“Florida Gov Scott No Help In Time Of Crisis”: When The Going Gets Tough, Rick Scott Heads Straight For The Airport

Florida Gov. Rick Scott removed his Harry Potter invisibility cloak and flew to Washington the other day.

There he begged for billions of federal dollars from a person he is suing, Sylvia Burwell, the secretary of the Health and Human Services Department. Burwell patiently listened to the governor and, predictably, sent him back to Florida with nothing.

Last summer the feds informed Scott that the government was phasing out a fund that reimburses local hospitals for taking care of low-income patients, basically replacing it with an expanded version of Medicaid.

At first Scott was in favor of the Medicaid move, even though it was a tangent of Obamacare. Then the governor changed his mind. Later, as an afterthought, he sued Burwell and the HHS.

The state Senate supports Medicaid expansion; the House doesn’t. Tallahassee has been paralyzed by the dispute.

In a snit, the House packed up and adjourned the session early, leaving Florida with no budget. Leaders in the Senate were furious.

Remember, these are all Republicans, ripping at each other like addled meerkats.

And where was the newly re-elected Republican governor, leader of the party?

Gone, is where he was — jetting to crucial functions such as the grand opening of a Wawa gas and convenience store in Fort Myers and the debut of a humongous Ferris wheel in Orlando.

It’s impossible to imagine any of the fully functioning governors in Florida’s past — Lawton Chiles, Bob Graham, Jeb Bush, to name a few — vanishing from Tallahassee during a Code Red meltdown of the Legislature.

But Scott isn’t a functioning governor. He is the emptiest of empty suits — no talent for leadership, no muscle for compromise, no sense whatsoever of the big picture.

When the going gets tough, Scott heads straight for the airport. This is what happens when you elect a guy with his own private jet.

Last week’s trip to Washington was pure theater. Scott’s lawsuit over the low-income health funds is a loser, and he knows it. He was trying to do something to give the impression he was awake and experiencing cognitive activity.

In fact, he has been laser-focused on the future — not Florida’s future, but his own. He’s looking ahead to a possible bid for the U.S. Senate in 2018.

(We’ll pause here while you choke on your cornflakes.)

It’s astounding but true — while the legislative process disintegrated in bitter confusion, the governor was airing TV commercials cheerily touting his imaginary accomplishments.

Yes, they were short commercials. And, yes, little of what he claimed to have done for Florida had actually happened, lawmakers having already tossed his proposed budget into the metaphorical Dumpster.

There were no tax cuts, no hefty increase in spending for public schools, no big boost for Everglades funding. Yet Scott’s commercials made it sound like a done deal.

Relax, Florida. All is well!

Perhaps that’s how it looks from 38,000 feet, though not from the rotunda of the Capitol.

It’s weird for a politician to openly resume campaigning so soon after being re-elected, but weird is the norm for the Scott administration. Since the law prohibits a third term as governor, he can only be thinking about Bill Nelson’s Senate seat.

This would be a far-fetched scenario almost any place except Florida, where Scott has already proven that, if you’re rich enough, there’s no such thing as baggage.

Currently he remains one of the state’s most unpopular political figures. He won the November election mainly because his opposition was Charlie Crist.

Yet with money from his “Let’s Get To Work” political committee, the governor has begun the uphill task of inventing a positive legacy upon which to run three years from now.

In the TV commercials, he plays the role of a hard-charging, hands-on visionary, leading Floridians to prosperity one new job at a time. He smiles. He talks. He is, briefly, visible.

Tallahassee is one of the cities where Scott showed his commercials, yet it didn’t move the needle. He was on the plane when he should have been on the ground.

While the Legislature didn’t need any help disgracing itself, Scott’s disappearing act made things worse by validating the public’s view of all state government as insular and incompetent.

As the House and Senate prepare to reconvene next month, desperately trying to salvage some credibility, the governor seems content with his role on the sidelines, essentially a cheerleader for himself.

“A Bold Truth-Teller”: What If A 2016 GOP Candidate Told The Truth About Obamacare?

If you’re a Republican presidential candidate, there aren’t too many ways you can distinguish yourself from your primary opponents on the issue of health care — I hate Obamacare, you hate Obamacare, we all hate Obamacare. But maybe there’s another way, for someone who has the courage to shift his rhetoric and present themselves as a bold truth-teller.

To put that in context, let’s look at some new developments on the Obamacare front.

A study just out from the Rand Corporation — not exactly a hotbed of socialist thinking — finds that after the coverage provisions in the Affordable Care Act took effect: “we estimate that 22.8 million people became newly insured and that 5.9 million lost coverage, for a net increase of 16.9 million with insurance as of February 2015.”

In addition, a new Gallup poll shows that 43 percent of Americans say they’re satisfied with the government’s work in health care, which doesn’t sound so great until you learn it’s the highest number this question has received since the organization began asking it in 2001.

We already know that all the predictions Republicans made about the ACA — a decline in health coverage, skyrocketing medical spending and premiums, massive job losses — failed to come true. One seemingly sensible response to the facts about Obamacare is to pretend they aren’t true, which is how prominent Republicans have handled things until now. After all, there hasn’t been much punishment for spreading falsehoods about the law, and the public is still woefully uninformed about it. For example, for every American who knows that the law has proven much less expensive than was originally estimated, there are eight who mistakenly believe it ended up being more expensive.

Nevertheless, the good news continues to pile up, and at least some of it may be penetrating to the public, albeit slowly (approval of the law has been ticking up of late). Which could create the opening for a Republican willing to say something different from his peers.

Let’s imagine a presidential candidate who said something like this to GOP primary voters:

“I know that just saying ‘Repeal Obamacare!’ is a good applause line. And believe me, I wish it had never passed. But we’ve had over 50 votes to repeal it in Congress, and it’s still here. Like it or not, it’s becoming entrenched. If we repealed it tomorrow, it would mean that millions of Americans would lose the coverage they’ve got. We can’t object to people losing their plans because of Obamacare, and then say it’s no big deal if a much larger number of Americans lose their coverage when we repeal the law. And Obamacare does a few things that we Republicans favor.

“So instead of just saying ‘Repeal it now!’, I’m going to give you a plan to keep the good things, ditch the bad things, and move toward a better health care system. We’ve spent the last five years banging our heads against the wall over this law, and some of my opponents think more banging is the answer. But I want to solve the problem.”

The Republican who said that would, of course, be branded a traitor by some. But he’d also get a wave of adoring press coverage, in which he’d be characterized as a straight-talking man of courage and the only one willing to have an adult conversation about health care.

The outcome of the King v. Burwell lawsuit could also help make his case. If the Supreme Court rules in Republicans’ favor, millions of Americans will lose their health coverage when subsidies are taken away, and efforts for a legislative fix are uncertain at best. The experience will make it clear even to many Republicans that “Burn it down!” isn’t always the wisest approach.

Yes, a Republican who turned his back on “repeal” to focus on “replace” would be taking a huge risk, since GOP primary voters are not necessarily going to be thoughtful and measured in their response to someone proposing something less than all-out war against Barack Obama and everything he ever touched. But it might just be crazy enough to work.

“Asking For A Bail Out Of His Self-Made Crisis”: Cut Taxes Or Expand Medicaid?; Florida Governor Rick Scott Is In Quite A Pickle

The Florida state government has been a hotbed of opposition to Obamacare, and has succeeded in resisting the law’s Medicaid expansion, in large part because of the state’s Low Income Pool: a multi-billion dollar, 10-year-old pilot program through which, right now, the federal government subsidizes health care providers who treat the poor.

Also right now, in Florida, Governor Rick Scott wants to enact hundreds of millions of dollars in annual tax cuts.

The budget room for those tax cuts, in other words, exists because the federal government is spending money—money that comes with no guarantee—in a way that bolsters Florida’s resistance to Obamacare.

Not keen on financing opposition to itself, the Obama administration is leaning toward ending this sweet arrangement, and phasing out the Low Income Pool, which has in any case grown obsolete in a world where Florida can adopt the Medicaid expansion and provide insurance to nearly a million of its poor citizens.

All of which is to say that if Scott and Florida Republicans want their tax cuts, they will have to use expanded Medicaid to fill the budget hole where the Low Income Pool used to be. But rather than push against that open door, Scott announced Thursday that he will sue the federal government. Specifically, he’s arguing that by rescinding the Low Income Pool, the Obama administration is coercing Florida into participating in Obamacare, so the Low Income Pool must continue. Put another way, he’s asking the courts to force the feds to bail out his tax cut.

This is all playing out against the backdrop of King v. Burwell, in which conservatives have asked the Supreme Court to rescind billions of dollars in Affordable Care Act subsidies in their own states—money they claim is contingent upon them establishing their own exchanges. Like most Republican governors, Rick Scott didn’t establish an exchange, but for some reason he isn’t sounding the coercion alarm over King.

Scott’s argument is transparently frivolous, but it underscores the extent to which the GOP’s deranged resistance to Obamacare is boomeranging on itself. As Greg Sargent notes at the Washington Post, “Scott’s lawsuit is designed to get the administration to fork over federal money for health care—but only if it isn’t part of Obamacare.” Without that money, Scott probably won’t get his tax cuts. Which means that in Florida, the GOP’s commitment to tax cuts is running up against its Massive Resistance to Obamacare. And the tax cuts might lose.

This adamant opposition to the Medicaid expansion is a relatively recent development. Scott claims his opposition stems from the administration’s coolness to the Low Income Pool. If the federal government can just end that program, how can Floridians trust them to commit to their end of the Medicaid expansion? But that doesn’t wash. The Low Income Pool was scheduled to expire, whereas the federal government is obligated by law to fund 90 percent of the Medicaid expansion in perpetuity.

Florida’s Senate president—a Republican—thinks Scott is being ridiculous. He released a statement that refutes Scott’s objection to the Medicaid expansion and undermines the lawsuit:

The federal government has no obligation to provide LIP funding, or to work within our timeframe. While we respect Governor Scott’s authority to protect the state’s interests in the way he sees fit, we have a constitutional responsibility to pass a balanced budget by a specific deadline. From where I sit, it is difficult to understand how suing [the federal government] on day 45 of a 60 day session regarding an issue the state has been aware of for the last 12 months will yield a timely resolution to the critical health care challenges facing our state. The Senate budget anticipated the potential reduction or elimination of LIP funding and included solutions to provide Floridians access to health care services and coverage. We remain hopeful CMS will approve the Senate proposal.

A likelier explanation for Scott’s change of heart is a combination of anti-Medicaid spending by the Koch-backed advocacy group Americans for Prosperity, and entrenched Obamacare opposition in the Florida House. Sensing that the Medicaid expansion might be in danger, Scott flipped, rather than be caught on the losing side of it.

But Scott could have solved this problem a long time ago if he’d ever fought for Medicaid expansion earnestly, and could solve it now by teaming up with the Senate to stare down the House.

Instead Scott is suing the federal government to bail him out of a self-made crisis. This isn’t an anomaly, but a pattern. Across the country, Republican governors are coping with the consequences of their own Obamacare intransigence—staring into a future where their insurance markets get destroyed by virtue of their refusal to help implement Obamacare and their unwillingness to take on the right as it pursued litigation.

It was inevitable that as Obamacare became more entrenched, Republicans would see their opposition to the law come into tension with their other core interests. This is exactly what’s happened, and to some extent it has exposed weaknesses in the resistance strategy. But that resistance—to the idea of providing health insurance to the poor—remains very strong. Stronger, perhaps, than the allure of tax cuts.

“It’s Better To Let Your Constituents Lose Their Coverage”: Paul Ryan To States; Help Us Sabotage Health Care

On the fifth anniversary of the Affordable Care Act becoming law, there’s value in reflecting on the systemic advances, which we did earlier. But it’s also a good time to look ahead and consider where the policy fight is headed.

Congressional Republicans, for example, who’ve already voted literally several dozen times to repeal the law, released budget plans last week that would – you guessed it – uproot the American health care system, replacing it with an alternative that Republicans can neither explain nor identify.

As if that weren’t quite enough, the GOP budget plans would likely double the uninsured rate, while eliminating $1 trillion in tax revenue that pays for the ACA. Because the Republican budget blueprint relies on bizarre gimmicks and fraudulent arithmetic, the plan offers no explanation for how it would cover the $1 trillion loss and no details about how Congress would help the millions of families that would lose access to affordable medical care after Republicans take their benefits away.

The GOP budget also makes no effort to address the possibility that Republican justices on the Supreme Court may soon scrap subsidies to consumers in two-thirds of the country in the ridiculous King v. Burwell case. House Ways & Means Committee Chairman Paul Ryan (R-Wis.), however, is on the case – he doesn’t have a policy solution, but Ryan has a plan to persuade state policymakers to help congressional Republicans’ broader game plan.

Rep. Paul Ryan urged state lawmakers to resist setting up state insurance exchanges if the Supreme Court rules that key parts of the Affordable Care Act can only continue if they do so.

“Oh God, no… The last thing anybody in my opinion would want to do, even if you are not a conservative, is consign your state to this law,” the Wisconsin Republican told state legislators Thursday during a conference call organized by the Foundation for Government Accountability, a conservative think-tank.

Ryan reportedly went on to say, “If people blink and if people say, ‘This political pressure is too great, I’m just going to sign up for a state-based exchange and put my constituents in Obamacare,’ then this opportunity will slip through your fingers.”

The right-wing Wisconsinite is known for some pretty extreme postures, but this is a brazen move, even for Paul Ryan.

If the Republican justices gut the Affordable Care Act, it’s likely Americans would see a bifurcated system: consumers in states run by Democrats would continue to receive subsidies to afford quality medical coverage, while millions of consumers in Republican-run states would go without. Or put another way, if your state created its own exchange marketplace, very little will change. If your state has referred consumers to healthcare.gov to enroll, you and your neighbors may be in big trouble.

If the high court’s ruling sides with the right, it’s quite likely that some Republican-led states would scramble to create their own exchange in order to help their citizens. Indeed, leading GOP officials in states like Michigan and Ohio have already indicated an intention to do exactly that in order to prevent their constituents from suffering.

That’s what Paul Ryan is responding to – he’s effectively telling these state officials, “No, wait, it’s better to let your constituents lose their coverage. Helping families keep their coverage is what the White House wants, so don’t do it.”

And what about the “opportunity” Ryan mentioned on Friday? As the congressman sees it, if the Supreme Court sides with Republicans, and if states agree to let their citizens go without, then they’ll be able to take advantage of the new GOP alternative to the Affordable Care Act. What’s in it? Paul Ryan doesn’t know. What will it cost? Paul Ryan doesn’t know. How many people will it cover? Paul Ryan doesn’t know. When can we see it? Paul Ryan doesn’t know.

Why in the world would state officials listen to such ridiculous advice, putting their own constituents in jeopardy? Paul Ryan doesn’t know – and neither does anyone else.

“Forget About Repealing Obamacare”: Too Many “Message” Votes Have Put The GOP In A Bind

If at first you don’t succeed, try, try again? That certainly seems to be the motto of House Republicans. Last week, the House GOP took its 56th vote to repeal the Affordable Care Act, President Barack Obama’s signature health care reform law.

The bill’s prospects for consideration in the Senate are low and the president has repeatedly promised to veto such a measure anyway. After 56 tries, the House votes to repeal the health care law have become so commonplace that hardly anyone in Washington even blinks an eye at them anymore. Even the president says he’s lost count of how many repeal votes there have been. If House Republicans are serious in their quest to roll back the Affordable Care Act, why do they keep pursuing a strategy they know is doomed to fail?

They do it because these multiple repeal votes aren’t a serious attempt to void the health care law. They are merely symbolic message votes. Voting to repeal the Affordable Care Act was a popular campaign message for candidates on the right, and the recent House vote gave them a chance to fulfill their election year promises.

The repeal votes also give the Republican party a platform to continue talking about their opposition to the health law and to highlight its differences with the president. However, too many “message” votes may have also put the party in a bind. After 56 votes on essentially the same piece of legislation, the Republican party has faced criticism, according to The Hill, for failing to articulate an alternative plan. The repeated symbolic votes also expose the party to criticism for failing to lead in a critical policy area. The time spent in fruitless endeavors to repeal the law could have instead been used to negotiate on policies to fix the Affordable Care Act’s weaknesses. When it comes to health care policy, Republicans have simply become the party of no.

It’s time to switch tactics. Following the House votes last week, Sen. Orrin Hatch, R-Utah, Sen. Richard Burr, R-N.C., and Rep. Fred Upton, R-Mich., released a proposal for an alternative health care plan. The proposal is a good first step and perhaps necessary as, for the first time, three House Republicans voted against repeal of the Affordable Care Act in protest of their party’s apparent lack of a plan to replace it.

In addition to putting an actual health care plan on the table, Republicans may also want to consider trying to make changes to the current health care law in pieces. There could be opportunity for negotiation on aspects of the law that remain unpopular, such as the medical device tax, the Medicare Independent Payment Advisory Board and the definition of a full-time work week. Further, the Supreme Court ruling on the King v. Burwell case later this year regarding the legality of the subsidies being provided for the purchase of health insurance on the federal exchanges could provide Republicans with another opportunity to change the law. If the Supreme Court rules against the subsidies, a legislative fix may be necessary. By taking advantage of these opportunities, the party might be able to make the law more palatable for its constituency and improve its credibility in the process.

House Republicans have made their disdain for the Affordable Care Act very clear. A 57th vote to repeal the law will not be necessary, especially since it, too, would be doomed to fail as long as Obama is in office. However, it’s entirely possible we’ll see one. By focusing strictly on repeal of the entire law, Republicans risk giving the impression that they are completely unwilling to engage in meaningful debate on health care policy. The party should instead work to improve the law and continue putting forward ideas to do so.

A great example of this can be found at the state level. Following the Supreme Court’s decision that the Affordable Care Act’s Medicaid expansion was optional, several Republican governors have proposed alternative Medicaid plans to the administration. Some have already been successful in putting their imprint on the president’s initial policy because they came to the table in a serious manner. Republicans at the federal level would do well to follow suit.
