“A Big Staging Ground For The More Diffuse Fight”: The Supreme Court Didn’t Cure Republicans Of Homophobia
It’s tempting to imagine that the abrupt end to the fight for marriage equality will ultimately prove to be a godsend for frustrated Republicans. Same-sex marriage enjoys the backing of a huge, youthful political movement, and, before the Supreme Court made it legal nationwide, it was becoming the kind of issue that could seal a politician’s fate with a huge swath of voters. In settling the debate by fiat, the Court might also have saved Republicans from having to wage the alienating opposition to marriage equality for several more years.
Though the Court had the power to end that fight mercifully, it could do nothing about the fact that many conservatives opposed marriage equality because they believe gays and lesbians are inherently defective, and thus couldn’t prevent the energy conservatives have spent battling marriage equality from spilling over into other issues.
Just this week, for instance, the Boy Scouts decided to change its longstanding policy and allow gay men to lead amenable scout troops. Wisconsin Governor Scott Walker, who announced his presidential candidacy on Monday, responded by saying he liked things better the way they were before, because the blanket ban on gay scout leaders “protected children.”
There are two ways to interpret Walker’s statement, both of which speak to the view that same-sex marriage resistance is more than just an expression of concern for the traditions of a particular institution. If you believe that banning gay people from Boy Scouts “protects children,” then you either believe discredited caricatures of gay men as child predators or you believe homosexuality and homosexuals are unsavory things that children should be “protected” from categorically, like drug addiction or verbal abuse.
The movement to make the Boy Scouts a more tolerant organization may not be as large or public facing as the movement to force states to recognize same-sex marriages. But it’s still a big staging ground for the more diffuse fight over how our society should treat gays and lesbians generally. And because the question at hand doesn’t touch on the nature of the Boy Scouts as an institution, it’s much harder for conservatives to disguise deprecatory views of LGBT people themselves behind an alleged concern for institutional continuity.
Which is all to say, Republican politicians will still have plenty of opportunities to treat gays and lesbians like aberrant miscreants. The ongoing partisan disagreement over LGBT equality will gather at smaller focal points, but the overall political valence of the issue won’t disappear anytime soon.

“Protecting Equality”: What Some Black Church Leaders Have Wrong About Gay Marriage — And Civil Rights
The African American church and its leadership have often been at the forefront of movements for equality. But the recent Supreme Court ruling on same-sex marriage has shed light on the resistance to social change among some black church leaders —and has left them sounding more like white conservative leaders.
On June 26, the Court ruled that two consenting adults have the right to get married—even if they are the same gender. As conservatives lamented the loss of morality and warned of the hellfire that would soon rain down upon us, President Barack Obama and the White House celebrated the decision.
Just a few hours later, Obama delivered a eulogy for Clementa Pinckney. Pinckney was a South Carolina state senator and a pastor at the historically black Emanuel African Methodist Episcopal church before he was shot and killed, along with eight other members, by white supremacist Dylann Roof during a Bible study on Wednesday, June 17. The juxtaposition was quite remarkable. It was a day marked by joyous celebration and indescribable pain: the first black president at the funeral of a black man killed by a white supremacist, on the same day same-sex marriage became the law of the land.
In May 2015, the Pew Research Center found that support for same-sex marriage among all Americans increased drastically from 39 percent in 2009 to a whopping 57 percent. Opinions on same-sex marriage vary by race, with 59 percent of whites, 56 percent of Hispanics, and just 41 percent of blacks in support.
One of the biggest indicators in whether a group is in favor of same-sex marriage is religion. Of those unaffiliated with religion, 85 percent support marriage equality. In contrast, 70 percent of white evangelical Protestants oppose gay marriage, as do 57 percent of black Protestants.
Since at least 1992, blacks have voted overwhelmingly for Democrats, the reason being that the modern-day Democratic Party champions causes that appeal to the black community: economic inequality, fair housing, taxing the rich, welfare, and public education. Meanwhile, the modern-day Republican Party consistently stands for causes that disproportionately hurt blacks. And much to the chagrin of conservative black pastors, the Democratic president (and those who hope to succeed him) is publicly in favor of same-sex marriage.
In May 2012, after Vice President Joe Biden came out in support for marriage equality, Obama quickly did as well. “I think same-sex couples should be able to get married,” he said during an interview with ABC News. And while many across the United States celebrated Obama’s voiced support, he faced backlash from black pastors.
The Coalition of African-American Pastors (CAAP) is a socially conservative organization made up of black church leaders. After Obama’s endorsement of marriage equality, the president of CAAP, Reverend William Owens, sounded the moral alarm. “We were once proud of President Obama, but our pride has turned to shame,” he said. “The man holding the most powerful position in the world is stooping to lead the country down an immoral path.”
After the Supreme Court ruling last week, CAAP doubled down on Facebook. “Pres. Obama’s legacy: Obamacare and Gay care,” read one post. Another update used the “unelected judges” talking point, widely used by conservative politicians when they don’t agree with a SCOTUS outcome:
Today is a significant setback for all Americans who believe in the Constitution, the rule of law, democratic self-government, and marriage as the union of one man and one woman. The Court got it wrong: it should not have mandated all 50 states to redefine marriage.
Five unelected judges do not have the power to change the truth about marriage or the truth about the Constitution.
According to The Christian Post, CAAP and other African American Christian leaders threatened mass civil disobedience. “If they rule for same-sex marriage, then we’re going to do the same thing we did for the civil rights movement,” proclaimed Owens. The fact that protesting a law protecting equality is antithetical to the civil rights movement must be lost on Owens and CAAP. Just as notable is the lack of recognition they seem to have for how the black LGBT community has long been at the intersection of racial equality and gay rights.
Two trans women of color were at the forefront of the Stonewall riots, widely considered the beginning of the modern LGBT equality movement. Sylvia Rivera, of Puerto Rican descent, was later one of the founders of both the Gay Liberation Front and the Gay Activist Alliance. She and Marsha P. Jackson, who was black, started the Street Transgender Action Revolutionaries, which advocated for homeless LGBT people.
Today’s Black Lives Matter movement, which mirrors so much of the movement of the 1960s, was started when three queer black women created the hashtag—Patrisse Cullors, Alicia Garza, and Opal Tometi—after George Zimmerman shot and killed Trayvon Martin in 2013. Writing for The Feminist Wire this past October, Garza declared that, “Black Lives Matter affirms the lives of Black queer and trans folks, disabled folks, Black-undocumented folks, folks with records, women and all Black lives along the gender spectrum.” The Black Lives Matter movement was inclusive and intersectional from the beginning.
The black LGBT community is strong and has been fighting for civil rights for decades. The coalition of black pastors who invoke the civil rights movement when they rail against the rights of gay couples should consider reading some history books.

“Martyrs To Marriage Equality”: The Famous Bakers And Florists Of Conscience
The thing that really amazes me about much of the conservative reaction to Obergefell v. Hodges, and indeed much of the religion-based complaints over LGBT rights generally, is the sense of personal grievence. I mean, on the one hand you’ve had people who’ve been persecuted, bullied, denied equal rights for ages, finally getting the right to do something the rest of us take for granted, and on the other hand you have people who are offended by them. This helps explain the hilarious fixation among conservatives about identifying the fifteen people in America who might be so homophobic that their “religious views” come into direct conflict with anti-discrimination laws–you know, the famous Bakers and Florists of Conscience. Agitating the air to make this extremely marginal “grievance” into something tangible, and then inflating it wildly with all sorts of specious slippery-slope arguments that next thing we know the Catholic Church will be forced to make gay sex a sacrament, has pretty much been the sum and substance of the “religious liberty” backlash.
And so today we find all too many Christian conservatives unable to feel empathy towards people expressing joy at their now-established ability to get married, and instead making themselves out as martyrs, to the everlasting embarrassment, I am quite sure, of the actual Christian Martyrs of the Ages who suffered harm to more than their sensitivities or prejudices.
I was driven to write this today not by Bobby Jindal or Mike Huckabee or the other pols trying to put themselves at the head of a pathetic parade of outrage, but by a post at the Federalist by “international pro-family” advocate John-Henry Westen warning of the totalitarian repression about to hit Christians, as evidenced by his experience with what had happened in Canada and Europe.
And of what is this wave of repression composed? Basically lawsuits, most of them withdrawn.
As anyone who has been to law school can tell you, there is no place short of Utopia without constant, frequent lawsuits, some serious, some frivolous. Neighbors battle in court against neighbors for decades over ridiculously small boundary disputes; disgrunted employees and employers carry their disagreements into courts every day; divorcing and ex-spouses ruin themselves and each other in the fight for the last word almost as often as they don’t. If, as several of the examples offered by Western suggest, he thinks the Roman Catholic Church is going to be nailed to a cross of LGBT litigation, I would suggest there’s another source of lawsuits that is rather obviously a bigger threat.
Westen does have an alternative argument against legalized same-sex marriage that’s not about the terrible martyrdom that awaits any dissenter against the Rainbow Fascist State. In a reductio ad absurdum of the hate the sin, love the sinner chestnut, he argues love for gay people compels not letting them get married:
[B]ecause same-sex relationships hurt everyone involved, marriage supporters have a duty to oppose inverted relationships out of love and compassion.
Despite being perhaps 4 percent of the U.S. population, the LGBT community sees devastating levels of HIV/AIDS, depression, anal cancer, suicide, shorter lifespans, and other ailments. Again, it is up to Christians, and especially our pastors, to energize society with the beautiful love of our faith. We never should have given up talking about sex [sic!], and we must start doing so anew.
As former Canadian LGBT leader Gens Hellquist said in 2006, “I am tired of watching my community die” of diseases endemic to the LGBT community. A Catholic with a master’s degree in psychology who visited a ward for HIV/AIDS patients in India, he saw it was clear that only monogamous, marital relationships are healthy for human beings.
So there you have it: we need to prevent people from getting married so as to force them into “monogamous, marital relationships.”
That’s the second biggest howler in Westen’s piece (or maybe the third, after the claim that conservative Christians don’t talk enough about sex!). The biggest is in the headline: “Same-Sex Marriage Won’t Bring Us Peace.” Nor will it bring us 4% GDP growth or a solution to the Israeli-Palestinian conflict. The idea is to bring us justice. But on second thought, there is a connection, or so thought Pope Paul VI, who famously said: “If you want peace, work for justice.”

“After Two Decades Of Litigation”: Supreme Court Extends Same-Sex Marriage To All 50 States
The Supreme Court has declared that same-sex couples have a right to marry anywhere in the United States.
Gay and lesbian couples already can marry in 36 states and the District of Columbia. The court’s ruling on Friday means the remaining 14 states, in the South and Midwest, will have to stop enforcing their bans on same-sex marriage.
The outcome is the culmination of two decades of Supreme Court litigation over marriage, and gay rights generally.
Justice Anthony Kennedy wrote the majority opinion, just as he did in the court’s previous three major gay rights cases dating back to 1996.

“Josh Duggar And The Purity Lie”: ‘Pure’ And ‘Godly’ Because They Police And Condemn Other People’s Sexual Lives
Josh Duggar, the oldest son of Jim Bob and Michelle Duggar, stars of “reality” TV and the real life conservative movement, has resigned his position as executive director of FRC Action, the political action arm of the Family Research Council, after In Touch magazine reported that he sexually abused young girls, including, apparently, his sisters, as a teenager.
In a statement to People magazine, Duggar, now 27, said:
Twelve years ago, as a young teenager, I acted inexcusably for which I am extremely sorry and deeply regret. I hurt others, including my family and close friends. . . . I confessed this to my parents who took several steps to help me address the situation. We spoke with the authorities where I confessed my wrongdoing, and my parents arranged for me and those affected by my actions to receive counseling. I understood that if I continued down this wrong road that I would end up ruining my life.
Ruining his life.
According to the police report, Jim Bob and Michelle, paragons of parenting, hid Josh’s crimes from the police and the public. In Touchreports, based on the police report it obtained via a Freedom of Information Act request, that:
Josh Duggar was investigated for multiple sex offenses — including forcible fondling — against five minors. Some of the alleged offenses investigated were felonies. Jim Bob and Michelle Duggar were interview [sic] by the Springdale Police department on Dec. 12, 2006. The report says that James told police he was alerted in March, 2002 by a female minor that Josh — who turned 14-years-old that month — had been touching her breasts and genitals while she slept. This allegedly happened on multiple occasions. In 2006, Jim Bob told police that in July, 2002 Josh admitted to fondling a minor’s breasts while she slept. “James said that they disciplined (redacted, Josh) after this incident.” The family did not alert authorities.
The police report reveals that Jim Bob Duggar “met with the elders of his church and told them what was going on” rather than contacting law enforcement. Josh was then sent to “Christian counseling” for three months, which, according to his mother’s admission, was not any sort of licensed counseling facility:
Asked about the training center that Jim Bob said Josh was sent to, Michelle told police, according to the report, “it was not really a training center. Det. [Darrell] Hignite asked if the guy [redacted, Josh] talked to was a certified counselor. She said no. She said it was a guy they know in Little Rock that is remodeling a building. Det. Hignite asked if the guy was more of a mentor. She said “kind of.”
In their own statement to People, Jim Bob and Michelle say that “when Josh was a young teenager, he made some very bad mistakes, and we were shocked. We had tried to teach him right from wrong,” that “each one of our family members drew closer to God,” and that they “pray that as people watch our lives they see that we are not a perfect family.”
But the Duggars and their supporters have very deliberately marketed them as a perfect family—or if not perfect, at least pure, and in particular, sexually pure.
The first episode of their “reality” television show aired in 2008, two years after the police interviewed family members about the sexual assaults that had taken place in 2002 and 2003; the statute of limitations had already run and the police could not pursue charges.
In 2010, the Family Research Council, Josh’s future employer, gave Jim Bob and Michelle the “Pro-Family Entertainment” award, describing the family as “outspoken ambassadors for Christian values in a secular world.”
On their television program in 2009, Josh Duggar was portrayed as devoting himself to a “courtship” with his future wife Anna, rather than dating, which was derided as part of the “divorce culture:”
Tonight, Anna described her husband to People as “someone who had gone down a wrong path and had humbled himself before God and those whom he had offended.”
This week, a recap of their television show on their blog discussed how Jim Bob and Michelle “encourage their kids to take a chaperone along on all their dates so they have someone to keep them accountable and ensure that they stick to their courtship standards.” In their family, they police sex outside of marriage. In politics they police sex between consenting adults, sex between people of the same sex; they are “pure” and “godly” because they police and condemn other people’s sexual lives. But now the public knows that this family which enforces “purity” has covered up the sexual predations—against children, even their own children— of their star son.
The Duggars haven’t shied away from “protecting” children in other contexts. As Right Wing Watch reports, last year Josh Duggar “led a successful campaign to defeat a LGBT nondiscrimination measure in Fayetteville, Arkansas, which he said jeopardized the safety of children,” and that his mother “also ran a robocall pushing for the repeal of the city’s nondiscrimination ordinance, which she warned would empower ‘child predators’ to threaten ‘the safety and innocence of a child.’”
The Duggars are no ordinary spokespeople for the religious right; they are super-spokespeople. For years, they have been held up as exemplars of biblical living, of devotion to Christ, and of, especially, homespun honest living and sexual purity. It’s long been obvious to many that this is a product of marketing and packaging, not reality. But now no one can pretend anymore.
