“Surprise! Republicans Aren’t Serious About Reform”: The GOP’s Lame Attempt To Blame Obama For The Failure Of Immigration Reform

This week, it became all too clear that House Republicans don’t really want to address immigration reform in any meaningful way this year. And if the reform effort does wither on the vine, Republicans know just who to blame: themselves.

Ha, just kidding. They’re going to blame President Obama.

A mere week after unveiling a list of immigration “principles” that the GOP would pursue, Speaker of the House John Boehner (R-Ohio) said Thursday that handling immigration this year would be “difficult,” because many Republicans don’t trust Obama.

“There’s widespread doubt about whether this administration can be trusted to enforce our laws,” he said. “And it’s going to be difficult to move any immigration legislation until that changes.”

Of course, a bipartisan immigration reform package has already passed the Senate, which includes an eye-popping $40 billion for border security. Obama has even signaled that he would be prepared to sign into law a more modest package, including one that bestowed only legal status — as opposed to citizenship — to undocumented workers.

The obstacle to reform has always been in the GOP-controlled House, where hardcore conservatives have opposed any law that bears even a whiff of amnesty. That, in turn, has spooked potential reform supporters who are wary of a primary challenge.

Indeed, Boehner’s so-called principles can be seen as a trial balloon that was quickly deflated by members of his own party, including influential conservative writers like The Weekly Standard‘s William Kristol, who argued that the issue unnecessarily divided the GOP ahead of the 2014 midterms.

Boehner’s remarks were still notable, though, in that they are part of a ridiculous attempt to pin the blame on Obama, a strategy that Republicans have been testing out for months.

Back in October, Sen. Marco Rubio (R-Fla.), who helped author the Senate’s immigration bill before fleeing to chase down his lost conservative credibility, said Obama poisoned immigration reform by standing firm through the government shutdown and debt ceiling fight. By not agreeing to the GOP’s fantastical demands that he gut his health-care law, Rubio said, Obama made immigration reform “harder to achieve.”

“The president has undermined this effort, absolutely, because of the way he has behaved over the last three weeks,” he said.

To be sure, some on the right have charged all along that the White House can’t be trusted to meet tough border security and verification requirements, necessitating “specific enforcement triggers” before a path to citizenship or legal status could even come into play. What’s different now is that the claim has gone mainstream, a reflection of how desperate the GOP is to convey to Latino voters that they would do something on immigration were it not for Obama.

A sampling from the past week:

  • Rep. Paul Ryan (R-Wis.): “Here’s the issue that all Republicans agree on — we don’t trust the president to enforce the law.”
  • House Majority Leader Eric Cantor (R-Va.): “There’s some real question of trust here and the White House continues to really thumb its nose up, if you will, at the Congress.”
  • Rubio (again): “We just don’t think government will enforce the law anyway.”

As Slate’s David Weigel explains, the argument is pretty much bunk:

Say the Senate bill was passed in the House tomorrow, conferenced, and signed by the president. He’s got three years left in office. The legalization component of the Senate bill depends on a border security standard that’s going to be determined by a panel of state governors. They have five years to sign off. If you think about the timing of the Affordable Care Act — passed in 2010, implemented at the end of 2013 — there’s no real danger of Obama using a new immigration law to grant more amnesty. He could do that right now.

So, file these talking points under “Republicans Looking Busy.” [Slate]

But Boehner can’t spike immigration reform without first finding a scapegoat to blame for its failure. And since Senate Republicans are on board, who else is there to blame but the ultimate conservative bogeyman?

“The Rebranding Mirage”: The GOP Mirage Isn’t Radical Grassroots Power But Elite Control And “Pragmatism”

Anyone who reads a lot of political commentary is aware there’s a broad division in opinion about what’s going on in the Republican Party these days. One camp holds that all the radicalism and restlessness associated with the Tea Party Movement (and before that, the Christian Right) is ultimately insignificant because the GOP is an elite-driven, business-dominated enterprise that’s willing to let conservative activists and their rank-and-file foot soldiers have the keys for a joy-ride now and then, but is ultimately in charge and is ultimately pragmatic and “centrist” in its outlook. The other camp holds that the mirage isn’t radical grassroots power but elite control and “pragmatism.”

I’m firmly in the second camp. So is Salon‘s Brian Beutler, who has a long essay today disputing the President’s relatively benign view of the direction of the GOP, as expressed in that gazillion-word interview-based profile by David Remnick in the latest New Yorker.

The most interesting thing in Beutler’s argument is his discussion of how immediately after the 2012 elections GOP elites decided on comprehensive immigration reform as their “rebranding” vehicle:

Republican leaders settled on immigration reform as their one big overture precisely because they thought it would be the easiest gesture to make to the voters who rejected them without antagonizing the ones who didn’t. The GOP donor class hates taxing wealthy people to subsidize takers, but supports immigration reform uniquely among social issues for opportunistic reasons; and of all the Republican Party’s potential growth constituencies, working immigrants are the most sympathetic to conservative voters who oppose abortion and marriage equality out of religious principle.

So immigration reform is the greatest common factor — and it has been on a breathing machine for half a year and counting.

This should be kept carefully in mind when more difficult issue-position maneuvers–i.e., over entitlements, poverty programs, abortion, foreign policy, same-sex marriage, taxes–are put out there as potential image-changers for the GOP. If GOP elites, with the full backing of the business community and many conservative religious leaders in tow, can’t succeed in convincing “the base” and its ideological shock troops to pursue the ripe, low-hanging fruit of a bigger share of the Latino vote with immigration policies accepted by Ronald Reagan and George W. Bush, why does anyone imagine the tougher cases are going to go well? Beats me, beyond an intensely held belief in the power of elites and their determination to follow the median voter theory in a “move to the center” whenever an election is lost.

“GOP’s New Immigration Spin”: If We Can’t Pass Reform, It’s Obamacare’s Fault

If you’ll recall the recent legislative history of “comprehensive immigration reform,” this has been the cycle: Democrats and senior Republicans all agree that we should do it, some proposals are proposed, and then it dies, usually in the House, because conservatives are very opposed to comprehensive immigration reform. Some time passes, and then we all try again. There will be another doomed-to-fail attempt this year, according to Democrats and senior Republicans. As usual, Republicans have preemptively assigned blame for its failure to President Obama.

Before his 2012 reelection, Republicans frequently argued that Barack Obama wanted immigration reform to fail, so that he could make Republicans look bad to Hispanics and use that to win reelection. After his reelection, when Obama decided to make another push for reform, under the assumption that a chastened GOP would play along, it eventually became clear that no immigration bill that provided an opportunity for citizenship for currently undocumented residents could pass the House. The end, for Immigration Reform 2013. On to Immigration Reform 2014.

Here’s the latest: Speaker of the House John Boehner will “unveil a set of Republican principles for immigration reform before Obama’s Jan. 28 State of the Union address.” He and Majority Leader Eric Cantor told fellow Republicans that reform would be a priority this year. Barack Obama has been described by Senator Chuck Schumer as “cautiously optimistic” that the House would pass something this year. It’s all finally happening!

Or what is happening, at least, is that John Boehner has decided that Republicans once again need to appear open to the idea of creating a more humane immigration process.

This Politico piece basically explains Boehner’s strategy. His list of principles will include “beefed-up border security and interior enforcement,” and “earned legal status,” presumably instead of “citizenship,” for undocumented immigrants. Plus, it won’t be one big bill, because Republicans have spent the entire Obama administration decrying long bills, for their length.

The draft principles will also include a promise that immigration reform will be done on a step-by-step basis and will foreclose the possibility of entering into conference negotiations using the Senate’s comprehensive package — pledges that could soothe some Republicans.

Mm-hmm. Soothe some Republicans, and also allow those Republicans to vote for more border security without voting to legalize anyone. That’s always been the point of passing reform “step-by-step.” Not that anyone even actually expects this limited, piecemeal proposal to pass!

The secret talks are taking place even as leaders doubt that such efforts will be fruitful, in part because of opposition from conservatives who sank the prospects for reform last year. That dynamic hasn’t changed. But Republicans think stating their position is important and could help chart a path forward for reform in 2015 after the midterm elections.

And that’s the paragraph that should end all 2014 “could this be the year comprehensive immigration reform passes” pieces. (We finished early this year, everyone!) Republicans think “stating their position” — a position they will state by claiming it is their position, not by voting to make their ostensible position law — is important, for branding reasons, but the House is still full of conservatives, so there’s still no hope for reform.

That’s why this year, just like last year and the year before, immigration reform won’t happen: There aren’t enough votes for it in the House, because conservatives oppose it and Boehner won’t try to pass it with mostly Democratic votes.

There is an alternative explanation, though. One that, conveniently, makes the failure of immigration reform the fault of people other than the ones who explicitly don’t support it. This is the explanation Andrew Stiles takes for a test drive at the National Review. Maybe immigration won’t happen because … Obamacare!

A number of House Republicans, including Majority Leader Eric Cantor (R., Va.), have argued that the Obamacare fiasco is to blame for their reluctance to tackle immigration reform.

I see. Please, Marco Rubio, regretful former member of the Senate immigration “gang of eight,” explain:

Other Republicans, including Senator Marco Rubio (R., Fla.), one of the architects of the Senate bill, have suggested that President Obama cannot be trusted to properly implement a large-scale immigration reform, given the countless waivers and exemptions he has handed out with respect to Obamacare. Conservative skeptics have long argued that there would be little stopping the administration from fully implementing aspects of the new law it likes, such as legalization and citizenship for illegal immigrants, while completely ignoring the provisions it doesn’t like, such as increased border security and interior enforcement. As Rubio told conservative radio host Laura Ingraham yesterday, “even people that would like to do something on [immigration reform] are finding it hard to argue against that.”

This is not a terribly surprising message from Rubio, who began trashing comprehensive immigration reform about 10 minutes after the bill he helped craft passed the Senate with his support, but it is a fun new variation on the classic Senate “I can’t support this thing I support because of this unrelated thing” argument. It certainly is strange that conservatives opposed immigration reform before the botched Healthcare.gov website rollout, if that botched rollout is why they can’t pass reform, isn’t it?

“Obamacare” is a great excuse to avoid ever doing anything. How can we trust this administration to go to war against Iran if it can’t build a website? We should probably destroy our nuclear arsenal, before the Obungler bungles his way into armageddon. And don’t get me started on the NSA! I didn’t do my homework because I cannot trust this administration to grade it correctly.

“We can’t pass reform because we don’t trust the president” isn’t really a better or more convincing argument than the last one (“the president doesn’t want us to pass reform because he wants us to look bad”), and I don’t expect it to make the Republican Party look more compassionate or appealing to people who currently (correctly) think conservatives are excessively hostile to immigrants in general and Latinos specifically. But the point isn’t really to make an immediate play for the Latino vote in 2014. It’s sort of light legislative extortion: If you want reform to pass, you’d better elect a Republican president. It would almost be convincing — a pro-reform Republican president would be more likely to convince or force congressional Republicans to vote for reform than a hated Democratic president has been — if it weren’t for the fact that Congress already tried this under President George W. Bush, and it failed. Because conservatives control the GOP and most conservatives oppose granting undocumented immigrants legal status. It’s that simple.

As the ACLU notes, there is still one thing that could upend the entire immigration debate: the potential deportation of pop superstar Justin Bieber. We can only hope that mere possibility will finally spur Congress to act.

“Another Dog Whistle To GOP Base”: The Latest Lie In The Push For Voter ID Restrictions

To the Republican supporters of laws that would treat the poll booth like an exclusive nightclub that asks for photo ID and other qualifications before allowing entry, the answer to why anyone would oppose this is simple: They must not want to vote badly enough.

This was the logic for Wisconsin State Senator Glenn Grothman who last week on MSNBC said, “I really don’t think they care that much about voting in the first place, right?” in response to a question about how African-American voters might be impacted by voter ID and early voting cuts.

This is not anomalous thinking among Republicans. Similar comments have been made by Republican state legislators in Nevada, Pennsylvania, and Florida. In fact, they say these things so often publicly that you have to wonder if it’s some kind of dog-whistle to the more racially polarized portion of their voting base.

The idea that people of color don’t “care” about voting ignores how expensive it can be to meet the qualifications of voter ID laws to begin with. Those expenses are irrelevant only to those who can easily meet them. On Friday November 15th, a federal court trial over Wisconsin’s voter ID law concluded after two weeks of testimony from at least a dozen state residents illustrating how difficult it’s been to obtain the photo ID needed to vote. It also featured the testimony of state government officials who dismissed those residents’ burdens as easily surmountable.

The question of who’s right in that tug of war comes down to careful consideration of the racial and class contexts of the law. If you are a white male with a government job, you obviously are in tune enough with the law, and have the resources to meet it. But if you are not that … well consider the statistics:

  • 78 percent of African-American men in Wisconsin between the ages of 18 and 24 do not have a driver’s license
  • 66 percent of young African-American women in the same age range lack a driver’s license
  • 57 percent of young Latino men aged 18 to 24, and 63 percent of young Latinas lack driver’s licenses

During the Wisconsin trial, statistician Leland Beatty testified that more than 300,000 registered Wisconsin voters did not have a driver’s license or state ID card in 2012—16.2 percent of them African-American registered voters compared to just 9.5 percent of registered white voters. For Latinos, over 24 percent lacked a driver’s license or state ID card. Beatty analyzed the same data for 2013 and found the same racial disparate impact.

The burden suffered by people of color in Wisconsin under a voter ID law is not an academic exercise in statistics, though. Real Wisconsin residents testified about how hard it is to comply with the law—a law unnecessary given the state went hundreds of years without it and yet still managed to earn the top score in election performance by the Pew Research Center last year. Despite that, the expenses that come along with the voter ID law were laid bare during the November trial, which is the first litigation that has happened under the Voting Rights Act’s Section Two since the U.S. Supreme Court gutted the civil rights law this summer.

Lorene Hutchins, a 93-year-old, African-American woman born in Mississippi was able to retrieve her birth certificate from her home state only after her daughter Katherine Clark helped her through the arduous process. It cost them over $2,000 in expenses and legal fees to do so.

Ray Ciszewski, a volunteer for his church’s program that helps the homeless and those recently released from prison obtain birth certificates for jobs, and lately to vote, testified that it costs on average $20 for a Wisconsin birth certificate. Roughly 23 percent of the people he’s tried to help were unable to get their birth certificates for a number of reasons, he said during the trial.

Carmen Cabrera of the Latino non-profit Centro Hispano Milwaukee testified that many of their members encountered language barriers—in particular, a limited availability of Spanish-speaking DMV clerks—when they help them get state IDs. Not to mention, there’s limited access to the DMV offices around the state since most of them are open only on weekdays and close at 4:30 p.m. Anytime voters have to take time off from work or school to haggle with DMV operators, especially those who don’t speak their language, that is a cost voters have to bare.

Attorney General Kawski called these plaintiffs’ experiences “uncommon, bizarre and one-of-a-kind exceptions”—again, only bizarre to those who are privileged enough to not have to deal with the every day struggles of people of color and low income.

I encountered this same dynamic last year while covering the Pennsylvania court trial over its voter ID law, where poor people of color had to prove that they even existed, ID or not. Over two dozen witnesses, mostly black and Latino, provided account after account about how difficult it is for them to transact with the government over ID while state officials responded on the stand by placing those life stories in doubt. That case is still unresolved, pending a judge’s ruling

More stories about the costs and burdens of Wisconsin residents who lack ID are bound to surface. The Wisconsin state supreme court this week decided to hear two other challenges to the voter ID law filed by local NAACP and League of Women Voter chapters. Other Voter ID law challenges are waiting for their day in court in North Carolina and Texas—the latter of which is a protracted court battle that rivals only Wisconsin in terms of time elapsed without resolving the voter ID controversy. Texas’s law was stopped last year in federal court under a Voting Rights Act Section 5 challenge. When the Supreme Court invalidated Section Five’s coverage formula, Texas immediately reinstated the law, which ranks at the top of the nation with Wisconsin in terms of its voter restrictions. It is headed back to federal court, this time under Section 2 of the Voting Rights Act.

The stakes for all of these voter ID trials are not only who may or may not show up to vote in 2014 and 2016, but also whether government officials will finally recognize the true costs and burdens of being poor, black and brown in America as illustrated in these court testimonies. It’s not that they don’t care about voting; it’s that too many obstructions have been placed in their way.

“The Coming Electoral Consequences”: Speaker Boehner Keeps Motivating The Wrong Base

The widely held assumption is that a variety of popular measures can pass the Senate and earn President Obama’s signature, but won’t become law because of the Republican-led House. And in plenty of instances, that’s true.

But on a variety of important proposals, the problem isn’t the House majority party, but rather, the willingness of the House GOP leadership to let the chamber vote up or down on the bills in question. The obstacle, in other words, isn’t 218 “no” votes; it’s House Speaker John Boehner’s disinclination to let the House exercise its will.

I can appreciate why the Speaker would rather kill popular bills than pass them – he promised his right-wing members he’d honor the manufactured “Hastert Rule,” and Boehner’s afraid of being deposed – but as Brian Beutler noted yesterday, the posture may well carry electoral consequences.

Big Senate bills in and of themselves won’t shake House Republicans out of their paralysis. It’s unrealistic to expect the House will address all of these issues and it’s possible they won’t address any of them. But the constituent groups to whom these issues matter – Latinos, the LGBT community, women and African Americans – won’t be confused about who killed them.

The flip side of the GOP becoming a whites-only party and crossing its fingers that Healthcare.gov fails is that Boehner is doing his damnedest to help Democrats receive their 2008 and 2012 coalitions in the coming midterm.

Remember, one of the key Democratic hopes going into the 2014 midterms – now 364 days away – is that congressional Republicans will motivate the Democratic base to show up for a change in a midterm cycle. How’s that going so far?

Swimmingly. Democratic candidates and campaign committees now intend to go to Latino communities and say, “Like immigration reform? Then help vote out the Republicans who killed the bipartisan reform package.” Dems intend to go to LGBT communities and say, “Like ENDA? Then help vote out the Republicans who killed the bipartisan bill.” Dems intend to go to African-American communities and say, “Like voting rights? Then help vote out the Republicans who made it impossible to reform the Voting Rights Act.”

And Dems intend to go to everyone and say, “Like the government shutdown and series of self-imposed crises? If not, then help vote out the Republicans who cooked up these schemes.”

The Democratic coalition is stable, but not unbreakable. By refusing to govern, Boehner and House Republicans are strengthening that coalition, boosting Democratic fundraising, helping Democratic recruiting efforts, and motivating the Democratic base.
