“Racism; It’s The Law”: What Institutional Racism Looks Like When We Finally Notice It

Smoke and fire, sirens blaring, horns honking, a sudden hail of bullets. This is what passes for the American dialogue on race and justice.

It’s hidden until it explodes.

“By 10 p.m.,” the Wall Street Journal informed us, “a St. Louis County Police squad car burned just down the street from the Ferguson Police Department, with spare ammunition ‘cooking off’ or exploding in the car.”

Those who want to shake their heads in disgust can do so. American institutional racism conceals itself so neatly from those who prefer not to see it and, of course, aren’t victimized by it. And then every so often something sets off the public trigger — an 18-year-old young man is shot and killed by a police officer, for instance — and the reality TV that is our mainstream news brings us the angry, “violent” response, live. And it’s always one side against another; us vs. them. It’s always war.

“But what is justice in a nation built on white supremacy and the destruction of black bodies?” Mychal Denzel Smith wrote in The Nation the day after the grand jury announced that police officer Darren Wilson would not be indicted. “That’s the question we have yet to answer. It’s the question that shakes us up and makes our insides uncomfortable. It’s the question that causes great unrest.”

What is justice, indeed? And beyond that question are the real questions, perhaps unanswerable. What is healing? What is peace?

If an officer had been indicted in Michael Brown’s killing, and then convicted on one charge or another, maybe that would have been justice, in a “case closed” sort of way. In our limited legal bureaucracy, justice means nothing more than punishment. Even when such justice is done, it changes nothing. The state’s “interest” has been satisfied and that’s all that matters. The terrible loss suffered by parents, friends and community would remain a gaping wound. And beyond that, the social brokenness and racism that caused the tragedy in the first place would remain unaddressed, unhealed.

But not even that minimal justice was in the cards for the loved ones of Michael Brown, or the occupied community in which he lived — because that’s not how it works. Officer Wilson, whatever he did inside or outside the state’s rules on the use of lethal force when he confronted Brown on the afternoon of Aug. 9, was just doing his job, which was controlling and intimidating the black population of Ferguson. He was on the front line of a racist and exploitative system — an occupying bureaucracy.

The New York Times, in its story about the grand jury verdict, began thus: “Michael Brown became so angry when he was stopped by Officer Darren Wilson on Canfield Drive here on Aug. 9, his face looked ‘like a demon,’ the officer would later tell a grand jury.”

This sort of detail is, of course, of immense value to those who sympathize with the police shooting and accuse the black community of endemic lawlessness. See! Michael Brown wasn’t just a nice, innocent boy minding his own business. He and his companion were trouble incarnate, walking down the middle of the street spoiling for a fight. He was Hulk Hogan. The cop had no choice but to shoot, and shoot again. This was a demonic confrontation. Politeness wouldn’t have worked.

If nothing else, such testimony shows the stark limits of our “who’s at fault?” legal system, which addresses every incident in pristine, absurd isolation and has no interest beyond establishing blame — that is to say, officially stamping the participants as either villains, heroes or victims. Certainly it has no interest in holistic understanding of social problems.

Taking Wilson’s testimony at face value, one could choose to ask: Why was Michael Brown so angry?

Many commentators have talked about the “anger” of Ferguson’s black community in the wake of the shooting, but there hasn’t been much examination of the anger that was simmering beforehand, which may have seized hold of Brown the instant the police officer stopped him.

However, an excellent piece of investigative journalism by Radley Balko of the Washington Post, which ran in September — “How municipalities in St. Louis County, MO, profit from poverty” — addresses the issue head on. He makes the point that local municipal governments, through an endless array of penny-ante citations and fines — “poverty violations” — torment the locals for the primary, or perhaps sole, purpose of keeping their bureaucracies funded.

“Some of the towns in St. Louis County can derive 40 percent or more of their annual revenue from the petty fines and fees collected by their municipal courts,” Balko writes. The fines are mostly for traffic offenses, but they also include fines for loud music, unmown lawns, “wearing saggy pants” and “vague infractions such as ‘disturbing the peace,’” among many others, and if the person fined, because he or she is poor, can’t pay up, a further fine is added to the original, and on and on it goes.

“There’s also a widely held sentiment that the police spend far more time looking for petty offenses that produce fines than they do keeping these communities safe,” Balko writes. “If you were tasked with designing a regional system of government guaranteed to produce racial conflict, anger, and resentment, you’d be hard pressed to do better than St. Louis County.”

Regarding the anger and resentment in communities like Ferguson, he quotes a longtime racial justice activist, Jack Kirkland, who says: “I liken it to a flow of hot magma just below the surface. It’s always there, building, pushing up against the earth. It’s just a matter of time. When it finds a weak point, it’s going to blow.”

And when it blows, we get to watch it on TV: the flames, the smoke, the rage, the ammo “cooking off.” This is what institutional racism looks like when we finally notice it.

“Where Is The Outrage”: How States Are Redistributing The Wealth

In 2008, then-candidate Barack Obama was lambasted for supposedly endorsing policies of wealth redistribution. The right feared that under an Obama presidency, Washington would use federal power to take money from some Americans and give it to others. Yet, only a few years later, the most explicit examples of such redistribution are happening in the states, and often at the urging of Republicans.

The most illustrative example began in 2012, when Kansas’ Republican Gov. Sam Brownback signed a landmark bill that delivered big tax cuts to high-income earners and businesses. Less than two years after that tax cut, the state’s income tax revenues plummeted by a quarter-billion dollars — and now Brownback is pushing to use money for public employees’ pensions to instead cover the state’s ensuing budget shortfalls.

Brownback’s proposal: Slash the state’s required pension contribution by $40 million to balance the state budget, even though Kansas already has one of the worst-funded pension systems in the nation.

Brownback defended his proposal to take money from middle-class state workers and use it to effectively finance his tax cuts for the wealthy. He told the Wichita Eagle: “It’s kind of, uh, well where are you going to go for the funds? And I don’t like it, but it’s kind of what’s your other option if you don’t hit K-12 and higher ed with allotments?”

Brownback is not alone. He joins fellow Republican Gov. Chris Christie in coupling large tax breaks with cuts to actuarially required pension payments. In New Jersey, Christie slashed required pension payments while signing legislation expanding tax credits to corporations, and doling out a record amount of taxpayer subsidies to businesses. Many of those subsidies have flowed to firms whose executives have made campaign contributions to Republican political organizations. Earlier this month, New Jersey pension trustees filed a lawsuit against Christie for not making legally required contributions to the state’s pension system.

Both Brownback and Christie promoted their tax cuts as instruments to boost economic growth. Yet, a recent review of federal data by the Kansas City Star found Kansas “trails most other states when it comes to job growth.” Likewise, an investigative series by Gannett newspapers recently found “New Jersey’s job growth rate [is] the second worst in the nation. … New Jersey’s middle class has lost billions in income through layoffs, salary cuts and wage freezes [and] more than 100,000 job seekers have been unemployed for months on end.”

Illinois followed a somewhat similar path. For years, lawmakers did not make the full actuarially required pension payments, causing severe funding shortages in the state’s pension system. While lawmakers said there was little money to meet pension obligations, Democratic Gov. Pat Quinn signed a corporate tax cut in 2011 that is projected to cost the state more than $370 million a year in lost revenue. Two years after signing that bill, as pension funding gaps swelled, Quinn signed legislation slashing public employees’ retirement benefits. An Illinois judge last month ruled that the legislation violated the state’s constitution, though the ruling is being appealed.

The obvious question raised by these episodes is: Where is the outrage? To date, these attempts to use workers’ money to finance massive giveaways to the rich have generated little media coverage or political opposition — and certainly less than the full-fledged frenzy that took place when Obama made his “spread the wealth” comment a few years ago.

The tepid response to this kind of wealth transfer suggests that for all the angry rhetoric about redistribution you might hear on talk radio, cable TV and in the halls of Congress, the political and media class is perfectly fine with redistribution — as long as the cash flows from the 99 percent to the 1 percent, and not the other way around.

“Tidings Of Comfort”: On Multiple Fronts, Government Wasn’t The Problem; It Was The Solution

Maybe I’m just projecting, but Christmas seemed unusually subdued this year. The malls seemed less crowded than usual, the people glummer. There was even less Muzak in the air. And, in a way, that’s not surprising: All year Americans have been bombarded with dire news reports portraying a world out of control and a clueless government with no idea what to do.

Yet if you look back at what actually happened over the past year, you see something completely different. Amid all the derision, a number of major government policies worked just fine — and the biggest successes involved the most derided policies. You’ll never hear this on Fox News, but 2014 was a year in which the federal government, in particular, showed that it can do some important things very well if it wants to.

Start with Ebola, a subject that has vanished from the headlines so fast it’s hard to remember how pervasive the panic was just a few weeks ago. Judging from news media coverage, especially but not only on cable TV, America was on the verge of turning into a real-life version of “The Walking Dead.” And many politicians dismissed the efforts of public health officials to deal with the disease using conventional methods. Instead, they insisted, we needed to ban all travel to and from West Africa, imprison anyone who arrived from the wrong place, and close the border with Mexico. No, I have no idea why anyone thought that last item made sense.

As it turned out, however, the Centers for Disease Control and Prevention, despite some early missteps, knew what they were doing, which shouldn’t be surprising: The Centers have a lot of experience in, well, controlling disease, epidemics in particular. And while the Ebola virus continues to kill many people in parts of Africa, there was no outbreak here.

Consider next the state of the economy. There’s no question that recovery from the 2008 crisis has been painfully slow and should have been much faster. In particular, the economy has been held back by unprecedented cuts in public spending and employment.

But the story you hear all the time portrays economic policy as an unmitigated disaster, with President Obama’s alleged hostility to business holding back investment and job creation. So it comes as something of a shock when you look at the actual record and discover that growth and job creation have been substantially faster during the Obama recovery than they were during the Bush recovery last decade (even ignoring the crisis at the end), and that while housing is still depressed, business investment has been quite strong.

What’s more, recent data suggest that the economy is gathering strength — 5 percent growth in the last quarter! Oh, and not that it matters very much, but there are some people who like to claim that economic success should be judged by the performance of the stock market. And stock prices, which hit a low point in March 2009, accompanied by declarations from prominent Republican economists that Mr. Obama was killing the market economy, have tripled since then. Maybe economic management hasn’t been that bad, after all.

Finally, there’s the hidden-in-plain-sight triumph of Obamacare, which is just finishing up its first year of full implementation. It’s a tribute to the effectiveness of the propaganda campaign against health reform — which has played up every glitch, without ever mentioning that the problem has been solved, and invented failures that never happened — that I fairly often encounter people, some of them liberals, who ask me whether the administration will ever be able to get the program to work. Apparently nobody told them that it is working, and very well.

In fact, Year 1 surpassed expectations on every front. Remember claims that more people would lose insurance than gained it? Well, the number of Americans without insurance fell by around 10 million; members of the elite who have never been uninsured have no idea just how much positive difference that makes to people’s lives. Remember claims that reform would break the budget? In reality, premiums were far less than predicted, overall health spending is moderating, and specific cost-control measures are doing very well. And all indications suggest that year two will be marked by further success.

And there’s more. For example, at the end of 2014, the Obama administration’s foreign policy, which tries to contain threats like Vladimir Putin’s Russia or the Islamic State rather than rushing into military confrontation, is looking pretty good.

The common theme here is that, over the past year, a U.S. government subjected to constant bad-mouthing, constantly accused of being ineffectual or worse, has, in fact, managed to accomplish a lot. On multiple fronts, government wasn’t the problem; it was the solution. Nobody knows it, but 2014 was the year of “Yes, we can.”

“Tribal America”: How Do We Bridge the Gap Between ‘Us’ and ‘Them’?

Within hours of the grand jury decisions in Ferguson and Staten Island, protests erupted across America. Sometimes peaceful, sometimes violent, they brought the issue of race and policing to the front burner once again. The heat has now ignited a man who assassinated two New York police officers in a fit of calculated retaliation. The peaceful protesters condemned those murders. The police condemned the protesters, and both condemn politicians. Welcome to tribal America.

In his provocative book, Moral Tribes, Joshua Greene argues that morality evolved to solve the problem of fighting among those who had to cooperate in order to survive. Shared moral rules were evolution’s way of keeping “you” and “me” from mutual destructiveness. “You” and “me” became “we” in service to our shared needs. But when other groups showed up, “we” became “us,” a tribe opposed to “them.” Violence and destruction too often followed, and we still search for a shared morality that works across tribes.

Tribes today can be close geographically as well as virtually, aided in both cases by social media. Common values, customs and ways of thinking bind each “us” and separate it from “them.” Widely dispersed Americans angry at racial injustice form a tribe, as do strong supporters of law enforcement – no matter where any of them live.

Tribes can be helpful or harmful, depending on whether their members work to bridge the “us-them” divide or deepen it. Unfortunately, what we are seeing as police and protesters square off is unproductive.

Ferguson and New York are brush strokes on a wider canvass of tribal behavior in America. On a host of social, political, economic, environmental, and educational issues, tribes abound. Like-minded people find each other and push their agendas. To a point, that is both appropriate and useful as well as consistent with American republican government. But when it goes too far, as it does on many issues, it frays the fabric of the very society it aims to fix. When protestors loot and burn, when an angry man kills police officers, when a mayor tries to distance himself from the police, when police officers turn their back on the mayor, when a former mayor blames the president, and when the chief of police tells the mayor he has blood on his hands, what good is served?

We rightly condemn destructive tribal behavior in places as far flung as the Middle East, Africa, and Eastern Europe. Why don’t we recognize and restrain it at home? If we want to cure our country, it’s time for tribes – and those who wish to lead them – to have the courage to act differently.

Tribes need to listen. This means managing their emotions and practicing the art of dialogue. Listening (not talking) and understanding (not necessarily accepting) the values and views of others helps set angry advocacy aside. Such a respectful, open stance humanizes “them” as well as “us.” When people listen to “them,” it tells them that they have been heard. Until this happens in Ferguson and New York, where most people in both tribes still claim they have not been heard, collaborative solutions will be elusive.

Tribes need to learn. Their tendency is insular – to see from the vantage point of their own biases. They defend and rationalize rather than explore their core assumptions. They get information by cherry picking from sources that are “trusted” because they agree with tribal views. They have an ax to grind, but axes cut things down rather than build them up. Protesters need to learn what the police fear and understand how many are killed or injured in the line of duty. Police need to understand what a black man feels when a police officer approaches and how to alter their own behavior during those encounters. When tribes embrace learning, their views (and then their actions) will change.

Tribes need to focus on the purposes they share with other tribes. Citizens and police both want safe streets and communities. But right now, they are dug in around their positions – what they demand from others, not what they can do for each other and by working together.

Tribes need leadership – from within and without – that does not seek personal gain by showing how much anger they share but seeks to bridge the chasm between them and other tribes. Where is the protest leadership that asks its tribe to calm down, respect the great bulk of police who are doing their best under trying circumstances, and offers solutions that demonstrate not only their own needs but the rightful demands of others? Where are the police chiefs and mayors who are willing to acknowledge and admit that they sometimes make terrible mistakes, that they can and must do better, and that they are asking their communities for constructive suggestions?

Tribes also need supportive politicians and media. The former have been too quick to take sides and inflame. The latter have been too willing to hype the conflict. What percentage of news stories on the events since Michael Brown’s death have focused on those seeking to foster better police-citizen cooperation and understanding? How much coverage have the media given to quiet healers as opposed to those whose anger makes a more enticing sound bite?

We will soon celebrate the birthday and life of Martin Luther King, Jr. Tribal behavior was rampant in his day as well, but King was a “crossover” figure. He urged his followers to love their opponents, and his goal went beyond desegregation to a universal brotherhood. Police and protestors today could learn a lot from this man, for whom there was only one tribe, the tribe of humanity.

“An Internalized Fear Of Black Males”: ‘Confirmation Bias’ Has Long History Of Helping Whites Demonize Blacks

Does “confirmation bias” influence the way whites think about police shootings of young men of color?

This bias is the tendency to interpret or remember information in a way that confirms what we already believe, and helps us to ignore new data. And it may explain the tension between white cops and black kids — and the public reaction to them — more than outright racism does.

Many of us think police must be in the right because we have internalized a fear of black males and assume that they are up to no good.

As Harvard sociologist Charles Ogletree has pointed out, “Ninety-nine percent of black people don’t commit crimes, yet we see the images of back people day in, day out, and the impression is that they’re all committing crimes.”

Young black males in recent years were at 21 times greater risk of being shot dead by police than their white counterparts, reports ProPublica, which analyzed federal data this year. It found that in “1,217 deadly police shootings from 2010 to 2012, blacks, age 15 to 19, were killed at a rate of 31.17 per million,” compared with 1.47 per million white males in that age range.

Roger J.R. Levesque of Indiana State University says that eyewitnesses to crimes generally report scenarios that are consistent with confirmation bias. Among the studies he cites is one in the Journal of Experimental Social Psychology that found merely seeing a black face led subjects to be more likely to mistake objects for weapons.

In Ferguson, Mo., the white officer who fatally shot Michael Brown, an unarmed black 18-year-old, described Brown as demon-like. Would he have used such a word if the teenager had been white?

Confirmation bias undoubtedly helped the defense in the 2013 trial in the death of Trayvon Martin. Lawyers successfully “thuggized” the black teenager, who was walking home carrying candy and a bottle of tea when he was shot by a white neighborhood watch member. Martin had no criminal record, but the defense dug up some minor problems he had in school and made an animated video showing him attacking the white man who shot him. There was no actual evidence that the unarmed teenager started the fight. But jurors clearly bought that narrative.

Throughout U.S. history, confirmation bias has helped some white people use the image of the evil black man for their own ends. The “Willie Horton” TV ad caused a huge controversy when it ran during the 1988 presidential race between George H.W. Bush and Massachusetts Gov. Michael Dukakis. The ad featured a fearsome-looking mug shot of a black convict who raped a woman while free under a Massachusetts prison furlough program backed by Dukakis. The ad was intended to picture Dukakis as soft on crime, and it worked.

Whites trying to escape punishment for their crimes sometimes find black men convenient scapegoats, because they are so readily seen as prone to crime. In 1989, a Boston white man, Charles Stuart, was shot in a black neighborhood in the city, along with his pregnant wife. He blamed a “black male.” His wife and son, who was delivered prematurely, later died.

News coverage was extremely sympathetic until evidence surfaced indicating that Stuart shot his wife and himself.

In 1994, Susan Smith, a South Carolina woman, claimed that a black man had hijacked her car and kidnapped her two young sons. For days, the news media gave around-the-clock coverage to a nationwide search for the black carjacker. But no such man exist. Smith had drowned her two sons by pushing her car into a lake with the boys inside. She had a wealthy boyfriend who allegedly was not interested in having a “ready-made” family.

It’s no wonder whites so easily accept the image of the evil black male. But this was not always so.

Early in the history of slavery in the Western Hemisphere, notes Audrey Smedley, now professor emeritus of anthropology at Virginia Commonwealth University, blacks were not set apart from other laborers. The first slaves the English used in the Caribbean were Irish. And there were more Irish slaves in the middle of the 17th century than any others.

At that time, Smedley writes, African slaves and European slaves “worked together, they played together … they lived together” and color didn’t “make much difference … because they were all in the same boat.”

One 17th century planter who wrote to the trustees of his company said, “Please don’t send us any more Irishmen. Send us some Africans, because the Africans are civilized and the Irish are not.”

But plantations grew ever larger and the African slave trade exploded. To justify the cruelty of lifetime slavery, the myth had to be manufactured that blacks — especially men — were subhuman and violent. That image stuck.

In the years since, those ideas too often have intensified. As Georgetown University professor Michael Eric Dyson points out, “More than 45 years ago, the Kerner Commission concluded that we lived in two societies, one white, one black, separate and still unequal.” And we still do. If we don’t resolve this gap, Dyson writes, “We are doomed to watch the same sparks reignite, whenever and wherever injustice meets desperation.”

Only when we realize the power of confirmation bias, and start looking at reality instead of stereotypes and misinformation, will things change.
