“Just Another Gutless Sniveler”: A Funny Thing Happened On Marco Rubio’s Way To The Nomination
Poor Marco Rubio.
As the prospects for comprehensive immigration reform sink, so go his hopes of establishing himself as the solid Republican frontrunner in the 2016 campaign for the White House.
Meanwhile, the junior Florida senator is under siege from the bug-eyed right wing of his own party. Glenn Beck called him a “piece of garbage,” and even the Tea Party has turned on him. It’s gotten so bad that GOP action groups are putting out commercials saying nice things about Rubio, just to preserve his shot at the presidency.
Unfortunately, immigration reform is the only serious issue on which Rubio has presumed to lead. Otherwise, his time in Washington has been quiet and forgettable.
During the big post-Newtown debate on expanding background checks of firearms buyers, Rubio revealed himself as just another gutless sniveler controlled by the NRA. In the budget battle he offered not a single new idea, only boilerplate attacks on President Obama over the federal deficit (which is now, to the chagrin of Republican presidential hopefuls, shrinking).
Immigration reform was to be Rubio’s golden ticket to the nomination — a young Hispanic candidate from a critical swing state, bridging with Latino voters a huge gap that helped cost Mitt Romney the election last year.
The immigration bill that has finally passed the Senate would add more resources for border security while offering a long road to full citizenship for millions of illegal immigrants. The legislation is doomed to crash in the Republican-controlled House of Representatives, where Speaker John Boehner has been neutered by the hardcore who take their cues from radio screamers like Beck.
Many of those House members disdainful of immigration reform don’t have to worry about their own re-election because they come from carefully gerrymandered districts where the majority of voters are older white conservatives.
As long as the House remains tilted so far right of the nation’s political center, and continues to smother all efforts at moderate compromise, the Republicans have virtually no prayer of recapturing the White House in three years.
This grim obstacle has become clear to Rubio and others seeking to be the next GOP nominee, as well as to some heavy political action groups that have launched an unusual ad campaign in several states.
One Florida ad running on Fox News encourages viewers to phone Rubio and “thank him for keeping his promise, and fighting to secure the border.” The commercial was funded by the conservative American Action Network (these big-money groups always have the word “American” in their name, to show how patriotically unselfish they are).
Another one, Americans for Conservative Direction, recently ran pro-Rubio ads in Iowa, the first major primary state, and also the whitest. “Stand with Marco Rubio to end de facto amnesty,” the commercial proclaimed.
And next month, in one of the grandest hypocrisies of the entire immigration furor, the Americans for Prosperity Foundation is for the first time taking its annual conference away from Washington.

Why is this so funny? Because the Americans for Prosperity Foundation is basically the infamous Koch brothers, Charles and David, those ultra-conservative billionaires who spend their free time and money trying to buy elections.
Paradoxically, their campaign contributions and massive media blitzes helped to install some of the same fire-breathing gasbags in Congress who are now dismantling immigration reform and damaging Rubio’s chances to be president.
That the Kochs would come to Florida and put Rubio center stage illustrates the bewildered desperation now plaguing the Republican Party. Charlie and Dave have seen the sorry poll numbers from 2012, and know they can’t win the White House without a titanic shift of Hispanic votes.
Apparently the strategy is to present a candidate who is heroically identified with pushing for immigration reform, while the brothers continue working backstage to ensure that reform itself has zero chance of becoming law.
Maybe that’s the secret strategy of the GOP leadership, too. The recent burst of political ads isn’t a pro-immigrant pathway so much as pro-Rubio, portraying him as a principled crusader on a sensitive issue.
The aim is to build him up as presidential material and deflect the ridicule from the far right.
For a candidate comfortably positioned in the political mainstream, being called “a piece of garbage” by a clown like Glenn Beck would be a badge of honor, something to brag about.
Rubio’s problem is that he isn’t in the mainstream, and he doesn’t have the conviction to get there. He won’t stand up to Beck just like he wouldn’t stand up to the NRA.
And if the immigration overhaul goes down the tubes, he might be standing in the wings at the next Republican convention, watching someone else get nominated.

“Based On Ambition”: Marco Rubio Decides Whether He Wants To Kill Immigration Reform Or Not
The Senate has just begun the weeks-long process of debating and voting on the immigration reform bill crafted by the “gang of eight.” Harry Reid would like the bill passed on July 4, for the rather obvious symbolism. Supporters are still confident that the bill will pass the Senate.
The best thing the bill has going for it is that Mitch McConnell is going to actually allow it to come to the floor. (Minority Leader McConnell has veto power over most Senate business, because many senators have convinced themselves that the founders wanted him to.) The “gang” has four Republican members, meaning only a few more are needed in order to reach 60 votes and beat a potential filibuster. Kelly Ayotte is one Republican who’s publicly announced her support for the bill.
That assumes, obviously, that all Democrats and all the Republican members of the “gang” vote for their own bill, which might not happen. In fact “gang” member Marco Rubio has threatened to vote against the bill unless it includes “tougher” border security. And amending the bill so that Democrats no longer want to vote for it is one of the Senate anti-reform bloc’s strategies for defeating the bill. Rubio has begun signalling that he supports such an amendment, by Senator John Cornyn, that would increase surveillance and enforcement at the border. More importantly, it would prevent the “trigger” point at which immigrants can apply for green cards, and then citizenship, from happening until a series of incredibly unreasonable security standards are met, including “90 percent of illegal border crossers” apprehended and “100 percent border surveillance, or situational awareness, of each one-mile segment of the Southern border.”
(In Bush’s second term, Cornyn made similar proposals, and then decided not to support reform after all, surprise surprise.)
Meanwhile, Ted Cruz, a right-wing populist Senate newcomer who may want to be president, just like Senator Rubio, has, unlike Rubio, won himself a great deal of conservative affection by declaring himself immigration reform’s greatest enemy in the Senate. In explaining his opposition to Yahoo, Cruz sums up the right-wing argument: If immigration reform fails, Democrats will be to blame, because they insisted that immigration reform actually do something about immigrants:
“The biggest obstacle to passing common sense immigration reform is President Barack Obama,” Cruz tells The Fine Print, going on to say that the White House’s “insistence” on including a path to citizenship is standing in the way of the bill’s ultimate passage.
Cruz has not “ruled out” a filibuster, which means he will filibuster. But then everyone already assumed the bill would require 60 votes to pass.
This is Rubio’s problem: It’s hard to see the GOP changing so much by 2016 that having been essential in passing immigration reform won’t be seen by many conservative activists as a massive liability. Rubio had a “pass” from conservative media figures like Rush Limbaugh to work on this stuff before, because everyone sort of “agreed” immigration reform was necessary. The further we get from November 2012, though, the less urgent it seems, and the nativist factions are reasserting themselves. Mark Krikorian in the National Review and Mickey Kaus at the Daily Caller are trashing Rubio almost every day. This Powerline post is a good example of the sort of press he’s increasingly getting. Rubio is now supporting amendments demanding incredibly strict border enforcement before the “path to citizenship” can begin. This is what conservatives want. The Powerline guy’s headline is “MARCO RUBIO’S LATEST FIG LEAF.” The problem, you see, is that Rubio’s proposed security amendments will rely on the government to enforce them, and you can’t trust the government. There’s not really any pleasing these guys, except, of course, with a bill that provides no path to citizenship at all — which is the Cruz approach.
The calculation now, for Rubio, is a bit complicated. If it looks like something close to the Senate bill can pass the House with Republican support, Rubio is no longer the sole conservative responsible for it happening. He escapes blame. If the Senate bill passes with Rubio’s support and then Boehner decides to get the bill through the House with Democratic votes, Rubio will be branded a traitor to the conservative cause for the rest of eternity. If it passes the Senate and dies in the House, Rubio stuck his neck out for nothing.
When Rubio met behind closed doors with some of the most conservative members of the House, he was less trying to sell the bill than he was getting a feel for the room. As the National Review’s Jonathan Strong says:
Opponents and advocates estimate that 10 to 20 Republican senators are on the fence. Politics, as much as policy, is driving their final calculus. What they need isn’t always some specific change but rather, as one top Republican described it, a “secret sauce” of political cover.
Rubio’s argument is that he’s working to make the bill conservative enough to pass. But aligning himself with people like Cornyn, whose goal is to make the bill totally unpalatable to Democrats, suggests that he’d be fine with simply making the bill unpassable. And right now prospects in the House look grim. Last week, Republicans passed a bill designed to force the administration to deport “Dream” immigrants — people who’ve done well in school or in the armed forces since arriving here as children. Former House “gang” affiliate Raul Labrador quit the group. House Judiciary Committee Chairman Bob Goodlatte, whose committee will have to approve the bill before it reaches the House floor, doesn’t want a comprehensive bill. He wants a series of smaller, stand-alone bills that will allow Republicans to vote for more border security without also voting for “amnesty.” Few Republican members of the House have any personal political incentive to moderate on immigration: Most of their seats are safe.
And in 2014, and 2016, conservative voters won’t be thinking of the long-term demographic health of the Republican party. They’ll just be asking whether Republicans worked with or against this reviled administration. Rubio knows this. His decision to become a key player on immigration was based on his ambition, not any particular principled concern for the undocumented. His ambition will continue to determine his course of action.

“Worried About The Right Wing”: Marco Rubio Threatens To Betray His Allies On Immigration Reform
As we discussed in April, Sen. Marco Rubio (R-Fla.) spent a few months playing an awkward game on comprehensive immigration reform. On the one hand, Rubio has been a high-profile member of the “Gang of Eight,” helping negotiate the details of the legislation. On the other hand, the Florida Republican signaled his willingness to oppose the legislation he’s ostensibly helping write. Rubio would say he likes his own bill, but wouldn’t commit to it.
Many of those involved in the process grew weary of Rubio straddling the fence. It was common to hear Capitol Hill insiders joke that the senator thought he could be “a little bit pregnant” on the policy.
But all that changed in mid-April, when Rubio got off the fence and began championing the legislation he helped craft. And all of that changed again late yesterday when Rubio said he’s prepared to reject his own legislation.
Speaking with radio host Hugh Hewitt Tuesday, Rubio said the Senate should “strengthen the border security parts of this bill so that they’re stronger, so that they don’t give overwhelming discretion to the Department of Homeland Security.” He said he was working with other senators on amendments to do just that.
Then Hewitt asked: “If those amendments don’t pass, will you yourself support the bill that emerged from Judiciary, Senator Rubio?”
Rubio answered, “Well, I think if those amendments don’t pass, then I think we’ve got a bill that isn’t going to become law, and I think we’re wasting our time. So the answer is no.”
Even for Rubio, this is bizarre. The Florida Republican had concerns about provisions related to border security, which he worked out through the “Gang of Eight” negotiations — his colleagues made the changes he wanted to see, which in turn led Rubio to endorse the bipartisan legislation.
But now the senator is moving the goalposts, saying the changes that have already been made aren’t good enough, and unless he’s able to move his bill even further to the right, Rubio is prepared to reject his own legislation.
Well, maybe Democrats can once again give Rubio what he wants, keeping the larger effort intact?
I’m afraid not — Rubio is asking far too much.
Senate Minority Whip John Cornyn intends to introduce a sweeping amendment to the immigration bill when it goes on the floor next week, seeking to replace an entire section devoted to border security and tweak the national security and criminal justice titles.
Sen. Marco Rubio (R-Fla.), one of the members of the Senate’s bipartisan Gang of Eight, has been working with Cornyn on the amendment “for weeks,” a Rubio aide said.
The Texas Republican wants stricter border patrol provisional “triggers” before registered immigrants are allowed to apply for green card status. His amendment would require 100 percent operational control of the Southern borders and that 90 percent of illegal border crossers be apprehended. It would also require 100 percent border surveillance, or situational awareness, of each one-mile segment of the Southern border and installment of a national E-Verify system before registered immigrants can pursue green cards.
No serious person involved in the negotiations believes this is a responsible approach. Indeed, no one even thinks these standards are realistic — it’s exactly why the Gang of Eight considered and rejected these measures during their negotiations. Rubio said they weren’t necessary to earn his support for the legislation, and now he’s saying they are.
He is, in other words, apparently prepared to betray his allies.
And why would Rubio do this? Because the Republican Party’s radicalized base opposes comprehensive reform, and Rubio’s support for the bill will undermine his future career ambitions, including a likely run for national office in 2016. [Update: Adam Serwer notes this is ultimately pointless, since the right will still resent the fact that he helped write a bill they hate, and the left will resent the fact that he walked away from a deal reached in good faith.]
There is an important caveat to all of this: Rubio has waffled before. I don’t recall him going as far as he did with Hugh Hewitt, but the Florida Republican occasionally waffles, only to be brought back into the fold. Reform proponents can hope that McCain and Graham will give him a call this morning, Rubio will walk back his comments from yesterday, and the process will move forward. Rubio isn’t a policy guy, so it’s possible he got rattled yesterday and said what he didn’t entirely mean.
But if we take his words at face value, Rubio has put the future of immigration reform at great risk, basically because he’s worried right-wing activists won’t like him anymore.

“Your Tax Dollars At Work, Or Not”: Marco Rubio Wants To Amend The Constitution To Repeal Obamacare
Sen. Marco Rubio (R-FL) proposed a constitutional amendment Tuesday that, if approved, would nullify Obamacare’s individual mandate. The amendment is the latest in a string of failed GOP attempts to repeal Obamacare, which many Republicans still view as unconstitutional.
The “Right to Refuse” amendment would make any laws that tax Americans who fail to purchase goods or services unconstitutional, targeting the Affordable Care Act’s stipulation that nearly all Americans must purchase health insurance. The amendment was introduced by Rep. Steven Palazzo (R-MS) in the House in February.
In a press release, Rubio cited the recent Internal Revenue Service scandal as one of his reasons for introducing the bill:
“ObamaCare is a disastrous policy that is not only destructive to job creation, it will also unleash the corrupt and scandal-ridden IRS on taxpayers simply for not buying health insurance,” said Rubio. “We should put our faith in the American people to decide what goods and services they want to buy, not have Congress dictate it and have the IRS empowered to harass Americans to make sure they do it.”
The Supreme Court ruled in 2012 that Obamacare’s individual mandate could be considered a tax, and therefore was upheld under the constitution. But that hasn’t stopped many Republicans from claiming Obamacare is unconstitutional — the act has survived at least 37 repeal attempts since Republicans took control of the House in 2011, the most recent repeal vote occurring in mid-May. Since news broke in May that the IRS flagged certain conservative groups applying for tax-exempt status for additional scrutiny, several Republican leaders have used the scandal to question whether the IRS can be trusted to implement Obamacare.
Constitutional amendments are far more difficult to pass than bills — amendments proposed by Congress require a two-thirds majority vote in the House and Senate. With a Democrat-controlled Senate, Rubio and Palazzo’s amendment would have difficulty achieving even a simple majority. Rubio has been billed as a rising star in the Republican party and likely 2016 presidential candidate, but his fervent opposition to Obamacare — along with several other positions — show that his views don’t stray far from the status quo of the Republican party.

“Kindergartner’s Behaving Badly”: The GOP Is Too Juvenile To Govern
With budgetary tantrums in the Senate and investigative play-acting in the House, the Republican Party is proving once again that it simply cannot be taken seriously.
This is a shame. I don’t share the GOP’s philosophy, but I do believe that competition makes both of our major parties smarter. I also believe that a big, complicated country facing economic and geopolitical challenges needs a government able to govern.
What we don’t need is the steady diet of obstruction, diversion and gamesmanship that Republicans are trying to ram down the nation’s throat. It’s not as if President Obama and the Democrats are doing everything right. It’s just that the GOP shrinks from doing anything meaningful at all.
The most glaring example, at the moment, is in the Senate. For four years, Republican senators lambasted their Democratic colleagues — with justification — for not approving a budget, one of the basic tasks of governance. Sen. John Cornyn(R-Tex.), and others regularly took to the Senate floor to announce the number of days since the body last produced a spending plan and to blast Majority Leader Harry Reid (D-Nev.) for this shocking failure.
Two months ago, Reid and the Democrats finally passed a budget. Since the House has already passed its version — the controversial plan authored by Rep. Paul Ryan (R-Wis.) — the next step should be for both chambers to appoint members of a conference committee that would iron out the differences. But Republicans won’t let this happen.
Specifically, far-right conservatives including Ted Cruz of Texas, Marco Rubio of Florida, Mike Lee of Utah and Rand Paul of Kentucky are refusing to allow the Senate to appoint its representatives to the conference. Yes, having demanded this budget for four years, Republicans are now refusing to let it go forward.
Some Republicans, that is. Establishment types such as John McCain of Arizona are apoplectic at the antics of their tea party-inspired colleagues, which McCain called “absolutely out of line and unprecedented.”
Cruz and the others are worried that a conference committee might not only work out a budget but also make it possible to raise the federal debt ceiling without the now-customary showdown threatening default and catastrophe. They believe that brinkmanship is the only way to stop runaway government spending, which produces massive trillion-dollar deficits, which add to the ballooning national debt, which . . .
Hold on, senator. According to the nonpartisan Congressional Budget Office, the deficit is shrinking rapidly and will fall to $642 billion this fiscal year. That’s still substantial, but it’s less than half the deficit our government ran in 2011. More important, if annual deficits continue to decline as the CBO predicts, the long-term debt problem begins to look more manageable. That’s good news, right?
What Republicans ought to do is declare a victory for fiscal conservatism and move on to the battle to have their priorities reflected in the budget — a promising fight, since the conferees appointed by the GOP-controlled House are hardly going to be flaming liberals. Instead, the party seeks not consensus but crisis.
This is no way for a 2-year-old to act, much less the self-proclaimed “world’s greatest deliberative body.”
And speaking of juvenile behavior, I would be remiss not to mention how Rep. Darrell Issa of California and his GOP colleagues in the House are embarrassing themselves by straining to turn Obama administration missteps into Watergate-style scandals.
The deaths of four Americans in Benghazi, Libya, resulted from a security lapse of the kind that every recent administration, unfortunately, has suffered. Since future administrations will have lapses as well, congressional oversight could be useful in at least making sure the specific mistakes of Benghazi are not repeated. But instead, House Republicans summon the television cameras and ask round after round of tendentious questions — without paying the slightest attention to the answers.
Similarly, on the question of how and why the IRS gave added scrutiny to conservative “social welfare” groups seeking nonprofit status, House inquisitors seem barely interested in what actually happened. “What did the president know and when did he know it?” was an appropriate question. But the follow-up — “Harrumph, well then, why didn’t he know sooner?” — isn’t much in the way of scandal material.
And concerning the Justice Department’s overzealous crusade to thwart classified leaks — and investigative reporting — it is amusing to watch House Republicans twist themselves into champions of the hated Lamestream Media. Who knew?
None of this is boosting the GOP’s poll numbers. I’ve got an idea: Why don’t they try doing the people’s business for a change?
