“A Big Split In The Republican Party”: Here Comes The Big Intra-GOP Fight Over Obamacare Subsidies
It’s been obvious for a while that congressional Republicans will be placed in a difficult position if SCOTUS strikes down subsidies for health insurance purchases under the Affordable Care Act in states that did not create their own exchanges. On the one hand, they’ll be blamed for failure to do something about the consequent loss of insurance and/or increases in premiums (at least in states that do nothing about it, either), when a one-sentence law confirming the original understanding virtually everyone had about the universal availability of subsidies would suffice. On the other hand, any reaction to such a SCOTUS decision that does not at least begin with an all-night kegger-and-prayer-vigil in celebration of this blow against tyranny will rile up The Base into a hate frenzy. Theoretically, GOPers could be ready with a full-fledged Obamacare Replacement bill that could be presented to the president on a take-it-or-leave-it basis, but despite having five years to come up with such a creature, that ain’t happening.
So as TPM’s Sahil Kapur explains today, Sen. Ron Johnson has introduced a bill, which the Senate GOP leadership has quietly gotten behind, that would extend the Obamacare subsidies until the end of 2017, in exchange for some key concessions to conservatives that fall vastly short of an alternative structure for health care reform.

The legislation, offered by Sen. Ron Johnson (R-WI), one of the most politically vulnerable Senate incumbents in 2016, would maintain the federal HealthCare.gov tax credits at stake in King v. Burwell through the end of August 2017.
The bill was unveiled this week with 29 other cosponsors, including Senate Majority Leader Mitch McConnell (R-KY) and his four top deputies, Sen. John Cornyn (R-TX), John Thune (R-SD), John Barrasso (R-WY) and Roy Blunt (R-MO). Another cosponsor is Sen. Roger Wicker (R-MS), the chairman of the conference’s electoral arm.
Such a move would seek to protect the GOP from political peril in the 2016 elections when Democrats would try to blame the party for stripping subsidies — and maybe insurance coverage — from millions of Americans in three dozen states. A defeat for the Obama administration in a King ruling would likely create havoc across insurance markets and pose a huge problem for Republicans, many of whom have been pushing the Supreme Court to nix the subsidies.
Given the certainty that this proposal will split Republicans, what are the odds Democrats would go along with this semi-“fix.”?
Democrats would probably demand a fix to make the subsidies permanently available if they go down. But they would be hard-pressed to vote down a bill to temporarily extend them if Republicans were to bring it up.
That may depend, however, on what happens to provisions Kapur calls “sweeteners” for conservatives, including elimination of Obamacare’s individual and employer mandates, and perhaps even more crucially, of the ACA’s minimum benefit requirements. Kapur seems to anticipate, and some conservative critics agree, that Republicans would cave on most of these “sweeterners” in exchange for Democrats agreeing to a temporary instead of a permanent extension of subsidies.
But you will note that the cosponsors of Johnson’s bill do not include Ted Cruz, Rand Paul or Marco Rubio, who will likely be focused on the Iowa Straw Poll at the time the decision comes down. There’s also a competing Senate bill from Ben Sasse that would instead of extending the subsidies replace them with simple tax credits for insurance purchasing that would fade away over time. And there are, according to The Hill‘s Sullivan and Ferris, several plans percolating in the House that would replace the subsidies with our without some “bridge” offering temporary relief. You can judge how much consensus there is from this remark by Republican Study Committee co-chair Bill Flores of Texas, who is one of the people working on one of the many plans:
“I’m not saying there should absolutely not be a bridge, I’m not saying there should absolutely be a bridge,” Flores said. “If we start building toward a shore, but we don’t know what that shore is, then the bridge might not work very well.”
I think we can all agree on that. And that is why despite everything you will hear from them before and after SCOTUS rules, there’s probably no group of people more avidly if silently cheering for Obama to win this case than are congressional Republicans.

“A Confused And Bitter Old Man”: Obama Reminds McCain How Foreign Policy Works
Late last week, Iran’s Ayatollah Khamenei took issue with the United States’ characterization of the recently negotiated nuclear framework, though the White House was dismissive of the Iranian leader’s posturing.
“The test of whether or not that framework can be memorialized in a deal is not going to be a comment on any given day by a particular Iranian leader,” deputy national security adviser Ben Rhodes told reporters Friday.
But in a bizarre twist, Sen. John McCain (R-Ariz.) seemed to endorse the Ayatollah’s credibility over the U.S. Secretary of State’s. “I think you’re going to find out that they had never agreed to the things that John Kerry claimed that they had,” McCain said Friday. Sen. Lindsey Graham (R-S.C.) made similar remarks.
To put it mildly, it was an unexpected development. For months, Republicans insisted, “We can’t trust Iranian leaders.” And yet, on Friday, McCain and Graham suggested rhetoric from Ayatollah Khamenei should be accepted at face value – while arguments from the American White House should not.
During a press conference at the Summit of the Americas, President Obama seemed visibly frustrated by the GOP’s increasingly unhinged approach to international affairs.
“When I hear some, like Senator McCain recently, suggest that our Secretary of State, John Kerry, who served in the United States Senate, a Vietnam veteran, who’s provided exemplary service to this nation, is somehow less trustworthy in the interpretation of what’s in a political agreement than the Supreme Leader of Iran – that’s an indication of the degree to which partisanship has crossed all boundaries. And we’re seeing this again and again. We saw it with the letter by the 47 senators who communicated directly to the Supreme Leader of Iran – the person that they say can’t be trusted at all – warning him not to trust the United States government.
“We have Mitch McConnell trying to tell the world, ‘Oh, don’t have confidence in the U.S. government’s abilities to fulfill any climate change pledge that we might make.’ And now we have a senator suggesting that our Secretary of State is purposely misinterpreting the deal and giving the Supreme Leader of Iran the benefit of the doubt in the interpretations.”
Obama added this isn’t how the United States is “supposed to run foreign policy, regardless of who’s president or secretary of state.” The president concluded that this is “a problem” that “needs to stop.”
I think even the most ardent Republicans, if they were to pause and think about this objectively, would be hard pressed to disagree with the underlying principles Obama presented. Put aside the GOP’s bitter, often ugly, contempt for the president and consider a more fundamental question: has American foreign policy ever worked this way?
Is there a scenario in which it can work this way? What signal does it send to the world when the legislative branch of the United States tries to undermine the executive branch of the United States on matters of international affairs?
For his part, McCain expressed a degree of dismay over Obama “attacking” him. I suppose that’s one way to look at it. The other way is that the president defended American foreign policy and America’s chief diplomat against ridiculous criticisms from a confused senator.

“The Obstructionists”: Congress Can Still Mess Up The Iran Deal
“Now, Congress takes up the matter” are words that are ensured to send shudders down the spine, so shudder away: We’ve just entered the congressional phase of the Iran talks, with a Senate hearing next Tuesday, after which it’s up to Mitch McConnell to decide how fast and aggressively to move with the bill from Tennessee Republican Bob Corker that would bar the administration from making any changes to U.S. sanctions against Iran for 60 days while Congress reviews and debates any Iran agreement.
There are, as the Dude said, man, a lotta ins, a lotta outs, a lotta what-have-yous here. It’s all quite complicated. But here, it seems to me, is your cut-to-the-chase question: Is there enough good faith in this United States Senate for something to be worked out? Or is it just impossible?
One proceeds from the assumption that the Senate will do whatever it can to kill a deal. It’s a Republican Senate, by a pretty wide margin (54-46); history would suggest that these Republicans simply aren’t going to hand President Obama a win like this. It hardly matters what the details are, about what Iran can or can’t do at Fordow, about the “snapback” provisions of the sanctions, about the inspections regime, or about what precise oversight role Congress has. It’s just basically impossible to imagine that this Republican Party, after everything we’ve seen over these last six years, and this Republican Senate majority leader, who once said it was his job to make Obama a one-term president, won’t throw up every roadblock to a deal they can conjure.
Once again, we’re left separating out the factors the way scientists reduce compounds to their constituent elements in the lab. How much of this is just Obama hatred? How much is (this is a slightly different thing) the conviction—quite insane, but firmly held—that he doesn’t have the best interests of the United States at heart? How much is a genuinely paranoid, McCarthy-ish world view about the intractably evil nature of our enemy and the definitional Chamberlainism of ever thinking otherwise?
And how much is just self-interested politics, as it is bequeathed to us in its current form? Which is to say—if you are a Republican senator, you simply cannot cast a vote that can be seen as “pro-Obama” under any circumstances. You just can’t do it.
I asked in a column last week whether there would be one Republican officeholder in Washington who might say, “Hey, upon examination of the details, this looks like a decent deal with risks that are acceptable, and I’m going to support it?” It’s still a good question. Senator Jeff Flake of Arizona is conceivable. He called that noxious Tom Cotton letter “not appropriate.” But Flake is pretty new to the Senate and doesn’t carry a lot of weight on these matters.
Some suggest Corker himself. Corker has this reputation, in part earned, as one of the reasonable ones. He gets articles written about him like this one, from The New York Times a couple of days ago, which limned him as a Republican of the old school, a sensible fellow who still wants to horse-trade.
And he is—but only up to a point, at which the horses return to their stalls. The most notable example here is the Dodd-Frank bill. This is all detailed at great and exacting length by Robert Kaiser in his excellent book about how financial reform became law, Act of Congress. Then, Corker talked for hours and hours with Chris Dodd about the particulars—derivatives reform, oversight of the Consumer Financial Protection Bureau, more. He wanted to play ball, even thought he might deliver some votes. But as time passed, it became clear to Corker that the base just wasn’t standing for it. He faced reelection in 2012. Not tough reelection—he won with 64 percent of the vote. But reelection campaigns are great excuses for senators to do nothing, and nothing is what Corker did. He withdrew from all participation with Dodd and Frank, and he ultimately voted against the bill. When it mattered, he caved to the extremists, in other words, among his colleagues and in his base. Why that means he should be getting credit for a spirit of compromise now in New York Times articles is something that, to my obtuse mind, requires further explanation.
“He’s not Tom Cotton.” Uh, okay. Wonderful. But that’s where we’ve come, celebrating a guy because he doesn’t want to start World War III. Happily, though, all is not lost. It’s far from clear that Corker or Cotton (and yes, they are different) can block a deal. There are, I’m told, three categories of senators on this question. The first is our own mullahs—no deal no how. The second is a group of mostly Democrats and independents—Virginia’s Tim Kaine, who is a close ally of the White House, and Maine’s Angus King—who basically wants a deal but wants to be sure that it’s good, and want to influence the shape of any legislation the Senate might pass.
The third group is senators who also basically would like to see a deal but want the Senate to serve as a backstop against a deal they see as bad. I’d put Chuck Schumer in that third camp. So when these people say they back the Corker bill, as Schumer did this week, it doesn’t mean they’re against the administration or a deal per se. Democrats aren’t going to be Obama’s problem here. A few, the ones from the deep red states, may be boxed in. But most will stick with the administration, if a deal is finalized along current terms.
I don’t think our mullahs have the numbers right now. But Obama is going to have to sell this to more parties than Tom Friedman and Steve Inskeep. He has, or should have, Friedman’s readers and Inskeep’s listeners already. The way to get someone like Corker to play ball is to sell it in Knoxville. Public opinion still influences foreign policy, as Obama knows from his Syrian experiences. Put it to work.

“Rootin’ Tootin’ Shootin’ Presidential Candidates”: A General Conservative Nostalgia For A Time That’s Passed
There was a time not too long ago when Republicans knew that when an election got tight, they could trot out “God, guns, and gays” to drive a cultural wedge between Democrats and the electorate, since the GOP was the party that, like most Americans, loved the first two and hated the third. It’s more complicated now, both within the parties and between them, but there’s no doubt that 2016 will feature plenty of culture-war sniping. For better or worse, Democrats and Republicans really do represent two different Americas.
I thought of that this weekend reading this article in the Washington Post about the personal relationships the potential Republican candidates have with guns. That they are all opposed to any limits on gun ownership is a given, but more interesting is the role guns play in their own lives. With a couple of important exceptions, the potential Republican candidates fall into one of two categories when it comes to guns: those who grew up with them, and those who embraced them once their political ambitions matured.
Some of them have been building their collections since childhood. Sen. Lindsey O. Graham (S.C.) is up to 12 now, including an AR-15 assault weapon that he has talked about using if law and order ever breaks down in his neighborhood. Former Texas governor Rick Perry is so well-armed, he has a gun for jogging.
Others were city kids who didn’t own guns until later in life. Sen. Marco Rubio (Fla.) bought a .357 magnum revolver in 2010, the year he ran for Senate, saying the gun was for protection… [Ted Cruz] grew up in the suburbs of Houston and got his first exposure to guns at summer camp. But, as an adult, Cruz bought two guns: a .357 magnum revolver and a Beretta Silver Pigeon II shotgun, according to a spokeswoman… In Wisconsin, Gov. Scott Walker also didn’t grow up hunting. But he got his first guns in his mid-30s: a shotgun he won in a raffle and a rifle he got as a gift, said a spokeswoman for his political committee. Now he hunts deer, pheasants and ducks with his motorcycle-riding buddies… Louisiana Gov. Bobby Jindal purchased a snubnosed, laser-sighted Smith & Wesson .38 revolver after Hurricane Katrina. He still keeps it for home defense, although his home is now the heavily guarded Governor’s Mansion.
Far be it from me to question the sincerity of any politician’s enthusiasm for firearms, but buying a gun does seem an awful lot like the kind of thing a Republican politician does just because that’s what Republican politicians are expected to do. But there’s gun rights, and then there’s contemporary gun culture. The two are not at all the same, and it’s the latter some Republicans seem so eager to embrace.
There’s an important context here, which is that gun ownership has been steadily declining for about four decades now. Yet even as fewer and fewer people own guns, gun sales are increasing, which means that the people who do own them are buying more and more. Ask a certain kind of gun-owner how many he owns, and he’ll say, “More than I need, but not as many as I want.”
And it’s that culture that many Republican politicians feel the need to make their own. You could see it as part of a general conservative nostalgia for a time that’s passed, when the law was a distant force and a man might have to protect his homestead from rustlers and thieves. The trouble is that for many gun-owners today, guns are less tools with everyday uses than fetish objects. It’s the very fact that they serve no practical purpose in most gun-owners’ lives that makes them so emotionally powerful. When a guy like Lindsey Graham says that he needs his AR-15 in case “there was a law-and-order breakdown in my community,” he’s living in a land of fantasy, where a middle-aged guy who wears a suit every day is actually an agent of heroic violence, the very embodiment of physical capability and potency.
But the bare fact is this: There are places in America where gun ownership is common and expected, and places where it isn’t. And more Americans live in the latter. So when Republicans proclaim themselves representatives of the first type of place—in both ideas and habits—they put themselves at an immediate disadvantage.
But not all of them do. Jeb Bush, for instance, has the appropriate Republican policy stance when it comes to guns (along with an A-plus rating from the NRA), but he does not himself own a gun. (The only other potential candidate who doesn’t is Chris Christie.) Which makes perfect sense if we think about gun ownership being so much a function of geography. Unlike some of his opponents—the emphatically Texan Rick Perry, the extremely Midwestern Scott Walker—Jeb isn’t really from any particular place. As a member of the Bush clan, he grew up traveling a kind of elevated platform of wealth and power that traverses the country. Connecticut, Texas, Florida—wherever it was, it was essentially the same. That isn’t really his fault; when your grandfather is a senator and your father becomes president, and you go to Andover and summer at Kennebunkport, that’s the world you’re from. And it isn’t a world where people view guns as a vital cultural totem. If Jeb walked out on a stage holding a rifle over his head, he’d look even dumber than Mitch McConnell did.
We don’t think about Hillary Clinton representing any particular place either. She grew up in Illinois but left it behind, spent almost two decades in Arkansas then left for Washington, and now lives in New York, but doesn’t embody any of those places (or even try to). That’s fine with liberals, whose demands for cultural affinity are served well enough by someone who moved around a lot. The president she’s trying to succeed most definitely represented a particular place, though it was less Chicago specifically than American cities in general, the dense and diverse places liberals either live or want to live.
And that’s where all the Republicans have a problem. They continue to romanticize rural and small-town life, but the number of Americans who actually live in those places is small and getting smaller. Even if plenty of suburban Republicans still imagine themselves out on the range, that isn’t the American reality. Planting your flag there may seem necessary to win the Republican nomination, but it won’t do you much good the day after.

“Hijacked By The Hardliners”: Threatening To Gum Up The Confirmation Of Loretta Lynch Is Just The Latest GOP Tantrum
On Sunday, Senate Majority Leader Mitch McConnell declared he really, really likes having Eric Holder as attorney general. He essentially told CNN that unless Democrats concede to anti-abortion language Republicans snuck into a human trafficking bill, the nomination of Loretta Lynch to succeed Holder would not move forward.
First of all, whether Republicans accept it or not, abortion is a legal, constitutionally-guaranteed medical procedure in this country, for sex trafficking victims or anyone else. And second, this is indicative of the hostage politics we’ve come to expect from a party that refuses to govern. There is no issue, no matter how humane, and no funding need, no matter how dire, that cannot be hijacked by the ideological hardliners in the Republican Party.
We could have had immigration reform a year ago, without the threat of a Department of Homeland Security shutdown, if Speaker of the House John Boehner had told the bigots in his own caucus to take a hike and held a vote on a common-decency bill that would have passed. Republicans did shut down the government and harmed Colorado’s flood recovery efforts thanks to tea party intransigence on the Affordable Care Act. And we came to the brink of ladyparts shutting the whole thing down in 2011 thanks to Republican opposition to Planned Parenthood funding for health care screenings and services.
And no, it’s not “both sides.” I will cheerfully provide a swift wedgie to the next smug pundit who tries to blame Democrats for Republican failure to act like adults. President Barack Obama waited a year and a half for Boehner to move on immigration reform, and Boehner decided to abdicate his leadership to Iowa Rep. Steve King, who has accused undocumented immigrants of being a bunch of drug dealers with “calves the size of cantaloupes.”
Meanwhile, the Denver Post editorial board (or more accurately, publisher Dean Singleton’s ire at former Sen. Mark Udall) continues to rack up bonus points with the most credibility-damaging, fatuous endorsement of 2014, Republican Sen. Cory Gardner. The editorial actually claimed electing Gardner would “usher in a new era of bipartisanship”, that the Senate wouldn’t follow the House’s infantile, truculent lead and it would actually be “more productive.”
How’s that working out for you, Denver Post editorial board? Because Gardner didn’t get the memo.
He was one of the 47 Republicans to “pull a Dennis Rodman” and decide to communicate directly with a foreign government in order to undercut Obama. Given the backlash, Rodman’s North Korea visit may have been more effective and less comical, but this remains yet another example of Republican ineptitude. As conservative Michael Gerson put it, “This was a foreign policy maneuver, in the middle of a high-stakes negotiation, with all the gravity and deliberation of a blog posting. In timing, tone and substance, it raises questions about the Republican majority’s capacity to govern.”
Gerson’s right, and it’s only going to get better from here. According to Talking Points Memo , there are five more policy “cliffs” awaiting Congress, including the debt ceiling, funding for the Child Health Insurance Program and the end of overall funding for the federal government on Sept. 30. Obama has so far managed to outmaneuver these fools, but at some point voters need to stop rewarding failure by electing a party that is utterly incompetent at the basic functions of government.
