“Ignoring Precedent And Denying Reality”: The Court Stacks The Deck Against Minorities

Affirmative action has opened doors for disadvantaged minorities and made this a fairer, more equal society. The Supreme Court under Chief Justice John Roberts apparently wants no more of that.

This week’s big ruling — upholding a Michigan constitutional amendment that bans public universities from considering race in admissions — claims to leave affirmative action alive, if on life support. But the court’s opinion, ignoring precedent and denying reality, can be read only as an invitation for other states to follow suit.

Justice Sonia Sotomayor’s thundering dissent should be required reading. She sees what the court is doing and isn’t afraid to call out her colleagues on the disingenuous claim that the ruling in Schuette v. Coalition to Defend Affirmative Action is limited in scope. It has implications that go beyond college admissions to other areas, such as voting rights, where majorities seek to trample minority rights.

By “rights,” I mean not affirmative action but the principle, upheld repeatedly by the court, that the political process should be a level playing field. In Michigan, with the high court’s blessing, anyone who wants to advocate for affirmative action is at a disadvantage. Instead of banning the policy outright — which would at least be honest — the court paints it with a bull’s-eye and strips it of defenses.

The case involves the University of Michigan — my alma mater, by the way — which has spent nearly two decades trying to defend taking race into account, as one of many factors, in deciding admissions.

The university is governed by an elected board of regents, some of whose members have campaigned on their views for or against affirmative action. Opponents of what they call “racial preferences” tried but failed to elect enough like-minded regents to end the practice, so they proposed an amendment to the state constitution that says Michigan’s public universities “shall not discriminate against, or grant preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin.” Voters approved the measure in 2006 by a wide margin.

This may sound reasonable, even admirable, but here’s the problem: With the amendment, voters changed the political process in a way that unfairly burdens racial minorities.

There was, after all, an existing process for influencing the university’s admissions policies. You could lobby the regents. You could run ads to pressure the board. You could campaign for board candidates who shared your views. You could run to become a regent yourself.

You can still do any of these things if you want to influence the university’s admissions policies in any other way — if you want, say, more places reserved for “legacy” applicants who are the sons and daughters of alumni. But if you want to influence the board in favor of race-sensitive admissions, you have only one option: an onerous, expensive and almost surely futile attempt to amend the state constitution yet again.

As Sotomayor wrote , “The effect . . . is that a white graduate of a public Michigan university who wishes to pass his historical privilege on to his children may freely lobby the board of that university in favor of an expanded legacy admissions policy, whereas a black Michigander who was denied the opportunity to attend that very university cannot lobby the board in favor of a policy that might give his children a chance that he never had.”

If stacking the deck in this manner is acceptable in university admissions, why not in voting rights? Sotomayor’s dissent recounted the long history of attempts by majorities to change the political process in order to deny racial and ethnic minorities the chance to achieve their goals. The court has recognized a duty to protect the process rights of minorities — until now, apparently.

Once Sotomayor dispensed with the other side’s legal arguments, the court’s first Hispanic justice — she is of Puerto Rican descent — gets personal.

Race matters, she wrote, “for reasons that really are only skin deep, that cannot be discussed any other way, and that cannot be wished away.”

She went on, “Race matters to a young man’s view of society when he spends his teenage years watching others tense up as he passes, no matter the neighborhood where he grew up. Race matters to a young woman’s sense of self when she states her hometown, and then is pressed, ‘No, where are you really from?’ . . . Race matters because of the slights, the snickers, the silent judgments that reinforce that most crippling of thoughts: ‘I do not belong here.’ ”

To young people of color, the Roberts court replied: Maybe you don’t.

“The Right’s New Racial Math”: How Its View Of Nonwhite Voters Got So Demented

The news is so depressing for conservatives these days. All the demographic trends are moving against them.With every election showing a large majority of single women, young people and people of color voting for the Democrats, thus solidifying their identification with the party, the less likely it is that Republicans can outrun the shift to a multiracial majority. But they still don’t seem to understand exactly what this means for them.

Take, for example, Michael Medved’s latest in the Wall Street Journal in which he explains that the Democrats’ strategy of wooing women voters by pointing out the GOP’s hostility to reproductive rights and equal pay is nothing but a sham. Sure, Barack Obama won the female vote by a commanding 11 points in the last election but it’s not as if he won a mandate for his message. After all, he lost the white female vote:

A closer look at the numbers reveals that Mr. Obama’s success with the ladies actually stemmed from his well-known appeal to minority voters. In 2012, 72% of all women voters identified themselves as “white.” This subset preferred Mitt Romney by a crushing 14-point advantage, 56% to 42%. Though Democrats ratcheted up the women’s rhetoric in the run-up to Election Day, the party did poorly among the white women it sought to influence: The Republican advantage in this crucial segment of the electorate doubled to 14 points in 2012 from seven points in 2008. In the race against Mr. Romney, Obama carried the overall female vote—and with it the election—based solely on his success with the 28% of women voters who identified as nonwhite. He carried 76% of Latina women and a startling 96% of black women.

The same discrepancy exists when considering marital status. In 2012, nearly 60% of female voters were married, and they preferred Mr. Romney by six points, 53% to 46%. Black and Latina women, on the other hand, are disproportionately represented among unmarried female voters, and they favored Mr. Obama by more than 2-to-1, 67% to 31%.

A similar pattern emerges among young voters, suggesting the president’s popularity among millennials also came from racial minorities, not any special resonance with young people. While nonwhites compose 28% of the electorate-at-large, they make up 42% of voters ages 18-29. Mr. Obama won these young voters handily—60% to 37%. He lost young white voters by seven points, 51% to 44%.

If the majority of women who vote for Democrats are young, single and black or brown, how can anyone say the war on women was a legitimate issue? True, those votes do come in mighty handy Election Day but let’s take a look at the reality: If young, female racial minorities couldn’t vote, the Republicans would win in a landslide!

I’m sure this makes them feel better. The right women are all on their side. Well, actually it’s just a small majority, even by that unfortunate standard: 46 percent of white women went with the Democrats so I wouldn’t be too sure that they’ve got them quite as locked up as Medved supposes.

This isn’t the first time we’ve heard such embarrassing rationalizations coming from the Republicans after a loss. They often explain that they actually won — it was just all those young nonwhites who messed up the proper results. Take this one from Romney’s adviser Stuart Stevens who explained his boss’s loss this way:

On Nov. 6, Mitt Romney carried the majority of every economic group except those with less than $50,000 a year in household income. That means he carried the majority of middle-class voters. While John McCain lost white voters under 30 by 10 points, Romney won those voters by seven points, a 17-point shift.”

There was a time not so long ago when the problems of the Democratic Party revolved around being too liberal and too dependent on minorities. Obama turned those problems into advantages and rode that strategy to victory. But he was a charismatic African American president with a billion dollars, no primary and media that often felt morally conflicted about being critical. How easy is that to replicate?

It’s interesting how he assumed that none of the African-Americans, women and young people who voted for Obama are middle-class. But then that was the campaign that famously derided “the 47 percent” for being parasites so it’s not all that surprising. He also assumes that the “minorities” the Democrats are traditionally “too dependent” upon will not vote in future elections and thus deliver the presidency to the candidate who represents what are apparently the Real Americans: white people who make over 50K a year.

None of this is to say that studying the demographics of the voting public is unacceptable. It’s a big part of American politics, and slicing and dicing the electorate is how the two parties strategize their campaigns and that’s fine. But to constantly bring up the fact that Democrats can’t win if they don’t have the votes of racial minorities and young people implies that there’s something not quite legitimate about it.

As Politico helpfully spelled out for us in 2012:

If President Barack Obama wins, he will be the popular choice of Hispanics, African-Americans, single women and highly educated urban whites. That’s what the polling has consistently shown in the final days of the campaign. It looks more likely than not that he will lose independents, and it’s possible he will get a lower percentage of white voters than George W. Bush got of Hispanic voters in 2000.

A broad mandate this is not.

Right. The popular choice of all racial minorities, unmarried women and urban whites of of all ages isn’t a mandate. It doesn’t include enough of the right kind of votes. You know, the best kind. The older, rural, married white kind. Also known as “Republicans.”

Michael Medved, at least, understands the GOP’s demographic challenge, even as he foolishly discounts the salience of issues that directly affect half the population, regardless of race or age. He counsels the Republicans to forget women and work harder to attract racial minorities. Here’s a tip, free of charge: A good first step would be to stop talking about their votes as if they aren’t quite as valuable as white votes.

“Racism Isn’t Dead”: LBJ’s Civil Rights Act Irrevocably Changed U.S. Landscape

Last week, President Obama and civil rights luminaries went to the Lyndon B. Johnson Presidential Library to celebrate the 50th anniversary of the Civil Rights Act. That legislation, signed in July 1964, was a stunning achievement, a herald of a dramatic transformation in the nation’s social and cultural landscape.

Yet the anniversary comes at a confusing moment in America’s racial journey. While a generation is growing up associating presidential power with a black man, evidence of a pernicious, race-infused backlash is inescapable. And bigotry played a role in the unjust shootings of two young black men, Trayvon Martin and Jordan Davis, who were almost certainly victims of racial profiling.

Few suggest, anymore, that the election of President Obama is evidence of a “post-racial” America in which no one notices skin color or takes into account racial and ethnic heritage. In fact, Obama’s rise has fueled the fears and hatred of a small but vocal minority who believe their America — a country run by and for white heterosexual Christians — is disappearing. If you think I’m exaggerating, just read Pat Buchanan’s 2011 screed, Suicide of a Superpower: Will America Survive to 2025?

It is easy enough to be pessimistic. Harvard political scientist Robert Putnam, who has conducted research on diverse communities, told me he was surprised that Obama’s election had seemed to revive racism rather than quelling it. That revival plays itself out quite vividly in our national politics, where a retrograde faction of the Republican Party dedicates itself to the notion that, if racism still exists, white people are its victims.

Still, it would be foolishly myopic to argue that little has changed in the half-century since President Johnson arm-twisted the Civil Rights Act into history. I’m old enough to remember a landscape that was much more hostile to black Americans, that conspired to limit us in ways too myriad to count. Black and brown millennials don’t know what it means to be refused service in a restaurant, to be shoved to the back to the bus, to be turned away at a hotel because of skin color, to be ushered to a separate (and often filthy) restroom. And their white counterparts would rightly find such policies absurd.

The America that elected Obama is a very different place from the nation over which Johnson presided. Not only do black Americans eat in any restaurant they can afford, but they also star as celebrity chefs on TV. Black men and women preside over corporate boardrooms, head major non-profit institutions and reign as single-name cultural icons.

Yes, there are still major disparities in health and wealth, incarceration rates and even school suspensions. Much work remains before full equality is more than a distant mountain peak. But we ought to be able to discuss the road ahead without pretending that we’ve not made any progress at all. To do that would be to disparage the work of our civil rights heroes and to deny ourselves the inspiration we need to keep plodding along.

Besides, pessimism breeds defeat. It infects its victims with a self-limiting lethargy that fails to take big risks, to reach for the skies, to dream big dreams.

Last month, for example, USA Today profiled high-school senior Kwasi Enin, a first-generation Ghanaian-American who was accepted by all eight Ivy League colleges, an extremely rare accomplishment. Enin has a lot on the ball, but the fact that his parents, as immigrants, likely focused on America’s opportunities — not its race-based limitations — undoubtedly played a role in his remarkable story. That didn’t shield him from any racism prompted by the color of his skin, but it certainly gave him the confidence and the gumption to think he could succeed.

A half-century after Johnson pushed through a law that helped to transform a nation, racism is hardly dead. But it’s a shadow of its former self, a limited force no longer able to define the lives of the nation’s citizens of color. That’s change we can believe in.

“Ryan’s Rhetoric Has Consequences”: First, One Must Understand His Own Culture And History

Reflections upon the recent holiday: The first time my wife saw tears in my eyes was in St. Patrick’s Cathedral, Dublin, at the tomb of Jonathan Swift. The brilliant 18th-century Irish satirist was my first and most enduring literary hero, a towering figure who Yeats thought “slept under the greatest epitaph in history” — composed by Swift himself.

I knew the Latin by heart, but seeing it engraved in stone moved me, although Swift had been dead since 1745. “It is almost finer in English,” Yeats wrote, “than in Latin: ‘He has gone where fierce indignation can lacerate his heart no more.’”

Reading Swift taught me more about Ireland and my Irish-Catholic ancestors than I ever learned at my alcoholic grandfather’s knee, I can tell you that. An Anglo-Irish churchman who considered himself exiled from London to the city of his birth, Swift condemned British misrule of Ireland in the most memorable satires written in English or any other language.

His 1729 pamphlet “A Modest Proposal for Preventing the Children of Poor People in Ireland from Being a Burden to Their Parents” retains the capacity to shock after almost 300 years. Impersonating the ever-so-reasonable voice of a public-spirited reformer of the sort who might today issue proposals from the Heritage Foundation, the narrator advocated genteel cannibalism.

“I rather recommend buying the children alive and dressing them hot from the knife,” he suggested, “as we do roasting pigs.”

It’s the laconic “rather” that chills to the marrow, precisely revealing the pamphleteer’s inhumanity.

Swift was certainly no Irish nationalist. A Tory by temperament and conviction, he’d have been appalled by the idea that the island’s Roman Catholic majority could govern itself. Even so, Professor Leo Damrosch’s terrific new biography makes a compelling case that both his voice and his personal example were instrumental to an evolving Irish national consciousness.

I thought of Swift’s “Modest Proposal” the other day, listening to the ever-so-reasonable Rep. Paul Ryan (R-WI) explain that America’s poor have only themselves to blame. “We have this tailspin of culture, in our inner cities in particular,” Ryan explained, “of men not working and just generations of men not even thinking about working or learning the value and the culture of work.”

Any question who he was talking about? As several commentators have noted, this business about “inner city” men not working isn’t so much Republican “dogwhistle” as GOP air-raid siren.

Ryan has since alibied that he’d been “inarticulate” and wasn’t trying to implicate “the culture of one community.” This came soon after a speech in which he’d told a heartfelt tale of a small boy who didn’t want a “free lunch from a government program,” but a Mommy-made lunch in a brown paper bag that showed somebody cared about him.

Coming from a guy busily trying to cut funding for school lunch programs and food stamps, this was pretty rich. Also apparently, apocryphal. The witness who’d told Ryan the tale in a congressional hearing had not only swiped it from a book called The Invisible Thread, but reversed its meaning. Which wasn’t so much that government assistance, as Ryan warned, threatens to leave children with “a full stomach and an empty soul,” as that sermons mean very little to hungry children.

Delivered just before St. Patrick’s Day, Ryan’s disquisition upon the undeserving poor earned him the scorn of the New York Times’ Timothy Egan. Taking note of Ryan’s great-great grandfather, who emigrated to the United States during the catastrophic Irish famine of the 1840s, Egan pointed out that Ryan’s words echoed the rhetoric of Victorian Englishmen content to let his ancestors die lest they become dependent upon charity.

It’s not always understood in this country that the mass starvation of Irish peasants — more than a million died, and another million emigrated — resulted not from the failure of the potato crop but English government policy. Ireland remained a net exporter of food throughout, with British soldiers guarding shipments of foodstuffs as they were loaded.

Rhetoric, see, has consequences. From Swift’s time onward, the native Irish had been depicted in terms justifying their subjugation. Virtually every negative stereotype applied to our “inner city” brethren today was first applied to Paul Ryan’s (and my own) ancestors. Irish peasants were called shiftless, drunken, sexually promiscuous, donkey strong but mentally deficient. They smelled bad.

Understanding that history is exactly what makes Irish-Americans like Timothy Egan, Charles P. Pierce and me — if I may include myself in their company — so impatient with a tinhorn like Ryan. If he wanted to understand his own ancestry, it’s authors like Swift, Yeats and James Joyce that Ryan ought to be reading, instead of that dismal ideologue Ayn Rand.

Nobody should let ethnic groupthink determine his politics. But if a politician like Paul Ryan hopes to be respected, it would help if he showed some sign of understanding the past.

“A Few More Thoughts On Thug”: The Words We Use Are Often Encoded With Racial Presumptions And Expectations

“I hate that thug music.”

This, according to Rhonda Rouer’s testimony last week, is what her fiancé, Michael Dunn, said when they pulled into a Jacksonville, FL gas station next to an SUV full of black kids who had the stereo up high, pumping some obnoxious, bass-heavy rap.

Rouer was inside the convenience store when she heard the shots. Dunn, who is white, had gotten into an argument with the young men about their music, had gone into his glove box for his pistol, and started shooting. As the SUV tried to get away, he fired still more rounds. At least one of those rounds fatally struck 17-year-old Jordan Davis.

Dunn drove to his hotel. He did not call police. He ordered pizza. The next morning, he drove home to Satellite Beach, 175 miles south, where police arrested him. Dunn claimed he shot at the SUV because Davis threatened him with a gun. Davis was unarmed.

Dunn is now on trial for murder. He’s claiming self-defense in the November 2012 shooting, saying he felt threatened, though his victim wielded nothing more dangerous than the aforementioned “thug” music.

And we need to talk about that word a moment. But first, let’s try a thought experiment: Close your eyes and picture a California girl. Close your eyes and picture a chess prodigy.

Chances are, you saw the former as a sun-kissed blonde in a bikini running along a beach in slow motion and the latter as a studious-looking boy in owlish glasses. Chances are you saw both of them as white.

Now, close your eyes and picture a thug.

It is exceedingly likely the person you pictured was black, like Jordan Davis.

The point is, the words we use are often encoded with racial presumptions and expectations. Thus, your image of a California girl is more likely to resemble Farrah Fawcett (born in Corpus Christi) than Tyra Banks (born in Los Angeles) and your idea of a prodigy will not include Phiona Mutesi, a teenage chess champion from Uganda.

And thus “thug” becomes the more politically correct substitute for a certain racial slur. This is why Stanford-educated black football player Richard Sherman was called a thug for speaking loudly in an interview, but singer Justin Bieber was just a “bad boy” while facing charges of vandalism, assault and DUI.

And it is why, in jailhouse letters released to the media, Dunn uses that word to describe the boy he shot. But he doesn’t stop there. “The jail is full of blacks,” he writes, “and they all act like thugs. This may sound a bit radical but if more people would arm themselves and kill these (expletive) idiots, when they’re threatening you, eventually they may take the hint and change their behavior.”

In other letters he decries the lack of sympathy from the “liberal b—–ds” in the media, and takes heart that the counties surrounding Jacksonville are dominated by white Republican gun owners. He writes, “The jail here is almost all black prisoners. You’d think Jacksonville was 90-95 percent black judging by the makeup of the folks in jail here!”

What he describes, of course, is the great Catch-22 of African-American life. They decide you’re a thug from the moment you’re born, so they lock you up in disproportionate numbers. Then they point to the fact that you are locked up in disproportionate numbers to prove that you’re a thug.

Michael Dunn is a hateful man, condemned as a racist by his own words and deeds. But that’s his problem. Ours is that this sickness is not confined to him. And that it causes blindness, rendering sufferers unable to see what is right in front of them.

So one can only wonder with dread how many of us gaze upon this man who shot up an SUV full of unarmed kids, then fled the scene, and see a victim.

And how many will see a “thug” in a teenager just trying to dodge the bullets.
