaker Laura Poitras helped Edward Snowden leak thousands of classified documents detailing the National Security Agency’s global surveillance apparatus.
What it makes clear is that Poitras’ experience protecting her information enabled Snowden to begin providing documents, and her skills as a filmmaker facilitated him identifying himself.
Basically, Poitras had a much larger role in Snowden’s leaks than previously known. Here’s what we learned:
“I keep calling [Poitras] the Keyser Soze of the story, because she’s at once completely invisible and yet ubiquitous,” Greenwald, referring to the character in “The Usual Suspects” played by Kevin Spacey, a mastermind masquerading as a nobody, told Maass.
When Greenwald began conversing with Snowden in April after he had met with Poitras in New York and installed encryption software on his computer. (Poitras began speaking with Snowden in January, and he got a job as a NSA contractor for Booz Allen in March.)
At that point, Maass writes, their work “was organized like an intelligence operation, with Poitras as the mastermind.”
Greenwald said of Poitras: “None of this would have happened with anything near the efficacy and impact it did, had she not been working with me in every sense and really taking the lead in coordinating most of it.”
Poitras wouldn’t say when Snowden began sending her documents, but she initially received many more than Greenwald (who received about 20).
In May “Snowden sent encrypted messages telling the two of them to go to Hong Kong” and told them that he wanted to go public with his identity.
Glenn Greenwald discovered the top secret order compelling Verizon to hand over all of its call data to the government during the flight to Hong Kong.
Poitras and Greenwald didn’t speak with Snowden between parting ways after he outed himself on June 9 in Hong Kong and early July. He had traveled to Moscow on June 23.
So it’s now clear that the Snowden saga wouldn’t have played out as it has without Poitras.
The article also indirectly touches on a primary mystery: What happened to Snowden between the time he outed himself and when he got on a plane to Moscow two weeks later?
On June 23, with the help of an Ecuadorian travel document obtained through WikiLeaks founder Julian Assange, Snowden landed in the jurisdiction of Russia’s intelligence services (i.e. FSB). He has since been granted temporary asylum and began establishing his life in Russia.
During this time he has been speaking with Poitras and Greenwald — he answered questions from Maass over encrypted chat — but otherwise he has been lying low while his FSB-linked Russian lawyer has been speaking for him.
Consequently, the significance of Snowden’s arrival in Russia is still unknown.

“A Self Styled Decider”: Edward Snowden Got Everything Wrong
Edward Snowden is now out of his limbo at Moscow’s airport, presumably ensconced in some Russian dacha, wondering what the next phase of his young life will bring. Having spent 30 years in the intelligence business, I fervently hope the food is lousy, the winter is cold, and the Internet access is awful. But I worry less about what happens to this one man and more about the damage Snowden has done — and could still do — to America’s long-term ability to strike the right balance between privacy and security.
Ever since Snowden, a former contractor for the National Security Agency, leaked top-secret material about its surveillance programs, he and the U.S. government have locked horns about the nature of those programs.
But those following the Snowden saga should understand two key points. First, though many things need to be kept secret in today’s dangerous world, the line between “secret” and “not secret” is fuzzy rather than stark, and if the goal is security, the harsh truth is that we should often err toward more secrets rather than fewer. Second, despite the grumbling from Snowden and his admirers, the U.S. government truly does make strenuous efforts not to violate privacy, not just because it respects privacy (which it does), but because it simply doesn’t have the time to read irrelevant emails or listen in on conversations unconnected to possible plots against American civilians.
Incidents like the Snowden affair put my former colleagues in the intelligence community in an impossible position. Yes, the official explanations about the virtues of data-collection efforts can sound self-justifying and vague. But they’re still right. I know firsthand that Gen. Keith Alexander, the NSA director, is telling the truth when he talks about plots that have been preempted and attacks that have been foiled because of intelligence his agency collected. I know because I was on the inside, I have long held security clearances, and I participated in many of the activities he describes.
I spent years in the middle of the effort to identify, disentangle, and ultimately attack Al Qaeda. We didn’t operate in secrecy because we were ashamed. We operated in the dark because we had to. Al Qaeda and its affiliates study our actions. They learn from our mistakes. America is safer because we’ve made a point of understanding their methods better than they understand ours.
I understand the trade-offs here. But the intelligence community isn’t keeping things from the American people because we don’t trust them, but rather because once important security information is out there, anyone can access it, including those who would do us harm.
That’s why I find the Snowden controversy so frustrating. I realize many Americans don’t trust their government. I wish I could change that. I wish I could tell people the amazing things I witnessed during my 30 years in the CIA, that I’ve never seen people work harder or more selflessly, that for little money and long hours, people took it for granted that their flaws would be scrutinized and their successes ignored. But I’ve been around long enough to know that deep-rooted distrust of government is immune to stories from people like me. The conspiracy buffs are too busy howling in protest at the thought that their government could uncover how long they spent on the phone with their dear aunt.
Let me break this to you gently. The government is not interested in your conversations with your aunt, unless, of course, she is a key terrorist leader. More than 100 billion emails were sent every day last year — 100 billion, every day. In that vast mass of data lurk a few bits that are of urgent interest and vast terabytes of tedium that are not. Unfortunately, the metadata (the phone numbers, length of contact, and so forth, but not the content of the conversations) that sketch the contours of a call to your family member may fall into the same enormous bucket of information that includes information on the next terrorist threat. As Jeremy Bash, the former chief of staff of the CIA, memorably put it, “If you’re looking for a needle in the haystack, you need a haystack.”
Unfortunately, during the Snowden affair, many news outlets have spent more time examining ways the government could abuse the information it has access to while giving scant mention to the lengths to which the intelligence community goes to protect privacy. We have spent enormous amounts of time and effort figuring out how to disaggregate the important specks from the overwhelming bulk of irrelevant data.
This is done under tight and well-thought-out strictures. I witnessed firsthand the consequences of breaking the privacy rules of my former organization, the National Counterterrorism Center. As the center’s deputy director, I had to fire people, good people, and remove others from their posts for failing to follow the rules about how information could be accessed and used. It didn’t happen often, and it was never a malicious attempt to gather private information. We had mandatory training and full-time staffers to supervise privacy regulations. We used precious resources to hire lawyers and civil liberties experts to oversee our efforts. And on those few occasions when we made mistakes, the punishments were swift and harsh.
Yes, some things that are classified probably don’t need to be. That may undermine public trust and dilute our ability to protect the data that really need protecting. But some things — especially U.S. sources and methods — must be kept secret. Snowden didn’t offer fresh insight about a massive policy failure. Rather, he took upon himself the authority to decide what tradecraft the intelligence community needs to keep his fellow citizens safe. Sadly, Snowden has captured the public’s imagination and attention, and the government’s reaction now seems too little, too late and too reactive. But the intelligence community — always a less sympathetic protagonist than a self-styled whistle-blower — actually has a good story to tell about how seriously the government takes privacy issues. We should tell it.
