“Who Gets Overtime Pay”: The Next Policy To Help The Middle Class That Republicans Will Oppose

Lately, Democrats have been searching for new ways to appeal to working class and middle class voters on economic issues. They know their basic economic perspective is popular, but they worry that the few specific policies they advocate, like increasing the minimum wage, don’t touch enough people’s lives. They also worry about being seen as advocates for the poor but not the middle class. So they’re looking for ideas.

But there’s one policy change already in the pipeline that looks as though it could be the next big Democratic economic push. It’s got everything: the potential to affect millions, guaranteed opposition from business groups, and the specter of another executive action from President Obama. That last point means that the change can be made as soon as the administration wants, and that Republicans will be apoplectic when it happens.

It’s about who gets overtime pay, which has all but disappeared from American workers’ paychecks. But maybe not for long.

A little background: Under the Fair Labor Standards Act, workers are supposed to be paid overtime (time and a half) if they work more than 40 hours a week. That doesn’t apply to executives and managers, or workers whose salaries exceed a certain threshold. The threshold is what’s at issue; it has only been raised once since 1975. The current threshold is $455 a week, or $23,660 a year — under the poverty level for a family of four. If you make more than that, you’re ineligible for overtime pay. Today only around one in ten American workers is eligible for overtime pay, compared to 65 percent of workers who were covered in 1975.

So what some are proposing is to raise the threshold back to something like what it used to be. Raising it to what it was in 1975, adjusted for inflation, would mean a level of $984 a week, or $51,168 per year, which is close to the median family income. According to the Economic Policy Institute, at that level over six million Americans would become eligible for overtime pay. Raise it a bit higher and you could cover millions more.

This March, President Obama instructed the Labor Department to reexamine the rules and propose a revision, and the department’s decision should be coming some time soon. And an organized campaign to promote it looks to be developing. Today in The Hill there’s an op-ed arguing for changing the overtime rules by Nick Hanauer, a liberal billionaire venture capitalist who could become an important figure in the economic arguments we have over the next few years. Unlike many other major political funders like the Koch brothers, Hanauer doesn’t just give other people money — he’s putting himself out as an advocate.

Many people first heard of Hanauer a few months ago when he wrote an open letter addressed to “my fellow filthy rich,” challenging the notion that the wealthy got where they are because of their unusual virtue and telling them that they had to start working to combat inequality in America). It looks like Hanauer wants to be a player in this debate, and he has the money to make an impact.

So don’t be surprised if a lot of elected Democrats suddenly start talking about overtime rules. This issue is more than an arcane piece of labor law. It gets to the heart of the insecurity and dissatisfaction Americans feel with their economic lives and prospects. It’s been repeated to the point of cliché that Americans feel like they’re working harder but not getting ahead. The lack of overtime is one key reason why. It’s one thing to work 50 or 60 hours a week and know that it means you’ll have extra money in your pocket. But if your boss tells you to come in on Saturday to finish up those TPS reports and you get nothing from it, it’s hard not to feel powerless and exploited.

For Democrats looking for specific policy moves that will demonstrate their desire to help middle-class Americans, the overtime pay issue looks like an excellent candidate, not only because it would mean more money for regular people but also because it would push the dynamics of power, compensation, and dignity a little bit back in the direction of workers.

Republicans will argue that raising the threshold infringes on the prerogatives of business owners, and that Obama is a tyrant for using the regulatory process to make the change. But I’m guessing Democrats would be happy to have that debate, so they can show that they’re trying to help the middle class. And at the end of the debate, the administration can issue the rules, and there’s nothing Republicans will be able to do to stop it.

“Coaching Sessions Have A Long Way To Go”: Rick Perry; ‘Running For The Presidency’s Not An IQ Test’

Texas Gov. Rick Perry (R) is wrapping up his 14-year tenure as his state’s chief executive – the longest such tenure in Lone Star State history – and as he gets ready to launch a second national campaign, the governor is talking more to the national media. The goal, in all likelihood, is to help reintroduce Perry in the wake of his failed 2012 presidential bid.

It’s off to a curious start.

The recently indicted Texas Republican talked with the Washington Post earlier this week, for example, “for a wide-ranging 90-minute interview.” It was a reminder that Perry hasn’t quite shaken off some of his bad habits.

Last week, Perry studied income inequality and economic mobility with experts Scott Winship, Erin Currier and Aparna Mathur. In the Post interview, he was asked about the growing gap between rich and poor in Texas, which has had strong job growth over the past decade but also has lagged in services for the underprivileged.

“Biblically, the poor are always going to be with us in some form or fashion,” he said.

I’m not a Biblical scholar, but I can find no Scriptural references to the notion that that the poor “are always going to be with us.” [Update: see below]

Perry acknowledged that the richest Texans have experienced the greatest amount of earnings growth, but dismissed the notion that income inequality is a problem in the state, saying, “We don’t grapple with that here.”

I suppose that’s true – in order to “grapple with” a problem, policymakers have to at least try to address it – though the fact remains that income inequality has gotten much worse in Texas in recent years, and a 2012 analysis of income trends published by the Center on Budget and Policy Priorities found that Texas was the nation’s seventh-worst state when it comes to the gap between rich and poor.

The governor’s new interview with msnbc’s Kasie Hunt was arguably even more informative about Perry’s progress as a national candidate.

For example, Hunt asked the governor, quite candidly, “Are you smart enough to be president of the United States?” He replied:

“Running for the presidency’s not an IQ test,” he said. “It is a test of an individual’s resolve. It’s a test of an individual’s philosophy. It’s a test of an individual’s life experiences. And I think Americans are really ready for a leader that will give them a great hope about the future.”

I’m a little surprised the governor didn’t reply with a more direct, “of course I’m smart enough” answer.

As part of the same interview, which was conducted Tuesday, Hunt asked Perry about the torture report released by the Senate Intelligence Committee. The governor’s answers didn’t quite bring his position into focus. For example, Perry sounded like he opposes torture:

“I agree that what happened to John McCain was abhorrent. It is inhumane. And the United States Government should never ever condone that type of activity. America has a record, going all the way back to George Washington when George Washington said that those British soldiers need to be treated with respect.”

And Perry also sounded like he understands Bush-era torture.

“But in the fog a war, you think back to 2001, and George W. Bush standing on that pile a rubble after he had talked to mothers and fathers and wives, loved ones of Americans who’d been killed by these soulless terrorist – you think back to Abraham Lincoln, suspending habeas corpus – you know, in retrospect, you know, sometimes decisions made in the fog a war, we can criticize ‘em, some years later.

And then Perry switched back, sounding like he opposes torture.

“But I think more importantly here is that the message that America is not going to be– like ISIS and cut the throat of innocent children– that we’re not going to– commit heinous acts, is clearly a message that Americans want to hear…. I respect [John McCain] for standing up and saying America will not be involved in torture. ‘No one in this country will ever do to any combatant what they did to me.’ And I totally agree with that.”

And then asked whether waterboarding is torture, Perry changed the subject.

“One of the most important things, though, that we need to do as a country, is that when the leader of the United States says, ‘Here’s a red line,’ that that’s what it means. Words matter. And hollow words hurt us as a country. They hurt us as an ally. And the words that come out of the president of the United States need to mean something.”

By all accounts, the Texas governor is meeting regularly with advisers who are helping him shape his agenda and vision. The coaching sessions apparently have a long way to go.

“Lift Yourself Up”: Rand Paul Wants To Prevent Another Ferguson By Scolding The Poor

Rand Paul begins his Time op-ed about Ferguson with a good point: One concrete way politicians can lessen discrimination in the criminal justice system is by reforming policing practices and the war on drugs. “Michael Brown’s death and the suffocation of Eric Garner in New York for selling untaxed cigarettes indicate something is wrong with criminal justice in America,” the Kentucky senator writes. “The War on Drugs has created a culture of violence and put police in a nearly impossible situation.”

But Paul’s meandering argument unravels from there. Going into full libertarian mode, he writes that “we all hold a certain degree of responsibility for our lives and it’s a mistake to simply blame others for our problems.” He says, unbelievably, that “no law” can possibly reform the criminal justice system. Then he points to the “link between poverty, lack of education, and children outside of marriage is staggering and cuts across all racial groups.”

It sounds a bit like another one of his rambling speeches. And then there’s this:

I have no intention to scold, but escaping the poverty and crime trap will require more than just criminal justice reform. Escaping the poverty trap will require all of us to relearn that not only are we our brother’s keeper, we are our own keeper. While a hand-up can be part of the plan, if the plan doesn’t include the self-discovery of education, work, and the self-esteem that comes with work, the cycle of poverty will continue.

Paul is essentially arguing that escaping poverty is not just a matter of criminal justice reform, but of character reform, too, on both the individual and community level. Of course, in scolding the poor, he also manages to scold government assistance. Lift yourself up, he’s saying, because the government can’tand shouldn’tdo it for you.

Paul’s references to “lack of education” and single parenthood are the only nods toward the systemic socioeconomic issues that make it so hard to escape poverty. And character’s hardly the reason for it. For starters, it’s the lack of job training and opportunities, inner-city schools’ inability to attract top talent, and the struggle to put enough food on the table (the link between learning and nutrition is well documented). And guess who has the power and means to address many of these problems? The very government whose laws Paul has no faith in.

“When Will They Ever Learn?”: Republicans Finally File Lawsuit Against Obama – And Stand To Gain Almost Nothing

Back in June, House Republicans announced, with deep regret yet great fanfare, that they were going to sue Barack Obama over his tyrannical usurpation of power. The suit was never actually filed; two lawyers the House had hired ended up quitting, and it looked as if it would fade away.

Then this week Republicans announced that they had found another lawyer to take the case, George Washington University law professor Jonathan Turley, who says he’s a liberal but has become an intense critic of the Obama administration. Just four days later, the lawsuit has finally been filed:

House Republicans filed a long-threatened lawsuit Friday against the Obama administration over unilateral actions on the health care law that they say are abuses of the president’s executive authority.

The lawsuit — filed against the secretaries of the Health and Human Services and Treasury Departments — focuses on two crucial aspects of the way the administration has put the Affordable Care Act into effect.

The suit accuses the Obama administration of unlawfully postponing a requirement that larger employers offer health coverage to their full-time employees or pay penalties. (Larger companies are defined as those with 50 or more employees.)

In July 2013, the administration deferred that requirement until 2015. Seven months later,the administration announced a further delay, until 2016, for employers with 50 to 99 employees.

The suit also challenges what it says is President Obama‘s unlawful giveaway of roughly $175 billion to insurance companies under the law. According to the Congressional Budget Office, the administration will pay that amount to the companies over the next 10 years, though the funds have not been appropriated by Congress. The lawsuit argues that it is an unlawful transfer of funds.

Call me cynical, but I can’t help but think that the newfound urgency to move ahead with the suit has something to do with President Obama’s immigration order. If conservative Republicans aren’t satisfied with whatever confrontation their leaders manage to create with Obama over immigration, John Boehner can say, “Don’t forget, we’re suing him!”

But what do Republicans get if they win this suit? Not much more than a symbolic victory. The actual complaints in the suit were always strange — they’re suing Obama for delaying the employer mandate, a provision they despise. If they won, he’d be forced to speed up implementation of the mandate, even as Republicans are pressing to eliminate it altogether. And by the time the suit winds its way through the courts, the issue will probably be moot. The mandate for employers with over 100 workers goes into effect in January (though they are only required to cover 70 percent of their employees, and almost all companies of that size already provided coverage even before the law was passed). And the mandate for the mid-size companies goes into effect in a year. By the time the case is heard by a high court, the remedy it’s seeking will probably have already taken place.

As for the other of the suit’s complaints, on cost-sharing subsidies, if Republicans are successful in killing them it would mean that poor people would have to pay more in copays and deductibles. But unlike the subsidies in three dozen states that are at issue in the King v. Burwell lawsuit, which the Supreme Court recently agreed to hear, this provision isn’t critical to the law’s basic functioning. So apart from the satisfaction some Republicans might receive from making life harder for the working poor, even if they win this lawsuit they won’t have dealt the ACA a serious blow.

Legal experts who have looked at this suit haven’t found much merit in it, particularly on the claim about the employer mandate. Federal agencies frequently delay the implementation of far-reaching regulations while practical problems are worked out. But even if they prevail, all Republicans stand to gain is the ability to say that they beat Barack Obama in court. Which may be more than nothing, but it isn’t much more than that.

“The Parties Of No”: Then And Now, Dire Consequences For The Nation’s Poorest Citizens

In 1874, Republicans suffered one of the greatest electoral reversals in American history, losing 170 seats and their commanding House majority to the Democratic opposition. Although not apparent at first blush, the recent Republican victory has a great deal in common with this Democratic landslide 140 years earlier. And if history is any guide, the upcoming Congressional realignment will again have dire consequences for the nation’s poorest citizens.

Although the conservatives of the post-Civil War era went under the banner of the Democratic Party, their policies and strategies were similar to today’s Republicans. Both exploited ailing economies and unpopular administrations in the White House to advance their programs of obstruction and fiscal retrenchment.

Above all else, what unites 19th-century Democrats and 21st-century Republicans is their dogged opposition to federal spending, especially on social services for the nation’s neediest. Today’s Party of No has attempted to block the Obama administration on a number of these measures — from food stamps and welfare to unemployment benefits and health care — even at the risk of a national credit default.

Yet long before today’s Republicans made obstruction their raison d’etre, Gilded Age Democrats turned “No” into a political rallying cry, and, in the process, rolled back some of the era’s most important social reforms.

One of their first targets was the Freedmen’s Bureau, a federal agency established in 1865 to aid the nation’s recently emancipated slaves. In providing rations, medical care, education and employment opportunities to freed African Americans, the Bureau was one of the great progressive institutions of the era, despite a chronic shortage in funding.

Democrats, however, protested vigorously with arguments that, to this day, remain central to the conservative critique of federal intervention on behalf of blacks. Nineteenth-century Democrats stressed that self-help, not dependence on the federal government, was the only path forward for African Americans, and that such so-called charity would injure the “character” and “prospects” of a newly emancipated class of citizens. They insisted that public spending on a single group was not only unfair, but financially unsustainable as well. One newspaper captured several of these concerns by dubbing the Bureau a “department of pauperism.” In 1872 Congress abruptly shut down the Bureau, and with that, millions of freed slaves lost one of their only allies in the struggle against violent racism in the South.

One hundred and forty years has done relatively little to shift the conservative position on taxation. Reducing the tax burden on the rich is a Republican mainstay, even as income inequality soars to Gilded Age-esque extremes. Meanwhile, Tea Party-affiliated politicians like Ted Cruz promote a flat tax, which would put disproportionately greater strain on lower earners.

Although they lacked the Reaganite vocabulary of trickle-down economics, 19th-century conservatives similarly pushed for lowering taxes on the rich. After the Civil War, Southern conservatives shifted the burden onto the poorest citizens, namely freed slaves. Whereas taxes on landed property were astonishingly low (.1 percent in Mississippi, for example), blacks often had to pay poll or “head” taxes that could amount to a substantial portion of their yearly income. The result was a system in which wealthy landholders could end up paying less overall in taxes than the hired hands who worked their land.

On the issue of voting rights, today’s Republicans have more in common with Gilded Age Democrats than any current political party should. As many have pointed out, the voter ID laws backed by Republican policymakers disproportionately affect poor people, minorities, and college students, key constituents in the Democratic base. Conservative efforts in this regard may not mark the return of Jim Crow, as some have suggested, but they certainly undermine key provisions of the Voting Rights Act of 1965.

Like today’s Republicans, yesterday’s Democrats recognized the electoral gains to be made in keeping certain voters from the polls. Thus they waged a national campaign against black male voting rights, which had been secured in 1870 by the 15th Amendment. In particular, they exploited the Amendment’s vagueness by introducing literacy, property and educational tests to severely limit black suffrage and thereby inaugurate the age of Jim Crow by the turn of the century.

To be clear, Republicans today differ from their conservative predecessors in certain crucial respects. No serious Republican leaders currently advocate the systematic disfranchisement of an entire race, nor would they condone the sort of racial violence that conservatives deployed in post-Civil War America.

Nonetheless, the parallels are disconcerting. Once again a bitter American electorate has empowered a party without an apparent political vision beyond repeals and rollbacks. And once again that party pursues the regressive goal of lowering taxes on the rich while dismantling federal programs for the poor.

When Americans gave up on the possibility of progressive reform in the 1870s, they ushered in an age of rapidly growing racial and economic inequality. We can only hope the repercussions won’t be so serious this time around.
