“I’m Down With The Trends”: Jeb Bush Wants To Be The Uber Candidate. Here’s The Problem With That

Jeb Bush is desperate for you to know that he is the Uber candidate. The old, 20th century ways are not for him and his bold campaign for the future. He’s sharing a ride to the glorious tech-driven tomorrow.

But what does that actually mean? So far he hasn’t said, but he’s certainly getting the coverage he wants.

The front page of today’s New York Times features a photo of Bush in an Uber car, over a story about Republican candidates embracing the company. It summed up the purpose fairly well:

Republican candidates are embracing Uber not just as a paragon of their free-market ethos and distaste for entrenched, government-protected industries, but also as an electoral strategy for building bridges to traditionally Democratic cities, where the company has thrived. During his visit to the left-leaning city of San Francisco on Thursday, Mr. Bush was ferried around, fittingly, by an Uber driver, who deposited him at a campaign event in a black Toyota Camry. “Thanks for the ride!” Mr. Bush hollered as cameras snapped away.

So what exactly is Jeb trying to communicate about the kind of president he’d be? On the surface, it’s entirely substance-free. It’s just about attitude: I’m hip to what the kids are into, I’m down with the trends, I’m forward-thinking. In that spirit, Jeb took to LinkedIn and mobilized a phalanx of Silicon Valley clichés to proclaim that his economic ideas are super-futuristic.

In a post entitled “Disrupting Washington to Unleash Innovators,” he went on and on about how liberals just want to crush innovation with their dastardly regulations, while he…well, he actually didn’t say anything about what sorts of policies he would pursue as president, other than to proclaim, “I’ve got a different view on things, and a different approach. I don’t mind disrupting the established order.” Ooo, did he say “disrupting”? How disruptive!

The truth, though, is that the president of the United States has no power to influence municipal disputes over taxi regulations, so there is approximately nothing Jeb will do as president to affect the regulations that govern Uber and other ride-sharing companies. And if you don’t feel at least somewhat ambivalent about Uber in particular, you haven’t been paying attention.

On one hand, the company provides a service that people find invaluable, and the local taxi regulations it fights against are often ridiculous (side note: despite the conservative assumption that the government “closest to the people” is the best government, it’s often local governments that are most corrupt and have the most onerous and illogical regulation). On the other hand, Uber’s leadership is apparently a bunch of arrogant jerks whose business model is built around moving into a new market, blatantly breaking the laws that restrain their ability to operate, and then trying to build pressure to get the laws changed. (Catherine Rampell lays out some of these issues well in today’s paper.)

In any case, one thing the federal government does have power over — and thus something Jeb Bush would have the ability to affect if he becomes president — is labor standards, and that’s a genuine policy dispute worth exploring. If Jeb’s right and more and more people will be earning income from companies like Uber, how should they be treated? What standards will apply to them? How are these workers going to obtain the things we ordinarily associate with a job, like health insurance, retirement savings, or paid leave?

Bush hasn’t spoken to these issues yet, but I’m pretty sure I know what his position is: the market will work everything out, and government just has to get out of the way. But we already have evidence that in some ways this approach is screwing more and more people over. It may or may not be appropriate to consider someone driving for Uber part-time to be an employee of the company, but what about a case like FedEx, which for years classified thousands of its full-time drivers as “independent contractors,” meaning the company didn’t have to pay payroll taxes or overtime, and could evade all sorts of other labor regulations? The company suffered a series of losses in court over the issue, and just settled a lawsuit by drivers in California for $228 million. Does Bush think they were in the right, and other companies should be able to just reclassify workers whenever they want?

That’s an example of what the Obama administration is trying to address with a new guidance the Labor Department just released to employers. It says in effect that you can’t just take an ordinary employee who works only for you and has all the conditions of their work controlled by you, and say, “You’re now an independent contractor” and thereby evade all your responsibilities as an employer. This kind of mis-classification has spread to all sorts of industries, with millions of employees finding themselves with fewer benefits, lower incomes, and less protection than the law says they ought to have. Hillary Clinton has endorsed the administration’s effort to crack down on mis-classification, but as of yet the Republican candidates haven’t addressed it. It’s no mystery what they’ll say, though: this is just more government meddling in the market.

There’s a lot more we should hear from Clinton on this topic and how it relates to companies like Uber, particularly since she’s the one more inclined to have government respond to the ways our economy is changing. In her economic speech Monday, she mentioned it briefly, saying: “This on-demand, or so-called gig economy is creating exciting economies and unleashing innovation. But it is also raising hard questions about workplace protections and what a good job will look like in the future.” Which is perfectly true, but it doesn’t tell us what in particular she thinks government ought to do to protect workers as the economy transforms.

I’m sure she’ll have more to say on the subject, and perhaps in response Jeb Bush can explain why government has gone too far out of its way to ensure that workers get a fair shake. Or he might even surprise us and offer a program of smart, nimble regulations that would allow innovative new models of work to flourish while still protecting people from exploitation. But until he says otherwise, we have to assume that Bush’s answer to the question of what government should do to respond to economic changes that can make workers more vulnerable is: “Nothing.”

“Bush ‘Woefully Misinformed’ On Overtime Policy”: The Economy, In Other Words, Is Not Bush’s Strong Suit

With Congress unwilling to pass meaningful economic measures, President Obama’s recently unveiled overtime policy is one of the year’s biggest stories on the domestic economy. Jeb Bush, not surprisingly, doesn’t like it, but he may not fully understand it, either.

To briefly recap, under the status quo, there’s an annual income threshold for mandatory overtime: $23,660. Those making more than that can be classified by employers as “managers” who are exempt from overtime rules. The Obama administration’s Labor Department has spent the last several months working on the new plan, which raises the threshold to $50,440 – more than double the current level.

The policy doesn’t just nibble around the edges; its scope includes roughly 5 million American workers. NBC’s Kristin Donnelly reported the administration’s move constitutes “the most ambitious intervention in the wage economy in at least a decade.”

Campaigning in Iowa this week, Jeb Bush said the policy would result in “less overtime pay” and “less wages earned.” The Guardian did some fact-checking.

Numerous economists attacked Bush’s statement, calling him woefully misinformed. And several studies on the rule contradict Bush’s assertion that the overtime rules would “lessen the number of people working”.

Daniel Hamermesh, a University of Texas labor economist, said: “He’s just 100% wrong,” adding that “there will be more overtime pay and more total earnings” and “there’s a huge amount of evidence employers will use more workers”.

Indeed, a Goldman Sachs study estimated that employers would hire 120,000 more workers in response to Obama’s overtime changes. And a similar study commissioned by the National Retail Federation – a fierce opponent of the proposed overtime rules – estimated that as a result of the new salary threshold, employers in the restaurant and retail industries would hire 117,500 new part-time workers.

The Economic Policy Institute’s Ross Eisenbrey added that Bush “should be embarrassed about how misinformed he was.” Noting that the Republican presidential candidate also said Obama’s policy would also prohibit many bonuses, Eisenbrey added, “All of that is exactly wrong – and pretty much nonsense.”

On a surface level, it’s problematic that Bush would flub the issue so poorly, but it’s even more significant in the context of related confusion about economic policy.

Remember, the Florida Republican remains deeply committed to 4% GDP growth – a target no president has reached in the post-WWII era – despite the fact that the number was basically pulled out of thin air.

Bush picked the growth goal because, as he sees it, four is a “round number.” The fact remains, however, that this is “backed by zero substantive analysis of any kind.”

The former governor still sees himself as some kind of economic expert, thanks to Florida’s growth in the 1990s, but as we’ve discussed before, whether Bush is prepared to admit it or not, Florida’s economic growth during his two terms was the result of a housing bubble. In fact, Paul Krugman accurately described it as “the mother of all housing bubbles – and when the bubble burst (luckily for Jeb! just after he left office) it promptly wiped out 900,000” of the 1.3 million jobs created when Bush was in the governor’s office.

The economy, in other words, is not Bush’s strong suit.

“Jeb Bush Suffers From Foot In Mitt Disease”: As Simple As That, The Beleaguered American Middle-Class Proles Are Slackers

Jeb Bush ought to be running away with the Republican nomination. He isn’t, and his persona as a national candidate looks increasingly — how shall I put this? — Romneyesque.

Bush is supposed to be the safe, establishment-approved choice, which is where the Republican Party usually turns. He and his allied super PAC have raised a phenomenal $114 million thus far. The hot mess that is Donald Trump ought to be sending GOP primary voters toward Bush’s column in droves. But the scion-in-waiting hasn’t yet consolidated the establishment’s support.

Instead, Bush made news for announcing an economic strategy that sounded straight from the Mitt Romney playbook. He told the New Hampshire Union Leader that “people need to work longer hours and, through their productivity, gain more income for their families.”

Simple as that, beleaguered American middle-class proles. You’re slacking.

The echo of Romney’s infamous “47 percent” remark was unmistakable. Bush seemed to blame those struggling in these unsettled economic times for their own predicament. Coming from a man who was born into great wealth and privilege, it was tone-deaf to say the least.

Politically, Bush’s pronouncement was the equivalent of a hanging curveball over the fat part of the plate. Hillary Clinton couldn’t have missed it if she tried.

“Well, he must not have met very many American workers,” the likely Democratic nominee said Monday in a speech outlining her economic policy. “Let him tell that to the nurse who stands on her feet all day, or the teacher who is in that classroom, or the trucker who drives all night. Let him tell that to the fast-food workers marching in the streets for better pay. They don’t need a lecture. They need a raise.”

Bush’s supporters claimed that what the candidate meant to say had to do with the millions of men and women who would like to have full-time jobs but are settling for part-time work — and also the millions who have dropped out of the workforce altogether. But why, then, didn’t he speak of the need to create better jobs for the underemployed? Why did he approach the problem from the opposite angle by blaming the workers for their plight?

There are two possible explanations. One is that Bush, like his father and brother, clearly has a troubled relationship with proper syntax. He may never match George Bush the Younger’s classic mangling of the language — he once said “you got to keep repeating things over and over and over again for the truth to sink in, to kind of catapult the propaganda” — but Jeb appears to have the potential, at least, to match George Bush the Elder for linguistic pratfalls.

When he was reacting to Trump’s anti-Mexican screeds, Bush tried to warn that the Republican Party could not succeed by appearing to be angry and negative all the time rather than sunny and positive. But he couldn’t find some elusive synonym for anger and instead went “grr,” thus creating one of the campaign’s most entertaining sound bites to date.

So maybe the “work longer hours” line was simply the kind of clumsy misstatement that Bush’s aides will spend a lot of time and effort cleaning up in the coming months. But maybe — and this is the other explanation for the remarks — it’s what he really believes.

If any Republican is going to win the White House, I’m confident it won’t be by scolding the middle class for its shortcomings. It is clear that Americans have no problem electing wealthy candidates. But in the 2012 campaign, Romney inadvertently helped define himself, accurately or not, as a rich man who held the less fortunate in contempt. People don’t like that so much.

With Trump (speaking of contemptuous rich men) now drawing the support of up to 13 percent of Republicans in recent polls, you would think the saner factions of the party would be coalescing around an alternative. But they’re still shopping. Wisconsin Gov. Scott Walker, who formally entered the race Monday, is about to have his day in the sun. Sen. Marco Rubio of Florida is still polling well. New Jersey Gov. Chris Christie, former Texas governor Rick Perry and political neophyte Carly Fiorina all have significant establishment support.

All this suggests to me that the GOP mainstream, determined to avoid Romney Redux, hasn’t made up its mind yet about Bush. As his brother once said, “Fool me once, shame on, shame on you. Fool me — you can’t get fooled again!”

“Contempt For Poor People”: Scott Walker Wants To Drug Test Food Stamp Recipients. That Shows Why He’ll Never Be President

Sixteen years ago, George W. Bush presented to America his vision of “compassionate conservatism,” and in response he received an absolute torrent of glowing articles in the media calling him a “different kind of Republican” — conservative, to be sure, but not so mean about it.

Well those days are long past. In the 2016 GOP primaries, it’s compassionless conservatism that’s in fashion.

Or at least that’s what Scott Walker seems to think, because among other things, he is hell-bent on making sure that anyone who gets food stamps in Wisconsin has to endure the humiliation of submitting to a drug test. First the Wisconsin legislature sent him a bill providing that the state could test food stamp recipients if it had a reasonable suspicion they were on drugs; he used his line-item veto to strike the words “reasonable suspicion,” so the state could test any (or all) recipients it wanted. And now, because federal law doesn’t actually allow drug testing for food stamp recipients, Walker is suing the federal government on the grounds that food stamps are “welfare,” and welfare recipients can be tested.

This is why Scott Walker is never going to be president of the United States.

First, some context. The drug testing programs for welfare recipients are usually justified by saying they’ll save money by rooting out all the junkies on the dole, but in practice they’ve been almost comically ineffective. In state after state, testing programs have found that welfare recipients use drugs at lower rates than the general population, finding only a tiny number of welfare recipients who test positive.

But this hasn’t discouraged politicians like Walker, any more than the abysmal failure of abstinence-only sex education discourages them from continuing to advocate it. The test is the point, not the result. Walker isn’t trying to solve a practical problem here. He wants to test food stamp recipients as a way of expressing moral condemnation. You can get this benefit, he’s saying, but we want to give you a little humiliation so you know that because you sought the government’s help, we think you’re a rotten person.

To be clear, there is no inherent connection between drug use and food stamps. There’s a logical reason to drug test people who have other’s lives in their hands, like airline pilots. You can make a case that employers should force ordinary employees to test for drugs, since workers who are high on the job would be less productive (though whether that actually works is a matter of some dispute). But what exactly is the rationale behind forcing people on food stamps to pee into a cup? It seems to be that we don’t want to give government benefits to someone who is so morally compromised as to smoke a joint. But you’ll notice that neither Walker nor any other Republican is proposing to drug test, say, people who use the mortgage interest deduction and thereby have the taxpayers subsidize their housing.

What does this have to do with Walker’s chances of winning a general election? What George W. Bush understood is that the Republican Party is generally considered to be somewhat, well, mean. It’s not welcoming, and it spends a lot of energy looking for people on whom it can pour its contempt. You can argue that this is an inaccurate representation of the party’s true nature, but it is nevertheless what many, if not most, voters believe.

So when Bush campaigned as a “compassionate conservative” and did things like objecting to a Republican plan in Congress by saying, “I don’t think they ought to balance their budget on the backs of the poor,” he wasn’t actually trying to get the votes of poor people and the minorities with whom he posed for innumerable pictures. He was sending a message to moderate voters, one that said: See, I’m different. I’m a nice guy. The fact that there was almost no substance to “compassionate conservatism” didn’t really matter in the context of the campaign. It was about his attitude.

And Scott Walker’s attitude is nothing like George W. Bush’s. He practically oozes malice, for anyone and everyone who might oppose him, or just be the wrong kind of person.

Proposing to force people who have fallen on hard times to submit to useless drug tests has an obvious appeal for a certain portion of the Republican base: it shows that you’re tough, and that you have contempt for poor people. But I doubt that Walker is too worried about how moderate general election voters might view something like that. As Ed Kilgore has noted, Walker’s theory of the general election is a decades-old conservative idea that if you motivate Republicans enough with a pure right-wing message, there will be so many hidden conservatives coming out of the woodwork that you won’t need moderates to win.

This theory persists because of its obvious appeal to hard-core conservatives. It says that they’re right about everything, and compromise is not only unnecessary but counterproductive. So the path to victory is to become even more conservative and even more uncompromising.

The trouble is that this theory has no evidence to support it. Its adherents, of whom Scott Walker is now the most prominent, believe that the reason Mitt Romney and John McCain lost is that they didn’t move far enough to the right (or that they were the wrong nominees in the first place). And they learned nothing from the one Republican in the last two decades who actually won the White House.

“Bomb-Bomb-Bomb Iran”: The GOP Is The Party Of Warmongers; What Its Insane Overreaction To Obama’s Iran Deal Really Shows

Whenever an election season rolls around, we too often hear from trolls, contrarians and cynics who wrongfully announce that both political parties are exactly the same.

Wrong.

One party thinks women should make their own reproductive choices; the other does not. One party thinks LGBT Americans should enjoy equal protection under the law; the other does not. One party thinks higher taxes on the rich and lower taxes for everyone else is good for the economy; the other does not. One party thinks the climate crisis is real, is happening now, and is caused by human activity; the other thinks it’s a hoax while insisting that severe weather events are caused by abortion and gay marriage.

We could do this all day. But the most salient contrast came on Tuesday with the announcement that the P5+1 nations finalized an agreement with Iran regarding its nuclear program. Going back to our party contrasts, one party is seeking at least 15 years of continued peace, while the other party wants to kill the deal, then perhaps, depending on their mood, proceed to “bomb-bomb-bomb” Iran, sparking a war not just between the U.S. and Iran, but involving the entire region, including Russia. Simply put: World War III. And that’s not just my forecast, it’s also the forecast of experts like former Bush-era CIA director Michael Hayden and Meir Dagan, the former head of the Israeli Mossad.

Possibly the most ludicrous reaction from the Republican field came from Lindsey Graham:

“If the initial reports regarding the details of this deal hold true, there’s no way as president of the United States I would honor this deal,” Graham told Bloomberg. “It’s incredibly dangerous for our national security, and it’s akin to declaring war on Sunni Arabs and Israel by the P5+1 because it ensures their primary antagonist Iran will become a nuclear power and allows them to rearm conventionally.”

Discontinuing Iran’s nuclear weapons program is like declaring war on Israel? The projection here is insane. Furthermore, I wonder how Israel would fare if we were to bomb Iran and deliberately collapse the region.

The second most ludicrous reaction came from Jeb Bush:

The nuclear agreement announced by the Obama Administration today is a dangerous, deeply flawed, and short sighted deal.
A comprehensive agreement should require Iran to verifiably abandon – not simply delay – its pursuit of a nuclear weapons capability. […] This isn’t diplomacy—it is appeasement.

That word—”appeasement”—keeps coming up, so let’s take a second to establish some basics. While it’s true that the deal doesn’t eliminate Iran’s nuclear program, as David E. Sanger writes in the New York Times, the deal “is a start,” and a necessary one.

Sanger reports:

Senior officials of two countries who barely spoke with each other for more than three decades have spent the past 20 months locked in hotel rooms, arguing about centrifuges but also learning how each perceives the other. Many who have jousted with Iran over the past decade see few better alternatives.

“The reality is that it is a painful agreement to make, but also necessary and wise,” said R. Nicholas Burns, who drafted the first sanctions against Iran, passed in the United Nations Security Council in 2006 and 2007, when he was undersecretary of state for policy. “And we might think of it as just the end of the beginning of a long struggle to contain Iran. There will be other dramas ahead.”

Negotiations necessarily require compromise, a fact that the Republican field would well consider before they spout off hardline bromides. (Also, perhaps Jeb should’ve double-checked the history of our effort to negotiate a settlement. If he did so, he’d discover that the U.S. first reached out to Iran in 2002 when his brother was president. Oops.)
