“Perry Case Complicates Boehner’s Lawsuit”: Republicans Arguing One Thing For Perry, And The Exact Opposite For Obama
The indictment of Governor Rick Perry of Texas and his subsequent court case are about to complicate things politically for John Boehner. No matter the actual outcome of Perry’s case, the arguments made by Perry and his supporters are going to provide an easy equivalence with Boehner’s plans to sue President Obama — an equivalence that would not have existed had Perry not been indicted.
Perry is making the claim that the entire thing is just a partisan witchhunt, driven by out-of-control Democrats in the liberal enclave of Austin. He may succeed in convincing the public of this — and it remains to be seen whether this will help or hurt Perry among Republican primary voters in the upcoming presidential contest. So far, he has signaled that he’s going to wear it as a Republican badge of honor — standing up to liberals trying to tear him down in the courts. Here is Perry’s lawyer, summing up this defense:
The facts of this case conclude that the governor’s veto was lawful, appropriate and well within the authority of the office of the governor. Today’s action, which violates the separation of powers outlined in the Texas Constitution, is nothing more than an effort to weaken the constitutional authority granted to the office of Texas governor, and sets a dangerous precedent by allowing a grand jury to punish the exercise of a lawful and constitutional authority afforded to the Texas governor.
He is arguing that the voters entrusted Perry with executive powers, which Perry then faithfully exercised, and that the case against him is nothing more than Democrats fighting a partisan battle that they already lost at the ballot box.
Now, I should explicitly point out that I have no idea what the actual facts are and until a jury hears the case, it is impossible to know whether the indictment was partisan overreach or not. I’m not going to argue the facts of the case here, to put this another way — we’ll all have plenty of time to do so as the case makes its way through the legal system in the months to come. I’m instead focusing only on the politics of the case.
Perry and his defenders are going to be making the case for strong executive power, which (they will say) is supposed to be executed without the interference of the courts. That’s Perry’s argument in a nutshell, and so far he has not been shy about strongly making this argument himself.
But this is going to become a major political stumbling block for House Republicans when John Boehner actually files his own lawsuit against President Obama. Because they’ll be arguing that, in Texas, the executive should be allowed to execute his powers without interference from the courts; while at the same time arguing that on the national level the courts should indeed interfere with the executive attempting to exercise his powers. The parallels are going to be obvious to all, in fact.
Again, the facts of both cases won’t even really enter into the discussion much, because while one party thinks the Texas case is weak, the other party is going to say the same thing about Boehner’s case. The real argument, in both cases, is: Should this be the way politics works? At what point should political arguments be handled by the justice system? Perry’s case is all about politics from beginning to end. Boehner’s case will be too.
Republicans were counting on Boehner’s case to whip their base voters into a frenzy, right before the midterm elections. They were all set to pronounce the righteousness of their position, using the justice system to rein in an otherwise-unchecked president. That’s going to be a lot tougher sell now, especially since it is scheduled to happen after weeks and weeks of discussing the merits of the case against Perry. Republicans will be denouncing using the justice system against an executive in purely partisan fashion, and then they’ll have to start arguing that John Boehner has every right to use the justice system against an executive in purely partisan fashion. The turnabout will be so dramatic it might induce whiplash.
To the casual observer of politics, the two cases are going to sound an awful lot alike. Some Democrats, perhaps realizing this, have already expressed doubts about the case against Perry. The woman at the heart of the case isn’t exactly a “poster child” character, since video exists of her drunk driving arrest, which doesn’t exactly inspire confidence in her personality. To defend the case against Perry means also having to defend her, which is why some Democrats are already backing away from this one.
But Republicans won’t be able to back away so easily from Boehner’s case. This isn’t some squabble in one faraway state; this is national politics. The speaker of the House will be suing the president of the country, which can’t be written off as some sort of parochial affair. House Republicans are already on the record, having voted to proceed with the lawsuit right before the August break. For some Republicans, the lawsuit won’t even go far enough — Boehner is already walking a tightrope with Republicans who want to see him impeach Obama. Boehner won’t be able to back down, to put this another way.
But now the argument for suing Obama is going to get more complicated than anyone could have foreseen. Perry’s case is going to prepare the ground with the public, and provide Democrats with an easy response: “How is this case any different than Perry’s?” Republicans are going to be arguing one thing for Perry, and the exact opposite for Obama. This is going to become more and more obvious to all concerned, in fact.
The best Boehner can hope for, at this point, is that Perry’s case moves very, very slowly. Maybe everyone will forget about it if there is no breaking news from Austin in the next month or so. My guess, however, is that Democrats will be more than ready to remind everyone of the similarities between the two cases, and how Republicans are taking positions in the two which are completely contradictory. The Perry case — again, no matter how it turns out — has certainly made it a lot more politically complicated for Boehner to move forward with his lawsuit.

“A Self-Accredited Ophthalmologist”: The Most Credible Candidate For President … Since Henry Clay
Kentucky’s annual Fancy Farm picnic is one of the state’s biggest political events, and this weekend was no exception. Rachel Kleinman had a helpful report on some of what transpired at the gathering.
But there was one quote from the weekend’s festivities from Senate Minority Leader Mitch McConnell (R-Ky.) that stood out for me. The Republican leader, who’s in a very tough re-election fight this year, reportedly had this to say about his fellow Kentuckian, Sen. Rand Paul (R-Ky.).
“I can say this without fear of contradiction: He is the most credible candidate for president of the United States since Henry Clay,” the minority leader reportedly told a county GOP breakfast earlier Saturday, a reference to the Kentucky senator who ran unsuccessfully for president in 1824, 1832 and 1844.
Sam Youngman, a political reporter for the Lexington Herald-Leader, also heard McConnell make the comment, though Youngman believes the senator probably meant the most credible presidential candidate out of Kentucky since Clay.
To be sure, Henry Clay was an accomplished public servant and an exceedingly credible presidential candidate – at different points in his career, Clay was a state legislator, a U.S. House member, a Speaker of the U.S. House, a U.S. senator, and the U.S. Secretary of State. Not too shabby.
Rand Paul was a self-accredited ophthalmologist up until four years ago, when he was elected to the U.S. Senate. To date, he has no major legislative accomplishments to speak of and he’s held no other public office.
I can appreciate McConnell wanting to say nice things about his in-state partner, but referencing Paul and Clay in the same sentence seems like a bit of a stretch.
Of courses, the fact that McConnell would even draw such a comparison in the first place speaks to a larger truth.
It’s easy to forget, but in 2010, McConnell desperately hoped Rand Paul would lose. The party establishment, including the Senate Minority Leader, enthusiastically backed Kentucky Secretary of State Trey Grayson in the GOP primary and assumed he’d win with relative ease.
That, obviously, didn’t happen, and the McConnell-Paul relationship has always been strained.
But when it comes to campaign politics, McConnell is no fool – he and his team can read a poll as easily as anyone else, and they realize that statewide, Rand Paul is far more popular than McConnell. As such, we see the Minority Leader running around making claims he almost certainly doesn’t believe, including the odd notion that Paul “is the most credible candidate for president of the United States since Henry Clay.”
As for the junior senator from the Bluegrass State, Paul apparently sees the partnership as a marriage of convenience. Earlier this year, during an appearance on Glenn Beck’s program, the host asked the senator about his McConnell endorsement. “Uhh, because he asked me,” Paul said. “He asked me when there was nobody else in the race. And I said yes.”

“Why The Border Crisis Is A Myth”: Another Justification To Play To Anti-Immigrant Voters In The Fall Elections
To hear the national news media tell the story, you would think my city, El Paso, and others along the Texas-Mexico border were being overrun by children — tens of thousands of them, some with their mothers, arriving from Central America in recent months, exploiting an immigration loophole to avoid deportation and putting a fatal strain on border state resources.
There’s no denying the impact of this latest immigration wave or the need for more resources. But there’s no crisis. Local communities like mine have done an amazing job of assisting these migrants.
Rather, the myth of a “crisis” is being used by politicians to justify ever-tighter restrictions on immigration, play to anti-immigrant voters in the fall elections and ignore the reasons so many children are coming here in the first place.
In the last month, about 2,500 refugees have been brought to El Paso after crossing the border elsewhere. The community quickly came together to support the women and children and Annunciation House, the organization coordinating the effort.
Contrary to the heated pronouncements, this is nothing we haven’t seen before. Groups of refugees arrive by plane and are processed by Immigration and Customs Enforcement. When they are released, Annunciation House takes them to a shelter where they get a shower, a place to sleep, meals and even health care — all provided by volunteers and private donations.
The families of the refugees also help, often paying for travel costs and taking them into their homes. The refugees then move on, to Florida, Georgia, New York or elsewhere.
While the numbers of refugees arriving in El Paso are a fraction of the number arriving in McAllen, in southern Texas, the chain of events is generally the same. Like El Paso, South Texas is not the permanent destination for these refugees. And the response from McAllen’s citizens has been generous, too.
The same can’t be said of our politicians. What we are hearing from Austin and Washington is an almost Pavlovian response to immigration concerns. My governor, Rick Perry, a Republican, announced this week that he was sending 1,000 National Guard soldiers, at a cost of $12 million a month, to bolster the border.
And despite President Obama’s efforts to work with Central American leaders to address the root causes of the migration, his recently announced request for $3.7 billion, supposedly to deal with these new migrants, contains yet more border security measures: Almost $40 million would go to drone surveillance, and nearly 30 percent of it is for transportation and detention.
In Texas, state legislators and the Department of Public Safety are planning to spend an additional $30 million over six months to create a “surge” of state law enforcement resources, an expenditure that some in our state’s Capitol would like to see made permanent.
The costs are significant. Every day we detain an undocumented child immigrant, it costs Immigration and Customs Enforcement — i.e., the taxpayer — $259 per person, significantly more than we spend to educate a child in a middle-class school district.
The irony is that this cash-intensive strategy comes from leaders who consistently underfund health care, transportation and education. And they ignore the crucial fact that children crossing our borders aren’t trying to sneak around law enforcement: They are running to law enforcement.
What is most alarming, however, is the attempt to erode rights and protections created by intelligent, humane legislation.
The debate is centered on the Trafficking Victims Protection Reauthorization Act, a law signed by President George W. Bush to provide legal and humanitarian protections to unaccompanied migrant children from countries other than Mexico or Canada. The act passed with bipartisan support, yet the “crisis” is now being cited by some of the same legislators who supported the law as a reason to repeal or change it.
This effort to take away rights that were granted when there was significantly less anti-immigrant fervor isn’t just shortsighted and expensive, it’s un-American. We can debate the wisdom of providing greater protection to Central American children than to Mexican children, but there can be no doubt that giving safe haven to a child facing violence in a country that cannot protect its most vulnerable citizens is what a civilized country, with the resources we possess, should do.
Our border communities understand this. I hope the rest of the country, including our leaders in Austin and Washington, can follow our lead.

“How Did The GOP Turn Into Such A Bunch of Clowns?”: Lurching From One Strategic Screw Up To The Next
For a lot of reasons, the current era will probably be seen as unusually consequential in the history of the two parties, particularly the GOP. For Republicans, it has been a time of ideological hardening and bitter infighting. But one aspect of the Republican dilemma hasn’t gotten as much attention as those: This is a time of unusual, even stunning, Republican political incompetence.
Let me back up for a moment, to put what I’m saying in context. As the 2012 election approached, liberals began to understand just how deluded many conservatives were about empirical reality, and in ways that could do them serious political damage. It’s one thing to deny climate change (a denial that may benefit you and your allies), but if you convince yourself that you’re going to win when you’re actually going to lose, you’re hurting no one but yourself. When they began to rally around a guy claiming to “unskew” the 2012 presidential polls that showed Barack Obama heading for a victory, liberals had a great time ridiculing them. But then it turned out that even within the Romney campaign—including the candidate himself—people who were supposedly hard-nosed political professionals had convinced themselves that it was just impossible they could lose, whatever the polls said. As seen in an unforgettable bit of election-night television, Karl Rove, the party’s most celebrated strategist, refused to believe that Romney had lost even when Fox News called the race for Obama.
Once the race was over, there was some soul-searching within the GOP about their loss, but most of it concerned the party’s image as a bunch of unfeeling, out-of-touch white guys who couldn’t appeal to young voters and Hispanics. (Needless to say, this is a problem they’ve yet to solve,) There was some discussion about the conservative information bubble and the distorting effects it can have, but nothing changed—lots of conservatives still get their news from Fox and Rush Limbaugh, and assume that everything in the New York Times is a lie.
There seems to be little question that the alternative media universe they built, which was once a strength for the right, has become a liability. But their biggest problem now isn’t the things so many conservatives believe about the world that aren’t true, or what they think will happen that won’t. It’s about the strategic decisions they make, and where those decisions come from. Think about it this way: Has there been a single instance in the last few years when you said, “Wow, the Republicans really played that one brilliantly”?
In fact, before you’ll find evidence of the ruthless Republican skillfulness so many of us had come to accept as the norm in a previous era, you’ll need to go back an entire decade to the 2004 election. George W. Bush’s second term was a disaster, Republicans lost both houses of Congress in 2006, they lost the White House in 2008, they decided to oppose health-care reform with everything they had and lost, they lost the 2012 election—and around it all they worked as hard as they could to alienate the fastest growing minority group in the country and make themselves seem utterly unfit to govern.
In fact, in the last ten years they’ve only had one major victory, the 2010 midterm election. But that didn’t happen because of some brilliant GOP strategy, it was a confluence of circumstance; the natural tendency for the president’s party to lose significant numbers of seats two years after he’s elected, and the stagnant economy would have meant a big GOP victory no matter what they did.
Since then they’ve lurched from one strategic screw-up to the next, the root of which is almost always the same: It happens because they’re deluded into thinking that the country shares their particular collection of peeves and biases.
In fairness, this is a challenge for both parties and, indeed, for everyone involved in politics. When politics is your life, it’s hard, if not impossible, to think like an ordinary, inattentive voter thinks. When you’ve spent so much time convincing yourself that you’re right; the idea that anyone else who’s even remotely fair-minded wouldn’t agree can seem nothing short of absurd. It can be hard to persuade people when you can’t put yourself in their shoes.
But again and again, Republicans seem shocked to find out that Americans aren’t on the same page with them. They’re flummoxed when the public doesn’t rise up in outrage to demand more answers on Benghazi. They’re befuddled when shutting down the government turns into a political disaster. They’re gobsmacked when the electorate doesn’t reject Barack Obama for saying “you didn’t build that,” and even more amazed when he gets reelected. And in between, they can’t come up with any strategy to accomplish their goals, whether in policy or elections. Again and again, they think the American public is going to see things their way, and when the public doesn’t, they never seem to learn anything from it.
It isn’t always pure bumbling; there are times when the GOP follows an unwise strategic path not because of miscalculation, but because of unavoidable internal dynamics within the party. For instance, they’ve failed to pass comprehensive immigration reform not because party leaders don’t understand the political necessity of doing so, but because most members of the House come from conservative districts where comprehensive reform is unpopular, and therefore it makes sense for them to oppose it.
It would be too simple to put the GOP’s recent string of missteps and disasters down only to the struggle within the party, which yields a course ultimately determined by its radical wing. It is important that Tea Partiers, while being very good at figuring out how to make life miserable for the rest of their party, are abysmal when it comes to devising strategies for appealing to the country as a whole. But it’s equally relevant that the supposedly more pragmatic and experienced conservatives haven’t found a way to handle the snarling beast on their right flank and turn the whole ghastly mess into something that can fight Democrats with any modicum of success.
This shows no sign of changing. They’re going to win seats this November, but once again it won’t be because they came up with some brilliant strategy. If they win the Senate it will be because Democrats are defending more seats this year, many of which are in conservative states. (Two years from now when that situation is reversed, Democrats will almost certainly take back the Senate if they lose it this year.) Republicans will probably gain a few seats in the House, but don’t forget that in 2012, they retained their sizeable majority despite getting fewer votes nationwide than Democrats: Their advantage there is baked into the distribution of congressional districts.
And look at the people lining up to run for the White House in 2016. Does any one of them seem like the kind of brilliant politician who can navigate the deadly obstacle course of a two-year long presidential campaign and win over a majority of American voters, including millions who aren’t already on board with his party’s agenda? Who might that be? Ted Cruz? Rand Paul? Bobby Jindal? Rick Perry? Facing that collection of political samurai, Hillary Clinton must be positively terrified.
There are still plenty of smart Republicans out there. But the days when Republicans would run circles around Democrats, outdoing them in fundraising, messaging, organizing, and every other aspect of campaigning and politics, are a fading memory. The 2010 election may have blinded us to how long it’s really been since they set out to achieve a political goal and made it happen through their acumen and judgment. I’m sure that one day the GOP will get its strategic mojo back. But it could be a while.

“The Koch-Tested, Koch-Approved Version”: Paul Ryan’s Faux Populism Isn’t Going To End Poverty Or Reduce Inequality
Paul Ryan’s fellow Republicans are quick to dismiss Elizabeth Warren as too radical, too progressive, too populist.
But Ryan is trying—a bit clumsily, but trying all the same—to borrow a page from the Massachusetts senator as he seeks to remake himself in anticipation of a potential 2016 run for the Republican presidential nomination. He’s talking about poverty, about inequality, about shifting the focus away from meeting the demands of corporations and toward meeting the needs of Americans.
Mitt Romney’s running mate is abandoning Romneyism for populism—or what former Secretary of Labor Robert Reich has referred to as “Paul Ryan’s Faux Populism.”
Instead of repeating the Mittnomers of 2012—“Corporations are people, my friend”—Ryan is suddenly informing fellow conservatives, “There’s another fallacy popular among our ranks. Just as some think anything government does is wrong, others think anything business does is right. But in fact they’re two sides of the same coin. Both big government and big business like to stack the deck in their favor. And though they are sometimes adversaries, they are far too often allies.”
It is hard to argue with Ryan’s reasoning. Populists and progressives have warned for more than a century that corporations are “boldly marching, not for economic conquests only, but for political power.” The author of those words, former Wisconsin Supreme Court Justice Edward Ryan , asked in 1873: “Which shall rule—wealth or man; which shall lead—money or intellect; who shall fill public stations—educated and patriotic free men, or the feudal serfs of corporate capital?” Elizabeth Warren confirmed Ryan’s worst fears when she addressed Netroots Nation last week and declared, “The game is rigged and the rich and the powerful have lobbyists and lawyers and plenty of friends in Congress. Everybody else, not so much.”
And now, Paul Ryan is on-message, announcing as only a career politician can, that “our country has had enough of politics.” He’s proposing to “reconceive the federal government’s role in the fight against poverty.” And he is even ripping corporations, decrying the way in which big government has become “a willing accomplice” of big business.
Ryan explained last week at Hillsdale College’s Center for Constitutional Studies and Citizenship session that “crony capitalism isn’t a side effect; it’s a direct result of big government.”
Grab the pitchforks!
But don’t look for Paul Ryan on the front lines of actual fights to reduce inequality or address injustice.
The House Budget Committee chairman, who on Thursday released an “anti-poverty proposal” that rehashed decades-old schemes to scale back anti-poverty initiatives and regulatory protections for low-income Americans, offers scant evidence of a serious determination to solve the problems that have got Americans up in arms. If Ryan was serious, he wouldn’t be proposing, as his “Opportunity Grant” plan does, to “consolidate” existing federal programs to aid the poor into block grants to the states—an approach that would allow Republican governors who have already shown a penchant for undermining healthcare, food-stamp and education initiatives the “flexibility” to do even more harm.
Congressman Chris Van Hollen, a Maryland Democrat who serves with Ryan on the Budget Committee, nails it when he warns about a proposal that “uses the sunny language of ‘reform’ as a guise to cut vital safety-net programs.”
So if the congressman is not worried about developing a serious response to the problem of inequality, what is on his mind?
Ryan is worried about solving his own problem: an association in the public’s mind with the failed messages of the 2012 Romney-Ryan campaign.
Last week’s populist speech at the Center for Constitutional Studies and Citizenship and this week’s poverty speech at the American Enterprise Institute begin the roll-out of Paul Ryan Version 2.0. Next comes the August publication of Ryan’s 2016 campaign book, The Way Forward: Renewing the American Idea, complete with its epic cover shot of Americans reaching out to touch a triumphal Ryan. Then there’s the bus tour.
Yes, the bus tour.
So Ryan is campaigning. To the extent that it is possible he will do so in populist style and with populist rhetoric about crony capitalism and fighting poverty.
But don’t be confused.
This is still the same Paul Ryan who went to the floor of the House in 2008 and rallied Republicans to support the Wall Street bailout. This is still the same Paul Ryan who opposed regulation of the big banks. This is still the same Paul Ryan who supported and continues to support) the free trade deals demanded by multinational corporations. This is still the same Paul Ryan who has peddled Social Security, Medicaid and Medicare “reforms” that would turn sound programs into vehicles for steering federal funds into the accounts of Wall Street speculators and health-insurance corporations.
This is still the same Paul Ryan who during the current election cycle has padded his campaign committee and “leadership PAC” accounts with almost $9 million in donations—with Wall Street securities and investment interests and the health-insurance industry giving most generously. And this is the same Paul Ryan who, when Congress took its August break in 2013 jetted home to Wisconsin via Arizona—where he was a featured speaker at the annual retreat for billionaire donors organized by the Koch brothers.
The other featured speaker was then–House majority leader Eric Cantor, for whom the ensuing months did not go well. Cantor’s Republican primary defeat—at the hands of a critic of “crony capitalism”—provided an indication that the American people are increasingly agitated. And increasingly disinclined toward the sort of insider politics practiced by career politicians such as Ryan.
Ryan got the signal.
He is rebranding himself.
He has downloaded some populist rhetoric to go with his “kinder, gentler” talk about poverty.
But Paul Ryan’s populism is not the real thing. It’s the Koch-tested, Koch-approved version.
