“The Right’s Impeachment Trap”: How Pundits Blame Obama For GOP Extremism

Every once in a while, those of us who were slow to board the magical Barack Obama 2008 Hope and Change Express get to say “We told you so,” and then go back to work. This is one of those times. Forgive me.

As Ezra Klein insists Obama has achieved success only by “breaking American politics,” and Ron Fournier tells us “the fundamental reason he became president was he was promising there’s no red state, there’s no blue state, I’m going to bring the country together,” people who resisted candidate Obama’s wispy, post-partisan rhetoric back then shake our heads and feel a little bit vindicated. Personally, I have to say: I hate being vindicated (on this, anyway). It would feel so much better to have been wrong.

Somebody broke politics, but it wasn’t Barack Obama — and yet he gave his enemies plenty of evidence to frame him.

Even President Obama has to regret some of his 2008 rhetoric, which partly blamed the Clintons for the right’s vengeful crusade against them, as pundits use it to claim that he not only broke politics, but that he will actually deserve the blame if Republicans impeach him for doing his job. Journalists still blame Democratic presidents for the unhinged behavior of Republicans.

Exhibit A is an allegedly “balanced” Wednesday Fox News panel where the non-right-wingers – journalists Fournier and A.B. Stoddard – joined conservative Charles Krauthammer in suggesting Obama could be responsible for his own impeachment, if he goes ahead with an executive order deferring deportation action on the parents of children who already enjoy deferred status. (Krauthammer called the move “impeachment bait” in Thursday’s Washington Post column.)

But the reaction of Stoddard and Fournier is worth breaking down in detail. (Thanks, Daily Caller, for capturing it.)

“If President Obama goes too far on this — whether it’s within his legal right or not — the outrage will be so incredible on the Republican side, it will probably bring more Democratic losses this fall,” the Hill’s Stoddard began. “Because I don’t know that Latinos are going to turn out this fall as a result of this issue. But it also could become a constitutional crisis.”

So it’s a bad move, “whether it’s within his legal right or not,” because a) it might not work politically and b) “it could also become a constitutional crisis.”

Fournier quickly agreed.

Let’s assume for a second that legally he can do this — just stipulate that, just for a second. Should he do it?  Even if you agree, like I do, that we really need to do something about these 12 million people who are in the shadows, even if you agree that it is legal, I still think there is an argument to be made that he should not do it.

OK, let’s stop there. The president shouldn’t do something to ease the immigration crisis, “even if you agree that it is legal.” Why is that? Fournier has a quick answer:

“Because the fundamental reason he became president was he was promising ‘there’s no red state, there’s no blue state, I’m going to bring the country together.’ He’s been a polarizing president.”

I’m not sure what qualifies Fournier to pronounce “the fundamental reason” Obama was elected, either in 2008 or 2012. Some people may have indeed admired his post-partisan rhetoric. But speaking as a two-time Obama voter, many of us wanted to see healthcare reform and less income inequality. Many members of the Obama coalition, who make less than $50,000, wanted economic relief from the Bush recession and the 30-year downward economic spiral that began under Ronald Reagan. Many of the Latinos who voted for Obama very much wanted immigration reform.

The political desires of the Obama coalition don’t much concern Fournier. “This would be a nuclear bomb that would blow open and make this country even more divided,” he warned. “In a way that most Americans just don’t want.”

In case you missed his point, Fournier followed up his Fox appearance with a whole column elaborating on it. The headline sums up the wrong-headed argument: “Even if reform is needed and legal, endowing the presidency with new, unilateral powers is a dangerous precedent.”

Obviously if reform is “legal,” then it wouldn’t endow the presidency with “new, unilateral powers.”

Kevin Drum boils the argument down to this: “President Obama shouldn’t do anything that might make Republicans mad.”

It really is that simple. If you grant, as Fournier seems to, that the president can legally change deportation priorities, but you think he shouldn’t, because it will further divide the country and Republicans will use it as an excuse to impeach him, you’re granting irrational people control of the nation. This is largely what happened during the debt ceiling crisis of 2011, but that time, Obama was listening to the Fourniers and Stoddards of the world, and trying to both be bipartisan, and also to appease the crazy Tea Partyers who would blow up the global economy rather than raise the debt limit.

That only enabled the crazies, who were being coddled by supposed moderates like Senate Minority Leader Mitch McConnell, who crowed approvingly that his party’s right flank proved the debt ceiling was “a hostage worth ransoming.”

So we know Republican leaders aren’t going to stand up to the party’s far-right base. And we know Krauthammer is going to accuse the president of creating a constitutional crisis to turn out his base for the midterm elections, because that’s Krauthammer’s job. But it would be nice if writers who don’t identify themselves with conservatism could describe this dynamic, maybe even critique it — not become part of it.

For the record, I can’t say conclusively whether the executive action the president is pondering is “legal,” and neither can Fournier or Krauthammer. (They both rely on Obama’s own previous statements denying that he has such powers; so he was right then, but he’s wrong now?) Anyway, it’s a perfectly legitimate point to debate. But I feel confident in saying that the enormously cautious Obama, who is sometimes too cautious for my taste, won’t do it cavalierly – not to turn out his base in November, and certainly not as “impeachment bait.”

The right is setting an impeachment trap for the president, and the media are starting to play along.

“Don’t Count Primaries In The Short Run”: The Tea Party Is Still A Powerful Force In GOP Politics

Liberal-friendly media outlets have been running obituaries for the Tea Party almost from the moment the grassroots conservative movement began in 2009. Tea Party anger over ObamaCare and corporate bailouts helped fuel a surprise Republican wave in 2010, shocking most pundits, as the House of Representatives shifted firmly into the GOP’s control. But then the movement fell short in 2012, and ever since then, much of the media have once again seemed eager to pronounce the Tea Party either dead or irrelevant — missing the larger point, and the larger impact. And the media’s Tea Party misfire will surely continue today, now that longtime Kansas Sen. Pat Roberts has emerged victorious over conservative challenger Milton Wolf in Tuesday’s GOP primary.

Or take, for instance, this year’s Mississippi Senate primary. The Republican incumbent, Thad Cochran, has a long reputation for pork-barrel politics and down-home pandering, neither of which has endeared him to small-government conservatives. The competitive challenge from Chris McDaniel came as a shock to Cochran and his supporters, who believed they could get one more easy ride back to the Senate from the seven-term senator in one of the friendliest states for Republicans. Instead, McDaniel narrowly edged Cochran in the initial vote, and narrowly lost the runoff — although McDaniel is contesting the results. To win the runoff, Cochran had to appeal to an unusual constituency: Democrats.

But in most states where incumbents faced challenges from Tea Party activists, the incumbents have had to defend their conservative credentials. Two key Senate GOP leaders had to fend off challengers with more effort than they have probably expended in several cycles put together. National Republican Senatorial Committee chair John Cornyn defeated a sitting House member, Steve Stockman, in the March primary in Texas, but it wasn’t easy; Cornyn got 59 percent of the vote, a decent enough showing, but hardly a ringing endorsement, even after Cornyn vigorously defended his brand of conservatism in the Lone Star State.

Mitch McConnell in Kentucky found himself in the hot seat, too. The Senate minority leader often runs afoul of Tea Party activists for his efforts to find compromise on issues when the grassroots want confrontation. McConnell won his Senate primary by 25 points over a first-time challenger, whose campaign ended up collapsing under its own weight. But first, Matt Bevin forced McConnell to shift to the right and get more defiant, at least rhetorically speaking.

Most Republican incumbents knew to move to the right well before the primary campaign; Lindsey Graham began laying the groundwork two years ago for his re-election effort, which paid off this spring in an easy win over six challengers. But not everyone got the memo. The biggest surprise came in the primary for Virginia’s 7th congressional district, where House Majority Leader Eric Cantor was expected to win easily. Cantor certainly expected it, spending most of his campaign fundraising outside of the district and barely engaging in his own race. Dave Brat, a local college professor with no electoral experience but with plenty of grassroots support, spent less on his whole campaign than Cantor spent on steakhouses — and ended up beating Cantor by double digits.

This dynamic — of conservative challengers, win or lose, forcing longtime incumbents to be more conservative — seems to be lost on the media. This week, both CBS News and The Hill ran Tea Party obituaries. CBS called this week’s primaries “the Tea Party’s last gasp this year,” while The Hill said that the movement’s Senate hopes will surely “fade.” And in the moment, that might well be true.

But look: The true test of the Tea Party won’t be in primary victories this week or this year, but in the impact of the conservative grassroots movement on the Republican Party. We have already seen incumbents who have rarely if ever had to deal with intraparty challengers shift their focus and message in response. The lack of banner wins in 2012 certainly didn’t persuade most of these incumbents to dismiss that pressure — in fact, the ones who succeeded most were the ones who prepared soonest and most vigorously.

When the New Left brand of progressivism arose in the 1960s, its candidates didn’t win a lot of elections at first either. It took two decades for the pressure of the movement to shift the center of the Democratic Party away from its traditional, blue-collar liberalism. In the late 1980s, the trend worried Democrats enough to form the Democratic Leadership Council to push back and recruit moderates to run for office, the most successful of which was Bill Clinton in 1992. By 2008, his wife blew her opening for the presidential nomination in part by falling short of the progressive credentials of Barack Obama.

The lesson here is not to count primaries in the short run. Look for the way incumbents have to defend their record and wait for the grassroots to produce change organically over the long run.

“Obama’s Other Success”: Dodd-Frank Financial Reform Is Working

Although the enemies of health reform will never admit it, the Affordable Care Act is looking more and more like a big success. Costs are coming in below predictions, while the number of uninsured Americans is dropping fast, especially in states that haven’t tried to sabotage the program. Obamacare is working.

But what about the administration’s other big push, financial reform? The Dodd-Frank reform bill has, if anything, received even worse press than Obamacare, derided by the right as anti-business and by the left as hopelessly inadequate. And like Obamacare, it’s certainly not the reform you would have devised in the absence of political constraints.

But also like Obamacare, financial reform is working a lot better than anyone listening to the news media would imagine. Let’s talk, in particular, about two important pieces of Dodd-Frank: creation of an agency protecting consumers from misleading or fraudulent financial sales pitches, and efforts to end “too big to fail.”

The decision to create a Consumer Financial Protection Bureau shouldn’t have been controversial, given what happened during the housing boom. As Edward M. Gramlich, a Federal Reserve official who warned prophetically of problems in subprime lending, asked, “Why are the most risky loan products sold to the least sophisticated borrowers?” He went on, “The question answers itself — the least sophisticated borrowers are probably duped into taking these products.” The need for more protection was obvious.

Of course, that obvious need didn’t stop the U.S. Chamber of Commerce, financial industry lobbyists and conservative groups from going all out in an effort to prevent the bureau’s creation or at least stop it from doing its job, spending more than $1.3 billion in the process. Republicans in Congress dutifully served the industry’s interests, notably by trying to prevent President Obama from appointing a permanent director. And the question was whether all that opposition would hobble the new bureau and make it ineffective.

At this point, however, all accounts indicate that the bureau is in fact doing its job, and well — well enough to inspire continuing fury among bankers and their political allies. A recent case in point: The bureau is cracking down on billions in excessive overdraft fees.

Better consumer protection means fewer bad loans, and therefore a reduced risk of financial crisis. But what happens if a crisis occurs anyway?

The answer is that, as in 2008, the government will step in to keep the financial system functioning; nobody wants to take the risk of repeating the Great Depression.

But how do you rescue the banking system without rewarding bad behavior? In particular, rescues in times of crisis can give large financial players an unfair advantage: They can borrow cheaply in normal times, because everyone knows that they are “too big to fail” and will be bailed out if things go wrong.

The answer is that the government should seize troubled institutions when it bails them out, so that they can be kept running without rewarding stockholders or bondholders who don’t need rescue. In 2008 and 2009, however, it wasn’t clear that the Treasury Department had the necessary legal authority to do that. So Dodd-Frank filled that gap, giving regulators Ordinary Liquidation Authority, also known as resolution authority, so that in the next crisis we can save “systemically important” banks and other institutions without bailing out the bankers.

Bankers, of course, hate this idea; and Republican leaders like Mitch McConnell tried to help their friends with the Orwellian claim that resolution authority was actually a gift to Wall Street, a form of corporate welfare, because it would grease the skids for future bailouts.

But Wall Street knew better. As Mike Konczal of the Roosevelt Institute points out, if being labeled systemically important were actually corporate welfare, institutions would welcome the designation; in fact, they have fought it tooth and nail. And a new study from the Government Accountability Office shows that while large banks were able to borrow more cheaply than small banks before financial reform passed, that advantage has now essentially disappeared. To some extent this may reflect generally calmer markets, but the study nonetheless suggests that reform has done at least part of what it was supposed to do.

Did reform go far enough? No. In particular, while banks are being forced to hold more capital, a key force for stability, they really should be holding much more. But Wall Street and its allies wouldn’t be screaming so loudly, and spending so much money in an effort to gut the law, if it weren’t an important step in the right direction. For all its limitations, financial reform is a success story.

“Stop Undermining The President!”: I Am Glad We Have Barack Obama As Our President At This Time In Our History

For a short time after September 11, 2001 anyone who dared to criticize then President Bush was called an unpatriotic traitor. Remember the Dixie Chicks?

But today when international crises occur those same folks pushing that patriotic fervor are quick to find fault with our current Commander in Chief. Whatever happened to putting our country first? It seems to me any global unrest becomes an excuse to bash our President for political purposes.

Take this recent shooting down of Malaysian domestic Flight 17 over the Ukraine. President Obama addressed the disaster the day it happened at an event in Delaware but he was criticized by pundits at Fox News and right wing radio for continuing his speech about building infrastructure. A case could be made that the President wanted to promote calm and business as usual on the home front. On the same day he spoke on the phone with the Russian leader, Vladimir Putin, who later put the blame on Ukraine.

The next day our President labeled it an “outrage of unspeakable proportions” and a “global tragedy” and asked for a ceasefire between Russia and the Ukraine and called for an international investigation into the incident. He also spoke on the phone to Ukrainian President Petro Poroshenko, Malaysian Prime Minister Najib Razale, and Prime Minister Marke Rutte of the Netherlands over the course of the past two days.

In other words, he took the appropriate steps and actions to lead and stay on top of this international crisis. Yet, Senator John McCain pointed fingers at President Obama for not supplying weapons to Ukraine to help fight off the Russian rebels accused of this dastardly deed (whether it was an accident or not.) In fact, President Obama just two days ago announced even tougher sanctions on Russia for its involvement in Ukraine. So he has been taking actions, just not the military ones that war hawks McCain and others in the GOP have been pushing.

Then the Fox pundits, Sean Hannity in particular, compared this situation to President Reagan‘s reaction to a downed Korean passenger airliner by the Soviet Union in 1983. Yes, President Reagan, great actor that he was, condemned it in strong words, but it took him four days to do it and then he never took any action after that. Plus, it was a totally different world then. We were in a Cold War with the Soviets and things are much more complicated today with all of the unrest in the Middle East.

The conservative pundits will never talk about the Iranian passenger plane Air 655 that we shot down by accident in 1988 under President Reagan’s watch. The United States never apologized for it, paid $61 million for the 290 victims’ families, and no one was fired or held accountable for it. Talk about ironic hypocrisy by those who are so outraged by this.

I, for one, am getting tired of hearing about how “weak” our President is regarding foreign policy. Isn’t it possible that calling him that undermines our country and our reputation in the world? He is not weak. He is not John Wayne (emulated by Ronald Reagan and George W. Bush) but rather Cool Hand Luke. He thinks before he acts. He doesn’t shoot from the hip. He takes his time and consults his advisors and looks at the big picture of any long term effects his decisions may create. This may infuriate the action hero testosterone crowd but I think it is the better approach.

Sure, there are statements and mistakes the President made that he would like to take back like the “red line” in Syria, providing more security in Benghazi, and domestically the “you didn’t build that” (although that was taken outside of context), and “if you like your plan you can keep it” (which I think he really believed.)

But the vitriol and hatred lashed out against our leader is very disturbing and maddening. Many of it is based on lies told against him by his opponents (remember the so-called “apology tour” and “death panels” and the debacle over his birth certificate?)

A Facebook friend accused President Obama of raising his middle finger to Republicans from the beginning. I had to straighten him out by pointing out that right after Obama was inaugurated he invited the GOP over to the White House for a Super Bowl party, he played golf with Speaker of the House John Boehner after the 2010 election, he said in his address to the American people “even if you didn’t vote for me, I am your President too.” He wanted to unite the country. Remember his 2004 Democratic Convention speech about the red and blue states and how we are the United States?

It was the Republicans who turned against him from the beginning. The first day of his Presidency they had a meeting to devise a plan to defeat him. The Senate Minority leader, Mitch McConnell, said his number one priority was to make Barack Obama a one-term president (we all know how that turned out.) Talk radio host Rush Limbaugh said in the midst of our Great Recession “I hope he fails.”

You can only extend the hand of friendship and have it rebuffed so many times until you get the message that it is pointless. And I’m not saying it’s racial although there may be elements of that. The GOP did the same thing to President Bill Clinton, leading numerous dead-end investigations until they latched onto the Monica Lewinsky scandal and actually impeached him in the House of Representatives.

The irony is that the oppositions’ constant barrages have actually strengthened the President. I have never heard him speak with more fire than after Boehner announced the GOP were going to sue him. He has become immune to the chatter on the right and has taken up this latest attack as a battle cry for him to “do his job” for the country as Congress has become the least productive branch of government in history.

President Obama has finally gotten the message that FDR, LBJ, Bill Clinton and even Ronald Reagan learned. You can’t please the opposing party so you have to stick to your principles and do what you feel is right for the country.

I don’t know if other Americans are sick of all of this infighting but I have reached my boiling point. I am seriously considering banning Fox News from my channel surfing as it just irritates the heck out of me.

I just wish we as a nation would get behind our President at times of international crises. Maybe that will happen after the mid-term elections, but I am not holding my breath. In the meantime, I am glad we have Barack Obama as our president at this time in our history. We need his calm, cool, clear headed approach to leadership at this time of unprecedented international turmoil. And if enough of us just get behind him, maybe we can once again become the “United States of America.”

“Republicans Have A Choice”: Their Donors, Their Right-Wingers, Or A Government Shutdown

It looks like the one big(gish) substantive consequence of Eric Cantor’s exit from the House Republican leadership will be the demise of the Export-Import bank. Or at least it looks very likely that John Boehner (who supports the Export-Import bank) will allow its authorization to lapse rather than pick a fight with conservative hardliners in the House.

The fact that the bank’s authorization expires on the same day that federal appropriations expire has analysts wondering whether it will end up at the center of a tug-of-war over funding the government, precipitating a shutdown. And that, in turn, has conservatives salivating over the prospect of “Democrats shut[ting] down the government” to protect corporate welfare.

First, allow me to disclose that I really don’t care very much what happens to the Export-Import bank, which subsidizes U.S. exports with loans and loan guarantees to insure against non-payment by importers. I guess the one convincing argument for reauthorizing it temporarily, or reforming and reauthorizing it, is that it probably is providing a modest boost to the economy at the moment, but generally liberals and hardline conservatives agree, for slightly different reasons, that the bank should go. Establishment Republicans, by contrast, really like the Ex-Im bank, which explains why Democrats are happy to set aside whatever misgivings they might have about it in order to exploit the division within the Republican conference.

That division is also why any talk of Democrats shutting down the government to protect Ex-Im is basically dishonest spin.

I think there’s almost no chance anyone will shut down the government over the Ex-Im bank, but if a shutdown happens, it will come as a consequence of Boehner wimping out, not of anything Democrats might do.

To my mind, there are at least four ways a fight over Ex-Im could play out within a fight over funding the government. Half of them end with the elimination of the Ex-Im bank. Only one ends with a government shutdown, and it would be on House Republicans.

I’ve simplified the processes involved here, for the sake of clarity, but in order of escalating complexity, the scenarios are as follows:

1. The House passes a bill to fund the government and sends it to the Senate, where Republicans successfully filibuster any attempt to reauthorize the Ex-Im bank. Harry Reid caves. Result: Ex-Im bank eliminated.
2. The House passes a bill to fund the government and sends it to the Senate where Democrats and Republicans tweak it to reauthorize the Ex-Im bank, among other things. It goes back to the House, where Boehner “caves” and puts it on the floor. Result: Ex-Im bank survives.

2a. The House passes a bill to fund the government and sends it to the Senate where Democrats and Republicans amend it to reauthorize the Ex-Im bank. It goes back to the House, where Boehner allows a vote on a measure to strip the Ex-Im authorization out of the legislation, but the measure fails thanks to the support of an overwhelming number of Democrats and a large contingent of Republicans. Result: Ex-Im bank survives, Republicans crow disingenuously about how Democrats are the real crony-capitalists.

3. The House passes a bill to fund the government and sends it to the Senate where Democrats and Republicans amend it to reauthorize the Ex-Im bank. It goes back to the House, where Boehner can neither muster the nerve to affirmatively strip the authorization (and anger donors) nor the nerve to put the whole bill on the floor (and anger conservatives). So he does nothing. Result: Boehner shuts down the government, Ex-Im bank in limbo.

4. The House passes a bill to fund the government and sends it to the Senate where Democrats and Republicans amend it to reauthorize the Ex-Im bank. It goes back to the House, where Boehner chooses his speakership over his big business allies, and rounds up Republican votes to strip the authorization out of the bill. The House sends the bill back to the Senate where Reid caves. Result: Ex-Im bank eliminated.

Note, I have baked into these scenarios an assumption that Senate Democrats won’t refuse to fund the government unless the Ex-Im bank survives because most Democrats a) Don’t really care that much about the bank, b) are mainly just interested in exploiting Republican divisions, c) want to make a point to conservative big business donors about the incredibly bad investment they’ve made in House Republicans, and d) aren’t an inherently reactionary bunch like their counterparts in the House GOP.

For what it’s worth, I think option 2a is the kabuki show we’re most likely to see. I think the GOP leadership’s overweening interest in not shutting down the government will carry here, which means scenario 3 is the least likely. But either way, Boehner and Mitch McConnell will have to make some fairly consequential decisions in the next few months.
