“The Political Situation In Ferguson Is Toxic”: Underlying Causes Of Ferguson Need To Be Addressed

Missouri is the Show-Me State.

It says so right on our license plates. We Missourians like to think this slogan captures our strength of character, our down-to-earth sensibility and skeptical savvy.

Very different qualities have been on display lately. Missouri has become synonymous with violence and misgovernment in the mayhem that has spiraled since the shooting death of Michael Brown in August.

We’re a national embarrassment. In the days following Brown’s shooting, protesters marched peacefully — and some looted — and police met them with excessive and militarized force.

After the St. Louis County prosecutor announced last week that charges would not be brought against Darren Wilson, the police officer who killed Brown, again protesters marched peacefully — not just in Ferguson, Missouri but across the nation — while others looted, rioted and set buildings aflame. This time there were actual soldiers on the streets of Ferguson to face down residents.

The killing of Michael Brown has become a politically divisive issue. In some ways it is a Rorschach test for racial and political points of view. Some regard Brown as one more casualty at the hands of a racist police force that demonizes all young black men as thugs. Others see him as a genuine thug who died in a scuffle that easily could have left a policeman dead instead.

In this charged atmosphere, nobody expected the grand jury’s decision to satisfy both sides — and it didn’t. The quality of the evidence it was shown, it has to be said, was not good. Accounts were contradictory, and in the end the jurors seem to have relied on Wilson’s account most of all.

The mass media coverage, especially the 24/7 cable TV treatment, has played Ferguson for all the drama it can provide. Eventually, the media will tire of the Ferguson story, yet the resentments will remain, as will the conditions that inspired them.

Nobody believes that Michael Brown will be the last unarmed black man to be shot down by a policeman with dubious cause. This happens everywhere in the United States. That’s why, in the days following the grand jury’s decision not to indict, protests and mass demonstrations were held in Atlanta, Chicago, Boston, New York, Denver, Los Angeles and many other cities.

People of every race were among the protesters marching peacefully in solidarity with similar peaceful protesters in Ferguson. Not with the rioters, not with the lawless, but with the far greater numbers that have gathered, peacefully, every day since Brown died in early August.

The object of their frustration is policing that does more to agitate communities than to protect them. People have seen too many instances of questionable encounters between police and people winding up severely hurt or dead.

This is not a new storyline.

What’s new is that many of the protest events were not led by the usual suspects—civil rights leaders, politicians and media-versed clergy. It was young people, 20-somethings often either still in college or recently graduated, who organized protests by tapping networks cultivated previously through social media.

What comes next is crucial. Mass demonstrations serve a purpose, but organizing for change is what solves problems.

The first step in Ferguson ought to be a massive voter-registration drive. This was attempted but wasn’t successful in the initial days after the shooting. The appeal should be simple. Don’t like the elected officials you have? OK, vote them out. Feel that you’re not represented on the city council or in the ranks of the police? Standing in the street yelling won’t accomplish it. You need to make change happen, and voting is the first step.

The political situation in Ferguson is toxic. Like a lot of smaller towns in America, it generates a disproportionate amount of its revenue through fines. Despite a recent decision to eliminate some fines, the city still puts police in the structural role of the Biblical tax collector, stopping and ticketing citizens for relatively minor infractions, and issuing arrest warrants when they don’t or can’t pay their fines. It also so happens that a disproportionate number of tickets are given to black residents. This heavy hand, squeezing citizens for their hard-earned money, is not just or healthy for the body politic. But it’s hard to see how it will be reformed unless the majority in Ferguson first exerts its power and throws the bums out.

Everyday misgovernment does not inspire the outrage that a police killing does. But the resentment it causes year after year adds to the explosive charge when the spark is supplied. Ferguson may have flamed out. It could very well wind up a footnote, a trivia question for future generations. Or perhaps something else may happen. Maybe once all the cameras are gone, local residents, working with national civil rights organizations and others, will do the hard work of taking government back for the people.

Ferguson might then become a laboratory of democracy … and show the rest of the country how to do it.

“Justice Is Not An Unreasonable Desire”: Eric Holder; Problems Exposed By Ferguson ‘Threaten The Entire Nation’

The problems put on display after the death of Michael Brown in the small St. Louis suburb of Ferguson, Missouri, in August “are truly national in scope and that threaten the entire nation,” Attorney General Eric Holder said in a speech on Monday.

Holder, speaking at Ebenezer Baptist Church in Atlanta, said the nation needs to confront the broken relationship between many law enforcement agencies and the communities that they are supposed to serve.

“Broadly speaking, without mutual understanding between citizens — whose rights must be respected — and law enforcement officers — who make tremendous and often-unheralded personal sacrifices every day to preserve public safety — there can be no meaningful progress,” Holder said in prepared remarks. “Our police officers cannot be seen as an occupying force disconnected from the communities they serve. Bonds that have been broken must be restored. Bonds that never existed must now be created.”

Holder, who plans to resign as the nation’s top law enforcement official if the Senate confirms U.S. Attorney Loretta Lynch as his replacement, visited Ferguson back in August. His Justice Department has launched an investigation into the practices of the Ferguson Police Department, in addition to a separate ongoing federal investigation into the shooting of Brown by former Ferguson Police Officer Darren Wilson.

In his speech on Monday, Holder said that the “overall system of justice must be strengthened and made more fair” to ensure faith in the justice system.

“Without that deserved faith, without that reasoned belief, there can be no justice. This is not an unreasonable desire — it is a fundamental American right enshrined in our founding documents,” Holder said.

Calling 18-year-old Brown’s death a “tragedy,” Holder said it “sparked a significant national conversation about the need to ensure confidence in the law enforcement and criminal justice processes” and exposed rifts that “must be addressed — by all Americans — in a constructive manner.”

Holder condemned the looting and destruction that took place around Ferguson last week, saying it was “deeply unfortunate that this vital conversation was interrupted, and this young man’s memory dishonored, by destruction and looting on the part of a relatively small criminal element.”

Holder said that “acts of mindless destruction are not only contrary to the rule of law and the aims of public safety; they threaten to stifle important debate, ‘adding deeper darkness to a night already devoid of stars,'” referencing a quote from Dr. Martin Luther King Jr. “They actively impede social progress by drowning out the legitimate voices of those attempting to make themselves heard. And they are not consistent with the wishes of Michael Brown’s father, who asked that his son be remembered peacefully.”

Holder called on “those who seek to lend their voices to important causes and discussions, and who seek to elevate these vital conversations, to do so in ways that respect the gravity of their subject matter.”

“These are the moments that remind us of the values that bind us together as a nation. These are the times — of great challenge and great consequence — that point the way forward in our ongoing pursuit of a more perfect union,” Holder continued. “And these are the lights that will help us beat back the encroaching darkness — and the stars that will guide us, together, out of this storm.”

“Acting On Our Collective Fears”: Darren Wilson; America’s ‘Model Policeman’

Truth is stranger than fiction; it is also most certainly harder to accept.

In a nearly hour-long interview with ABC’s George Stephanopoulos on Tuesday, a day after thousands of protesters took to the streets from coast to coast, expressing outrage that yet another white police officer got away with the murder of another unarmed black person, Wilson stuck to his story: “I just did my job. I did what I was paid to do. I followed my training…. That’s it.”

Sure, there are plenty of reasons to doubt his account. If he knew Michael Brown was a robbery suspect, why did he politely stop him and Dorian Johnson for jaywalking only to “have a conversation,” as he described to Stephanopoulos? If the West Florissant section of Ferguson is “really a great community,” why did he testify that it was a not very “well-liked community” and a hotbed of anti-police sentiment?

And yet, despite all the equivocations, the shooting death of the teenager on August 9 and Monday’s grand jury decision not to indict Wilson were entirely unsurprising. They are the predictable outcomes of a criminal justice system doing exactly what it was meant to do. For all the dissecting and debating of the veracity of Darren Wilson’s grand jury testimony this week, one thing seems crystal clear. He was in fact doing his job.

Indeed, by this standard, isn’t Darren Wilson actually a model police officer?

He certainly thinks so. When asked by Stephanopoulos if he could make “something good” come of this experience, he said he would “love to teach people” and give them “more insight in uses of force.” That he may have logged more time on first-person shooters—emptying clip after clip to take down demonic super-villains who “run through shots”—than actual police work is beside the point. Darren Wilson has the kind of experience that many Americans value.

Evidence abounds that the United States is the world’s most punitive nation. More people are behind bars and incarcerated at higher per capita rates here than anywhere in the world. African-Americans are the nation’s prime suspects and prisoners. White police officers are our chosen protectors, enforcing the law in the name of public safety.

In a Pew research poll conducted shortly after Ferguson made national headlines this summer, researchers found that most Americans have a “fair amount of confidence in local police.” Eighty-five percent of respondents, white and black, gave a fair to excellent rating on police “protecting people from crime.” And on “using the right amount of force,” 66 percent of respondents gave a fair to excellent rating; white support stood at 73 percent and blacks at 42 percent. Though a clear racial divide exists, African-Americans are only 13 percent of the population nationally. Everyone is therefore implicated in police performance writ large, if not by choice, certainly through political representatives.

Critics and protesters of police violence among African-Americans and on the political left, as polling data suggests, see things differently. They are organizing against the routine killing of unarmed men and beating of helpless women on an unprecedented scale not seen since the anti-lynching movement of the last century. Even with such evidence in hand that black men are twenty-one times as likely to be killed by law enforcement than white men, as analyzed in a recent report by ProPublica, today’s movement like the one before it might fail to overcome deeply entrenched fears of black criminality without a massive shift in white public opinion and a new model for law enforcement.

Most whites do not realize they are reading from very old racial scripts. When Ida B. Wells, the world’s leading anti-lynching activist and black social worker of the early twentieth century, tried to explain to a wealthy suffragist in Chicago that anti-black violence in the nation must end, Mary Plummer replied: blacks need to “drive the criminals out” of the community. “Have you forgotten that 10 percent of all the crimes that were committed in Chicago last year were by colored men [less than 3 percent of the population]?”

Like Mary Plummer, Darren Wilson is emphatic that the issue is not racism. Brown’s African-American neighborhood is “one of our high-crime areas for the city,” he said during the interview. “You can’t perform the duties of a police officer and have racism in you. I help people. That’s my job.” On that day, “the only emotion I ever felt was fear,” before my training took over. “We are taught to deal with the threat at hand.”

Implicit bias research tells us that most Americans are afraid of black people and subconsciously associate dangerous weapons and animals with them. They see things often that are not there. Stanford psychologists Rebecca Haley and Jennifer Eberhardt note in a study last month that the more people perceive blacks as criminals or prisoners, “the more people fear crime, which then increases their acceptance of punitive policies.”

The truth is that Wilson has no regrets. He wouldn’t do things differently. He’s looking forward to a new chapter in his professional journey as a teacher, trainer or a consultant. He’s our representative figure—a model policeman—acting on our collective fears.

“Let’s Talk About ‘Black On Black’ Crime”: African-Americans Long Oppressed By What Might Be Called “America On Black” Crime

OK, fine. Let’s talk about “black on black” crime.

That, after all, is where the conversation seems to inevitably turn whenever one seeks to engage a conservative on the American habit of shooting unarmed African-American boys and men. So it was exasperating, but nowhere near surprising, to see former New York City mayor Rudy Giuliani go there last week on Meet the Press.

Asked by host Chuck Todd, during a discussion of the Michael Brown shooting in Ferguson, Missouri, about the fact that African-American communities like that one are often served by snow-white police departments, he offered some perfunctory words about the effort to produce more representative cop shops. But then Giuliani took a sharp turn off topic and into the brambles. “I find it very disappointing,” he told Todd, “that you’re not discussing the fact that 93 percent of blacks in America are killed by other blacks. … I would like to see the attention paid to that that you are paying to this.”

There followed a sharp exchange with another panelist, author and professor Michael Eric Dyson, which produced this parting shot from the mayor: “The white police officers wouldn’t be there if you weren’t killing each other.”

Somehow, he managed not to call Dyson “you people.” In nearly every other respect, Giuliani’s words reeked of a paternalistic white supremacy unworthy of a former mayor of America’s largest city — or even a sewer worker in its remotest Podunk. But again, this has become the go-to “reasoning” for those on the right — Sean Hannity, Lou Dobbs, Rush Limbaugh — when asked to give a d–n about the killings of unarmed black boys and men.

That formulation is false for multiple reasons.

In the first place, being concerned over the shooting of unarmed black men hardly precludes being concerned over violence within the African-American community. Giuliani and others suggest a dichotomy where none exists.

In the second place, they ignore the obvious: When black people commit crimes against black people, they face prosecution, but when police officers (or certain neighborhood watchmen) commit crimes against black people, they face getting off with little if any punishment.

In the third place, what exactly is “black on black” crime?

Do black people kill one another? Sure they do. Ninety percent of black murder victims are killed by black assailants.

But guess what? White people kill one another, too. Eighty-three percent of white victims are killed by white assailants. See, the vast majority of violent crime is committed within — not between — racial groups. Crime is a matter of proximity and opportunity. People victimize their own rather than drive across town to victimize somebody else.

So another term for “black on black” crime is “crime.”

But there is crime and there is crime.

Redlining, loan discrimination and predatory mortgages have stripped generations of wealth from the African-American community. What is that if not robbery?

The Republican Party practices policies of voter suppression. That’s the assault and battery of African-American political rights.

Mass incarceration criminalizes the very existence of black men and boys. That’s the rape of equal justice.

Unarmed people are killed by those who are purportedly there to protect and serve them and the “just us” system looks the other way. That’s the murder of basic human rights.

It is touching that Giuliani and others are so concerned about black-on-black crime. But African-Americans have also been long oppressed by what might be called “America on black” crime.

When do you suppose they’ll be ready to talk about that?

“The Deck Is Stacked In Favor Of The Police”: Given Every Benefit Of The Doubt, Which Rarely Happens In Other Criminal Cases

Once more a police officer is not being held legally accountable for a killing. There are so many instances of this. Earlier this year, two Fullerton, Calif., police officers were found not guilty of all charges in the killing of Kelly Thomas, a homeless man who had been diagnosed with schizophrenia. Medical records show that bones in his face were broken and he choked on his own blood; the compression of his thorax by the police made it impossible for Thomas to breath and deprived his brain of oxygen.

In the wake of the grand jury’s choice to not indict the Ferguson, Mo., police officer Darren Wilson, the question must be asked as to why so often juries, and grand juries, rule in favor of the police, even when there is strong evidence of police misconduct. With a videotape of a savage beating, a California jury acquitted the four officers who beat Rodney King and a subsequent federal court jury acquitted two of them.

It is only when police officers are being investigated that the criminal justice system seems to operate most like it is supposed to in protecting the rights of suspects. Grand juries are meant to be a check on prosecutors. But in reality grand juries usually do whatever prosecutors want and generally are presented only evidence supporting an indictment. In Ferguson, however, the prosecutor presented all of the evidence and deferred entirely to the grand jury.

There is supposed to be a presumption of a defendant’s innocence in every criminal investigation. All too often, though, prosecutors and judges and even juries act with the assumption of a defendant’s guilt. By contrast, when the defendant is a police officer, there is a strong presumption of innocence. There is great deference to the split-second decisions of the officer in the field, even when the force seems clearly excessive. The officer is given every benefit of the doubt, which rarely happens in other criminal cases.

The problem is that the law gives too much deference to police conduct and does not do nearly enough to hold the police accountable. This also is true when police are sued by victims for money damages in civil court. A number of legal rules make it very difficult for victims of police abuse to successfully sue.

The events in Ferguson have focused national attention on the problem of excessive police force. It must be a catalyst for a careful analysis of why the legal system fails to achieve justice for victims of the police and how to correct it.
