“The Inevitability Of Republican Reactions”: Opposition Is A Republican Action, Not A Republican Reaction

Ron Fournier of the National Journal has become (to liberal bloggers anyway) the embodiment of multiple sins of the Washington press corps. Most notably, there’s the High Broderism, in which the blame for every problem is apportioned in precisely equal measure to both parties, and the embrace of the Green Lantern theory of the presidency, in which anything can be accomplished, including winning over a recalcitrant opposition, by a simple act of will from the Oval Office. The latter’s most comical manifestation is Fournier’s frequent pleas for President Obama to “lead,” with the content of said “leadership” almost always left undetailed (though one suspects it might involve giving a great speech, after which Republicans would decide to come together with Democrats to solve the nation’s problems).

Though lately I’ve been trying to limit my pundit-bashing to once or twice a month, I couldn’t overlook this passage in Fournier’s latest column expressing his dismay that Obama might take some executive actions in areas where Congress hasn’t done anything, like immigration or corporate inversions. While I’ll give Fournier credit for acknowledging that to know whether such actions are good or bad we’d have to look at each one individually (a remarkable concession), I can’t stomach this:

For argument’s sake, let’s say Obama is right on the issue and has legal authority to act. The big question is …

Would it be wrong to end-run Congress? Another way to put it might be, “Would more polarization in Washington and throughout the country be wrong?” How about exponentially more polarization, gridlock, and incivility? If the president goes too far, he owns that disaster.

Fournier is saying that even if Obama is right on the merits of an issue and has legal authority to take a particular executive action, to go ahead and do so is the same thing as creating “exponentially more polarization, gridlock, and incivility.” But it takes two to tango, or to create polarization. (Gridlock and incivility, one party can do on its own, as we well know.) In other words, Fournier is saying that when Republicans react to an executive action by remaining firm in their obstructionism and being uncivil about it to boot, it’s one person’s fault: Barack Obama.

Isn’t it long past the time when we were able to put aside the quaint notion that Republican actions are determined in any meaningful way by what Democrats do or don’t do?

It isn’t only journalists who have believed this; for some time; Democrats believed it, too. Many Democrats voted for Obama in the 2008 primaries because they were worried about the ferocious opposition Hillary Clinton would engender from the GOP. As they quickly found out, that opposition is a Republican action, not a Republican reaction. I remind you (for the umpteenth time) that on the very day Barack Obama was inaugurated, Republican leaders met for dinner and decided to oppose anything and everything he tried to do. Politically, it was a pretty smart move. But it wasn’t because Obama hadn’t reached out to them and they were mad—he had only been president for a couple of hours. Within weeks, they responded to the fact that Obama hired people to work in the White House by accusing him of appointing a group of unaccountable “czars” who were wielding tyrannical power.

On this subject, there are basically two kinds of Republicans. There are those who understand that maximal opposition will yield lots of political benefit for them, and there are those who genuinely believe that Obama is an evil Kenyan Marxist tyrant trying to destroy America. When it comes to things like how they react to the administration’s policy initiatives, the distinction doesn’t matter. They both arrive at the same place, whether through clear-eyed political calculation or wild-eyed hatred. And nothing—nothing—President Obama does or doesn’t do makes a bit of difference.

To read Fournier, you might think that if Obama came out and said, “Fixing immigration is really Congress’ responsibility, so I’m not going to do a thing until they put a bill on my desk,” Republicans would respond, “We appreciate the trust the President is putting in Congress, so we’re going to get right to work passing comprehensive immigration reform.” But of course they won’t.

If we know anything about the way today’s Republicans react to this president, it’s that nothing he does really matters. They’re going to do what they’re going to do. There will be gridlock and incivility if he does things they don’t like, and there’ll be gridlock and incivility if he does nothing at all. To think otherwise you have to ignore everything that’s happened for the last five years.

“A Painful Ritual”: Rand Paul, Not So Independent After All

Rand Paul is discovering that being a libertarian-ish senator with a knack for getting the press to pay attention to your sometimes slightly-contrarian views is one thing, while running for president is something else entirely. Paul has moved to paint himself as an outsider and independent thinker in advance of 2016 — but he’s now learning that taking positions that challenge even secondary elements of Republican doctrine is not going to fly.

When there’s a party consensus, a presidential candidate can only contradict it as long as no one’s paying attention. There’s no such thing as an independent-thinking presidential candidate; only one who is sticking to positions he hasn’t yet renounced, but will eventually. Ironically, it’s the GOP, whose members work so hard to characterize themselves as outsiders beholden to no one, where orthodoxy is most strictly enforced.

Paul has now been confronted with the fact that back in 2011 he proposed ending all foreign aid, which seemed like a good idea for him at the time — after all, did you know that most foreign aid goes to…foreigners?!? Egad. Foreign aid is quite unpopular, in part because people wildly overestimate how much we spend on it.

Paul’s problem: The largest recipient of foreign aid is Israel, which gets about $3 billion per year in American taxpayer money. We might want to debate whether Israel really needs that money from us. But that’s not a debate we’re likely to have any time soon, and is sure as heck isn’t a debate anyone’s going to have in a Republican presidential primary, where “supporting Israel” has become an article of dogma.

So Paul had to backtrack. He tried to argue: “I never really proposed [cutting off aid to Israel] in the past.” That could only be true under some elaborate and tortured definition of “really” or “proposed.” In fact, Paul had even made those points about Israel being able to fund itself without our help. But he won’t be saying that kind of thing anymore.

For someone who has built his political brand on being different than other Republicans — by virtue of being a quasi-libertarian and a relative newcomer to politics — this must be a painful ritual to have to enact.

Two months ago, Paul might have brushed off a question about Israel by saying vaguely that we have to look at all parts of the budget to bring down spending. But with Israel on the front pages, he has to line up behind the rest of the party and pledge to support Israel forever and in every way. If the party is genuinely divided on an issue, a candidate has some room to move; this is true of government surveillance, where Paul takes a more libertarian stance than some other Republicans. But once there’s something approaching a consensus, as there is on Israel, dissent will not be tolerated, no matter what you might have said in the past.

Almost all the 2016 GOP candidates are going to portray the race as a contest between a bunch of establishment Washington insiders and one independent outsider (who just happens to be whoever is telling you this — nearly all of them will try to make the claim). But very quickly, they will all have to jump through the same hoops and take the same pledges, even if in some cases it means renouncing their previous positions. By the time it’s over this process will make them substantively almost identical, whatever minor differences they had at the outset.

So if Rand Paul wants everyone to think he’s an independent-minded outsider, maybe he should forget about using issues to do it. Maybe he ought to get himself a ranch and a cowboy hat. It’s worked before.

“Your Choice Mr. Speaker”: House Intel Committee Finds No Benghazi Scandal; Will Boehner Ignore Its Findings?

According to Representative Mike Thompson, Democrat of California, a report from the Republican led House Intelligence Committee on the September 2012 attack in Benghazi, Libya, “confirms that no one was deliberately misled, no military assets were withheld and no stand-down order (to U.S. forces) was given.”

Late last week, before Congress headed out of Washington for August recess, the body voted to declassify the document.

After nearly two years of investigations, millions of dollars spent, tens of thousands of pages of documents handed over by the administration, a Republican-led committee is about to release a report stating that there is no evidence of wrongdoing on the part of the Obama White House. In fact, nearly all of the accusations levied against the White House over the past year by conservatives in Congress, and amplified by the media, have now been determined to be false—by a Republican jury.

House Speaker John Boehner is now left with a choice. Will he allow Rep. Trey Gowdy’s kangaroo court, formulated in the guise of a select committee, proceed with its Benghazi investigation, covering ground already delved into not only by the House Intelligence Committee, but by the House Armed Services Committee, the Senate Intelligence Committee, the Accountability Review Board and numerous other investigatory panels?

Doing so would now be nothing short of an explicit vote of no confidence in House Intelligence Committee Chairman Mike Rogers, the Michigan Republican. What will Gowdy, Republican of South Carolina, discover that two years of investigations by his GOP colleagues could not? If the House leadership views the Intelligence Committee as that incompetent, shouldn’t its chairman be replaced?

As The Daily Beast’s Eli Lake reported in May,

“There is deep unease within the Republican leadership that the select committee, which has yet to announce a schedule of hearings, could backfire, and badly. Investigate and find nothing new, and the committee looks like a bunch of tin-hatted obsessives. Investigate and uncover previously-hidden secrets, and it makes all of the other Republican led panels that dug into Benghazi seem like Keystone Kops.”

But what is even more clear now than it was a few weeks ago is that, for Boehner, the appointment of the Benghazi Select Committee has nothing to do with finding the truth about the attack that took the lives of Ambassador Chris Stevens, along with those of Sean Smith, Glen Doherty, and Tyrone Woods. It was theater—and bad theater at that.

Attempting to placate the ideological fringes of the Republican conference by using a taxpayer-funded investigation is at best the most cynical form of politics. To continue the charade after a Republican chairman releases findings that undermine the very core of your investigation is outright fraud.

But the Benghazi Select Committee will keep on moving forward. And it will not end after the 2014 elections. If Hillary Clinton chooses to run, the committee will become a principal tool in the conservative movement’s campaign apparatus against her, holding hearings designed to obscure the truth and smear Clinton during the least opportune moments of the electoral cycle.

And if Clinton is elected in 2016, there is little doubt the work of the committee will continue as long as Republicans continue to control the House of Representatives. Why surrender a taxpayer-funded campaign attack dog, especially one endowed by Congress with subpoena power?

“Obama’s Other Success”: Dodd-Frank Financial Reform Is Working

Although the enemies of health reform will never admit it, the Affordable Care Act is looking more and more like a big success. Costs are coming in below predictions, while the number of uninsured Americans is dropping fast, especially in states that haven’t tried to sabotage the program. Obamacare is working.

But what about the administration’s other big push, financial reform? The Dodd-Frank reform bill has, if anything, received even worse press than Obamacare, derided by the right as anti-business and by the left as hopelessly inadequate. And like Obamacare, it’s certainly not the reform you would have devised in the absence of political constraints.

But also like Obamacare, financial reform is working a lot better than anyone listening to the news media would imagine. Let’s talk, in particular, about two important pieces of Dodd-Frank: creation of an agency protecting consumers from misleading or fraudulent financial sales pitches, and efforts to end “too big to fail.”

The decision to create a Consumer Financial Protection Bureau shouldn’t have been controversial, given what happened during the housing boom. As Edward M. Gramlich, a Federal Reserve official who warned prophetically of problems in subprime lending, asked, “Why are the most risky loan products sold to the least sophisticated borrowers?” He went on, “The question answers itself — the least sophisticated borrowers are probably duped into taking these products.” The need for more protection was obvious.

Of course, that obvious need didn’t stop the U.S. Chamber of Commerce, financial industry lobbyists and conservative groups from going all out in an effort to prevent the bureau’s creation or at least stop it from doing its job, spending more than $1.3 billion in the process. Republicans in Congress dutifully served the industry’s interests, notably by trying to prevent President Obama from appointing a permanent director. And the question was whether all that opposition would hobble the new bureau and make it ineffective.

At this point, however, all accounts indicate that the bureau is in fact doing its job, and well — well enough to inspire continuing fury among bankers and their political allies. A recent case in point: The bureau is cracking down on billions in excessive overdraft fees.

Better consumer protection means fewer bad loans, and therefore a reduced risk of financial crisis. But what happens if a crisis occurs anyway?

The answer is that, as in 2008, the government will step in to keep the financial system functioning; nobody wants to take the risk of repeating the Great Depression.

But how do you rescue the banking system without rewarding bad behavior? In particular, rescues in times of crisis can give large financial players an unfair advantage: They can borrow cheaply in normal times, because everyone knows that they are “too big to fail” and will be bailed out if things go wrong.

The answer is that the government should seize troubled institutions when it bails them out, so that they can be kept running without rewarding stockholders or bondholders who don’t need rescue. In 2008 and 2009, however, it wasn’t clear that the Treasury Department had the necessary legal authority to do that. So Dodd-Frank filled that gap, giving regulators Ordinary Liquidation Authority, also known as resolution authority, so that in the next crisis we can save “systemically important” banks and other institutions without bailing out the bankers.

Bankers, of course, hate this idea; and Republican leaders like Mitch McConnell tried to help their friends with the Orwellian claim that resolution authority was actually a gift to Wall Street, a form of corporate welfare, because it would grease the skids for future bailouts.

But Wall Street knew better. As Mike Konczal of the Roosevelt Institute points out, if being labeled systemically important were actually corporate welfare, institutions would welcome the designation; in fact, they have fought it tooth and nail. And a new study from the Government Accountability Office shows that while large banks were able to borrow more cheaply than small banks before financial reform passed, that advantage has now essentially disappeared. To some extent this may reflect generally calmer markets, but the study nonetheless suggests that reform has done at least part of what it was supposed to do.

Did reform go far enough? No. In particular, while banks are being forced to hold more capital, a key force for stability, they really should be holding much more. But Wall Street and its allies wouldn’t be screaming so loudly, and spending so much money in an effort to gut the law, if it weren’t an important step in the right direction. For all its limitations, financial reform is a success story.

“Hilarious High-Dudgeon Denial”: GOP; How Dare You Say What I Said About Impeachment

The Republican leadership is furious that the media keep talking about their plans to impeach Barack Obama, and the GOP knows who’s injecting this false idea into the talking heads: Barack Obama.

Even as he led the House in the unprecedented step Wednesday of voting to sue a POTUS, House speaker John Boehner insists that all this talk about impeachment is “coming from the president’s own staff, and coming from Democrats on Capitol Hill.” Why? Because they’re trying to rally their people to give money and to show up in this year’s election. We have no plans to impeach the president. We have no future plans,” Boehner emphasized. “Listen, it’s all a scam started by Democrats at the White House.”

And although any alert reporter knows it’s Boehner’s protest that’s the scam (a dozen or so Republican congressmen have openly called for Obama’s impeachment; White House spokesman Josh Earnest named some of them, including Representative Steve King of Iowa and Steve Stockman of Texas, earlier this week), some in the corporate media nevertheless sniff a chance to deploy false equivalencies once more.

Chuck Todd, for example, said on Morning Joe, “I think the White House ought to be embarrassed at how they’re trying to play it. Boehner, the idea that he’s saying, Oh, we’re not talking impeachment. The lawsuit, please. That’s about placating the impeachment caucus in his own party. This is sort of an embarrassing moment for Washington. The leaders of both parties here, they’re driving away people from the polls. They’re driving people away from politics. This is cynical, it’s ugly, it’s disgusting.”

This pox-on-both-your-houses rant ignores the two houses’ very different dimensions. Calling for impeachment when no grounds for it exist and responding to those calls by raising funds to beat the impeachment-wingers at the polls are not equally cynical. It’s true that Democrats are exploiting GOP calls for impeachment to raise ire and money—several million dollars so far. And good for them. Why, in the age of Citizens United, shouldn’t they? “It would be malpractice if they didn’t do it,” Washington Post columnist Jonathan Capehart said on Hardball.

The Republicans’ inability to throw their base red meat without sane people noticing drives them into high-dudgeon denial. Hilariously so. On Tuesday, Fox & Friends co-host Steve Doocy said, “Republicans, conservatives, not talking about it. Only Democrats. It’s to gin up the base before November.” He said this even though, just days earlier, as Media Matters points out, Fox News legal analyst Andrew Napolitano appeared on F&F “and counseled the GOP to impeach the president, which Napolitano claimed would ‘focus his attention immediately.’”

Fox is also trying to gloss over the impeachment soap opera coming from some of its other contributors, like Allen West and, most famously, Sarah Palin. Yeah, but those are just has-been fringers, not to be taken seriously, centrists point out. Chuck Todd even mocked Josh Earnest for listing pro-impeachment officials currently in office. The White House spokesman, Todd said, was “sitting at the podium trying, ticking off names of—oooh-oooh—look at Republicans that want impeachment.”

But look who’s wagging the dog here. According to a CNN/ORC International poll, 57 percent of Republicans say they support impeaching Obama. And Representative Steve Scalise, the new House majority whip, wouldn’t put impeachment off the table when Chris Wallace asked him about it three times. (It was a fascinating example of getting hoisted on your own talking point: each time Scalise refused to rule out impeachment, he blamed Obama for keeping the issue alive.)

For the record, John Boehner won’t take impeachment off that increasingly crowded table either.

Worse, Boehner is ignoring the top GOPer who “started” it: himself. The notoriously weak speaker set this latest round of impeachment talk in motion by bringing the lawsuit against Obama to the floor in the first place. The idea of this “impeachment lite” was to let his Tea Party masters vent their Obama hatred in a way that it would squelch talk of actual impeachment. The Republican leadership knows the issue could backfire on them during the 2014 elections, just as it did when the GOP impeached Clinton in 1998 and lost five House seats that year they previously had in the bag.

But rather than cool impeachment fever, the lawsuit has in fact heated it up by giving extremists in the House another way to question “responsible” Republicans’ true commitment to the cause. At least four of the five conservatives who voted against the lawsuit did so because they think it’s a weenie version of impeachment.

Here’s the bottom line: Boehner responded to impeachment talk from his right wing by filing a lawsuit. Yet when Democrats responded to that same impeachment talk from the same right wing, Boehner claims that it doesn’t exist—and if it does, the Dems are behind it.

We’ve seen this political blame-the-victim game before. Republicans from Glenn Beck to Karl Rove blamed Obama for keeping the birther issue alive by not releasing his long-form birth certificate as soon as they demanded it. (When he did, the Trump-led crazies received a very public pie in the face.) Last October, Republicans with presidential ambitions, like Rand Paul and Ted Cruz, blamed Obama for the government shutdown, even though they both voted for it and maneuvered around their leadership to make it happen. It’s worth recalling that before the shutdown went down, Boehner insisted that it was going nowhere—just as he now swears that impeachment ain’t gonna happen.

Making the GOP bear some responsibility for the crazy in their ranks is the real purpose behind the spotlight Democrats are shining on the right-wing fever swamps. The media’s “both sides do it” reflex obscures the real meaning of this particular charade. Chris Matthews, I think, has it right: he’s been saying the right wants to delegitimize this president (more than they did even Clinton), to put an “asterisk” by his name in the history books so they can pretend that a black man was never really the president of the United States.

If Republicans win the Senate in November, then we’ll be hearing more a lot more about impeachment, no matter how much John Boehner says otherwise.
