“Two Different Fantasies”: The Coming Conservative Tax Cut Deficits Will Make Bush’s Look Puny
For going on a year now, a group of reform-minded conservatives has been gently coaxing more pious coreligionists into supporting a tax reform plan that would violate the first commandment of supply-side economic theory.
In a broad sense, the two groups share similar goals. Both want to distribute income upward. The difference is that reformicons would like to limit the amount of upward redistribution to preserve some significant spoils for middle-class workers with children. They’ve rallied behind legislation, drafted by Senator Mike Lee (a Tea Party favorite from Utah) that would lower the top marginal tax rate only modestly—from about 40 to 35—while creating generous new tax credits for families with kids. The supply siders, as you probably guessed, want to ply those spoils into even larger rate cuts for the wealthy. The poor are left almost entirely out of the equation.
Under normal circumstances, the two camps would resolve a policy dispute like this by splitting the baby (the proverbial one; not the human one that comes with a generous tax-subsidy). But as supply-side stalwart Congressman Paul Ryan explained recently, asking rate-cutters like him to check their rate-cutting ambitions would be like asking Lance Armstrong to share his “secret sauce” with mid-tier racers—not much help for them, at the expense of his competitive edge. And on the flip side, the reformicons can’t yield too much to the supply siders, because at some point the political payoff (more money for the middle class) would disappear along with the whatever supposed incentive the credits would create for people to start families.
Enter Ramesh Ponnuru, a high-profile reformicon, with a plan to win Ryan over using clever spin. Just pretend the Lee plan’s child tax subsidies are comparable to tax cuts for investors, except the investors here are parents rescuing the country from a bleak demographic future, and the tax cuts are actually new tax expenditures.
“You can’t draw up a realistic budget with a top tax rate of 25 percent and a large child credit,” Ponnuru writes for Bloomberg. “(You might not be able to draw up a realistic budget with a top rate of 25 percent even without the credit.) You probably can, however, draw up one with a lower top rate than we have today and better treatment for investment — including parents’ investment in the next generation. Because that mix of policies would leave many millions of middle-class families ahead, it may well be easier to enact than a plan that concentrates solely on reducing the top rate. Supply-siders, that is, might achieve more of the rate reduction they seek if they embrace the credit.”
This is another way of saying that the politics of the Lee plan are vastly more appealing than the politics of the Ryan plan. The tax blueprint in Ryan’s budget is such a political disaster that it would likelier die in committee than become law in some less radical form, leaving Ryan with no rate reduction at all. Under the circumstances, he’d be better off settling for less-severe rate cuts and plying some of the projected deficits into the pockets of the middle class.
That’s absolutely true. But for supply-sider zeal, it would settle the argument under the prevailing terms. Yet those terms omit something fundamental to both plans: deficits. Neither party to the conversation has used the word deficit even once. And when you introduce the idea that both of these plans—not just Ryan’s—are deficit-financed (or financed with implicit tax increases on the poor and middle classes) it becomes hard to fathom why a tug of war between the reformicons and the supply-siders is necessary at all.
Lee offsets his tax cuts by eliminating and reducing a swath of tax expenditures. Nevertheless, they would increase deficits $2.4 trillion over ten years. Ryan’s plan would probably increase them by twice as much (before offsets, which he’s never specified). There isn’t a point along the connecting line where this trespasses into fantasy. These are just two different fantasies. Under the circumstances, the smart play isn’t for the reformicons to out-debate the supply siders, or to negotiate with them, but to buy them off. Give Ryan a big rate cut. Keep the middle-class child subsidies. Don’t bother paying for either, in full.
This, as Ponnuru sort of implies, would be deeply irresponsible. But it would enjoy the dual benefits of papering over the rift and solving the GOP’s miser problem, in much the same way that George W. Bush solved his regressivity problem in 2001 by cutting everyone’s taxes (the wealthy merely got a hefty bonus tax cut).
Instead Lee is teaming up with Senator Marco Rubio to narrow the $2.4 trillion shortfall. Perhaps they’ll succeed. But they’ll also have widened the conservative rift, leaving them a plan that’s intended to forge an alliance between the ruling and working classes, but does less for the former than the supply siders and less for the latter than Democrats. Actually legislating will almost certainly require surrendering to one faction or the other.

“Mr. States Rights In A Political Pickle”: How The Constitution May Screw Rand Paul For 2016
Rand Paul has a little-discussed problem. Yes, he’s riding a wave. Yet another new poll brings happy tidings, putting him at the top of the GOP heap in both Iowa and New Hampshire (although still well behind “undecided”). He keeps doing these clever things that titillate the Beltway sages, like coupling with Democratic Sen. Cory Booker (ooh, he’s black!) on sentencing reform. All this, you know. He’s a shrewdie, we have to give him that.
But here’s what you maybe don’t know. Paul is up for reelection in 2016. One assumes that he would want to hold on to his Senate seat. If he ran for president, he would hardly be the first person hoping to appear on a national ticket while simultaneously seeking reelection, although the other examples from the last 30 years have all been vice-presidential candidates: Paul Ryan in 2012, Joe Biden in 2008, Joe Lieberman in 2000, and… trivia question, who’s the fourth?
For those, it hadn’t been a problem. But it is for Paul, because under Kentucky law, he cannot run for two offices at the same time. The law has been on the books in the Bluegrass State for a long time. Paul quietly asked that it be changed, and the GOP-controlled state senate acquiesced this past session. But the Democrats have the majority in the lower house, and they let the bill expire without voting on it. I would reckon, unless the Kentucky state house’s Democratic majority is possessed of a shockingly benevolent character unlike every other legislative majority I’ve ever encountered, it won’t be rushing to pass it.
Paul has said that he’d just ignore the law.
We should stop and pause to appreciate that: Rand Paul, of all people, arguing that states don’t have the authority to dictate the rules for federal elections. Yes, Mr. States’ Rights insists that this is the province of the federal government!
It gets even better. The tradition that states set the rules of their elections and always have was not handed to us by a bunch of pinko mid-century judges, but lo and behold, by the Framers themselves. I give you Article I, Section 4 of the Constitution: “The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of choosing Senators.” So not only is Mr. States’ Rights backing the federal jackboot as long as it’s kicking on his behalf, but Mr. Tea Party Strict Constitutionalist is challenging the Constitution!
Here’s what the Supreme Court has had to say on the matter. There are two cases that are most relevant, U.S. Term Limits Inc. v. Thornton and Cook v. Gralike. In those cases, the court held that Arkansas and Missouri’s respective term-limit laws added extra qualifications to seek office that weren’t found in Article I, Sections 2 and 3 of the Constitution (the sections that state the qualifications for candidates for the House of Representatives and the Senate). That is, the court protected candidates who had served X number of terms and were thus, under those states’ laws, prohibited from seeking office again. You can’t do that, said the court to states; you’re in essence adding an extra-constitutional “qualification” for office (that a candidate can’t have served more than three terms). Sen. Paul can argue that Kentucky’s law imposes an extra-constitutional qualification on him—that if he wants to run for president, the state has added the “qualification” that he not also run for Senate.
I’m no lawyer, but that sounds like a reach to me. A term-limits law is a clear imposition of an added qualification. But a law requiring that a person seek only one office at a time seems to me like a perfectly reasonable thing for a state to decide, under the word “manner” in the relevant constitutional passage, if it wants to. States have had these laws for a long time. Florida has one, too, and Marco Rubio—also up for reelection in 2016 and also considering a White House run—has defended it and said of running for the presidency: “I think, by and large, when you choose to do something as big as that, you’ve really got to be focused on that and not have an exit strategy.”
Paul said in June: “Can you really have equal application of federal law if someone like Paul Ryan or Joe Lieberman can run for two offices, but in Kentucky you would be disallowed? It seems like it might not be equal application of the law to do that. But that means involving a court, and I don’t think we’ve made a decision on that. I think the easier way is to clarify the law.” Touching. I doubt Paul worries too much about the “equal application of federal law” for pregnant women who live in states where they’ve found ways to shut down every federally legal abortion clinic. And of course, historically speaking, there are the black Kentuckians and Southerners generally who weren’t soaking up much equal application of federal law until the passage of the Civil Rights Act that Paul so famously told Rachel Maddow in 2010 he would have opposed.
Paul is going to be in a political pickle over this. Remember, a presidential candidate has never done this in modern history, just vice-presidential ones (trivia answer: Lloyd Bentsen in 1988). Vice president—who really cares. But president? Even if he prevailed in court, can a person really run for president of the United States while also seeking another office? Rubio sounds right here to me. This is the presidency. It just seems cheesy. Plain and simple, Paul should have to choose.

“The Right Problem, The Wrong Solution”: GOP Policymakers May Not Have Thought This One Through
Almost immediately after President Obama unveiled his plan to resolve the border crisis, congressional Republicans balked. There were, House Speaker John Boehner complained, no provisions in the plan about sending National Guard troops to the border.
A week later, the president was in Texas, where he met with a variety of state officials, including Gov. Rick Perry (R). The Republican governor emphasized one point above all others: he wants Obama to deploy National Guard troops to the border.
GOP policymakers may not have thought this one through. In fact, Greg Sargent talked to the head of the National Guard under the Bush/Cheney administration, who offered a valuable perspective.
[I]n an interview today, the head of the National Guard under George W. Bush said he had not yet heard a clear rationale for sending in the Guard and suggested it might not be the appropriate response to the problems at the core of the current crisis, though he did say he could envision the Guard playing some sort of part in a broader solution.
“Until mission requirements are clearly defined, it can’t be determined whether this is an appropriate use of the Guard in this particular case,” H. Steven Blum, who was the Chief of the National Guard Bureau from 2003 to 2009 and has been a career military man for decades, told me. “There may be many other organizations that might more appropriately be called upon. If you’re talking about search and rescue, maintaining the rule of law or restoring conditions back to normal after a natural disaster or a catastrophe, the Guard is superbly suited to that. I’m not so sure that what we’re dealing with in scope and causation right now would make it the ideal choice.”
That seems to be an exceedingly polite way of saying, “Republican demands don’t seem to make any sense.”
Some of this seems to be the result of GOP confusion about the nature of the story itself. Many Republicans seem to believe this is a border-security crisis, which the National Guard can help address directly.
But that’s not consistent with the facts on the ground.
In many instances, unaccompanied children are simply turning themselves in once they find border patrol agents. That’s not a border-security crisis; that’s largely the opposite.
Indeed, Fox News’ Brit Hume, hardly a progressive media voice, asked Perry to explain over the weekend what the National Guard would actually do if deployed to the border. The Texas governor struggled to explain his own position, saying only that Guard troops would send a “message that gets sent back very quickly to Central America.”
Hume reminded Perry “[I]f these children who’ve undergone these harrowing journeys, to escape the most desperate conditions in their home countries, have gotten this far, are they really going to be deterred by the presence of troops along the border who won’t shoot them and can’t arrest them?”
At this point, Perry changed the subject.
This is not to just pick on the Texas governor; Republican confusion about the border seems fairly common. Sen. Marco Rubio (R-Fla.) said last week, “Let’s remember, this administration went around for years saying the border has never been more secure than it is now. I think that’s been exposed as a fallacy over the last three weeks.”
But again, this is plainly at odds with reality. It’s not a “fallacy”; the Obama administration really has strengthened border security to new heights in recent years. The humanitarian crisis doesn’t undermine this fact at all. For Rubio to make such a comment suggests he doesn’t fully understand the underlying challenge.
If it seems like policymakers are having a debate in which two sides are talking past each other, it’s because that’s largely what’s happening. The GOP wants Guard troops, but they’re not sure why, and they’re convinced there’s a border-security crisis, which doesn’t really exist.
For his part, Obama has said he’s willing to deploy the National Guard, basically to make Republicans feel better in the short term, if it’s part of a larger response to the crisis. At least for now, GOP leaders have said this isn’t good enough.

“Borderline Behavior”: GOP Demands Action, Blocks Solutions — And Always Complains
Listening to Republicans in Washington (and Texas and Arizona) scream about the “crisis” of migrant children arriving from Central America on our southern border, it is puzzling to realize that they don’t actually want to do anything to solve the problem. Nor do these hysterical politicians – led by that down-home diva Rick Perry, the governor of Texas – want to let President Obama do anything either.
Except that they insist the president absolutely must visit the border, in person, preferably with a thousand members of the National Guard (who could join the Border Patrol and local police in accepting the children as they surrender). Strangely enough these Republicans, along with a few Texas Democrats, seem to believe that is the most important action Obama could undertake.
Understandably, the president is skeptical. “This isn’t theater,” he responded tartly. “This is a problem. I’m not interested in photo ops. I’m interested in solving a problem.” As he knows, this episode is only the latest in a long sequence of similar clown shows, with Republicans citing ridiculous reasons to delay or prevent government action. His irritation is fully justified.
But perhaps Obama should have gone down to the border anyway, stood in the blazing sunlight with the dim governor for as long as Perry wished – and allowed the television cameras to show that their presence had accomplished exactly nothing. Of course, if Obama showed up at the border, the Republicans assuredly would criticize him for wasting time on a photo op. They have become the party of perpetual whining.
When they aren’t bleating about Obama, they’re concocting weird theories about his secret plans to destroy America. Only last week, Perry coyly hinted – although he said he didn’t want to be “conspiratorial” — that the White House must be “in on” the border crossings, because migrant kids couldn’t have showed up en masse without “a highly coordinated effort.” Later, he tried to persuade CNN’s Kate Bolduan that he didn’t really mean what his idiotic words said – an explanation everyone has heard from him before.
While Perry has taken the lead, he isn’t the only elected official whose mouth spews absurdities on this subject. Senator Ron Johnson (R-WI) offered a policy approach that would please any simpleton, when he explained why the President’s request for $3.7 billion in emergency funding looks far too big to him. “I’ve gone online and have taken a look on Orbitz and taken a look at what does it cost to fly people to El Salvador and Guatemala and Honduras. You have fares as low as $207. There’s nonstop flights at $450. You take those numbers and it costs somewhere between $11 million and $30 million to return people in a very humane fashion,” he opined.
Evidently nobody informed the Wisconsin senator about the myriad other costs involved in rounding up and caring for these terrified children, who are entitled to a court hearing and other consideration under an anti-trafficking law signed by George W. Bush. Anyone who wants to expedite their removal – a disturbingly inhumane and unnecessary policy – must first provide more courts, judges, and lawyers. And anyone who wants a decent policy, which includes action against the drug warlords who are threatening and killing these innocents, must be prepared to spend more than the cost of an Orbitz ticket.
Some Republicans, notably Senator Marco Rubio (R-FL), are urging the president to include their pet projects in his spending bill, such as electronic verification requirements for employers and at border crossings. And many GOP lawmakers, having demanded action on the border issue from Obama, are equally adamant that the funding must be “offset” by cuts in other programs.
None of these geniuses appears to realize that all their barking and carping and mooning are frustrating the president’s attempt to address the “crisis” that is agitating them so fiercely. Or more likely they know exactly what they’re doing — and the point, as usual, is to embarrass Obama.
But not every Republican talks total nonsense about the border and immigration. Alfonso Aguilar, who headed the Office of Citizenship under Bush, recently wrote: “Contrary to the narrative of some opportunistic politicians and pundits, this unfortunate situation is not the result of the Obama administration failing to enforce the law. In reality, most would-be-migrants believe that crossing the border has become much more difficult, and in the last decade, the U.S. government has greatly strengthened border security and interior enforcement.”
Meanwhile, the majority of Americans is increasingly repulsed by the primitive nativism and partisan opportunism of Republican leaders on immigration. Democrats, independents, and even many rank-and-file Republicans want a more decent and constructive policy. Ultimately voters must grasp that the GOP is the greatest single obstacle to every vital reform. That day cannot come too soon.

“Desperation Mode”: What ‘Draft Mitt’ Reveals About The GOP’s Future
Could Mitt Romney really run for president again in 2016?
According to Rep. Jason Chaffetz (R-UT), the answer is yes. During a Monday evening appearance on MSNBC’s Hardball, Chaffetz insisted that Romney will not only run — but that this time, he’ll win.
“A hundred times he says he’s not, but Mitt Romney has always accomplished what he’s set out to do,” Chaffetz explained to host Chris Matthews. “I think he’s proven right on a lot of stuff. I happen to be in the camp that thinks he’s actually going to run, and I think he will be the next president of the United States.”
Chaffetz, who endorsed Romney early in the 2012 primaries, is not the only Republican to call for a third Romney run. Former Bush administration Assistant Treasury Secretary Emil Henry penned a Politico op-ed which (favorably) compared Romney to Richard Nixon. The Washington Post reported on a GOP donor summit which “quickly became a Romney revival,” and quoted several of the attendees pining for another presidential bid from the twice-failed candidate.
“Everybody realizes we’re devoid of leadership in DC,” top Republican fundraiser Harold Hamm told the Post. “Everybody would encourage him to consider it again.”
The report also notes that MSNBC host and former Republican congressman Joe Scarborough encouraged the crowd “to begin a ‘Draft Romney’ movement in 2016,” insisting that “this is the only person that can fill the stage.”
Such a movement now exists; more than 51,000 people have signed a petition urging Romney to run in the next election.
Despite all of this “Mittmentum,” the odds of a Romney run remain extremely long. Romney himself has repeatedly denied any interest in another White House bid, and after the long string of indignities he suffered during his two presidential campaigns, it’s easy to believe him.
Still, the “Draft Mitt” drive is undisputably a real and growing movement within the GOP. And that must be profoundly sad for Republicans.
For years, Republicans boasted of their “deep bench” of 2016 presidential contenders (a narrative that was eagerly embraced by the political media). But by 2014 the bench has been left, as Salon’s Joan Walsh deftly put it, “in splinters.” New Jersey governor Chris Christie entangled himself in “Bridgegate” as his state’s economy sank. Wisconsin governor Scott Walker is fending off ethics questions of his own, and is no longer even a safe bet to be re-elected in 2014. Louisiana governor Bobby Jindal boasts a 32 percent approval rating in his own state. Florida senator Marco Rubio’s clunky attempts to appeal to both sides of the GOP civil war left him detested by both. Senator Ted Cruz (R-TX) is literally Democrats’ dream candidate. And former Viriginia governor Bob McDonnell is literally on his way to jail.
Of course, Romney has plenty of baggage of his own. He’s still the same stiff, sneering right-wing plutocrat who struggled to fight off the likes of Herman Cain and Rick Santorum before losing the general election by 126 electoral votes. In 2016, he’d face the added hurdles of age (at 69, he’d be tied with Ronald Reagan as the oldest president to ever enter the office), and the fact that it’s been nearly a decade since he’s held a job other than unsuccessfully running for president.
It’s not as though Republicans aren’t aware of Romney’s flaws; many of them vocally and repeatedly pointed them out in 2008 and 2012, when Romney still had a realistic shot at becoming president. That some are now crawling back to him when his odds would be longer than ever speaks volumes about the damaged state of the Republican Party.
